This is a frightening time for our country.
And in just two hundred and thirty-seven short days, you, the American people, are going to decide whether or not we're going to allow Biden and company to continue to destroy every institutional norm that we've ever had in this country.
Or are we going to return to sound economic policies, energy policies, border policies, foreign policy issues.
Are we just going to keep declining?
Because that's the we we are a nation now in decline.
And much of this is self-inflicted.
I I think four more years of this beyond this term, I don't know how America ever comes back.
Uh we have been watching all day, Robert Herr testifying on Capitol Hill, and and this ought to make everybody's blood boil.
Let me start by playing Robert Herr.
And listen to what it, and this is so reminiscent.
It just reminds me of July of 2016.
James Comey spells out all the top secret classified documents that they found on Hillary Clinton's servers.
And I'm like, wow, I remember my what I was thinking that day.
He's going to do it.
He's actually going to enforce the law, and he's he's he's they're gonna prosecute her.
Then he ends with, but no reasonable prosecutor would prosecute.
In this case with her, it's it's well, yeah, he willfully retain classified materials as a private citizen.
Uh it didn't rise to the level of proof beyond a reasonable doubt because, well, we we had to factor in the fact that Joe is very old with a very bad memory, and would would come across to a jury likely as an appealing figure.
But uh so we won't apply the laws uh as as vigorously as we did Donald Trump.
Because Donald Trump is not likable, and Donald Trump uh is uh I I guess somebody we can get a conviction on, so we'll go for him instead.
That's not equal application of our laws in America.
That is not equal justice under the law in America.
Now, let's get to the heart of the issue here.
Robert Herr saying in no uncertain terms that Biden willfully retain classified materials as a private citizen.
And then he goes into the excuse making.
Well, the evidence didn't rise to the level of proof beyond a reasonable doubt.
Now, this should infuriate people.
And he also made comparisons in his report to the Trump case.
And his big argument was, well, Joe was more cooperative in the case of him versus Trump.
That's not true, would he say?
Because if you recall, I do the weeks before, long time before the FBI ever rated Marilago, again a choice by the Biden TOJ, uh the top opponent, a likely opponent of Joe Biden.
Uh before that, you might recall that the FBI was at Marilago.
And they were in the room where they had access to and saw classified documents.
Now, did the FBI take them that day?
No.
Were they stopped from taking them that day?
No.
What did they do?
They said thank you, walked out.
A couple of days later, they called in and said, Would you mind putting another lock?
I know you have one lock on the door.
Would you put a padlock on that door as well?
No problem.
Now, they could have gone back and they could have said, Do you mind if we we pick up the documents in the closet?
Because among them we saw top secret classified documents.
Now, that was what the in the four or five locations that Biden has his top secret classified documents, some going back to when he was vice president, and he did not have the power to declassify with the Presidential Records Act as applicable as it may or may not be.
That has yet to be determined by a court.
But he didn't have any of that backing him up, nor did Hillary Clinton, what makes what they did far more egregious than Donald Trump.
But listen to Robert Her.
The key words, Biden willfully retain classified materials as a private citizen.
Listen.
We identified evidence that the president willfully retained classified materials after the end of his vice presidency when he was a private citizen.
This evidence there.
Stop right there.
He's guilty of that which they were investigating.
Really?
He's guilty?
Then he starts making excuses as to why he didn't charge him.
That sounds just like James Comey, July 2016.
Listen, it's included an audio recorded conversation during which during which Mr. Biden told his ghostwriter that he had, quote, just found all the classified stuff downstairs.
End quote.
When Mr. Biden said this, he was a private citizen speaking to his ghostwriter in his private rental home in Virginia.
We also identify.
Stop right there.
You do you understand?
Oh, we just found classified materials in my basement, and and we could use that for the book.
And this goes to an exchange we'll play later today at some point of Jim Jordan.
He's on TV tonight.
Jim Jordan saying, Did we we know the reason?
We know what Joe was motivated by.
He had eight million reasons, because he got eight million dollars in an advance for his book that I don't think anybody ever bought or read.
Now comes the excuses.
Listen.
Other recorded conversations during which Mr. Biden read classified information aloud to his ghostwriter.
We did not, however, identify evidence that rose to the level of proof beyond a reasonable doubt.
Stop right there.
Stop right there.
So he willfully retained classified materials as a private citizen.
We have audio of him talking with his ghostwriter about oh, we we just found classified documents.
We could use it for the book, and then he read the classified materials.
They would those classified materials, he was vice president.
He didn't have the power to declassify them the way Donald Trump did.
And by the way, there's no stated process on how that would happen.
And then says he read it out loud to a stranger.
Top secret, classified information.
Imagine if Trump did it.
Now comes the excuse.
Short of that standard, I decline to recommend criminal charges against Mr. Biden.
That's not how Donald Trump was treated.
And that gets to everything you need to know about today.
But there is plenty more.
A lot of nuance, a lot of a lot of of detail that we got to get into.
Then Robert Hurr said, Well I had to consider Biden's memory and mental state and how a jury would perceive his memory in a criminal trial.
So let's punish Donald Trump because Donald Trump doesn't mumble bumble fumble, uh, can't remember what day of the week it is, and trip and fall every five seconds.
So we're going to give the old guy that's the president.
Now, what he's really saying here, I want you to listen to this because this is important.
He's really saying, but he couldn't say it because if he did say it, that would be a legal term.
He's saying and describing somebody that would be incompetent to stand trial.
But he, you know, well, he wouldn't understand the charges.
Listen.
There has been a lot of attention paid to language in the report about the president's memory, so let me say a few words about that.
My task was to determine whether the president retained or disclosed national defense information willfully.
That means knowingly and with the intent to do something the law forbids.
I could not make that determination without assessing the president's state of mind.
Stop right there.
For that reason, I had to consider the president.
Stop right there.
He just said that, oh, he told his ghostwriter, oh, we found classified materials, and then started reading it out loud.
That would be willful and that would be a slight contradiction as to what he's The president's memory and overall mental state and how a jury likely would perceive his memory and mental state in a criminal trial.
These are the types of issues that prosecutors analyze every day.
And because these issues were important to my ultimate decision, I had to include a discussion of them in my report to the attorney general.
So if Donald Trump just came across as a nice old man with both a mental capacity that has greatly diminished and didn't remember the years he was vice president or the years within years when his son died, If he didn't remember that, well, then that means he wouldn't have been charged.
So you're only going to charge the guy that had what punish him because he has a good memory and you don't like him, or Democrats don't like him?
Because that's what they're saying.
That's weaponizing our legal system.
That is politicizing our legal system.
Now, listen to what he said, and he said that the evidence, and Biden himself put his memory squarely at issue.
And he said it was necessary and accurate and fair.
So only people with good memories like Donald Trump will be arrested and raided and charged.
But people that are incompetent to stand trial, like Joe Biden, well, uh we're never going to get a conviction because people know we'll figure out he doesn't know what day of the week it is.
Listen to this.
The evidence and the president himself put his memory squarely at issue.
We interviewed the president and asked him about his recorded statement.
Quote, I just found all the classified stuff downstairs, end quote.
He told us that he didn't remember saying that to his ghostwriter.
He also said he didn't remember finding any classified material in his home after his vice presidency.
And he didn't remember anything about how classified documents about Afghanistan made their way into his garage.
My assessment in the report about the relevance of the president's memory was necessary and accurate and fair.
Most importantly, what I wrote is what I believe the evidence shows.
And what I expect jurors would perceive and believe.
Nor did I disparage the president unfairly.
I explained to the attorney general my decision and the reasons for it.
That's what I was required to do.
How convenient that Joe didn't remember the audio, which by the way, once this guy was appointed, the ghostwriter tried to erase all of this.
Apparently, a lot of it was recovered.
But the ghostwriters say, you know, he says, well, he didn't remember saying that to the ghostwriter.
Uh, Mr. Herr, is that a convenient excuse he didn't remember that?
Really?
Is that what you're gonna tell us?
This this is devastating.
Now, listen to this exchange with Congressman Kelly Armstrong.
And this describes all of the places Biden had classified documents dating back to when he was a senator.

Mr. Herr, classified documents were found at the Penn Biden Center?
That's correct.
They were found in President Biden's garage?
In Wilmington, Delaware, yes.
And in his basement den?
Also in the same home, yes.
And the major and his main floor office?
Correct.
And his third floor den?
Correct.
At the University of Delaware?
Correct.
And at the Biden Institute.
Correct.
That's a lot of places to have a lot of classified documents laying around and even, oh, we just found some.
Let me read it aloud to the guy.
Now, one of the more humorous things, and we'll get into this.
Democrats went bat Adam Schiff crazy today, starting with liberal Joe over at MSDNC.
Uh, maybe the most entertaining part of the testimony was watching them go nuts and and just losing it.
Corey Bush couldn't resist calling Trump though, the white supremacist in chief.
No, that actually, the guy that was friends with and and had a mentor that was a former Klansman, that would be Joe.
The guy that tried to stop school busing and integration of public schools and partnered with the former Klansman.
No, that would be Joe too.
Uh the guy that said he didn't want public schools becoming racial jungles.
Was it Donald Trump?
No, it was Joe Biden.
Uh really?
But that's the way they're going.
I mean, it's pretty spectacular.
And then it was very clever of Jim Jordan to start this whole thing out by playing a clip of Peter Deucey when he was challenged when they first leaked parts of the report that, yeah, his memory was really bad, which is why we're not charging him.
Uh and and the president fought back with vigor.
It was almost like we got jacked up Joe, though the early version of it.
I'll tell you days like today, as a host, it gets a little frustrating because I've got so much to impart to you, and so much happened today, and we're gonna get some analysis.
Rand Paul and Pam Bondy and Brett Tolman will come in, we'll get your calls in as well.
I know a lot of other issues we got to hit today.
You know, Her was very clear though.
He didn't exonerate Biden over his mishandling of classified documents, which makes the decision all the more absolutely just it's inexplicable.
How could you basically be saying, well, we think he's too old and we think he's you know too incompetent to stand trial, but not say it because you don't want to ruin his presidential chances.
As mad as Democrats were, and they were absolutely nuts today.
They went insane.
That shouldn't have factored in.
And if we're going to treat Donald Trump one way, you gotta treat the other guy the same way.
But this is Biden's Justice Department that's allowing this.
You know, her, when asked if Biden was outright innocent, says that conclusion is not reflected in my report.
And of course, he was clashing with Democrats left, right, and sideways.
They went crazy.
We'll get into that.
He didn't identify evidence that pride and money motivated Biden.
I'm sorry, that he did uh he did identify evidence that pride and money motivated Biden to retain classified documents as evidenced by him saying, Oh, I just found some more documents downstairs, top secret documents I can share with you, my ghostwriter.
Who's the ghostwriter?
I mean, it's unbelievable.

I mean, Democrats went nuts today.
They went absolutely insane today.
Uh, you know, attacking Robert Herr, attacking Donald Trump, doing everything they could.
You know, Corey Bush couldn't resist calling a white supremacist in chief.

You know, he once questioned a Navy Admiral about the possibility that the island of Guam might capsize that guy.

You know, and then he quizzed her about whether he was a member of the Federalist Society or whether he was a registered Republican or whether or not that he was hoping to get something uh from Donald Trump if he becomes president, like an appointment as a federal judge.
You just can't make it up.
It all started out uh if it all started out with liberal Joe over at MSDNC, just losing his mind.
And you know, literally, he just went crazy this morning.

I wonder what uh pastor he will walk off into.
I don't know.
Just kind of wander off and say, well, you know, and Joe Biden, I noticed he didn't really tie his tie well.
The ty not Suggested that maybe he has arthritis in his left thumb.
Where are you going with that?
I'm just saying this guy says such random sh about his oh stop.
He's a kindly old man who could not remember his son's booth.
Like he wandered off into a pastor here.
And you know, maybe Arnold the Pig led him there.
I don't know.
No, you should apologize for her because I don't know exactly.
Like, does he hope he gets a judge?
I think he does.
I think he hopes he gets a judge up if Donald Trump gets elected again.
He's trying to because he humiliated himself.
Okay, so that's exactly and by the way, he's just stating the obvious that which we already knew that is a cognitive mess.
You know, her the transcript confer uh confirms all of that we knew about Biden's memory lapses.
I mean, he confirmed all of this, you know, and he couldn't remember details about when his when his own son died, couldn't remember the years he was vice president, and it was included in the report because that ultimately is what saved him from getting indicted.
And then he pointed out again, he concluded that Biden willfully retained classified materials.
Then he talks about the phone call.
Hey, we just found more classified materials in my basement.
Let me read them to you to the guy.
And that's where Jim Jordan stepped in, and Jim Jordan was on his A game as usual.
And you need to know they didn't they they hit the committee with this 350 page transcript just you know, moments before uh they actually had the hearing, so they couldn't actually get into it and read every part of it, which was another dirty trick by all of them.
And anyway, so Jim Jordan opened the hearings by by playing a clip of Peter Deucey challenging Biden on his memory, and Biden says he's fine.
Well, why does that because that's the one out?
And then Jim Jordan told her Biden's motivation for mishandling all of this.
It was clear in the conversation with the ghostwriter.
There were eight million reasons why.
And her then agreed with Jordan's assessment that Biden broke rules because of pride and money.
And then Gordon got uh Jordan got him to testify that the ghostwriter destroyed evidence after he was named special uh counsel.
Well, that sounds a lot like deleted emails, 33,000 that Hillary got away with, you know, bleach bit, hammers, devices, sim cards removed.
Matt Gates was particularly strong today, pointing out that you know, Robert Herr agreed that Biden lied when he said he didn't share classified information with the ghostwriter and that documents were kept in locked filing cabinets.
He's saying that he lied.
That's called perjury.
But of course he's a Democrat.
Then he told Mac Gates that he's you know using the senile cooperator theory as his reason to not charge Biden, and then Gates called out her for not charging Biden's ghostwriter for obstruction or deleting audio recordings.
Apparently a lot that was that was recovered.
And Tom McClintock told her that his toxic decision not to charge Biden is an unprecedented assault on our democracy.
All of these guys were right in every capacity.
They all were.
And then the rest of the Democrats went insane also, and they did go insane.
But once you willfully once he testified willfully that Biden willfully retained classified documents and that he just found some in the basement and read them to the ghostwriter.
That's game set and match.
And he's telling the ghostwriter what's on classified materials.
Uh, and he doesn't have the same position that Donald Trump had.
Trump had the ability to declassify.
Then whatever impact the court decides the presidential records act may or may not have, but but Trump had authority.
Now you might say, well, did he go through the proper process?
Well, that's a problem for the government because they don't have a process for declassification.
And and this then gets to the heart of a double standard, a dual justice system, unequal application of our laws, unequal justice under the law, and this is why the weaponization committee and their work is so vital and so important.
You know, Republican reads Robert Herr, the riot act over this decision.
That was McClintock.
He was great today.
One thing that Jonathan Turley rightly pointed out is her confirmed that Biden documents mark classified from when he was a senator.
And he points out some of those documents reportedly came from a secure skiff.
What does that mean?
That means that a very cognizant Joe Biden, that would likely require himself to remove them.
Because that's not an area that his staff would have access to.
It's insane.
All right, I'm going to get into this.
We have a lot more.

And we have primaries going on around the country.
One issue.
Now the White House is now trying to say, even though Joe Biden said that he regretted using the term in this interview on MSDNC over the weekend, the term illegal.
But he didn't apologize to Lake and Riley's family for butchering her name and calling her Lincoln Riley, even though, and this is during his jacked up Joe speed reading, you know, State of the Union address.
God only knows.
And you know, the funniest part about that is the real Joe Biden returned this weekend.
Whatever Red Bull caffeine or whatever it is that Joe took to get that speedy.
He didn't even allow the speaker to introduce him to the joint session of Congress for crying out loud.
Getting rid of that tradition.
It's unbelievable.
FBI director Ray, you paying attention?
He's been saying what I'm saying.
He's warning about the very dangerous threats at the border and smugglers with network ties to ISIS.
What have I been saying?
I pray to God I'm wrong, but I don't think I am.
I don't believe all these people from China, Russia, Iran, Syria, Egypt, and Afghanistan are coming here all the way to our southern border because they want a better life for themselves and their kids.
I'm not buying that for a minute.
I mean, this is pretty disgusting.
Biden apologizes.
Now they say, well, he didn't really apologize.
I know, and the borders secure and the borders closed.
I got it.
Now we have very dangerous threats.
It's not a matter of if, it's when.
There are terror cells in this country.
I would bet everything I have.
And I pray to God I'm wrong.
I hope one day, the last day I'm ever on the air, years have passed.
Tanner, you told us that this was going to happen, and I turn out to be wrong.
I'm not going to be proven wrong, unfortunately.
I wish I was.
But that's not going to happen.
This is not a good day for Joe Biden.
Democrats knew it, but it's the only out that her could actually give them that Joe Biden literally is not fit for trial.
Think about this.
He's incompetent to stand trial.
Because that's ostensibly what he was saying without saying it, because if he said it, it would have legal ramifications for saying it.
But they're apologizing to the illegal suspected murderer of Lake and Riley.
This this these are unprecedented times we're living in.
It really is.
Unprecedented.
Biden asks his staff, Am I am I allowed to take questions again?
And the press is kicked out immediately thereafter.
I'm not allowed.
They told me no, and I probably that means they're going to take away my ice cream cone tonight, and I can't have that.
Am I allowed?
You're the president, Joe.
In case you didn't remember, it's unbelievable.
It was one report today that a top Biden White House officials says they were bullied, verbally, and sexually harassed colleagues over more than a decade.
But apparently this person's considered untouchable because the first lady, Jill Biden, regards him as her work husband, some guy whose status as the first lady's top aide grants him enormous clout with both the White House operations and democratic politics.
Yeah.
Wow.
And they give specific examples.
You know, apparently two sources say the guy shared with them a theory that the size of a person's thumb corresponds to that of their genitalia, making the hypothesis both that the White House had in prior roles during Biden's campaign and vice presidency under Obama.
It is to make people uncomfortable and have power over them.
Well, if that was a Republican, boy, there'd be a reaction to that.
Not good news on the economy today.
Biden is lying about Trump adding more to the national debt than he has.
In fact, the CBO has pointed out Joe Biden added 33% more to the national debt than Biden than Donald Trump did during his first four years in office, including this year's projected deficit.
National debt grew by 5.56 trillion under Donald Trump.
Remember COVID.
And which was the year Democrats closed the economy, sent tax revenues over the cliff.
In 2020, the first year of COVID, the deficit was 3.13 trillion.
Okay.
Actually, a rationale of wherefore and a why.
Under Biden, the national debt has shot up a whopping $7.6 trillion.
That's in three years versus Trump's $5.56.
And what does Biden do?
He released a $7.3 trillion budget, including $850 billion for defense.
Do you realize now that the payment of interest on the debt is now going to cost more than we're paying for national defense?
A story out of The Guardian today, American dream of owning a home is dead, according to a majority of renters.
I was a renter once in my life.
One of the happiest days of my life.
Outs in Atlanta.
I got to buy my first house.
I think I paid $114 or $15,000.
I was the happiest guy in the world.
Oh, and by the way, guess what?
Gas prices are adding to the higher inflation numbers that we got today.
They're surging again.
Whoopsie Daisy, I guess Venezuela needs a call.
Consumer prices up 0.4% in February and up 3.2% from a year ago.
Uh oh, what is the CPI number mean?
Yeah, that's the biggest indicator of inflation.
A broad measure of goods and services and what they cost.
Up a whopping 3.2% from a year ago and a year ago.
It wasn't great.
Monthly gain in line with expectations, but the annual rate ahead of what they were forecasting.
Whoopsie Daisy.
I thought the Bidenomics was working.
I thought this was all about shrinkflation.
Biden's budget is unmitigated total BS, $7.3 trillion.
And then he brags about lowering the deficit by $3 trillion over the next decade.
Wrong.
These guys, I'm telling you right now, we're never going to get out of this debt.
It's a total facade what Joe Biden says about this.
You know, massive green spending.
$23 billion in climate adaption and resilience across, you know, all federal agencies.
I mean, and that's getting worse by the day.
A scheme for price controls magically cap out a pocket drug cost to $2,000.
Then, of course, he wants to give new time home buyers and home sellers, you know, a massive $400 a month.
I told you about that yesterday.
A move to kill origination fees on federal student loans that they've been forgiving left and right.
You know, the Supreme Court decision be damned.
These new government contracting rules put parents and caregivers and seniors out of work.
U.S. national debt tracker for March 11, 2024.
Yeah, it's climbing.
We're nearly at 35 trillion.
God help us.
This is not going to end well.
That I can tell you.
By the way, Jim Jordan has threatened the FBI chief.
He's going to be on TV tonight with contempt over Hunter Biden's laptop.
Well, they should.
Arizona's Democratic governor vetoed a bill that would allow police to arrest Biden's illegals.
Wow.
How stupid.
New York's annual spending on Biden's illegal immigrants, $141,000 per migrant household.
A Biden illegal has been charged with manslaughter and a high speed crash and the death of a 12-year-old boy.
I'm sure they'll be giggling about that over at MSDNC.
