What I told people I was making a podcast about Benghazi, nine times out of ten, they called me a masochist, rolled their eyes, or just asked, why?
Benghazi, the truth became a web of lies.
From Prologue Projects and Pushkin Industries, this is Fiasco, Benghazi.
What difference at this point does it make?
Listen to Fiasco, Benghazi, on the iHeartRadio app, Apple Podcasts, or wherever you get your podcasts.
Hey, welcome back to Hannity the Seculos, Jordan Jay and Logan summing in for our friend Sean Hannity.
We've got a really special guest here, someone that we've had an over 25-year relationship with, and that is our good friend John Schneider, who Logan is the star of the co-executive producer Logan Seculo and John Hannity.
I am not the star.
You're not going to know what John Schneider.
John Schneider is, who's joining us right now.
The movie is available right now.
It's a great, big, fun family movie with a lot of heart, a lot of humor.
It's not just obviously for kids, not a kids' movie, but a movie that can be enjoyed by everybody.
Hey, look, if you just like that song by John Rich that brought us in, Big and Rich, John actually gave us a song also for the movie called Santa Claus is a Dirty Job, and it's in there.
So we connect all of the world here, but we're joined by John Schneider, who is coming to you.
And John, we're thankful for you to not only be a part of this movie, but to come on today.
Hey, well, you know, you're selling yourself short because you really rocked that first scene.
You were just in the jail cell.
It looked like you were almost as comfortable as Hunter Biden's going to be in a jail cell.
Exactly.
Yes.
I look like a natural born prisoner.
I suspect Hunter Biden will not be in a jail cell.
I'm not just giving my legal prediction on that going on.
One can hope.
But if you go right now, John, you're right.
People haven't seen, because I think they're so distracted by, you know, everything that's happening.
Because Sean opens the movie.
It's the first thing you see.
Then Ben is there.
And then you come in.
I'm in there in the back corner.
You can see me.
Yeah, I throw a guy against the wall like a lot of movie away.
That's the first season.
It's not giving the movie away.
The movie's not available.
It's now available right now.
You can watch it at any time.
And a lot of you have watched it as we have been talking about it.
At least you've been making your purchases because we've been following along.
And John, it's exciting because not only is the movie available to stream, but also you have the DVDs available.
We decided to circumvent all of Hollywood and do this all as independent as we can.
That's how we have to do it.
You know, Hollywood would never make a movie like this because it thumbs its nose at the woke culture.
It thumbs its nose at this nonsensical cancel culture.
You know, of course, and myself and my friends from the Dukes of Hazard were perhaps the first victims of this cancel culture.
They took the rebel flag off the model like 20 years ago.
So When I read the script and when I had the opportunity, folks, to do this movie, when they canceled, they cancel Mason Stone because he dares to be publicly conservative.
I thought, oh my gosh, this is great.
Of course, of course, the Seculos are going to make a movie like this.
And of course, I want to be part of it because it's just such nonsense.
And I've had many friends now.
You know, you're streaming on Rumble, and folks can watch it at jinglesmells.movie.
They can watch it right now.
Or they can get a hold of it.
They can get a hold of the DVD.
But I've had lots of friends now who have seen it, to include Rob Carson, who I did a, I talked with Rob earlier today.
I've known Rob for a number of years.
And everybody just loves this movie because it attacks this nonsense in such a fun way that you don't realize, you know, it's nothing worse than being preached to.
But there's something very clever about having the truth be known in a wonderful storyline where it doesn't browbeat you.
It's just kind of the undertone of what this movie is about.
So my friends are now watching it.
They're loving it.
And I'm very, very proud to be part of it.
I really am.
You guys are.
But Logan, you've got to start playing golf.
I'm sorry.
You just have to.
I will, maybe I could just drive the carts.
I could just walk around.
I'll get y'all guys drinks.
I'll do everything I need to do because maybe one day we'll see.
Maybe for you, I will do it.
I will do my best.
But what is interesting?
She brought that up, like Rob Carson from Newsmax, those kind of guys who are saying that they've seen the movie.
We actually had that happen with Jim Brewer, who is in the movie as well, SNL alum, who said the movie came out.
He's busy.
It's around Christmas.
And he hasn't had a movie out in years on his own intention.
He left Hollywood intentionally and came into this movie because the same reason.
He saw the script and said, I want to be involved in this.
He had his neighbors come up to him and go, hey, we loved Jingle Smells.
And he's like, what?
I mean, the word of mouth is spreading and it's very grassroots.
And I find that to be very cool.
It's not about, you know, whether the big Hollywood reviews are coming in positive.
Not worried about any of that.
What we're worried about is, does it entertain the audience that it's intended for?
And it does.
And we're getting great feedback.
People love this movie.
And it is available, like you said, to stream it on jinglesmells.movie.
You can get it on Rumble or Voodoo.
And then also, the DVDs are available, which is, again, all of it supports all of us.
That goes through John's John Schneider Studios.
Pretty cool.
Logan, you also did a video for people who are listening right now and say, maybe I haven't used Rumble to do a movie or I haven't used Voodoo before.
You've got a video out explaining it to people because even I did have an issue on one of my older Samsung smart TVs.
Well, we're the first feature film ever released on Rumble.
So they're, you know, the free speech platform.
They've done a lot of documentaries.
They've done some comedy specials, but they've never done a feature film.
We're the first one they ever partnered with, which was really awesome.
But with that, we knew where's going to come some questions.
So yeah, there is that tutorial on our Rumble channel at Jingle Smells on Rumble that says, here's how you watch it on your TV.
But again, if you're not used to that, the DVDs are available.
And I think everyone else is going to be able to do it.
I've watched it on, John.
I've watched it on Rumble.
I have watched it on Voodoo.
And I'm ordering CDs.
DVDs, CVDs.
So all three.
But John, you know, you said something earlier, and I think it's important for people to understand.
The movie is funny.
It's entertaining.
But it also, there's a real message here.
It hits our military.
I mean, it supports our military.
It talks about trauma that military men come and women coming back from combat face.
So it hits real issues that Americans are concerned about.
Well, yeah, my son and I in the movie fought in the same war 20 years apart.
So and I think that's a wonderful thing to talk about in this movie.
The music in the movie is great.
The message is great.
The comedy, it's so funny.
And we need to laugh.
I need to laugh.
It's been a very interesting year for me.
I need to laugh.
And this movie makes me laugh.
So there's, it's win-win-win.
Get a hold of it.
Watch it on Rumble.
And here's what I learned.
If sometimes your browser, there are several different browsers that you have on your computer.
Sometimes one browser will work better than the other.
So if you have any problem streaming the movie, then just switch browsers.
It's pretty simple.
Safari or Chrome.
It works better on one than the other.
I don't know why, but it's true.
You're very technologically advanced.
John has been advanced.
Well, John's been releasing movies.
John, you've been releasing your own.
You've been kind of creating the blueprint for a lot of us for years, going out there and making, you know, probably a dozen-ish movies, maybe more, all completely yourself.
Yeah, and we've released them.
We have a website called Cineflix D-O-D, and that's where we release our movies.
So we've been streaming movies for six or seven years.
So we were way ahead of our time.
But you have to do that.
You have to be willing.
If you want to be free, if you want to take part in this noble experiment called the United States of America, you have to be unafraid to dream.
But there's work that comes along with dreaming.
You've got to be willing to do the work.
And if I may, gentlemen, I want to let you know that, you know, I'm the Dukes of Hazard guy.
I've been on probation since 1979.
And I finally have my own moonshine.
And we ran, we sold out on opening night.
So I want to thank you because Jingle Smells has a lot to do with people saying, oh my gosh, there's John Schneider.
He's back.
But now he's wearing a badge.
That's weird.
I thought that was ironic.
Look, early on, we first presented it with you.
I'm like, I don't even know if I'm comfortable yet with seeing John Schneider dressed as a cop, but here he is.
Yeah, I mean, he's been fighting the law since the day he was born.
But now I have to deal with this situation.
But I did want to give you that opportunity, John, because it is Christmas time.
People are looking for things to get.
Not only is the DVDs available, you've got a ton of new product, whether that's your new CD, whether that's your book, or except the moonshine.
A lot of products are available through your website.
I'll just give you a minute to talk about that.
Okay, I'll go ahead and do that.
So we've got a wonderful book that my wife wrote 90% of.
I finished it for her.
It's called In the Driver's Seat.
If you've been diagnosed with cancer or someone you love has been diagnosed with cancer, you need to read this book because it will help you navigate.
Regardless of the outcome, it will help you navigate.
Then I did a tribute album to her called We're Still Us.
It's wonderful.
It will help you heal.
But then I finally have my own moonshine.
It's called John Schneider's Revenuers Reserve.
If you've seen the commercial, that's exactly what it is.
It's moonshine that is too good for the revenuers to break up with a baseball bat.
It's the original flavor, which is white lightning, and then there's apple pie and there's blackberry.
You can go to revenuersreserve.com, revenuersreserve.com.
We have run a new batch, so we do have more.
But I'm delighted to say that we sold out on the first day.
So look out, John Rich.
Look out.
Yeah, exactly.
That's right.
We'll tell John.
We'll have a John, a Rich versus Schneider rivalry, and maybe we'll get them on.
You know, our executive producer, he has a whiskey podcast.
So maybe we could have them come together and, you know, who knows?
Will could host it.
Yeah, Will could host it for the podcast.
Have a battle of it.
We'll see what it is.
I was just thinking about this.
You've got John Schneider starring in this movie.
You've got music by John Rich.
You've got two SNL alums.
You've got Sean Hannity in it.
You've got professional wrestlers.
It's some cat.
It was amazing, actually, to see how many people showed up and decided they wanted to help out.
A lot of these people did it knowing that this movie was going to mean something more than just throwing out a random Christmas movie of the holidays.
Obviously, we want something that can last forever.
We want something that you can watch every year, but also the amount of people.
Governor Mike Huckabee makes a cameo in this in the most ridiculous way you could possibly imagine.
All the seculars are pretty much in it.
All both of our wives.
It's really a sweet movie that I'm very proud of.
I think our team here and our national team and our team out in Albuquerque, Daniel and Isaac and everyone who worked on this movie really kind of bled for this Christmas movie because we know this message needs to get out there and more content like this needs to be made.
I think that's what's most important.
Can we make this the number one Christmas movie of the year?
Just like selling out moonshine from Josh Dneider.
Can we sell out all of his DVDs?
Can we sell as many copies of streams as we can?
Because this is a message that we're sending not only to Hollywood, but to the world, that the content we can actually play for our families is very important.
You know, also, John is going to be on Sean Hannity tonight.
He recorded it with Sean talking about the movie on the TV show.
So you're going to want to stay tuned for Hannity tonight on TV.
John, let me ask this question also.
And that is the importance of being able to make a movie with a statement and be able to do that without, as we said in the beginning, the hassles of Hollywood.
Well, unapologetically, I mean, you know me.
We've known each other for decades.
Yeah, you've got to be, like I said, if you're going to dream, you've got to be willing to do the work.
Well, if you're going to be free, then you've got to be willing to take risks.
And taking risks are making a movie like this.
Hollywood is against movies like this because Hollywood figured out, oh, maybe 15, 20 years ago, they figured out rather than making content that unites families so everyone watches the same thing at the same time, like Dukes of Hazard, like The Hulk, like Little House on the Prairie.
Like a Christmas movie I did, this is a perennial.
It's called Christmas Comes to Willow Creek.
That's the Boo Pat 30 years ago.
But Hollywood figured out how to take that whole model and divide families.
You know, when there was one television per household, then everybody watched the same thing.
Now, they figured out how to divide the sons from the daughters, the parents from the sons and daughters.
You're 100% correct, John.
And we appreciate you being part of this and appreciate the relationship you've had with our family for decades.
Folks, go to jinglesmells.movie.
That's jinglesmells.movie.
John's in it.
Sean's in it.
We're in it.
A lot of stars you know are in it.
And that's a great way to celebrate the holiday.
Absolutely.
Jinglesmells.movie.
We appreciate that.
Check out all of John's products.
And again, hopefully there's more coming.
We'll see with us and John Schneider.
So I sure hope so.
John, thanks for being with us.
We really appreciate it.
Again, jinglesmells.movie.
You could stream it on Rumble, stream it on Voodoo, or get the DVDs from John.
We're going to be back with more Hannity in just a moment.
Hey there, I'm Mary Catherine Hamm.
And I'm Carol Markowitz.
We've been in political media for a long time.
Long enough to know that it's gotten, well, a little insane.
That's why we started Normally, a podcast for people who are over the hysteria and just want clarity.
We talk about the issues that actually matter to the country without panic, without yelling, and with a healthy dose of humor.
We don't take ourselves too seriously, but we do take the truth seriously.
So if you're into common sense, sanity, and some occasional sass, you're our kind of people.
Catch new episodes of Normally every Tuesday and Thursday on the iHeartRadio app, Apple Podcasts, or wherever you listen.
I'm Ben Ferguson, and I'm Ted Cruz.

What I told people I was making a podcast about Benghazi, nine times out of ten, they called me a masochist, rolled their eyes, or just asked, why?
Benghazi, the truth became a web of lies.
It's almost a dirty word, one that connotes conspiracy theory.
Will we ever get the truth about the Benghazi massacre?
Bad faith, political warfare, and frankly, bullshit.
We kill the ambassador just to cover something up.
You put two and two together.
Was it an overblown distraction or a sinister conspiracy?
Benghazi is a Rosetta Stone for everything that's been going on for the last 20 years.
I'm Leon Napok from Prologue Projects and Pushkin Industries.
This is Fiasco, Benghazi.
What difference at this point does it make?
Yes, that's right.
Lock her up.
Listen to Fiasco, Benghazi, on the iHeartRadio app, Apple Podcasts, or wherever you get your podcasts.

To the people who make the news.
This is the Sean Hannity program.
We are the Seculos here subbing in for Sean.
By the way, we have a broadcast every day, noon Eastern time, called Seculo.
And if you just go to aclj.org, you can find a station that carries it.
Or, of course, we're also streamed everywhere.
So, anywhere you get your podcasts or Facebook, YouTube, Rumble, Twitter, we're available there too.
We just had on John Schneider talking about our new ACLJ movie out of ACLJ Films.
First one we've done, Logan, like this.
We've done other movies, but this was different.
Yeah, that's right.
This is our first really feature film, if you will, narrative story.
And of course, definitely our first comedy that we've taken on.
So we took on cancel culture, supported the troops, had a lot of good messages in there, great patriotic messages, faith, strong Christian faith messages.
Obviously, we're at Christmas time, and we're able to provide it in the wrapping of a big Christmas comedy.
Again, I think such a huge part of impacting culture is also getting involved in things like this, whether that's broadcasts like Hannity, but also going outside the box, making movies, doing things that would not necessarily appeal or would not appeal to people who just want to listen to News Talk 24-7.
Maybe they want to find something else.
We're able to provide that, get this in front of them.
And again, that's how you start impacting minds, how you start changing culture, is to not just talk about the news, not just report on what's happening, but also infuse your own views and the views that we want our children to see into the content in an entertaining and fun way.
And the great thing is, Sean Hannity is the co-executive producer.
He's also in the movie multiple times, actually.
That's right.
He plays a pretty pivotal role in the movie.
We all have appearances in it, but Sean was an amazing partner here.
And obviously, just being able to come on this broadcast and talk about this show or talk about this movie is more than a lot of filmmakers could ever really dream of.
So it was really amazing to have him on board.
All right.
So if you want to get information about the movie, want to download it, stream it or get the DVD, go to jinglesmells.movie.
That's jinglesmells.movie.
Coming up in the next segment, we're going to recap the Supreme Court issues that are going on right now involving the former president, but also the Supreme Court issues that are going to have big implications for whoever the next president is.
And that includes the issue of presidential immunity, something I know about, because I argued a presidential immunity case before the Supreme Court in 2020.
So we've got a lot more ahead on Hannity.
Again, check out the movie jinglesmells.movie.
More of Hannity.
When we come back from this break, again, we'll focus on the Supreme Court.
Back with more in just a minute.
Sean Hannity is back on the radio right now.
Hey, everybody, welcome back to Hannity.
This is Jay Seculo, Jordan Seculo, Logan Seculo.
And I want to kind of end where we started in this next half hour.
And that is what's at stake at the Supreme Court of the United States coming up because there are a lot of cases that they just took.
And this thing's moving in a record speed.
I'm surprised at one, not surprised at another.
You've got a series of cases we talked about, these 14th Amendment cases.
You had a bunch of liberal activist groups like Crewe and then some individuals that started filing lawsuits all over the country.
Republicans in the swamp.
Yes, including Republicans in the world.
D.C. Republican lawyers who make no money off Donald Trump and don't like him, don't want to see him back in D.C. because it's not good for their business.
Yep.
So a group of them filed lawsuits utilizing the basically the disqualification, the insurrection clause of the 14th Amendment, Section 3, which was used last in 1917.
When it was utilized then, the Supreme Court of the United States overturned the use of it, saying you cannot keep that candidate off the office, out of office.
So in a number of states, Jordan, you've got the list of the number of states we are at the ACLJ, American Center for Law and Justice, that we're involved in right now.
We just found out yesterday we won at the Michigan Court of Appeals, which is actually their Supreme Court.
That's our idea.
Yeah, so Michigan and Minnesota and Oklahoma, we have won, but we've intervened in pending litigation in West Virginia, Virginia, and Wyoming.
We won.
It's on appeal right now at the highest court in Colorado.
We're waiting for that, but we won't be a trial court in Colorado.
We also are doing one, and this is the Michigan case.
We represented 14 other states in that case.
And these were state GOP parties.
They want to make sure that their Republican Party members get to vote for the candidate of their choice.
And the candidate they're trying to exclude this time is Donald Trump.
But they'll say in the future, if they were allowed to do this, they can always say, let's exclude the guy who's doing the best in the polls.
Let's exclude the candidate who's going to be hardest to beat.
We'll find a reason.
So why are you see all these states come together?
Oklahoma, Colorado, West Virginia, Kansas, Wyoming, North Dakota, Delaware, Georgia, Nebraska, Maine, Idaho, Rhode Island, Ohio, and Dan.
I'm not going to name other states, but we're not done.
And these are all, by the way, states and state parties that the ACLJ is representing because of our donors and because of our supporters.
We have had to add attorneys in this.
We've had to go to court, different trial courts.
These are in state courts, so you've got to work with state attorneys as well.
So we are there making sure that all of you listening have the right to vote.
Have the right to vote for the primary candidate of your choice if you decide to vote in the Republican primary.
Yeah, and so again, President Trump happens to be the person being attacked, but it literally, as Jordan said, it could be anyone.
And therefore, we assembled a team.
Basically, we assembled some of the lawyers that we worked with when we represented the former president, Jane Raskin, others that have come alongside us in these cases.
Because when you mention the cases, like there's another one in Oregon right now that's not on our list yet, that just got, I think just was filed.
So one of these is going to go to the Supreme Court.
Now, we all think it's going to be the Colorado case, but you know what?
Could be the Michigan case.
The other side could take it.
We won.
They could take it up.
So we'll see.
What is surprising also, though, is the Supreme Court, and I do my practice over the last 40 years.
I've made, I don't know how many oral arguments, I think 17, 18 oral arguments.
We've done 35 cases at the Supreme Court of the United States at the American Center for Law and Justice on the merits.
Some of them were just, but we won without having due argument.
They don't have argument in every case.
But I've argued, I think, 16, 17 times now.
The fact of the matter is, the one case that's up there involves the issue of presidential immunity.
Now, I argued a presidential immunity case for President Trump in 2020.
It was Ruth Bader Ginsburg was still on the court.
She passed away shortly after the opinion.
Amy Comey Barrett was then appointed to the court and confirmed.
If she was on the court at the time, we would have won the presidential immunity issue.
It was a 5-4 decision on a scrutiny level.
The end result was good because it allowed a president to go into federal court.
That was a big issue.
It wasn't clear they could do that to assert presidential immunity.
But this case involves presidential immunity for acts of the president as president, but they bring the suit when the president's out of office.
And if this stands up, and this is one of the allegations in the special counsel Jack Smith's case, if it stands up, any president could be criminally charged for actions they took as president of the United States.
And then you think about who on earth would run for president?
I mean, think about that because you think they're going to be able to prosecute me three years down the road for something I did three years ago because they didn't like the fact that we did this in this war or they didn't like the fact that we negotiated this treaty this way or the phone call I had with the Russian leader or the Ukrainian leader.
They didn't like the tone I took, so they're going to prosecute me.
I mean, think about that.
And in this case, which was interesting, Dad, I mean, Jack Smith says, even though, and it's about Donald Trump this time, he was impeached twice and acquitted twice, he would still like to bring criminal charges against him three years later.
Which raises the whole issue of what's called double jeopardy.
He's nervous about it.
He's nervous about it because, look, it's a question.
It's an open question.
I mean, we defended the Ukraine, the president in the Ukraine impeachment, the first impeachment, and he was impeached.
But then it goes to trial in the United States Senate, and he was acquitted on both charges.
We did that trial for three weeks in Washington, D.C.
That should be then the end of that issue.
But Jack Smith, who takes his very expansive view of the federal law, he did this against Bob McDonald.
You mentioned that earlier, where he brought these charges against Bob McDonald, tried to ruin his life, got a conviction at the U.S. District Court in Richmond, went to the Supreme Court of the United States, and Bob McDonald won 9 to 0, meaning that Jack Smith lost 9 to 0.
They brought charges against John Edwards when he was running with John Kerry for president in 2004.
Jack Smith brought criminal charges against him.
By the way, his criminal defense lawyer, John Edwards, who was acquitted, was none other than Abby Lowell, who is, I think, is Hunter Biden's lawyer.
And I will tell you, and Sean has said it on this broadcast, one of the best criminal defense lawyers in the United States.
I put him in the top three.
And then they shipped Jack Smith off to Europe.
And then they sent Jack Smith off to another venue we deal with at the ACLJ, and that is the International Criminal Court in The Hague.
Convictions there, so it's not easy.
Because cases go for 25 years and never get out.
I don't even know what he was doing there as an American because we don't accede to True Speaker.
He was doing the possible prosecution.
Then there's some controversy.
I didn't even know the details of this.
There's a big controversy about some of that and witness tampering.
Who knows?
They got brought back to go after that.
Then he had the Menendez, Senator Menendez trial.
And he lost that.
So he has these rather expansive views of the law that the courts don't tend to, the appellate courts don't tend to agree with.
The question I always ask the American people is whether you're for Trump, against Trump, for DeSantis, against DeSantis, whoever, for Biden, against it, whatever it is.
The idea that an elected official without due process to the person could be struck from a ballot, Logan should scare everybody in your generation.
Yeah, and it should.
It should scare anyone ever wanting to run for political office, the fact they're able to take these kind of actions against.
And look, they'll make it very personal in the sense of clearly this is targeted to President Trump.
But it seems like what the Democrats forget is what the impact could be in the future.
The problem is if you have rogue Republicans, they could do the same thing.
There are so many things that can happen in terms of how this impacts the future of politics.
You're not going to have anyone who should be running for president ever wanting to run.
That's what I'm saying.
This would exclude almost anyone who's not a billionaire because how could you even afford the legal fees it would cost to make the decision to run for president?
I mean, you could be a great governor.
You could be a great senator.
You could be the person everybody wants.
And in fact, in this case of Donald Trump, he's got like 50% of the vote this time in all the different polls, state polls, national polls, and that's who they target.
And he's unique because he could kind of afford this, but most candidates couldn't.
I mean, I think about the Mitt Romneys.
They used to make a big deal.
He was at $250 million.
That $250 million would be gone after four or five of these cases.
Oh, yeah.
I mean, gone.
And it's not just him.
They go after your kids.
They go after your CFOs, your COOs, your attorneys, your spokespeople.
I mean, they're making it in D.C., they're trying to criminalize working for a Republican president.
That's what they're trying to do.
Look, we know firsthand because we were on the receiving end of it.
Listen, the Democrats are getting it right now.
We were on the receiving end of the subpoena.
We were the lawyers, but the subpoenas.
They tried to, you remember this in the impeachment.
When they couldn't get to the president, who did they try to go after?
The lawyers.
And we told them no.
So this is what's going to happen, though.
I guarantee you.
Joe Biden's White House will play the playbook that was put in place by Pat Cipollone and Jay Secchulo in defending a president.
How do you defend a president from impeachment?
So they're going to do the same tactic because it's political tactics.
Because when he was a senator and even as a vice president, and he said this about President Trump and the White House staff then when he was out of office, that if you ignore one of those subpoenas from Congress, you should be in jail.
So Congress first, his White House counsel said, well, we don't have to, we can ignore these subpoenas because you didn't vote for an impeachment inquiry.
Now they have.
So when those subpoenas get issued in a few weeks and they try to ignore one, is Joe Biden going to say that his staff person who ignores it should be in prison?
Well, or is the Department of Justice going to try to get a new membo?
Or are they going to use the more recent membo from the Trump team?
Yeah.
They're going to use the most recent memo from the Trump team.
Which is that you could make an argument that the people cannot go before.
Yes, because some people have privilege.
President is entitled to getting advice from individuals without worrying about it being discussed with the entire populace.
They can't testify.
Definitely.
Some people did.
Yeah, at this point.
Yeah.
Now, there was another case they took, and this was the one that surprised a lot of people.
And that was one of the January 6th defendants.
And I opposed what happened on January 6th.
I think tax on the Capitol are horrible.
But they applied Section 1512.
And here's the problem with all of that.
They made the broad argument that these activities, and this is what the dissent, Judge Castas, who I worked with when he was a deputy White House counsel for President Trump later became a Court of Appeals judge.
And he said the problem with what they're doing in this particular aspect of the indictment is it's so expansive that it includes core fundamental political speech.
Freedom of speech, freedom of association, freedom to petition your government for redress of a grievance.
And he said for that reason alone, that provision should go.
He was the dissent, though.
It's two to one.
Here's what's interesting.
Case goes up on sertiori.
Everybody expected to be denied.
Supreme Court's not going to want to get into the January 6th stuff.
And boom, they took the case.
What you said is because, again, including Jack Smith, he was not willing to charge the president with insurrection.
And most of these people who were in prison for January 6th did not face insurrection charges.
So the big charge they faced was impacting a government official act.
Yeah, interfering with congressional action, which was the certification of the president.
And what that judge said, who was the dissent, but now the Supreme Court decided to take the case is, well, then every protester could violate this and you could put him in jail for 20 years.
So the person that gets up and shouts at the congressional hearing, is that now?
Because that congressional hearing is an official congressional act.
So are those pro-abortion protesters from Code Pink now going to go to jail for 20 years?
Well, they've done that at the Supreme Court of the United States.
Right.
So it'll be interesting if any of those protest groups are honest about this.
I don't think they will be these days.
No, I'll tell you this.
We're involved in all these cases at the American Center for Law and Justice.
