All right, news roundup, information overload hour, 800-941-Sean, our number, if you want to be a part of the program.
So what's getting interesting is rumors running rampant that there might be charges and an indictment brought against Donald Trump related to the document issued down in Mar-a-Lago.
From all the sources I've been talking to, it seems like the original investigation, which was supposed to be about two things, January 6th and secondly, about the Mar-a-Lago top secret classified document issue.
Apparently, they're talking about charges unrelated in the sense that it has nothing to do with Donald Trump having in his possession documents that were top secret or classified.
Now, if so, that would be an easy comparison to what happened and how Hillary Clinton was treated.
You know, no reasonable prosecutor would prosecute after James Comey laid out all of the top secret classified materials that he found.
And never mind the fact that she had deleted 33,000 emails with bleach pit that nobody got a chance to look at.
We can only guess what might have been on that.
That would be a clear obstruction case if that's where the special counsel in this case is ultimately headed.
And anyway, so it looks like that's the direction they're headed.
We have not heard a word, not one peep, not one leak, unlike the Trump case, about Biden's special counsel.
Nothing at all whatsoever.
And the talk is that there might also be an indictment of Hunter Biden, but from all the indications that we're hearing, it's going to be about the low-hanging fruit, which would be lying on a gun application.
And number two, tax issues, but nothing specifically to do with him and his father and offering no experience, no background, no services for massive amounts of money from a lot of different countries for services that he was not qualified to perform that we can see.
So we're watching this.
There's two indictment watches.
Now, that to me says that the Justice Department is extremely sensitive.
Now, they've had Hunter Biden's laptop since December of 2019.
It's taken them a long time.
The special counsel, I think, was appointed in October or November as it relates to Donald Trump.
Their movie At Lightning Speed in this particular case, but that sounds like a CYA.
Oh, well, we're indicting Trump, but we're also indicting Hunter.
Well, this indictment could have happened by the end of January of 2020 if they had actually authenticated the laptop, which was very true.
The laptop that later the FBI was telling big tech companies might be victims of a misinformation campaign.
It may be about Joe or Hunter or Biden and be on the lookout.
And you probably don't want to run any information that might come available and hence the censoring of the Hunter Biden laptop story to begin with.
Anyway, here to sort through all of this.
Greg Jarrett, Fox News analyst, his new book is out Trial of the Century.
Alan Dershowitz, his best-selling book, Get Trump, attorney at Harvard University, and both friends of the program.
Welcome both of you.
Let me get your take, Professor, and what you are hearing and reading and seeing.
It seems like an indictment is imminent and maybe two about Hunter Biden, but I think that's the low-hanging fruit.
That's not the real issues that James Comer and his committee are looking into.
Well, I predicted a long time ago that they would not indict President Trump on the mere possession of classified material because he has defenses to that.
And there's the comparison to other people, Democrats, who haven't been indicted for that.
I predicted from the outset they would try to find a process crime, an obstruction of justice crime.
It's not there, as far as I can tell.
Remember that you don't have to cooperate with a government investigation of you.
You know, Biden did that.
Fine, that's commendable.
But Trump had the right to resist.
He had the right to do everything in his power to make it harder for the government to pin a wrap on him as long as he didn't cross the line into illegality.
And I just don't see, based on the evidence that's available, him crossing that line from being a tough, uncooperative defendant, constitutionally protected, to obstructing justice in an unlawful way.
But, you know, these laws are very elastic, and you can expand them to cover anybody you want to.
And that's the big problem in America today, weaponizing the criminal justice system in a partisan fashion.
I think we're seeing that happen.
Are you concerned that they've been able to pierce executive privilege and attorney-client privilege in this case?
Particularly attorney-client privilege.
The judge made an outrageous ruling that if your client and you discuss criminal conduct, essentially, and you admit to some kind of criminal conduct that the lawyer-client privilege evaporates, that would mean I think I've never had a lawyer-client privilege with any of my clients because I try hard to get them to admit if they did something wrong so I can work around that or get them the best possible deal.
They've really eviscerated the lawyer-client privilege, and that could hurt every single American, not just Republicans.
And so we have to be very critical of judges who are hurting lawyer-client privilege, which is in the Sixth Amendment.
Let's get to you.
Let's get your take, Greg Jarrett.
Assuming these stories are true and there's an indictment by the end of the week, what are your thoughts?
My thinking, I agree 100% with everything Professor Jershowitz said.
This case over documents is a civil dispute governed exclusively by the Presidential Records Act.
But Merrick Garland, who has weaponized the DOJ for political purposes, decided to criminalize a civil case so that he could raid Trump's residence.
And to do it, he had to reverse longstanding Justice Department policy that a former president can take whatever he wants.
And in fact, a decade ago, a federal judge agreed with that, which means that the proper remedy for Garland was to file a motion to compel production of the documents in civil court.
Let an impartial judge decide.
So what Merritt Garland is doing is mangling the law.
I think he's doing it for political purposes to hurt his boss's electoral opponent.
I think it's a dishonest abuse of power.
Looks like he's focusing on obstruction of justice.
Well, what is that?
It's defined in the criminal codes.
It means acting corruptly to influence, obstruct, or impede an investigation.
Now, what does corruptly mean?
That's the key word.
Supreme Court has said it means wrongful, immoral, depraved, or evil intent.
I don't think there's any evidence that satisfies that legal requirement against Donald Trump.
But yet here we are, Professor, and, you know, we've talked at length about the FBI, for example, putting their cinder blocks on the scale of the 2016 election, even going as far as knowingly use an unverifiable dossier to spy on Carter Page and backdoor into Trump world and giving Hillary Clinton a pass.
No reasonable prosecutor would prosecute.
And, you know, that's not considered obstruction.
If you destroy 33,000 emails and devices, you bust them up with hammers and remove SIM cards.
That kind of sounds obstructiony to me.
And then 2020, the case I mentioned, as it relates to Hunter's laptop.
Yeah, no, there has to be equal justice.
The only thing I disagree with what Jared said is that he talked about an objective, disinterested judge should decide.
Do we still have objective, disinterested judges?
We are seeing so much politicization of the judicial system as well.
We're seeing judges taking sides now.
And it's just so dangerous to our system of justice.
But at least judges are supposed to be less partisan than prosecutors.
And so, yeah, we have to let judges make the decision, but don't necessarily believe that judges will make decisions that are nonpartisan.
Judges are just human beings and rogues.
They're Democrats.
They're Republicans.
They vote and they vote twice.
They vote once on Election Day, and then they often vote in their opinions as well.
There's a special counsel that's appointed, and news broke yesterday that there might be a tape recording that, quote, where you acknowledge that you understood that these were classified documents.
First of all, do you know who this call may be with?
Do you know anything about it?
No, I don't know anything about it.
All I know is this, everything I did was right.
We have the Presidential Records Act, which I abided by 100%.
Biden has 1,850 boxes with a lot of classified stuff that he's not supposed to have.
In his case, I have the right to declassify as president.
He's got 1,850 boxes that he doesn't want anyone to see.
He had seven or eight boxes in Chinatown, in Washington, D.C., where nobody even speaks English in Chinatown.
Chinatown is very, it's in favor of China.
And he has boxes in Chinatown.
They took those boxes and they sent them to Boston to his lawyer so his lawyer could look through them and probably do things that you're not supposed to do.
No, this is about election interference.
All right, we continue with Greg Jarrett, his book, Trial of the Century, and Professor Dershowitz, his book, Get Trump, discussing possible pending indictments, both of Hunter Biden and former President Trump this week.
Let's talk about the reality.
I mean, by the time we get to Election Day 2024, we're talking about not one, not two, but three indictments and trials that Donald Trump could be facing.
I mean, how does one run for president with that burden dumped on his shoulders like this?
By the force of the public and the voters who see this for what it is, a dual system of justice in which the Department of Justice is taking sides for political reasons, that they're running a protection racket for Hunter Biden over documents that implicate his father, the president.
I mean, how else do you explain a five-year-long investigation with no criminal charges being brought despite an overwhelming number of incriminating documents juxtapose this case, which you have described correctly, Sean, as lightning speed to try to derail President Trump's election plans?
So Americans see this and they will vote accordingly.
But Greg, I don't think he can get, if you look at the venues we're talking about, New York City, Washington, D.C., and Fulton County, Georgia.
Now, I can't think of any three worst jurisdictions for a Republican to go on trial.
Both the Bragg indictment, which is utterly ludicrous on its face, as well as any potential indictment in Fulton County, Georgia.
I mean, I just would like to think that they cannot withstand judicial scrutiny by fair and impartial judges on appeal.
Now, you know, the professor has brought up a great point that are there any fair and impartial and neutral judges anymore?
I would like to be optimistic.
Professor?
You're right to be cautious.
Judges in places like Manhattan are elected, and they don't want to be the one to be walking down the street or going to their private club and having people point to them, think that's the guy that freed Trump.
Look, I was only the guy that defended Trump, and nobody on Martha's venue will talk to me.
The library, they're having putting pressure on the library to cancel my speech.
No judge is going to want to be the one who freed Donald Trump.
So, you know, you can't count on judicial justice here.
This is going to be the first election in American history since George Washington ran for president, where the issue is going to be who has committed more crimes, the Democrats or the Republicans.
And that's not what people should ideally vote for.
They should vote for the economy, for foreign policy, for what's good to their children, instead of having to parse through indictments and see whether the Hunter indictment is worse than the Trump indictment.
People should be allowed to vote on the merits, and we're moving away from that, and we're moving toward the criminalization of political differences, which really endangers civil liberties in America.
So, whether you're a Democrat or Republican, you have to be concerned.
Professor, you're saying it as somebody that's more left-of-center than I am, and I'm saying it from the right-of-center perspective.
I don't think it's ever been this bad, but I think all of this now is about to unfold, and hence your book at Trump.
I don't see anything that I can possibly think of related to the documents if you compare it to Joe Biden and his document problems, Hillary Clinton and her document problems.
If obstruction comes into play, you know, how do you look at Hillary Clinton's deletion, Greg Jarrett, of 33,000 emails and the destruction of devices with hammers is anything but that?
Well, there's a dual system of justice, as you frequently point out, you know, one for Clinton and Biden, and another one for everyone else.
Bill McGurn of the Wall Street Journal made that same point again today in an editorial.
And, you know, Americans are smart.
They see what's unfolding.
They realize this.
The question is, can they do anything about it?
You know, Trump is looking at two different federal grand juries, one in South Florida, another one up in Washington, D.C.
And in both jurisdictions, people have been subpoenaed to testify.
And, you know, a lot will depend on where an indictment is brought.
In the meantime, there appears to be no indictment of the Biden family crime syndicate in their influence peddling scandals that reaped tens of millions of dollars from foreign adversaries.
Unbelievable times, I'll say that.

And this crime is growing by leaps and bounds daily.
It is the anniversary of D-Day.
And I know that we kind of have gotten away from history because, you know, our kids learn everything woke and everything about CRT and everything about, let's see, gender identity.
But they're missing a very important aspect of their education.
And that is what happened on June 6th, 1944.
It was the largest amphibious invasion in the history of warfare, codenamed Operation Overlord.
The Allies used 5,000 ships landing craft to land more than 150,000 troops slamming the beaches of Normandy.
And that marked the start of what was a long, very, very costly campaign in Northwest Europe, which ultimately convinced the German high command that defeat was inevitable.
And Overlord opened the long-awaited second front against Nazi Germany.
And a lot of those people that day died slamming those beaches as they were pulling up on these amphibious vehicles on these boats.
I mean, they knew what they were facing.
And that is that in that moment, you can watch Saving Private Ryan.
It's a great movie.
And, you know, you see this scene where the high ground is controlled by the Nazis.
And then all of a sudden, I mean, these guys getting off these ships, they're basically sitting ducks and machine guns just mowing them over one after another.
You know, blood-soaked, nothing but red, the ocean rather, soaked with red blood.
This is the day to remember them.
It is the entire Normandy campaign.
It was the critical tipping point moment to defeat Nazi Germany, which was not an easy task.
There were many D-Days throughout the war, but this was the D-Day.

I want to talk about Trump, and I want to talk about how everybody can give Trump flack, but he can never give it back.
And it just breaks my heart because Trump has got to be Trump.
And everyone, every Republican, every conservative, everyone who wants to win this country back better understand that if you try to change Trump and if you try to change his anointing and you try to change the way he speaks and the way he gets things done, we're going to lose.
Trump must be Trump and he will win.
So those people that say that stylistically it would be better for swing voters to see a more watered down Trump, not on issues, but on other issues, on the battle, the fight.
I mean, look what this guy is now running.
He's got a headwind he's plowing into here with speeds at 150 miles an hour with all this legal crap that they're about to throw on him.
He is the only one that can stand in the storm.
He is the only one that can take the brunt of what's about to happen to him.
And he's going to come out standing.
And we all better be standing behind him.
We all better unite behind him.
And if you want this country back, there's no deals that anybody can make.
They're not going to stand by anything they say the other side is going to do for us.
Trump is a righteous man.
I don't care how he speaks.
His actions are righteous.
And everybody's looking for a nice guy.
We supposedly got a nice guy, right?
Right?
Look at this guy in office.
There's not one thing we can point to that we can say, oh, he's been successful at this.
Nothing.
He can't handle it.
He has not been appointed for this.
Listen, the world has taken full advantage of America's weakness under Joe Biden.
It's so transparent.
You know, the communist-Chinese alignment with Russia and Iran, it's so clear, crystal clear what they're doing.
They're undermining our economy, and they are trying to surpass us as the world's lone superpower.
And it's happening before our eyes.
It's scary.

Anyway, I just wanted to click on that question.
There's been rumor that Chris Christie has been backed by a lot of dollars, funded by a lot of dollars to go on this campaign to run against Trump, and he's going to bash him.
Do you think Vice President Pence will bash Trump as well?
I think all these candidates are in a tough spot because the Trump policies are popular.
You know, and I've even asked a couple of people.
I asked Nikki Haley this.
I think I've asked Vivek Ramaswamy this and others.
All right, so where are your policy disagreements with Trump?
It really is not, they don't really have a good answer to that question.
You know, Nikki will argue that it's time for a new younger generation, and others are making similar arguments, that we need somebody that maybe is less combative and more palpable to swing voters.
I mean, those are the arguments people are making.
But on policies, I think Trump is pretty much in, you know, and the other candidates are in lockstep.
They mostly agree.
Agree.

I think that's part of making America safe again, and then we can concentrate on making it better.
I think it needs to be safe first.

I mean, without law and order, safety, security, how is one capable of pursuing happiness?
If you can't walk, we had 50 people shot over the weekend in Chicago, surpassing last week's number of 48 people shot in Chicago.
How are the people in Chicago faring in terms of freedom to pursue happiness?
It doesn't look pretty good.
It doesn't look good to me.
Well, it's like Wayne Lafayard said: you know, only the only, you know, the only thing that's going to stop a bad guy with a gun is a good guy with a gun.
And if that takes somebody that's wearing the badge representing the law or an individual citizen's concerned citizen like yourself or myself, whatever it takes, I think we need to start as individual states and quit relying on the government in Washington, D.C.
We need to be more active in our own politics in our individual states.
And as the Canadians call us, I'm talking about the lower 48.
All 48 states need to get on board with this.
That's how we get this country turned around.
I'll tell you right now, I've never been more worried about the direction of the country than I am now.
Never in my lifetime.
And that's saying a lot.
I've seen a lot.
You know, I'm right there with you as age-wise.
I'm a 63 model.
I'll be 60 towards the end of this year.
And I've seen a few things too, but it's just, it's really disappointing and scary in the times that we're living in now.
It really is.

And God bless the greatest generation.
Two quick topics.
The first is the debt ceiling bill.
I know it's been discussed quite a bit.
As a conservative, I'm really disappointed in Speaker McCarthy.
As you stated, the House had a bill.
The Senate didn't do anything.
The president refused to meet with him for months.
I just think McCarthy should have held firm, had a press conference every day stating these facts.
Heck, maybe put an ad in the TV guide.
Well, I don't know if there is a TV guide that's actually in publication anymore.
I mean, all you have to do is hit the guide button on your television and you got your own TV guide.
That's a note to Newt earlier.
He did a typical backroom deal.
I'm concerned that when the 2024 election comes up, the Democrats are going to have this in their back pocket just saying the Republicans are going to cut more Benefits and they're going to cut Social Security.
I just see that as their talking points for 2024.
Well, that's always going to be a part of their talking points, whether it's rooted in reality and truth or not.
I mean, that's what they do: they lie.
And, you know, I give you the whole litany of what they'll say.
They'll say they're going to, you know, take away Social Security, Medicare, feed grandma and grandpa dog food and cat food.
And then some Republican will pick them up in a wheelchair and dump them over a cliff.
And they're racist, sexist, misogynist, homophobic, xenophobic, Islamophobic, transphobic.
I mean, that's all, that's just standard, fair Democratic Playbook 101.
That's what they always do.
McCarthy had a bill, he could have stated, hey, we're not cutting these programs.
Look at our bill.
And I think he lost the opportunity.
I would not have voted for the compromise bill.
There's my answer.
And I think there was a lot of anger.
Interestingly, you know, he survived this, but from my understanding, is he's been told, don't go rogue again.
That's what I've been told.
So we'll see what happens.
But anyway, Tyson, good points, my friend.

So we were talking earlier about the anniversary of D-Day.
And, you know, I wish people really understood what these guys were walking into and just how devastating it is and the sacrifices they all made.
It was interesting.
FDR at the time, historical note, literally did a nationwide prayer that you may not know about.
Let me play it for you.
My fellow Americans, last night when I spoke with you about the fall of Rome, I knew at that moment that troops of the United States and our allies were crossing the channel in another and greater operation.
It has come to pass with success thus far.
And so, in this poignant hour, I ask you to join with me in prayer.
Embrace these, Father, and receive them, thy heroic servants, into thy kingdom.
And for us at home, give us strength to strengthen our daily tasks, to redouble the contributions we make in the physical and the material support of our armed forces.
And let our hearts be stout to wait out the long travel, to bear sorrows that may come, to impart our courage unto our sons, wheresoever they may be.
Help us to conquer the apostles of greed and racial arrogancies.
Lead us to the saving of our country and with our sister nations into a world unity that will spell a sure peace, a peace invulnerable to the schemings of unworthy men, and a peace that will let all men live in freedom, reaping the just rewards of their honest toil.
