Democrats are admitting, yes, Hunter put the Vice President of the United States in touch with his foreign clients, a felony under the Foreign Agents Registration Act.
They're admitting Hunter committed felonies.
And they're admitting Joe was an accessory to said felonies.
But Joe's just a nice guy.
And nice guys don't hang up on Russian billionaires bribing their kids.
And Joe doesn't even know who he's talking to half the time.
Yes!
Joe Biden, the weatherman!
We had to open with something amusing today because my poor wife.
I have been in a foul, stinking mood all day.
And I hope you have been as well.
Because if you're not angry, if you're not fuming, At what happened in America yesterday.
Well, you're really not an American.
And you don't deserve to live here in America.
And you really don't give a rat's backside about the Constitution that has made this the greatest nation on God's green earth.
Alright.
I have it in front of me, all 45 pages of the now third federal indictment, or the third, second federal indictment, third indictment against President Trump, if you include Alvin Bragg.
I will give you my analysis.
We'll have none other than Harvard Professor Emeritus Alan Dershowitz on next, momentarily, in a few minutes.
We'll have Mark Houck, The man who had his home raided by armed agents of the FBI to make a very special announcement.
He understands what President Trump is going through.
We'll have your calls.

But first, let's listen from that political hitman, Jack Smith, who gave, not a press
conference, but a political statement yesterday, shortly after he dropped this political document.
Cut seven.
The attack on our nation's capital on January 6th, 2021 was an unprecedented assault on the seat of American democracy.
As described in the indictment, it was fueled by lies.
lies by the defendant, targeted at obstructing a bedrock function of the U.S.
government, the nation's process of collecting, counting, and certifying the results of the presidential election.
The men and women of law enforcement who defended the U.S.
Capitol on January 6th are heroes.
They are patriots and they are the very best of us.
They did not just defend a building or the people sheltering in it.
What has any of that got to do with this indictment?
to defend who we are as a country and as a people.
They defended the very institutions and principles that define the United States.
Since the attack on our Capitol, the Department of Justice has remained committed
to ensuring accountability for those criminally responsible for what happened that day.
What has any of that got to do with this indictment?
This indictment is about what happened concerning the election.
And it's a good thing.
What has it got to do with police officers on January 6th?
Nothing!
But that's because you're a political actor.
You're not interested in the law.
And the fact that you gave this case to a certain judge who... Well, I'll talk about the judge momentarily.
But let's talk about this indictment.
The four groups of charges listed against President Trump are count one, conspiracy to defraud the United States.
Count two, conspiracy to obstruct an official proceeding.
Count three, obstruction of an attempt to obstruct an official proceeding.
And fourth, most peculiar of all, conspiracy against rights.
We'll explain all of that, but let me read the key aspect, the key charge against the president.
First things first.
Second sentence.
The defendant lost the 2020 presidential election.
Really?
Well, what if I disagree with that statement?
Am I a criminal as well?
What about the millions of people who say, no, something fishy happened.
And we don't know that to be sure.
And that's why we wanted the electoral college vote count to be recertified, to be checked, as was the constitutional duty of Mike Pence.
We'll talk about Pence in a moment.
So for more than two months, following election day on November 3rd, 2020, the defendant spread lies that there had been outcome determinative fraud, jargon, in the election and that he had actually won.
These claims were false!
And the defendant knew that they were false.
Remember that.
The defendant knew that they were false.
The document goes on to state...
The defendant, President Trump, had a right, like every American, to speak publicly about the election and even to claim, falsely, that there had been outcome-determinative fraud during the election and that he had won.
He was also entitled to formally challenge the results of the election through lawful and appropriate means, such as by seeking recounts or audits of the popular vote in states or filing lawsuits challenging ballots and procedures.
Oh, so he could do what he did?
Really?
Well then, what are the charges you're bringing?
Here we are.
Three criminal conspiracies.
Segment four.
A. He is guilty ...of a conspiracy to defraud the United States by using dishonesty, fraud, and deceit to impair, obstruct, and defeat the lawful federal government function by which the results of the election are collected, counted, and certified by the federal government.
B. A conspiracy to corruptly obstruct and impede the January 6th congressional proceeding at which the collected results of the presidential election are counted and certified.
And C. A conspiracy against the right to vote and to have one's vote counted.
How did President Trump do that?
How did he obviate anybody's vote?
As we said back then, we want every vote counted.
Every legal vote.
We don't want fraudulent ballots.
We don't want forged ballots.
And we don't want illegally harvested ballots.
We want everybody's vote.
The opposite of what this charge is.
And to quote Kurt Schlichter, who immediately sent me this analysis that I quoted yesterday evening multiple times on Newsmax, everything in this document, all 45 pages of it, is protected by something called the First Amendment.
I can say whatever I like about any election as an American citizen.
I can say it was stolen.
I can say the Martians rigged it.
I can say it didn't happen, we live in the Matrix.
And guess what?
I'm protected in doing that.
You can say whatever you like about the election.
About any election!
In fact, if this were a crime, what is listed here, every prominent Democrat from Al Gore and his hanging chads of 2000 to Hillary Clinton, who today persists in saying, the 2016 election was stolen from me, every single one of those Democrats should be in prison!
So what is this really about?
It's about one thing and one thing alone.
Preventing the man, the only man, who can unseat Joe Biden from doing that.
Oh, and it's about you.

So where do we begin?
Let me run by you an attorney friend of mine who tweeted this out yesterday.
Tell me how wrong, how right he is.
He said, everything in Jack Smith's indictment is protected under the First Amendment.
Is that a good approach?
Is that what President Trump's team should begin with?
I think they should begin with a change of venue motion to try to get the case out of the most anti-Trump district in all of the United States and away from a very anti-Trump judge who was trained in a law firm that's extremely zealous and filled with a history of corruption.
So that's the first move that should be made.
The second move should be to challenge many aspects of the indictment, both on First Amendment and Sixth Amendment grounds.
First Amendment grounds are very important because what this indictment does is it criminalizes political lies.
If we ever allow lies by politicians to be politicized, Congress would have to meet in Allenwood Prison instead of in the Capitol because lies are common.
They've been common since the Alien and Sedition Act was passed at the end of the 18th century.
We honor two presidents, Washington and Lincoln, because they told the truth.
What does that say about the other 40 some odd presidents?
We don't honor them for telling the truth, because we know that lying is so common in politics.
And one of the most frequent lies is to deny you've lost an election.
I think many politicians believe it in their heart that they didn't lose the election.
I defended the people of Palm Beach County in the Gore case, Gore versus Bush, in which I to this day believe that Gore honestly won the election in Florida and was deprived of his victory by the butterfly ballot and other kinds of But to add to that, that line of reasoning, Professor, I mean, we still have.
The 19 Project is now coming after all the lawyers who defended Trump and is trying to
get them disciplined and disbarred, including me.
So we have not only our First Amendment is in danger, but our Sixth Amendment right to
counsel is in danger as well.
Yesterday was not a good day for America.
But to add to that, that line of reasoning, Professor, I mean, we still have, she did
it recently.
We have Hillary Clinton, President Trump's erstwhile opponent, who to this very day is
saying, literally, the election was stolen from me in 2016.
Does that mean that she could expect an indictment from Jack Smith as well?
I don't think so.
First of all, Jack Smith's not going to indict a Democrat.
Number two, she didn't take the steps that Donald Trump took.
He did take steps.
He tried to get a slate of electors that were different from the slate that was appointed by The governor and the legislature, but that's the way you challenge elections in America.
You put an alternate slate forward.
So what Trump did was he tried to challenge the election within the rule of law.
And one of the things about the indictment that's so shocking is they claim that people are not allowed to lie.
Well, the indictment contains one of the biggest lies in modern day politics.
It cites the speech that President Trump ill-advisedly gave on January 6th, and it leaves out, deliberately doctors the speech, and leaves out
the words, patriotically and peacefully, allowing the reader of the indictment to
believe that he incited the violence.
And a lie of omission is just as serious as a lie of commission.
And so Jack Smith ought to really wonder to himself why he had to lie in that indictment.
Why didn't he include those words in the indictment?
Why did he allow the public to believe, the people who read the indictment, that President Trump urged people to engage in unlawful and unpatriotic conduct when he, in fact, urged the opposite?
Is there not also an analogy to, what is it, the 1972 ruling Sullivan versus New York Times that meant that you basically as a public individual can't bring a libel case in America because you have to prove malintent that the person knew they were lying at the time they wrote the piece.
What Jack Smith has to do is to prove inside President Trump's brain that he was actually lying, not that he believed that there were problems with the election.
Is that not the bar he has created for himself?
Yeah, it's a brilliant analogy.
You should be a law professor.
You're right.
I was one of the law clerks on New York Times versus Sullivan.
And it requires proof of malice, which is reckless disregard for the truth.
And so, yeah, he has created a bar for himself, which I think will be very, very difficult to climb over.
I honestly believe that President Trump honestly believes that the election was stolen from I think he is completely wrong.
I think it was a fair election.
There was some corruption.
There was some distortions.
There were some votes that shouldn't have been counted that were counted in Pennsylvania, particularly.
But on balance, he did not win the election.
He believes he did.
And that is the key to this prosecution.
They have to get inside of his brain.
And have to prove that his motive was corrupt, not a good faith motive, in an attempt to undo an election that he honestly believed was unfair.
It's going to be easy to do that in the District of Columbia, which is the most anti-Trump district in all of the United States, and in front of this judge.
But I think if you got a fair judge and you got a fair venue, I do think that there would be a much Better chance for an honest verdict to be rendered.
We will talk about who the judge is and her connections momentarily but I'm just going to put a little codicil on my resume.
I think I've reached the zenith when Professor Dershowitz says I did really good legal analysis.
I think I've reached the peak.

They doctored a tape about my speech in front of the Senate in defense of Donald Trump.
Wow.
Well, you could explain, why did they create this completely unreasonable requirement that you have to demonstrate malice at the time of the libel?
I mean, that's just absurd, isn't it?
We're challenging it.
In our brief, in front of the 8th Circuit.
But why did that happen at the time?
What was the logic?
The logic was that you have to have breathing room for the First Amendment, and therefore the press has the right to be wrong and make mistakes as long as they're honest mistakes.
But the malice requirement has been taken to extremes.
And judges, including the judge in my case, said what they did was foolish, stupid, unprofessional, but you haven't proved malice.
So we're appealing that.
Now the Brits have the opposite extreme where the burden of proof is on the lie blur.
What would be the happy medium point?
Happy medium is to have to prove that it was a serious lie, a serious misstatement, and that You know, professional journalism wouldn't allow it to happen, what happened in my cases.
They listened to what I said.
I said that a president could be impeached if he commits criminal type behavior.
And they had three of their people on on the air saying, even if a president commits treason, bribery, extortion, murder, he couldn't be impeached, attributing that to me.
And, you know, the judge found that it was clearly false.
But he found that I couldn't prove malice, so we're appealing that.
And we're challenging the malice.
And you have to prove it by clear and convincing evidence.
That's one thing that should be obviously abolished.
It should just be proving it by a preponderance of the evidence.
Well, I hope it goes all the way to the Supreme Court and that you win.
That would be fabulous.
All right, so let's talk a little bit about the judge next.
We can talk about the venue again.
And then let's talk about Wilmington, what happened there.
And then if we have the time, what your expectation is for this case?
Because, I mean, given the amount of things the president's team could bring up, this could drag on and on and on, couldn't it?
It can.
There's no doubt it'll drag on.
Especially since the motion for a change of venue may be appealable if it's denied.
So we'll have to see.

Professor Dershowitz, we discussed so many Ways in which this indictment could be attacked in court.
How about the question of who the judge is?
This Tanya Chutkan who worked for Boyz Flexer for 12 years at the same time that Hunter Biden was an attorney there.
Should this woman not be recused on top of the fact that she's the most This is the most aggressive January 6th judge we have seen so far.
But the fact that she worked with the current incumbent's son, how can she be trying this case, sir?
Well, I think she should be recused.
The law firm itself has had a history of conflicts of interest.
I challenged the law firm and got a judge to rule that they had a conflict of interest.
They had another conflict of interest in, I think it was Florida, where the judge said, Any first-year student should understand that this would have been a horrible conflict of interest, and yet they went forward.
I think it's true that among all the big firms, this firm has been accused of improper conduct more than any large firm in modern American history.
And so getting trained in this firm is not training for Honesty and integrity.
It's training for corruption.
At least that's my opinion based on my experience with the firm.
I've been adverse to them over the years and basically for like 30 years I've been on different sides of cases with them and I've always regarded that firm as you can't accept their handshake.
You can't believe what they say in that firm.
How does that work?
Is that day one of the trial?
They request the judge recuse herself?
I think you do it in combination with a motion to change a venue.
What you do is you seek a change of venue and a change of judge at the same time and try to move the case to West Virginia or Southern Virginia, somewhere purple, where you get not only a decent venue where there's a chance, Remember, the District of Columbia is the most anti-trump venue in all of America.
And so you try to move the case and you try to move it, you try to get a judge from that area as well, picked out of the wheel and try to recuse this judge.
Recusing a judge is very difficult.
And, you know, lawyers are not supposed to attack judges, but I believe in the First Amendment and I have the right to say what I believe about this judge's background.
I also, I'm representing one of the people a young law student who went into the Capitol just to
protest.
And so I've been studying a lot of these January 6th Capitol cases,
and she has been regarded as the worst judge on those cases.
And so she seems to have a very strong point of view that is inconsistent
with the appearance of justice.
Remember, this may be one of the most important cases in American history,
and it should be presided over by a judge about whom there can be no possible complaints,
in an area where there can be no possible concerns about a lack of fairness and a juror of one's peers.
This has to be a trial that not only is absolutely fair, but that appears to be fair.
And so far, it's going down the wrong direction, wrong place, wrong judge, wrong indictment.

What if he's convicted and sentenced to prison?
Can he rule the country not from the Oval Office but from behind bars?
These are questions none of the framers had in mind when they wrote our Constitution.

I told you a story about how your pro-life activist And you protected your 12-year-old son from a loony, you know, pro-death worker at a Planned Parenthood in Pennsylvania.
You were charged with a misdemeanor assault for protecting your son from this person, which was thrown out, dismissed in a local court.
And then what?
Two, three, four months later, the DOJ, Biden's FBI, decided nevertheless to come raid your home In front of your children.
What have I left out of the story?
Let's see.
Five days after the dismissal in state court, I was served a target letter saying I was a target of a grand jury investigation under the potential indictment under the FACE Act.
Now six months after that, I had a massive high-risk raid on my home.
So I presume you first received a letter from the FBI saying, please come to this field office and surrender yourself, and you refused to do that, right, Pastor Howe?
No, no.
I didn't refuse.
My attorneys reached out and they said he's a peaceful man.
We'll bring him in to you.
No need to bring an agent out to his house.
We'll bring him right to you.
Oh, and by the way, you can pick him up on the street every Wednesday because that's where you served him.
And there's case law in your own district against indicting him.
But again, should you want to indict him, we'll bring him to you peacefully.
And instead you get your house raided.
How did that happen?
Were these officers, were these agents actually armed?
Did they put you in handcuffs?
What happened?
Sure, so they heavily banged on the door, didn't even announce themselves.
I came to the door, it was 6.30 in the morning, it was dark in Bucks County, Pennsylvania, where I live, and I asked who it was.
They did tell me it was the FBI.
I opened the door, and then they had M16 guns, at least five agents on my porch, and then we had additional personnel on the property, about 20 federal agents and state troopers, SWAT gear in the back.
Two battering rams, heavily armored vests, ballistic helmets, ballistic shields.
And then they didn't even really respond when I came out.
I said, what are you doing here?
And they said, well, you know why we're here.
And I said, well, I don't know why you're here.
And they didn't really answer much.
And I said, well, you're here because I rescue babies.
And they didn't say anything to that.
And then I looked at him straight in the eye and I said, you wouldn't be here if the Trump administration was in the White House.
And they didn't even say anything to that!
And were any of them apologetic?
Did any of them say, we don't really want to be doing this Pastor Hal?
Nah, no one had anything to say at all.
My wife came down and said, do you have a warrant for his arrest?
And they said, we're taking him with or without a warrant.
And that's when you know that... Hang on, hang on.
Did they not have a warrant?
When they had the guns pointed at me and when my wife requested the warrant, they said we're taking him with or without a warrant.
Now after I was cuffed and put in the SUV with an FBI agent, they did produce a cover sheet to an arrest warrant.

It's a cowardly deal.

I checked it out and it is.
12 years before becoming a federal judge, 12 years at the law company Boyz Flexer, one of the most corrupt attorneys outfits in America, where she was colleagues with Hunter Biden.
I'm sure it's just a coincidence.

And this is why it has to be stopped.
And this is why the sworn promise that every candidate, because President Trump will do it, but every other candidate who dares utter a word about this needs to say that they are ready to go in and clean house because this is blatant.

They just don't care what it looks like!
They absolutely do not care.
And don't think for a second that any of that is coincidental.
Merrick Garland has been compromised.
DOJ is compromised.
Thank God he is not a Supreme Court justice.
That is something I will thank the old codger Mitch McConnell for.

And, you know, you have to also add in that New York Times story that came out just about a year ago.
And, you know, take what you will with the New York Times.
But the story is making its way around the Internet right now that says they reported back in the summer of 2022 that Joe Biden was becoming frustrated that Merrick Garland had not yet started to prosecute or go after Donald Trump.
Well, what's happened?
Now they're going after Donald Trump and they're coming up with all of these crazy charges as Jack Smith should be ashamed of himself.
He is like pawn scum that he comes out there and especially with the most recent set of charges where he basically says, well, it was misinformation that he was giving to try to gin people up.
Is that wrong?
Because then let's start taking everyone else into the same realm and let's start charging Hillary Clinton and John Kerry and Al Gore.
My goodness, the Trump plan, even after the 2020 election, was developed by the Kennedy family and used by Democrats in the 1960 election.
It was used again in 2016.
It was used throughout our history by Democrats.
It was the same plan This scheme that Democrats like to say President Trump cooked up to try to subvert our election.

It's all ridiculous.
They are making this a political war.

The most jarring thing about this indictment is that it basically just accuses him of disinformation.
This is a disinformation indictment.
It says that you were spreading falsehoods, that you were undermining the integrity of the election.
That's all part of the First Amendment.
On the face of it, that's what the indictment says, and you can tack it on that, because if that's a crime, then Adam Schiff should be in prison for the Russia hoax.
Everyone should.
Hillary Clinton should be in prison for saying, to this day, the election was stolen from her.
But the fact is, it's not actually a disinformation issue.
It's a First Amendment issue.
Why?
I know President Trump.
He believes the election was stolen, as do I. Guess what?
You can't be put in prison for that belief.
Yeah, no, you're absolutely right, and I believe it too.
And look at every other thing that they have thrown at President Trump, that he has said that people have called misinformation that turns out to be true.
In fact, most recently, he was vindicated for the first impeachment when he made the totally perfect phone call to Ukraine.
Looks like, after all, he was right.
And we find out a few years later, but the damage, or at least they hope, the damage has already been done.
But you know what?
This is not a candidate, Joe Biden, is not a candidate that People think is a very strong political leader.
He is falling apart at the seams and he's corrupt.
And so I don't believe that he is going to drive a lot of momentum.
I think you are going to have more momentum in the general election because I believe his political bet is that he wants to see Donald Trump be the nominee because he thinks that he can take him.
But I think he's wrong.
So I'm curious on this because I go hot and cold.
I was thinking about this issue this morning.
They hate him.
But don't you think after what they did under the cover of COVID, with all the 80 million mailed out ballots, don't you think they're actually afraid of him?
I'm not sure I buy this thing that Democrats want to run against.
I think they would think it would be much easier to defeat DeSantis.
I don't want to put you in the mind of the Democrats, but are you leaning to this thing that they actually want President Trump as a nominee?
Well, the reason I believe this is because, and look, I can get into the mind of a Democrat, it's dirty and dark in there, but I go in there every once in a while and sneak in with my flashlight.
And I really think that they feel that they can drum up so many people that hate Trump, because think about Democrats.
Democrats right now hate President Trump so much from all of the information that has been thrown at them, that they're actually justifying that Joe Biden can be corrupt, and they don't have to call that out because, oh, Trump is bad.
So, I think that there is a very simplistic way of thinking for Democrats, that they're going to be able to rehash the anti-Trump stuff on the Democrat side that will maybe help get them through.
I think that they're wrong.
Look, while I'm telling you what I think they are thinking, it is not the brightest.
Because I think they would have a much easier time going against the dud Ron DeSantis.

So, President Trump is attacked once more by a politicized DOJ, and whose side is Pence on?
Pence is on the side of the deep state.
And by the way, when it comes to, you know, doing their constitutional duty, He didn't do his on January 6th.
He wasn't asked to overturn anything, Jen.
He was asked in the four states with the suspicious reversal of presidential vote counts to send their vote tallies back for recertification.
I'm done with this man, Jen.
It is really tough because I have thought that Mike Pence was a nice man, but this tweet, it put the nail in the proverbial coffin.
And it's not only wrong because he is siding with the DOJ, which has weaponized itself against President Trump.
But it's also stupid.
It's short-sighted because the base of the Republican Party is not going to join forces with Mike Pence, who's saying to put the Constitution first.
Maybe that tweet should have been directed at Joe Biden.
Because, of course, we all believe that the Constitution should come first, but that's not what's happening here.
They are trying to throw the book at someone that they are afraid of.

When a leading American politician in front of an audience, including black Americans, uses the phrase of the other party, they want to put y'all back in chains.
How did that happen?
Somebody should write a book with that title!

First things first, we're going to talk about the book.
Let's put it up on the screen, of course.
Somebody had to do it, but we're very glad it's Horace.

How Joe Biden's policies hurt blacks.
I would say not just Joe Biden's, but the rest of his party.
Let me just go back in time for a little bit.
So I came here 15 years ago, Horace, as an immigrant.
I chose America.
I got in line.
I paid my money.
I waited.
I took the test.
I passed the test.
I took my oath of allegiance to the U.S.
Constitution.
It was naturalized.
When I started working here 15 years ago, I was a professor for the Defense Department.
My classroom was full of foreign nationals, U.S.
military, black, white, purple, you name it.
I really didn't see racism in America.
Of course, there could have been the odd idiot who was a racist, but as an issue that was endemic or that was a national issue, it just didn't exist.
Then Obama was elected, and things changed.
Am I seeing things incorrectly?
No, you're not seeing things incorrectly.
In fact, what we're seeing is history repeat itself.
My grandparents, my great-uncles, great-aunts, grew up in the Jim Crow South.
When the world wasn't watching, blacks and whites had to get along.
If there was a big freeze, blacks and whites came together.
But the elites, the opinion makers in the South imposed on everyone else a requirement that we act as if we don't have a regard for one another.
Because?
They profited from it.
I'm going to give a quick story, and that is that my great uncle wanted to buy a Cadillac.
He had finally saved up enough money, and by the way, there was a time when people paid cash for their cars.
Where was this?
Where was this?
This was in East Texas.
Okay.
And he went to the dealer, and the dealer said to him, in 1949, Sir, I will not sell you a car we don't sell to blacks.
He had to go to Chicago where he went and could go right in the dealership in the front door and buy a car.
Now let me explain something to you.
Everybody focuses on he couldn't buy Cadillac.
If you are a dealer or a salesman working in East Texas, You sold fewer vehicles because you couldn't sell to everyone.
We often place all of our attention on people like my uncle who were punished because of their race.
But not the dealer in Chicago?
But not the dealer in Texas who was punished because of his race.
What we're seeing today is a reprise of this same concept and it happened when Obama first became president and it has become much more pronounced.
We have shifted what color is going to be the favorite color.
But the phenomenon of everyone suffers, regardless of color, whenever societal elites pick racial winners and losers.
Can you unpack that, that concept of the favored color?
So, if you look at the situation now in America, what's the favored color, Horace Cooper?
Oh, it's pretty obvious that white men, especially, and whites generally, are the disfavored.
Just as my uncle, my grandmother, might have been expected to defer to non-black people or to whites, today, in the workplace, in social settings, that same sort of deference is being imposed.
And then this administration is pushing with the power of law.
Their efforts are not unlike regulations that prevented you from being
able to swim in a swimming pool in 1952 just because of your race. Now today they like to tell us,
the left, that they're the party of science. Then there was no science behind this and today
there's no science behind this.
Well, in fact, it's the negation of science.
I think we've played it four times already since it came out last week, this incredible clip from the Congress of Matt Gaetz interrogating the superintendent of the U.S.
Air Force Academy, who has a fellowship at the Air Force Academy, which you cannot apply to if you're cisgender.
I hate the term.
If you're heterosexual and white, Yes.
You cannot apply, which I thought was illegal, Horace Cooper.
Absolutely, I do believe that it is illegal.
I'm confident that that is unlawful.
The federal government and state government may not use public resources in this way.
I'm confident of that.
So walk me through it, because I was just living it.
I was trying to, you know, I just arrived, two small kids, trying to make sure we made the rent check.
I was on a government wage.
It was, you know, D.C.
is the cheapest place to live in.
What happened under the eight years of Obama?
So what are the mechanisms that we went from comity to racial division in less than ten years?
Okay, so the number, if people ask me, sometimes even if they don't, I'll volunteer this.
My number one criticism of Barack Obama, not his completely destructive takeover of healthcare, not his attempt to shut down our energy sector, not his desire to tax people who have worked hard and put out efforts at risk by claiming you didn't build that.
My number one complaint was that he is a living, breathing example of what's possible in America, and he denied it!
We have second-graders, third-graders, fifth-graders, high-schoolers who need to hear that in America, regardless of your race, regardless of your family background and your circumstance, you can rise up to the most powerful position in the world.
He held that very position and he lied to people and said, America won't let you have this.
Now, deny what you can see and people, well let me say this, effort and energy and work, they can be hard.
And if someone tells you none of that will work, A lot of people won't put out the effort and the energy and apply themselves.
So he's actually making it worse.
Absolutely.
Disenfranchising people by discouraging them.
Yes, yes.
And when he could be an exemplar of what is possible.
and then beyond that an active...
So then his EEOC, his Department of Justice, first they started with our law enforcement.
People don't realize this, but there are certain judicial decrees
that control our police departments and limit their ability at crime fighting.
He broke free from nearly 20 years of America not going down this route,
crippling and paralyzing our police departments, trying to restrict their recruiting.
And then he started pushing universities that they should report
on what their racial outcomes were with regard to admissions.
Whatever is reported on, people focus on it, and of course they start manipulating.
The Department of Justice, even as the numbers of hate crimes against blacks showed a sharp decline during his administration, they started ramping up, trying to dig up any kind of case that they can find.
In fact, Race hoax was not a problem in the early 2000s.
It wasn't a problem in the 90s.
It wasn't a problem in the 80s.
During Barack Obama's presidency, the race hoax phenomenon became a real thing.

Horace, before we go, we've discussed what Obama did to not just exacerbate, but to really generate racial tension in America as a man who could have done so much to build upon what had been achieved We'll get to your latest work, which focuses on what Biden has done, but one thing I must address in our historic overview, can you just talk to us about the myth of the Southern strategy, that the Republicans were the racists, the Democrats never were, and then there was some kind of switch after Nixon?
So, I've often said this, that one of the distinct burdens that people on the right carry, that the progressives don't, is that we can remember what happened last year, ten years ago, or even yesterday.
Whereas for the progressive, every day is a new day.
One of the reasons that they have embraced with gusto the new racism of the 21st century is they forget the old racism of the 20th century.
It's interesting to see that here it is 2023 and the racism that existed in 1923.
It was dissipating rapidly, not because people were being forced to change, but because
their mutual interests were encouraged.
When you have a Calvin Coolidge, you have policies that encourage people to apply themselves, to put forward risk.
More black millionaires were created during his tenure.
In fact, you have to go all the way to the Reagan administration to eclipse the number of black millionaires.
Now, this is when a million dollars was really worth something in the 1920s.
What the left did in the post-Calvin Coolidge era was highlight that Wait, since the Civil War?
We consistently are not able to hold office.
We're getting the presidency one out of every 20 years of presidential elections.
One of the largest congressional majorities included the Republican Congress in the 1920s.
And so, they started off on a wedge.
I've written about this, the Fair Labor Standards Act.
Oh, we're told that if Jesus were writing in the 20th century, he would have written the Fair Labor Standards Act.
If you look at it, what you'll see is its supporters, people like Senator Black of Alabama, a Klansman who ended up going to the Supreme Court, wrote this to protect white workers.
Because there was a time when people thought Well, those white workers don't work as hard as those black workers.
Black workers will come in early, they'll stay late.
We've got to get the government in here to stop it.
And as a result of their actions, they have crushed the impression that America has of who black people are.
You could go all the way to the Great Depression, and you see, since the end of slavery up to the Great Depression, black men were the most likely to be employed of any other group.
Today, well, starting with LBJ, Black women were encouraged to marry the government, kick their husband or men to the curb, and not have a regard for the importance of this thriving family, that destruction of the family.
And then all these Southerners worked Not because they genuinely believed in the supremacy of one race over the other, but because it served their purposes.
And this is true today.
The point is, Emmett Till was killed because people were willing to put their political priorities first.
Today, Who is going to suffer?
Who is going to die?
Not because of any genuine look with your eyes, touch with your hands.
There is no difference between black, white, or brown.
And yet, it serves the political purposes of the same group today that it did a hundred years ago.

I'm going to have a few legal questions for you next, but let's do a little bit of amateur
psychiatry.
When we look at what the left has wrought, and I think of my former Salem colleague Larry Elder's movie, I think it's the second one, Uncle Tom 2.
The pre-title, the pre-credit scene, It's just color home movies of black families in America from the 30s and 40s and 50s.
And it's stunning.
The prosperity, the wealth, the cars, the clothing.
It's just it breaks my heart to see that level of prosperity now absent.
The idea that what?
60 years ago, 20% of births in the black community would be out of wedlock.
Now it exceeds 70%.
Let me ask you if you can, through your work, your book and everything you do at Project 21, What is the left doing with the Great Society, with LBJ, with the trillions that have been expended?
Is it grift?
Is it control?
Were they well-meaning?
Or was it really shackling the black community, not to the plantation from whence the Republicans had Okay, here's what I would say.
They're coming for you.
You see, you go through a scale.
You start with one group, then you do the next group, and you do the next group, and the next group.

The real goal is a totalitarian presence of government controlling every single aspect.
Now, there has been a recent willingness to use race as a pretext for getting more government control.

Mind you, Your typical segregationist said racism was good for blacks and it was good for whites.
Those voices that destroyed that advocacy, that destroyed the black family, they haven't stopped.
In fact, now white Americans are finding some 30 plus percent of their children are born out of wedlock.
That plan will not stop until it reaches the same.
Black Americans are the canary in the coal mine.
What we're looking at is a long and ambitious scheme for greater and greater and greater government intrusion.
So the blank dependency on the government is just a petri dish to make everybody do it?

Let's talk about the current incumbent of the White House.
The new book has put you all back in chains.
Why did you write this book?
He's been in office for two years.
What is your objective here with this book?
So, several people have asked me that question.
My audience is not primarily black Americans.
I welcome all readers.
My audience isn't primarily conservatives.
My audience is those that think.
That government should make a special effort to set up policies to alleviate the problems in black America.
And my point in writing the piece is showing that it doesn't work.
In fact, it has made things worse.
We now have, as I mentioned in my book, fewer new cars on the highway than we've had in a while.
In fact, under the Biden years, cars are older than they were under the Obama years.
Which set a record in how old they were.
People aren't buying a 5-year-old used car when they need a car, they're buying a 9 or 10-year-old car.
They don't get as good as gas mileage, they're not as safe, and they're not as reliable.
Not because they're made shoddily, it's that the life is out of them.
Barack Obama and now Joe Biden have created an economic environment where we're rolling back.
Instead of more Americans getting the home of their dream, fewer and fewer Americans.
In fact, the Federal Reserve says it's policy.
That we're going to raise interest rates so that we stop people from wanting to rush out because it's overheating the economy.
Mind you, standing up for your family, making sure they're secure in a great neighborhood, that's bad for America.
And so I'm going to make it all but impossible.
And it is working.
There's a gap.
Between black employment and the average employment in America.
It is widening once again.
And it's precisely because we have an Air Force leader who is going around trying to say, we're going to have programs that are specifically seeking racial winners and losers.
You can do it with solar, you can do it with automobiles, you can do it with construction.
Racial winners and losers always makes it worse.
But your argument with the book is that it's not just blacks they want to put back in chains, they want to put everybody in chains.
That's correct.
Look and see what is happening and you can see what is about to happen.
And it's inevitable is my point.
It's inevitable.
If you go down this path, this is where you go.
If it's about power and the exploitation of others to gain power, this irrespective of your skin color, this is where you will end up.

You are a former law professor.
That's why talking to you is so pleasurable because you have such It's like I'm in the courtroom.
Your arguments are always cogent and transparent.
Let me get some legal analysis concerning the President's son.
What happened last week in Wilmington in a court is stunning.
Firstly, a member of his defense team impersonates a Senate staffer to try and get an 800-page amicus brief.
So, the quick answer is no.
the docket that was bad for her client.
And then the judge isn't shown the universal amnesty sweetheart deal that the DOJ is trying
to get rubber stamped.
And she used the phrase, I will not rubber stamp this document, kicks them out of the
court for 14 days.
I have to ask you, have you ever seen the like of this before in your profession?
So the quick answer is no.
But the more complicated answer is, all this judge did was simply say, you're going to
have to tell me exactly what we've done.
And I'm going to look at certain sections and ask questions.
And that's where the disagreement occurred.
It was in the interest of the Department of Justice to be opaque.
Yes.
Defense team, you should wink, wink, nod, nod, understand that we're giving you a sweetheart deal.
But when the judge asks us point blank, well we can't actually say that.
And then once the defense team hears you say, No, we're still investigating.
We reserve the right to prosecute.
Hold on!
That wasn't our understanding.
No, it was implicit, not explicit.
We have a problem.
I predict that they are still going to end up with some sort of nearly sweetheart deal because the alternative is jail.
There is a trial and then jail.
Well, when you have this trial, it will be jail.
And then, as a result, they've kind of created their own catch-22, because if they have a sweetheart deal, I don't think Judge Noriega is going to agree to a sweetheart deal of any substance, and then allow the DOJ to also say, but he remains under investigation, so Congress can't ask anything of him.
So, the prosecution said to the judge, He is still under investigation.
That was a violation of the understanding, it wasn't explicit, of the sweetheart deal.
So the point is, while the judge may, I think judges don't really want to break up These, and the reason is, there's a prudential benefit.
We could end up with way more trials if we don't have plea agreements.
So judges for judicial efficiency often will accept them.
All that she did was insist.
Let's say out loud so everyone understands.
I think that he is either, if he doesn't accept the new limitations, He's going to have to reach a plea agreement where he admits a felony.
So, not admitting the felony means accepting a less sweet of a deal.

Alright, Horace, last question or two.
You've written this book about put y'all back in chains, and you've made it clear that this isn't just about black Americans, it's about all Americans, given this propensity for the left to create dependency.
Let's talk about the challenge for conservatives, those who believe in the pursuit of happiness and individual liberty.
What is the biggest thing that a conservative, that a Republican, a local activist, a local politician could do to connect with the black community if they're not black?
Where does that conversation begin in its most easiest form?
Okay, so before I answer that, I would like to just comment a little bit more on that trial, that hearing, that lawyer that reached out and attempted to manipulate.
Now, if I'm sitting in my con law class and I'm telling my students, you're going to be practicing.
And when you do, you have to remember this judge is as close to God as you might see in this life.
What you don't do, Or little hijinks, like calling to her clerk and saying to her, saying to that clerk, I am so and so, please make this change and do it now.
According to the actual report, the person was haughty, the person was angry, and the person insisted that the action occur immediately.
This judge not only has issued an order that no Communications by these two parties, including the prosecutors, may occur with the clerk.
They must all go through her, and that means any misrepresentation could be subject to sanction.
Be very, very careful.
Now, I say all of this occurred because people are a bit out of control on the left.
You have to play by the rules.
I just wanted to make sure people understood that that was a significant breach.
It was.
And the judge is now looking what we used to call a jundist eye.
At everything that's happening in this case, Hunter Biden has a far less open-minded judge overseeing this with these hijinks.
And it has nothing to do with politics.
It's because you've contravened the way that a case should be managed.
That's right.
Okay, now to the other point, school choice is one of the biggest issues that has universal support among black Americans and conservatives.
I've said this before and I'll say it again.
Black Americans as a community are more likely to believe that faith is central than the population at large.
We, in the movement of conservatives, have allowed ourselves to be quieted to be pushed to the periphery, and we don't talk faith enough.
We don't have to engage in some sort of Protestant jihad, but we ought to, in fact, be free to express that we believe in a Creator, that He loves us, and He's interfacing with us on a regular basis.
That is a conversation that we need to have more frequently.
Again, we ought to talk to Black America when Black America is organized in ways where we are.
We should spend a lot more time talking to sheriff groups, deputies groups, police membership organizations.
Black Americans are overrepresented, according to their population, in law enforcement.
Interesting.
We ought to be making a special effort to go to those groups and talk about these things.
I came on your program when black Americans were asked during the summer of love that cost nearly $10 billion in insurance claims.
Whether they wanted more law enforcement or less, they said overwhelmingly they wanted more law enforcement.
We see where there are areas, but we often think, no, no, you're this.
You're this different thing.
That's not the approach.
Find out where the similarities are and focus on making a presence there.
I love that.
Very solid advice there.
School choice, as well as reaching out to the law enforcement community.
It's stunning when you hear things, for example, that more than 50% of the Customs and Border Patrol are actually Hispanic, are actually minority, so the majority is the minority.
Just think of, you know, a target-rich environment.
