As president, all of my documents fell under what is known as the Presidential Records Act, which is not at all a criminal act.
Everything.
It's all judged by the Presidential Records Act.
In this whole fake indictment, they don't even once mention the Presidential Records Act, which is really the ruling act.
Which this case falls under 100% because they want to use something called the Espionage Act.
Doesn't that sound terrible?
Oh, espionage.
We got a box.

The Espionage.
The Espionage Act of 1917.
I think it was put in there about World War I.
Boxes.
And by the way, Biden's got 1850 boxes.
He's got boxes in Chinatown, D.C.
He's got boxes all over the place.
He doesn't know what the hell to do with them.
And he's fighting them on the boxes.
He doesn't want to give the boxes.
And then they say Trump is obstructioning.
He's obstructing.
No, it's a sad, sad day for the country.
How that man maintains his composure and sense of humor in the face of what they are doing to him is, I don't know anybody else who has that capacity right now in America, at least not in politics.

Let's talk about it.
Let's get down to business.
I have in my hand the almost 40-page indictment against President Trump.
I've written a piece on it on my Substack.

But here, I'm going to give you... I've got my notes on the back.
I'm going to give you the essentials that you need to be aware of so you understand what's really going on.
It's garbage.
It's rubbish.
Not only that, it's evil, it's cruel.
The fact that not only have they gone after President Trump, but after his butler, his so-called body man, Waltine Nota.
We called him Walt in the White House.
He was the Navy aide that would look after the President in the White House.
He took him with him to Mar-a-Lago and to Bedminster after he'd left the Oval Office.
The fact that they're indicting him With felony charges because what?
He moved documents around a secured compound?
Let me tell you what's really important about this document.
And I doffed my cap to Grant Stinchfield, who I think on Friday night or Saturday did a very short video on his Instagram account where he nailed it.
And I called him up and I said, Grant, you get it.
The indictment is important for what it doesn't state.
Not for what's in it, which is a version of events.
It could all be lies.
It probably is.
Why?
Because it's written by the Department of Justice.
By people who hate President Trump.
By an entity that has been trying to take him down for the last seven years.
But what's missing from it?
Well, very importantly, what's missing is the fact that you can't charge a president with felonies regarding classified information.
It is not technically, legally possible.
Why?
Every president, as I mentioned before, maintains till their dying day the highest level of security clearance.
Jimmy Carter, Obama, Clinton, GW.
They all have their clearances, as does my former boss.
Secondly, The fact that the 1978 Presidential Records Act is a civil statute, not a criminal one, means there are no charges that can be brought against a former president with regards to classified information.
Why?
Because if that were possible, Congress would have had to brought a law that supersedes and post-dates that 78 Act, which is predated by the Espionage Act, by the National Defense Information Act.
And it says very simply, if there are transgressions, if there are issues, they will be regulated administratively between the archives, between the federal government and the said former president.
You can't manufacture crimes out of thin air if the statute that covers the individual is a civil statute.
And then lastly, why don't they tell you the fact that the compound in where the documents were being held was secured by the Secret Service?
Why don't they tell you that the FBI inspected it and said yes this is fine But could you upgrade the lock to that archive?
And they said, yes, FBI, we will do that.
And they did it.
The fact that boxes were moved from one location to another is utterly wholly irrelevant.
Why?
Because the whole building is secured by the Secret Service.
Tough men carrying loaded weapons.
What's this really all about?
Scott Adams has had his issues over the years, but he published this video a few days ago, and it's the real question.
It's a lengthy cut, but it goes to the heart of the matter.

Can we really, as a country, do you think you could send Trump to prison Over documents that the public is not allowed to see.
Now, I don't think anybody framed it that way until I did, you know, yesterday.
But just hold this in your head.
This is not Watergate, right?
With Watergate, we said, here's the building, here's the people, here's the break-in, that's the crime.
Everybody's looking at it.
And then even Republicans.
You know, not all of them.
But enough Republicans even said, yeah, OK, that's a crime.
No doubt about it.
We all saw it.
That's a crime.
But what happens?
What happens if the public is not allowed to see the evidence?
Because these are secret documents.
What if they're just described to you sort of a general way?
Oh, it was a document about an attack on a country.
You good with that?
Are you OK that the person who was the president of your country Would go to prison because somebody said they saw a document that they're describing in a general way.
No.
No.
Nope.
That is not acceptable.
That is too far.
Watergate was not too far.
They showed the evidence.
The people judged it.
The Congress judged it.
We got we got past it.
But if you put a living ex-president who's running for office in prison, in prison, and you don't let the public see the evidence, because it's private, it's all secret stuff.
No.
Let me just say this as clearly as possible.
No.

No, that's not going to happen.
Now, I don't know what will happen, but I'll tell you what's not going to happen.
You're not going to put the president in jail, let's say prison, without showing us the evidence.
Now, if you can't show us the evidence, **** you.
Do something else.
Figure it out.
Figure it out.

But he's right.
Are you going to trust the DOJ with evidence you're not allowed to see?

Commissioner, let me share just a very brief clip with you with Molly Hemingway, which goes really to the heart of the matter with regards to any indictment that comes out of the Department of Justice against somebody who has any connection to President Trump or who is a well-known conservative.

We had the Russiagate collusion hoax, in which the Department of Justice participated in a Democrat-invented conspiracy theory to say that Donald Trump was a traitor.
This week, we learned that Joe Biden was credibly accused by a very serious whistleblower of a $5 million bribery scheme, and the FBI worked to cover it up.
So you're absolutely right that people are talking about the broader context, because that's the most important thing here.
Nobody takes the Department of Justice seriously so long as they fail to include exculpatory evidence and they participate in this kind of hoax over and over and over again.
Isn't Molly right that after the last seven years, why the hell should any American trust anything that comes out of the DOJ?
I'm sad I have to say, but isn't she right, Bernie?
Yeah, she is right.
You know, think back five years ago, Sebastian.
If you go back to my interviews five years ago, I basically said then they're going to go after his friends, his families, his supporters.
And, um, and then when they can't get them and they can't turn them, then they'll go after his lawyers.
And then when he can't get his lawyers, then they'll do him in a criminal way.
Everything I said, including the lawyers, every lawyer has been targeted, you know, violating his attorney-client privilege, anything and everything under the sun, right?
Every lawyer, nearly everyone he's had, has been targeted in some way.
Now we're down to, you know, this prosecution by the feds that would never, ever exist.
If Donald Trump wasn't the primary candidate for 2024, it just wouldn't happen.
You now have the head of the Democratic Party, Joe Biden, has basically sent out and directed that his primary opponent for President of the United States, Be targeted and prosecuted and that's what Jack Smith has done at the direction of the Attorney General.
This has turned into, I almost feel like we're in Venezuela or Iran or China or somewhere where they do this stuff consistently.
My fear is what happens when they can't get him?
What happens if he's not convicted?
What happens if they can't put him in prison?
That's my greatest fear.
To your point about everybody around President Trump, everybody who works for him,
in this indictment, for those who haven't read it, it talks about
Donald Trump, Attorney 1, Donald Trump, Attorney 2, and they're basically targeting... I mean, I thought we had
client-attorney privilege in America.
The DOJ is targeting the people who are supposed to be representing the President as his attorneys.
When did that get to be okay?
That got to be okay in the last eight years.
That's the problem.
That got to be okay in the last eight years.
There's a couple, you know, these types of things the American people should focus on.
One, attorney-client privilege exists only when your opponent is not in power, right?
Your political opponent is not in power.
The second thing is, you don't really have the constitutional rights you think you have if you don't have the right, the manner in which to pay for them.
In other words, if you don't have the money, look at Rudy Giuliani.
Rudy Giuliani has been sued and sued and sued, double sued, triple sued, you name it, all because he represented the president.
They're trying to bankrupt him.
He's lost $40 or $50 million in business.
His legal fees are astronomical.
They are doing this intentionally.
And if you don't have the money to pay for a defense, You're done.
You're finished.
That's why you have all these J6 people taking pleas and sitting in prison.
Because they don't have the money to pay for their defense.
And that's exactly what the Justice Department and Joe Biden wants.
Annihilate everybody around Donald Trump, whether it's his supporters, his colleagues, his friends, his lawyers, his family.
Doesn't make any difference.
Anybody and everybody around him You have to annihilate them because you will shut them down, you will bankrupt them, and you will shut them up.
And that's the biggest issue, shutting them up.
It's not DC, it's not even Virginia, it's Miami.
I don't even trust that.
Your expectation that he could get a decent trial in Florida, Commissioner?
Well, you know, the bottom line, he shouldn't even be on trial.
Yeah.
He shouldn't be on trial.
You know, I'm hoping That the his attorneys will take the prosecutorial misconduct, you know, the almost extortion where, you know, they're telling a witness that his attorney, the witness's attorney, if you want that judgeship that is sitting on the president's desk, you better make sure your client flips on the president.
That's number one.
Number two, the grand jury Misconduct inside the grand jury was outrageous.
Timothy Politor, one of the president's attorneys, was in the grand jury and outlined an outrageous case of misconduct by the prosecutors.
You take the fact that the president himself, Joe Biden, is under criminal investigation by the FBI for a $5 million bribe, not to mention probably 60 counts of criminal activity by his son, who's his partner in crime.
You take all that stuff, take it before a judge and say, here's the head of the Democratic Party.
Here's the head of the Republican Party.
And this guy is running in prison.
The Republican candidate.
I think it should be thrown out.

We've been on the same Twitter space multiple times, but we were on after the Bragg indictment, and you were vociferous.
You were as clear as crystal that this is wrong, this is political, and it's bad not just for conservatives, it's bad for the fabric of America.
I have to ask you to respond to what we've witnessed in the last four days and give us your take on what's happening in Miami tomorrow, Vivek.
So, Seb, I'm actually going to be in Miami tomorrow.
I'm going to be hosting a press conference at 1030 a.m.
discussing something that I filed today, which is a FOIA request, a Freedom of Information Act request, demanding answers on what the mainstream media is not asking, which is what did Biden tell Garland and what did Garland tell Jack Smith?
And why am I doing that, Seb?
I read the indictment.
It reeks of politicization.
I could get into technical reasons why, but just a few reasons off the bat.
No mention of the Presidential Records Act, the main statute that's relevant here.
No mention of the fact that the classification scheme is itself created by executive orders rather than by actual congressional statute.
Quoting Trump from the 2016 campaign trail, saying that he would go after Hillary Clinton for classification breaches.
Yet, by the way, his quotes from a campaign have no place in an indictment.
Yet even if they do, you should at least also quote him.
From November of 2016, after he won the election, when he said he wouldn't prosecute Hillary Clinton for those same violations.
So the list goes on, but this is a politicized document, it is a politicized indictment, part of why I really don't believe much of anything that's in there.
We've been given very little reason to believe what's in there.
But explain!
That's why I'm also getting to the bottom of actually asking the questions with the FOIA request that I submitted earlier today.
But you said at the beginning of that CNN cut, and I'm going to ask you again, Why are you doing this?
You're a competitor to President Trump.
This is the amazing thing about what you're doing.
Well, I mean, to be honest with you, I'm going to be just totally frank.
It would be a lot easier for me to have a path to the nomination if Donald Trump were not in this race.
This is not about Donald Trump.
Martin Luther King actually said it famously, an injustice somewhere is an injustice everywhere.
And if they can do this to Trump, they can do this to any American.
You want to just talk about somebody else?
Julian Assange sitting in prison in a foreign exile while Chelsea Manning, the government agent who leaked to him, had her sentence commuted by President Obama because why?
She's a member of a favorable political class.
She's trans.
You want to talk about the Antifa protesters?
Violent, actually.
I'm generous in calling them protesters.
Rioters across this country go completely free while peacefully those who marched, at least those who were peaceful on January 6th, many of them still punished.
There are two tiers of justice.
And so this is not even about President Trump to me.
It's about a two-tiered justice system based on political beliefs.
And I want to appeal to the left here, Seb.
For 160 years, or 160 years ago, we did have a two-tiered justice system in America based on race.
We overcame that.
The left still obsesses about that today.
Well, today we have a two-tiered justice system based on political beliefs.
And I stand on the side of principle against it.
And so, yes, it would be easier for me if Trump wasn't in the race.
Other Republican candidates have Have gloated about this or quietly or even some openly happy about it.
Yeah.
I view it differently.
This is sad.
And I would rather win this election.
I'm in this election to win, but I want to do it by persuading the people of this country to come along with my vision, not by the administrative police state eliminating the competition from running.
That is not America.
Well, what a great phrase, the administrative police state.
And you're absolutely right.
We used to have two tiers of justice, depending on your skin color.
Now it depends as to whether you have an R or a D after your name.
Vivek, we were taught, we were preached at for the last three years by Biden.
He did it in his inauguration, that he would be the great unifier He's doing exactly the opposite.
He's targeting Republicans.
He's flying in premier place a flag that doesn't represent America from the balcony of the White House today, yesterday, and this month.
Tell us about what you would do to actually seriously be a unifier.
What is Vivek's campaign about?
My campaign is about reviving the ideals of the American Revolution, period.
I'm a George Washington, America first conservative.
That means to put America first, we have to rediscover what America is.
If there's three things I get done by January 2033, when I'm leaving office, what do I want to be telling you that we accomplished?
There's a lot of things we could say, but there's only a small handful that I'm actually going to commit to.
One is shutting down the administrative state, making sure that, yes, we again have three branches of government rather than four in this country.
Second is to declare independence from China.
We should not depend on our enemy for our modern way of life.
And then, Sam, I think the third and maybe most important one is reviving pride in this country again amongst our citizens.
We have lost our sense of national pride.
We have lost our sense of national identity.
If you ask most people my age, what does it mean to be an American, you get a blank stare in response.

Why is it immigrants, why is it the children of immigrants that get it, that have a certain understanding of what America is, a little bit more easily than those who are blessed to have been born here?

Former US Attorney for the District of Columbia, Joe DiGenova, welcome back to America First.
Delighted to be with you, Sebastian.
She was on the show on Friday while I was traveling with my good friend who was hosting for us.
Let's listen to one of the attorneys, Alina Haber, being asked a question about what President Trump's going to do tomorrow.
Cut five.
Is there any thought in the President's mind, you please some of this away, you've got to focus on the campaign which is in itself an exhausting, very consuming process?
No.
I could never imagine.
I know I would never advise that, especially when he's not done anything wrong.
You take a plea deal to make something go away, that's an admission of guilt.
He would never admit guilt because there was nothing wrong with declassifying documents, taking documents with you, negotiating with NARA.
The only thing that was wrong was the raid on his home and the complete dual-tier system of justice that we're seeing here.
That's Alina Haber.
Joe, we have in front of us the document you've digested, I've digested, almost 50 pages long, 37 indictments.
What is the most logical thing to do?
Because the Presidential Records Act Postdates the Espionage Act, postdates the National Defense Information Act.
Do the lawyers, do the attorneys tomorrow say, excuse me, none of this indictment applies because a president can have these records?
What is your advice?
Well, I think tomorrow is going to be a very brief proceeding.
It'll just be about the president being present, being presented with the charges against him, and then some personal recognizance being set.
They're not going to be doing any of that tomorrow, but they will be filing motions over the next several months, motions to dismiss the indictment for prosecutorial misconduct, for the reasons you've just given, that the Espionage Act is not applicable in this case because of the Presidential Records Act, and a number of other very, very substantial legal points that he'll have at his disposal.
But, you know, the likelihood of the case being dismissed is, you know, not great.
Even though he has a very good judge and apparently a fair judge, the government usually gets the benefit of the doubt in all of these dismissal motions.
But the judge is going to have a great deal of power over the selection of the jury, the evidence that she's going to allow in, and that will be one of the big things where Trump is going to file a motion to suppress all of the evidence in the case because of the warrant that was secured and how it was carried out and the abuses that attended its execution.
So I think this is the beginning of a very long process, and notwithstanding what Jack Smith said the other day, which made me gag, that there's one set of rules for everybody in this country, I've never heard anything more cynical or arrogant.
If that were true, James Comey would be in chains, Hillary Clinton, all the people involved in the Crossfire Hurricane, corrupt Russia hoax.
Just absolutely outrageous for Jack Smith to suggest that the president is just like anybody else.
He's not.
He's being treated completely differently.
Joe Biden, for example, is not being treated anywhere near the way that President Trump has been treated.
So, tomorrow's the beginning of a lengthy process.
Joe, you yourself, your wife, has suffered political targeting by the DOJ, by the FBI, and you are practicing attorneys.
In this document it says, Trump Attorney 1, Trump Attorney 2, it's clearly a targeting of people who work for him as well, not just his valet, not just his butler, Waltie Nauta.
What happened to the special status Well, it's pretty obvious that this scorched earth approach to this prosecution and investigation by Jack Smith and the Department of Justice was purposeful.
They were going to do anything they could To get any evidence they could at any time from the president, including running roughshod over the attorney-client privilege and constitutional rights.
This is a disgraceful performance by the Department of Justice.
But we've gotten used to this with Merrick Garland.
It's been noted that what he's done to people like Peter Navarro and others, the abusive use of arrests, the warrants for misdemeanors, putting people in chains, I mean, it's just outrageous what this Justice Department has done.
So I'm not surprised that they tried to pierce the attorney-client privilege veil, and they've succeeded in doing so in the courts in the District of Columbia, but those rulings are not binding on this judge.
This judge can rule that that evidence is inadmissible.
She can continue to hold hearings on that and decide as a separate judge in a trial that that evidence is not going to be admissible.
And I hope she holds separate hearings on that and that that's part of the motions to dismiss, that they also file motions to suppress all of the evidence from the lawyers in the case.

Well, I think what's really amazing is that we've... I don't think these people, and I mean Garland and Smith, realize what they've done.
I don't think that See, Democrats change norms.
When they don't like where we are, they change the norm, and that's what they did with the indictment.
They did something that hasn't been done in 250 years, and they were just fine with that.
It didn't make any difference to them that they were throwing out 250 years of history and tradition.
We don't do this to former presidents in this country.
This was a vendetta.
It was designed to cripple him for the 2024 election.
It was completely political.
All of this could have been negotiated right away.
There was no need for an indictment.
This could have been all taken care of.
By the way, none of this information was compromised, wasn't given to a foreign power, wasn't shared with anybody.
None of the documents they were seeking was destroyed by the president or anybody else around him.
This was really a disgraceful act by disgraceful people.
But when you say they don't know what they've done, expand on that.
I think the American people are shocked by what they did.
Not because they think that President Trump is an angel or doesn't make mistakes or didn't commit a crime technically or something, but because the American people expect their government to act like the United States government, not like the Cuban government.
And I think they feel that their government now is not as good as it used to be and that it's being run by a bunch of thugs.
So do you think that because this is being done, it's not some 30-year-old case in Manhattan, but it's being done in a federal court, do you think this is the moment where Americans who aren't political, don't follow these issues, will wake up to what the Democrats are doing, Joe?
Some of them will, and I think that because of the publicity that will surround all the proceedings, They're going to be they're going to be affected by it.
We've seen the polling data already.
This has helped the president And it's an example of the fact that it's sinking into the American people that seven years of trying to destroy a man is not something we like as a country and That's what this is about and the Democrats are shameless about it.
They just they don't they have no moral compass No, but they think they're very moral They do, but it's all about power.
It's all about one thing.
It's just about power.

At that point, I would hope that an impeachment proceeding might be considered, not only considered, brought, and ultimately he would be removed from office.
Judge Ojenewe, didn't Eric Holder just reveal for us the real objective here?
This isn't about any crime committed, because as you said, no documents were given to foreign powers, no documents were destroyed.
This is about making sure that the American people can't choose President Trump to be president again.
Of course it is.
That's what this is all about and always has been about from the time he came down the escalator until today and tomorrow.
It has been about preventing him from being president and stopping him.
What I find fascinating about what Eric Holder just said is that he wants him impeached right after he's been elected president by the people of the United States.
Does he understand how idiotic and inconsistent and bankrupt intellectually bankrupt that
is he wants someone impeached that the American people would have just chosen as
president of the United States.
It's inconceivable to me that anybody could mouth those words. But doesn't it I mean it just
cuts straight to the center of what the Democrats have become.
Screw the people.
We decide America.
You don't get to give us a mandate.
We take it!
Of course, it demonstrates categorically their arrogance.
Their desire for power, their sense that no one but they know what is the right thing to do, quote unquote, the right thing.
It is truly a strange time that we live in.
And the American people are learning a very valuable lesson that democracy is very delicate and that in a very short period of time, it can be taken away, our Republican form of government, by people like that who just spoke.
This is a very dangerous time, and people have to be alert, they have to be aware, and most importantly, they have to vote.
They have to get out and vote.
They have to make their friends vote, their family members, everybody, because this election will change America.
And if we elect a Republican, we're going to have a country again.
If we don't, we're going to be in deep, deep trouble.
Worse than we've ever seen.
Yeah, I would say that it has to be President Trump because the other Republicans aren't going to fix this because President Trump knows the power of the administrative state.
Last question for you, Joe, and then we've got to continue this discussion in the days and weeks to come, sadly, with you and with Victoria.
I know it's Miami, I know it's a Trump-appointed judge, but I don't like any of this and I have zero, zero faith that President Trump will walk away unscathed from this despite being innocent.
Am I being too negative?
No, you're not.
You're being very realistic because this is a very dangerous time for him.
The criminal justice system is not designed To be perfect, it isn't designed, even though there's a presumption of innocence.
You can see what good that does for public commentary.
Everyone in this process is basically saying Trump's guilty, Trump's guilty, get Trump, got Trump.
And that is a dangerous place for us to be as a country.
This is a very, very difficult time for President Trump.
This is not a good thing for him to be going through, notwithstanding his inner strength and his personal strength, and that he's going to fight it and not give in.
The truth is this is going to distract from his campaign.
It's going to make it much more difficult for him to campaign for president and there will be the possibility of a second indictment from Jack Smith over January 6th and then another indictment from Fannie Willis in Georgia.
It's really dangerous.
And very disturbing.
And it's not the way this country is supposed to operate.
It never ever stops.

Are you suspicious of the timing?
Oh, of course I am.
And I think this all comes back to the fact that the swamp always wants to protect its own, right?
If you're somebody that has consistently been protecting the D.C.
bureaucracy your entire career, like Joe Biden has been, a part of that swamp, Um, then it's always going to find a way to find any excuse the world to protect you.
Um, that's why we see, uh, uh, the, the Hillary emails and excuse not to prosecutor, uh, the Clinton sock drawer, uh, incident and excuse for the department of justice to back up, uh, Bill Clinton.
And for these records, we're going to see another excuse that Joe Biden had another excuse for the department of justice to give him a pass.
But they will always, always find a reason to go after Donald Trump.
And the reason is something that I think we all know, and that is Donald Trump is the first president, and who knows how long, that has actually gone and stood up to the D.C.
establishment, stood up to that swamp, and tried to make it very clear that it's the American people who are in charge, and he answers to the American people, not to their bureaucracy.
Now, I know I'm making a huge mistake, Jesse, of using logic here when it comes to the assault on my president and, you know, the judicial fabric of America, but Does not prosecuting Clinton, does the sock drawer documents for her husband, the Hunter Biden laptop, pens and everything else, classified documents, does the failure of the DOJ to prosecute in those instances, can that even be used as a defense in this case?
Or do we just say, excuse me, Presidential Records Act, Civil Act, there can be no felony charges?
Well, selective prosecution is an actual defense.
It is something that courts have made very difficult to actually use because, quite frankly, they have left the door open for prosecutors to do exactly what they're doing here, which is using the phrase prosecutorial discretion.
Be able to go after One person or for one political party for an offense and give a pass to somebody else But there is actually defense called Selective prosecution that could be used in this case quite frankly I think the stronger defense legally is the simple fact that the law that they have charged here the Espionage Act is Does not apply.
And there is very good constitutional reasons why the Espionage Act does not apply here.
Congress could have tried to make it apply, which would have actually opened the door for some really interesting constitutional litigation.
But Congress hasn't opened the door to say that the Presidential Records Act applies to a president or former president for records created during that president's term of office.
Well, and the fact that amongst the almost 50 pages, Jesse, the Presidential Records Act isn't mentioned?
Isn't that everything you need to know?
It is.
That is everything, to a certain extent, that you want to know, because unfortunately, logically, for the special counsel's office, they have to use the Presidential Records Act, because before the Presidential Records Act was passed in the 1970s, constitutionally, legally, Presidents completely owned their documents, the documents that were created during a president's term of office.
The only thing that ever changed that was legislation that culminated in the Presidential Records Act.
The Espionage Act never attempted to change that, and it could have.
The Espionage Act goes back to the First World War, so Congress could have tried to make it apply.
It never has.
How buoyed are you that this is occurring in Miami, Florida and not in D.C.
and not in Northern Virginia?
Oh, it's, I mean, definitely a good thing that I think the special counsel's office knew that they were going to have a huge venue fight on their hands if they tried to bring this in D.C.
or Northern Virginia.
So it's definitely a good thing that it's going on.
in Florida and that the case should be tried in the Palm Beach division there
with a jury from that area.
And I'm confident that if President Trump gets a fair trial, and he should
have a fair trial, that he will be vindicated.
Yet again, how many times does this man have to be vindicated, Dr. Corker?
It's just, it's ridiculous that he has to vindicate himself this many times, but what you and I know is that they keep going after him this way because the process is the punishment.
They think that they can slow him down just by putting him through this.

I don't even know where to begin because, you know, you are a former DOJ prosecutor.
You've run the intelligence community.
You've run the Pentagon.
So let me just give you my layman's opinion.
I read this on the plane.
I had an event in North Carolina on Friday.
I read this.
I could talk about my take on it, but I have to give credit to my colleague Grant Stinchfield.
The important thing about the indictment is what's not true.
In it.
All the things they hide from you in terms of the security of those documents, the Presidential Records Act and everything else, but you're the legal professional, you're the intelligence community former assistant chief.
Tell us what the average American needs to know about this document.
Yeah, and look, I'm probably one of the few guests that you have on that was a former federal public defender and a national security prosecutor, having done both sides of it.
And Grant and you are right to point out what's not in it.
A document like this is meant to do one thing, scare everyone.
And that's what indictments are supposed to do.
They're supposed to scare the person you charge and the public, if it's a media case, to be like, look at all of the bad stuff this individual did.
But there's no defense.
There's no legal issues that are outlined.
It's just, we the prosecutors are the best.
Look at what we have.
But to me, the document itself actually exonerates President Trump.
Okay, what do I mean by that?
Well, for two years, we heard Donald Trump has classified documents.
He's got them in his golf bag.
He's got them at Mar-a-Lago.
He's got them in the pool.
He's got them in his briefcase.
And then when the Department of Justice goes to the grand jury and says, charge Donald Trump with unlawfully possessing and taking classified information, they don't.
That's right.
He's not charged with unlawfully taking any piece of classified information.
Instead, they reach back 105 years to the National Defense Information portion of the Espionage Act from 1917.
Seb, you know why this is important.
Yeah.
There was no classification system back then.
It didn't exist till the 50s.
So the DOJ has now admitted to the world that Donald Trump never possessed classified documents.
OK, that should be the end of the case.
But what they want to do is take this ancient statute and say, even though we gave Hillary Clinton a pass on this and putting aside the Presidential Records Act, which I think also destroys this indictment, They want to say President Trump took stuff he shouldn't have.
And then they want to dirty him up by saying we think Trump's intent was so bad because he's Donald Trump that he wanted to somehow harm America.
Right.
And then they bootstrap it with a conspiracy charge because they want to be like, oh, other people are involved.
And the co-defendant in this case is a storied American who served his country well.
And for them to chase him down is just goes to show you how shameless this is.
But, Seb, I think The indictment is damning in itself for the DOJ more so than it is for President Trump and we'll talk about the corrupt prosecutors on hold.
Let me just quickly make an observation in terms of the arcane usage of the law that they have to go back to 1917 to a pre-classification statute.
Smacks of the Oath Keepers prosecution that they brought the conspiracy charge, a seditious conspiracy which has never ever been used before, Especially for cases where no violence was involved.
Doesn't that show desperation that they're having to do these labyrinthine Byzantine ancient statute attacks because there's no there there?
Yeah.
You said to us, you the government, that he stole classified documents.
And then when you tried to charge him, you told the world Actually, just kidding, haha, we can't charge them with illegally taking classified documents, or even legally taking classified documents.
You charge them with this thing we used to prosecute sailors for when they stole maps off ships, literally.
So that should show you how far of a reach, as you pointed out, Seb, keenly.
But I don't care if it's brought in Miami or in Texas.
I don't trust the DOJ for a millisecond.
being brought in DC because that would have been a disaster.

I don't trust the jury process for the selection of the jury. How telling is it that
everywhere in the document they also say documents with classified markings, not classified
documents?
Because a document can have classified markings, but if the President said, that's declassified, the marking doesn't change, but substantively it's not a classified document anymore.
How important is it that everywhere it says, documents with classification markings, not classified documents, Cash?
It's just their attempt in what we call a speaking indictment to dirty up the jury pool, and of course the media is gonna run with it to be like, oh my God, 32 separate counts.
That's the other thing.
They went and said, not only are we gonna charge Donald Trump with the NDI, National Defense Information Act stuff, we're gonna charge him for every sheet of paper that is in existence that we can find.
And here's the thing, Seb, this also doesn't make sense.
So if they went that route, which they did, and they charged him with 31, I think, counts of NDI based on 31 separate docs, didn't they tell us he had tens of thousands of pages of material?
Boxes and boxes!
They had to show us photographs of boxes.
Boxes spilled open with photographs and mementos in them cash.
Yeah.
So now they're telling us only 32 pages of the boxes and boxes was national defense information and only some of it has classified markings.
And oh, by the way, every document in American history that has been declassified has classified markings on it.
It's just been declassified.
And the only reason they put it in here, in the speaking indictment,
is to scare the layman into thinking, oh my God, look at this, this reads pretty bad.
And you have the cowards, the legal analysts, who are supposed to be the pros on legacy media,
being like, oh, this is damning.
And Bill Barr and his clown show operation for selling his book is out there saying how,
you know, he's toast.
He, Donald Trump.
If half the indictment is true.
If half the indictment is true.

Then this judge must dismiss it outright based on prosecutorial misconduct.

Why are they going after our buddy Walt?
Yeah, I, like you, know Walt.
He's my friend.
We served together.
He has a storied career, and they're going after him for one reason.
Unlawfully so, in my opinion, but one reason.
To go after Donald Trump.
They need to have somebody be a part of this so-called grand conspiracy, so they had to charge someone else, and they got Walt Natta to be the scapegoat in this case.
I think that goes to show you what we were talking about earlier, how far they're stretching.
Yeah, it's a mark of desperation.
I mean, it's like an Agatha Christie novel.
You know, the butler did it.
It's a joke.
Right.
If you're going to kill the king, kill the king.
Right.
The guy who is a career servant, and it's not knocking Walt's service, but you're talking about two people in very disparate positions on the echelons of government.
And if you're going to go after him and say he did some criminal activity, then you better hardline it.
But they didn't.
What they did was, first, the illegality of the charge itself.
Then since it's illegal, there can be no conspiracy to commit what?
A non-illegal crime?
Yeah.
And then they want to dirty up by saying, oh, you know, these two guys were getting together.
It just sounds like a spy thriller instead of what it should be.
A badly written spy thriller.
Badly written.
All right, I've got my additional theories I have to test with you, but first let's talk about who brought this.
Let's talk about the people you know on the government side, and let's start with Jack Smith.
What do our listeners need to know about Jack Smith and his team?
Simple.
Handpicked guy to take on a national security case who has no national security experience.
And remember, Jack Smith was the head of the criminal, excuse me, the public integrity section at DOJ when he authorized the Bob McDonald prosecution.
Do you know what happened in that case?
The conviction was shellacked.
By the Supreme Court, 8 to 0.
And if that weren't bad enough, you have two other rogue, corrupt government gangsters.
Jay Brat, the Assistant Special Counsel at DOJ, who I used to work with, is so politically minded to get Donald Trump that there's now an allegation before the court that he dangled a judgeship in front of the attorney for the co-defendant on this case.
Yes, said, you know, if you play your cards right, we'll get your judgeship, right?
Exactly.
And he is that corrupt.
He is that evil.
He is that vindictive.
He is that political.
And if that weren't bad enough, the guy that signed the indictment, the special counsel, let's go to his deputy, who I know from my time in Miami.
She's a prosecutor from Miami.
I was a federal defender against her in Miami.
We tried cases against each other.
She hates Donald Trump and is extremely corrupt.
Don't believe me?
Believe the judicial record.
Look up the Ali Shagan case from 2009.
Karen Gilbert, the deputy special counsel right now, was the chief of the narcotics section during that prosecution and authorized the illegal and unlawful wiretap of a defense attorney's phone with his investigator during a prosecution.
They got caught.
She was on the verge of being thrown out of the Justice Department and rightfully so.
And you know what she did, Seb?
In true cowardice and government fashion, she resigned from her post and years later she is now being promoted through the ranks and now coming in to prosecute Donald Trump.
And I find it a bit ironic That these people broke attorney-client privilege to seize information that should never have gotten for this indictment, and the prosecutor in the case, Karen Gilbert, is busy breaking the law to wiretap defense attorneys' offices.
These issues must be brought up by Trump's defense team first and foremost after the arraignment.
All right, Anita, I'll run another theory past you that others have floated.
The Presidential Records Act of 1978 is a civil statute.
It's not a criminal one, meaning if there's an issue, There's no felony charge even possible.
There's negotiations, administrative measures, the Nixon administration.
The Nixon office of the former president for 20 years was negotiating with the National Archives.
We know other cases with Bill Clinton, his audio tapes, Obama's thousands of documents in Chicago.
How can you even bring a felony charge against an individual whose whole universe of document handling is covered by a civil act?
Surely the whole case collapses at that point because he's a president, therefore it doesn't, you know, Espionage Act, that other stuff doesn't apply.
The Presidential Records Act apply.
Am I out of order here?
No, you're absolutely spot on right.
You don't need to go to law school or be a lawyer to figure this out.
Seb, you know this.
Civil or criminal or what have you, whatever act is passed by Congress, when it comes on a sequential timeline, the Presidential Records Act came after the Classification Act and came after the NDNI Espionage Act.
That means unless Congress says otherwise, the act later in time supersedes everything before it.
It's black letter law, as we call it.
That means if Congress wanted to carve out a criminal exception under the Presidential Records Act, they would have put it in the legislation.

And you're right to point out that it's just a civil measure.
So that's another legal question that they're gonna have to present to this judge.
It's another legal issue, which is why I think this case
should not ever see a jury trial, because the law itself answers this question,
but it's no surprise that the two-tier system of justice is at play with these corrupt criminal prosecutors.

Two-time Attorney General, here is Bill Barr.
If even half of it is true, then he's toast.
I mean, it's a pretty—it's a very detailed indictment, and it's very, very damning.
And this idea of presenting Trump as a victim here, a victim of a witch hunt, is ridiculous.
Yes, he's been a victim in the past.
Yes, his adversaries have obsessively pursued him with phony claims.
And I've been at his side defending against him when he is a victim.
But this is much different.
He's not a victim here.
He was totally wrong that he had the right to have those documents.
Those documents are among the most sensitive secrets that the country has.
They have to be in the custody of the archivist.
He had no right to maintain them and retain them.
And he kept them in a way at Mar-a-Lago that anyone who really cares about national security, their stomach would churn at it.
So maybe he should go to law school because I didn't go to law school, but I know the phrase cash fact pattern.
If he says, yeah, yeah, yeah, the president was persecuted by the administration for years, but this one, no biggie.
This isn't persecution.
Surely he doesn't understand that maybe if they did it before, they might be doing it again.
How stupid does he think the American people are cash?
And it's not just maybe they did it before, they'll do it again.
It's the same people protecting the institutions.
It was he, Bill Barr, and Rod Rosenstein that buried Russiagate and never let the documents out, along with Chris Wray, who's still the director of the FBI.
These people are all friends, and they work together after their government careers to make a bazillion dollars together.

But Bill Barr has it even worse.

He doesn't even say how that law applies to this instance.
He doesn't even say that if President Trump was so reckless That this DOJ has corrupt prosecutors that used to work for him as the lead henchman in this case.
He fails to do so on purpose and he should be discredited entirely as a hack who is running on some book tour to maintain relevancy because his tenure at DOJ is so now marred in total corruption.
So what is... I feel...
Childlike, I feel naive even asking this question.
If it's patently obvious that the Presidential Records Act is 1978, it post-dates everything else, espionage act, national defense information, everything else, surely all that President Trump's attorneys need to do is day one is say, your honor, This is a civil act.
The president cannot be charged under these prior, superseded acts.
Therefore, we request a dismissal.
Am I being naive that that could actually be a tactic?

Do you know what they did on the indictment?

In the back page of the indictment, where it says, you, the prosecutor, must file this information truthfully with the court, they ask, is there a related case to this indictment before the district?
And the prosecutors wrote no.
Why is that important?
Of course there was a related case.
Judge Cannon presided over the case about the classified documents and the special master.
The reason the prosecutors wrote no is because they didn't want the case to go to Judge Cannon.
And instead, it went to the wheel after their lies, in my estimation, and they drew Judge Cannon anyway.
