The 1023 produced to the House Committee's redacted reference that the foreign national who allegedly bribed Joe and Hunter Biden allegedly has audio recordings of his conversation with them.
Seventeen such recordings.
According to the 1023, The Foreign National possesses 15 audio recordings of phone calls between him and Hunter Biden.
According to the 1023, the Foreign National possesses two audio recordings of phone calls between him and then-Vice President Joe Biden.
These recordings were allegedly kept as a sort of insurance policy for the Foreign National in case that he got into a tight spot.
That's the real news, ladies and gentlemen.

History was made today in a dark, dark way.
Never before in the history of our Republic has one administration led by one party taken the act of deploying its Department of Justice to indict, to charge, to arrest, A former president.
Not only a former president, but the man who right now stands the greatest likelihood of unseating the current president and taking over the executive.
That is the enormity of the situation.
Instead of that story, we should be discussing what you just heard.
Senator Grassley, who spoke on the floor of the Senate for nine minutes last night, revealing that a foreign businessman, the CEO of the oil and gas company Burisma of Ukraine, the one that was paying the current president's son $83,000 a month for a no-show job, Allegedly has multiple audio recordings, 15 with Hunter Biden, two with then Vice President Biden, detailing, as Senator Grassley puts it, his insurance policy, revealing that he bought
Influence in the then-Obama administration.
As my friend Dan Bongino has pointed out, the real crime here points to the then-executive, because the vice president has no policy power.
So if Biden were bought off by multiple foreign interests, he would have had to convince his then-boss, Barack Hussein Obama, to make those changes in US policy to benefit foreign companies and foreign individuals.
That's what this is really about.
Now, truth be told, I'm not interested.
I mean, God bless Senator Grassley for revealing that to the American people, but I'm not interested.
It's thin gruel to tell me or tell the American people that someone says somebody else has shocking evidence of the corruption of the incumbent president.
That's not news.
Someone says someone has is technically hearsay.
I want to hear from the person who has those recordings.
I would like to know if the CEO of Verisma, one of the most corrupt companies in Eastern Europe, has actually said, yeah, I have those recordings.
Or more importantly, I, along with my fellow Americans, I hope every one of the three and a half million people listening to the show right now, would say, I don't want to hear about the existence of this nuclear evidence.
I want to hear the evidence.
I want to make a judgment.
As we played just yesterday, the viral video of Scott Adams, We are supposed to take on trust.
We are supposed to believe the Department of Justice that President Trump should be charged and indicted and convicted of felonies that could lead to three, four hundred years in prison, based upon documents we're not allowed to see?
No.
That doesn't happen in America.
And more specifically, We're supposed to trust the Department of Justice now?
We're supposed to trust the FBI?
Really?
Why?
After what they did to General Flynn?
After they spied illegally using secret court warrants.
The fact that we have a secret Foreign Intelligence Surveillance Act court in America at all is a travesty.
I don't care about 9-11.
I don't care about Watergate.
I care about the Constitution.
The fact that those secret courts were used to surveil members of the Trump campaign and then to surveil Actual officials in the administration I worked for, who worked in the White House, were supposed to trust that FBI, that DOJ.
We're supposed to trust the DOJ.
Think about one thing.
Forget everything else for the last seven years.
For almost two years of those seven years, for 20 months, a former director of the FBI investigated President Trump and his whole team.

Could you come out clean, scot-free, innocent of anything, after the federal government deployed 40 federal agents, spent tens of millions of dollars, hundreds of interviews, hundreds of subpoenas, and they still couldn't find any evidence against him?
Yeah, I think you know the answer to that question.
We're supposed to trust that FBI?
The FBI led by James Comey, Andy McCabe, who lied under oath to federal agents in their own organization, and then, in front of the House, on more than 200 occasions, said, oh, I don't know, I can't remember.
When the President's butler, Walton Nowt, says, I don't know which boxes moved where, he gets charged with a felony?
37 times?
But James Comey is on a book tour?
Let me be very clear with everyone listening to the show.
There's only one person who should run for the presidency after today.
It's President Trump.
Why?
Not because I worked for him, but for this reason and this reason alone.
If you don't support President Trump, I don't care who you choose.

I don't care if you like DeSantis, Haley, or traitors like John Bolton.
If you support anyone except President Trump, it actually means You're okay with what the DOJ and the FBI did to him and the people who worked for him and his family.

I don't want to live in that America, and I would hope you don't too.
As a result, I support President Trump, and so should you.

Good to be back on your show, particularly with you hosting, Sebastian, so good to be with you.
Hey, I've got to ask a quick question.
So how many shell companies do you and your family have?
Is it 20 or more?
Yeah, no, it's less than that number.
It's actually zero.
Yeah, and not just 20 shell companies, but what, 150-some suspicious activity reports.
And I always say the key word in that phrase is the word suspicious.
Yeah.
That's why the Treasury Department puts these reports together, because they're saying, Something doesn't look right here.
Something smells funny.
Something looks suspicious.
And they put together dozens and dozens of these reports on these multiple companies where they're moving money in and around.
That is a problem.
Now, we have the footage.
The president has arrived.
He's been arraigned in the court in Miami.
Your reaction to what this means for America?
Is there any going back from this, given that we have the quote-unquote leader of the opposition, the most likely person to unseat Joe Biden, being arrested and arraigned by the federal government?
Yeah.
No, I mean, it's sad.
It's wrong.
It's terrible for our great country, the greatest nation ever, to see this happening.
I think the vast majority of the American people have common sense, and they understand that this is wrong.
But they also understand the pattern, Sebastian, that you've talked about.
It started in 2016 when they used a document they knew was false.
They knew the dossier was garbage.
In fact, Durham says in his report they never confirmed one substantial allegation in the dossier.
They didn't validate one thing, but they used it to go get a warrant to spy on an American citizen associated with President Trump's campaign, and it's been nonstop For seven years.
2018 was the Mueller investigation.
Then it was impeachment.
And in 2020, there was the 51 former intel officials putting out the false letter with their titles, head of the ODNI, former head of CIA, putting out with their titles that they said the Biden laptop was false and it was Russian disinformation.
That was baloney.
Then in 2022, they raided President Trump's home 91 days before an election.
And here we are, 2024, 17 months before the presidential election.
The guy who's winning in every poll gets indicted.
So it hasn't stopped.
And again, I think the country sees that pattern and says, wait a minute, this guy was changing this town.
This guy came here to represent we, the people, and to make America great again.
And he's been targeted by the left ever since he came down the escalator.
We have been impressed, the America First voters have been impressed with what the GOP, what you and your colleagues have been doing under the new speaker's leadership in the last few months.
How significant is it that the business partner of Hunter Biden was subpoenaed last night?
I think that's huge, and I think this document is important, too.
I reviewed it last week, the redacted version, and so I know what Senator Grassley has said about these audio tapes that exist, and we'll look forward to hopefully seeing those at some point.
But this is a non-classified document.
When I reviewed it last week, the thing that stuck out to me was the confidential human source.
Again, the FBI put this document together based on things the confidential human source told them.
The Confidential Human Source, who they've paid for a long time, has worked for the FBI a long time.
The Confidential Human Source is having a conversation with the Foreign National.
The Confidential Human Source says to the Foreign National, he says, hey, hey, you know, you better be careful dealing with the Bidens.
And the Foreign National says, not to worry.
We've directed the money through so many banks, no big deal.
And then he says something to this effect.
He says, and we never paid the big guy directly.
And that stuck out to me because it's like, this is the second time we've seen a reference to that term, the big guy.
But this reference comes from someone who was allegedly paying the big guy, not the one we saw in October of 2020, where it was a business partner of Hunter Biden saying 10% for the big guy.
So now you have people on both sides of the equation.
The foreign national who's paying, the Hunter Biden business partner who's on the receiving end of these funds, both are referring to the big guy.
That to me is significant.
We have the person doing the bribe, and we have Tony Bobulinski on the other side confirming it.
I had a long drive this morning, Chairman.
I had a four-hour drive to my friend's studio near Bedminster, and one idea just out of the blue, it's, you know, when I get to think behind the wheel of the car, why is any document from the federal government that is handed to you or your colleagues who have clearances, why is any document redacted at all, let alone an unclassified one?
Because if it's redacted, how are you exercising oversight, Chairman?
No, great point.
And understand that what happened here, the process with the FBI, initially, they wouldn't even confirm this document existed.
Remember, the whistleblower came to Senator Grassley and said it exists.
Initially, they said they didn't even confirm whether it existed.
Then they said, well, it does exist, but we're only going to let Chairman Comer and Ranking Member Raskin see it.
And then they said, well, now I guess we'll change that, too, and we'll let all the committee members see it.
Well, frankly, the whole country should be able to see it, and they should be able to see it in an unredacted form, because the one I saw still had a lot of redactions on it.
Let's have it.
And it's not classified.
That's the fundamental thing.
It's a document they created.
I have never.
I still have my clearances, sir.
And I've worked in the DoD.
I've worked in the White House.
I have never seen an unclassified document with redactions, ever, in my seven and a half years in federal service.
Well, you can, like, look, one redaction I'll give them.
Redact the source's name.
Fine.
Redact the source.
But leave everything else so that we can see.
We, the people, can see it.
That would be the way to do this.
But no, no, Chris Wray and the FBI say no, we can't do it that way.

I just kind of wanted the president to know that I have his back through these tough times, because in 2024, we need him to be our president.
And loyalty, and his loyalty to this country, really is what really gave him a very successful four years.
He is not loyal to D.C., he is not loyal to the swamp, he is loyal to the American people.
The least we can do is be loyal to him.
Yeah, that's perfectly put.
This isn't about a cult like the left.
This isn't about an individual or personality.
This is about a man who loves America, and that's why they want to destroy him.
You can even take, you know, Republican, Democrat out of the equation.

How worried are you that this is just another iteration of political persecution and that things could get even worse given what the Democrats are prepared to stoop to to stop this man?
My belief is they need to put him in prison.
They are exposing themselves for exactly who they are.
Literally, President Trump has been the most investigated American in the history of America.
We're talking about multiple impeachments that yielded absolutely nothing.
The FBI then raises home, the home of a former president to find secret documents, secret documents
at a former president's home.
And then you're looking at what happened with Alvin Bragg in New York.
And then now you're looking at the weaponization of the DOJ that's clearly politically motivated
against a political opponent who was once the former president of the United States of America.
Look, the fact that they are doing this is fantastic for our cause.
I am talking to people all over Texas, and most of them are saying to themselves, you know, maybe I wasn't that big of a Trump fan, maybe I was leaning even kind of toward DeSantis, but now that I know that the left is willing to go through these lengths, To get him out of even running for office over the course of the next 18 months says all I need to know.
I want to side with the man that wants to fight against the swamp.
He is not of the swamp.
He is for the American people.
And we're seeing it play out day in and day out with these witch hunts that keep manifesting themselves just miraculously right before the next election cycle.
Yes, absolutely.
We opened the show with Chairman Jordan and when a politician comes on the show and then you do the show, he's been on many, many times, I always end up asking them the same question.

When you're in Congress and you have people across the aisle, Can you work with them?

When we've got AOC saying, you know, the likes of Jim Jordan wanted to kill me on January 6th.
How can you find common ground with people who seem to be insane congressmen?
So right now, in my opinion, is not the time for common ground.
It is time for us to take our country back.
We could sing Kumbaya here in the next few years, but I'm going to give you an example of what I mean by compromise when it comes to dealing with the left.
The very first vote that I took in the halls of Congress was to repeal all 87,000 IRS agents because we don't have a tax revenue problem in this country.
We have a spending problem.
So, in this bill that we passed a couple of weeks ago, instead of eliminating 87,000 IRS agents, we negotiated with them.
And you know what?
They are now able to fund 85,000 IRS agents.
They took away 2,000 IRS agents, and that's what it means to negotiate with the left right now.
We have the House.
We've got to take back the House, keep the House, take back the Senate and the presidency, and then under our terms, we can talk about negotiating.
But that's where they are.
They're so far left that there really is no reasoning with these people.

But when I heard him say those words, that he will propose a constitutional amendment for term limits and ban politicians from becoming lobbyists, I tweeted out that evening.
He's declared war on the political establishment.
He must be destroyed.
I think today is confirmation.
Let's analyze with somebody who understands presidential politics, who's written seminal works on Nixon, on FDR, and on President Trump, Lord Conrad Black.
Welcome to America First.
Thank you, Sebastian.
You said, I think, before we came on air, that this is a shambles, this is a disaster.
Will you put today's events of the last two hours into the correct historic context?
Well, I'll do my best.
Look, I think it comes down... Let me give an answer in two parts.
I think it comes down to two basic things.
One is, a country where A government can and does use the right to prosecute people in an effort to destroy the candidacy of their chief rival, and can actually do that and get away with it, is no longer really a democracy.
And I think the people of the United States have to recognize that.
There were many other ways of dealing with the alleged complaint against Trump's handling of documents than what has happened.
This was a deliberate, brazen, in-your-face, bet-the-branch effort by the Democrats to sustain themselves in office by an abuse of the right of prosecution.
And I think the other aspect to that, obviously, is the get-out-of-jail-free tickets Dispensed to themselves by the Democrats in respect of Hillary Clinton in particular, but Bill Clinton to some degree, and in respect of the Biden family, which we have ample reason to believe has been conducting an influence peddling operation all around the world for decades at great profit to themselves.
And this may or may not be illegal, but it is certainly improper.
And it has also been the subject of a very assiduous attempt to disguise it and distract the country from the agonizing extraction of evidence about it.
And historically, I think what we have is the confluence of the addiction that developed to criminalize political differences, starting with Watergate, and including the Iran-Contra nonsense, and the And the Monica Lewinsky affair.
But given a take of phrase from COVID parlance, say, Uh, a gain of function with a tremendous boost when it was mixed in with Trump hate, which is not so much hate as fear.
It is the fear of the Democrats that finally there is a Republican who's going to break up this log-rolling, back-scratching operation they've been running in Washington ever since the retirement of Ronald Reagan.
That is an incredibly significant observation.
I'm going to ruminate on that, that it's more than Trump hate or Trump derangement.
It's Trump fear, fear of a man who is not beholden to the establishment interests here in Washington, D.C.
Conrad, if I may, let's focus on one aspect of the document, which I'm sure you've read, this indictment.
So there is an act of Congress that is a civil act, not a criminal act, that regulates the documents a president accrues during his term.
Prior to the 1978 Presidential Records Act, every document generated by a president was deemed to be his personal property.
Afterwards, it was regulated by a bill that brings no felonious options for charging if there is any transgression.
The fact that they resorted to the Espionage Act of 1917 to bring these indictments against President Trump and his butler, totaling 400 years in prison, theoretically, that presupposes that a former president is handing the nation's secrets to our enemies, is
destroying top secret documents, none of which is substantiated by the 49-page indictment.
What does it tell us about the Democrat establishment and the prosecutors that have a
Democrat leaning that they are prepared to even posit that of a former president? It's shockingly
negligent by any historical standards and I don't think in any era prior to the Watergate era any
such thing would have been considered for a moment.
I mean, as a very young person, I remember quite clearly various instances when President Eisenhower and I read about when President Truman and certainly President Roosevelt, three of the country's most distinguished presidents of both parties, declared the executive privilege and the national security interest to entitle him to do almost anything in terms of Withholding things, retaining things, or whatever they as elected presidents judged to be required by the national interest and within the very broad limits of the executive privilege that attach to the office of president.
And it was gradually whittled down and both parties became addicted to this practice Uh, abusing the legal system to try and harass their enemies.
But it has really been a specialty of the Democrats.
They started it with Watergate, and unfortunately, certain aspects of Mr. Nixon's personality made it easier for them.
Although, in fact, there remains, after 50 years, not a shred of probative evidence that he himself committed any crimes.
But he was a patriotic, conscientious American, a very distinguished president, and he retired rather than uh... permit this embarrassing spectacle to continue any
longer uh... those who have followed him have not been it quite so
high-minded so it would work if what we have now is a democratic party
that is frightened they've gone so far that they they can't there's no turning
back they've got to try
and and bar the door and carry on to the end with this theory
the trump is evil trump is bad and trump must be destroyed in anything is
justified to destroy him politically.
And, you know, it started with the Trump-Russia collusion nonsense.
Then they went to the first impeachment over the phone call with the president of Ukraine.
We now know that that was animated in part by a well-founded fear by the Biden faction
and their supporters that if the president of Ukraine had responded to what President
Trump was asking, it was going to cause a great deal of embarrassment to the Bidens.
I mean, that wasn't much talked about at the time.
That spurious impeachment was played out.
And they've just gone from crisis to crisis, manufactured by them, to try and destroy Trump.
And it is clearly driving them crazy that they failed.
I mean, they thought that they'd finished with him when they stole his election with the harvested ballots.
And then the icing on the cake was their spin on January 6th, which had nothing to do with Trump.
The last thing in the world he wanted was Trespassers surging through the Congress.
They tried to hang that on him as his attempt at insurrection.
And he's not leading all the polls.
As I understand it, on the early polls since the indictment announcement last week, he's gone up again in the polls.
Correct.
And they are now staring down the loaded double barrel of complete rejection by the voters.
Presumably followed by retribution within the framework of the justice system.
And I don't think the Republicans would be remotely as reckless and, in fact, illegal in their procedure as the Democrats have been.
But if the Democratic Party's performance Their leaders has been as shockingly reprehensible and illegal as it appears.
The simple operation of the law in an objective, fair manner, which has been denied to Trump, when applied to the Democrats, will bring down criminal convictions on a good many of them.

To find some charge that they can stick.
And that's why I just don't trust the system.
Of course, I shouldn't be lecturing you.
You know what this is all about.
The system's rotten.
The country's a jungle.
It's not Norman Rockwell and Walt Disney's America.
But the people will decide.
None of this stuff is going to trial before the election.
Really, your judgment day is going to be on election day, assuming Trump's the nominee.

I mean, the CBS poll from this weekend has him 38 points in front of DeSantis.
That's CBS!
And by the way, in fairness to DeSantis, he appears to be quite robust here.
He has finally.
His statement, Glenn Youngkin's statement, was surprisingly solid.
Yeah, but Haley was a disgrace, I think.
Oh, totally.
But the quote Republican end quote that aggravates me even beyond this little twerp Hutchison in Arkansas is Bill Barr.
I mean, his conduct is shocking.
Let's talk about that.

And none of them came into possession of those documents while they were president.
None of them were president who, as the head and sole member of the executive branch, has the power to summarily declassify documents.
The decision to pursue charges against President Trump while turning a blind eye to others is emblematic of the corruption that we have here.
We are at a turning point in our nation's history.
The targeting, prosecution of a leading political opponent is the type of thing you see in dictatorships like Cuba and Venezuela.
It is commonplace there for rival candidates to be prosecuted, persecuted, and put into jail.
What is being done to the President Trump should terrify all citizens of this country.
These are not the ideals that our democracy is founded upon.
This is not our America.

Lord Black, I tweeted this out a few days ago, that the next 18 months we'll see a political
separation of the wheat from the chaff.
We will know who are conservatives, who believe in the rule of law, and who have just been faking it for years and decades.
We have a statement, I'm not even going to play it, from a former cabinet member, the secretary, the Ambassador to the United Nations is a cabinet-level position, the only ambassador who is.
Nikki Haley, who lambasted her former boss, said that he risked the lives of our U.S.
military.

And the fact that she's believing the statement of the DOJ hook, line and sinker, when we know what they've done to lie about the president and his employees for years, Beggars belief, but not as much as perhaps his attorney general, Bill Barr, who used this very pedestrian colloquialism where he said, President Trump is toast if half of this is true.
Well, Lord Black, what if it's all a tissue of lies?
Well I think it probably is, and I don't think he is toast.
I think you've got a number of problems with that.
Barr started out making the ritualistic statement that any accused person should be presumed innocent until proven beyond a reasonable doubt to be guilty.
Yeah.
But after that sort of boilerplate uh... homiletic he then went on to say however this is a
very very strong case and that half of it is true
the former president's toast he'd be he's become he's come out of the closet as a trumpeter he went into the
government under false colors
it by divide because of his legitimate and genuine objection
to the espionage illegally conducted against the trump campaign in trump
transition team with false affidavits for fees or warrants
You know, FISA warrants to make telephone intercepts and so on.
But he could deal with it.
He put in place a special prosecutor whom he clearly instructed to drag his feet, take his time, come to the right conclusion, but do no political good for Trump.
If Durham had produced his report in one year instead of three years, we would have seen much more clearly and indisputably what the Democrats had been up to.
But Barr didn't want that.
He wanted to shore up the system, but he wanted to help kill Trump politically, and that's not what an attorney general should be doing for the president who did him the honor of appointing him to that office, reappointing him in his case.
Yes.
And I think it's a shameful performance, just absolutely shameful.
I always force you into a corner after which you say we're not qualified as psychoanalysts or psychiatrists, but I really need your assistance, Lord Black, because I saw this with colleagues of my rank inside the White House And then even at the cabinet level, what possesses somebody?
You're not press ganged.
You're not forced to take the king's shilling to become a cabinet member or an assistant to the president.
And we were full of individuals who detested the person they worked for.
What possesses a person to volunteer for a position to work for a man they politically hate?
Well, it has to be either That they just want, which I understand, to have the experience of working in the White House, in an important job close to the President, even though they don't actually like the President.
He's the President who's offering them the position, so they take it because they like the position, but they have no loyalty to the person who put them there.
Or, even more sinister, they took the position Precisely because they didn't like him and wanted to get at him from the inside where you can do a lot more damage than you can if you're just a member of the public.

What advice would you give President Trump in the next 18 months given what they've done to him today?
I think he's got, and it's hard to see it when you're in the eye of the hurricane, but he's got a great historic opportunity to clean up the government.
And he can do it in a way that isn't vituperative or bombastic.
He shouldn't be histrionic.
He shouldn't be more insolent than angry.
He should stick to the facts.
I thought his response to Barr yesterday, I understood it.
I understood why he was so angry, but I thought it was the wrong response, saying he was a poor attorney general and he fired him.
I don't think he did fire him.
And, you know, in some ways he was a competent attorney general, but in this issue, he should be disbarred, if you'll pardon the pun.
But I think what he's got to do is say, look, he's got to make it clear.
He has to say, I didn't do what I'm accused of doing.
And I deserve, as even Barr says, the presumption that I didn't.
And we are going to object to all of this.
They should have proceeded under presidential records.
The thing in New York is nonsense.
It's just, as I've said, an attempt, at the last moment, as they're going down in the polls and fearing they can't steal it with ballot harvesting again, they're trying to stop me because they know that if they can't stop me, I'm going to expose them for what they've done.
You, the American public, must choose.

You see, I think in the end what these people are going to get is a referendum on honest government.

That was just a few months ago at CPAC, the largest convocation of conservatives in the United States.
Perhaps that is why the events of today had to occur, because of President Trump's renewed commitment to represent the American people and to quote-unquote drain the swamp.
I can think of no one better to discuss these sadly historic events with than one of your favorites, one of the wisest strategic minds in America, if not the globe, from Stanford, from the Hoover Institution, Senior Fellow Professor Victor Davis Hanson.
Professor Hanson, it is a line that is often used, perhaps overused, but with this event, with the federal indictment of a former president, have we crossed a Rubicon in a way that has forever changed the United States?
I think people who are looking abroad at the United States certainly do.
Maybe some people on the left can't appreciate it, but we've lost all moral credibility to lecture anybody about the sanctity of consensual or constitutional government.
And this is, we've indicted an ex-president, we've indicted the leading opposition figure in the next election.
This is what people in third world countries and Dictatorships that mask as democracies do so I don't think in a president can go abroad now and say we would like you to Transition over to the type of consensual government that we have in the United States because they're gonna be laughed at if they do
Let's focus on that second aspect, because this isn't an indictment, a federal indictment of Jimmy Carter or George W. Bush.
This is happening to the man who left the Oval Office two years ago, who currently, depending on all the polling, is between 20 and 30 plus points, leading the pack of conservative nominees for the candidacy.
So to use that phrase that you just mentioned, It's the leader of the opposition being hobbled, being kneecapped by the other party which is running federal government.
What is the long-term damage to the fabric of not just what other nations think of us if we go and lecture them on rule of law, but to the average American's faith that we have rule of law here in America looking forward.
Well, there's two things.
One, we're establishing precedents.
So both parties are going to accept those precedents.
So the next time we have a Republican president, and if he's desperate, and he's not leading in the polls, he might find his Democratic likely opponent, even if the person is not an ex-president, he might find a particular technicality that he can You know, wage a law for a campaign against as it has happened to Donald Trump.
And I think I'll have a lot of people who are not so political, though, so they're going to get very angry about the other dimension, not just that he's a candidate, but he's an ex-president, because that we honor our ex-presidents and they're supposedly immune and above immune from and above politics.
Yes.
Now, an ex-president has to be very careful what he says, because if he should challenge his successor or embarrass him, the successors Levers of justice can be pushed on against it, turned on against it.
So everything about it is bad.
But then they've established so many precedents anyway, that we've never seen before.
We've never impeached a president twice.
We've never tried him as a private citizen in the Senate after he left office.
Nobody in the modern period has talked about packing the court or junking the Electoral College.
These are all, these are people who ended the filibuster.
So they were revolutionaries.
I think everybody in the right doesn't appreciate that fully.
They believe in the process.
They can't win under the existing system, so they have to change the process, the system, and massage it in their direction or to their advantage.
Well, others have made that argument that what's, you know, sauce for the goose is sauce for the gander.
That if you do this with a former Republican president, well guess what?
Next time around we're going to do it to your former Democrat president.
I have to ask...
Is the Republican Party, can you imagine it ever doing that?
Because for me that argument is predicated on the idea that the Republicans are prepared to use every form of power under the sun, legal and illegal.
I look at today's GOP and I just don't see that.
They're going to have to wise up.
Obviously, we're not advising them to embrace many of the models that are border on illegality, if not illegal on the part of the Democrats.
We do not want Republican protesters swarming the private homes of Justice Sotomayor or Kagan with the knowledge that they're going to be exempt from a felonious indictment for doing that, which is against the law.
That's what Democrats do.
We don't want to do that kind of stuff.
But They set the precedent that if a president loses the majority in the House in his first term, and he's supposedly got legal vulnerability, he's been impeached.
Now, we have some earth shattering news that came out yesterday that there is a claim made by some US senators that there are people abroad that have Joe Biden on a tape.
Accepting money, which is specifically outlined in the Constitution, high crimes and misdemeanors as bribery.
If that were true, then I would assume that the Republicans would start impeachment pretty quickly.
Yeah, the statement from Senator Grassley disappointed me, because statements from the floor that somebody says that somebody else has the recording is thin gruel.
We want the person who has the recordings to say, I have them, and we want to hear them.
We want to hear them.
Let me ask... But what you just said...
What you just said, that process could be, if the Republicans wanted to, very easily accelerated, so that within a matter of days, they could get the supposed audio version.
And if that were to be true and not doctored, And we could have a dissent, then I think that's an impeachable offense.
Absolutely, absolutely.
That could be done in a matter of weeks.
Now, prior to that, we had last week, concurrently with the indictment news, we had the documentation released only visually.
They couldn't keep it, which is stunning.
The members of the House Judiciary Committee were able to look, or Oversight Committee, were able to look at this document in which the FBI source says yes, Joe Biden and Hunter
Biden were given $5 million each.
Now, I spurn, I abjure conspiracy theories, but the idea that that document is read by
the Oversight Committee on the same day that Jack Smith drops his indictment, is it fair
to say there are no coincidences in Washington, D.C., Professor?
Well, a lot of great philosophers said there are no coincidences in politics.
So there are no coincidences in politics.
And, you know, what was interesting about that document, Seb, was it wasn't a classified document.
So why was the FBI director so intense, so adamant, so almost paranoid about releasing it?
It's inexplicable.
He should have just said, well, it's not classified.
Come on over and I'll give it to you.
But he apparently felt that it was of such import That it might change the election?
I don't know.
Or he felt that the FBI's reputation had been so tarnished for interfering in elections that this was an explosive document that could change the temporal.
But the sheer paranoia was incredible.
And not only that, this document which the chairman, which the members were not allowed to keep, not only was it not classified, it was also redacted.
I still have my clearances.
I worked in the DoD.
I had my top secret clearance in the White House.
I've never seen a non-classified and unclassified document with redactions.
And according to Senator Grassley last night in his nine-minute speech, he said, we in the Senate saw the document, were presented with the document, And our version had a fraction of the redactions that the House did, which tells you there is no checks and balances.
There's no effective oversight because the House, which oversees directly the federal government, had more information withheld from it than even the Senate did.

I have two questions related to the list.
Number one, as was pointed out yesterday by We had for an hour as well, we had Kash Patel, who not only ran, he was a deputy head of national intelligence, he was also a federal prosecutor, a counter-terrorism prosecutor, and a public defender.
So he's seen these cases from both sides.
And he made the following point, and tell me if I'm naive for believing this has any weight.
Congress decided in 1978 to regulate a former president's retention of documents.
That was a bill that was brought, the Presidential Records Act.
It was decided then that this is a civil act.
There are no criminal charges pertaining to anything to do with the regulation of a former president's documents.
As such, the predated Bills, the Espionage Act, the National Defense Information Act, those cannot have any application because a more recent bill says, no, presidents, it's a civil act.
They can keep these documents.
The president's lawyers, we know what happened today.
Can they make the argument that these charges are fallacious and just walk away?
Or does that speak of my naivete when it comes to the current judicial system?
Well, I think what you just outlined was the operative ideology or jurisprudence in 2017 when Barack Obama took a lot of documents out, and they were much larger than Trump.
And there were people on the right that criticized that or asked where they are or what happened, and they were told by archivists that the President of the United States has the legal right to declassify whatever he wants, and to the degree there might be one or two Obama documents That we're not officially declassified.
That was a procedural matter.
Because if a president has that absolute right, then we're talking about an infraction where he didn't fill out a form.
And nobody in the United States very often goes to prison for a civil infraction like that.
So I think that's pretty clear.
And I think that I think the problem with all of us that we're talking about is I don't think That the people who are bringing these indictments, whether it's Jack Smith or Alvin Bragg or Latita James or Miss Willis in Georgia, really believes that they have a case that would stand up in any jury in the United States.
That's not the point.
The point is to wage lawfare against the ex-president and leading candidate and bleed him with a thousand cuts and tie him up with gag orders and hand the baton from prosecutor to prosecutor.
And we got that from Rachel Maddow when she said at some point, and I think that magical point is after he's the nominee, then can't we plea bargain with him to drop all of the charges so that he bows out?
And I think that's the ultimate game.
My fear is this, and I look at the fact pattern of the last twenty, thirty years, and I look at the last seven years, and even if it's a conservative appointee to the court, what usually happens?
They don't have the fortitude To say, this is garbage, I throw this out, there is no crime here.
Usually to save face with the other side, just to look a little bit salonfähig, to use the German word, you know, to fit into society.
He's guilty on this count.
Mishandling of documents, but not espionage.
Whatever happens, there has to be some compromise with the other side from people who ostensibly are conservatives.
Do you share my fear?
Well, it's not that I share it.
I mean, it's a matter of record.
If you look at the record of the Bush appointee, David Souter, or Jerry Ford's John Paul Stevens, even Sandra Day O'Connor by Reagan, or you look at going back a little further, Earl Warren, Justice Powell, they all became icons of the left.
And they found that when they became justices, Their jurisprudence was, I guess, modulated by the new environment in which they found themselves, which all the rewards, the ostensible rewards were on the left and all of the downsides were on the right, socially, culturally, politically, even economically when you, you know, and so they made the necessary adjustments.
I don't believe that a Supreme Court justice who's kind of Hang, uh, angling for the appointment, they all angle, then gets a Republican to appoint them.
Suddenly he is, what, enlightened by liberal jurisprudence and has a new career.
So that happens a lot.
And it doesn't happen on the other side simply because when they get into the Georgetown, Washington circuit, whether it's network news or being treated fairly by the New York Times or the Washington Post or having your memoirs published or having adulation or getting awards, it's all from the left.
Yeah, so the Clarence Thomas's and the Antonin Scalia's are very, very rare beasts, are they not?
Yeah, well, they take the job with the idea that they're going to be true to their conservative principles for which they were nominated, and they're going to have to pay a price, but they don't consider the hatred or the ostracism from the left as a price.
They're honored by it.
That's a very rare quality, Justice Thomas.
Justice Alito is that way as well, but very few others.
I would say my interlocutor in his own academic world is also one of those people.

Well, the notion that you could have a trial, defend it, be convicted, somehow win the election, be sworn in as president, or whenever it happens, that seems inconsistent with our notion of fairness, of the rule of law.
At that point, I would hope that an impeachment proceeding might be considered, not only considered, brought, and ultimately he would be removed from office.
Professor, you mentioned Rachel Maddow.
You can say she's just a talk show host, but they use these individuals to set narratives.
She floated the idea that, well, a plea bargain for the sake of America.
The president will plead guilty and we'll just move on and he can disappear.
In this case, it's not a talking head.
It's the former Attorney General.
It's Eric Holder, the man who called himself Obama's, quote, wingman.
Now, I think that statement is perhaps one of the most important statements of recent years, because you had a former cabinet-level official who says, If President Trump wins next year, he should be indicted, he should be congressionally impeached the day he is sworn in.
Now what does that mean, Professor?
It means that the left It is, but it's not unexpected.
contempt for the will of the American people, because what he's saying is 85 million, 90
million Americans choose President Trump, but we just remove him the next day.
Isn't that a glimpse behind the curtain of what the Democrat Party has truly become?
It is, but it's not unexpected.
This is Eric Holder, who became famous during the Fast and Furious scandal when he had a
congressional subpoena, and he just ignored it.
This is what they put up.
Steve Bannon, they indicted him for and convicted him.
And so his idea was the rule of law doesn't apply to me.
And any Democrat or left-wing person of a protected species class, a Democrat, liberal, then is not subject to the rule of law.
But I think he's a little naive.
If Donald Trump were to be elected, Then that would almost be confirmation that he will retain the House and probably win the Senate.
And the idea that a Republican House and Senate is going to indict Donald Trump or in the sense of impeach him and convict him is absurd.
So I think what the big problem is with the left, they are terrified because they have a president who's non-compos mentis and they have a vice president who's incompetent and cannot serve as president realistically, and they don't know what to do.
So they have to eliminate any viable Republican and then come up with a solution at the end.
But I think they're very scared.
And they know Trump.
Let's be honest.
When Donald Trump says, I am your retribution, he means it.
Well, isn't he were to be elected?
I mean, isn't I mean, that's why we opened our discussion with that clip from CPAC.
And for me, Far earlier, last November, I was at Mar-a-Lago when my former boss said, I'm launching my campaign.
And I knew why I was there.
I knew what he was going to say.
But even I was shocked that he was prepared to put himself through that calumny that his whole family had to go through, the assaults in the courts for the last four years.
But at the end of that announcement, he said, I'm going to bar members of Congress and Senate for life.
If from lobbying and I'm going to initiate a constitutional amendment for term limits.
Immediately I heard that I said this is a declaration of war and I tweeted out now they must destroy him.
Can you make a direct connection from his commitment to take actions that are so radical in terms of cleaning up politics to what is happening today in Miami?
I can.
And when he set that precedent, and I know we worry about the backbone of the Republicans, but there are people in the Republican Congress talking about not funding the FBI new headquarters, or breaking it up, or moving it out of Washington.
And there are other candidates.
DeSantis said, for example, that he didn't understand Why people could go through the revolving door from one defense contractor into the Pentagon out to another contractor without a cooling off period.
Or why it is that John Brennan and James Clapper and Andrew McCabe and Jennifer Granholm most recently can lie with impunity under oath to Congress.
And yet they'll go after Walt Nauta, a 10 year military veteran and an aide to Donald Trump because he wouldn't turn state's evidence and they're going to indict him and try to put him in prison.
For saying what?
I don't know?
When James Comey said that exact phraseology, he used that 245 times with impunity under oath before the House Select Intelligence Committee.
For me, reading the indictment, that is the most egregious thing.
I know Walt.
He was, of course, you know, the President's butler in the White House.
A man served with distinction in the Navy that they went after.
Is Donald Trump a national security threat right now?
And if he is, I think I know what you're going to say.

and a threat? Everything that all of his opponents for the White House are saying today. He
is definitely a threat.
Major dangers in our national security.
He has been, I think, for many years and will continue to be.
Again, a cri de coeur, a naive question, Professor.
How can we be living in a nation where a former CIA director who voted for Gus Hall, the Communist Party candidate for president, who still maintains his top-secret clearance, say that And the average American have faith that justice will be done for President Trump or for the average American citizen.
I'm sure you're familiar with Scott Adams, this rather controversial cartoonist, the Dilbert cartoonist, who had a viral video two days ago where he said, Really?
He's not a big Trump supporter.
He says, Americans are supposed to agree to a former president being imprisoned because of documents we're not allowed to see.
How does America survive such a status, such a state of being?
Well, in this case, it's even worse than that, because the person that was just on the screen was the CIA director at the time, and he was asked directly under oath in the US Congress.
Did the CIA under your direction or did it not spy and monitor and tap into the computers of Senate staffers?
And he said, no, no.
And then he was in a public forum and they asked him, have your CIA drone assassination missions had any collateral damage and killed innocent civilians on the Afghan?
He said, no.
Both of those times he lied.
One was under oath and he admitted he lied.
He admitted he lied and he got absolute impunity.
And then he peddled for five years, the fake Russian collusion hoax while he was being paid as an analyst.
So Mr. Nauta, to get back to Mr. Nauta, your close friend, he is being, he's facing a prison charge for saying, I don't know, under oath when this man was CIA director and he knowingly lied on a matter of national importance, and he was rewarded.
And this is from a media who is lecturing us about the morality of Donald Trump in this indictment.
And they hire a man who's a confessed liar and abused his oath of office as the CIA director.
As did Clapper, as did McCabe, as did Stroke, and so many others.
Comey.
Comey.
What was it?
You always remember the number, Professor.
How many times?
It's the 200?
245 times, according to members of his House Select Intelligence Committee.
Incredible. I do not know.
I'll be seeing the President in a few hours at Bedminster.
I have my recommendations for what should happen on January the 20th, 2025, should God willing he become the 47th
President.
But, you are a historian of great renown.
Given what has happened in the last two plus centuries in America, given the political culture and what's happened in the last 50 years, President Trump has the determination to root out the corruption, the political actors with a veil of bureaucracy over them.
Can it be done?
Can day one of a Trump administration really see these people fired, arrested, expatriated to Alaska to work in the DOJ field office there?
Can it possibly be done?
If he comes in with a national unity ticket of conservatives, if he's the nominee and he can get everybody behind him and they can win the Senate and the House, then they can do pretty much what they want.
And they cannot make it personal.
They can just say, if you are a federal official and you lie under oath, This is what's going to happen to you.
If you are a Pentagon high ranking official, or you're a retired general and you're subject to the Uniform Code of Military Justice, and you call the commander in chief, Hitler, Mussolini, liar, coward, should be removed sooner than later, then you are going to face the full extent of that code.
And he can do that right down the line.
And I think that would win him support, bipartisan support.
There's Democrats that are shocked at this, not a lot of them, but we've never been in this territory before.
And I think he can say that I'm going to restore American norms and behaviors and everybody is going to be treated equally under the law.
And we have to start not with little people, but with the highest figures, Hillary Clinton, all of those people.
I don't know what the statute of limitations is, but he's going to have to follow the law, not be vindictive.
But if any of these people or their successors are subject to an infraction or a violation of law, they should be prosecuted
and they should be convicted of guilty.
And I do think that he has to come out and say, if any of these people are commenting who have lied under oath,
and they have security clearances, and they're monetizing those,
while they have a record of admitting they lied, they should have to give those up.
And given the fact that during the speaker debate only 20 members of the GOP wanted to, you know,
rein in the next speaker and have him represent the will of the people,
can you envisage the GOP going along with this, even if they win the House and the Senate?
Will...
Will they philosophically go along with it?
Well, I think one thing about Kevin McCarthy, a lot of people had lost confidence in him and thought he would be Paul Ryan 2.0, but he's not.
And you can see that with this, these house oversight committees, they're doing things in the house that we haven't seen since Devin Nunes was chairman of the intelligence committee.
And so that gives me hope.
And the other day, when I cannot imagine a Paul Ryan, when a CNN reporter attacked him, turn around and say, then you better not hire convicted liars and people who've committed felonies.
Don't give me a lecture.
That was new.
I hadn't seen that.
So I'm a little bit more confident and I'm a pessimist, kind of an Eeyore figure that I don't expect much, but I am starting to get enthused about the house leadership.
It seems to me a break with the past.
One thing I would like just to add in closing is that I would like all of the candidates to say that they are going to endorse the nominee, whoever it is.
And that includes Mr. DeSantis and Mr. Trump, everybody, because they need a national unit.
There's no margin of error in 2024.
That may be the last time we really have a chance to stop these abuses, because otherwise they're becoming institutionalized.
That will be a great test for the 11 candidates.

Professor, I know my former boss, the President, values your counsel very, very highly.
I'm not going to ask when you last spoke to him.
What advice would you give to him and his team?
Not legally, but in terms of strategy in the next 18 months, knowing the depths of the administrative state, knowing the challenges he will face.
Do we have to see any new tactics, any new procedures deployed?
What would you say to him right now if he was sitting in front of you?
I would tell him to keep cool and he's going to Undergo the worst attack on a political figure in the nation's history.
And his enemies are capable of any and everything.
And he must remain cool and fight these charges and get even rather than get mad.
And then I think his, I would argue this may be controversial.
I don't think that Ron DeSantis is his enemy.
So these commercials he's running, I think should be directed at the left.
I really do.
I know that everybody's going to run.
I don't want to.
Suggests that candidates not run against each other.
I just think that that His problem right now is that the left has weaponized the judicial system and that is and he's trying to destroy him and And for him to unite the Republican Party, he cannot waste one second attacking somebody on his side.
I just, that's just a piece of advice.
But more importantly, he has to keep cool because they're going to try to bait him.
They're going to try to entrap him.
They're going to, they want him to get mad and reckless and he cannot do that.
Yeah, it's remarkable the good humor he had at his rallies at the weekend, stunning that he was on such good form.
Is this going to be, should this be the key issue for his campaign?
Should it be rule of law, equality before the law, or will it be the border, will it be the economy, or is it too early to say?
I think he has two Two things.
One is the restoration of American power and influence and stability, and that would be by implication the border, the economy, crime, foreign policy.
And more importantly, Saving the Constitution.
And that's what we're talking about.
When all of these people are doing these things, they have one thing in common.
Hillary Clinton, Coleman, Comey, Brennan, Clapper, McCabe.
They feel they're exempt from the rule of law because of their position, their influence, or their value to the left.
And that has to end.
We don't want to have a country where Walton Alta goes to prison and Andrew McCabe comments on national TV for a price about the theory of jurisprudence.
If we're to that point, then we don't have a country.
Perfect juxtaposition.

A man who served this nation honorably and is indicted, and a man who lied as a federal agent and was rewarded.
