What a crazy news week it's been.

All right, so we had Lauren Bobert on the show yesterday talking about the deal you predicted would come together, and it came together.
How are things shaping up?
You've got some news out of Indiana.
Tell us the things you're working on right now, Matt, that all of our three million listeners need to know about.
Yeah, well look, I mean, obviously the new Congress is the biggest story of this month, and seeing how this Republican majority is handling things in the wake of that contentious week of a speakership election after speakership election that eventually ended with Kevin McCarthy being elected Speaker, and the deal that conservatives were able to get as a result of them holding out all week And what the fruits of that are, and we're seeing that play out right now.
I think you're seeing a lot of conservative victories and McCarthy's upholding his end of the bargain to his credit.
So look at the major things that have played out already.
So first and foremost, committee chair races, right?
So the Homeland Security Committee is going to be chaired by Congressman Mark Green from Tennessee instead of Dan Crenshaw from Texas, right?
The Ways and Means Committee is going to be chaired by Jason Smith from Missouri rather than Vernon Buchanan of Florida.
Another big win for conservatives.
And that's because Byron Donalds is on the Steering Committee, which is a result of that happening.
Now, in addition to that, you see the membership of these committees that were announced over the course of the last several days here.
That happened earlier this week.
The Oversight Committee in particular Has a number of top conservative members on it.
Lauren Boebert is on there.
So is Marjorie Taylor Greene.
So are several of the other members.
I think Byron Donalds is on there.
I think Paul Gosar is on there.
Several of the people that were holdouts on the McCarthy situation are on the Oversight Committee.
which means they're going to be able to apply the energy that they applied to the speaker race that you saw clearly play out to the investigations, which is where the fight is right now, going into the Biden administration, particularly the document scandal, the border, you name particularly the document scandal, the border, you name it.
So there's all sorts of different things that need to be investigated, Hunter Biden in his laptop, etc.
So you're seeing wins in that regard.
You're seeing across the board this new Congress is already proving to be a major success for conservatives and for Republicans.
So tracking that whole storyline, in addition to the falling of the left with this Biden document scandal, I mean, this has rocked the White House.
They are shocked.
They're in serious trouble right now.
Joe Biden is in a very bad way as president.
I don't know if this is going to take him out, but it's certainly going to hurt him.
Do you think the DNC are trying to take him out?
What are you suspicious of?
I mean, I still think they think he's the strongest candidate they could run in 2024.
And I think he fully intends to run.
Look, if Kamala was the nominee, they can kiss the White House goodbye.
Like, so, and they know that.
So, however, they might be, like, trying to go for a clean slate of their party and whatnot, and they know that if Trump is the Republican nominee, which, by the way, I fully expect to happen, you know, we'll see how this process plays out over the course of this year.
And later this year, if Governor DeSantis does decide to run, I don't know how that's going to shake out.
But President Trump, by the way, has seen an 18 point surge in his approval rating from a month ago.
So, as he's rolling out these policy videos, laying out his vision, President Trump, all these people in the establishment, especially on the Republican side, the donor class, etc., discounting President Trump, they're so wrong, right?
Like, I talked to a guy who's very plugged in with the donor class community earlier this morning, and he was saying, you know, I think that all these people are just totally out of touch with where people are at in the real America.
Because Real America, they want President Trump back, right?
And you see that in the numbers.
He's got a double-digit lead over Governor DeSantis, and we haven't even started this process yet.
We haven't even gone through this yet.
If DeSantis does decide to run, and then if so, will he be scrutinized?
I mean, he's still in the romantic honeymoon period, Governor DeSantis.
And by the way, great success that he's had as governor, don't get me wrong.
But I just, I don't see it if he's not doing better than down double digits.
Right, and the donor class is, you know, usually completely out of touch with the average American.
He's back on social media.

Allegedly, the new committee to investigate the criminalized exploitation of the FBI and the DOJ that is being set up as part of the speakership deal, Jim Jordan won't be allowed to send out subpoenas unless Kevin McCarthy approves first.
Have you heard that?
I have not heard that.
I don't believe that to be the case.
I don't think that's how committee structures work, and I believe that this is going to be a subcommittee of the Judiciary Committee, which Jordan's going to be the full chairman of.
Anyway, so I don't know if I buy that, so I don't know how to dig into it.

And I wanted to comment on two things.
And one is why the Democrats covering the story in the left-wing media and their Not running away from it like they did with the Hunter Biden story.
I don't think the reason is because they want to get rid of Joe Biden for 2024, because if that's what they want, they wouldn't have to jeopardize their whole agenda of getting Trump for obstruction of justice, because now they can, quote, hold Trump accountable.
All right, that makes sense.
So give us your theory.
Right.
I mean, they just have to let some other Democratic candidate run, and he loses because he's the least popular Democrat.
So my theory is like this.
They know that the Republicans have the House now.
And they're going to come out with a lot of dirt about Democrats.
And so the Democrats are going to be in the hot pot.
So they want to lower the flame and set up a perception where the Democrats hold their own accountable and they also hold their opponents accountable, like Trump and others with the January 6th game and everything.
And then they'll say Republicans are only holding Democrats accountable because they didn't vote to impeach Trump with Russian collusion in January 6th.
But we went after Joe Biden when it came to the classified documents.
It's kind of interesting.
You know, there's a certain logic to it.
And I appreciate Alex.
But there's a point at which the whole that theory collapses.
They've never held themselves accountable for 40, 50, 60 years.
It's the opposite of accountability.
So I need some pretty convincing evidence as to why they would start doing that now.

All right, seriously, we've talked to Stella Morobito, former CIA specialist on Soviet propaganda, which makes her unusually, unusually qualified to talk about So many things today.
She is the author of a new book, The Weaponization of Loneliness, How Tyrants Stoke Our Fear of Isolation to Silence, Divide and Conquer.
What an amazing topic.

So, why this book?
Why now?
Let's start with the geopolitical context.
Why have you written this book now, Stella?
Well, now I think is more relevant than ever, but why I wrote the book was I felt that we needed, I think most people, especially Americans, need a blueprint for understanding how all of these forces of psychological manipulation operate on them to induce them to self-censor.
You know, when we shut up about what we believe, and we've been doing that, Americans in general have been doing that for way too long, very obedient to political correctness, That's how things get as bad as they've gotten today.
We do a lot of the heavy lifting for those who want to censor us under the guise of quote misinformation.
Yeah.
So we in the last hour we truly you cannot you cannot make this up to have Brian Stelter formerly of CNN at Davos at the World Economic Forum hosting a panel on disinformation.
Unless he's telling people how to do it, it is the deepest, deepest irony of all.
Are you surprised?
I, as an immigrant to this nation, who chose this nation, what I often say here on the show is one of the most important things you can do as an American is never censor yourself.
If you catch yourself biting your tongue in public, if you're on Facebook and you say, oh, I better not post that, the most important thing you can do is to cleave to the truth, to shout it even louder.
But one of the most tragic things I find in the last three years, Stella, Is our propensity as a nation to just cave when Fauci and others told us, close down the schools, mask the kids, close down the businesses.
Were you not shocked by the level of self-censorship and just genuflecting at the altar of the bureaucratic authoritarians?
Well, yeah, it was astonishing how compliant people were with all of these mandates, and especially with the sowing of hostilities against even family, you know, don't get together for Thanksgiving.
or shut them out of your life if they didn't get vaccinated, that kind of thing.
Very destructive to civil society and very destructive to our human relationships.
And when you think about it, you think about the history of communism from the very beginning, the Communist Manifesto in 1848, one of the prime sentences in that manifesto was, abolish the family.
And of course, the war on religion went right along with that.
And why?
Well, because when people have strong relationships with at personal relationships, family, faith, real community, organic community, not this fake community that they talk about at the World Economic Forum.
When you have that, totalitarians find that to be, you know, to go against their agendas.
Because people, when they have strong relationships, really can learn the truth.
They can learn about the world around them.
And this is very dangerous for tyranny.
In fact, Hannah Arendt, when she published her book in the mid-50s, The Origins of Totalitarianism, She made the point that terror can only rule over people if they're isolated against one another, and so the main concern of all tyrannical government is to bring that isolation about.
And so, of course, you know, we've had a loneliness epidemic for a long time, but COVID and all of those mandates just fast-tracked it all, and it actually enforced our isolation and also cultivated these hostilities that I was talking about.
How significant in all of this, and I think it's probably early days because the big platforms have only really been around for a decade or a decade plus, how significant an additional factor or fuel on the fire of this enforced isolationism to wield ever more power is the significance of the influence of social media?
Oh, yeah.
Oh, it's very significant.
I mean, that's where you can really start, you know, tyrants can really start developing mobs and shutting people down and, you know, the whole cancel culture thing.
Use that to great effect with a lot of people.
You know, part of the problem is that there is so much brokenness, you know, with family and faith and you know, community, and we have a bit of a road to go to try to revive civil society and rebuild a lot of that.
But people who don't have that to fall back on, don't have families or, you know, don't have strong relationships to kind of let their hair down and say exactly what they think at home or, you know, in private, when they don't have that, they're a lot more vulnerable, a when they don't have that, they're a lot more vulnerable, a lot more susceptible to these forces that include social But they also include like your corporate human resources department.
I mean, a mob can be a street mob, but it can be a mob on social media.
You know, mobs are there to enforce political correctness and identity politics.
Yeah, this idea of dehumanizing the other, of canceling them.
So, of course, it's connected to Orwell, 1984, the memory hole.
But it goes right back to the genesis of communism.
So, you know, the other has to be dehumanized to the point at which, if we manage to kill them or exile them, they are airbrushed out of the photographs with Stalin.
So any idea that cancel culture is new, I mean, this is genetic code of socialism, is it not?
Absolutely.
Absolutely.
And you think about what would happen during the era of the Gulag in the Soviet Union, one of the, you know, in part of the mass hysteria was being declared a non-person.
Yes.
Actually, a non-person.
A non-person and that plays into our very, very natural human fear of ostracism, which is tied, the flip side of that is our very natural need to connect with other people.
To belong.
Absolutely.
And having, you know, and when you're cast out or you feel you're being ostracized, I mean, that's like a social death sentence.
And especially youth are very susceptible to that.
And so you see, you know, you see so much of the same phenomena, the same dynamics being played out.
But you know, I think it's kind of the default nature of a society.
What is?
This kind of tyranny.
I think that our founders, you know, with our Constitution, it's really kind of miraculous that they put together The only constitution of its kind.
The only nation in the world built upon the principle of individual liberty.
Based upon what?
Not rights endowed us by our government, but because we are made in the image of our Creator.

We are back with Stella Morobito, who is an expert on propaganda, on its application, not just during the Cold War when she worked at the CIA, but today under the COVID restrictions of the likes of Fauci.

Let's look at what to do about it, Stella.
During the Cold War, one of the most efficacious tools, in addition to helping those behind the Iron Curtain push back with the truth, Radio Free Europe, Radio Liberty, supporting Solidarnosc, the solidarity trade union in Poland, was a small group of very adventurous individuals.
They were White House staffers, State Department staffers, and congressional staffers, who under Reagan created something called the Active Measures Working Group that took, you know, particularly egregious examples of Soviet propaganda, such as the story they planted in India and in Africa through a Soviet cutout, a newspaper founded by the communists, that AIDS had been invented at Fort Detrick by the US Army to kill black Americans.
And they just showed the paper trail in declassified reports.
They showed the world, yes, this KGB officer working at this fake newspaper in India planted the story.
It was picked up here in Africa and propagated.
So basically, you know, they shed a massive searchlight beam on how the Soviets were doing this.
And people said, Oh wow, that's really despicable.
It's not an exterior threat.
It's not the Kremlin today.
It's not the second chief directorate of the KGB.
So how do we deal with propaganda being propagated against us by our fellow Americans?
Have you thought about that?
Oh yeah, and the example you gave of the Reagan years is really interesting because then you had the force of the federal government working for good.
Not like today.
Well, and today, we're dealing with kind of a hydra-headed beast.
All of these destructive agendas are coming at us from all different directions.
We've got not just government, but the corporate world and the wokeness in all of our institutions, education, big media, big tech.
Where do you go to turn this whole thing around?
I mean, it's, you know, it's not like you can go to the education, you know, institution of education or the media, especially these days.
So it really falls onto us as individuals.
And this was the whole thesis of Vaclav Havel's amazing essay in 1978 called The Power of the Powerless.
And his point was that our power really comes from that hidden sphere of life, our personal relationships, and how it ripples outward into communities and can overcome totalitarianism, just if you're just not afraid to speak your mind, to speak up, and in that hidden sphere or that private sphere.
And that, of course, is why the private sphere of life has always been a target Of tyrants.
Why, you know, it's abolished the family, as the Communist Manifesto says, or, you know... Have children dime out their parents to the state.
Oh, yeah.
I mean, that this is really chilling.
I mean, how the state is really starting to meddle in the relationship between parent and child.
And especially in medicine, where children are, you know, going to, you know, can get surgeries and vaccines without parental knowledge, even or approval.
So this is really, we're dealing with some really insidious criminal kinds of So there's a kind of poetry here, a kind of ironic symmetry, if you will, because the communists, the socialists, the WEF, the Davos types, they all want to atomize us.
They want us to feel as if we can't make a difference as individuals.
We're disconnected from society, from our family members.
But the flip side of that, as Habal said in his famous story, One man, one person telling the truth can be a catalyst, can be the start of a brush fire that collapses a whole dictatorial system.
So even if they are trying to atomize us, the power of one is really all we need.
Isn't that the irony, Stella?
Exactly.
And that we don't recognize that.
Yes.
And we have to learn that.
I wrote this book, The Weaponization of Loneliness, to kind of serve as a sort of blueprint to help people understand that one voice makes a huge difference.
It can embolden others.
I mean, I've told people, I started a book club on this theme a few years ago in the Washington area.
And one of the things we talked about, aside from it being very cathartic, people would talk about all kinds of, you know, experiences they had with political correctness and mobs and all of that.
But, you know, there's really three things.
People are very fearful of even expressing an opinion to someone who may implicitly trust them but doesn't know what they believe.
I mean, a neighbor or, you know, just somebody you see in daily life.
And Hobble talks a lot about that, how we don't necessarily know if people actually agree with us.
But one of three things can happen.
Number one, You just kind of say what you believe and you find out, and this has happened to me, and it's happened to others I know, that you've emboldened a like-minded thinker.
They'll say, oh yeah, you know, I've always felt that way, and that gets that ripple effect going.
The second thing that could happen is you're just engaging a fence-sitter, and that's really valuable because you're influencing that person.
And the third thing And the reason people shut up is because they're fearful that they're going to be rejected because that person will disagree with them.
But if it's that relationship, like a neighbor or somebody you implicitly trust, what can happen is you've watered down the stereotype associated with that viewpoint.
And that's valuable.
And let me tell you from personal experience, one of the most liberating things in your life is to get to a point where you don't Fear the third scenario, where you're not afraid what they may think about you.
It is liberating.

That's one thing that we're doing.
We're also looking to get this a vote in the Congress anytime an agency passes or issues a regulation.
The Congress has 90 days under the Congressional Review Act, 90 days to repeal it, to have a vote on a repeal.
Now, this is non-filibustrable in the Senate.
30 senators can force it in the Senate, so it doesn't matter that Chuck Schumer runs the Senate.
30 senators can force a vote.
Of course, we're working with the House leadership to bring up a vote in the House.
We want to put these people on record, and this becomes a chess game.
I mean, obviously Biden will veto this if it comes to his death, but then that just further pushes the momentum for defunding and slashing the ATF budget, which is exactly what needs to happen.
Yeah, this is something that Newt Gingrich managed to put in place in the 1990s, this 90-day review process that allows him to repeal something.
Do you have any sense, have you shaken the trees here in D.C., where we're at in terms of congressional willingness to fight this insanity to turn innocent Americans into felons?

They were asking, what can we do?
And this is exactly something that they can do.

The New York Post did a wonderful, you know, story on it.
I want to dive deep into all of this.
I think what we could do of value to our listeners is to a little bit of a one-on-one on clearances, handling of classified documents, what the reality is, so people understand how egregious this is and how the Mar-a-Lago case has no application here because of the unique powers of a president.
But before we get into the nitty-gritty, because you are So imbued with an understanding of this stinking hellhole that is Washington, D.C., I've got to ask you your take, just what your spider sense is telling you.
Because originally, when the first thing broke about the Penn-Biden think tank, the closet with the top secret, our producer Jeff, who has a very good political radar, said, They're just dropping this now to make it so that in two years' time, it's not a story.
They want to get in front of the story, drop it now, and protect Joe so he's fine in two years' time.
Then, in the preceding 48 hours, we had the garage.
We had the private office.
We had, you know, three more drops.
Which you don't do unless you want to hurt the person concerned.
So is this Joe being thrown under the bus or something else?
What would you bet your money on Joe?
Well, here's my take.
The first and most important question is why on November 2nd did the lawyers go to the Penn Biden Center to do the search?
My guess is Something happened that was very serious.
It drove them crazy.
They had to do something right away.
They hid it.
Now remember, they hid it until January.
Until after the midterms.
And they sent lawyers.
They sent lawyers to that office.
So they have the client-attorney privilege.
At least they thought they were going to get that.
But if you're committing a crime, you don't have the attorney-client privilege at that point because of the crime-fraud exception.
But that aside... And there's no exception additionally.
Let me just be clear, because you are the experts.
There's no exception to sending your attorney if your attorney doesn't have a clearance.
You can't be handling classified documents unless you have a clearance, whether you're an attorney or not.
Precisely, and isn't it interesting that they did not tell the Justice Department right away what they knew.
See, I think they knew there were classified documents there before they went.
So something precipitated it.
Yes, that's the most important question.
They had to respond.
What do you think?
I don't know.
I think there was somebody outside of the little circle.
Otherwise, they might have just deep-sixed those classified documents.
They didn't have any choice.
Acknowledged.
This is my, not a theory, but you know, I'm suspect that there could be, it could be something as simple as somebody with a personal animus.
Oh yes.
Who's just dripping it from the outside and there has to be this crisis management.
And went to somebody else in the government, like the U.S.
Attorney in Delaware or the Justice Department or somewhere.
So they were caught.
They couldn't get rid of it.
They had to deal with it.
Right, so before we do our one-on-one on all of these issues and what a skiff is and who can handle classified information, let's start with They're trying to make an analogy between this and Mar-a-Lago.
Why is it utterly fallacious to say, well, this is similar to Mar-a-Lago because he was the vice president?
Two different laws.
Totally.
Presidential Records Act, which was meant for a negotiation in a back and forth.
And which wasn't a criminal bill.
Never a criminal bill.
So that, I mean, Trump is completely different.
So when it comes to regulating, managing classified materials, records to do with a president, we have something that's a civil matter.
Presidential records, usually negotiations, sometimes in the case of Nixon and others, takes years, if not decades, to settle.
It was passed in 1978.
Right.
So it was because of Nixon it was passed.
And then, in the case of a vice president, which laws apply, Jo?
It's not the Presidential Records Act.
- No, it's not the presidential record.
- It's the Espionage Act.
- Well-- - No, no, it's 18 U.S.C., 1924. - But also the mishandling of-- - You can have, there are lots of statutes that could apply depending upon the facts, but not the presidential records.
He doesn't have any right to take any records at all, at any time.
He doesn't have the power to declassify-- - He can request, but he cannot declassify.
No, he could have asked President Obama to declassify things.
President Obama has not been asked whether or not he was asked by Vice President Biden to declassify things.
Interesting, yes.
And he should, and no doubt he won't answer.
But there are two different situations.
They are not similar at all.
Now, 18 U.S.C., 1924.
1924, and I give it because I know readers like to Google right away and find it, says it is a crime to remove and retain classified information.
So it doesn't matter if he had put these classified documents in a time vault 20 feet under the earth.
He was not supposed to have them.
He can't have them under any circumstance.
Even in a skiff, he cannot have them.
And there's also this amazing point that one of our listeners made and called in.
There's a chronology issue.
The Penn State think tank, Biden's whatever, wasn't announced and established until a year after he left the vice presidency.
So where were the documents then?
Where were they during that year?
Were they in some, you know, storage facility in a, you know, Home Depot, you know, spackle bucket?
I mean, we don't know.
No, nobody knows, and that's why the manner in which this has been handled by the Justice Department is so outrageous.
Explain.
Well, because they didn't do an investigation.
They've allowed the lawyers for the President, the private lawyers, to do all the searching instead of allowing the FBI.
Once they knew there were classified documents, that's a crime per se.
There should have been FBI agents conducting all of those searches, but Merrick Garland decided no, We want to allow his lawyers to do the searching, and then they allowed some government lawyers to go with him, and then they allowed the White House counsel to go.
This is nonsensical.
With a complete absence of armed federal agents a la Mar-a-Lago.
Think of the irony.
When Trump's Mar-a-Lago was raided, the FBI would not allow the lawyers to even accompany them to make sure that the search was being carried out properly.
No, this is really important.
We had one of the lawyers on the show who said, we were not allowed to see what the feds were doing on the president's private property.
And should have been, just to make the balance of authority there.
And yet, the Biden lawyers didn't allow the FBI to come in and watch the search.
It's really quite remarkable that Merrick Garland has stood on its head the federal investigative process.
He has ruined it by not allowing FBI agents to do... Once they discovered the first classified document and were told about it, there should have been a special counsel and the FBI... And that special counsel, by the way, Mr. Herr, we haven't heard bupkis from him.
I'd be pissed as hell if I were the special counsel and the FBI was not allowed to conduct these searches.
We'll talk about Mr Hearn next, but just adjust the position of two things.

People know I take classified documents and classified information seriously.
When my lawyers were clearing out my office at the University of Pennsylvania, they set up an office for me, a secure office, in the Capitol.
The four years after being Vice President, I was a professor at Penn.
They found some documents in a box in a locked cabinet, or at least a closet.
And as soon as they did, they realized there were several classified documents in that box.
And they did what they should have done.
They immediately called the archives, immediately called the archives, turned them over to the archives, and I was briefed about this discovery and surprised to learn that there were any government records that were taken there to that office.
But I don't know what's in the documents.
My lawyers have not suggested I ask what documents they were.
I've turned over the boxes.
They've turned over the boxes to the archives.
And we're cooperating fully, cooperating fully with the review, and which I hope will be finished soon.
And there'll be more detail at that time.
The first question now I forgot.
The last bit gets me every time.
Forget the Crimes Committee, the connections to Ukraine, everything else.
Just the mere fact that his defense, Biden's defense at that press conference in Mexico is, I didn't know I had the classified documents and I don't know what's in them.
That makes me feel so much better.
Doesn't it?

There could be millions more.
I have no idea.
And what's in them?
Nuclear launch codes?
Don't worry about it, because I don't know what's in them.
We are dissecting all of it with Victoria Tunsing, Georgia General.
So we had Devin Nunes on right after this broke for a whole hour.
And this is why you know he was the right person as chairman of the Intelligence Committee.
Because I showed an image on screen that somebody else has found.
Of the background screening request, I think it's probably a credit request, for a certain individual who was buying, or about to, uh, no, buying, yeah, the box has been ticked, purchased, by the building in which the secret documents were found, uh, next to the Corvette.
And interestingly, the name at the top of the form isn't Joe Biden, it is Robert Hunter Biden.
So it's not even Joe's house.
It's Hunter's.
And then as we're on air, because I hadn't read the whole thing.
I just looked at the who signed it.
He says, Devon says, did you read the rest of that document live on air?
I said, no, no, just the top bit, the bit about Hunter.
Look at what it says for monthly rent.
Because Hunter has to put in there how much he's currently paying as part of the credit check.
And it says $49,910.
As somebody else said right after that, and I reposted it, how does a drug addict, how does a crack addict get $50,000 a month for rent?
It's a very good question.
Let's get back to the law.
Is there anything... That's the rent he got from the Chinese.
Oh, that's probably... Exactly the same amount, $49,000, whatever, and change.
So does this add an extra twist to the story that it's not even Joe Biden's home?
It's Hunter Biden's, a guy who lost his clearance because in the Navy first day on the job, he failed a drug test, Joe.
It is part of a an entire picture that needs to be investigated.
There are so many unanswered questions that require a federal grand jury, that require detailed number of agents assigned to get data.
Now, this also-- - But can that happen if the DOJ is under Merrick Garland? - But he's already appointed a special counsel.
And so the question is, what is David Weiss, the U.S.
attorney in Delaware, doing?
What is the status of that?
Because that relates directly to this.
We are now in the fifth year of the investigation of Hunter Biden.
There's no way an investigation of Hunter Biden takes more than a year and a half, given what's there.
Why do we allow that?
Why does the U.S.
if they were going to go into the kickbacks and the foreign agent activities overseas, which we have no indication they've gotten into.
So now this raises the whole specter of foreign payments from the Chinese, 70 million perhaps into the University of Pennsylvania after Biden went there.
Anonymous donations from communist China.
Why do we allow that?
Why does the U.S. law allow anonymous foreign donations?
Fabulous question.
I think that the entire thing screams for a massive grand jury investigation.
And of course, with Merrick Garland, there's no reason to believe that's going to happen.
So I had Lord Black on the show yesterday, and Conrad Black said, the Office of Special Counsel, Special Prosecutor, is a travesty, is an abortion.
All of them, all of them were scoundrels.
And I made sure to say, except one, right, Conrad?
And he said, oh yes, oh yes, that chappy Joe DiGenoa, the only Honorable Special Counsel out there.
So you know of what you speak.
You, on the other hand, have served with a clearance on the Senate Intelligence Committee.
So let me ask you a very pragmatic question.
We have a new Congress, not a new Senate, but what should be happening and do we have any chance?
Will Jim Jordan have Sir Peter Powell?
We're hearing maybe Kevin McCarthy has to sign off on that.
Give us your unvarnished realistic expectations of the next two years when it comes to these issues on Capitol Hill.
Well, I'll try to be the optimist and hope that Jim Jordan has the capacity to decide what kind of warrants or subpoenas that he's going to issue.
You know, in the past Congress, when Trump was first elected in those two years, they wrote letters requesting people to come in.
And I said to Mark Meadows one time, because he was still in the Congress, do you know how to spell subpoena up there?
It's complicated.
It's a Latin word.
It's complicated.
Right, Joe?
A little Italian.
He said, well you have to talk to Paul Ryan and Trey Gowdy because they will not let us because it doesn't look nice.
The fake conservative and the fraud.
Yes, Trey Gowdy, I called you out.
You are an utter fraud.
So, looking forward?
Expectations?
I'm just going to hope and pray that they get enough.
Hope is not a strategy.
I know it isn't.

But they better subpoena the right witnesses and get And here's what they have to do, and we've talked about this, they have to get a counsel there who brings continuity to the questioning.
Right, a professional.
Yes, they can't do 5 minutes, 5 minutes, 5 minutes.
Not a congressman who reads things for 60 seconds that a staffer gave him, right?
And then another one on the same political side doesn't even follow up on it.
Because Democrats are really good at following up.
If they're going to do it right, they have to do depositions in private.
Very, very detailed.
Like January 6th.
Yes, do serious depositions.
But they have to have professionals run them.
That's exactly right.
What are your expectations for the next two years, Joe?
Knowing the swamp, having served in the swamp, being a U.S.
attorney for D.C.
I don't have a lot of confidence in the Republicans because they've never demonstrated the kind of things that would give us confidence.
But if Jim Jordan and Mr. Comer can get their act together, but they must hire the right staff.
They can't go with a bunch of old hands.
They have to hire good people.
Should it be lawyers or should it be national security experts?
They need lawyers.
They need academics.
They need a former FBI.
They need investigators.
And they need a message person.
Because they don't know how to give out a message.

I have a very prosaic, kind of naive question, but it really plagues me every time I hear this latest scandal of a Republican being thrown to the dogs and then a Democrat walking away, like that recent case of Sussman who should have, we had the text messages, he lied, he purged himself, he should have gone to jail and what have you.
So my question is this, how does it work in practice?
In Delaware, you said, for example, they've been sitting on this Hunter Biden case.
Does the local U.S.
attorney say, don't do that.
Put that file in the shredder.
We're not going after him.
Oh, but Devin Nunes' chief investigator, yeah, throw the book at him.
Subpoena him.
Is there no paper trail?
Is this all done with a wink and a nod and a funny handshake?
Because there has to be so much evidence at this point of the corruption, or am I dreaming?
No, what's happened is there's been an incredible sea change in the ethical environment inside the Department of Justice and the U.S.
Attorney's offices around the country.
It's all ideological.
They've gone far to the left, and they've justified all sorts of unethical, unprofessional conduct.
And they've targeted people that they disagree with politically.
It's been a complete abuse of the process.
And what's most sad about it, however, is that the federal judges have gone along with it.
Very few of them have stood up and said, I don't like this.
I don't understand why this is happening.
I don't trust you.
It's just amazing.
And including many Trump appointees on the federal bench who've not done their job.
I am extremely disappointed in the federal bench.
One of the best, or maybe I should say worst, examples is the DC bench.
Well, and all the January 6th judges.
Well, that's what I'm talking about.
They're all the January 6th judges.
That's who they are.
Well, you have judges and also public defenders.
This is, as a child of those who escaped communism, this beggar's belief.
Giving the indicted January 6 individuals mandatory reading lists that are politically and ideologically skewed and saying in front of the judge they must pledge allegiance by saying in public, yes, Joe Biden is the real president.
I mean, that's Maoist.
That's not American, Joe.
This is stuff that should never happen in an American United States District Court.
It's an embarrassment.
The Justice Department under Merrick Garland has become basically a Saturday Night Live joke.
And unfortunately, they have the power to lock people up, to send stormtroopers to their house like they've done with Republicans and not with a single Democrat.
I really am.
I'm just outraged at the way the Justice Department is being run and the way that the federal judiciary is not reacting to the outrages that are being conducted.

Are we not going to wake up one day, is one brave person not going to give us the leaked document where a U.S.
attorney, a judge in cahoots with the FBI, and there's this political chain of custody of, yes, let's crush this guy.

Let me say two things about that, because we talk about all these FBI informants that have come into Jim Jordan.
The whistleblowers.

Why hasn't anyone from the DOJ come in?
That bothers me greatly, because I work there.

Why is it all FBI agents?
Not a single DOJ person has come forward to complain.
And the reason is the place is now ideologically structured that they're almost all Democrats.
The entire career personnel are almost all Democrats.
That used to be meaningless but it isn't anymore.
It used to be when the Democrats took over, then more antitrust cases were developed.
Yeah, it was a functional issue.
Yeah, Republicans took over like Ed Meese.
Oh, we're going to go after pornography.
Oh, we'd all roll our eyes.
It was the proclivities of the party.
Yes, never.
Policy-based.
Never.
They served a search warrant on me and knew I did not have one document, but they wanted to embarrass me.
And then they called the press and said, guess what?
Well, it's like Peter Navarro, you know, contempt of Congress.
I have contempt for Congress.
And they shackle him, they leg-shackle him at Reagan Airport.
That has nothing to do with justice.
When he was negotiating.
And by the way, he lives literally a block from the DOJ, so they could have said, hey, Peter, can you come in tomorrow?

They arrest him in front of Americans and leg-shackle him at Reagan Airport.

All right, so many stories about Mar-a-Lago, the Biden file scandal, but nary one of them Actually starts at the beginning that the world of classifications and what people need to know because it is a you know What it what it did Jesus James Angleton call, you know, a wilderness of mirrors the intelligence community So we have strata of classifications the most precious and secret are q related code name related to do with nuclear energy nuclear weapons and
You have to fill out an SF-86, a background form to be investigated by the Federal Bureau of Investigations to get a clearance.
A clearance lasts for five years.
You have to be working for the government in a job that requires a clearance or a government contracted to maintain that clearance.
And these documents, whatever they pertain to, must be held in a secure facility called a SCIF.
And if they go in and out of a SCIF, they must be in a locked Curious bag, and you can't just put them in your garage.
Even more than that.
What?
When I was Chief Counsel for Goldwater, I worked in a skiff.
I mean, the guards were outside, it was a vaulted room, and we were in there.
And my first week as Chief Counsel, I didn't have any great appreciation.
I figured, I'm working in a skiff.
Did you make a boo-boo, Victoria?
What did you do?
I went to lunch and left classified information on my desk.
I got a black mark.
That's how... I was supposed to put it back in the safe.
Right.
I mean, so that's how serious they are about your following the rules.
And why does the president, Joe, have a very unique position in this galaxy of special information?
Because he is the only person who can declassify a document with the wave of his hand.
He can simply announce in his presence, as presidents have done.
Obama did this a couple of times by accident by talking about something that he shouldn't have been talking about it and automatically declassified it when it happened.
So a president has the ultimate authority on classification, but only he can declassify.
He has the authority to declassify.
Talk to us about the nexus, the connection of classifications, classified documents in the press.
Because we see this argument, we play this cut again and again and again from What's-His-Face, the guy who was canned from CNN, the brother of the Randy Gover of New York, who actually said on his show... Chris Cuomo.
Chris Cuomo, who said on his show, with regards to classified information, You're not allowed to read this.
We are.
We're journalists.
We'll tell you what's in it.
So the abuse of the mainstream media, of classified documents, goes back to the Pentagon Papers and is storied, is it not?
Well, they're not allowed to read them, actually.
They are given permission by the courts to read them, but as Justice Powell said in a very famous concurrence in an opinion, oh, they can read them and they can have them, but they can also be prosecuted.
Now no Justice Department has ever prosecuted a news organization for possession of classified information, but Justice Powell wanted to make it very clear that they could be prosecuted.
They were not immune under the statute.
That doesn't mean that they can't publish what they see.
But once they have those documents, they are just as liable as any private citizen for possessing those documents.
That doesn't affect their publication.
They can publish with impunity under the First Amendment.
They're protected, regrettably, in many instances.
But they can be prosecuted, but it's never been done.
I want to go a little bit off subject, but I think it's an important question.
And that is, the National Archives were mentioned again and again and again about Mar-a-Lago.
And they had said that they knew that they had documents missing from Trump.
They had, I don't know, they didn't list them, but they knew them.
Why didn't they know that these Biden documents were missing?
For six years?
Six years.
Why weren't they pursuing the Bidens?
See, that goes back to the original question, which is, somebody blew the whistle.
And those lawyers went there with a purpose.
They didn't go there to move Bach.
We've never been hired to move Bach.
They went there with a purpose.
They were Biden's plumbers, right?
And it had to do that someone blew the whistle.
The cover-up.
Someone blew the whistle, and they were there to begin the cover-up.
Plus, this is an important thing, whenever Joe and I have had a client, CIA or NSA, we have to call the agency and say, Sam Smith wants me to represent him.
Can I have clearances?
And then you get clearances for that representation.
They didn't want to ask for clearances.
They didn't want to ask for clearances.
But what happened was, when they got there and they found what they found, their hands were tied as lawyers.
Because in order to cover it up, they were going to have to lie.
And then they were going to be disbarred.
And then they could be charged with crimes.
And so once they found the classified documents, they had no choice Unless they were willing to commit crimes, which they weren't.
By the way, it wasn't Louis Powell.
It was Potter Stewart who said they could be prosecuted and made a big deal out of it.
By the way, little Miss Muffet, who I call the press secretary, said, they didn't have to tell anybody.
Oh, yes, they did.
Oh, no, no, no, no.
She repeatedly said, I found it so delicious because I hope it's going to be used against Biden in a court of law.
She repeatedly said it wasn't intentional.
The mishandling of the top secret Well, the statute says it's irrelevant whether you're giving it to the Chinese because you're a spy or you're a cretin.
And the little envelope says personal.
And who was the personal?
That's another statute.
And that's a statute, 18 U.S.C.
793, everybody wants to look it up.
That's the espionage statute.
That's the one that Hillary Clinton violated because she was grossly negligent handling them.
But she was allowed to have the documents.
She was authorized to have the documents.
Right, but she wasn't authorized to have a flunky go into a skiff, top and tail a document, print it out, and take it off to a private seller.
See, Biden has two statutes against him.
The 1924, which says it's a crime to remove and retain, and he's handled them sloppily.

Just a very pragmatic question.
After the Biden scandal, the eruption that I think is going to go on and on and on and on, does the Mar-a-Lago case against President Trump just collapse now?
Well, it's going to be much more difficult to prosecute the President over those documents.
Now, you know, they've got all these other investigations about the insurrection.
No, just the Mar-a-Lago.
No, I think it's going to be almost impossible to prosecute him for those documents.
If not legally, I never understood their legal basis for going after him anyway.
But he, you know, and the government has the burden to prove that he did not declassify those.
He did not.
Yes.
The government has that burden if it's going to prosecute him.
And then, you know, and I don't know how they're going to prove that.
And they can't go after him without there being far more serious ramifications for Biden because Biden did not have that unique authority, correct?
Politically, I mean, forget legally, politically, they cannot go after Trump.
That's why when Garland appointed a special counsel for Trump, he boxed himself in and then he had no choice.
This is interesting because I don't look at this man, especially when he's testified in front of Congress, It's very sharp.
Merrick Garland is not impressed.
He has been a federal judge for almost all of his adult life.
Federal judges make lousy executive officials.
Because they think they're, you know, kings.
They don't know how.
They don't know how.
They're cloistered.
And when they leave the cloister, they are clumsy, inept, and inarticulate.
Besides, we've known Merrick Garland for several decades.
And he's like Joe Biden.
He's lost a step or two.
This is not the Merrick Garland halting.
In comparison to how he was.
Yes.
He's lost the ease of speaking and he can hear his voice.
It's cracking.
He doesn't have a command presence.
He has difficulty reading the stuff that's in the teleprompter at the Justice Department.
He never takes questions.
He has not taken any questions as Attorney General.
I remember that press conference right after Mar-a-Lago where he ended it by saying, and how dare anyone impeach or impugn the FBI?
And then he walks off the stage!
Alright, he can tell us a few things about the decrepitude of somebody else as well.
Is it true that you grew up knowing Joe Biden?
I did.
We grew up together in Wilmington, Delaware.
Did you ever see Corn Pop?
Did you get into fights with Corn Pop?
You know, I never saw Corn Pop or a single Puerto Rican.
What?
But he said he was surrounded by Puerto Ricans.
There were no Puerto Ricans in Wilmington, Delaware.
And Catholic kids.
Catholic kids.
Lots of Italians and Irish.
