If you want to be a part of the program, another unbelievable blockbuster day in this, you know, sham courtroom in uh New York City, uh, you know, starting with Michael Cohn on cross-examination, admitting stealing tens of thousands of dollars from the Trump organization, uh, admitting, yeah, he did steal.
Uh talked about, you know, tet that he would goes to a bank, withdraws cash over a couple of days, uh totaling over 20 grand, keeping it in a pl a small brown paper bag, giving it to Redfinch, uh, but never giving the full amount to the company.
And he testified the Trump organization thought he paid the full amount.
He was still reimbursed, uh, which was pretty pretty unbelievable in terms of an admission.
Uh further, you know, discrediting him.
Uh on top of that.
One thing Andy McCarthy said, if Trump would only be convicted on the misdemeanor, well, that case that would have to be thrown out, rightly pointing out the statute of limitations on a misdemeanor, you know, that runs that ran out in 2019 or 2020.
Uh so that would ha that would absolutely have to be thrown out.
Uh that the former president, uh that the grand jury in in fact recommended charges against Trump, but they didn't get all the information he needed.
He said this on Fox News.
He was on America's newsroom to explain that uh Manhattan uh DA Alvin Bragg's team, they didn't want to see or hear exculpatory information that he provided them.
And as a courtesy, he spent an hour and a half on a Zoom call, and when he told them the exculpatory material, he said, you know, if that was supposed to be put before the grand jury, and they they literally cherry picked only those parts that would benefit an indictment against Donald Trump.
I mean it's pretty unbelievable.
Uh but anyway, uh they did give the schedule for this, and and that would be next Monday closing arguments would begin.
Anyway, Alina Haba is with us.
Uh she is the legal spokesperson for the president.
And uh anyway, Alina, you've been in the courtroom the whole time.
You were there all morning.
I mean, wow, what a moment.
How much how much the ultimately I saw conflicting reports, fifty, sixty thousand dollars that he stole from the Trump organization.
Yeah, it's unbelievable, Sean.
Um, it was uh twenty, you know, I have to be careful.
I I'll tell you the numbers, but I'm not gonna go too much into his testimony, but it was a a grave admission.
Obviously, there was um the numbers were I believe 50.
Was the actual number.
So um, you know, interestingly, it just kind of shows us, and and I think this was what my takeaway was I don't see that any of that's being prosecuted or that that was prosecuted, so you can feel uh, but that's not a problem.
If you're sitting here doing your job and being paid as a lawyer, that's a problem because you're Donald Trump.
And uh this is what we're seeing here.
These are the star witnesses.
This is the quality of people that they've come to rely on.
Um, and it's speaking volumes.
Every single day I've been here, there had been one catastrophe admission after another, and I'm just not sure how they are thinking they are going to wrap this case up at this point.
Now the jury's having a tough time, according to somebody that I spoke to in the room, rubbing their eyes, holding their their head in their hands and and shifting in their seats.
Like what I mean, how do you read that?
I think that they're beating a dead horse to some extent.
I think that we're hearing a lot of um, you know, they're now frankly on redirect trying to rehabilitate the witness, uh, which is uh the current status.
And I think they're trying to just re-ignite the excitement of the BS for lack of better words, fran that they've been doing for the free past few weeks just to keep President Trump off the campaign trail.
Um, you know, I I think they're getting bored.
I think there's the schedule is not ideal.
There's going to be a gap in the schedule before closing arguments and before jury charges and deliberations.
So we'll see what happens.
Then we have this issue of this novel legal theory uh by which 34 misdemeanor counts of business records quote falsification.
But again, I go back to what Cohn acknowledged on the stand that he told everybody that Trump wasn't involved at all.
Uh, but not that an NDA is a crime, which we've talked at length about.
Uh and and the idea uh I I'm kind of disturbed that the judge is unwilling to allow even um my understanding is the the guy that wrote the FEC law could testify and give very specific details to the jury, which are are crucial to the law in the case that is at hand here, and he's gonna limit that testimony.
Yeah, most of this morning was um actually about that was about getting our expert testimony in arguing how it's relevant for the jury to basically understand that we need to have an expert to testify as to campaign finance uh laws and regulations because it is a foreign, very niche world.
It's one that requires intent, it's one that requires the person not to be in the White House, uh not the one uh booking it in an accounting department at Trump org.
And there's a lot of back and forth, and I'm not surprised to see that I think the judge is wavering towards against again the prosecution there.
Um we've seen ruling after ruling here, Sean, and this is the one thing I can tell you coming out of this court, looking at objections, looking at what's been sustained, what's been granted.
Everything is always leaning towards the prosecution, and it's an unfair advantage.
It's what you can only see when you're here and see how much uh the objections are just ignored and overruled.
And to for us to not be able to bring in an expert to explain to a jury and to leave it to just be the charges that'll be done with the prosecution with the judge and with our oversight, it's just it will be detrimental uh to say the least.
Okay.
Bragg's team forgot to offer any evidence that the records were even falsified.
I mean, this would be a legal expense because the lawyer is admitting that he to everybody in and that would listen at the time uh and and admitting it on the stand that in fact he said he did all of it on his own, which would mean that would be a justified legal expense.
So they forgot to offer any evidence that records were falsified or to specify what the other crime is.
If I were to ask the members of the jury right now what the charges against Donald Trump were, I I would venture a guess that they could not answer that question.
Right, I assure you you're correct.
I I know myself I've been stopped by numerous people, and they have asked me to explain to them what this case really is about.
And uh the truth is people don't know.
The only thing this case really is about, frankly, is keeping him out of the campaign.
That's the truth.
Um it's evident with the testimony I've heard, it's evident with the lack of evidence.
It's evident with the fact that we have you know, lawyers being paid as lawyers is somehow now a crime.
And um and I think they're f frankly, the case is falling apart in front of everybody's eyes.
The only question we have is will the jury understand, will they be led in the wrong direction by judge decisions for jury charges?
And that's where my concern always lies because closing arguments will be one-sided for each side, but if the jury charges are not given in a fair manner, it will be incredibly um destructive to the case.
Why would we ever expect it from a judge that donated to Biden and then the whole issue of you know all everything that has been written about uh the family conflicts as it relates to the work of his daughter which I believe according to New York law would have required recusal.
So let's talk about the the time that Michael Cohn admitted he spent practicing testimony with the prosecutors in this case and the admission that Costello spent an hour and a half on the phone explaining all the evidence that they chose not to show the grand jury exculpatory evidence.
Doesn't a DA have a an obligation not to withhold exculpatory evidence like that?
Absolutely I think it's grounds for a mistrial it's grounds for reversal if you're not given a mistrial but in my opinion that should be grounds for a mistrial in itself.
We've made motions for mistrials as you know Sean here.
Again the problem this all goes back to is who's the one deciding if there's a mistrial a judge a judge who should have recused himself the matters of which you mentioned I cannot mention because of the unconstitutional gag order on my client and myself but I can tell you right now that this all goes back to the bench.
These things you're making out these points you're making right now are common sense.
They're accurate and anybody would say that that's what should happen.
The problem we have is as I'm sitting here in court right now you've got decisions coming off of a bench that has different political motivations than it should.
And that's where we get into trouble every time we're in the city.
So I I mean I know it all too well.
We'll see what happens but I will say that you know we're not done yet we have um uh are uh we have to we have to see what they do on redirect and then we will make determinations and strategy calls as it comes I mean it it's really unbelievable.
Let me go back to this issue of Judge Mershaw you know uh warning because your legal team has requested to bring forth forth a legal uh analyst my understanding is that the person responsible for actually writing the applicable law would be willing to testify.
You don't have to confirm that but if that's the case I would think that is the most relevant part of of your defense in as much as this is about the law.
We're talking about lawyers.
We're talking about a court of law and the judges you know just dismissed it is well then it will become a battle of the of the experts and uh and ultimately the prosecution would would summon their own expert but I don't think they can outdo a guy that maybe was involved in writing the law but anyway um the final decision was that they can't they can talk about general legal definitions terms related to the case but not it that any specific detail are you kidding me?
Yeah exactly that was the interesting portion it was that he wants the expert to come talk about his opinion but not actually what the law is not explained to them what it actually means and his hesitation in allowing this expert is that he thinks he cannot as a lawyer as somebody who has actual experience with campaign finance who ran it somebody who is in that whole department can't come speak to the jury about what it actually means to have one.
Don't forget Sean President Trump was never fined by the FEC he never got that charge.
That was Michael Cohen.
So they're convoluting and confusing the jury on purpose keeping out the expert again will further the confusion and what we will be left with as the judge has informed us this morning will be his version of the jury instruction after considering what the jury charges are from the prosecution side and ours.
So ultimately again it goes back to one person and that's the man in the robe on the bench um and uh yeah I mean it was un it was unheard of what I heard this morning saying we can't bring an expert uh because we don't want to have the jury understand the laws of finance which happens to be the claim that they're making in a misdemeanor form against President Trump discreetly I I've never I've never heard of anything this so fundamentally unfair.
Let me let me ask you a final question.
Um regardless of of all of the unfairness that has taken place uh they've not proven their case they have actually proven nothing.
Now I've said from the beginning too it's New York City can't get a fair trial.
How does this end in your view?
I don't know you have to run I think um I I look because I'm considering we're in New York, if you ask me how does it end after this case it should be completely an acquittal without question.
Uh because We have a New York New York jury, I say, you know, at worst a hung jury.
Um, I I really do think that they have destroyed credibility for the DA's office.
I think they've destroyed um credibility for frankly the judicial branch, and I think that this jury, if they're listening, will see that.
Now, do I think that they're always fair?
No.
Do I think people's biases still come through in a jury despite charges and despite everything else?
Absolutely.
So, um, look, uh if it was me, I would be the one making sure it was a hung jury because this they have proven nothing.
They have proven truly.
Well, we need an investigation and a brag with holding exculpatory evidence.
We need an investigation into the conflicts of the judge and whether he should have by law uh uh recused himself.

I mean, two really unbelievable things happening in in the course of this trial this afternoon, late afternoon when the jury was was out of uh the the courtroom.
And the first had to do with the FEC expert and the limitations that this judge put on the defense in terms of somebody that has the ability to actually tell tell the jury what the law is, because I guarantee you there's not a single person that has a clue about about the law and and what even Donald Trump is being being charged with.
I mean, that's how spectacularly unfair all of this has been.
None of this is a surprise considering the judge that we we have in this case.
Uh now we did learn at the end of uh the court proceedings today that in fact that uh Bob Costello is gonna be called as the second witness, which I think is a great idea.
However, they want to limit his testimony as well.
There's a big clash, you know, once the jury was excused for the day about the possibility and permissibility of Costello's testimony.
The prosecutor arguing that Costello's testimony should be admissible only to address any prior inconsistent statements.
The defense uh attorney said the prosecution opened the door to the evidence and that they intend to rebut the evidence pressure campaign theory.
Perfect.
By the way, Trump apparently looked bemused, but this case because he contradicts everything that Michael Cohn said.
You know, and he explained in in great specificity, number one, how exculpatory information of Alvin Bragg was withheld from the grand jury.
Well, the jury should hear that too.
But even more importantly, you know, he told uh, you know, Congress and Fox News, he specifically told them it was Michael Cohn said it was his idea to take care of the NDA and been contacted by a lawyer from Stormy Daniels, and he said that he did it all by himself.
I decided to do it all by myself, take care of it all myself.
All of that's admissible.
Anyway, we'll take a break.

It's just absolutely been insane.
Uh we've been summing it up for you all day.
I don't want to I don't want to keep repeating myself.
But uh this is not equal justice under the law.
Uh this is not equal application under the law.
It is not it is not constitutional what's been happening, and we see what it is also done, and that is kept uh a major presidential candidate in a courtroom for five, six weeks, and it's just gonna go on into next week.
So he can't campaign like his opponent who wants to dictate all the terms of the debate along with the media mob, and then declare, all the all the debate about debates are over.
No, it's not.
You don't get to dictate all the terms of the debate.
The fact that Donald Trump's agreed to do it uh is you should be glad.
He said you wanted your day made, he made your day.
And we'll double make your day.
Do one on Fox News with Brett and Martha.
I'm not asking to be the moderator of that debate, although, Linda, I don't you think that would be very good at it.
I do a good job.
I mean, I think it's I think it would be amazing.
I think you would be great at moderating anything.
I don't know how hard or easy it is to moderate, you know, sleepy Joe.
I mean, he can barely get through a five-minute speech, and then he starts to talk about Uncle Bosey.
I don't know how you moderate that.
Well, and uh, President Trump, and I'll tell you, it's not just him.
Everybody I talked to this weekend wanted to know about yeah, why don't they have a drug test?
What we saw at the State of the Union was not normal.
You saw jacked up Joe.
And everyone's now using my term.
I was on immediately on Fox after the State of the Union and and I started with Jacked Up Joe, and I noticed it's gone viral.
Now people say, Well, what are you saying, Hannity?
I said he's jacked up.
I don't know if it's Red Bull, I don't know if it's caffeine.
Uh the not blinking thing is super weird.
I mean, there's a lot of conversation about that on social.
It's it's super weird.
Well, it's it's it's look, the bottom line is uh I you they do this to professional athletes.
Why wouldn't they do it to to somebody?
Look, here's what I know.
We we've never seen jacked up Joe the State of the Union address, and we've not seen it since.
Now that's interesting to me, because he's gone right back to form, which is mumbling, bumbling, stumbling, tripping, and falling Joe.

Uh thank you for taking my call, Sean.
Hey, uh, two points I wanted to make.
One was I know you were uh discussing uh my cousin Vinny, that that movie, but I was thinking about what about Lincoln lawyer with Matthew McConaughey.
If you remember uh there was a scene where the judge had to call them into chambers because he was gonna dismiss the trial because he put a known liar on the stand.
How is it different?
Because he I mean he's critical to the case.
I mean, he he literally destroyed the prosecution's case uh both last week and and what happened today.
Putting a known liar on is is okay.
There's not gonna be, you know, a mistrial because you know, and it just I mean it goes to his you know character again, stealing thirty thousand dollars from you know, the Trump organiz I mean uh don't the jury say, you know, look at this guy's character, look at who he is, and oh yeah, we're gonna believe what this guy has to say.
That logically doesn't make sense.
But anyways, uh one other point was I remember when you did the uh the debate with uh DeSantis and uh Newsom, and when you did that, you you put on the background on the on the TV screen uh you know their numbers for the state of California and the state of Well, that's how I was asking the questions, and the questions were very fact-based.
And I never once, not one person, and because we were so diligent in getting the right numbers, like when I had all right, here are the crime statistics from the FBI, violent crime, rape, murder, homicide.
This is California's number, this is this is Florida's number, and and the rate was twice as high in California.
Well, when I put up the taxes, this is your tax rate, the tax rate in California, this is the tax rate in Florida.
You know, I got everything right, and I never got criticized for what I put on the screen.
However, you know, any debate that Donald Trump does, I would say no media should be allowed to do anything because we know the media is corrupted and abusively biased.
Look at fake Jake Tapper.
You know, he he should not be uh a quote moderator in this debate at all.
Right.
In any debate.
That was to me very powerful.
And I think the the problem with maybe the you know the American public, I think if you did it on your TV show, because a ton of people dislike Trump and a ton of people dislike Biden.
But uh if we just I know we it you can't eliminate their names from you know this election because that's who it is, but if you just put Democrat and you put Republican and you show you know, every single day the people were saying, okay, if you want, you know, kids to, you know, at five-year-olds to have you know their private parts removed, vote Democrat.
If you want to give billions of dollars away to another country to defend their border, vote Democrat.
You're you know, you see what I'm saying, as opposed to saying Trump and because everyone's focused on the name, but if you were to show you know the policies, you know, and show, okay, if you want the gay pride flag hanging from the White House, vote Democrat.
I'm not telling you not to vote that way.
What I am saying is if you vote Democrat, you know how in a in a sports game, they always say this is why we play the game.
You know, this is why we play the game to find out who's gonna win.
This game's our this really does illustrate how bad they want to destroy this man.
This case is been the worst case possible uh for those that are using lawfare and weaponizing our Justice Department and justice system against Donald Trump.
And I think the American people see it.
I think it's being reflected in the polls, and once again, they have overreached, and once again, the net result is it is boomerang back against them.
And I can only say to you that you know, let's let's watch how this plays out.
I still don't trust any New York venue.
I don't.
But uh Derek, I gotta let you run.

I got three quick points that I want to make.
Number one.
This trial in New York should have never happened.
Number one.
But when Sony Daniels got off of the witness stand, it should have been declared a mistrial.
She was there for no other reason but but to disparage Donald Trump.
Had nothing to do with the case whatsoever.
Number they then they bring on Michael Cohen, who's a known liar, and lo and behold, what does he do today but admit to a felony on the witness stand?
Well, I I think that that and of course, you know, being coached by the prosecution, and then coupled with and and Michael Cohn admitting on the stand today, he told all these media people that Trump had nothing to do with any of it.
Okay, that's the heart of the case.
Case closed.
And it it literally should be a directed verdict.
It should be over by now, but the judge is so abusively biased and compromised and should have recused himself that that that's not gonna happen.
Letitia, Alvin Bragg, this judge, the other judge, whatever his name was, Fonnie Willis, are all gonna be sitting where Donald Trump is sitting right now.
That's my hope.
If it'll happen, no idea.
I just don't want what they have given us, and that is a weaponized system of justice.
I really I really don't.
I don't want a weaponized system of justice.
I want equal justice under the law.
I want equal application of our laws.
I want America.
Uh I I don't I I I believe in a constitutional republic.
And I don't want done to any Democrat what they've done to Donald Trump.
That's what I want.
And me maybe some people don't believe me.
I am telling you, believe me, it's not we won't have a a country if this continues.
That's how dangerous it is.
Second point I want to make is if there is a debate between Donald Trump and Joe Biden, and it's all done by TV and no audience there.
I anticipate there's gonna be a lot of commercial breaks.
You probably are right.
I do like the drug test idea.

As far as the debates go, it's such a setup.
And I know Trump is is smart and his people are very smart.
What they're gonna do is Biden is gonna stew lies.
The moderators are gonna support him when Trump tries to rebut it.
They're gonna cut off his mic.
They're not going to let him speak.
It's gonna be just like this gag order with this trial.
And this trial is is ridiculous, and I know that.
And I'm trying to have faith in the New York jury.
People say New Yorkers hate Trump.
But you know what?
New Yorkers are not chunks.
They don't like to be played.
And I'm praying that that there's one or two on there that says, no, this ain't right.
I'm not going for it.
Because I am I am of the belief that there's got to be at least one or two.
You've got to be of the belief.
Now, it should be a full out acquittal.
It should be a directive verted by the judge.
All of that is right.
All that is correct.
They've not proven their case, and if anything, the the we we we now have really serious ethical issues for attorney general, uh D.A. Bragg on the issue of withholding exculpatory evidence to the grand jury.
This is why you can indict a ham sandwich.
This is what's scary.
And the other one is for the judge and why he didn't recuse himself.
We need investigations into both.
However, they'll come from Congress uh in the end, is my guess.
But you know, unless Republicans win the House and the Senate, it's not gonna go anywhere by big margins.
We need a big victory in November, not a little victory, not a not a squeaker.
We need a massive, massive victory.
I hope the people in Wisconsin are hearing me.
Michigan are hearing me, Pennsylvania are hearing me.
Georgia, North Carolina are hearing me.
Arizona, hearing me.
I hope New Mexico's hearing me.
I hope Minnesota's hearing me.
I hope the rest of the country's hearing me.
I want a landslide, massive win, and including in that House of Republican House members and senators.
That's you know, if we're gonna save this country, that's what it's gonna take.
