I don't think I've ever seen a star cooperating witness get his knees chopped out quite as clearly and dramatically as what just happened with Michael Cohen.
And Trump's more ahead than he's ever been.
It's going the wrong way.

And our two Sean Hannity show, toll-free on numbers 800-941, Sean, if you want to be a part of the program, another unbelievable blockbuster day in this sham courtroom in New York City, starting with Michael Cohen on cross-examination, admitting stealing tens of thousands of dollars from the Trump organization, admitting, yeah, he did steal.
Talked about, you know, that he goes to a bank, withdraws cash over a couple of days, totaling over 20 grand, keeping it in a small brown paper bag, giving it to Redfinch, but never giving the full amount to the company.
And he testified the Trump organization thought he paid the full amount.
He was still reimbursed, which was pretty unbelievable in terms of an admission, further discrediting him.
On top of that, one thing Andy McCarthy said, if Trump would only be convicted on the misdemeanor, well, that case, that would have to be thrown out, rightly pointing out the statute of limitations on a misdemeanor.
That ran out in 2019 or 2020.
So that would absolutely have to be thrown out.
The former president, the grand jury, in fact, recommended charges against Trump, but they didn't get all the information he needed.
He said this on Fox News.
He was on America's newsroom to explain that Manhattan DA, Alvin Bragg's team, they didn't want to see or hear exculpatory information that he provided them.
And as a courtesy, he spent an hour and a half on a Zoom call.
And when he told them the exculpatory material, he said, you know, if that was supposed to be put before the grand jury and they literally cherry-picked only those parts that would benefit an indictment against Donald Trump, I mean, it's pretty unbelievable.
But anyway, they did give the schedule for this, and that would be next Monday.
Closing arguments would begin.
Anyway, Alina Haba is with us.
She is the legal spokesperson for the president.
And anyway, Alina, you've been in the courtroom the whole time.
You were there all morning.
I mean, wow, what a moment.
How much did he ultimately, I saw conflicting reports, $50,000, $60,000 that he stole from the Trump organization?
Yeah, it's unbelievable, Sean.
It was 20, you know, I have to be careful.
I'll tell you the numbers, but I'm not going to go too much into his testimony.
But it was a grave admission.
Obviously, there was the numbers were, I believe, 50 was the actual number.
So, you know, interestingly, it just kind of shows us, and I think this was what my takeaway was, was I don't see that any of that's being prosecuted or that that was prosecuted, so you can steal, but that's not a problem.
If you're sitting here doing your job and being paid as a lawyer, that's a problem because you're Donald Trump.
And this is what we're seeing here.
These are the star witnesses.
This is the quality of people that they've come to rely on.
And it's speaking volumes.
Every single day I've been here, there had been one catastrophe admission after another.
And I'm just not sure how they are thinking they are going to wrap this case up at this point.
Now, the jury's having a tough time, according to somebody that I spoke to in the room, rubbing their eyes, holding their head in their hands and shifting in their seats.
Like, I mean, how do you read that?
I think that they're beating a dead horse to some extent.
I think that we're hearing a lot of, you know, they're now, frankly, on redirect, trying to rehabilitate the witness, which is the current status.
And I think they're trying to just reignite the excitement of the BS, for lack of better words, that they've been doing for the past few weeks just to keep President Trump off the campaign trail.
You know, I think they're getting bored.
I think the schedule is not ideal.
There's going to be a gap in the schedule before closing arguments and before jury charges and deliberations.
So we'll see what happens.
Then we have this issue of this novel legal theory by which 34 misdemeanor counts of business records, quote, falsification.
But again, I go back to what Cohn acknowledged on the stand that he told everybody that Trump wasn't involved at all, but not that an NDA is a crime, which we've talked at length about.
And the idea, I'm kind of disturbed that the judge is unwilling to allow even my understanding is the guy that wrote the FEC law could testify and give very specific details to the jury, which are crucial to the law and the case that is at hand here, and he's going to limit that testimony.
Yeah, most of this morning was actually about that, was about getting our expert testimony in and arguing how it's relevant for the jury to basically understand that we need to have an expert to testify as to campaign finance laws and regulations because it is a foreign, very niche world.
It's one that requires intent.
It's one that requires the person not to be in the White House, not the one booking it in an accounting department at Trump Org.
And there's a lot of back and forth, and I'm not surprised to see that I think the judge is wavering towards against, again, the prosecution there.
We've seen ruling after ruling here, Sean, and this is the one thing I can tell you coming out of this court, looking at objections, looking at what's been sustained, what's been granted.
Everything is always leaning towards the prosecution, and it's an unfair advantage.
It's what you can only see when you're here and see how much the objections are just ignored and overruled.
And for us to not be able to bring in an expert to explain to a jury and to leave it to just be the charges that'll be done with the prosecution, with the judge, and with our oversight, it's just, it will be detrimental to say the least.
Okay.
Bragg's team forgot to offer any evidence that the records were even falsified.
I mean, this would be a legal expense because the lawyer is admitting to everybody that would listen at the time and admitting it on the stand that, in fact, he said he did all of it on his own, which would mean that would be a justified legal expense.
So they forgot to offer any evidence that records were falsified or to specify what the other crime is.
If I were to ask the members of the jury right now what the charges against Donald Trump were, I would venture a guess that they could not answer that question.
I assure you, you're correct.
I know myself.
I've been stopped by numerous people, and they've asked me to explain to them what this case really is about.
And the truth is people don't know.
The only thing this case really is about, frankly, is keeping him out of the campaign.
That's the truth.
It's evident with the testimony I've heard.
It's evident with the lack of evidence.
It's evident with the fact that we have, you know, lawyers being paid as lawyers is somehow now a crime.
And I think, frankly, the case is falling apart in front of everybody's eyes.
The only question we have is will the jury understand, will they be led in the wrong direction by judge decisions for jury charges?
And that's where my concern always lies, because closing arguments will be one-sided for each side.
But if the jury charges are not given in a fair manner, it will be incredibly destructive to the case.
Why would we ever expect it from a judge that donated to Biden and then the whole issue of everything that has been written about the family conflicts as it relates to the work of his daughter, which I believe, according to New York law, would have required recusal.
Let's talk about the time that Michael Cohn admitted he spent practicing testimony with the prosecutors in this case and the admission that Costello spent an hour and a half on the phone explaining all the evidence that they chose not to show the grand jury exculpatory evidence.
Doesn't a DA have an obligation not to withhold exculpatory evidence like that?
Absolutely.
I think it's grounds for a mistrial.
It's grounds for reversal if you're not given a mistrial.
But in my opinion, that should be grounds for a mistrial in itself.
We've made motions for mistrials, as you know, Sean, here.
Again, the problem this all goes back to is who's the one deciding if there's a mistrial?
A judge, a judge who should have recused himself.
The matters of which you mentioned, I cannot mention because of the unconstitutional gag order on my client and myself.
But I can tell you right now that this all goes back to the bench.
These things you're making out, these points you're making right now, are common sense.
They're accurate.
And anybody would say that that's what should happen.
The problem we have is as I'm sitting here in court right now, you've got decisions coming off of a bench that has different political motivations than it should.
And that's where we get into trouble every time we're in the city.
So, I mean, I know it all too well.
We'll see what happens, but I will say that, you know, we're not done yet.
We have to see what they do on redirect, and then we will make determinations and strategy calls as it comes.
I mean, it's really unbelievable.
Let me go back to this issue of Judge Mershon, you know, warning because your legal team has requested to bring forth a legal analyst.
My understanding is that the person responsible for actually writing the applicable law would be willing to testify.
You don't have to confirm that.
But if that's the case, I would think that is the most relevant part of your defense in as much as this is about the law.
We're talking about lawyers.
We're talking about a court of law.
And the judges just dismissed it as, well, then it will become a battle of the experts.
And ultimately, the prosecution would summon their own expert, but I don't think they can outdo a guy that maybe was involved in writing the law.
But anyway, the final decision was that they can talk about general legal definitions, terms related to the case, but not any specific detail.
Are you kidding me?
Yeah, exactly.
That was the interesting portion.
Was that he wants the expert to come talk about his opinion, but not actually what the law is, not explain to them what it actually means.
And his hesitation in allowing this expert is that he thinks he cannot, as a lawyer, as somebody who has actual experience with campaign finance, who ran it, somebody who is in that whole department can't come speak to the jury about what it actually means to have one.
Don't forget, Sean, President Trump was never fined by the FEC.
He never got that charge.
That was Michael Cohen.
So they're convoluting and confusing the jury on purpose.
Keeping out the expert, again, will further the confusion.
And what we will be left with, as the judge has informed us this morning, will be his version of the jury instruction after considering what the jury charges are from the prosecution side and ours.
So ultimately, again, it goes back to one person, and that's the man in the robe on the bench.
And yeah, I mean, it was unheard of.
What I heard this morning saying we can't bring an expert because we don't want to have the jury understand the laws of finance, which happens to be the claim that they're making in a misdemeanor form against President Trump.
Discriminate.
I've never heard of anything this so fundamentally unfair.
Let me ask you a final question.
Regardless of all of the unfairness that has taken place, they've not proven their case.
They have actually proven nothing.
Now, I've said from the beginning, too, it's New York City, you can't get a fair trial.
How does this end in your view?
I don't know.
You have to run.
I think, look, because I'm considering we're in New York, if you ask me how does it end after this case, it should be completely an acquittal without question.
Because we have a New York jury, I say, you know, at worst, a hung jury.
I really do think that they have destroyed credibility for the DA's office.
I think they've destroyed credibility for, frankly, the judicial branch.
And I think that this jury, if they're listening, will see that.
Now, do I think that they're always fair?
No.
Do I think people's biases still come through in a jury despite charges and despite everything else?
Absolutely.
So, look, if it was me, I would be the one making sure it was a hung jury because they have proven nothing.
They have proven truly a pressure.
We need an investigation into Bragg withholding exculpatory evidence.
We need an investigation into the conflicts of the judge and whether he should have, by law, recused himself.

I mean, two really unbelievable things happening in the course of this trial this afternoon, late afternoon, when the jury was out of the courtroom.
And the first had to do with the FEC expert and the limitations that this judge put on the defense in terms of somebody that has the ability to actually tell the jury what the law is, because I guarantee you there's not a single person that has a clue about the law and what even Donald Trump is being charged with.
I mean, that's how spectacularly unfair all of this has been.
None of this is a surprise considering the judge that we have in this case.
Now, we did learn at the end of the court proceedings today that, in fact, that Bob Costello is going to be called as the second witness, which I think is a great idea.
However, they want to limit his testimony as well.
There's a big clash, you know, once the jury was excused for the day about the possibility and permissibility of Costello's testimony, the prosecutor arguing that Costello's testimony should be admissible only to address any prior inconsistent statements.
The defense attorney said the prosecution opened the door to the evidence and that they intend to rebut the evidence pressure campaign theory.
Perfect.
By the way, Trump apparently looked bemused, but Costello is critical to this case because he contradicts everything that Michael Cohen said.
You know, and he explained in great specificity, number one, how exculpatory information of Alvin Bragg was withheld from the grand jury.
Well, the jury should hear that too.
But even more importantly, he told Congress and Fox News, he specifically told them it was Michael Cohen said it was his idea to take care of the NDA and been contacted by a lawyer from Stormy Daniels.
And he said that he did it all by himself.
I decided to do it all by myself, take care of it all myself.
All of that's admissible.

I said he's jacked up.

The not blinking thing is super weird.
I mean, there's a lot of conversation about that on social.

Well, look, the bottom line is they do this to professional athletes.
Why wouldn't they do it to somebody?

We've never seen Jacked Up Joe until the State of the Union address, and we've not seen it since.
Now, that's interesting to me because he's gone right back to form, which is mumbling, bumbling, bumbling, stumbling, tripping, and falling Joe.

Hey, two points I wanted to make.
One was I know you were discussing my cousin, Vinny, that movie.
But I was thinking about what about Lincoln?
lawyer with matthew mcconaughy if you remember uh there was a scene where the judge had to call them into chambers because he was going to dismiss the trial because he put a known liar on the stand how is it different I mean, he's critical to the case.
I mean, he literally destroyed the prosecution's case both last week and what happened today.
Putting a known liar on is okay.
There's not going to be a mis trial because, you know, and it just, I mean, it goes to his character, again, stealing $30,000 from the Trump organization.
I mean, let's the jury say, you know, look at this guy's character.
Look at who he is.
And, oh, yeah, we're going to believe what this guy has to say.
That logically doesn't make sense.
But anyways, one other point was, I remember when you did the debate with DeSantis and Newsom.
And when you did that, you put on the background, on the TV screen, you know, their numbers for the state of California and the state of...
Well, that's how I was asking the questions.
And the questions were very fact-based.
And I never once, not one person, and because we were so diligent in getting the right numbers, like when I had, all right, here are the crime statistics from the FBI, violent crime, rape, murder, homicide.
This is California's number.
This is Florida's number.
And the rate was twice as high in California.
Or when I put up the taxes, this is your tax rate, the tax rate in California.
This is the tax rate in Florida.
I got everything right, and I never got criticized for what I put on the screen.
However, any debate that Donald Trump does, I would say no media should be allowed to do anything because we know the media is corrupted and abusively biased.
Look at fake Jake Tapper.
He should not be a quote moderator in this debate at all.
Right.
In any debate.
That was, to me, very powerful.
And I think the problem with maybe the, you know, the American public, I think you did it on your TV show because a ton of people dislike Trump and a ton of people dislike Biden.
But if we just, I know you can't eliminate their names from this election because that's who it is.
But if you just put Democrat and you put Republican and you showed, you know, every single day the people were saying, okay, if you want, you know, kids to, you know, like five-year-olds to have, you know, their private parts removed, vote Democrat.
If you want to give billions of dollars away to another country to defend their border, vote Democrat.
You see what I'm saying?
As opposed to saying Trump, because everyone's focused on the name, but if you were to show the policies, you know, and show, okay, if you want the gay pride flag hanging from the White House, vote Democrat.
I'm not telling you not to vote that way.
What I am saying is if you vote Democrat, you know, in a sports game, they always say, this is why we play the game.
You know, this is why we play the game to find out who's going to win.
This game's ours.
I think this really does illustrate how bad they want to destroy this man.
This case has been the worst case possible for those that are using lawfare and weaponizing our Justice Department and justice system against Donald Trump.
And I think the American people see it.
I think it's being reflected in the polls.
And once again, they have overreached.
And once again, the net result is it is boomerang back against them.
And I can only say to you that, you know, let's watch how this plays out.

I got three quick points that I want to make.
Number one, this trial in New York should have never have happened, number one.
But when Stormy Daniels got off of the witness stand, it should have been declared a mistrial.
She was there for no other reason but to disparage Donald Trump.
Had nothing to do with the case whatsoever.
Then they bring on Michael Cohen, who's a known liar, and lo and behold, what does he do today but admit to a felony on the witness stand?
Well, I think that that, and of course, you know, being coached by the prosecution and then coupled with, and Michael Cohen admitting on the stand today, he told all these media people that Trump had nothing to do with any of it.
Okay, that's the heart of the case.
Case closed, and it literally should be a directed verdict.
It should be over by now, but the judge is so abusively biased and compromised and should have recused himself that that's not going to happen.
I hope that within the next year, Leticia, Alvin Bragg, this judge, the other judge, whatever his name was, Fonnie Willis, are all going to be sitting where Donald Trump is sitting right now.
That's my hope.
If it'll happen, no idea.
I just don't want what they have given us, and that is a weaponized system of justice.
I really don't.
I don't want a weaponized system of justice.
I want equal justice under the law.
I want equal application of our laws.
I want America.
I believe in a constitutional republic, and I don't want done to any Democrat what they've done to Donald Trump.
That's what I want.
And maybe some people don't believe me.

That's how dangerous it is.
Second point I want to make is if there is a debate between Donald Trump and Joe Biden, and it's all done by TV and no audience there, I anticipate there's going to be a lot of commercial breaks.

They don't like to be played.
And I'm praying that there's one or two on there that says, no, this ain't right.
I'm not going for it.
I am of the belief that there's got to be at least one or two.
They've got to be of the belief.
Now, it should be a full-out acquittal.
It should be a directive verdict by the judge.
All of that is right.
All of that is correct.
They've not proven their case.
And if anything, we now have really serious ethical issues for Attorney General, I'm sorry, D.A. Bragg on the issue of withholding exculpatory evidence to the grand jury.
This is why you can indict a ham sandwich.
This is what's scary.
And the other one is for the judge and why he didn't recuse himself.
We need investigations into both.
However, they'll come from Congress in the end, is my guess.
But unless Republicans win the House and the Senate, it's not going to go anywhere by big margins.
We need a big victory in November.
Not a little victory, not a squeaker.
We need a massive, massive victory.
I hope the people in Wisconsin are hearing me.
Michigan are hearing me.
Pennsylvania, hearing me.
Georgia, North Carolina are hearing me.
