I am glad that this lawsuit now is about to be filed, a $100 million lawsuit against the Biden administration.
And it's being filed by the family of a 20-year-old woman that was slain in 2022.
The $100 million wrongful death lawsuit will argue that the Biden administration caught and released an illegal immigrant who then brutally raped and strangled this young woman with a phone charging cord.
Authorities later figured out that the suspect had MS-13 ties at the time he snuck into the U.S., but he was still caught and released under the Biden administration and they're unvetting the illegal immigrants' policies, open border policies.
Quote, we bring this landmark lawsuit in honor of Kayla to get answers on how this catastrophic failure occurred and help prevent other senseless murders, said Brian Claypool, who is the veteran trial attorney that is representing Tammy Nobles, Hamilton's mother, but is part of the impeachment proceedings against the Homeland Security Secretary, Alejandro Mayorkas.
Now, what was really interesting is we learned also that the DHS secretary, Mr. Mayorkis, is once again just outright refusing to even appear before the House Homeland Security Committee alongside angel moms who have lost their children to illegal immigrants and the crimes that they've committed, as well as the fentanyl that has taken place.
I mean, we have chronicled now on this program for years.
The committee has given Secretary Mayorkis chance after chance to appear and explain his actions, decisions, and statements.
He's just lied like Joe Biden and Vice President Harris have lied, just like Circleback Jensaki has lied, just like Colleen Jean-Pierre has lied, you know, by telling us over and over again the border is secure and the border is closed.
That's never been the case, but this lawsuit continues.
Let me play for you Tammy Nobles.
She's the mother of Kayla Hamilton.
I want to play a lot of this, actually, describing how her daughter was raped and murdered by MS-13 gang members who crossed the border.
My name is Tami Nobles.
the mother of Kayla Hamilton.
July 24, 2002 was one of the best days of my life.
I gave birth to a beautiful baby girl and named her Kayla Marie.
She loved to smile and laugh.
She always kept her friends close and never forgot anyone.
She was kind, caring, thoughtful, and funny.
She loved God.
She loved life and God.
She showed the world that being yourself was okay and you didn't have to follow everyone else.
But sadly, on July 27th, 2022, I received the worst news that a parent doesn't want to hear, that my newly 20-year-old daughter, Kayla Hamilton, was murdered in her own room and left on the floor like trash.
The illegal MS-13 known gang member brutally raped and murdered my daughter by strangling her with a cord and robbed her of $6.
During the attack, Kayla called her boyfriend for help but went to voicemail.
The voicemail of the murderer strangling Kayla was two minutes and 30 seconds long.
DHS employees failed to visually inspect the assailant by lifting his shirt to check for gang-related tattoos.
Had DHS employees performed a visual inspection of the assailant's body, they would have seen MS-13 gang-related tattoos on his body, disqualifying him from entering the U.S. Let's take a moment and think about how Kayla felt that day.
How scared she must have been that day knowing that she was dying.
If she was going to see her mommy again, her baby sister, her brother, or her cat Oreo.
Kayla fought for her life that day with all that she had.
And in the end, she lost to an individual that wasn't supposed to be allowed in the country.
For me, this is not a political issue.
This is a safety issue for everyone living in the United States.
This could have been anyone's daughter.
I don't want any other parent to live the nightmare that I am living.
I am her voice now, and I'm going to fight with everything I have to get her story told and bring awareness of the issue at the border.
If we had stricter border policies, my daughter would still be alive today.
Nothing will bring my daughter back nor fix the pain of not having her here.
I don't want to prevent this from happening to someone else's child.
This isn't about immigration.
This is about protecting everyone in the United States.
Then you have the powerful testimony of Josephine Dunn.
She's the mother whose daughter Ashley died from fentanyl being trafficked across our southern border, slamming Mayorkas for not showing up to the hearing.
He took an oath to defend and protect the Constitution and the American people, air, land, and sea from enemies, foreign and domestic.
Ms. Dunn, do you believe he violated that oath?
Yes, sir.
I flew from Arizona to meet him and face him and ask him why.
And he's not here today.
I did not know that until after I landed yesterday.
And he doesn't have the decency to even show up and talk to you personally.
Today is my daughter's birthday.
I would have much rather been home with my poor husband grieving her.
I didn't need to be here today.
So whatever he's doing, I hope it's more important than that.
Let me say, I'm sorry.
Thank you.
Because apparently the secretary doesn't care to show up and say that to you.
All right, joining us now is Brian Claypool.
He's a veteran trial attorney.
And, you know, he is representing the family, Tammy Noble, and the family of Kayla Hamilton, this 20-year-old girl killed by this illegal immigrant.
Brian, welcome back.
How are you, sir?
Yeah, I'm great, Sean.
Thanks for covering this.
I mean, absolutely pathetic.
I mean, we are tired.
We are fed up with being held hostage in our own country.
We're fed up with Majorkis, DHS, and by the way, Becerra and the DHHS playing Russian roulette.
That's what they're doing, Sean.
They're playing Russian roulette with you, me, your listeners, your viewers on your TV shows, and our kids.
We can't take this anymore.
And you said it, you said it right.
They have blood on their hands for what happened to Kayla Hamilton.
They could have done the most rudimentary things, and they should have.
All they had to do, Sean, was lift up the shirt of this 16-year-old MS-13 gang member, lift his shirt up.
And by the way, that's in their protocol, and that's what we're alleging in this lawsuit.
They have a protocol they're supposed to follow.
And if they lift up his t-shirt, they see a gang member tattoo.
He would have been disqualified, Sean, from entering the U.S.
But then it gets worse.
All they had to do then is call.
There's a hotline to the El Salvador consulate, right?
And guess what?
This guy's name was on the list because Jim Jordan did a great job, Congressman Jordan, who you've had on your show, he did a great job of researching this.
They make one phone call.
This kid's on the list.
Send him back.
And Kayla Hamilton lives to see another day.
She lives to get married and have kids.
It's just horrible.
I mean, it just breaks my heart.
And, you know, the fact that Majorkis doesn't have the courage.
He can't muster up the courage to meet with and listen to and maybe be educated by the parents that have lost their children, parents that they'll never be the same.
I've never in my life met a parent that lost a child that ever fully recovers.
I mean, they find coping mechanisms.
They go on with life.
Many of them have a deep, abiding faith that they'll be reunited one day in heaven.
But that doesn't take away the pain of the moment, does it?
And all of this is preventable.
Sean, you are not wrong.
And the reason why is because President Biden, Majorkis, they have a policy.
You know what their policy is?
We don't care.
That's what happened here.
That's what happens with the fentanyl folks coming across the border to kill our young kids.
And that's what this case is about.
We are making a stand, finally.
Somebody is going to hold our government accountable and force them to have consequences for not safeguarding.
They're supposed to be the gatekeeper for our border to keep us safe, Sean.
And they are just allowing, they're voluntarily allowing killers into our country.
Can I share with you one other staggering catastrophic failure?
It goes beyond DHS.
DHHS, Sean, once somebody is permitted to cross the border, an illegal immigrants, permitted, right?
They are supposed to call and verify a sponsor, a verified sponsor.
This kid was 16.
He's an unaccompanied alien child.
And they blew it there, too.
They didn't have a verified sponsor.
They allowed this kid in.
He goes to an alleged sponsor.
He runs away, Sean, a month later.
He's on the loose in our country.
And guess what?
You're not going to believe this.
He ends up in the same trailer as Kayla Hamilton, a roommate of my client's daughter.
And guess what?
The person who rented that room to Kayla was an illegal immigrant as well.
Two layers of illegal immigrants leading to the staggering rape and murder of Kayla.
And guess what?
It gets even worse.
Jim Jordan then sends a letter, two letters, over to DHHS and says, give us this file on this murder.
They fought.
Sean, DHHS has fought Jim Jordan, alleging privacy rights.
Privacy rights for a 17-year-old MS-13 illegal immigrant murderer.
His privacy rights are more important than what you mentioned a few minutes ago, which is getting us information to help us prevent this from happening again and helping a mom cope.
Their privacy rights are more important than our right to be safe in our own country.
It's just too much to handle.
Let me ask you, it's often difficult to sue the federal government.
Why do you think you will prevail here?
Yeah, great question, Sean.
And by the way, when Tammy, the mom, reached out to me, she'd seen me on another Fox show commenting on Kayla's murder.
And you know what I said at the end of the segment?
I said, I'm a single father.
I'm a single father of a teenage girl, Sean.
I have 100% custody of my daughter, not far from the age of Kayla.
At the end of the segment, I said, man, if that was my daughter, I'd go after the federal government.
Tammy hears that, contacts me, and it took me a couple of months to research it, right?
Because I don't want to take a case just based on emotion.
We've got to have the legality to do it.
And guess what?
We can and we will win.
Why?
Because we have to allege what's called operational negligence under the Federal Tor Claims Act.
Operational negligence is different than discretionary, like a discretionary decision made by Maorcus or President Biden.
This is operational negligence because they had a protocol, Sean, to follow.
They've got a list of what they are supposed to do.
That list was promulgated by DHS.
They're supposed to lift the shirt of this kid, of this MS-13 gang member.
They're supposed to call the consulate in El Salvador.
Sean, this kid was arrested in 2020 for being part of an illicit gang in El Salvador.
We're not talking about a 60-year-old housekeeper crossing the border where it's not foreseeable that she would commit a crime.
That's another fact we've got to prove.
Is this reasonably foreseeable?
Absolutely.
This kid was in a gang, documented, 2020.
That's why we've got a shot in getting around that immunity, that immunity that the government gets.
We can get around it because they didn't follow protocol, and then we've already talked about it.
Then we've got the second layer of DHHS.
They have operational protocols they're supposed to follow.
They didn't follow any of that.
They didn't verify where this kid was.
They didn't check where he was living.
And guess what?
Brace yourself for this, Sean.
This kid, after he murdered Kayla and was on the loose, he was placed by DHSS in a foster, in a group foster home.
Can you believe this?
He could have killed somebody else in that foster home.
So we believe that we can sustain this case.
We've got to file it in a federal district court in Maryland because that's where the murder took place.
But we've researched it, and we are going to make new law in this country to protect parents and protect us from the dereliction of duty from our federal government.
When you next please talk to Tammy, please send my deepest sympathy over what happened to her daughter.
That shouldn't happen to anybody.
You know what the worst part is?
They have lied to us repeatedly.
The border's closed.
The border's secure.
And like, okay, open your eyes and see what the images that I have been playing now since Joe Biden became president because that was not happening under Donald Trump.
And they could prevent it.
They didn't prevent it.
That holds.
That means, in my mind, they're liable.
Win this lawsuit.
And I hope the floodgates open because they need to be held accountable for the failure of their policies and not enforcing the laws of this country.
It's a disgrace.
My sympathy to the family, and please done my very best.
I'm so sorry to hear about all of this.
It's so sad.

Nobody, President Biden, nobody from that administration ever reached out to Tammy Noble, never to express their condolences.
Just wanted to get that out there as well.
Yeah, and Mayorkas wouldn't sit next to her.
What a gutless Department of Homeland Security Secretary, just like they'd never go down to the border anyway to see for themselves or learn for themselves.

This upcoming election, obviously, is going to be brutal.
The Democrats are going to lie about everything.
Trump is Hitler.
We're Nazis, et cetera.
But the one issue that they've had traction on and they've made great gains is abortion.
And this really isn't an abortion call.
It's about the politics of it.
I agree with you.
I'm a purist on abortion, except for the life of the mother.
But we can't eliminate rape or incest or a number of weeks as well.
But I don't think that'll be near enough.
They are going to, the Democrats are going to literally carpet bomb us starting probably in September, NFL games, college games, everything else.
And we won't have much to fight back with.
And we have to get on offense somehow.
And my idea is to, you know, you work with Pre-Born.
Show America a fully formed baby in the womb.
I would guess 95% of America hasn't seen that.
And it really affects women who are thinking about an abortion.
It would affect the country.
I mean, the Democrats approve of killing this child.
And somehow we have got to get on abortion on offense and put the Democrats on defense.
And I think that might be a possible way to do that.
Look, I think science and imaging and the fact that you can actually see, you know, let me go take you back 25 years when my son was born and 22 years when my daughter was born.
And I could tell you that when you got, what was it called?
A sonogram or ultra, I guess a sonogram, you didn't really see anything.
I remember, is it a boy or is it a girl?
Hang on, hang on.
And then they say it's a boy.
And I'm like, how can you tell?
And they show me how, and I'm like, I still can't tell.
But now with 4D imaging, you can literally see facial features and you can count fingers and toes.
You can see the image of a real baby inside a mother's womb.
And they also hear the heartbeat.
You could hear the heartbeat when my kids were being born, but it's having a profound impact.
And, you know, nearly 80% of people that go to pre-born clinics, if they're thinking about abortion, guess what?
They're not thinking about it when they leave.
And that is the power of science educating people.
So I think your idea is a good one.
And maybe pre-born could put up different images of the different stages of birth so people can see exactly what is the majesty and the miracle of birth and understand more about the sanctity of life and the seriousness of it all.

Hey, the reason I'm calling is, I mean, I'm just about pulling my hair out over this Nikki Haley, and she's talking about decorum.
She kind of reminds me of George H.W. Bush from back, you know, we're going to have a kinder, gentler conservatism.
I mean, it's like these people are evil.
I mean, you have the most racist president administration that we've ever had in this country, and yet they're sitting there and they're calling Donald Trump a racist.
He's the least racial president that I could even remember.
And Nikki Haley, I mean, it's like the fact that she's even saying that just tells you exactly where she's going to go when she gets there.
She's not going to be looking out for us because they want to destroy every one of us.
I mean, we're just totally the enemy.
Anybody that works hard, minds their business, you know, we're the enemy.
You know, look, put Nikki Haley aside.
The left in this country does not believe in the rule of law.
They have no program.
They have no agenda that they're implementing that is successful.
Their policies are killing the country.
America sadly is a nation in decline, and it's declining right before our eyes.
We need strong, real principled leadership.
It's not complicated.
Conservatism, what do we believe in?
Liberty and freedom.
We believe in limited government, less bureaucracy.
We want lower taxes.
We don't believe government is the answer.
We believe government is the problem more often than not.
If you put your faith, your hope, and trust in government, like the new Green Dealers, and they're going to provide a guaranteed government job and guaranteed government wage and guaranteed health care and guaranteed government healthy food and guaranteed daycare and guaranteed pension at the end of your life.
Okay, well, how's that working out with Social Security and Medicare?
Because they're headed towards insolvency.
The government runs public education.
How's that working out for most American kids?
Not well.
How is government-run policing doing with defund, dismantle, no bail laws, reimagining the police?
It's not working.
And they want more of this government.
I am saying freedom is the answer.
This new Argentinian president gave a speech at the WEF, his closing remarks at Davos.
And then when you go to Davos, you got, you know, basically like every other globalist organization, starting with the UN, the WHO, Paris Climate Accords, I would include in this, but the WEF.
And this is what he said in his closing remarks, and it really struck me.
He said, do not be intimidated, intimidated either by the political caste or by parasites who live off the state.
Don't surrender to a political class that only wants to stay in power and retain its privileges.
You are social benefactors.
You're heroes.
You're the creators of the most extraordinary period of prosperity that we've ever seen.
Let no one tell you that your ambition is immoral.
If you make money, it's because you offer a better product at a better price, thereby contributing to a general well-being.
Do not surrender to the advance of the state.
The state is not the solution.
The state is the problem itself.
You are the true protagonist of this story.
And rest assured that as of today, Argentina is your staunch, unconditional ally.

You know, he warned the Western world about headed down a path to socialism.

And it is endangered because those who are supposed to have to defend the values of the West are co-opted by a vision of the world that inexorably leads to socialism and thereby to poverty.
Unfortunately, in recent decades, motivated by some well-meaning individuals willing to help others and others motivated by the wish to belong to a privileged caste, the main leaders of the Western world have abandoned the model of freedom for different versions of what we call collectivism.
We're here to tell you that collectivist experiments are never the solution to the problems that afflict the citizens of the world.
Rather, they are the root cause.

Anyway, what's on your mind today?
So I'm a black American, 100% Trump supporter, so I got a lot of wounds on my body from talking to a lot of people trying to get them to swing over.
And also, I lived in China for 15 years, so I was 100% in when Trump was talking about China.
But two things.
First thing is I was a little surprised when you had asked him the question about the dictation thing, because I saw that interview and that kind of threw me off a little bit because I knew that the, uh, the Democrats would jump right.
Oh, jump right on that.
And, uh, the other question, well, they had been, the reason I asked the question is because the liberals had been calling him that.
And I just said, okay, uh, Mr. President, can you assure the American people that you have no plans to be a dictator?
And he was being Trump.
He just said, no, I'm going to be a dictator, but only for one day.
And I'm going to secure the borders on day one and go back to energy independence on day one.
That's all he said.
He did say he wasn't going to be a dictator, but that's not how the media mob reported it.
Of course.
They took it the other way, which, you know, he's just saying that he's just going to do what he needs to do to get the country back on track.
That's not really dictating, but of course they ran with it.
And the other question I had with you was, I noticed that you say Taiwan, that China wants to reunite Taiwan with China.
And using that word, reunite, is a problem because Taiwan has never, ever had any connection with China.
So when you use reunite, that gives the impression that it was united with China at one time.
And a lot of my Taiwan friends, because I speak Chinese, so a lot of my Taiwanese friends, they get upset when the word reunite is used.
So I just wanted to ask you about that.
Reunite means to take over.
They will invade and they want to take over Taiwan.
And my prediction is that President Xi has that territorial ambition.
He stated it openly.
They're showing hostility regularly by flying their fighter jets all over Taiwan airspace and threatening even U.S. jet fighters in international airspace and threatening our Navy and international waterways.
They've gotten very aggressive and they get away with it because they know that Joe Biden is pathetically weak.
And frankly, when it comes to China, that family is compromised as far as I'm concerned.
100%.
I just think that my Taiwanese friends, they don't like the word reunite because they think that using that word reunite means that they've been with China at one point instead of saying unite China with Taiwan.
Reunite means take over, invade, and control.
Let there be no ambiguity, what reunification of Taiwan would mean and will likely happen.
And I predict Joe won't lift a finger.
I hope I'm wrong.
