So pretty sad Supreme Court ruling today.
I understand the legal arguments behind it.
It was an 8-1 decision giving the Biden administration, frankly, a big victory.
And it results, though, in a pretty big blow to local communities that now have to keep convicted felon illegal immigrants.
Right.
On the surface, it makes no sense, does it?
Now, anyway, they found that handed the Biden administration a victory in this immigration case, ruling that GOP-led states don't have the standing to challenge a policy narrowing federal immigration enforcement.
Again, an 8-1 decision, the U.S. v.
Texas.
And anyway, if you look at the crux of this, they found Republican states didn't have the standing to challenge ICE and their priorities for arrests and deportations.
And in some, quote, states have brought an extraordinarily unusual lawsuit.
They want the federal court to order the executive branch to alter its arrest policies so as to make more arrests.
Federal courts have not traditionally entered this kind of lawsuit.
Indeed, the states cite no precedent for a lawsuit like this.
The opinion of Justice Kavanaugh, Sam Alito was the sole dissenting justice in this case.
And the case involved issuing new enforcement guidelines by the Department of Homeland Security.
Here's the problem.
Not only is Joe Biden and his administration not enforcing the laws, not holding people accountable, they're aiding and abetting in the law breaking.
Now, at some point, I would think that any American that's impacted by all of this would have standing.
Anyway, maybe my legal mind and my legal thinking is wrong on this.
Florida Attorney General Ashley Moody, I wanted to get your take on it.
How are you?
Oh, great to be with you, Sean.
And you're correct.
This is one of the most devastating, tragic opinions we've seen thus far.
And this was one of the first things that Florida brought suit on, one of the first policies Biden did that basically wrecked our immigration integrity and enforcement, in which he basically said, I don't care if you're a dangerous felon, we're not going to deport you.
And unless you're one of these specific targeted people, meaning, sheriffs, you have to release them back into the community.
Once they have served their sentence or you can't detain them anymore in the states, we're not going to deport them for you.
And we know what the law says, but we're choosing to not focus on that.
And this is really, really a frustrating opinion.
Like you said, Sean, they kept saying this is an unprecedented situation where you would see a lawsuit like this.
Well, we're living in an unprecedented time.
You've never seen a president ignore so many of the mandates under immigration law.
In fact, when Congress came out and said, in these certain instances, you shall deport and detain criminal illegal aliens, Bill Clinton was president.
Even Clinton said, you need to deport these dangerous felons.
So under Biden, and now with the approval of the Supreme Court, if he doesn't want to deport Sentinel traffickers or folks burglarizing people or serious felon offenders, they don't have to.
Well, look at how out there they went on this.
DHS Secretary Mayorkas said in a memo, you know, the fact that an individual is a removable non-citizen, therefore, should not alone be the basis of an enforcement action against them.
Well, why not?
That would be enforcing the laws of the land.
If you don't like the laws, you would have to go to that other branch of government, the legislative branch, and get the laws changed.
And he went on to say, we will use our discretion and focus our enforcement resources in a more targeted way, and justice in our country's well-being require it.
No, I think the laws should be applied equally across the board.
And if you don't abide by the laws and you enter this country illegally, how the Supreme Court doesn't stand up for the rule of law here is a little mind-numbing to me.
You're correct.
And this is a bigger picture, right?
We're seeing this so many times in executive branches all over the nation where you're getting prosecutors and executive leaders saying, we don't like the laws.
Like Maorca said, I don't like that law that says that I have to deport those here illegally committing crimes against Americans.
I don't like that law, so I'm just not going to do it.
You have prosecutors, Soros, radical prosecutors all over the nation saying, you can't interfere with my executive authority, and I don't like those laws, so I'm not going to prosecute them.
So I think that this opinion is incredibly dangerous because we have not seen the likes that we're seeing now of executive leaders saying, nope, don't like the laws.
I'm going to decide what the law is.
And so I think what's going to have to happen, and I have said this for a long time, and actually working with Congressman Posey, we have proposed a bill in Congress that says, look, if the AG declares that there is a crisis,
an immigration crisis, and the resources are not being dedicated by the federal government, state officials should be able to do the job of the federal government and detain and arrest folks here as necessary for their security.
And I think what Congress is going to have to do, as the ruling lays out, Congress can say, okay, states can bring suit.
They can show injury, in fact.
They may have per se standing.
Congress is going to have to roll up its sleeves and come up with an ingenuity of way to make sure the states can provide for the security of their communities.
I think don't the states now, to me, that would give them, and especially if you believe in federalism, the right to come up with their own laws that say that they have the right to deport people out of their state that are not in the country legally or not in the state legally.
Well, they would have to be given, obviously, the structure would have to give them and assign them the authority specifically for arrest.
Obviously, the federal government and many Supreme Court rulings have said that it is their purview.
They oversee and have the authority to govern immigration nationalization.
But there have been ways in the past where states have been given some of that authority and been able to help.
And so I think Congress is going to just have to come up and say, okay, we've never seen anything like this.
If the states want to step up and offer resources and offer manpower and offer their help, what could be the legal mechanism to do that?
Because, you know, if you get someone like a Biden in my orchestration office, you're jeopardizing the security and safety of our communities and states.
And so it's an interesting balance.
I think that Congress will have to come in and really roll up their sleeves.
But we've been trying to be helpful with our litigation and with our expertise as we've developed it since Biden's been in office and making those recommendations.
But this really is, as you said, it is really a devastating blow to the rule of law and our ability to protect our states and communities.
All right.
Different topic, different question.
Are you getting involved in the Republican presidential primary or are you staying on the sidelines?
Well, as you know, I have worked incredibly close with Ron DeSantis, who is our governor here.
I've admired so much how he digs in and really tackles some of the challenging issues we faced here in Florida.
So like yesterday, we stood up and announced a new lawsuit going after the agencies that accredit universities for playing a hand in trying to develop standards.
That's never been done.
And we've done that here in Florida under the leadership of DeSantis.
But as you know, I have been very much standing up for the rule of law and those that are going to dig their heels in it and support the men and women of law enforcement and protect the nation's security.
So I'll keep promoting that and those will stand strong in that regard as we move forward.
You're in good company.
Reagan wouldn't endorse in primaries either.
I don't blame you.
But I understand your position.
It's not easy, is it?
No, and I've supported and said that I think Ron DeSantis is doing a great job, and I think he would.
He has a lot of energy and a lot to say regarding the direction of this country.
And I think Americans should really just pay attention to what everybody is saying and what they're promising to do, because that's what it's about after you get decisions like this one we're talking about, right?

Starting with, by the way, if you want to look at the first case that I think is most comparable, because you're talking about $3 million that Hunter owed in taxes in years 2017 and 18.
All right, well, let's compare that.
Slap on the wrist, no jail time.
Of course, no penalty for the gun violation, lying on a gun application, which, by the way, would normally hold up to 10 years in jail if your last name's not Biden.
Anyway, he is himself the great senator from South Carolina.
Always great to be back in his state and a friend of the program and now a 2024 presidential candidate.

How are you, sir?
Well, Sean, it's always good to be back here with you.
Thank God you're in Myrtle Beach, South Carolina.
We're always happy to have you back, but we are not happy about the fact that the kid gloves are back on for the Biden family.
This DOJ continues to hunt Republicans and protect Democrats.
I can't think of anything more blatant.
You know, I look at, for example, we have not gotten an answer.
Now, your colleague, Senator Chuck Grassley of Iowa, as well as Congressman James Comer, have referred to this FD 1023 form.
Now, this was put together by somebody that the FBI viewed as very credible, as evidenced by the hundreds of thousands of dollars that the FBI has paid this individual in the past for intelligence and talking about specific acts taken by then Vice President Joe Biden in exchange for financial gain for both him and his son, Hunter.
And I'm asking, you know, what did the FBI do here?
Because I'm concerned that our FBI that put their thumb on the scales in the last two presidential elections, you know, is going to be back at it again in 2024.
Yeah, thank God for Senator Grassley and Congressman Comer who seem not to be sleeping until we have the actual results of the FD 1023 form 17 recordings that 15 Hunter to Joe Biden, as far as as I understand it, this is serious allegations.
And if there is a smoking gun, it's likely on one of these audio recordings.
Getting that information to the public has got to be the job.
And I will say this, if the investigation doesn't finish under Senator Grassley and Congressman Comer's watch, I will finish it as President of the United States.
Well, let me ask you this, because I think this is now in the minds of most conservatives I know, is look at, for example, we know Hillary had top secret classified information on her servers.
We know that because James Comey told us that in July of 2016.
We know that Hillary Clinton destroyed 33,000 subpoena emails and she used something we had never heard of before called Bleach Pit to do it.
We know that she had aides destroying devices that might have had some of these emails backed up on it with hammers and SIM cards were removed.
That to me would be a classic obstruction case.
You know, I think the question that most conservatives are asking today is do we have equal justice under the law?
Do we have equal application of our laws?
I read a tweet that you had put out that this is another reason that Americans have lost faith in Biden's justice system.
And while the Biden family gets a slap on the wrist with kid gloves, the DOJ throws the kitchen sink at political opponents, raids the homes of pro-life advocates, and targets parents as domestic terrorists.
And I can't think of a truer statement, Senator.
Well, Sean, I'll say this, as I said in my tweet, my press releases, you cannot look objectively at the current state of the Department of Justice and not ask yourself the question, not if it's true, but how deep does it go?
That is the question we're asking because as you just articulated, the former president finds himself being focused on by a DOJ that's been weaponized by the Biden administration.
We know that pro-life activists have SWAT teams gun-drawn in their homes.
We know without any question, parents showing up at school board meetings to talk about eliminating the indoctrination of their kids.
Hey, let's get back to educating our kids.
Let's get rid of the CRT and get back to the ABCs.
These are the folks that the DOJ call domestic terrorists.
So we don't ask the question if we are seeing the weaponization of the Department of Justice.
What we ask ourselves is how deep does it go?
As an African-American, the one thing I will tell you is black versus white in the justice system should never be.
As a conservative, now the colors are red and blue.
It should not be.
We need to have lady justice with a blindfold on, Sean.
Anything other than that is unacceptable, but it's also un-American.
You know, I mean, it really is amazing when you look at it.
And especially when you look at the FBI's role in the last two presidential elections.
I mean, they took Hillary's dirty dossier.
They even sent FBI agents to corroborate it and offered Christopher Steele a million dollars.
He couldn't collect his million because he couldn't corroborate any of it.
Then they used it for not one before FISA applications.
And then in the lead up to the 2020 race, what do we know?
That the FBI is out there pre-bunking the Hunter Biden laptop story, a laptop that they themselves had in December of 2019, verified in the spring of 2020, according to John Solomon.
And yet they're telling these big tech companies, you might be a victim of a misinformation campaign and it may be about Hunter Biden.
And it ends up that before the election, they censor what could have been a changing narrative in the country and shift the voting patterns of significant portions of our population.
There's no doubt that when you look at the thumb on the scales of justice, as well as on the outcome of elections, you can look at the social media, just follow the breadcrumbs that lead back to the Department of Justice and the way that they concealed or suppressed information in 2020, before the election.
Many of the things that we're discussing as it relates to Hunter Biden and the Biden family, that didn't happen in 21 or 22 or 23.
This predates the election.
It's one of the reasons why so many Americans today are asking the question, not only can we trust the Department of Justice, but how do we make sure that our elections have integrity?
And I thank God that we've had states like Georgia that went through the process of actually strengthening the integrity of the election process, but it does not make up for what ultimately we saw in 2020, which has to be considered at least putting the thumb on the scale again.
We see that you said it a few times in the show, and I love that I wrote it down, thumb on the scale of justice.
That is the thing that Americans find despicable is that when we're not treating each other fairly.
That's well said.
You know, as I prepared for tonight's town hall, I learned, and I've known you very well for a long time, and we've been friends for a long time.
But your life story is beyond compelling.
You grew up in a very poor, single-parent household.
My mom worked 16 hours a day as a prison guard.
Your mom was a nurse's assistant, a single mom.
You didn't start out as a brilliant student.
You very freely have discussed as a freshman in high school.
You flunked out of four classes.
Things were not looking good for you.
And between your mom and a mentor that you met, an owner of a local Chick-fil-A, you turned your life around in a major way.
Tell us about it.
Well, Sean, one of the things that the radical left hate about my life story is it disproves the lies of the left.
They want everyone to believe that in America, the only way to get up and to be able to put yourself on the right path is to be the exception.
What my life says is, here's a dude, not a brilliant man, but here's just a dude, an everyday guy like most Americans, struggling in some parts of his life, in most parts of his life.
He meets a mentor who tells him that in America, all things are possible.
Any kid from anywhere at any time can rise above their circumstances if they take responsibility.
And Sean, as you know, in today's America, the radical left, they want everyone to be a victim.
They want everyone to buy the drug of despair.
They want everyone hooked on grievance.
You know why?
It's not for progress.
It's not to write the ship.
It's to keep the power and the control.
And my life only reinforces the fact that, yes, a kid born in the deep South who happens to be African American, who happens to be raised in a single parent household in poverty, can rise above his circumstances.
Because in America and in South Carolina, where we are tonight, all people will be judged by the content of their character, not the color of their skin.
We are actually fulfilling the dream.
We are living out the more perfect union.
And that's why they are so scared of my candidacy, because it's undeniable the progress that we as a nation, the American family, we have made remarkable progress in very little time.
And I thank God I'm American.
So you tell the story about your grandfather.
He dropped out of third grade to pick cotton.
And he couldn't even read it, but he would sit at the table every morning with a newspaper because he wanted to set an example to his family.
And your campaign site ends with your grandfather's story and the statement, to go from cotton to Congress in one lifetime is a journey that can only happen in America.
And you tell the story that your grandfather, when he was growing up, that if a white person was walking on the same side of the street as him, that he would have to step off the street and wait for this individual to pass.
And, you know, and it gets even highlighted more when you get attacked by the likes of a white liberal in New York by the name of Joyless Behar, or more recently, Barack Obama.
And I'm like, that you don't know what it's like to be black.
And I'm like, we're going to listen to Joy Behar on what life for black Americans is life in America with your family and your background.
I'm sorry.
She's not exactly an expert or somebody that I really care.
It's somebody's opinion that I care to hear about.
Well, John, you and I are in the same boat.
And when Joy wears blackface, it's just reprehensible and no one calls her on the carpet.
She keeps her job at ABC.
Can you imagine if she was a conservative or a Republican?
She would be, her contract would be canceled.
The double standard goes beyond the Department of Justice.
I'd say that.
Let me just say this on those folks coming out.
She actually claimed you don't get racism.
Oh, it's ridiculous.
I'm the guy that has said loud and clear in 2021, while I have been the victim of discrimination, I will refuse to be a victim.
Because I've experienced discrimination, it makes me appreciate the significant progress we've made as a nation.
It's the fact that my mentor, who happened to be white in 1981 through 84, that man who invested his life into mine, helps me understand that Americans, they respond to the call consistently.
Are there bad people in the country?
Of course.
Are there racists in our country?
Of course.
Does that make us a racist country?
Absolutely, positively, unequivocally, no.
Not just no, Guyana, no.
We should respect and appreciate the evolution that we represent today.
You and I break bread together at a restaurant.
That's called American progress.
We should celebrate that.
Oh, and by the way, I got to meet your mom.
What an amazing woman she is.
I hope she's here tonight.
I'd love to see her again.
