Magistrate Judge rejects charges against Don Lemon over anti-ICE protest in Minnesota church.
A Minnesota federal magistrate judge refused to sign a complaint charging independent journalist Don Lemon in connection with the protest inside a church in St. Paul on Sunday.
Multiple sources familiar with the proceedings told CBS News, basically, Pam Bondi and the DOJ put forward a request to charge Don Lemon, and the judge denied it.
Two other, at least two other people who stormed the church have been arrested.
I believe a third has now been arrested.
That creepy looking Raspbuten guy has been arrested at this point.
But the judge wouldn't sign it for Don Lemon, and I'll tell you all about that a little bit later in the show.
The judge is, of course, one of these judges who has spent his entire career, dedicated his entire career at this point to counter signaling everything Trump does and trying to stop him at every pass.
He was also a judge that signed dozens of arrest warrants for January 6th protesters.
So if you're a plumber from Montana and you take an unapproved tour through the U.S. Capitol, he will send you to jail.
If you're Don Lemon on video collaborating with a group of terrorists storming into a church to frighten children, that's A-OK, just so we're aware of the non-existence of law and order in this country at this point.
Although the attempts to bring it back have had some astounding success, murders plummeted more than 20% in the U.S. last year, the largest drop on record study shows.
Murders plummeted more than 20% in 2025 from the year before, the single largest one-year drop on record, and it might be the lowest murder rate in the U.S. since 1900.
A study released Thursday by the Council on Criminal Justice found.
Yeah, it turns out arresting and convicting criminals makes the crime rate go down.
This is an incredible discovery.
We may have to take this into account when deciding things in the future.
Or we can just keep letting the criminals out and hope it turns around.
Meanwhile, U.S. Prosecutor Jack Smith tells Congress that Trump willfully broke laws.
Former U.S. Special Counsel Jack Smith, who unsuccessfully prosecuted President Donald Trump, told the House of Representatives panel on Thursday that Trump was, quote, looking for ways to stay in power following his defeat in the 2020 election as he confronted Republican criticisms of his investigation.
Smith was fielding questions before the Republican-controlled House Judiciary Committee about his two criminal cases, which he dropped after Trump won the 2024 presidential election.
We'll show you clips from this moving forward.
Of course, he is not repentant or they're moving ahead full steam.
I mean, they're acting as if they're still the ones in charge.
And in a lot of ways, they are.
So I guess that makes sense.
But of course, that proceeding is what was interrupted by Michael Fanon claiming that Ivan Rakelin had raped his kids because I think he's an insane person that shouldn't be anywhere near power.
Meanwhile, Bondi says two people arrested over protest at Minnesota church service.
Attorney General Pam Bondi said Thursday that two people have been arrested over the anti-immigration enforcement protest at a Minnesota church service.
Saying minutes ago, at my direction, FBI agents executed an arrest in Minnesota.
So far, we've arrested Nakima Levy Armstrong, who allegedly played a role in organizing the coordinated attack on City's Church in St. Paul, Minnesota.
We'll share more updates as they become available.
Listen loud and clear: we do not tolerate attacks on places of worship with an update saying that a second arrest had been made.

In fact, really across the board, but this Jack Smith hearing is very interesting.
It's going very interestingly, not exactly going that well for old Jack Smith.
But of course, he's being defiant and acting tough.
And again, just running with the scam that they've been running with since, well, about January 6th, 2021.
I want to go to some of these videos of the Jack Smith hearing, which I don't know.
I guess we might have new viewers, new listeners.
Maybe I should repeat myself, but I feel like Jack Smith is one of these things where from the beginning, it's always been absurd that this guy was ever appointed to anything.
His entire career, up to the point that he became this special counsel, which he was never duly qualified to do.
They never went through an approval process in the Senate.
He's just some guy.
He's just, Merritt Garland called up his friend Jack and said, get Donald Trump.
That's literally what happened here.
And they gave him like carte blanche, the Georgia election case, the New York real estate case, the documents case in Mar-a-Lago.
Why is one person running all of these investigations?
Because it was about Donald Trump.
Get him on whatever.
If you got to come up with some scam about Georgia, go with that.
Of course, we know beyond any doubt.
I mean, the reason all of this is absurd is because all of these things were obviously lies from the very beginning.
And why we have to suffer through a decade of inaction by the government in correcting any of these abuses of power is just absurd.
I mean, from Russia Gate to the Mueller investigation to the 2020 election, it was stolen right in front of us.
We knew it before the election even happened because we saw the way the mail-in ballots were impossible to verify or disprove.
So it's just exhausting having to say this over and over and over again.
Now it sounds like, you know, more people are saying this.
Actually, one of the clips that we have today from the Jack Smith hearing is him basically admitting that he wasn't really sworn in.
They like faked his swearing in, I guess, but it makes sense because he was never sworn in because he was never approved by the Senate.
His appointment was illegal on the face of it, the entire time.
So again, I don't know why we have to suffer through listening to these people.
Same with this Michael Fanone guy.
He's become a celebrity because of such a dirtbag.
All these guys, they're just dirtbags and they just lie continuously and they get busted on this and it doesn't matter for some reason.
I don't get why they get away with everything all the time.
It's completely absurd.

Yet in your opening statement, you said that we followed Justice Department policies, and I would assume you meant the law as well.
It strikes me as odd that you don't remember who swore you in, how you were sworn in.

We all get sworn in here, and I remember every day.

I don't remember the details of it as I sit here today.

I think my recollection is it was when I was appointed.

It was when it strikes me as odd that Attorney General Garland had you retake the oath of office on the 14th of September of the following year.
Why did he make you do that?
jack smith
As I sit here right now, I do not recall.
I know that there is the oath of office that I signed.
I believe it was on the 18th, the day that I was appointed.
And I know the department had me do a second one.

I don't know the particulars of why they asked me to do it again, but you signed it on the 20th of November 22nd, November 2022, but there was no witness, which, I mean, you have to agree.
It's a little odd.
If there's no witness saying that you took the oath of office, it would maybe make someone like me question whether or not you were legitimately doing the job until you finally took the oath of office.
It sounds like the Attorney General had the same question and thought, oh, shit, we got to have him sign this on the 14th day of September of the following year.
So why did you take the oath of office again on the 14th of September of the following year when you say you took the office in November of 2022?
Why'd you need to do it twice?

My recollection is that I took the oath of office, as you said, it was the 18th of the 20th and felt I was under the oath of office.
I believe, if you have it in front of you, I think I signed an oath.

You signed it, but there was no witness.
There was supposed to be either notarized or a witness.
And apparently, Attorney General Garland thought it was significant enough.

Yeah, he's never signed in.
He was never, he was never duly appointed.
He's literally just some guy.
He's just some dude that's walking around pretending like he's a duly appointed expert and is allowed to do this.
He's issuing subpoenas and he's gathering evidence.
He has no right to do any of it.
He's just some dude.
He never took a valid oath.
He was never approved by the Senate.
I mean, if these things don't matter, then why did Lindsey Halligan just get kicked off?
Then why did the Comey indictment get thrown out?
That all had to do with her not being accurately and duly appointed, even though she was.
And even though she only had to be appointed as a interim, didn't require Senate approval for the first 90 days or whatever it is, but they only had to appoint her because the guy that had been previously appointed was slow walking it and was going to let the statute of limitations expire in five days.
So they had to appoint Lindsay Halligan, but she doesn't get approved by the Senate because there's literally no time.
She has to get an indictment in five days.
She gets the indictment.
Then the indictment's thrown out because they say Lindsey Halligan isn't duly approved of.
However, neither is Jack Smith, and nothing he did ever ran into that barrier.
How very curious, right?
I mean, I guess we're just relearning this over and over again.
It's being reasserted constantly: the fact that the Democrats really do not have laws.
They really just do whatever the hell they want, whenever the hell they want.
Whereas the Republicans, even if we are adhering to the law, even if Trump is sticking exactly to the letter of the law perfectly, they will still just claim that he's not and just throw it out anyway.
Completely, utterly, and outrageously rage assistant.

She was their star witness, January 6th Committee, their star witness in one of those staged and choreographed hearings they paid the former president of ABC News to put together.
She was, in fact, the only witness at this special prime time hearing Tuesday, June 28th, 2022, 8 o'clock in the evening, and she told some stories.
I mean, these were some stories.
She talked about President lunged across the back seat, grabbed the steering wheel, tried to drive the car to the Capitol.
And I just want to know: you think she was lying?

Chairman Jordan, my assessment of that particular issue is that with respect to the testimony about someone lunging the president lunging towards the driver, my recollection of her testimony about that is that it was secondhand.
She said she'd heard that from somebody.

You familiar with the name Tony Ornado?

Secret Service agent who was actually in the car that day.

And they both said the first time they ever heard this story was when Ms. Hutchinson testified in the primetime hearing as their star witness of the January 6th Committee.
By the way, did you ever confirm her testimony about this particular incident?

We conducted, as I said before, our own independent investigation of all aspects of the case that we thought was relevant.

Well, we interviewed her, I should say, attorneys in my office.

Did you ever confirm the president leaping across the seat, grabbing the steering wheel, this whole concoction she brought up in the January 6th hearing?

We interviewed another first-hand witness who was in the car who did not confirm that that had happened, but also your deposition to the committee last month, Mr. Smith, you said this.

My recollection with Ms. Hutchinson was a number of the things that she gave evidence on were secondhand hearsay.
You remember us making that statement to us last month in the deposition?
jack smith
I did, and I was referring particularly to what we're talking about now.
jim jordan
Yeah, and you also said Ms. Hutchinson, regarding this particular claim, was a second or even third-hand witness.
We asked you, if you were a defense attorney, how would you handle cross-examining her if she was on the witness stand?
And you said, if I were a defense attorney, Ms. Hutchinson were a witness, the first thing I would do was seek to preclude her testimony because it was hearsay.
You remember saying all that?
jack smith
Yes, that's correct, sir.

That's correct, right?
Were you going to put her on the witness stand if you ever got to trial?
jack smith
We had not made final determinations as to who we were going to call as a witness.
We had a large choice.

You were still considering her?
jack smith
We had a large choice of witnesses in this case.

Are you familiar with what Washington Post reporters Carol Lenig and Aaron Davis said in their book?
They did this book, 300-some pages book on Chronicle and the whole investigation at the Justice Department.
And here's what they said on page 310.
They said Jack Smith had wondered whether some of Hutchinson's claims might be relied upon at trial.
Still, at one point, Smith told the elections team he wasn't ready to give up on Hutchinson's account.
Ultimately, however, Trump administration officials uniformly, fiercely disputed her accounts under oath.
Prosecutors on your team told Smith they wouldn't want to use Hutchinson as a witness in court, and Smith agreed.
Are Carol Lenig and Aaron Davis, who wrote this, are they lying?

My recollection is that I certainly have not made any final determinations about who we were going to call.

And that's the point.
That is the point.
The fact that they used her in a primetime hearing and you won't rule out using her or didn't rule out using her, putting her on the witness stand when everybody knows she wasn't telling the truth.
That says it all.
That's the degree the left and Democrats were willing to go to get President Trump.
Putting on the witness stand someone everybody knows is making it up.

And you were willing to do it.
By the way, you know how many times Cassidy Hutchinson was mentioned in their report, the January 6th report?

Someone that the whole country knows wasn't telling the truth, and you were still considering putting her on the witness stand because you had to get President Trump.
And everybody can see that.

That was really a masterclass.
I mean, we just saw Jim Jordan set up a trap, set up a stick with the box over it and a string, and then go hide behind a tree.
And here comes dumbass Jack Smith wandering right into it.
But he has to.
He kind of has to.
It was sort of a trap of his own making, actually, because what is he going to say?
No, Cassidy Hutchinson is completely unqualified, totally untrustworthy, and I would never have chosen her to be a witness.
Well, then why was she a witness for January 6th?
Damned if you do, damned if you don't.
He can't say that she's a totally untrustworthy witness because it undermines the entire January 6th show trial that they did.
But he also can't say, yeah, absolutely, we're going to use her testimony because everybody knows the testimony is entirely fraudulent.
Now, the problem that we were talking about back when the January 6th show trial was going on was it was just that, a show trial.
And the convenience of a show trial is you can have a witness go up, lie her ass off, completely, flagrantly fabricate events that never happened, but she never gets cross-examined.
Because a show trial has that convenient aspect to it, that you never have to give the defendant a chance to defend themselves.
You can just put forward people who will condemn the people accused and never be questioned about the legitimacy or the accuracy of their retelling of the evidence that they provide.
That's the whole problem the entire time.
Cassie Hutchinson wouldn't have been able to say the lies, she said, if there had been a defendant and a lawyer for the defendant, and they'd been able to cross-examine her.
The whole thing would have fallen apart.
It would have been exposed as the ridiculous charade that it always was.
That's why they had the show trial, was to put that evidence out into the public sphere, dress it up as if it looks like a court proceeding.
And so the assumption is to the average person watching, to the normie watching there, when they see a judge and a witness in a stand and a lawyer questioning her, gee, this looks an awful lot like a trial.
And so they're going to assume that the same provisions of a trial apply, that the person's taken an oath to tell the truth, that they'll be cross-examined, that the evidence has been approved of by the judge to be presented to a jury.
There was no jury.
There was no defendant.
There was no cross-examination whatsoever because it was a show trial put on by traitors to our country attempting to disguise their tyranny under the facade of a legal proceeding, under the facade of due process.
So well done by Jim Jordan, just completely exposing all of that, that they knew that Cassidy Hutchinson was lying and they put her on the stand anyway.
They approved of her evidence and presented it as if it was truthful anyway, despite knowing it was fake, because they could, because there was no cross-examination.
Pretty simple, actually.
No rules of evidence.
No ability for the accused to affront their to confront their accuser.
Because the entire thing was anathema to the fundamental function of our entire system, not just the judiciary, but like literally the things that America was built on.
Innocent until proven guilty, the right to defend yourself, the right to speak for yourself in public when other people are condemning you.
All of those things were deliberately destroyed by the Democrats in this sickening and tyrannical pursuit of their political enemies.

So, no, the warrants for Trump were never legitimate.
The indictments against Trump were completely fraudulent.

So, why are they still sitting there as free people?
Why, when they tried, and even if they failed, and they didn't really fail, like it keeps like, what is the charge for like attempted tyranny?

I guess I'm now defending against our domestic enemies and threats.
It was such a great opportunity to showcase to the entire planet that this, by the way, he was a Metropolitan Police Department officer, spent a majority of his time undercover.
And when you read his book, which I did, he lauds that he's drinking buddies with Nancy Pelosi.
And on more than one occasion, he would actually call and speak with her at two or three in the morning about things.
Also, he talks about how he had a, I believe if I'm not mistaken, I'll have to pull these up now that everybody's asking me for an interview as we highlight this individual and his unhinge demeanor.
He also had a, I think, a drug problem, if I'm not mistaken.
Again, I read it a couple of years ago, but I think I'm right on that one.
And some of the things that he started spewing out, he knew immediately that he already lost his cool.
His fellow U.S. Capitol Police Fed surrectionists, along with MPD Fed surrectionists, were there to hold him back from essentially assaulting me.
Let me face it.
He can't assault me because one of the elements is fear or apprehension of harm, which I can never have.
So, I mean, I guess you could get him for battery if he did touch me.
And so you can see that he was on the verge of doing so.
And remember, this is a calm break.

This isn't the first time I've interacted with him.
In every single instance where I physically am in his proximity, I use cordial language.

But before that, from what I know, and Gary McBride, who's been looking at all the different videos and assessing the witnesses specifically, these particular four, what Gary McBride told me from the CCTV footage and the body cam footage, this guy concocted a majority of his story up.

There was some pushing and shoving going on.
I mean, imagine what happens to somebody on hinge like this when I'm calmly addressing him and when somebody just kind of like maybe accidentally bumps into him.

I didn't even look at the details of the story.
I see that leftists are saying that ICE kidnapped a five-year-old to use as bait.

On January 20th, ICE conducted a targeted operation to arrest Adrian Alexander Konega, Konehegai, something or Arius.
As agents approached the driver, Adrian fled on foot, abandoning his child.
For the child's safety, one of our ICE officers remained with the child while the other officers apprehended Konejo Arius.
Our officers made multiple attempts to get the mother inside the house to take custody of her child.
Officers even assured her that they would not take her into custody.
She refused to accept custody of the child.
The father told officers he wanted the child to remain with him when he was under arrest, okay?
Our officers' primary concern during the entire operation was the safety and welfare of the child.
Following the mother's abandonment of the child, officers abided by the father's wishes to keep the child with him.
Father and son are now together at Dilley, which is a holding facility.
Parents are asked if they want to be removed with their children or ICE will place the children with the safe person the parent designates.
This is consistent with the past administration's immigration enforcement.
Parents can take control of their departure and receive a free flight and $2,600 with the CBP home app.
So I believe them.
I 100% believe them.
You know why?
Because there's no reason to believe that this kid was ever used as bait.
There are no actual pieces of evidence to hint that that was actually ever happening.
All it is was that somebody said that.
Somebody said they kidnapped a five-year-old kid to use his bait to lure out the family.
When the reality was the dad was with the kid, the dad ran away, leaving the kid behind.
They try to give the kid back to the mother, and the mother says no.
And so they're like, okay, we'll leave the kid with his dad then.
But I printed this story out this morning.

Obviously, they're lying.
District officials confirmed that one of the children is a five-year-old boy who attends an elementary school in the area and was allegedly used to draw relatives out of their home.
Why detain a five-year-old?
You can't tell me this child is going to be classified as a violent criminal.

They're just lying.
That's all it is.
And again, another adult living in the home was outside and begged the agents to let him take care of the small child and was refused.
Instead, she said the agent took the child out of the still-running car, led him to the door, and directed him to knock on the door, asked him to be let in in order to see if anybody else was home, essentially using the five-year-old as bait.
Again, it's actually, and so, okay, let's take the actions.
Let's say, like, okay.
So they confirm basically everything the DHS agent said.
They just present it as if it's evil.
It's like, okay, the kid was in a car that was still running, but that the dad was driving.
So they did pull the dad over with the kid in the car, and then the dad left and left his kid in the still-running car.
So they actually confirm the legitimate story, but are presenting it as if he was used as bait somehow.
Okay, so just abject lie.
It doesn't matter.
It's going to be added to the construct, added to the facade, and built upon endlessly.
And it's that, it's this type of thing.

The officer also has probable cause.
So they're just lying about this.
They're lying about the five-year-old.
They're lying about going in to enter houses without warrants.
All of it is lies, 100% lies, which is why it's so frustrating seeing headlines like this from futurism.com.

No, they went, okay, if they try to do ICE things, then our local government can impede them.

So then, if the federal government tries to crack down on the violence, we can claim that they're being oppressive and tyrannical and inspire more people to rise up against it.

You simply cannot have a country when laws only exist for some people.

Why would Don Lemon not be charged with this?
He was provably not acting like a journalist at the time.
A journalist isn't involved in the pre-planning of an event.
A journalist doesn't go out of their way to help the event planners cover up their intentions, which is exactly what Don Lemon did.
He's filming the organizers before they ever go into the church.
And he says, let's step over here and get the camera away from them so they can discuss details in private.
I'm sorry, that is the opposite of what a journalist does.
What a journalist would do would be to say, these people are about to go raid a church, like not allow the crime to proceed while participating in it and then bragging about it afterwards, only to then say, well, I'm just a journalist.
I'm just a journalist.
Now, if you were like a journalist on January 6th and you're just in the crowd filming it, I mean, you had no idea they were going to go into the Capitol and you might actually want to go in to film what's going on in there because it's an event that's unfolding unexpectedly in front of you and you are literally there to document it.
But not if you're planning it beforehand with the people involved.
Not if you know what they're going to do storming into a church to yell and scream at innocent people and shut down the service, stop them from carrying on their religious activity, and you help them cover up the planning, but you participate in the planning, you know what they're going to do, then you participate in it and you think you get away with it because you're saying, Nana Boo-Boo, you can't touch me.

A Minnesota federal judge, magistrate judge, refused to sign a complaint charging independent journalist Don Lemon in connection with the protest inside a church in St. Paul on Sunday.
Multiple sources familiar with the proceedings told CVS News.
The attorney general is enraged at the magistrate's decision, said a source familiar with the matter.
The thing is, this shouldn't be a surprise.
This judge has spent the entire second Trump administration as an outspoken enemy of Trump who is going out of his way to give interviews about how his role as a judge is to stop Trump from carrying out his agenda.
Why is he still a judge?
He is not making decisions on the basis of law.
He is not making decisions as an unbiased arbiter of the law.
He's making decisions as a Democrat activist and has the entire time.
Why was he not impeached by the Republicans six months ago when this became obvious?
By the way, the same judge signed dozens of warrants to arrest January 6th protesters.
That's how you really know that this has nothing to do with the law or the equitable application of the law.
If you're a plumber from Maine that happened to high-five the cops as you wandered through January 6th, this magistrate has no problem slapping you with a terrorism charge, even if you never did anything to anyone, never heard anyone, didn't even, you know, disturb the velvet ropes in Statuary Hall.

He would let you be charged by the DOJ.
He would let them try to send you to jail for 20 years.
He would let them put you in solitary confinement for two years straight before you're ever even brought to trial.

Dylan declined to comment when reached out to by CBS News.
The Attorney General's office in D.C. faced similar hurdles last year after President Trump flooded the street with federal agents as part of an initiative to crack down on violent crime.
Prosecutors in U.S. Attorney Jeanine Pira's office were ordered to pursue every case as a federal offense when possible, a plan that backfired when the Justice Department began to see grand juries reject charges and magistrate judges push back on cases they viewed as flimsy or that contained constitutional defects.
In an October 28, 2025 opinion, Magistrate Judge Zia Faruqui in the U.S. District Court for Columbia revealed that over the course of eight weeks since the crime surge began in office in August, the government moved to dismiss 21% of all cases that were charged by criminal complaint.
That statistic is shocking, he wrote, compared with the 0.5% of cases charged by criminal complaint that the government dismissed in the district over the past decade.
However, murders have plunged 20% in the last year.
So do we want to take that into account at all?
Maybe the way that it was being done in the past was deliberately inconsequential, was deliberately ineffective.
You know, maybe the way they used to do it, with all those really, you know, perfect 0.5% rejection rate, maybe that's because they weren't charging anybody and all the criminals are running wild and rampant and not ever being forced to face justice.

No state agency responsible for the administration of federal funds shall impose a requirement on nonprofit charitable organization providing a federal public benefit to determine, verify, or otherwise require proof of eligibility of any applicant for such benefits.
So it's literally saying that you're not allowed to check if somebody is actually qualifies for the benefit they're receiving.
So somebody can say they have a daycare, collect money for their daycare, and they never have to prove a daycare exists.
And it's illegal to try to find out.
It really, I mean, you might as well write a bill that's like, did you see what they did in Minnesota?
