The court ruled today that there was a special prosecutor who decided to retry him in a case, despite the fact, you've got to follow this, that the Cook County State's Attorney's Office previously dropped the charges against him.

And that many people were dissatisfied with the resolution of the original case and believed it to be unjust.
Nevertheless, what would be more unjust than the resolution of any one criminal case would be a holding from this court that the state was not bound to honor agreements upon which people have detrimentally relied.
That's an estoppel theory.
That's promissory estoppel, justifiable reliance, kind of.
Here's what happens.

And he claimed he had been attacked by two men who shouted racial and homophobic slurs who recognized him at two in the morning in Chicago in the dark.

He paid him $3,500 to help him.

So after they charged Juicy Smell It with disorderly conduct, The Cook County prosecutors dropped the charges, noting that he had forfeited his $10,000 bond and had done community service.
Now, this is weird.
When you drop charges, it's the most official thing anybody's ever seen.
You know exactly what you're doing.
You enter a document.
You enter a pleading.
You enter some formal notice.
It's clear as day.
Deferred prosecution.
Criminal intervention.
Something along those lines.
You do this.
Then you successfully complete the program.
It's like a deferred prosecution.
And it's all signed.
And you do it.
There's no doubt about it.
No lawyer would ever say, listen, I'm not going to forfeit bond or you do community service unless I get this in writing.
This is an absolute agree-to understanding.
So, after they dropped the charges and everybody went crazy, the former judge, Michael Tooman, appointed a former U.S. Attorney Dan Webb as a special prosecutor in the case.
Now, for some reason, the judge and Webb thought this case was still active.
Webb refiled the charges.
Again, if there was a document that says, this is it, this is incompletion and satisfaction of everything, this agreement.
By the way, he refiled charges.
Juicy's attorneys now argued.
That the new charges amounted to a violation of the double jeopardy cause of the Fifth Amendment, and you can't bring somebody to trial twice for the same charge.
And the court says it defies credulity to believe that the defendant would agree to forfeit $10,000 with the understanding that the prosecutors could simply re-indict him.
Who cares what he thinks?
The question is, what is it?
I mean, this is the sloppiest thing.
You mean to tell me he forfeited his $10,000 and did community service, and then later on they said, you're not going to charge me, are you?

So anyway, he was previously found guilty of the refile charges.

And then this Judge Lynn sentenced him to 150 days in jail, 30 months of probation.
This is in March of 2022.
After a seven-hour hearing, he was ordered to pay restitution of over, just over $120,000, all of the cops in the investigation, and a $25,000 criminal fine.
After being found guilty of five counts of disorderly.
So they adjudicated him, convicted him.
150 days, 30 months probation, or 30 months paper, as we call it.
120,000 bucks in restitution.
I mean, they hammered him on disorderly conduct.
So Juicy never served any time.
He was released on his own recognizance bond.
It's like an ROR.
And during the time, Lynn, the judge called Smellett, Juicy Smellett, a charlatan who pretended to be a victim of hate because he wanted attention, calling the hoax, quote, premeditated to the extreme.
He said the evidence was overwhelming.
And the judge Lynn says, you've been lying and lying and lying about this case.
He is a psychopath.
And that Kim Foxx, one of those Soros people, I remember, who was it?
