As you know, libel, defamation.
We used to say slander.
Slander is merely spoken word, but it's libel.
Liable is a statement of fact that causes damages.
It's false.
A statement of fact that's false that causes damages.

If it's a statement of fact that's true and it causes damages, it's not liable.

These are statements of fact which are false that have libeled us.
Fox News could have said, wait a minute, we're just reporting this.
CNN says, we're just saying, these people are claiming this.
But that's not what Dominion said Fox did.
Dominion said Fox not only had the people who made these claims on, but kind of supported it, kind of agreed with it, kind of said, yeah.
That's a little bit different than just reporting it.
But then people said, but wait a minute.
You can have an opinion.
Maria Bartiromo or whoever it was can say, yeah, and I agree with that.
Maria, anybody has a First Amendment right to say, I think that so-and-so, I think that this company did this.
I think, in my opinion, This causes cancer.
I believe this.
We hear this stuff all the time.

You're saying a public figure.

When a public figure is involved, it's a different story altogether.
The difficulty, the difficulty, the problem of a defamation case is even if you've got a claim that's valid, even if you're 100% correct, if the court considers that you, you are a public figure, it's a problem.
If you're a public figure, you're defined as an individual or someone who has assumed a role of prominence.
In society, or you thrust yourself into the spotlight, like a government, a celebrity, or even a person who is at the heart, is at the center of a controversy.
Public figures have got this higher burden.
And when they bring a defamation suit, they've got to show that the defendant, people you're saying, acted with actual malice.
Or, A reckless disregard for the truth.
Actual malice meaning you know it's wrong or you didn't even care.
And up till now, it's been a waste of time.
