Mohsen Madawi, the organizer of the pro-Palestinian movement at Columbia University, was freed from federal custody on Wednesday after immigration officials sought to rescind his green card.
In a ruling to release Mr. Mwadawi, a federal judge, Jeffrey W. Crawford, found on Wednesday that he did not pose a danger to the public and that he was not a flight risk.
The judge referenced cases from the 50s and the specter of McCarthyism saying this was not our proudest moment.
So Trump is doing the new McCarthyism.

And what the Constitution said and what the writers of the Constitution said, the founding fathers of our country said, is that the government will not interfere with that free speech right that you have from God.

The Constitution protects free speech for everybody.
And if you're for free speech, it's not a privilege.
It's not a privilege just for people who are citizens.
It's a value you're supposed to live by and you're supposed to want to spread to everybody, just like the founders of this country wanted to.
So if you're against free speech for students here on green cards or Visa or anybody anywhere in the world, you're against the U.S. Constitution.
You're against God.

The Secretary of State Marco Rubio has argued the immigration authorities have a right to eject even legal residents from the country for protest activities that the government says harms Americans' foreign policy interests.
Mr. Madwadi, 34, has been in custody since April 14th when an immigration official detained him at an appointment in Vermont that he thought was a step toward becoming a U.S. citizen.
So here's a guy doing crossing all the T's, dotting all the I's, showing up for his appointments.
He's got a green card.
He's a legal resident and he wants to become an American citizen and he's doing it the legal way.
No MS-13 tattoos of any kind.
And so what they do is they try they arrest him and try to deport him for free speech for a thought crime, not a thought crime against America, not a speech crime against Americans, but for another country.
How despicable if you think you're a good American and you support that bullshit that Trump is doing.

So Judge Crawford ordered that Mr. Madwadi be released from the detention facility where he had been held in the state.

Mr. Madwadi was not accused of a crime.
Rather, Marco Rubio wrote in a memo justifying his arrest that his activism could undermine the Middle East peace process by reinforcing anti-Semitic sentiment.

Mr. Madwadi's lawyers had requested a temporary restraining order to prevent federal officials from transferring him to a more conservative jurisdiction.
A tact that was used in the detention of attempted deportation of at least four other college demonstrators, including Mahmoud Khalil, a legal permanent resident who has been in Louisiana detention facility since last month.
Another Vermont federal judge, William K. Sessions III, swiftly granted the request, ordering that Mr. Madwadi, who grew up in Palestine refugee camp in the West Bank, not be removed from the United States or transferred out of Vermont until he was ordered otherwise.
Judge Crawford then extended the decision to keep Mr. Madawi in the state until Wednesday's ruling.
Shortly after Mr. Madwadi's release, his attorney said that he would be allowed to finish his academic program at Columbia.
The Trump administration had sought to deport Mr. Madawi using the same legal provision that it is using to detain Mr. Khalil, contending that his presence is a threat to the foreign policy and national security interests of the United States.
Federal officials have argued that pro-Palestinian demonstrators have enabled the spread of anti-Semitism.
No, what Trump is doing is furthering anti-Semitism.
Again, whenever you try to censor someone, it doesn't work.
It just creates more backlash.

In April, an immigration judge in Louisiana found that federal officials could deport Mr. Khalil, and the Department of Homeland Security later denied him permission to attend the birth of his first child.
In recent weeks, Mr. Madwadi or Madawi had been in hiding, worried about being arrested by immigration police after Mr. Khalil was detained on campus housing at Columbia.
He asked the university for help, but did not receive it.
An extreme pro-Israel group called Batar had warned on social media that he was next to be detained.

Yesterday, California District Judge Jennifer Thurston demanded CBP agents cannot arrest suspected illegal migrants without a warrant or reason to believe the person is a flight risk before they can get one.
So that seems kind of crazy to me, but here's a guy named Codfish Johnny.
I'm going to guess not his real name.
So he says this, Mike Lee, a sitting U.S. senator and former clerk to Justice Doledo, is lying to you.
So this is, he's saying the law and the opinion of this judge provide only a limited set of circumstances in which arrest without a warrant is lawful.
Those include where there is individualized reason to believe the alien is likely to escape or where crime occurs in front of the agent.
Furthermore, agents have systematically violated the requirement under the same law that requires reasonable suspicion before even detaining someone.
Detaining someone includes all of the tactics described in the complaint, which makes it obvious that violating this law is quite simply the policy of this administration.
Among the named individuals in the action are a 56-year-old lawful permanent resident and a 44-year-old U.S. citizen who had his tires slashed after providing his ID to an agent.
The case appears to show a grotesque intentional violation of the law on a very large scale by the administration.
It is not in any way judicial overreach.
The only serious problem in this decision is the administration's actions.

Probably, probable cause can be based on factors like lack of documentation, suspicious behavior, or other evidence of illegal entry or presence.
However, arrests must still comply with Fourth Amendment protections against unreasonable seizures, meaning agents need sufficient evidence to justify the arrest.
So this seems to contradict what Codfish Johnny was saying.
And to me, so when I saw that news report and I saw Mike Lee, a senator, former clerk to Justice Alito, saying this is nuts, it did sound nuts to me that the immigration enforcement officers can't arrest someone unless they first go obtain a warrant.
Now, again, I'm not a lawyer.
I'm not an immigration specialist.
But as Mike Lee said, that sounds crazy.
And that sounds like the judge is, I didn't have enough time to really go into it because this happened right before I came on air.
So I'll look more into this.
I'm sure we're all going to learn more about it tonight or going forward.

But this seems nuts that a federal judge.

Time says, would it be acceptable to you in a deal if Crimea and the four other regions that Russia has taken from Ukraine would be folded into Russia under a final accommodation?
I would be 100% okay with that, me personally, because the United States, if you don't know the story, very quickly overthrew the Ukrainian government in 2014, the Maidan coup, and installed a puppet.
So the ethnic Russian speakers in the eastern part of Ukraine, they didn't want to go along with the coup government that was installed by the United States.
And so what did you, the puppet government of the United States started doing in Ukraine?
They started bombing the people in the Donbass in the eastern part, and they slaughtered at least 16,000 of them over the next six years or eight years.
And so Trump's, so that's the whole, so no, I would be okay.
And when Putin invaded Ukraine, he didn't invade to start a war.
He invaded to stop a war, the war against the people in the Donbass that were being slaughtered by Ukraine and the Azov battalion, which is a Nazi battalion.
So Trump's response is, if Crimea will stay with Russia, we have to only talk about Crimea because that's the one that always gets mentioned.
Crimea will stay with Russia, and Zelensky understands that.
And everybody understands that it's been with them for a long time.
It's been with them long before Trump came along.
And again, this is Obama's war.
This is a war that should never have happened.

So Zelensky was so angry with Trump over that statement that he almost took a shit.

I mean, they had the opportunity to end it.

You end this war and we'll take you out.

I don't know why the United Kingdom wants to keep this war going.

But yes, this all happened under Obama.
You cannot put this on Trump.
You also can't expect Trump, as good at negotiating as he is, to get back an area where nine out of 10 people speak Russian.
Like the one out of 10 that live in the area that speak Ukrainian.

And yet I could just see somebody trying to bring that up as a subject and, you know, say, oh, he raised taxes.

I'd be raising them on wealthy to take care of the middle class.
But I can't do that because then J.D. Vance would lose the election in 2028.
I'd like to raise taxes on millionaires to take care of the middle class, but then they'd use it against us.
