I mean, to have all of these instructions just read to them without them getting a copy is going to be overwhelming for them.
And also, it's crazy that the lawyers were not able to discuss the instructions in their closings yesterday.
Typically, lawyers can go through the instructions and explain why they've met them or why the government hasn't met them, and they weren't able to do that yesterday, which I find bizarre.
I think the lawyers should have been able to do that, because the jurors right now must be wondering, What is this all about?
Jeff, was that like a deep fake?
At the bottom of that clip on the video, it said CNN.
Yeah, and he was the guy that came in to replace the guy from before, the day before, that said that on CNN, their legal analyst said that they didn't prove the case at all.
What is going on?
I don't think they can find any lawyers that actually want to agree with it.
That's a criminal attorney, I think his name is David Marcus, and he's on CNN saying that he's never seen anything like it.
He's never seen anything like it.
That the judge, Judge Juan Merchan, a Biden campaign donor, whose daughter's made $93 million for the Democrats off her daddy's case, That his instructions, we've never seen anything like.

The jury is still in deliberation.
This is day two.
They've got an hour and a half left, formally, of deliberation before the judge will theoretically excuse them for a second day.
But the idea that he tells them yesterday that you don't have to agree, this is the first time in a criminal felony trial ever that you don't have to have agreement amongst the 12 jurors, that if four of you agree on one of the charges and four of you agree on One of the other charges, he'll take that as unanimous.
That's a kangaroo court.
That's Kafka.
And then, then, you heard there on CNN, the judge tells President Trump's attorneys, you are not to give legal explanations to the jury before they deliberate on the finer points of the law.
That there has to be actual intent to defraud.
Yes.
The charge is fraud of record keeping in a private, non-publicly traded company that has to be beyond a reasonable doubt proof of intent to defraud.
Not just somebody saying he was defrauded.
By the way, who was?
Who was defrauded?
Did Stormy Daniels get the money?
Did Michael Cohen get paid?
Oh, and did he defraud President Trump of another $40,000 to which he confessed on the stand less than two weeks ago?
You're not allowed to instruct the jury?
Let's go from CNN to Fox and to a woman who has served in that self-same position as a judge.
Judge Jeanine Pirro yesterday.
But there's no evidence.
The defense couldn't defend themselves on it.
That's bizarre, John.
No one has heard of this.
It's like a menu.
A, column A, B, or C. You don't all have to agree on it.
Whatever, folks.
This is a kangaroo court.
This is unheard of.
I'm telling you, I've done this for 32 years.

Or is it the fact that his daughter has made 93 million dollars for the Democrats off her daddy's trial of President Trump?
Is that what gives him the man-crush?
Or perhaps, is it the fact that when I was in the court, you can read all the details in my article that went up yesterday, he said to the president's defense team, as the attorney He was just about to rise out of his chair to the microphone to request something of the court.
What did Juan Mochan, that exemplar of judicial temperament, do in front of all of us?
He said, Sit down!
I don't want to hear from you again!
As if magically, thanks to some pixie dust out of the judge's left ear, The U.S.
Constitution dissolved into nothing because the defendants, representatives, can't speak in front of the court because the judge doesn't want to hear from them?

I'm Carrie Lake and I want to get to know you.
You impressed me and Katie way back when and you've been doing so ever since.
So give us an update.
You're a candidate for the U.S.
Senate out of Arizona.

How's the campaign going and what do your fellow Arizonans Think of what's happening in Manhattan as we speak.
Well, the campaign's going great.
I mean, you know, we're fighting against a real true radical and a man named Ruben Gallego.
He's a mini me.
Joe Biden votes with Biden 100 percent of the time, you know, is for getting rid of the filibuster for everything from he wants to get rid of the filibuster to bring abortion to nine month.
He wants to get rid of the filibuster to make D.C.
and Puerto Rico a state.
He even wanted to get rid of the filibuster to push a piece of legislation that would
defund the police.
This guy is completely radical.
So he is a candidate that we have to stop, and we have a movement here.
The movement has grown since even our governor's race.
More and more people across Arizona said independence.
I'm talking to disaffected Democrats are saying, oh, my gosh, we've got to bring about a change.
We're looking good in the polls.
It's still a little bit neck and neck with this guy because he's got so much money coming in from Soros.
But we're looking really good.
President Trump is up eight points in the state.
My opponent, when people get to know him and really find out what his radical voting record is, they're going to run the other direction.
So I feel very confident that we can take the seat back.
Of course, we need all the support we can get.
Yeah, I'm glad he's spending a lot of money on advertisements because he's spending them very poorly.
He keeps turning up on my Twitter feed, this Gallego guy, so you're advertising in the wrong place, my friend.
But his campaign, it's pretty sleazy, pretty dirty, Carrie.
Oh, well, I mean, that's kind of par for the course with the deep state Democrats.
And, you know, when you've got Soros money behind you, we just announced he put $7 million to carpet bomb the airways because nobody in Arizona really knows him.
He's just kind of a generic Democrat to them.
But when they find out, oh, my goodness, you mean his district is the one downtown that has the fastest growing homeless population in the country?
Oh my goodness, he voted against the border wall, called it dumb and stupid, and said he would never, ever, ever vote to fund a border wall.
He voted for sanctuary cities.
He marched and defunded the police rallies.
It's really radical, and it's always dirty with the Democrats.
They'll stop at nothing to try to take this seat.
It's an important seat in the Senate, and of course they don't want someone like me, a fed-up mom, who's going to go to Washington, D.C.
and represent the people of this state.
I can't be bought.
I can't be bribed, I can't be blackmailed.
And Seb, you know how Washington D.C.
operates.
They only want people in positions of power that they can control through that apparatus of bribery and blackmail.
Let's go beyond Arizona to the broader picture for the next five months.
You made a lot of news with this.
I was in the room when you said it.
Your take on the last federal election.
Cut one.
But time and time again with President Donald J. Trump, when it seemed like the world was falling apart, he came in and brought it back together.
He had these guys back there attacking him, left and right.
He had the swamp going after him, and he was still getting stuff done.
And now we have stumbling, bumbling Joe Biden.
81 million votes.
My ass.
Quite the cheers at CPAC.
We've only got a few months left.
Tell us about Arizona.
Tell us about what you hear when you travel the nation.
Are you confident that we will have a free and fair election, Carrie Lake?
I'm hoping that we have brought enough change.
It's obviously not enough, but just enough to get through this election and have such a huge turnout.
And by the way, I'm the only person running for U.S.
Senate in the state of Arizona that That has verbalized the fact that I don't believe Joe Biden truly won 81 million votes.
Everybody running for the U.S.
Senate in this state doesn't believe that there was fraud in the election.
And we know better than that.
And we must have fair, honest elections going forward or we'll lose our country.
I mean, Seb, you look at the people pouring across our border in this Biden-vasion right now.
They're coming from 170 different countries.
And many of those countries Have watched as their economies have collapsed, as their elections were run like they are in banana republics, because many of them are banana republics.
And once you lose elections, once they become just theater, where the people know they're a joke and that their vote really doesn't count, then you lose your country forever.
And so I don't want America to go down that way.
I want to have honest elections, a level playing field where every Democrat vote counts, every legal vote.
Whether it's Democrat, Republican, or somewhere in between.
And that's what I've been fighting for and continue to fight for to this day.
I'm the only one running for the U.S.
Senate in Arizona who believes that there was fraud and believes we must address it immediately.
So we're continuing to work.
We still have court cases that are running through.
We're still trying to fight and get rid of these machines that, obviously, when they rolled them out on Election Day, not only were they not tested, they had disapproved, unapproved software.
They didn't follow the law when it came to those machines.
And because of that, we saw how they failed on election day in 60% of the polling locations in Arizona and in Maricopa County, I should say, and they were all Republican areas.
So we got to get this straightened out.
I'm still working and fighting for that.
But really, what's important... We're almost out of time.

That's what I'd be doing.
And then the judge has the power, rarely, rarely exercised, but he has the power.
I've seen it done to say, well, if this juror won't deliberate, then he's violating his oath.
And I'm going to substitute one of the alternate jurors for that jury, juror.
And then immediately they come back with a 12 to another.
And then give me 11. 11.
Yeah, I mean, I think that it feels like there's a dam breaking.
There are so many people who have been working within the system trying to speak through the proper channels about what they are witnessing and what they're seeing and how horrific it is and that we are supplying these weapons.
We're providing the financing for the ongoing violence against innocent Palestinian civilians.
And I think people are realizing that no matter what they do or say, that their voice isn't being heard.
And I think they're starting to reach the same conclusion, unfortunately, that I made and that Lily made.

So I was there, standing behind the president on Tuesday, last Tuesday, In this corridor, and it's this dingy, dimly lit, neon lights above you, this corridor where the 45th, and God willing, if we do our part, the 47th President of the United States gives his press conferences.
They deliberately do it there.
It's a power move.
There's no microphone.
The press pool is 30, 40 feet away with the microphones You know, on their cameras or their cell phones.
And what does the President do?
I thought it was weird the first time I heard him quote our friends, like Greg Jarrett, like John Solomon.
And he's got a sheaf of articles in front of himself, and he's reading the analyses from legal scholars, from investigative journalists, from the likes of Alan Dershowitz, instead of speaking himself.
Why?
Because he can't.
Because the first time ever, the gag orders, which are meant to protect the defendants, who are innocent, they're innocent until proven guilty beyond any reasonable doubt, that is the requirement.
But he's been gagged, not the prosecution.
The defendant's been gagged.
So he can't qualitatively talk about the court case in which he is risking imprisonment.
So what does he have to do?
What is he forced to do?
He's forced to read what other people say.
Because otherwise he goes to prison not because he's found guilty but because the judge slams him in prison for contempt of court.
Truly, if you think of the fine details, and you realize what they all add up to, you understand what's really happening.
All right, it's 3.47 now, 3.48.
Still the jury hasn't decided.
I hope that's a good sign.
But let's listen to a truly nightmare scenario.
From perhaps the most famous academic scholar in America, he is emeritus professor from Harvard, and he's not even a Trump voter.
He's a lifelong Democrat.
What happens if one of the jurors says President Trump isn't guilty?
This is what Alan Dershowitz thinks Judge Murchan could do next.
So the judge hears from the jurors, and the judge hears that they're 11 to 1.
And then the judge says, well, is that other juror, the 12th juror, is he negotiating?
Is he involved in the conversations?
And the foreman of the jury says, no, he's refusing.
He's sitting there with his arms folded saying, guy's innocent.
Sorry, guy's innocent.
I'm not going to listen to you.
The guy's innocent.
There's no case here.
The guy's innocent.
If I were on the jury, that's what I'd be doing.
And then the judge has the power, rarely, rarely exercised, but he has the power.
I've seen it done to say, well, if this juror won't deliberate, Then he's violating his oath.
And I'm gonna substitute one of the alternate jurors for that jury, juror, and then immediately they come back with a 12 to nothing verdict of conviction.
I'm not saying that that's going to happen.
I'm not saying that's even in the judge's mind.
But knowing this judge and seeing him in actions, particularly having seen him in action the day I was in the court, when they cleared everybody but I was allowed to stay, why, I still don't know.
And I saw the real Judge Merchant.
That's not beyond the realm of possibility.
So they talk about venue shopping.
They talk about judge shopping where the permanent bureaucracy,
the unaccountable elite just chooses the judge.
They know is on their side.
What did we just hear from Alan Dershowitz?
Juror shopping.
The judge, who's a political activist, illegally donated to the Biden campaign.
If he doesn't get the jury to unanimously convict President Trump, he'll just excuse, he'll fire that one recalcitrant juror and say, oh, alternate?
Your time's up.
You're going to agree with the other 11, right?
It's not out of the question, after what we've witnessed in the last three and a half years.
Hopefully, Professor Dershowitz is wrong, but he may not be.

Marshal security detail SUVs outside the church, I'm thinking, I'm thinking, why are Supreme Court justices in danger, and why is it only the conservative ones?
Because I doubt the Democrats go to church to begin with, and if they did, I doubt there'd be anybody threatening their lives.
Can you talk to the fact that we have Democrats who are threatening politically and physically the highest court in the land?

Yeah, it is, and also family members too, which is supposed to be off limits.
It is funny you notice that, Dr. G, because I want to point out how where I'm at now, just north of L.A., when you see a celebrity sighting, it's usually at a restaurant, maybe it's at a dog park.
When you're in D.C., the celebrity sightings are at church, and this happens to me all the time.
I saw so many famous people.
No, if you're a conservative, right?
Yeah, and it's always a trip to know people who have to really know that they're all eyes on them, even while they're at church.
But what's happening with the intimidation of Supreme Court justices, it is a way of the weaponization of our media that I wrote about in my first book, Breaking the News.

It's trying to punish you and make it a crime to be a conservative person, to have constitutional, originalist values.
And it is something that they might be able, you might be able to get away with it, so to speak, but they want to make your life miserable.
They want to send a signal to you to get harassed when you're in public, that your neighbors make it uncomfortable for you to live in their neighborhoods.
It is so nasty and disgusting, and it's out of the realm of anything we would have thought possible until recent years.
And it's coming almost entirely from one side, and that's the political left.

But Dr. Jill Biden is such a nothing burger.
And the fact that the thing that she dines out on the most is that she got an Ed D.
when she was in her 50s and walks around like she's, you know, the Surgeon General, which Whoopi Goldberg, by the way, recommended, Dr. G., that Jill Biden be the Surgeon General.
That is true.
And that is fact check true.
She has a postgraduate degree in education policy.
And nobody who gets an Ed.D., nobody gets an education policy doctor.
Nobody calls himself a doctor.

All right, let's flip to, we're waiting, we've got, you know, they're showing the camera, the door of the court right now, President Trump's second day of juridiberation.

Talk to me about the last five weeks and what we're seeing in New York.
Yeah, what we're seeing is a war on our Constitution.
It's that level from Judge Marchand.
This is something that I want people to understand the gravity of the third world nature of what's happening.
This is horrifying what is going on in this courtroom.
We still don't even know what the charges are.
We don't know what laws the president allegedly broke and they're trying to frame it as if he's trying to defraud the public, Dr. G, but they're not listing specifically what he did.
They're trying to make the act of running a political campaign basically a felony, not even just some sort of a petty crime, a felony.
Because he was trying to spend money to influence the election.
No, he was doing something that appears to be perfectly legal in any other circumstance and they're trying to invent a circumstance where it is illegal because he was running for office or something.
If you're confused, so is everyone else.
I've talked to the smartest people imaginable on this stuff, and even they can barely follow what's going on in this courtroom, and it's all designed to do the exact same thing they're doing to Justice Alito.
It is to make it illegal to be a conservative.
That is what's going on right now.
During the closing arguments, they made the prosecution go last so the defense couldn't respond.
The prosecution was invoking, Dr. G., a campaign finance violation, even though Trump has never been charged with a campaign finance violation.
They're trying to stack the deck as much as possible.
But the good news, it appears to me, as the American public sees through this, it appears to me that the American public is going to run to Donald Trump's side after the verdict, no matter what it is.
So you concur with what Vivek said yesterday, that guilty or innocent, it's a win-win for President Trump?
Absolutely.
My prediction is if he's innocent, then it is a big win.
If he's guilty, it's a bigger win.
What's more interesting is if it's a hung jury, which is probably the most likely option at this point.
The only reason why maybe a guilty conviction is the most likely outcome for now.
It's because the rules that Merchant has put into place Yeah.
are so that if they agree that Trump committed any crime, even if they can't agree on which crime,
they can render a guilty verdict.
Which no one's ever tried this.
This is such a dirty trick.
It's so political.
This is so clearly about November the 5th.
It will eventually get overturned, but will it get overturned before the election?
And that's what she's trying to do.
And the Supreme Court actually has precedence to do this.
They can reach down proactively if New York kind of slow rolls this in the next five months.
But we shall wait and see.

Her name is Susan Talamantes Eggman and she is talking about Senate Bill 1414 which they wanted to make it a felony To buy children to have sex with.
It's now a misdemeanor, right?

And so there's this lobby, including, you know, LGBTQ, LMNOP lunatics like him, that want, you know, sex with 16 or 15 year olds.

I'm done with us protecting people who would buy and abuse our children.

You know, all of these things have, when you get them in the minds of normals, they make them want to throw up.
And that's what had to happen, and I thank them for going too far, because we had to fix this.
What is the danger?
Because you understand politics, you also understand information operations.
What's the danger of us taking this for granted and saying, ah, we're going to win.
Whatever happens in the court, we're going to win.
Everything's okay.
They've crossed the Rubicon and America's waking up.
Well, if we don't act and actually start replacing people on school boards, if we don't act and say laws like this have to be passed and it's unacceptable not to, and make the people who vote the wrong way pay, then what, just saying we won the information war is meaningless.
The information war is designed to win the real war, the policy war, and the war to stop people abusing kids.

What would you like to see, irrespective of what happens in that courtroom, what would you like to see, oh breaking news, court deliberations, jury deliberations will continue tomorrow, they've excused the jury again for a second day, what would you like to see President Trump do more of in the next five months?
I think what he needs to do is go ahead and remind everyone, and he started saying it a long time ago and it didn't work as well.
He says, they're not coming for me, they're coming for you.
I'm just in the way.
And I think people can see that now.
I think that theme You know, among everything else, he's got the economy is a shambles.
He's got the foreign policy, the world's on fire.
But the bottom line, if people believe that they are no longer safe and secure in their homes, that the Constitution no longer protects them, laws no longer protect them, because political attacks can become criminal attacks, can destroy your life, like they've destroyed his, well, he's going to be president again, so not too much destruction.
But they tried and failed, and that needs to be the message.
Spread that message.
It's not just about one man, it's about you, it's about all of our rights, especially if you're a patriot and if you're a conservative.

First reports from the battlefield are always incorrect that we mentioned a few moments ago that the jury has been excused after a second day of deliberations.
Not quite.
The breaking news is that a verdict has been reached in the trial of President Trump, New
York versus the 45th President of the United States.
Apparently the reading of the verdict is moments away, so we shall keep our eye on the ticker.

Okay, I think, who do we have?
We have somebody on line three.
I don't know if it's on this topic.
Who do we have?

We've lost it.

perhaps the most important one that we could tease out from you is what happens now.
There are three, I hate saying this, logical scenarios because there's nothing logical about this court case
where a 12 person decision is not required according to the judge.
Where the prosecution was allowed to speak last?
Where the judge told the defense team to sit down because I don't want to hear your voice again?
Anything can happen in a court of that ilk.
But if things were logical, there would be what?
There would be a guilty finding?
There would be a finding of innocence, not guilty, or there could be some kind of technical issue, a mistrial, a hung jury, or in the other instance, what Alan Dershowitz summarized for us, a strange scenario whereby if one juror said something that was displeasing to the judge, who clearly is working for the prosecution, for the Biden administration, whose daughter has Netted 93 million dollars for the Democrats off this trial as an advisor, as a strategist, as a fundraiser for the party that is in power in the White House.
Then he could just say, OK, I've got alternates and I'm going to replace you.
My decision is that you have not kept your oath as a juror.
And as such, I'm using that as a pretext to what?
Not to venue shop, not to judge shop.
But to juror shop until I have 12 people who concur with me and agree that President Trump committed a crime.
I can't tell you what it is.
And let's not talk about the statute of limitations expiring three years ago and the fact that this is a federal election and I have no writ as an acting judge in the state of New York.
But those things are all irrelevant, just as they were in the E. Jean Carroll case.
A case that could only have been brought, how?
By the statute of limitations being temporarily extended so they could go after President Trump.
Don't listen to me.
Listen to the governor of New York, Kathy Hochul, who said what?
She said to all those people saying, well, we've got businesses in New York, and what if you come after us like you came after President Trump?
And that's when they said the quiet part out loud.
This isn't indicative of how stupid they are.
They're wicked.
They're evil.
They hate America.
And they hate President Trump and all patriots.
But they're stupid as well.
Why?
Because she said it out loud.
If you're a businessman in New York, no, nothing to worry about.
This case about filing of expenses, this is just about one man.
It's about Donald Trump.

The legal system is perverted, is stretched, is bent for one purpose, and one purpose alone, to go after President Trump.

The guy that Fannie Willis is having sex with while they're both married, who's taking her on expensive holidays every month, and then being reimbursed in cash, quote-unquote.

He says, no one will be able to survive.

So I'm not very optimistic.
You mean the judge wouldn't allow them to bring that decision?

What are we feeling in our guts?

I'm thinking, again, Jeff's claim makes sense that, again, given that the fact that there's 34 charges, it's likely it could be a hung jury on most of them, but all they really need is one.
It could be anywhere from like three to five guilties and the rest hung, I think.

Last week, outside the court, with a 30-page document the president's defense team had provided to me from the federal court system, the SDNY, Southern District of New York, listing all the crimes of the alleged star witness, Michael Cohen, a document the president's team wanted to submit in evidence, but which was suppressed by Judge Merchan.
Why?
Well, I think we know why.
Judge Machan is back, seated in the court.
A verdict has been reached.
We are waiting for that verdict to be read by the foreman, by the officers of the court, until we know what it is.
We have to analyze what we've witnessed for the last five weeks.
None better to discuss than our good friend, Victoria Townsend.
Welcome back to America First.
Hi, Jeb.
So, let's just look at it logically for a moment.
What are the scenarios?
What are the options?
We have 34 counts, unbelievably.
They can each be innocent.
They can be found guilty or not guilty.
And then there's the question of a hung jury, a mistrial.
What are the various permutations that are possible before we actually hear what the final decision is?
Well, it's not a hung jury, because they're back.
And if it were a hung jury, they would be putting a note in saying, hey, judge, we can't reach a decision.
And he would have to give them an Allen charge and all of that.
That brouhaha has not been gone through.
So it's either guilty or not guilty.
And it's got to be on all counts.
Because let me explain something, because I keep hearing people say, well, maybe he's guilty on some and not on others.
No, no, no.
What Bragg did was take one alleged crime, And make it into 34 different crimes every time some piece of paper was signed.
It's the equivalent of, say, somebody goes in and robs Saks Fifth Avenue of $10,000 worth of goods.
And so the prosecutor charges that person with stealing shoes.
That's one count.
Stealing a scarf.
That's the second count.
And so that's what Bragg did.
It's unethical.
It's called overcharging.
Prosecutors are not supposed to do that.
But what else is new in this case, really?
So the jurors are going to find him either innocent or guilty.
Breaking news.
Breaking news.
Count two.
Count one.
Count three.
Guilty.
I'm watching the TV screen right now.
They're counting off the counts.
We are count four.
Guilty.
I'm going to read these.
All 34 will be guilty based upon that.
Count five.
Guilty.
So what does this mean?
Count six guilty.
Is this man who has secret service protection, is he going to be taken into central booking?
Will he be handcuffed right now?
What can we expect, Victoria Tunsing?
Well, you've got a nut for a judge.
So you've got to tell me.
I don't know what this judge is going to do.
He shouldn't be under any of the process in New York City.
I mean, people who are assaulting cops walk free on bond.
So that's what should happen.
And I have no idea.
This judge, I can't believe he was so audacious as to put in a jury instruction that you didn't have to reach unanimity.
That's so unconstitutional on its face, but he can get by with anything.
Look.
So we've never been here in the history of America.
We've never been here, have we?
No, we haven't.
Never.
And Gerald Ford saved us from it with Nixon with the pardon.
And so here we are.
And there's a little difference between a burglary in Watergate and lying about it.
And some trumped up charge, so to speak, of a dead misdemeanor being made enlarged to a felony by who knows what, you know, I don't know.
And here's another thing, Seb.
As I understand it, the jury form didn't require the jurors to put down what that other crime was.
Count 18.
So how can they even evaluate it?
Count 19.
I'm just listing.
I'm seeing it live as we speak.
Unbelievable.
This is history in the making as we speak.
There is now the question what happens to the service, part of the Department of Homeland Security, the secret service that is mandated to protect presidents, former presidents and their families, that has the express mission to make sure that they are not in danger.
How can they do that if this individual is put in holding?
If this individual has to go to some kind of jail, either in New York City itself or part of the state system.
Wow.
All right, can we just hear some feed?
Can we hear some feed live?
Is that possible?
Okay, go ahead.
Stand by, Victoria.
The decisions on objections, whether it was a decision not to let in certain witnesses that the defense wanted to call.
All of the above.
The verdict is a necessary and probable consequence of everything that happens up to that point.
That includes jury selection.
It includes evidentiary rulings.
I was in the courtroom or the overflow room four different days.
Shannon, it wasn't just the result of Judge Mershawn's rulings.
The tone of his voice was different depending on which side was doing the objecting.
So, you know, look, I said a week ago, juries usually get it right based on the information they're given.
When you don't get to hear from an FEC expert, when you hear both proximity and propensity evidence against the defendant, and by that I mean he was close to two people who were guilty, therefore he must be guilty, and you hear salacious details with Stormy Daniels.
I mean, I...
I didn't ever think it was going to be an acquittal.
Having been in the courtroom, I thought it might be a hung jury, 10 to 2, 11 to 1.
But verdict is only the result of what you're given up until that point.
So this is not a surprising result to me.
Okay, so, Judge, I want to bring you in here.
Obviously, an appeal takes time.
It could be months.
It could be years.
Like Andy said, it may be a long time before that is resolved, however it is resolved.
But what that leaves is this White House, the Biden-Harris campaign, free now to call President Trump a convicted felon.
I got to say, though, over a year ago, when President Trump was asked, will you drop out of this race if convicted or not convicted, if indicted, he said, no, because I actually think it will help me in my poll numbers.
They've done well in fundraising.
He's done well in polling.
Let's talk about what happens now in terms of that question of appeal, Victoria.
Is there any precedent for accelerated appeal?
Is there any role for the Supreme Court given that this is a state jurisdiction?
Or is this something that can just be stretched out beyond November?
I think it's going to have to go through the regular New York process.
I can't imagine Don Roberts, the Chief Justice of our Supreme Court, does not like to get into tawdry politics, as he sort of seems to view it.
So I can't imagine the Supreme Court stepping in.
So it's going to have to go through the regular process.
Which could take how long?
Is there any realistic expectation?
Months and months.
And Sam, I have no faith in the judicial system at all in New York.
The appellate court said it was just fine that Judge Marchand had a gag order on Donald Trump and not on anybody else.
They refused to overrule that.
So why would you have any confidence in this system?
I don't.
That's a very good question because you yourself and your husband Joe DiGenoa has been targeted by the Department of Justice to the tune of at least half a million dollars.
You, Rudy Giuliani, we can mention my colleagues in the White House, Peter Navarro, we can mention Steve Bannon, on and on and on.
This is a dark time we are living in.
As the President said in that corridor every single day, this isn't about him.
This is about all Americans.
This is about 300 million Americans and about whether or not Lady Justice still wears a blindfold in America.

Victoria, I apologize in advance for asking layman's questions, but President Trump was called back in court, the judge sat down, the guilty verdicts were read out for all 34 counts, and then we just heard him live walk out of the courtroom and give a press conference.
How did that happen?
I don't know.

Are you talking about the... No, I mean, maybe I'm just going off, you know, TV procedurals, but if you're found guilty and the verdict has been read, are you just allowed to walk out free out of the court?
Are we waiting for the sentencing?
What's going on here?
I know this is not a standard case, but is it strange for the defendant after he's been... Standard court.
Is it strange for the defendant to walk out just after being found guilty by the jury and then to be speaking?
Well, evidently said, maybe that's a sign that they're not going to lock him up.
Well, that's what I'm asking.
Here's what I always did as a prosecutor is I would stand up after a guilty verdict and say, I would like Bond issued, Your Honor, or I'd like him reprimanded.
I think it would really be a problem if they tried to lock him up.
I just can't imagine that.

They've been connected to some kind of felony, perversion of the election, even though the Federal Elections Commission said there was no crime.
Do you have any idea, based upon what you've seen in the last five months, what kind of penalty, what kind of prison time, what kind of fines we could be talking about?
No, I have no idea.
But I'll just say, Seb, just look at this.
How can it possibly be that an entry made in 2017 affected An election that occurred in 2016.
I mean, right there on its face, that shouldn't have gotten out the door, the prosecutor's office, and it shouldn't have gotten into the door of any judge, any decent judge's chambers.
It should be on its face, it's ridiculous.
How do you affect an election that has already gone by?
Yeah, this is a detail of the case that is missed by so many, that the bookkeeping, the entry, the categorization of that payment happened after the election, in the January after the election.
So how can you Pervert the course of an election with an act that occurred after the election.
It beggars belief.
It makes no sense.
And I think most Americans will see through it.

Will this go to the Supreme Court?
I said not before the election and she said not even in an emergency motion like Gore versus Bush.
My understanding is that the Supreme Court has to be the last instance.
You have to go through the appeals process of the state of the jurisdiction when all of that has been gone through and you're not satisfied.
Then you can go to the Supreme Court.
Can you talk to this from your perspective as a legal professional?
Sure.
Well, Bush versus Gore was a federal case.
I mean, it wasn't a state case.
So it started out on the federal level as a federal issue.
And the urgency that arose was that a new president had to be sworn in within weeks of the decision.
I said, Justice Scalia Tonino, who was a good friend, I said, you all decided Bush versus Gore just to put us all out of our misery, didn't you?
And he said, yes.
Because any way you played it out, whether it went to Congress or whether it went back to the Florida legislature, Bush was going to win.
And so the Supreme Court, they just acted on it to stop all that stuff.
That's what happened.
And this case isn't like this.
This is a state case, so it's going to have to go through New York procedures.
But as you said previously, given what we've witnessed in New York of late, we should have zero faith or as much faith in the appellate court in New York as we should have of this acting judge, Juana Merchan, in the first instance?
That's how I feel about it.
The only way that I see it going to the Supreme Court is if The New York courts deny any appeal as they keep affirming.
And it may go to the Supreme Court on the issue of the jury instructions.
I mean, the Supreme Court just decided a case in 2020 applying a unanimous jury to the states because Oregon and Louisiana did not have unanimous juries.
And they had great language in there.
They quoted Blackstone from the 18th century saying, No person should ever be convicted of a crime, or of any allegation, any allegation, it said, any accusation, was the words, unless by a unanimous jury of his peers, of his equals, is the words Blackstone used.
But I mean, what a quote!
And how does that apply here?
Because there had to be no unanimity for the important crime That made this dead misdemeanor come alive as a felony.
And so it is possible that they could even refuse an appeal in New York?
They could affirm.
They'll take the appeal, but they would affirm the conviction and ignore these constitutional issues.
I mean, just starting with Bragg targeting Trump.
And then charging a case that was overcharged, as I talked about earlier.
And then the judge not recusing himself, putting a gag order on Trump and no one else, allowing Stormy Daniels to talk about sex, but not allow the FEC experts to talk about election law, but allowing Michael Cohen to opine on election law.
I mean, all these things.
There's just so many issues.
It's a feast!
If I wrote a law school exam for this, you know, I'd flunk anybody that didn't find 15 constitutional and reversible errors.

So is this what you expected?
I thought I was going to split the parson's egg, do the Gordian Knot thing, and they do this kind of mealy mouth.
Well, he's guilty of three things and then the rest not.
But 34 counts, Joe, this is insanity.
Well, I predicted this, Seb.
I said he was going to be found guilty.
And the reason is very simple.
The process by which this case came to the fore.
is really horrendous.
Once you saw the indictment and the way the charges were made, and once you saw the way the judge conducted the trial, didn't allow evidence for the defense in, and once you saw the way he allowed closing arguments to be done and the jury instructions, which were basically a directed verdict of guilty, this was going to be the result.
And shame on the state of New York, shame on the New York judicial system, and the American people should rise up in anger And elect Donald Trump president on November 5th.
Will you explain what it was about those instructions from Juan Merchan, who illegally gave a donation to the Biden campaign?
What was it that made this a directed verdict of guilty?
Could you explain for our listeners?
No, no, no.
They didn't have to be unanimous.
That was it.
It didn't have to be unanimous.
They could decide which crime was the extra crime that made a misdemeanor felony.
And even Trump did not know what those crimes were until after the prosecution made its argument.
So, Joe, is it that aspect of the smorgasbord, the buffet of you can decide these are guilty and then I'll call it unanimous?
Was that the most crippling aspect of this?
Well, I don't think there's any doubt that that was, in fact, the single most crippling thing.
In addition, what we can't forget is that he did not allow them to introduce evidence
that would have helped the jury understand.
He didn't allow them, for example, to know that nondisclosure agreements are not illegal.
Okay, hang on, hold on, hold on, hold on, hold on.

President Trump has left the courtroom in his secret service detail.
President Trump is a free man.
He is returning back to his abode.
So, for those of you out there who wanted to know what has happened to him, he is in his security service entourage in his motorcade as we speak.
Sorry, Joe, carry on.
No, but I mean, one of the things that's important is that it was the cumulative effect of all of the actions of the judge in this case, from the charging document, to the way he conducted the trial, to the limitations on the evidence that the defense was allowed, to the limitations on closing argument, and then the jury instructions themselves, which were designed purposely to make the jury feel that they had to convict The president.
And there's no doubt when you look at these, it's very difficult to explain this to people who have never read jury instructions before.
But these jury instructions were tantamount to a directed verdict of guilty.
They violated the president's Fifth Amendment right, his Sixth Amendment right.
And I have no doubt that on appeal, assuming there is some sanity left in the New York judicial system, this case will be reversed.
But it will be too late.
It will be after the election.
The Democrats have accomplished what they wanted to do, which was to label him a convicted criminal.
And that is what I think will anger the American people, knowing that that was the purpose of this.
Not the doing of justice, but the destruction of a human being.
We do have Antoinette still on the line.
We'll squeeze her in before this hour is up.
But I wanted to talk about, we've got a minute in this segment, Victoria, this idea that if you want it to be the one holdout of the 12, the level of intimidation must have been enormous just to go with the pack, no?
Yeah, people say you only need one, and Joe and I always say, no, you need two.
Two people that need to prop each other up.
But, you know, Seb, I say this from experience.
When we worked on the 2020 post-election with Rudy, there was intimidation all over the place against the lawyers who did anything for Trump.
We were met with bar complaints.
We were met with anything.
Young lawyers would want to work for us, and then they'd call back and say, I'm sorry, I've seen your partner said, I can't do it.
So this intimidation, permeates our country.
It's not just Donald Trump as he says, I'm here for you.
So I can imagine jurors would be afraid.
All right, I'm going to ask you one question.
I never do this.
I never give a warning in advance to my subjects about what I'm going to ask you, not even President Trump.
But it's one of those days.
I'm going to break the rules.

This is actually a day of really great sadness.

A complete disappointment in the people of the state of New York, the judicial process in the state of New York.
