He's good with his family and the people he respects and with God.
Well, maybe he shouldn't be.
John Durham had this to say about the people he spoke to in the FBI regarding the years-long quote-unquote investigation of quote-unquote Russian collusion by the Trump campaign and Trump administration.

Well, let me give you some real life views on that.
I have had any number of FBI agents who I've worked with over the years, some of whom are retired, some are still in place, who have come to me and apologized for the manner in which that investigation was undertaken.
I take that seriously.
These are good, hardworking, majority of people in the FBI, decent human beings who swear under their oaths to abide by the law and the like.
I think that exemplifies the concern here.
There were investigative activities undertaken or not undertaken here, which raised real concerns about whether or not the law was followed, the policies in place, the FBI were followed.
Now that's kind of Washington weasel language, but let me translate it into English.
FBI agents involved in covering up the Clinton email investigation, the crimes by Hillary, the destruction of thousands of subpoenaed emails, and the FBI agents who were involved for years in the Mueller probe, etc., in Operation Crossfire Hurricane, to surveil on and investigate President Trump, his campaign, and his administration.

You didn't even interview Comey, the architect!
You didn't even subpoena McCabe or Stroke!
You are part of the cover-up.
You're worse than the criminals because you're helping them escape John Durham.

Investigators had, quote, identified payments to Biden family members from foreign companies while Joe Biden served as vice president and after he left public office.
So actually there was something there.
It was a scandal.
Racketeering, money laundering, wire fraud.
Those are some of the crimes that Biden seemed to have committed.
In addition, of course, to selling out the United States for cash.
So what would happen to them?
Well, Donald Trump had an idea.
Trump wrote that about two weeks ago.
And it turned out those were prescient words.
This morning, Hunter Biden pleaded guilty to pretty much nothing.
Biden pled to two misdemeanor tax evasion charges, then entered a diversion on a federal gun charge.
That's it.
As far as Merrick Garland's Justice Department is concerned, Hunter Biden is done.
There was no pre-dawn raid carried live simultaneously on CNN.
There was no perp walk, no handcuffs, no press conference.
Above all, there was no felony.
Hunter Biden, who broke federal gun laws, can still carry a gun.
It's like it all never happened.
In fact, the Justice Department just baptized Hunter Biden.
A lifetime of sins washed away in an instant.
Yeah, it's incredible.
President Trump predicted it.
Oh, they'll just slap him on the wrist and it'll make raiding my home and arresting me and charging me with crimes that could lead to 400 years in prison look reasonable.

What's your take on what we've heard so far from this individual who's rather quiet, usually, Special Counsel John Durham?
Yeah, you know, it is totally against everything in his career For him to be in front of television cameras in front of a committee.
I mean, this guy is a very serious, sober, and I think totally fair prosecutor.
He spent a career going after bad guys and exposing corruption, which is what he did in his Durham report, in which it is a withering condemnation.
Of the misfeasance, malfeasance, and corruption at the FBI under James Comey.
And, you know, I invite people to read the report, but of course, you know, when you get people in a committee like Adam Schiff, the biggest hoaxer of all time, and a prolific, prodigious liar, you know, questioning Durham, of course there are going to be fireworks, but I think that Durham acquitted himself Pretty nicely and made Schiff look like the fool that he is.
But the fact that after four years he never even interviewed Comey or Stroke or McCabe, it's not really a special counsel's report.
It's a cover-up, isn't it?
Well, I cut him a break because Comey would never have agreed to an interview and then you would have had, you know, a court battle over that.
And besides, you know, Comey's the guy who, you know, under oath in front of Congress said, I don't recall, what, 234 times?
234 times, yeah.
Yeah, I mean, the man suffers from chronic amnesia only at his convenience.
You know, James Comey did more to ruin the good name and reputation of the FBI than anybody in its storied history.

running a protection racket, and their larger crimes are being ignored by the DOJ.
This is the real issue, the larger crimes.
It's not the gun form or the not paying taxes.
It's everything else.
It's the pay for play.

So the idea is still a superb idea and we are going to... I don't know.
Let me keep working with the higher-ups to see if we can build that into our town hall event next year for the election.
But in the meantime, please listen to what that lady just told us a few moments ago.

She's pushing back in a month of pride in perversity, and that's what it is.

Your reaction to what we've seen so far on Capitol Hill today?
Yeah, listen, John Durham put it out there very clearly.
There is a dual system of justice.
The FBI refused to acknowledge or look at the possibility that Hillary Clinton had set up Donald Trump with a fake Russian narrative and they proceeded to investigate Donald Trump and try to prosecute him without any evidence of wrongdoing and with the full knowledge that the U.S.
Intelligence Committee believed that Hillary Clinton had invented the allegation to get rid of her email problems.
There isn't any more clear declaration that a dual system of justice.
He said it flatly.
The two campaigns were treated differently.
You said in the break that something big could happen tomorrow.
Which committee is it concerning and can you tell us what to expect?
Not the one we normally watch for when it comes to scandals, but it will be tomorrow.
The House Ways and Means Committee Chairman Jason Smith of Missouri has scheduled an 8 a.m.
vote tomorrow.
At that vote, they will vote out the whistleblower testimony and accompanying documents that have been provided by an IRS whistleblower named Gary Shapley.
Gary Shapley ran the IRS team that investigated Hunter Biden.
They were looking at tax violations going all the way back to 2013-2014.
And his testimony is going to make three bombshell revelations.
The first is the Justice Department let the statute of limitations on the most serious and largest tax evasion allegations Expire without the IRS knowing.
Secondly, that the FBI kept from the IRS the knowledge that it had emails showing that Hunter Biden admitted in emails and was discussing in emails that he hadn't paid $400,000 of income taxes on, $400,000 of income he got from Burisma.
Yep, the Ukraine company, the one that we were told there was no scandal about.
And then third, that the FBI also didn't tell the IRS that they had a confidential human source saying that this money from Brisma may have been connected to a bribe to Joe Biden.
The IRS had both hands tied behind its back so that it couldn't get the full force of the law against Hunter Biden.
That's what the testimony That they're going to vote out tomorrow is expected to show.

Oh, is that really why you didn't even have the balls to interview Comey, McCabe, or Stroke?
It's like, you are an utter failure.
So I need a sanity check from the feminine side of Salem.
How do you react?
Well, I will tell you that I am with you in the fact that he was definitely, he did not pursue The investigation hard enough.
He was not aggressive enough.
And this is not about serving Trump or serving any Republican.
This is about the basic sense that we need to trust our justice system.
And so I was disappointed in John Durham.
But there were a few interesting moments that I watched today.
We carried some of it live on The Morning Answer this morning.
And one of the things that I think I was probably most shocked to hear is that he had FBI agents coming to him and apologizing for the way they screwed up the investigation.
How he said laws were not followed.
And I said, that's called a crime, Durham.
They were broken and that's a crime and that's why that's where the frustration comes in, right?
But we heard FBI agents are apologizing.
We heard one FBI agent was so upset that he had to leave the room with his lawyer because he was so upset about the information that he was that was held back from him as part of the investigation and That one of these honest whistleblowers, I mean, it shows you what's going on in the FBI.
So that's what we can use this for, right?
Where one woman who says, hey, wait a second, I'm gonna blow the whistle.
This doesn't feel like it's right, says something about how this investigation seems based on nothing and that it's highly political.
And what happens to her?
She gets reassigned.
But before she goes, She leaves a note in the file, and that was how it was even revealed.
So look, I'm so tired of conservatives promising tapes, and I'm tired of conservatives saying we've got the evidence.
I'm tired of all that.
I'm ready for people who are ready to put up or shut up and fight because our country's on the line.
But in the meantime, while we have John Durham sitting there, we might as well learn what we can.
And if this doesn't give you fodder for firing Christopher Wray, I know they're talking about the FBI under James Comey, but he has done nothing to clean this up.
He should be fired.
We need to figure out ways that we can prevent funding to the highest levels of the FBI.
We need to start fighting.
And the only way we can right now, Republicans in Congress, we have the House of Representatives, they hold the purse strings.
So that's where our place of power is.
It's the only thing we can do in the moment.
Let's show up.
Yeah, yeah.
Well, we have to make as much as we can out of a bad hand dealt to us.
My issue is I just don't see anyone with the strategy.
I talked to people on the Hill who have a strategy, but they're in junior positions.
They're not, for example, chairman of the various committees.
And I've had it.

As one congressman told me, stop firing a BB gun at the Death Star.

Because you sit in traffic for a long period of time before you can actually get into the stadium on game days.
And so they have this lot, Lot 13, set up.
for this rally, which was peaceful and prayerful.
No arrest.
They had police out there, but the organizers had no problems whatsoever.
You had all kinds of people from all different faiths coming out to support the fact that we should be respected as people who are Catholic or Christian or whoever wants to practice their religion should be respected.
And you had Jack Buscevic, you had Sheriff Villanueva, you had a whole bunch of spiritual leaders.
Bishop Mendez was out there.
And it was incredible to see at least 2,000 people show up to this protest.
That's huge for LA on a Friday night, again, at Dodger Stadium.
Because, you know, our protesting begins and we don't have to sit in traffic.
So the fact that people did that is absolutely amazing.
I did hear the information about the game and a lot of people were showing empty seats.
There were empty seats when the Dodgers chose to acknowledge the Sisters of Perpetual Indulgence.
So the Dodgers knew they stepped in it.
They knew they made a bad mistake.
They knew they handled this incredibly wrong.
So they honored the Sisters way before the game.
I think at 5.30 or 6 o'clock game time wasn't until after 7.
So the stadium was pretty much empty.
Now you did hear like some boos coming from the stadium from the people who were in there, but it was empty at that time.
Every other group that was honored by the Dodgers, they were honored in between innings.
The Dodgers did not do that with the sisters because they knew they stepped in it.
Um, as far as the game attendance goes for a Friday night, they have fireworks.
It's the Giants, which is the Dodgers sworn enemy.
That's our rival.
Aside from the Astros, you would expect a sellout crowd.
They were at 41,000, which is short of a sellout.
Sellouts over 50,000.
So there were fewer people in the crowd.
Was it empty like that for the entire game?
No, but there is a success story to tell here that we got a couple thousand people in Los Angeles to show up on a Friday night to tell the Dodgers that they shouldn't do this again.
And I think I mentioned to you before, Seb, with a sports team, it's really hard to imagine that they're going to feel the hurt like Target or Bud Light because people are really loyal to their sports teams.
But it was important for conservatives and people of faith to send a message.
And they did, and it was loud and clear, and there was news coverage, and the Catholic Church, the Archdiocese in Los
Angeles had masses dedicated through this all throughout the city and all across the country.
The Dodgers heard this message, and I will be surprised if they make the same mistake again.
But they're not going to apologize, are they?
Oh no.
And I don't expect that.
I expect them to walk away from this very quietly.
And now their focus is going to be all on their Christian night, their family night, which is coming up in July.
Really?
And that was the mea culpa, essentially, because they have many of the Dodger players are Catholic or Christian.
Clayton Kershaw.
He's an outspoken Christian.
And he went to the media and said, hey, I've now forced the hand of the Dodgers to expedite this family night, which is about the faith-based community.
So they're going to be welcoming in Christians primarily in July.
I can't remember towards the end of the month.
And so now their attention is going to be on that.
So they're going to back away slowly from this.
I doubt you will ever hear the Sisters of Perpetual Indulgence again at Dodger Stadium.
And we'll see if the fans are going to be forgiving, but the Dodgers were cursed all weekend.

So Friday night, the night of the protest, I don't know.
We don't believe in curses, right?
But it was some bad juju.
You don't want to make God mad.
You don't want to make the big guy mad.

So on Friday they had a brand new kid.

Pitching a no-hitter through seven innings.
They overmanage.

Not since 1910 or something had someone been blown out at home 15 to nothing on Saturday.
And on Sunday, they blew the game.
So they did not have a great weekend after they let the dark one in on Friday.

This story out of Ventura County is incredible.
I had to read it three times today to make sure that it's right.
Very simple to understand, but absolutely insane.
This guy, 29 years old, goes to a house that he used to live in, kills the mother and the daughter living there, an 80-year-old and a 50-year-old, stabs them to death, leaves them behind.
The next morning, he is arrested for the crime.
There's no doubt that he did it.
But he was drunk, doesn't remember doing it.
So that becomes his defense.
And in California, this guy who sat in jail from 2019 on, had his trial and was convicted of involuntary manslaughter, even though he intentionally stabbed these two women.
But in California, apparently, if you were unconscious while you're committing an act, that makes you eligible to get an involuntary manslaughter charge.
Which is what the DA in Ventura County threw at him.
So at his sentencing yesterday, the judge had to let him out of jail on the day she sentenced him for involuntary manslaughter of two people because he had already served enough time under California guidelines for involuntary manslaughter.
Because he came up with the excuse that he was too drunk to remember killing these two individuals.
So apparently this is great news for Hunter Biden.
He can just get super hammered and do whatever he wants in California.
But it'll be a great defense for the president.
I mean, sadly, he doesn't drink any alcohol.
But if he just says, oh, what documents?
I was drunk.
I mean, it'll be the great defense, right?

I think that love him or hate him, and I'm going to go bring this back to Trump, he was kind of outside all of this in a way, and I think that's why he was such a lethal risk.
He wasn't an elite.
He had no relatives in power.
He was the anti-hunter.
So he didn't have friends in high places.
He didn't have any relatives that were in politics, and he was already rich.
So no wonder he was a target for destruction.
He was a threat.
Is that part of it?
Because he's the guy who's not part of the swamp, Chris?
I've shared with you before, and when you've been kind enough to invite me to fill in for you, I've shared with your audience before, and my own audience, that I, in 2015, was convinced beyond a shadow of a doubt that we needed a traditional candidate.
We needed a governor.
We needed a senator.
We needed a doctrinaire conservative.
And I openly, brazenly challenged everybody, including the late, great Rush Limbaugh, they were wrong about people like Ted Cruz, and absolutely wrong about people like Donald Trump.
And it was the greatest mistake of my professional career, Seb.
And I voted for Donald Trump, but I did it grudgingly.
And four years later, and then watching everything that was thrown at him since, I see the error in my ways.
I learned from my audience why they saw in a man something that I didn't.
I was in this hamster wheel of thinking that the only way to go was the Washington way.
Even I, as someone who thought I really valued the Constitution and conservatism, There's professional Washington on our side, too, and I couldn't break myself of it.
Trump broke me of that.
And so now, seven years, eight years later, watching what he's endured, two impeachments, his home raided, his family dragged through the mud, framed for espionage, Russia collusion, and the like, I said to myself, if he's willing to continue to stand through all this and do it again, who the hell am I, Seb, to abandon him?
How can I?
I can't, and so I'm not going to.
And I know it was, you know, your buddies, but it was still Pennsylvania.
That crowded room, let's show it again, yesterday at the Cigar Republic, that crowded room of your listeners, I think everybody there kind of agreed with you and me.
I think so.
I get a fair number of people, maybe there's some in this audience, who just for whatever reason, and I think they're of good will, and I think they voted for Trump twice, but they sincerely worry that, I don't know, the system or whatever is stacked against Trump and that he can't win again, and they've talked themselves into believing that the only way forward is someone else, like a DeSantis.
I think there are people that honestly believe that.
I mean nothing against DeSantis or anyone else in the Republican field.
I just can't, I can't abandon the guy that brought us to the dance.
You know what I mean?
And isn't there something that, you know, we don't have to talk in religious terms, but there's a kind of element of, of cosmic justice after what they did to him, raided his home, now arrested him.
The idea that, you know, he doesn't get a second term.
It just, you know, there's a word for that and that word is wrong.
Yeah.
And then, of course, the Hunter Biden nonsense yesterday.
It's as though they're just provoking and poking us, daring us.
Don't you like the game we've got going here?
We're going to throw your guy in jail for the rest of his life and our side gets to walk scot-free.
It's a taunt almost now.
It feels like all of us are being challenged as Americans.
Do we stand with this man and our system of justice?
Not two-tiered, as you pointed out, but our system of justice.

This is not an espionage case.
He didn't sell to enemies.
He didn't hurt the national security.
This is a documents case.
And the question is, should you bring a documents case, even if it's a strong documents case, and interfere with the election in this way?
I think that's a hard, hard question.
So many important points being made by a man who's not exactly a Trump supporter, not exactly a conservative, Alan Dershowitz, Professor Emeritus of Law from Harvard University, about the case, the federal indictment against the 45th President of the United States.
Does logic matter anymore?
Well, let's break it down.
For the next hour, a very special one-on-one with two of your tip-top favorites.
The one and only Victoria Townsend and Joe DeGeneva on deck.
Welcome, dear friends.

Good to be with you, Sam.
Now, I want to go through the motions of what Dershowitz said, my own layman's analysis of the nigh-on-50-page indictment.
But first, let's start backwards.
Is there any point to being logical and actually dissecting this?
Because this is just a political hit job, isn't it?
Yes, it is.
It's a political document.
That's why there's 31 counts for every document.
This case could have been done with two documents, three documents, and we can get into that later.
But it's a political document, as is Alvin Bragg's case in New York, so what's new?
Jo, your take?
Should we assault this logically and analyze it as legal scholars, or should we just look at this as purely a political attempt to negate the next election?
Well, I think it's the latter.
I don't think there's any doubt that any reasonable Justice Department understanding 250 years of American history would have said, OK, Mr. President, we understand you did the wrong thing.
We had a little fight over the documents.
We think you've broken the law, but we're not going to indict you.
We got the documents back.
None of them were lost.
More importantly, as opposed to Hillary Clinton, none of the documents we sought from you was destroyed.
We got them all back.
We have them now.
And so let's just settle this thing, and you and the National Archives can work out whatever documents you have.
But, you know, this is a reprimand, and the public needs to know that you handled these documents improperly.
That's the way this should have been handled.
But this was designed by Merrick Garland to make sure they could figure out a way to tie up Donald Trump in court along with the New York state charges and help to disqualify him politically, not legally, politically in the minds of the American people.
Can I take you through one logical point?
Yeah, please.
That's why you're here.
Really?
Legal logical point.
They should be synonymous, shouldn't they?
Here's the dilemma that Jack Smith has, and it's a very serious dilemma.
He needs to have the jury find beyond a reasonable doubt that Donald Trump kept documents regarding the national defense that either helped a foreign country or harmed the United States.
How is a jury going to do that unless they read all the document?
And I don't mean read each document, but everything on the page of every document.
Now, there is a law that deals with that.
It's called the Graymail Statute.
Its initials are CIPA, Classified Information Protection Act.
And there's a process.
Joe and I have both done cases with this law.
And here's what it was intended for.
The defendant comes in and wants to blackmail, that's why it's called graymail, wants to blackmail the prosecution and say, oh, well, if I only had this document, which I know is classified, I could show my innocence.
So it's a procedure for getting classified information into a trial.
But what happens when the court works that out, and it all has to go through the court, is that information is either redacted and or summarized.
Well, you can't do that when the document is the very essence of the case.
Right.
Right.
Let's look at the couple of things that were mentioned there by Dershowitz.
So we have, and please tell me if I'm missing anything, we have the statutes that are relevant.
We have the 1978 Congressional Act, Civil Act, concerning presidential records, which is not a criminal statute.
Yet this indictment relies upon the 1917 Espionage Act, and the regulations and the penalties concerning national defense information.
Would you address this statement by Allen that no espionage was involved, so therefore why are we even invoking the Espionage Act?
This is the 45th president.
This isn't, you know, nuclear spies.
This isn't Hansen.
This isn't Aldrich giving classified information to our enemies.
This is a documents case.
Well, I think what Alan is doing, he's trying to make an artistic, political, and legal point all at the same time.
He really wants to say that the judge should instruct the prosecutors that under no circumstances may they use the word espionage in any argument or evidentiary matter before the court.
Because it isn't an espionage case.
It's an illegal retention case involving someone allegedly keeping documents that they're not entitled to keep in an insecure location.
That's not espionage.
It's just part of the generic espionage statute.
And I think if I were the trial judge, I would grant a ruling saying that the government under no circumstances may refer to any evidence in this case or any act in this case as espionage, because then that limits it to being a documents case.
The issue of whether or not the Presidential Records Act subsumes under it the Espionage Act is a complex legal
issue which has never been decided except for one case involving Bill Clinton which
really isn't relevant to this case. So I imagine the judge in the case is going
to have to rule on whether or not the Espionage Act was improperly used by the
government but we're not there yet. Victoria if the Congress had wanted to
regulate presidential records with a criminal statute then isn't
that what they But they didn't.
Seb, you've got it exactly on point.
That's what the legal argument is.
Statutory interpretation.
The Espionage Act was written in 1917.
And Alan Dershowitz, and we all agree, has been saying for a long time that it's invalid, it's unconstitutional because it's so vague.
But put that aside, the Presidential Records Act was passed much later, I think it was 1976.
I think it was 1976. 78. 78. Yeah. And presumably, we always say in statutory construction that
78.
78.
Congress always knows everything.
So presumably, Congress knew that there was an Espionage Act and could have said, except for classified information under the Espionage Act.
Congress did not do that.
They did not carve out any exception for any kind of classified information when it did
the Presidential Records Act.
It's later in time, which is also a really important thing, and it's much more specific.
So by any statutory interpretation, this indictment should go down.
Joe, let me ask you, is that reasonable?
Is that fantasy for the president's team on day one to say, sorry, we want this all to
be dismissed because the 78 Act.
He's a former president, and the Presidential Records Act is a civil act.
We want this to be thrown out.
Is that just a fantasy ploy?
No, it's not.
And I disagree very strongly with Bill Barr and others who say that that argument is irrelevant.
It's not irrelevant.
This legal interpretation of what the Presidential Records Act means is central.
It would be one thing if we were talking about the Secretary of Defense or a Vice President who had these records or a United States Senator like Joe Biden.
That would be clearly—the Presidential Records Act would not be superseding.
But here we have a president who was in possession of these records.
That's the issue.
The issue isn't a generic analysis of whether you can have a so-called espionage indictment superseding the Presidential Records Act.
This is a former president who had possession of records.
The issue of whether or not he legally had possession is determined under the Presidential Records Act, not the Espionage Act.
So I think the judge is going to have before her a very substantial question of law.
And the people that say this is a ludicrous argument I have to say, I'm really disappointed in Bill Barr on this issue.
It's not a ludicrous argument.
This is a very serious subject.
We're talking about a former president being charged, not just a regular civil servant.
The president is Article 2.
He is the person who has declassification authority.
And none of the people who have been previously charged under the Espionage Act ever had that power.
And that's why this is so important, Seb, because... We'll continue in a moment.

If even half of it is true, then he's toast.
I mean, it's a very detailed indictment and it's very, very damning.
And this idea of presenting Trump as a victim here, a victim of a witch hunt, is ridiculous.
Yes, he's been a victim in the past.
Yes, his adversaries have obsessively pursued him with phony claims.
And I've been at his side defending against him when he is a victim.
But this is much different.
He's not a victim here.
He was totally wrong that he had the right to have those documents.
Those documents are among the most sensitive secrets that the country has.
They have to be in the custody of the archivist.
He had no right to maintain them and retain them.
And he kept them in a way at Mar-a-Lago that anyone who really cares about national security, their stomach would churn at it.
I don't understand how a former Attorney General, I presume he went to law school, uses the phrase, he's toast.
Not sure that's a classic legal term.
And also, somebody should introduce Bill Barr to the concept of fact pattern.
If you admit that there has been political targeting for nigh on seven years, Why the hell, excuse my French, would you believe, as he said, even half of this indictment?
Let's continue, let's analyze with our one-on-one guest, Victoria Tunsing.
Your response, I cut you off previously, your response, please continue, and to that cut from Bill.
Let me address Bill Barr for you.
Yeah.
And that, he says, he handled the documents very, he was careless.
You mean like keeping An unsecured server in your basement?
You mean that kind of careless?
Yeah.
Yeah.
I mean, you know, I don't know why Bill's doing that.
I really don't.
The point I wanted to make, Seb, was that here's why it's important for our court to decide whether the PRA, the Presidential Records Act, supersedes the espionage statute, because this situation can be used as a weapon by any incoming president against his or her successor.
Joe, let me ask this question.
Victoria brings up unsecured servers, such as Hillary Clinton's, which weren't just unsecure, but which were transmitting topped and tailed, to use the colloquialism, classified information.
So somebody on her team, Likely Huma Abedin went into multiple skiffs, secure facilities for classified information, removed, illegally removed the communications from those secure facilities and then transmitted them to Hillary Clinton on her unsecured server.
Every single one of those is a felony and we know at least at least of a hundred and twenty documents of secret or top-secret classification that were thus transmitted beyond many many more.
Is this is this a viable Tactic?
Or can this not be brought up?
Can the Trump lawyers say in court, well, look what happened to Mike Pence.
Nothing happened to him.
Look what happened to Joe Biden with secret documents next to his Corvette in the garage.
Look what happened to Hillary Clinton.
Will the prosecution or the judge say, utterly irrelevant, this is a sui generis case, or is this a mode of potential defense?
Theoretically, the judge could rule that what happens to other people is not relevant.
But if you make selective prosecution your defense, if that's going to be the essence of your defense, that you are being treated differently than anybody else, that you were purposely targeted just to prosecute you when others were let go, like Hillary Clinton, like James Comey, Like Peter Strzok, like all the people involved in trying to go after Donald Trump, and you could argue that he was conspired against from the time he was a candidate and make that the entire defense.
I believe you could argue that.
And you could argue that it would be the reason that the jury should not find him guilty, because this was part of a process.
Even the investigation, you could argue, was part of a process, the way it was conducted.
And you would use his evidence.
After they searched Mar-a-Lago, Look what the FBI did.
They took documents that they found in boxes, and they laid them out on the floor, took photographs, and then made it look like that's the way they found them when they came to Mar-a-Lago.
That is an example of the prejudice by which the investigation was conducted, and they leaked that information, which, by the way, was a violation of law.
So I think that ordinarily this defense would not be relevant, but I think in this case it is, and I would make it the core my defense. Do you... I would disagree with Joe, which I
rarely do. What? Hang on, hang on, let me write this date down in my diary. Tunsing, Councilor Tunsing disagrees
with Geneva. Carry on.
No, I think the much better argument is not only how do you get to the process of classified
information, which I outlined earlier, but also the PRA supersedes the Espionage Act.
I agree with all of that.
I think you should do all of that.
Here's my question as a layman, and to use an Italian analogy.
What is the the way that is usually done or what is most efficacious do you do you throw the whole bowl of spaghetti on the wall i mean do you do you do you mention espionage versus presidential records act do you mention uh the other cases and selective prosecution or do you is is it wise for a defense team to pick one defense policy and then stick on that
You're entitled to present as many defenses as you want.
You don't have to have one defense.
And in fact, in this case, with a jury that's likely to be at least fair in Florida, as opposed to a DC jury, the more defenses the merrier, as far as I'm concerned.
because you don't know what the judge is going to do to limit your defenses.
The judge may say, no, you can't argue, Mr. President, that you were singled out.
This isn't selective prosecution, because at least you've preserved the issue for appeal in case you are convicted.
Right.
The PRA issue over the Espionage Act is actually an issue for the judge.
No jury can decide that.
The jury has to decide, factually, whether the documents fit the definition of national security, hurt or harm, you know, the U.S.
or another government.
That is a factual issue, and you can't get around the jury having to see that.
So, 12 jurors tried and true, and no background clearances?
How do you work that out?
And the Washington Post this morning said, oh, not a problem, they can just read it in the jury room.
So the jury's going to decide to convict, or not, a president, and nobody in this country is going to know on what basis?
Well, what about the attorneys?
What about, you know, we're hearing about the need for the president's attorneys to have security clearance, the president can't access the documents.
I mean, doesn't this just put a spoke, you know, gum up the works?
Well, no.
Actually, it's pretty common to have everybody get clearances who are going to be on the defense team, who are going to see the documents that are in question.
That's very standard, and it's not a problem, by the way.
Everybody's making a big deal about this judge's order that was issued saying the president is not allowed to share information with other people after he's looked at it.
Well, of course he isn't.
But that goes for every defendant in every case and every lawyer in a classified information case.
So there's nothing unusual about the order that was issued by this magistrate.
But let me just say one more time, the jury is perfectly capable of finding,
if it is allowed to, that Donald Trump was selectively prosecuted
and find him not guilty because of that.
That is a legitimate defense, if the judge allows it.
The question is, will she allow it in these circumstances?
And in my opinion, along with everything else that Victoria talked about, the PRA, the classification issues, he should argue that to a fairly well.

The president right after his arrest and arraignment in Miami, buying lunch for everybody in that peculiarly named Cuban cafe, the Versailles.
I bring it up because in the background, for those who know him, he was a colleague of mine in the White House, is the president's former butler, Walt Nauta, a man who served with honor in the US Navy, who is now his body man, his bag man, if you will, at Mar-a-Lago.
I have to bring this up because it's such a...
I just feel awful for this man, for Walt, who served the president in the White House and now at Mar-a-Lago, that he's the other target of this indictment, Joe, in Victoria.
Why is this former naval individual, a member of an ethnic minority.
Does he have to be in the indictment to prove conspiracy, so it's not just the president, that the man who moved
the documents is somehow this super spy who has to be locked away for 300 years?
Explain why it's President Trump and Walt Nauta in the indictment.
Because a conspiracy requires two or more people.
And since Walt was the only other person actually involved in the moving of the documents, he is the other person,
and that's the conspiracy.
But let me tell you a story about Walt.
And that is, when his lawyer was representing him and met with Department of Justice lawyers, the lawyers said, hey, we hear you're up for a judgeship.
Boy, it would really be good if your client cooperated.
And he has reported that, and he's a very well-respected lawyer in Washington.
So I think it's also a very serious issue.
But for me, and again, I am the layman here, the idea that that happened, allegedly, that a lawyer who's being investigated as part of this indictment, Absolutely.
Well I think as part of motions to dismiss this case, that should be one of the motions.
That there ought to be sanctions against the government.

Absolutely.
Well, I think as part of motions to dismiss this case, that should be one of the motions,
that there ought to be sanctions against the government.
And one of the sanctions that a judge has available, you know, the judge can limit evidence,
can exclude evidence, can say this witness can't testify.
And then the ultimate sanction is dismissing the indictment against somebody like Walt
And so, yes, that should be done.
It absolutely should be one of the motions, and I expect that it will be.
There should be a hearing about this immediately.
And the lawyer who did it for the Justice Department should be forced to testify.
You mean a separate hearing by the same judge?
Or how would that work?
Well, you file a motion to dismiss.
In the motion to dismiss, you make these allegations about this threat that was made.
And you demand a hearing.
And you demand that the attorney who made the threat be put on the witness stand.
Now, many times, judges will not allow Department of Justice lawyers to be questioned.
They'll say, I'll take an affidavit.
In this case, it's got to be cross-examination, and that lawyer has to take the witness stand.
This is a serious charge, because it's the White House that decides this judgeship.
It's a superior court judgeship.
This is so sleazy.
It's hard to believe that a Department of Justice lawyer would even mouth those words in a meeting with a lawyer for a target in a case.
But it shows you what has happened with Merrick Garland in charge of the department.
The place is out of control.
But also, again, repeatedly, the so-called evidence of Trump Attorney 1 and Trump Attorney 2.
It seems as if this whole indictment of boxes being moved around is based upon privileged communication between the President and his lawyers.
Well, that's certainly part of it.
I mean, they were forced to testify because Judge Beryl Howell, who is the retiring chief judge in D.C., in the D.C.
grand jury, said that there was an exception to the attorney-client privilege called the crime-fraud exception, and that it had been proven that the lawyer was being used to commit a crime, and therefore the lawyer could be forced to testify about his conversations with his client.
I think the judge was wrong in that interpretation of the law and on the factual findings she made.
And remember, the judge in Florida is not bound by this ruling.
The defendants can file a motion to dismiss and suppress all of the statements by the lawyers who were put under oath, and Judge Cannon can rule that those statements by the lawyers are inadmissible.
That is not a binding ruling on the ruling that was made during the grand jury.
We're talking to Joe DiGenova and Victoria Tunsing.
This is a very special one-on-one on the indictment of the 45th President of the United States.
We are broadcasting from the relieffactor.com studios.
The Biden family has at least 20 shell companies that were created for the sole purpose to launder money to at least nine Biden family members.
When you create a bunch of shell companies for the sole purpose of laundering money, that's called racketeering.
And the money laundering, those aren't my words.
Those are the words of at least six big publicly traded banks that filed bank violations to get the Biden family.
They said it sure appears that they're money laundering.
Actually, Chairman Comer, that is not the definition of racketeering, but the fact that the Bidens have 20-plus shell companies to get paid, that's reason enough.
It seems that every day there are new revelations about the corruption of Joe Biden and his family.
I want to ask our friends about timing.
The timing here, let's start with this issue.
The indictment being announced the day that the DOJ allows Chairman Comer and the members of his committee to read the evidence against the incumbent president, a $5 million bribe to the incumbent president.
You've been a U.S.
attorney for the district, Joe.
Victoria, you've worked on Capitol Hill.
There are no accidents in this stinking city, are there?
There are no coincidences, and this was not a coincidence.
This was done purposely to detract from the information about President Biden.
And let's remember something.
Who did this release of information?
The Department of Justice, which is the same Department of Justice which is supposed to be investigating Hunter Biden and Joe Biden and the corruption and the bribery and the Foreign Corrupt Practices Act.
So that will give you some idea of how honest The investigation is by the Department of Justice.
What's going on now at the department is a joke.
Hey, Seb, you were talking about a pattern in practice.
How about this coincidence?
The day that Comer had his first press conference, George Santos was indicted.
the little, you know, who knows him, congressman from New York on the very same day that Comer had his first press
conference about this issue.
Let's talk about timing going forward because a lot of people, you know, conservatives are saying,
oh, don't worry about it. You know, President Trump will be fine because there's no way that this
jury is going to be impaneled and the whole case is going to be heard in the next 18 months.
What is, you, You are the true experts.
What will be the rhythm going forward?
Can the DOJ push through a quick conviction?
Can the President's lawyers say, no, no, no, no, no, slow your roll, slow your roll?
What is the next year hold for us and the President?
Well, the President's team has the right to file motions of all kinds and seek hearings and take testimony.
That's going to take time.
The person who will determine the speed of this trial is not the United States government.
It's not the prosecutor.
It's not Jack Smith.
It's the judge in the case.
She will determine at what point this case is ready for trial.
And my guess is, she's going to be undeterred.
She's not going to worry about the politics of it or the election.
Although, at a certain point, if Donald Trump is the nominee of the Republican Party, which it looks like he very well will be, Then, the scheduling of the trial becomes a fascinating political-slash-legal issue for the court, because he has a right to campaign, he has a right to a fair trial, and while he's campaigning, it seems to me he can't get a fair trial.
And speaking of that, Seb, what about New York with Alvin Bragg?
There's an interesting thing that's happened.
Trump's team has filed a motion to remove that case to federal court, and I think it has a very good chance of being a winning motion, but it was filed over a month ago.
With what argument?
Why would you want it moved from a local court to federal court?
Because he's a federal officer, and then just without going into detail, the state court cannot interpret federal election law.
Well, you want it out of Manhattan.
Supreme Court because the judge in the case is clearly- Well, for obvious reasons, yeah.
The legal argument is he's a federal officer and you can't all, whenever he acts- Well, he's running for federal office.
So here's another question, returning to strategies of defense.
And again, maybe this is just the layman speaking.
Is there not an argument to be made Given that it is Biden's DOJ bringing the case against the leading candidate of the opposition, that we can just say this is election interference.
The whole case is election interference and should be jettisoned for that reason.
There's no doubt that you can make that argument to the jury.
It will not succeed as an argument to dismiss the case if you make that argument to the judge.
But you can make that argument to the jury.
But why?
Why not to the judge?
Because the judge is going to find that if the legal processes were all followed, in other words, there was the proper number of grand jurors, they met, they considered all the evidence that were presented, and did they return this indictment, then the judge cannot use that as a basis to dismiss the case, unless she rules on an omnibus basis that the entire prosecution was ill-founded

I think that's unlikely that she would ever rule that, but that may very well be the argument
that succeeds with a jury in a trial.
But then don't forget there's Fannie Willis out there in Atlanta, Georgia.

What do you expect the timing to be like, Victoria?
Do you think this will go to trial or will be suspended during the election season?
Given your experience, what do you think is going to happen?
Well, I've never experienced this.
I mean, this situation is... None of us have.
Yeah.
Unfortunately, sadly, I would think that it has to be put off.
I think there's so many issues to be worked out.
I can't imagine a court, a federal court, telling a presidential candidate he has to stand trial in the middle of a campaign.
The only reason you want a speedy trial for Donald Trump is to try and get him convicted before the election, which is not a legitimate reason for a speedy trial.
He's entitled to a trial that's fair and just and to an impartial jury.
There is no urgency for this case to be trialed before the election.
Correct.
No urgency at all.
They have fought the deep state.
They were targeted by the Department of Justice to the tune of more than half a million dollars.

Let's posit that, God willing, the President is back in the White House and he is determined to, as he said recently at Bedminster to obliterate the deep state.
Can we fix what we've witnessed outside of the administrative state?
We have a problem with the courts, not just the DOJ.
We have a problem with judges across America.
Is this fixable in your estimation?
Well, the answer is yes, but it's going to require a just a powerful response from the American people at the ballot box in November.
And it's going to require a new attorney general in the Republican administration who is powerful, smart, and a great lawyer.
And we have to redo the Department of Justice at the same time in the FBI and, of course, replace Christopher Wray.
This can be done, but this is going to be the heaviest lifting since the founding of the republic.
And the biggest problem, political problem, is in the U.S.
Senate.
Because even if Republicans take over, there are so many of them that are rhinos, that it's frightening.
Look at the 18 that voted for the big spending bill, and the Mitt Romney, the John Cornyns.
I mean, it was just disgusting.
So, I think the Senate needs a new leader, Mitch McConnell.
It's time to go.
Well, I think President Trump has been explicit on that, that he will not be able to work with Mitch McConnell, and we need a MAGA Senate as much as we have an America First, or the nascent America First House.
