Well, I think it's very sad and I'll be going, as you know, I'll be spending some time in Ohio where he should be and frankly that FEMA should have been there a long time ago and I announced that I was going and all of a sudden FEMA is sending a lot of money now and they weren't going to send anything so I'm honored by that, but I'll be there on Wednesday and I look forward to that.

Those are great people and they were abandoned, but now I think they won't be abandoned any longer.

He just did something quite interesting.
There are 44,000, I'll repeat that again, 44,000 hours of footage that the January 6th committee refused to release from their witch hunt show trial.
Strangely, I guess they weren't interested in uncovering the truth.
And they hid those 44 hours worth of footage.
And Kevin McCarthy...
Well, he's the new speaker.
And he's decided to release it!
And not just put it on some website where you'd have to troll through it yourself for weeks at a time.
He's given it to the team that runs the biggest cable news show every evening.
It's our buddy Tucker Carlson, one of the few good guys left at Fox News.
Has now taken possession, he has confirmed it, of all 44,000 hours of the missing footage.
And he has promised...
That next week they will start to release what they have found.
I don't know how much they will be able to watch in the next seven days, but I'm sure they have some tips about where to look, which corridor to focus on, which event out of the multiple deaths that occurred.
Not just Ashley Babbitt, who was murdered that day, but the others who died under very suspicious circumstances.
Maybe we will finally know why police officers...
We're opening doors to the protesters.
How those MAGA protesters actually died, who died that day.
What really happened to Brian Sicknick on January the 6th, before he died the following day.
And then, perhaps most important of all, when it comes to the truth behind those events, footage, evidence of instigators.

And that's where Lieutenant Michael Byrd, the man who shot and killed Ashley Babbitt, was when he drew his gun and fired through the window, admitting in an interview months later, after his identity was finally unveiled, after six months, he said, no, I couldn't see who it was or what were they doing.
I'd just opened fire.
He couldn't see who it was or what they were doing?
Well, then why did he pull the trigger of that weapon?
What if it were a colleague?
What if it were a child?
What if it were a first responder?
Well, now we may get footage of what he was doing on the other side of that window before he murdered Ashley Barrett.

And I had to laugh because you know what?
You know me a long time and he knows me a long time.
I've been a registered Republican, a proud Republican conservative since I was 18 years of age.

You know I had to be strong and fight.
And then my whole life, which he knew as well.
So it's just, it's funny to me because people try to make excuses even though they know the truth.
And I said, you know what?
I didn't change.
Gavin, you did.
Because he used to stand for, you know, the taxpayers and small businesses and did care, not cash in San Francisco.
Strong, robust programs that stopped handouts, that helped to try to curb drug addiction, et cetera.
But then all of a sudden, he got very taken in by the left side of the party and really pushed to the outer extremes.
Now, let's see, did that work?
Is that a good idea?
Answer, no, it's not.
Look at California.
Disgusting, destroyed, ruined.
San Francisco as well.
You have little kids, Ukrainian refugees in schools in San Francisco.
They said it's terrifying and frightening.
I want to go back to Ukraine.
What does that tell you about what's going on in this country?
There is a dramatic, drastic choice in the America that you want to see, the America you want to be a part of when you wake up in the morning.
And we want the robust, We want Trump economy, we want manufacturing, we want infrastructure, we want jobs, and we want to be respected again on the foreign stage.
None of this nonsense.
What's gone on is a total sham, and it's made America less safe from all of our adversaries that will do us harm.
Look at China, look at North Korea, look at Russia.
Nobody is showing us any respect.
Why?
Because we have a buffoon in the White House, and these people are reckless, they are dangerous, and they put every other country first and America last.
That's why President Trump is putting up with this nonsense and running again to try to save this country.

It'll be great.
Those are great people and they were abandoned, but now I think they won't be abandoned any longer.

I wanted to say about Kevin McCarthy handing all these thousands of, you know, hours of footage of January 6th to Tucker Carlson.
I take issue with that.
Unless he gave it to Tucker Carlson to put together an entire video that he's going to be playing in the Congress, because Nancy Pelosi, what she did was, she had ABC put together a video, and they played it in the Congress, and you had every single media company, the Fox News, you had Newsmax, you had DNN, MSNBC, and the entire country was watching it.
I hope he didn't just give it to Tucker Carlson to only play it on Fox News and then Newsmax is going to play it.
Because if we would be playing it in the Congress, then the entire country would be watching it.
So I hope he's just not trying to get away with, you know, only a certain part of the country and the right... I don't understand your logic.
Congress had their chance under the Democrats.
They hid 44,000 hours worth.
It's now somebody else's turn.
Congress had their opportunity.
Things were hidden.
Now a news organization that's not interested in fake news is going to show us what was hidden.
What's the problem with that, Alex?
No, I want Fox News, just like ABC got a chance to show whatever footage they wanted to show in the Congress, I want Fox News to get a chance to do that.
I want our side to be heard for the entire country.
If Tucker Carlson gets it and he only plays it on Fox News and then you guys are going to play it on Newsmax, only Republicans are going to get to see the truth.
If we have it played in the Congress, like Nancy Pelosi... Yeah, no, I'm not worried about that.

They were all in DC on January 6th to try and make their voices heard, and You know, while their doors are being open, they're being shuffled around and everything, and they're taking pictures.
This edited footage from Raskin and this This bogus J6 non-committee committee has been used to convict them.

Now, as somebody who's written various tomes on various American presidents, from an apolitical perspective, could you just react to the idea of an American president going to another nation in a war zone, albeit like Kiev and Ukraine, at a time when politics is so divisive at home and people are suffering in East Palestine, Ohio.
What are the presidential optics of this like?
I have to say, and you and your listeners would know, Tended to be highly critical this president, but I think he was right to go and I commend him for going I think it is hyperbole to compare it to the most publicized visits of President Kennedy and President Reagan to West Berlin, but And They were outstanding speakers and Mr. Biden is not but but I think
I would defend him on the charge of going there when there are bad things in the United States.
I think it's a scandal that he has not gone to East Palestine, Ohio.
But you can do both, you know.
But on President's Day, is there something a little bit piquant about him going on President's Day?
I thought that was, maybe I'm being naive, but I thought that was more or less of an accent.
I mean, it's just a scheduling thing.
I mean, the fact that he went on President's Day, I wouldn't read a great deal into that.
I mean, it's as good a day as any other to go, and there's no reason that a president can't be out of the country on that day.
I mean, presidents do travel, and part of their mandate is to uphold the American position in the world and defend American national interests in the world.
And I think that I think it was a good thing for President Biden to show solidarity with Ukraine.
And I would hope he'd get bipartisan support for that.
I must say, unlike greatly, unlike the addresses in West Berlin of President Kennedy and President Reagan, I didn't actually hear or understand what he said when he was there.
So I'm just saying the symbolism of his going was there.
I don't think whatever it was he said is going to be remembered like like Ich bin ein Berliner and Mr. Gorbachev tear down this wall.
And of course, Berlin is a much more important city in the world and much more central to the Western world.
than kiev and thank you for calling it kiev this idea that it is kiev is nonsense and my ukrainian uber driver reassured me on that point yesterday oh good and um but and the situations are not exactly comparable But that's not the point.
I mean, Ukraine is a country struggling to make it as a country.
It's a new country.
It hasn't been a very successful country in its 30 years of independence.
It was brutally and completely illegally attacked.
by Russia.
It is, as all the world knows, it's done a very valiant job of defending itself.
And I don't think, and I say this to my friends in the conservative movement in the United States, many friends being commentators and people on television and radio, who, in my opinion, are in danger of seriously deserving themselves if they focus too much on You know, we can't spend money in Ukraine because there are people in need in the United States.
It is a well-settled fact of national policy for every serious country that in order to protect its national interest, it has to deploy some resources outside the country.
argument so far that that money committed to Ukraine has been wasted.
But that doesn't excuse the President for not going to East Palestine.
Which I mean in Ohio, I'm not talking about the Middle East.
Right, right.
You mentioned your newest piece for the New York Sun.
Let's drill down on this point exactly.
There seems to be an inability of some very influential voices on the right To understand why, you know, Russia, you use the phrase, snuffing out Ukrainian independence, is a bad thing.
Is this just a neo-Buchananite, neo-isolationism that's just knee-jerk?
Or do you see something darker in this?
Because for me, the idea that anyone who calls themselves any kind of conservative doesn't understand why Russia invading other countries is a bad thing kind of boggles the mind.
I find it astounding, and I don't know what the basis of it is.
I referred earlier in general, I'm not going to name any names here, but friends of mine who in most respects I agree with politically, and have for years, when we just part company in this issue, and just taking those cases as illustrative, I think part of the reason is they're fed up with the extravagance and stupidity of the Pentagon.
For all the stupefying amounts of money President Trump conferred on the Pentagon to bring American defense right up to scratch, they didn't address vulnerabilities in Taiwan.
We don't have an adequate defense system for the Nimitz-class carriers, which are gigantic ships.
And we are behind the Russians and Chinese and hypersonic missiles.
And when confronted with this, they moronic, in my opinion, it should have been court-martialed years ago, the chairman of the Joint Chiefs of Staff, General Milley, said, it's a Sputnik moment.
You know, we're caught with our pants down.
Well, where have you been for the last 20 years, General?
And what did you do with all that money?
And I think that's part of it.
And part of it is, Understandable, excuse me, weariness about contributing to another war.
I mean, since the Korean War, most of the, except for the first Gulf War, which had the very limited objective of getting Iraq out of Kuwait, all of these American wars have really fundamentally been unsuccessful.
The second Iraq war was, the war in Afghanistan was, Vietnam, of course, was.
And it's an understandable wariness, but the answer to it is, one, don't mix apples and oranges.
No one's talking about deployment of American ground forces, so it's not at all comparable.
Two, it is a clear-cut issue of defending or assisting a country in exact compliance with what was at different times the Truman Doctrine and the Nixon Doctrine.
helping a country defend itself against foreign aggression.
And that's not quite how you could describe Afghanistan or Iraq, for example.
And third, there is a clear principle here.
We in the West won the greatest and most bloodless strategic victory in the history of the world in the Cold War.
Not a shot was fired between NATO and Russia, and the Soviet Union simply disintegrated.
And what Putin is trying to do is replay that, you know, have a second turn at it by taking back Ukraine, which was the biggest part of the Soviet Union that separated from Russia.
And Ukraine now is a solid military power struggling in this heroic moment to flower as a country.
And the Russians are trying to strangle it contrary to their assurances, to a number of assurances they've given in the past, that they would not violate its frontiers.
And we can't allow it.
We'll discuss why that is in the 1995 Budapest Memorandum.

Then when coal died, we moved down to Delaware, to a town called Claymont, Delaware, which was a working class town.
But everybody in town was either Polish or Italian.
I grew up feeling self-conscious.
My name didn't end in an S-K-I or an O.
He sounds really bad there.
He does.

He looks very tired.

I hate to be critical, but he shuffles along in a way that's worrisome.
In this, I speak with compassion.
I mean, we'll all get there.
I sympathize with elderly people.
I'm getting close to being one myself, but it's not what you want in a leader of a country.

He's not in fine fettle, that's for sure.
And by the way, years don't have anything to do with it.
No, look at President Trump.
Mr. Gladstone formed a government at the age of 83.
Palmerston was still Prime Minister in his 80s.
Adenauer was in his late 80s.
I mean, it's just a matter of what condition you're in.
Well, it's the genes.
I mean, I couldn't keep up with President Trump and he's 20 years older than I am.
He's a phenomenon.
He's a human tornado.
That's right, that's right.
And I don't see that he's slowed down at all in the last two years.
Not at all.
And when he's on the campaign trail, it's like he's been plugged into the wall.
Nikki Haley thinks he's slow.
I have a funny feeling in a strange way.
He has actually won the war of attrition with his enemies.
I think the animosity is starting to subside.
His enemies are running out of energy.
Right, right.
He's the last man standing in the arena.

We are back with our regular guest, one of your favorites, Lord Conrad Black, a man who has written a veritable library of books, including works on FDR, on Nixon, on President Trump.
As such, Lord Black, let me ask you, we have the news of just the last day or so that President Carter, age 98 I believe, has been admitted to hospice.
He may not be long for this world as a presidential historian.
How will the historians of the future look to his presidency?
Look, I would always like to be as positive, especially with a man who is now clearly in the extreme December of his days.
And I think on the positive side, he did produce the Camp David Agreement, for which I thought he deserved the Nobel Peace Prize for that.
I'm glad he got the Nobel Prize for Peace eventually, but I thought he deserved it then, in 1978.
But I think he suffered from a form of indecision that compromised his effectiveness as a leader of the country.
He had this tendency to change direction, and we were going to deploy the Neutron weapon in Western Europe, and it was all agreed to, and then he changed his mind.
He was sending a strong naval squadron into the Indian Ocean, and then it turned 180 degrees.
We had an irrational fear of communism, and then after Afghanistan, he had learned a great deal about communism.
These are quotes.
And when the energy crisis came upon us, he spoke of a malaise and appeared Wearing a cardigan on television, advising people to turn the thermostats down.
I think he was a good man and a very intelligent man.
And to the very slight degree I know him, a very interesting man.
And of course, like all politicians, quite a charming person.
But as a leader, I think he was not perceived as a strong leader, and he was not particularly imaginative.
He was studious and diligent, and did his best, and had his moments, and was a good man.
But I'm afraid he will not rank as an outstanding president.
But he had his moments, and he was not to be disparaged as a president.
As a man, I think he had Rightly seen as a good and decent and fine man.
He would barely remember me, but I salute him and wish him well.
Let's go to somebody who was a very different president, and may be again.
That's my former boss, President Trump, who yesterday gave quite a barnstorming interview with our friend John Solomon on his show, and he made some news with a different approach to elections in the future.
This is President Trump on John Solomon's show yesterday.

Mr. President, millions of Americans last week got an email from you saying you're going to take on the Democrats in the early voting, in the harvesting game, and you're going to beat them in 2024.
Tell us a little bit about that strategy, why the change, and what do you think will happen in 2024?
Well, it changed because it's so unfair.
The whole process is, it's a rigged process.
It's a disgusting process.
And what was happening is, you know, they'd go in there with an accumulation of votes, which in many places isn't even legal.
And they would accumulate votes at a level like nobody's ever seen before.
And, you know, if you ever check the ballots, you might like be very disappointed.
As an American, you may be very, very disappointed to see what happens with the ballots, whether or not they're signed, if they need to be signed, where they come from.
So we're going to have to play the game a little bit differently because we're starting off with a deficit and tremendous bad things are happening.
Look, I know that your next question will probably be, like, what do you recommend?
And what I recommend is all paper ballots, one-day voting, voter ID, and no mail-in except for faraway military and people that are really seriously ill.
Yeah.
And we'll have an honest system again.
So, Lord Black, the President's saying, until we fix things, we have to out-game the Democrats and harvest better than they do.
It caused quite a bit of news here in America.
Do you think that's a wise political tactic for the next election?
Absolutely.
Not only wise, but essential.
The Republicans have been fighting with one hand tied behind their backs.
I mean, what went on in the 2020 election is absolutely scandalous.
Now, unfortunately, The former president conducted that operation in an erratic manner.
He warned early on of the dangers of ballot harvesting.
But as is clearly brought out in Molly Hemingway's book about how the election was rigged, and that's the title of the book, Rigged, he didn't have a legal team on the ground ready to fight each change in voting and vote counting rules as they were introduced in the swing states. he didn't have a legal team on the ground ready He sat there in total passivity while it happened, though he warned about it.
And then when it did happen, when the election came, they weren't ready to challenge on the ground immediately, go to court at once.
Instead, we had Rudy Giuliani going around attacking on individual voters' complaints, but not a serious challenge against the integrity of the result for constitutional reasons based on the change of the voting or vote counting rules by either the courts or the executive in several states, the six key swing states in particular, rather than, as the Constitution requires, the state legislatures.
And so, you know, he wasn't ready, but he's ready now.
And I think that this has to be, I mean, logically, Sebastian, whatever anyone thinks of Trump or the election or Biden or anything else, where a change of 50,000 votes in Pennsylvania and any two of Arizona, Georgia, and Nevada would have flipped the election from Biden to Trump, 50,000 votes where there are millions of these unverifiable ballots, the unsolicited ballots sent out,
and no one knows in whose hands they were on their tenuous and tortuous and no one knows in whose hands they were on their tenuous and tortuous trip You know, you don't know who won the election.
I mean, I won't say it was stolen.
I don't know.
But you don't know.
When you mail out 80 million ballots unbidden, then you are just inviting fraud.
The President has spoken.
He has a new game plan.

He won in every region.

It's not the fact that he's driving us into a World War III scenario with China and Russia going into each other's arms, but the fact that he doesn't even see his own people as people.
It took him two, three weeks to send out help.
I mean, it took Donald Trump to tweet one time saying he's coming, and then an hour later he sends FEMA after he announced that he wasn't going to.
These are people that have income, if they have an income, an average of $48,000 a year.
They don't have no money.
So when something like this happens, and him not sending any federal help, that should alert the rest of the world, or the population of the United States, what his agenda truly is, in my eyes.
I think it's disgusting, and I just want to say, again, God bless Donald Trump.
Even if nothing comes of it, at least he got the wheels in motion from the federal government to move their backside.
And I'll hang up and say thank you.

I've spoken to a lot of people.
Actually, a fireman that was in Mike DeWine's press conference standing behind him, I texted him, and he said, it's just been hell on earth up there, and it's not getting any better.

And it's not bad enough to where this man can't send federal help to help them out when they had nothing to do with it.

Project Veritas, if you're not familiar, is the investigative journalism team that was really born thanks to Andrew Breitbart's counsel of the undercover operation James O'Keefe launched against ACORN.
ACORN, which was the community organizing conglomerate that was promoting abortion for minors.
And James O'Keefe went undercover as a, how shall I say this, actor.
As a pimp dressed in a fur coat wearing sunglasses and a very 1970s Huggy Bear outfit with an undercover journalist by his side who was pretending to be I can't remember a 14 or 15 year old prostitute and they filmed the encounter in Acorn where the person said yeah we can we can help you out with your prostitution with abortions you may need and that led of course to the collapse of Acorn.
Since then in the last however many years I think it's been 12 13 years They've had various successes, most recently with the Pfizer undercover videos of the admission that there are things, strange things, experimentation going on inside Pfizer on new vaccines and new viruses.
And then, Seemingly out of the blue, the board has fired James O'Keefe, or rather, James O'Keefe, the founder of Project Veritas, who said, I resigned before they could fire me.
Yesterday, apparently, looks like he's standing inside the offices of Project Veritas.
Despite having been fired or resigned, he filmed a 40 plus minute video Giving his version of events.

Later that same day, that's Thursday, February 2nd, a few days after the 50 million viewed Pfizer videos, I was informed by a different officer of Project Veritas that he would go to the board in a few hours from that moment and have an emergency vote to restructure this company.
Receiving an agenda in my email while I was sitting on an airplane tarmac with the doors closing, The meeting was scheduled for the moment that my plane landed in Nashville.
It became clear to me, in that moment, I would be removed from my position at Project Veritas by the time I landed at my destination.
So, our mission continues on.

Since that video was released, the board of Project Veritas have made their own statement.
Maybe there is another version of events.
Here is a list of things that James O'Keefe has allegedly spent donors' money on.
So this is money That was given to Project Veritas to do undercover investigative journalism.
According to the statement, and I'm reading from the Daily Wire news service, Project Veritas released a statement on why James O'Keefe was removed from company.
The statement highlighted the following, quote, small representative sample of James O'Keefe's alleged spending of donors' money.
So this is just a small example.
$14,000 on a charter flight to meet someone to fix his boat?
James O'Keefe's boat under the guise of meeting with a donor.
So he says he's going to meet a donor.
Spends $14,000 on one plane, on one charter flight.
But in fact, apparently, allegedly, he's meeting somebody who's going to fix his boat.
$60,000 in losses by putting together dance events such as the Project Veritas Experience.
More on that in a second.
Over $150,000 in black car limousines in the last 18 months.
I don't know how many trips is $150,000, Jeff.
That's a lot of trips, isn't it?
I would think so.
More than you're supposed to for a non-profit.

I spoke to a member of Project Veritas' board who said monies were spent on a personal party for a James O'Keefe to do with a family event.
I'm just reporting what I heard.
And hundreds of other acts of personal inurement, which means he's profiting from corporate largesse.
When it comes to this strange thing about spending money on dance events, which isn't exactly Investigative journalism.
I'm reminded of what I witnessed at CPAC a few years ago.

Let's just look at the situation on Capitol Hill.
This was a catastrophic failure of security by the Capitol Police and the police in the District of Columbia who are responsible for the security of the Capitol.
The Capitol Police are responsible for the security of that building.
The Speaker of the House, the sergeant-at-arms in both chambers, and the architect of the Capitol.
I used to run this when I was the Chief Counsel and Staff Director of the Senate Rules Committee.
I had jurisdiction over the Capitol Police and all the security.
The fact that they were unprepared, knowing that there were going to be a half a million people who were going to be asked to march to the Capitol and peaceably demonstrate, shows that they were woefully unprepared.
Now, when you're unprepared and you lose the advantage as a law enforcement organization, the one thing that you do not do You did not become Bull Connor, and you do not start brandishing weapons on people who are unarmed.
This is a big mistake.
It is a catastrophic security failure on Capitol Hill, which never should have occurred.
They were totally unprepared.
That's called Making the News As It's Happening.
That's a throwback to our former studio.
Two years ago, as the events of January 6th were unfolding, we had the perfect guests in studio.
People who understand what was happening, even as it was happening.
And we're back because of the breaking news of January 6 and all that footage that's been released to a certain individual of Fox News.

Do you remember what that day was like?

Because you had just gotten in from hearing the speech.
I'd been right there in front of the Ellipse with the President, listening to the speech, couldn't make it to Congress.
My speech in front of the Supreme Court later that afternoon had been cancelled, although that didn't stop Nancy Pelosi subpoenaing my text messages because I was giving a speech at the Supreme Court.
But let's go back in time because we have to talk about these latest developments.
We have to talk about what's happened in the last two years.
But, Joe, why were you uniquely qualified to talk about security on Capitol Hill as those events were occurring?
Please remind our listeners.
Well, I had been the United States Attorney for the District of Columbia under Ronald Reagan from 1983 to 1988.
How old were you?
I'm going to ask something very rude.
How old were you?
I was 36.
That's crazy.
I was the youngest U.S.
Attorney.
U.S.
Attorney for District of Columbia.
He was great, though.
I believe he was great, but that's so young!
Yeah, but I had also been an assistant U.S.
Attorney in that office years before, and one of my assignments was to monitor the demonstrations in front of the then-Soviet embassy.
And all of those demonstrations over the years had been monitored, controlled with the Metropolitan Police Department, demonstrations on Capitol Hill, tremendous amount of planning, scripting, talking with the Defense Department, the State Department, everybody.
There was no way that you have something like January 6th, and you don't plan that out in every single step of the way, every detail, fine-tuned with the police, the National Guard, and everything, and it didn't happen.
But you were also in that position as U.S.
Attorney.
You were in those meetings back then with the House.
Yes, absolutely.
We conducted those meetings.
We were in charge of making sure that the FBI, that the Metropolitan Police, that everybody coordinated the activities, that we had prosecutors ready to go to do arraignments in court if large numbers of people were going to be arrested.
And so, this was routine.
We've been doing this for 40 years, and then this happens on January 6th, and you look at it, and all you can say as a professional is, these people did absolutely nothing to prepare for this major event.
They were so prepared.
I think it was interesting that Joe has told me that they would say, OK, you're all going to be arrested, and then we're going to go down to the station, and then we're going to let you go.
And everyone agreed, OK, we'll do it that way.
We'll be arrested, and then we'll say goodbye.
So, explain the role of that speaker, the incumbent Speaker of the House, when it comes to securing the Capitol.
Well, the Speaker has control of the Capitol Police.
The Chief of the Capitol Police works for her and the architects of the Capitol.
Pelosi back then.
Absolutely.
The Speaker of the House was in charge of everything.
But in those days, people listened to what the U.S.
Attorney and the FBI and the Capitol Police had to say.
What happened to the Capitol Police as around January 6th was that the Capitol Police Chief, Sund, his name was, S-U-N-D, was not being listened to.
They were writing memos to Pelosi and Schumer, and they weren't getting any response from the Schumer and Pelosi staff.
They didn't care about security.
They wanted an event of some sort to occur.
They wanted something dramatic to occur.
There was incompetence on the part of Pelosi and Schumer and all of their staff.
So really, really very, very remarkable.
So you've said two different things there.
You've said it was deliberate and it was incompetence.
Is it fair to say that it was a combination?
Because we now know that President Trump offered the National Guard when he knew that there are hundreds of thousands, maybe a million people coming to hear his speech, that there may be something untoward.
Therefore, here's the National Guard.
Let's put a, you know, security force in place.
And that offer was rejected by Pelosi.
was rejected by Pelosi and her people because of what they called optics.
They didn't like having troops.
That DC word, optics.
And so the optics that occurred were that since they didn't want to have the National Guard and troops there, they ended up having a phony perimeter.
They used bicycle racks to be the perimeter instead of security fencing and troops and police.
There was no way that any of those demonstrators in the numbers that there were should have ever, ever penetrated the Capitol if it had been properly defended.
And it wasn't.
It was a monumental failure of security planning.
Interestingly enough, though, as soon as January 6th was over, Pelosi had no problem putting up high fences.
Oh, 12 foot fences with razor wire and humvees.
So I guess the optics are great if they're useful to attack the other political party, but not if they make you look bad.
Precisely.
Is that how D.C.
works, Joe?
Tell me.
You've been here long enough.
That's exactly how it works, especially when you have somebody like Pelosi.
who was really a complete political animal with no sense whatsoever for the institution itself.
I know she gets all this praise about she was the greatest speaker in history.
That's nonsense.
I mean, she was a hack.
She will always be a hack.
And it's really fascinating how she's disappeared and gone into the woodwork.
That is so true.
Since the new Congress was sworn in, since the four days it took, the four days, not four months, four days it took to choose a speaker for the Republicans, there was one kind of glowing, vomitous event where Schumer said something like she's the best ever.
And it's like she's just like water for the Wicked Witch of the West.
She's just disappeared.
She's just a member now.
Just a lowly member from San Francisco.
A backbencher.
A backbencher.
where they can't control their streets and they can't protect her house.
Yeah, that's another thing.
San Francisco, do you not know who lives in your neighborhood?
You don't know where the Pelosi's live?
And also, speaking of footage, I've got to ask your take.
Allegedly, there's no Capitol Police presence at the Pelosi's home in San Francisco, but there are cameras that are linked in to the police back here, the Capitol Police, and the Capitol Police, and there's footage!
There's footage of, you know, the man, the pape, breaking in the glass to whatever, 2 a.m., and nobody was watching the feed.
Nobody was watching the feed.
My question about that is, we have a security system at our house.
If somebody was breaking a window, it would go all over the neighborhood.
I don't know why the security system was not on, or do they not have a security system?
It was really a great question left unapproached by any reporter.
Has anything changed in the last two years in terms of your live analysis then on air of what happened on January 6th?
No, everything that's happened since then has confirmed our initial analysis in your studio on that day as it was happening that this was a catastrophic security failure.
All right.
And the significance.
We're going to analyze it in depth.
Don't go anywhere.
This is one-on-one for the whole hour.
But the significance of the decision.
Let's put it this way.
Are you surprised, both of you?
Because I'm a little bit surprised.
I'm going to admit it.
That Kevin McCarthy has already handed over 44,000 hours worth of footage to Fox News.
What took him so long?
I'm not surprised at all because he's decided he had to take the bull by the horn, he really had to, and act like a speaker in charge because he didn't have that aura around him and he's made so many... So this is building the optics of being a speaker?
Absolutely.
And the fact that he didn't say okay we're gonna have our guys look at it but he gave it to a conservative outlet, didn't that surprise you?
That surprised me tremendously that they didn't just give it to the committees and let them do it.
But I'll say this, I think it's brilliant.
I think it was a brilliant stratagem to give it to Fox and to have them, because they can professionally analyze the footage in a week.
That's an awful lot of footage to analyze in a week.
I'm sure they know where to start.
I think that was a brilliant stratagem on McCarthy's part.
And we haven't been a fan of his, but we're beginning to see.
He's not doing too bad, the old Kevin, last few weeks.

All right, we're going to leave Tucker's team to do the heavy lifting over the next few days to sift through the 44,000 hours of footage.
But given that two years has elapsed since January the 6th, given the charade, the farrago, the clown show that was the January 6th committee, that didn't answer any real questions.
What should those people be looking for?
There's obvious questions like, where was Ray Epps?
Who was the tower commander with the bullhorn?
But what other things, if you were guiding those teams of videographers, what would you say? - Let me give you a legal issue, and that is-- That is the issue of entrapment.
Because I was a drug prosecutor when I was an assistant U.S. attorney.
And you always had to be careful that the undercover agent wasn't enticing getting someone to do something that that person wouldn't ordinarily do.
So that's the issue of entrapment.
So in this case, it would be what?
It would be police officers?
How many undercover ATF, FBI, whatever, whoever, or even people being paid by those government agencies?
Assets.
Yes, the assets.
How many of them were present?
And for some reason, the federal judiciary in D.C. hasn't thought that that was a defense.
And so they haven't allowed that discovery.
Well, there was that very strange moment in, I think it was the deputy director of the FBI, female, Yes.
One of the hearings couldn't answer the question whether Ray Epps worked for the for the Feds.
Right.
That's strange.
She acted like she wasn't supposed to answer.
Yes!
As if there was something that she meant to divulge.
But that issue of entrapment I think is so important because if you're seeing people who are working for the government saying, come on in!
Right, right, right.
When a lot of people said, well, they were telling me to come in.
And for example, why people who were enticing others weren't charged would be interesting, because Ray Epps the day before says what on video?
He says, you know, we're going to storm the Capitol.
And then he ends up top 20 FBI most wanted, and then carefully just quietly disappears from that list.
What other things do you think should be scoured for?
Well, the absence of weapons.
One of the things you'll see is you're not going to see any weapons on the part of the demonstrators.
You're not going to see weapons.
Wait a minute.
A Trump flag was described as a weapon in one of the indictments.
Yes.
I think what will be most revealing is the conduct of people in the government, the Capitol Police and the people.
What they did is really most important, what the officers did.
I would be interested to see if there's any other footage around the shooting of Ashley Babbitt.
Yes.
I think probably that entire bit of footage inside the chamber where Lieutenant Byrd was.
Because we haven't seen footage from the other side of the door, but not inside But there's stuff before it, there's stuff after it, and why did those people leave the front of that door where they were?
They all left at the same time, like some sort of order was given.
So all of that sort of stuff around Ashley Babbitt, to me, is something that interests me tremendously.
Because the fact that Byrd was never charged, wasn't even interviewed properly for a homicide, which this clearly was, is very, very important to me.
A man who, by the way, is known for having left his sidearm in a bathroom on Capitol Hill as a Capitol Police officer.
Yeah, he should never have had a weapon.
He never should have been permitted to have a weapon.
I find his presence in that situation to be really disgusting.
And look how differently he was treated than the police officer, a woman, who thought she had, and it was somewhere in the Midwest, but thought she had gotten her laser gun out.
Her taser gun.
Her taser gun out.
actually didn't and shot and killed.
What about the other deaths of that day?
Do you think we could get some footage revelations of the other protesters who, quote unquote, died of natural causes?
And that seems to be fallacious.
I think all of that are the kinds of things to look for.
I know the one beating that took place, took place in a tunnel, where there may not have been... I don't know.
Only on the front of the tunnel.
So far that we know of.
Yeah, we just don't know.
But with 41,000 hours, there's going to be things that people have never even thought of.
And all of a sudden, there are going to be revelations about the conduct of the people who are allegedly providing security.
And what it will show, and it already has shown, is how disorganized the security apparatus was inside the building and outside the building, How unprofessional it was.
How untrained they were.
How different orders were being given at different places by different people.
A remarkable lack of coordination and supervision.
This was not a military operation in any sense of the word.
It was, in fact, Episodic, unplanned security.
And that is the antithesis of good security.
Nothing was set in place ahead of time to prevent this.
And when you watch this, and I remember that day vividly, sitting in your studio, watching it, looking at it, saying, what the hell are they doing?
Where's their plan?
At the very first, we were looking at it, and we couldn't believe it because the people who were entering the Capitol were all staying within the ropes.
Yeah, the cordon.
Some riot.
They're taking selfies sometimes with the officers.
One of the most disgraceful things about the January 6th committee was the fact that they purposely lied about what happened inside the Capitol.
They purposely lied to the American people about the security that was non-existent.
They purposely lied about what the preparations were, and then they purposely refused to let the American people know what wasn't done.
They avoided the most important issue of all in order to get Donald Trump and to smear a bunch of people.
It's really a horrendous abuse of congressional power.

On the side of the U.S. Constitutional Constitution, America First.
It is a day that will live in infamy, but for all the wrong reasons, especially the cover-ups of what occurred on January 6th.
We have our very special in-studio guests, Victoria Tunsing and Joe DeGeneva, who were actually in studio that day, here on America First.
So, before we move on to what has happened since January 2nd, especially to The defendants, what's happened to you two in the last few years.
Let's talk about what could be, because you've been prosecutors, you've been U.S.
attorneys.
What are the possible ramifications, if things come out in this footage that are clearly wrong, have been covered up, are criminal acts, what could the possible civil or criminal consequences be?
Well, I think given the Garland Justice Department and the Wray FBI, very little will happen from the federal government's perspective.
I think they're going to ignore everything, do everything they can to make believe that nothing ill occurred.
From a civil standpoint, it's very difficult to tell until we see the footage and see what happened.
But people, theoretically, will have causes of action for assault and various other things, obviously loss of life, unlawful.
killing and things like that.
We have to find out.
If there's evidence of police brutality.
Yeah, all sorts of things like that.
And so, and it may actually get some Capitol Police officers to come forward and be whistleblowers who have kept silent because of the small nature of the force.
It's a very insular organization, generally historically been very poorly led and poorly trained, and nothing demonstrated that more than January 6th.
Legally, the government has what's called immunity, and for most acts, you can't hold any government official responsible in any civil action, in a Bivens action if they go outside of their area.
But I find it despicable that FBI agents went and arrested these poor souls that were just at the Capitol, just walking.
I mean, people, when you read Julie Kelly's book, you see people who had done nothing, but they were just, some just standing on the Capitol grounds.
Five, six, seven FBI agents with loaded guns coming into their house and arresting them in front of their children, and that will never be addressed, unfortunately.
Unfortunately.
On that matter, what if there were excarpatory evidence, Relating to people who have been convicted.
What if some footage comes up that says, no, that's not what that person did.
This is what they did.
Is there any recourse for these individuals who have already been charged?
Well, yes.
Theoretically, they can file motions for new trial.
They can file writs of habeas corpus.
They can do all sorts of things.
The courts have been relatively unsympathetic to all of these defendants, and I think in a way that's been really pretty For those of us who practice law, it's been pretty depressing to see how unresponsive the federal courts in the District of Columbia have been.
It's been quite an embarrassing performance by the courts here.
Very, very unsympathetic and uninquisitive.
Just not interested in learning what could have gone wrong here.
And the federal judge with the Peter Navarro case, when he was arrested, In contempt of Congress.
For a misdemeanor and put in shackles.
And the federal judge didn't... I mean, any federal judge I used to appear in front of when I was an assistant U.S.
attorney would have chewed my rear end.
Yeah, this point of curiosity, this was made to me by Mayor Giuliani, who said that if I were a judge, this is concerning the allegations of election fraud, he said, if I were a judge in Arizona or Philly or somewhere, I'd just be curious to hear what the evidence is, instead of just abovo, dismissing it, not listening.
I'd just be curious to hear it.
Precisely.
And in fact, that is exactly what's very disturbing.
About what didn't happen here in the federal courts in the District of Columbia during all of these cases.
There appears to be an absolute indifference to the rights of these defendants.
And appalling.
And I don't understand, for the life of me, these people having pre-trial detention this long.
For years.
I find it, and I find it unbelievable That members of the judiciary don't see it the same way.
I'm really appalled at what has occurred to these people.
We'll talk about what has happened in the last two years more specifically in a moment, but thank you for reminding me, Victoria, somebody who's done sterling work, lion's share of the reporting.

Well, in April 2021, there was a knock, a doorbell rang, and Joe answered it.
And there were four FBI agents at the door with... Coming for me to get your autographs, say, hey, how you doing?
Actually, they apologized over and over again.
And they said, we love you all.
We're so sorry to be here.
Really?
But we have the search warrant.
And they don't know.
Let me tell you who I blame.
I blame Merrick Garland, that he had to approve that search warrant.
So, this was coming out of, what, Washington Field Office?
No, it was Southern District of New York.
Southern District of New York.
And they went after Rudy Giuliani.
Yes, of course.
The same day.
And they tried throughout 18 months.
18 months.
And we had to pay legal fees for the whole time.
They came up with nothing.
Oh, ho-hum, nothing to see here.
And what was the accusation levied against you?
There was none.
It was that I had evidence of somebody else committing a crime.
So you hadn't committed a crime, but you were somehow magically hiding somebody else's evidence of a crime?
They said that on her phone and her iPad there was possibly information that related to something that Rudy Giuliani... No, they didn't say Rudy.
They never said.
No, they never did, but that's clearly... They would never tell who.
That's clearly what it was related to.
Hang on, hang on.
I need to stop.
As an immigrant to this nation, I need to have a little lesson in the law.
You had your personal property taken.
You had your house searched under warrant because of evidence of a crime somebody else did, but you don't know who it was and they didn't tell you?
Never told us for 18 months.
But that's obscene!
That's Kafkaesque!
That's Franz Kafka!
You have to know that violated the rules of the Justice Department for lawyers.
Because lawyers are in a special category, correct?
Like doctors.
I had all this privileged information.
On your phone, on your laptop.
From other clients.
It had nothing to do with anything.
Correct.
And now they took it all.
And you had to surrender your personal phone.
Yes.
Right.
But they had secretly accessed all of this information two years before.
And on a covert warrant.
How did you find that out?
They had to tell us when they issued the search warrant for the devices.
They had to reveal that they had had a previous search two years earlier.
Which affected, if I remember well, your remote cloud data.
That's exactly right.
So without your knowledge as attorneys, your confidential data had been accessed by the Fed.
And my criminal representing people in the federal courts.
But here's what's really, really key.
And we never forget this.
I had been talking in 2019.
That was the year they got all the information.
Rudy and I had been talking to people who had evidence of Biden corruption in Ukraine.
Hunter Biden.
They didn't want to root around in your clouds.
They wanted to see what I had, Joe Biden and Hunter Biden, the information that I had.
So let's fast forward.
You're sitting here, free individuals.
What happened to all of this?
So, guess what?
The Republicans take over the House of Representatives.
And within weeks, they end the investigation in New York and say there will be no charges at this time.
And you get a big fat apology and a bunch of roses from the Southern District, right?
Box of chocolates.
No, we didn't even get a letter.
The letter was just sent to us as a copy.
The letter was to the judge, saying we no longer... That's the authoritarian little twist.
That's the little twist of lemon on top, like something in Ceaușescu's Romania.
We're not going to prosecute you at this time.
Yes.
Right?
Yes.
To have that sort of Damocles.
No criminal charges at this time.
And it happened right after the Republicans took the House of Representatives and got subpoena power in the Judiciary Committee.
So I had my phone records and my wife's and my children's phone records.
Verizon surrendered to a subpoena from Nancy Pelosi's January 6th illegitimate committee.
I've never been in this situation before.
I've never had to hire a lawyer except, you know, when I was buying a house or whatever, right?
I had to pay a lawyer in D.C.
to write one letter.
One letter to Verizon and January 6th committee cost me $10,000.
So I can't begin to imagine... Half a million dollars.
Half a million dollars.
We spent a half a million dollars defending our clients' rights in the New York court.
There had to be a special master set up.
We had to go through all of the documents.
We had to invoke privilege for all of our clients.
That cost a half a million dollars.
And as one FBI whistleblower has been quoted as saying, the punishment, the process is the punishment.
Of course.
The process is the punishment.
So it was done purposely.
Of course.
To intimidate.
And they called CNN, by the way, An hour after the FBI left our house, we got a call from CNN wanting to know about the raid of our house from the FBI.
Lucky it wasn't Roger Stone Scenario 6 a.m.
outside your house with the TV van.

Could they be substantial?

I expect that given the format that Tucker Carlson uses, one hour every five nights a week, that they will be able to project Vast amounts of information which the Congress can use.
They can have subpoena power to use it to do things.
They can further expose.
But the key thing, and this is always important, names have to be attached to actions.
It's very important that people know who these people were.
Who were these officers who did this?
Get their names.
This guy Berg, for example.
Who shot and killed Ashley Babbitt.
There are people like him throughout this story whose names have to become public knowledge.
They have to be named.
It's very important.
Victoria, do you have high hopes at least of political consequences for the revelations?
Well, you know, I'm always the optimist.
The glass is always half full.
And then last November occurred, and I got a bit deflated on that, but I will still go back to my optimism.
And a lot of people watch Tucker.
And I think the more this news gets out, the bigger audience he's going to have for it.
So at some point, people will just rebel.
People say, enough is enough.
And we hope it motivates people to get out and vote.
Indeed.
I'm going to go on the record now.
I may shock some of my listeners.
