So you have a very important article that's been resonating across the interwebs about the 2020 election.
We'll get to that in a second.
Also, the latest from NPR.
But first, let's talk about this news.
How hard is it?
When I joined the Trump administration, I had to sell all the stocks and shares I owned because, you know, we didn't want to have any kind of perceived or actual conflict of interest and that's what my wife and I did.
She went to DHS, I went to the White House.
How hard is it?
It must be very difficult for a private citizen like Hunter Biden to do the same because apparently, according to Chinese business records, his LLC still has 10%, they've vaunted 10% in a Chinese company that he should have sold long ago.
Is it just sloppy business record keeping in China?
Or is it a sloppy Hunter Biden?
What's your gut telling you?
Yeah, we've seen this for some time.
And the last time I talked to Hunter Biden's lawyers about this, they said that it was that they had divested and that the Chinese records hadn't caught up.
But this gets to another issue, which I think is very important for the American people to understand.
The Chinese may have chosen not to expunge these records because they want to keep Hunter Biden and his father over a barrel, right?
And this is why families that have as much prominence as the Biden family are always advised, don't get involved with foreign adversaries.
Don't do it.
There's no upside to it.
The Chinese have not changed these records for whatever reason, whether there's been a divestiture or not.
And the American people are left wondering, can I trust the Biden family?
And think about this while you're having that conversation.
Remember that this was the investment firm that did some business with Sinopec.
The Chinese oil company.
Yes.
And who is the Chinese oil company that benefited from a release of the strategic petroleum reserves?
Sinopec.
What a coincidence!
I know it.
It's why and it's exactly why Ron Johnson and Chuck Grassley did the investigation they did because at the end of the day the Chinese have at the very least created the perception that the Biden family is over the barrel and owe them and doing them favors And we'll never be able to get the truth because of the way these relationships were created, because of the lack of transparency.
So, you know, I've been digging into a lot of Hunter Biden's emails.
When you look at Hunter Biden's emails and Sinopec, this Chinese family, he was very excited to cash in on the largest Chinese oil company in the world.
And that's exactly what the Chinese probably wanted.
They wanted to lure him into this so that one day when his dad, if his dad was president, all these questions would linger over the family.
The Chinese have already won.
No matter who owns the stock right now, the Chinese managed to create that doubt in America about their president and their first son.
Classic Sun Tzu.
John, I have to ask your professional opinion.
National Public Radio has launched a disinformation reporting team.
Isn't NPR the same federally funded entity whose head of news reporting said, we're not going to report on Hunter Biden because that's irrelevant during an election?
They did, and they bought into the whole laptop was disinformation.
They ran relentless stories on Donald Trump was hooked to Russia and was a Russian stooge.
If anyone knows about disinformation, it's NPR because they...
I've produced a lot of it in the last six years and I think there are great examples of Lafayette Park that they covered.
Many of the great fall stories of the last six years were prominently showcased on NPR and the idea that they now think they can be arbiters of truth and disinformation, well, it's gotten a lot of chuckles and probably well deserved.
And your reaction, are you surprised?
This is from the Post Millennial, quoting a Pew Research study.
69% of Democrat voting journalists say, quote, every side does not deserve equal coverage in the news.
I mean, then how are you a journalist, John?
Yeah, well listen, it's why only one side of the January 6th day has ever come out, right?
No one's asked the stuff that I've been able to get about the Capitol Police and the failure of securities.
And listen, the single most enduring question of January 6th is how did a $600 million police force, entrusted with protecting one of the most important buildings and institutions in America, get overrun by a bunch of underarmed hooligans who were just Acting terribly bad that day?
That is a very serious question.
And then, what did Nancy Pelosi and her team know in preparation for this?
And we now know they knew almost everything, and they still got overrun because the Democrats made decisions like, don't accept the National Guard, don't put out the riot squads.
Those are the questions.
But the reason most Americans don't know that is because most media institutions subscribe to that sentiment, which is, we're not going to give Donald Trump or Republicans Fair or equal time.
Even if they gave Republicans 10% of the time, it would be a major upgrade to what they've been covering for the last five or six years.
Not surprising.
I'm glad that Americans are beginning to see the true colors of the establishment media.

With regards to Hunter Biden, what should we be looking for in the next 24 hours?
We're really going to dial into exactly what Hunter Biden was doing with Sinopec, what he was hoping to score, how much he saw value from his company's investment in Sinopec.
We're going to put out all the emails that Hunter Biden over six years had in trying to score business money with China's largest oil company, the one that just got a million barrels of oil from the Strategic Petroleum Reserve, when that was supposed to go to Americans to lower our costs.
I think when people see the full nature of the relationship, not the cryptic way it's been referred to, they're going to have a lot more understanding of why the Biden family is over the barrel with China.
And the article that has gone so viral, I'm putting it on my Twitter feed right now, at Seb Gorka, is the, uh, the problems with the 2020 election.
At least one phrase does not fit, the shoe does not fit the foot, and that it was the perfect election.

We have to dissect what really happened On the visit to the Middle East of the current incumbent in the White House, none better to discuss than our good friend, Professor Waleed Farris.
He is the author of numerous seminal works such as Future Jihad, The War of Ideas, and most recently, The Choice, Trump versus Obama-Biden in US foreign policy.
Professor Farris, welcome back to America First.
Thank you so much, Professor, for inviting me today.
All right.
So where do we begin?
Let's start with the question that you proposed to me as we were preparing to come on the show.
It's a year and a half in.
Why is he going now?
Is it because of the crazy cost of oil?
Give us your insight.
Absolutely.
The genesis began with a new administration.
That's the Biden administration coming quickly and rushing to apply The Obama foreign policy, without even trying to change, without even consulting with our allies in the region, not with Israel, not with the Saudis, not with the Arab coalition, and just jumping to the table of negotiations with the Iranian regime.
And this lasted a year and a half, or a year and four months, until they realized they have a problem, which is the Ukraine war.
And you have spoken about it many times.
Russia invaded, worldwide crisis, economic crisis, oil prices skyrocketing, impact on our pump here, and the American public is really not happy.
So that prompted basically the President, President Biden, to say, okay, let me go and try and get some changes in the oil prices.
He started to think, or his team, started to think about speaking to the Iranians.
Iranians elevated, escalated their conditions, not gonna work.
Then he went to Venezuela, did not work.
So the only thing he had to do is to go back to the Middle East, speak with the producers who are the partners, have been the partners of the United States, Remind you, Sebastian, that President Trump was the one who went and gathered that huge summit in 2017.
You were still in the White House, I guess.
Yes.
And got a coalition running, started the Abraham Accord.
Nothing about those two items during the first year and a half.
But now he decided to go to Saudi Arabia and ask for an impact on the price of oil.
So, I have to ask, you know, you weren't in those negotiations or those meetings this week, but we're having such contradictory reports.
The administration says they raised the question of OPEC price drops.
The president said that, yes, we raised the issue of Khashoggi's dismemberment.
And when the Saudis are asked, even the Foreign Minister said, no, no, no, we didn't discuss any of these things.
So who's lying or did they just talk to different people?
Well, already through the media, Both American, but mostly Arab media, which, as you know, I'm very, very close to monitoring every day.
I appear there all the time.
Yes, we have two sounds, two reactions.
One positive and, you know, from the administration officials saying everything was fine.
We raised that issue.
I believe the president said in a few weeks we're going to see the impact here on gas stations, on the one hand.
Oh, and then, of course, he raised the issue of Khachoggi.
But from the Saudi-Emirati-Egyptian-Arab coalition, I don't even mention Israel, it has a different dimension, side, they said, no, this was not mentioned.
Basically, what was mentioned was the fact that he wanted to mend fences.
He said, we don't want Russia and China to come and fill the void.
They told him, of course not, but we have a problem.
And that is the Iran deal.
You are going to be sending, that's the Arabs telling the world, telling President Biden, you're going to be sending billions of dollars.
And by the way, last year we did send money to the Iran regime.
Tehran is buying weapons from China and from Russia and using those weapons against Saudi, the Arabs, and Israel at the end of the day.
So, yes, you have two reactions coming from the region.
Which one you want to believe, up to you.
And we have a senior advisor to Khamenei.
This is from the Jerusalem Post.
I'm reading it right now.
The headline is, Tehran is capable of building a nuclear bomb.
That's a statement coming from the regime.
So we have to try and think with their mind and through their eyes.
What does Tehran think of this White House professor?
Look, many things have happened during and after the Jeddah summit.
One, what you have just mentioned right now, they are escalating.
They feel that an administration which has not decided to go clearly in one or the other direction is a weak administration.
That's the Iranian assessment.
Then, they are inviting President Putin this next week to come down to Tehran and flex muscles.
And three, what many people have not noticed over the past, I would say, 48 hours, I posted a few things on Twitter about it, Iranian leaders, including Hezbollah, are now positioning themselves across from U.S.
positions in eastern Syria and central Iraq.
So Iran is upping the ante.
They are mobilizing.
They are putting pressure on the administration.
And obviously, my friend, as you know, the Iran lobby, those who are close to the Iran deal in Washington, are rushing to the president probably and telling him, see what you have done.
You have not done well.
The Iranians now are far away from signing the Iran deal.
My view is that there will be a political battle here in Washington within the administration.
Talk to us a little bit about that battle back home.
We have this, you know, he's not going to shake hands with the Saudi head of state and he's going to call him out on Khashoggi's murder and then, you know, these things don't go down as planned.
What is the squad element doing?
What are the other parts of the Democrat Well, there's a very large quote-unquote squad which is not just the squad but a huge far-left wing which has been in alliance with the Iranian regime and as you know before that with the Brotherhood.
It's just a quagmire.
And that wing is the one pushing on domestic issues, which I'm not addressing, but it's also pushing on foreign affairs, pushing the administration, pushing the actual bureaucracies, the defense, national security, and the other, you know, normal bureaucrats, to go faster and almost partner with Iran, with Venezuela, with all the far-left network here in Latin America and Central America, They were not happy, actually, that Biden went to Saudi Arabia.
And these were the forces that raised the issue of Khashoggi, thinking that this would be a landmine.
It did not work.
They said also that we have an Iran deal, and the president, by going to the region, by going to Israel first, is going to sink that deal.
And at the end of the day, he came back and This is what I'm talking about.
They're going to have to confront each other and to decide what to do.
Should he change policy in the midst of an election year, or should he maintain the old policy?
Either he loses everything he's achieved in Jeddah, if he did, and Israel, or he's going to clash with the far left in his party.
You mentioned Israel and the fact that he went there first.
What is your prediction?
Things seem to be looking all the more positive for Netanyahu.
Can we expect a change of government imminently?
There are elections to come, and that's possible in a very complex Israeli political system.
Netanyahu has the wind with him at this point in time.
The Israeli public is very sensitive to what Iran is doing.
They are happy with the Abraham Accord, so they don't understand why this administration here at home is not backing Israel and the coalition against Iran.
So if there are elections, predictions are, not by me, but by Israeli experts that Netanyahu may have a chance.
If he comes back on the one hand in Israel and you have all those leaders in Jeddah also pressing President Biden, it's going to be very hard on the White House to choose between Iran or between a majority of our allies and partners in the region.
Do you think that they could?
I mean, I see a desperation amongst the Obama era holdovers to make the JCPOA Iran deal live again.
Do you think it could be delayed?
It could be delayed because now happening inside the administration and you served, like many others who speak but don't know what's going on, People at the DoD, I mean, the people in charge of defense, regardless of all the political problems, and they realize that we're not ready for an Iran deal.
And Iran has been so far deep inside and active.
We saw it on the Ukraine war.
Putin is coming next week.
Iran is buying weapons and selling weapons to Russia.
It's becoming an Axis, as you know.
So in the midst of this, we're going to sign an Iran deal and send money?
That is a problem.
There's one problem with your analysis, Professor.
You're being logical, and the last year and a half from this administration has not been very logical.

Well, you heard from our friend Waleed Faris about the trip to the Middle East.
What does the swamp, what does the quote-unquote elite think about it?
Richard Haass has been the president of the Council on Foreign Relations since 2003.
This is what he thinks of Joe Biden's trip to the Middle East.

And we do have to deal with the Saudis, not simply over oil, but I would say, more importantly, over Iran.
That's coming to a crunch, and it's important that Saudi Arabia and the United States be on the same page, both in terms of what we do vis-a-vis Iran, but also, we don't want Saudi Arabia feeling so adrift from the United States that the idea that they would need their own nuclear arsenal, that that somehow becomes a real option for them.
So again, I understand the critics, but I think the critics are wrong here.
This is grown-up foreign policy.
You gotta sometimes deal with really objectionable people.
The grown-ups are back.
This is really good, and Iran isn't going to get a bomb.
Really, Mr. Haass?
Let's talk to somebody who actually knows of what they speak.
The first ambassador, I do believe, to be confirmed for the Trump administration.
A personal friend of the former president, and I consider him to be a friend myself.

So, are you impressed?
Is this the return of the adults?
Were you blown away by the amazing diplomacy eschewed by Biden this weekend?
Yeah, I was really blown away by how inept it was and how disappointing it was how much of a missed Opportunity it was.
And, you know, I remembered five years ago when President Trump made his trip to the Middle East.
He also went to Jerusalem.
He also went to Saudi Arabia.
We had took a lot of planning, you know, we spent a lot of time orchestrating that trip.
If you compare the two trips, you really see just how bad this one was.
I mean, first of all, on the Israeli side, let's talk about the Israeli side first.
So, you know, President Biden has, you know, excellent He's got a great smile.
And, you know, he used that smile.
And, of course, any president of the United States comes to Israel, they're going to smile a lot, because the Israeli government is going to treat the president of the United States from either party like royalty, because Israel loves America and Israel respects the office of the presidency.
So, he came to Israel.
He smiled a lot.
People smiled at him.
And I guess, you know, those optics were good.
But, you know, here's where he didn't go.
He didn't go to the Western Wall.
And if you remember, in May of 2017, President Trump came to the Western Wall.
He was the first sitting president to do so.
And why is that important?
Because the United States had, you know, up until that point, you know, really humiliated Israel by refusing to recognize that the iconic symbol of its 4,000-year-old connection Can I interrupt you there, because for me it's an iconic image of your friend, my former boss at the Western Wall.
How important was that 10 minutes to Israelis of every political color?
Could you just help explain that, given that you were the President's envoy, the President's representative in Jerusalem?
It was like exhaling after holding your breath for 70 years.
I mean, it was something that the people of Israel have waited for, just that any country, but especially the United States, the most important country, Israel's most important ally, would come and simply extend the basic courtesy of recognizing the centrality I mean, that was enormously important.
And to this day, look, President Trump was, is the only sitting president to ever visit the Western Wall.
But once we did it, right, we proved that it did not engender any violence or any criticism or any—I mean, nobody said a word.
Biden could have come.
You know, we plowed that field.
It was completely safe and peaceful.
Biden could have come, and he refused to come.
What does he do instead?
He takes his beast, you know, his massive car, takes off the Israeli flag, drives to a hospital in the eastern part of Jerusalem, and refuses to allow any Israeli authorities to accompany him.
So what is he doing?
He's stating, symbolically but very stridently, That Israel does not have the rights to all of Jerusalem, that parts of Jerusalem don't belong to Israel.
In essence, that Jerusalem should be a divided capital, which is contrary to what we believe, what we said.
It's also contrary to the Jerusalem Embassy Act, which has been on the books of the United States Code for more than 25 years.
That is, Jerusalem should be undivided.
So that was the first kind of humiliation.
The second thing, Was, if you listen to Yair Lapid, right, he's the acting prime minister of Israel, and he is not a hawk.
By any stretch of the imagination, he's not a hawk.
Center left.
And he gets up and he says in his speech next to President Biden, Mr. President, with all due respect to diplomacy, the only way to stop Iran is with a credible threat of force.
That's what Yair Lapid said.
And he was looking for something From Joe Biden to say, yeah, you know, here are the red lines where if Iran crosses them, you know, we will either engage ourselves or give you, Israel, all that you need to engage.
Something like that.
Didn't get it.
Didn't get it.
Got Biden simply to say, you know, we'll use force as a last resort, which is a platitude of no meaning.
You know, everybody, all civilized countries will use force as a last resort.
Doesn't mean anything.
So Jerusalem on the two issues that mattered on, you know, kind of Jerusalem and the Palestinians and on Iran, Israel came up empty handed.
And it's even worse because not only that, so Biden throws hundreds of millions of dollars at the Palestinians.
He makes that announcement on this trip.
Palestinians make no commitment not to Pay their terrorists so effectively and I think it's important for your listeners to understand this the united states because money is fungible the united states is now funding the payments by the Palestinian Authority to terrorists to incentivize them to kill Jews.
That's what we're doing.
Just be clear about that.
But on top of that, just to make it work, and what do the Palestinians do as soon as Biden leaves?
They shoot four rockets into Israel just to show that they're not satisfied even with that.
So it was the Israel part of the trip really, I think, went very badly.
Clearly made things worse, not better.

Before we get to what it was like working for your friend President Trump, that's the question everybody always asks me.
Talk to us about the ramifications of this visit, the visit to the Kingdom of Saudi Arabia, and then this news that just broke that Senior Advisor to Khamenei in Tehran says, we are capable of building a nuclear bomb.
Doesn't seem as if the trip brought the requisite results, now does it Ambassador?
No.
We talked about Israel.
In terms of Saudi Arabia, I think the results might have been even worse.
They ended up arguing about this stupid fist bump as if that's relevant.
Then the question is, well, did Did Biden really look MBS in the eye and complain about Khashoggi?
And the Saudi Arabian foreign minister says, not really.
Biden says that's not true.
So they don't got their story straight, which means the relationship really isn't that good if they don't have their stories.
Coordinated.
I mean, that's really like the first lesson of diplomacy between on a national meeting like that, you know, and then it looks like the US got a lecture from the Saudis on Abu Ghraib, you know, which, you know, I don't think Biden came for it came there to be lectured.
Nothing, nothing on the price of oil.
We didn't give anything, any assurances on Iran.
So, you know, he walked out of there.
I think the Saudis were disappointed.
I don't think America got anything for it.
And the most important thing, Seb, is that Iran, which is watching this trip very carefully, didn't see anything.
at all on that trip that gives them any concern to alter their path to a bomb.
And right now, you'd have to think that they're going to get one.
Now Biden says we'll never let Iran get a nuclear weapon.
How are those not just empty words?
What is the credibility of the U.S.
after Afghanistan, after Ukraine, after we ran after the Chinese?
You know, where is the credibility of Biden at this juncture to really scare the Iranian regime?
And what I've been saying is at least, look, you know, Biden, you ain't got the The credibility right now, at least, at least give Israel All that they need to mount a credible threat against Iran.
Somebody has to be able to threaten Iran.
Iran has to be afraid of somebody.
They're not afraid of America.
They would be afraid of Israel.
I think the more Israel is supplied with, you know, the latest weapons, radar jammers, bunker busters, refueling equipment.
So, you know, I think that at this point—I hate to say it, because it's not what any of us wanted to turn out.
But right now, I think the path to a nuclear weapon For the Iranians, runs really through Israel, not through the United States.
And that's a shame because this is a bigger issue that should be handled by the strongest nation on earth, not by the Israelis.
They're definitely not afraid of America after what Biden did in Afghanistan.
We only have literally a few seconds left.

It's a fraudulent congressional hearing.
It's an embarrassment to the institution.
But as long as the Democrats run the institution, it will be an embarrassment.
I can't believe you two are saying committee.

Where else but in the Soviet Union does just the government get to put on the case and the person in the dock doesn't get to and of course that was hearsay because she said it as if she had witnessed it but then she says a little bit later that the Secret Service agent told her about it.
You can't have I don't want to waste much more time on her, but there's this... When somebody's reporting something, second or third hand, you don't tell somebody else when you're reporting.
And he reached for the clavicles.
I mean, it's just... Unless you're in a medical school environment.

Well, she was trying to convert herself into a first-person witness when she wasn't.
And the committee was perfectly happy to have her commit that fraud on the American people.
Because you know, with a name like Cassidy Hutchinson, that she was going to be believable.
Unfortunately, she looked pretty dumb, pretty stupid, and pretty uninformed.
I just have one quick observation to make about the Soviet-style group.
They're all so unlikable.
I mean, when you just think about Jamie Raskin, and I've debated him on TV, he doesn't know squat about constitutional law.
Hang on, but this is the person who rails against questioning the results of an election, who did exactly that in 2016.
He was the person in the well of the Congress saying, I protest these election results, this electoral college is flawed.
Do you have a senator?
Oh, well, not yet.
Not yet.
He was asked, do you have a signature of a senator?
It's hard to believe.
But I think what Victoria says is really interesting.
These are people, A, with no sense of humor, but B, they're really vicious.
They don't care about anything but power.
They are debasing the Congress as an institution.
They are making a mockery of the hearing process.
And what they're doing is, they are conducting a trial.
This is not a congressional hearing.
This is a trial.
They are putting a former president on trial without the opportunity to respond.
It's not a hearing.
It doesn't have any legislative purpose.
This is another impeachment hearing.
We'll stop there for a second.
I mean, this is so important that everybody misses.
You can't have an Investigatory Committee of Congress unless it relates to some legislation.
There is no legislation that impinges upon January 6th.
So irrespective of not having Republicans on the committee who are nominated by the minority party, It's an illegitimate committee to begin with.
Well, it's been illegitimate from the beginning because of the manner in which it was quote-unquote put together.
It didn't even follow its own rules.
It didn't have the right number of people on it.
It's a joke.
And the American people have taken it as a joke.
And by the way, all this thing about, oh gosh, are they going to refer it to justice?
Let me tell you, I was referred to the Justice Department for prosecution for perjury in front of Congress by Henry Waxman.
I drafted the Agent's Identity Protection Act and when the Valerie Plame issue came up, I testified she was not covert.
Which she was not.
And Henry Waxman sent my name over to justice to prosecute me.
So that means squat.
You've read my mind.
This is exactly my question.
So on Friday we discussed the little bit of intel I received on Thursday night regarding President Trump's decision to declare his candidacy for 2024.
I think they're going to go for it.
I think there will be criminal referrals, some kind of sedition, conspiracy to obstruct justice or unofficial proceedings.
What do you think?
It doesn't matter.
Forget whether it matters or not.
Do you think they will take that measure?
Oh, yeah.
I have no doubt.
Yes, I do, because they're crazy.
They're crazy.
This is not good lawyering.
This is vicious partisanship.
No legal foundation.
There is no basis for charging the President with any crime whatsoever.
And then what do you expect comes out of DOJ and Merrick Garland when he gets this referral from the crazies like Raskin?
Well, the problem with Merrick Garland is he doesn't appear to be in control of the department.

There are a lot of partisans there who are running the place.
Lisa Monaco, others.
Yes.
And so, if it were a real Justice Department, this would be laughed out by them.
But it's not a real Justice Department.
It's a partisan political operation, and they might very well try to proceed against the President.
But I just don't think that's going to happen.
We've known Merrick Garland for decades.
I'm sorry.
Just like we've known Joe Biden for decades.
We've known Merrick as a judge on the circuit.
Was he as weak as a judge as he is now?

He looks like a cypher.
He's Scott and Biden-ish.

Minimal confidence.
He exudes nothing.
It's like he's out of his element.
Which is not unusual for someone who's been cloistered for 20 years in an appellate court.
So what's your expectation?
If they do send criminal referrals, if he's just a shell at the top of the DOJ, will he be just writing, putting his signature on something that Lisa Monaco writes for him?
He put his signature on a letter about the FBI investigating Paris.
Parents of Virginia.
And remember, if they were to bring such a case, it would be in the District of Columbia, where the jury pool is anti-Republican, 99% Democrat.
They would convict Donald Trump on a whimper.
Is there any – how could they – if President Trump is indicted on some spurious charge, he's the former president of the United States, how could they refuse his attorney's requests to have this case held outside of D.C.? how could they refuse his attorney's requests to have this Because, of course, he'd do.
He'd say, I can't – this is the biased jury pool.
Could they refuse that job?
Well, it's within the discretion of a judge.
But I'll tell you, it's almost impossible for me to believe that any judge on that court, including the Obama judges, would not throw this case out if it were brought by the Justice Department.
Really?
You don't think they're that insane?
You know, I'm holding out one bit of hope.
After what they've done to the January 6th prisoners?
It is very, very difficult to conceive of this case lasting, but it's so sad what has become of the federal judiciary as a result of this that it's an embarrassment.
I'm so embarrassed for the judges in DC, the trial judges.

We could spend the whole rest of the hour talking about the January 6th show trial, the Inquisition, but as you noted, Victoria, the last time we met was on the cusp of the decisions coming from the Supreme Court.
Now they have landed.
Let me ask with your incredible legal, judicial, governmental experience, Have we ever seen a week of decisions as monumental with those three decisions?
We haven't.
Joe and I were sitting on Newsmax every single morning and we'd wait for the decisions to come down and then we would have to read them really fast on the SCOTUS app and then digest them.
We'd hurry and we'd learn to go right to the holding real fast.
It's an understatement to call it consequential.
This court has transformed the analysis of the Constitution, returned it to its original meaning, given life to the Constitution, and so naturally the left is going crazy because something has been restored and had integrity brought back to it, and they can't stand that.
And Nino Scalia is responsible for this?
Yes.
Explain.
Originalism.
It was Nino that got on the court with a philosophy of law.
Right.
Not a kind of, oh, yeah, like... I mean, the thing about these decisions, when the first one was leaked, on Roe and Casey, I read it on a plane, I read it onto video and audio so everybody could hear it.
I'm not a lawyer, but these are remarkable pieces of writing.
Yeah.
I mean, Alito, Clarence's, they're...
They're truly historic.
I mean, the Casey one was a tour d'horizon, a historic overview of Western civilization's attitude to life in the womb, from the quickening, before and after.
There was nothing you couldn't understand.
There was no legal gobbledygook.
It really was a return to common sense for me.
And the interesting thing was to watch the anger of the people on the left, especially the legal anger from lawyers and even some judges who were commenting on it how, quote, the Supreme Court ignored history.
That's one of the most ludicrous statements I've ever heard.
It's the opposite!
The opinion was replete with the history of how life was protected, how abortion was always a crime, how it was something that was just not considered civil.
And just to outline the sin of the Royal Supreme Court, they definitely found a right that was not in the Constitution to be in the Constitution.
Penumbra or otherwise.
That was their first grave fault.
But the second was, they acted as a legislature.
Then let's carve out a scheme.
Hey, how's the first trimester?
We're going to have this rule, second trimester, third trimester.
And totally capricious and arbitrary.
Who decided the trimesters?
There's great doctors on the U.S.
Supreme Court.
Why that trimester?
I said, I didn't know there was an emergency room at the Supreme Court with nine doctors in attendance.
I mean, really, really quick.
Take us back in time, if you recall, back in 73.
I was in law school, yes.
How did such garbage law come out of the Supreme Court?
Because no one had a philosophy.
That's why I'm saying, Nino Scalia... But they had to have... They had to know the law, that this is a bench and not a legislature.
It was basically what feels good.
I find it hard to believe how they did it.
It was the culmination of a type of thinking on the Supreme Court that started under Earl Warren, and it never stopped.
What was that type of thinking?
That the court could do anything it wanted, that it could create out of whole cloth things, and Blackmun just, when you go back and you read Roe v. Wade, you are astonished at how awful it is as jurisprudence, how monumentally bad it was, emanations, Penumbras to find rights in the 14th Amendment.
I mean, you had to have a kind of arrogance to write that opinion and believe that it was the right thing to do.
And really importantly, when Casey came down about 20 years later and reaffirmed Roe v. Wade, It rather ignored Roe v. Wade.
It ignored Roe v. Wade.
It had to because it was so bad.
It said, oh, viability.
Well, and science was changing.
Now we're into viability.
Science was catching up with Roe v. Wade because of sonograms and all that sort of stuff.
And so they said, well, let's see now.
Let's see, this trimester thing, let's go with undue burden on the mother.
After viability.
Well, where's that in the Constitution?
And how is that an objective standard?
It's not.
Based upon whose burden?
And what is due burden?
In the cases they got, a waiting period of five days, a waiting period of ten days.
Do you have to have the father's permission?
Do you have to have parents' consent?
I mean, so many different issues.
The Supreme Court was acting as a legislature with every appeal that came up.
They were writing a new law.
And what Alito did, And the other justices who voted to overturn Roe v. Wade was to make clear that Roe v. Wade was an abomination, it was constitutional chicanery, it never should have been law, and it took almost 50 years to overturn it, but it was the right thing to do.
We are having chaos as a result of it because the left only knows violence and violent rhetoric.
But you know what?
Sometimes in a democracy and a constitutional republic, you need to have upheaval.
Oh, now he's being Thomas Jefferson.
That's right.
So I asked you before we came online, and I'm going to do it in front of our millions of listeners, help me out, because after this decision, there's lots of things, packing the court and so forth, there's Maxine Waters saying literally screw the Supreme Court, which is interesting, I mean if that's... I don't think that's the word she used.
Well, she said, we don't give a damn what the Supreme Court says.
So I'm using editorial license.
But I think that's rather an insurrectionist attitude, if you ask me.
But the current incumbent in the White House said, we are going to respond to this tragedy.
Tragedy, which is weird, because 20 years ago, he said every abortion is a tragedy, and we played the video.
He said, by codifying Roe v. Wade in Congress.
How does that work, Victoria?
Well, I don't think it works because of the Supreme Court.
- Sent it back to the states.
And under the Constitution, if you say it's state authority, it's state authority.
They didn't say Congress can pass a law or the states can decide.
The Supreme Court decision specifically said it's now in the states' hands.
And the phrase was, Alito, again and again, at least five times, maybe more, in that 70-odd pages, used that beautiful phrase.
We're sending it back to the states where the citizens can debate amongst themselves, where their representatives can try and convince each other of the merits or otherwise of abortion, which is exactly why we are a republic.
That is exactly why the Congress cannot pass a law and preempt the states.
Because what they're doing is they're saying, well, we're going to preempt the Supreme Court.
They can't do that.

I want to move on to some other topics, but before we completely leave the arena of the Supreme Court, we can even discuss the Second Amendment decision as well.
How, as people who've been in the arena as former U.S.
Attorney for the District, people as working on the Senate, How concerned are you for the health and the safety of the institution that is the Supreme Court?
I'm very concerned about it and the reason is the President of the United States and the Attorney General of the United States have allowed a situation to get out of hand because they disagree with the ruling, they have allowed violence to reign, they have allowed threats to become common, they have allowed Illegal demonstrations under both federal and state law to occur at the residences of five justices.
It is absolutely disgraceful that there has been no condemnation.
There's been some technical recognition of it, but there should have been immediate condemnation of these demonstrations.
And the fact is, it is only as of yesterday that the Maryland State Police put on its website that from now on anybody who disturbs the peace at the Justice's home and stops and doesn't keep walking will be arrested.
Only now!
There's a Supreme Court case written by Sandra Day O'Connor and ironically it was because people were protesting at the home of an abortion provider and there was a local ordinance that said you can't You know, an abortion doctor, you can all leave them alone.
You can march to the neighborhood, but you can't.
And Sandra Day O'Connor said, this is not a problem.
It's perfectly constitutional.
Nobody has to listen to threats and shouts in their own residence.
So for Maryland and Virginia governors, both of them Republican, to say, oh, my, we're not clear on the law.
There is just no doubt that the justices are in danger.
The physical presence of the court itself, the building is in danger.
And the president and the attorney general, and may I say the FBI director as well, have done nothing about it.
I am embarrassed by those three people.
The president, the attorney general, and the FBI director are a disgrace.
Well, I'm embarrassed as a resident of the Commonwealth by the behavior of the new people.
Putative Republican Governor Glenn Youngkin who says, I am poised to use my state troop assets.
What?
After a successful assassination attempt?
You have control of the state troop as they should be outside the houses of the Virginia domiciled Supreme Court associate justices keeping them safe.
We have an organization We have the organization that is posting bounties for intelligence on the whereabouts of the Supreme Court justices.
$50 for a sighting, $200 if the judge is still there when they get there to do whatever their nefarious plan is.
This is online right now.
That's the physical danger.
We went to Morton's last night just to support them.
Oh good, God bless Mortons, yes, where Justice Kavanaugh was, well, had to be escorted out through the back because of the crazy protesters outside and Mortons stood up to them.
Let's talk about, not the physical danger, let's talk about the The institutional political danger.
How serious is the threat, Victoria, to the institution from concepts such as court packing, given that the Constitution doesn't limit the number of justices?
If I ever wanted a new constitutional amendment, it would be to limit the number.
of Supreme Court justices, or just the Republicans get their act together, if they get control, and pass a law, because it would be really hard to undo it.
But something has to be there, because there's no prohibition on the number of judges.
There's no number set in the Constitution, and indeed it's varied over the years.
Isn't this weird?
Is this an oversight of our founding fathers, that we don't have a limit, Joe?
No, actually, it was part of the process that the courts were there to serve a purpose.
And, you know, it evolved over time when Chief Justice Marshall finally said, you know, we interpret the Constitution, we say what it means, Marbury versus Madison, and this is our role.
It was at that point that the court established this vast power that it had.
I don't think the Founding Fathers Assume that the court was going to become so important, but it did.
It started out as just six members, which is weird because it's like your instinct says to get an odd number.
But they would just come out and talk their opinions because they were riding circuit.
They were going all over the 13 colonies.
And so after Roosevelt tried to pack the court, that's when Congress should have set the number and did not.
That's who messed up.
How serious is the threat?
I don't think that there will be a successful effort to increase the size of the court.
I think that people like Manchin and probably even Sinema would stand for it.
I'm actually more worried about Mitt Romney than I am about most of the Democrats because he's so wacky.
But I think it's not going to succeed.
No, but here's what is succeeding.
And that is the image of the Supreme Court in people's minds because the derision that the Democrats aim at the justices is having its effect.
And now people do not think as highly of the Supreme Court as they did a decade ago.
This is what the Democrats are very good at.
Delegitimize, target, harass, demean, demean.
It's the Alinsky playbook.
It's not angulate, isolate, destroy.
It's there.

You understand how these decisions came about.
It's not because of just some Supreme Court associate justices.
It's because of a groundswell.

A lot of people excitedly are talking about, well, what's good for the goose is good for the gander.
What goes around comes around.
We'll have our committees.
We'll subpoena people.

And I say no!
I say not enough.
For me, when I look, we just did a whole show on Sunday on Newsmax on the Gawker reality check on the border situation and human trafficking.
And I look at – I opened the segments with Mark Morgan, the former commissioner, with these little cuts of Mayorkas, the DHS secretary, saying the Trump administration destroyed the border regime.
We are rebuilding it.
The border is secure.
And I think people like that should be arrested and charged for complicit assistance, aiding and abetting the cartels, for his involvement in the death of the 53 illegals that were literally roasted to death in a tractor trailer just a week ago.
So, am I... Can justice, Joe, be restored and the appearance that Lady Justice is blindfold if we don't have Judicial consequences for what has been done out of government office.
Well, I don't think there's any doubt that Mayorkas and Garland and the President of the United States have failed to faithfully execute the laws of the United States and have committed impeachable offenses.
Obviously, until there's an election in 2024, the Justice Department will remain in the hands of unfriendly forces that will never charge the President or Mayorkas with anything.
They'll applaud them.
"but if we take over the House, "Mayorcas should be impeached." I think it's very important, even if you can't get a conviction in the Senate.
It's worth doing it as a statement.
It doesn't have to be a long process.
The evidence against Majorca for failing to faithfully execute the law is right there.
You could have one week of hearings and get a vote on the floor, and that's all you would need.
It wouldn't be something that would take up a lot of time.
The problem is, if Kevin McCarthy becomes the Speaker, he's very weak.
He's not a leader.
He doesn't like conflict.
He's a classic, bushy type guy.
He has a lot of trouble speaking, by the way.
He can't get a compound sentence out.
As our friend Chris Blount says, it's tough to be speaker if you don't know how to speak.
It's just unbelievable.
But the bottom line is, I think the answer is impeachment.
But let me enforce... Is it enough?
Committees are enough?
Subpoenas are enough?
Well, it's all we have.
As much as we could ever do, I agree with you.
You've taken me over the edge, Seb, but here's my... That's something!
I, little old me, have taken Victoria Tunsing over the edge.
I'll put that on my resume.
But let me give you the example because it's just so clear to me.
The independent counsel law, which meant an independent counsel was triggered at the drop of a hat, was just fine with the Democrats as long as it was being aimed at Republicans.
Not until Bill Clinton got in the White House and that independent counsel law was applied to him did the Democrats say, well, maybe this is not such a good idea.
And it went by the wayside.
And you don't need any better example than that, that the goose and the gander have to be given to each other.
Well, let me ask an independent counsel.
Let me see if I can find one.
Oh yeah, there you are.
We've had this discussion before.
Let's just remind our listeners or those who missed it last time.
I don't like it.
I mean, God bless you.
I mean, you are one of the honorable guys as an independent counsel, as a special prosecutor.
But for me, it's an unguided missile, and often it ends up doing completely different things from what it should be doing.
I think it should be scrapped or fixed.
Having been one, where do you stand, Joe?
It's now, the special counsel is what it's called now, and it's a regulation in the department.
And the Department of Justice can use it to recuse itself from a case when it has a political, personal, or financial conflict of interest.
Or an appearance of, I think.
Or an appearance.
And the Attorney General has all of that now with regard to the President and Mr. Mayorkas.
And Hunter.
And I do think it's better if you have a non-political Justice Department and you leave it alone.
However, we're not there.
Unfortunately, we have a very political Justice Department.
And in fact, it goes beyond just the political appointees.
The career people in the Department have become terribly politicized.
They're almost uniformly Democratic.
There are records on how much they give.
And it's all to the Democratic Party.
When I was in the White House, I came to the conclusion that the Obama administration had done such an amazing job at corrupting government.
But for me, it was the DOJ that was the most corrupt.
Yes, it is.
Not the CIA, not the FBI, the DOJ.
Well, the CIA now, too.
No, but I mean in terms of just being avowedly political.
And being an outreach thug arm of the DNC.
And you know what it used to be?
If the Republicans were in, well there might be a priority on pornography.
And if the Democrats got in, antitrust might come to the top.
It used to be a real vanilla.
Political policy.
This now is... I mean, the Justice Department is aimed at getting political... This is vendetta now.
Yes, this is political revenge.

I mean, what was the crime of having the diary?
Even... Oh, come on, come on.
I mean, just look at Peter... Oh, Peter Navarro.

Leg shackles!
Leg shackles.
For a misdemeanor that had not been decided yet.
See, that's one of the things that the Judiciary Committee and the House should do when the Republicans take over.
There should be hearings on those arrests.

And Christopher Wray should be made to answer, why were those tactics used?

And he's going to say, well, those decisions were made by the people at the lower level.
Good.
Let's get them all in here.
Bring them in.
They're all coming in.
And if you don't present them, we're going to hold you in contempt.
Whoever made that decision to publicly arrest... Well, and I'm sorry, having worked with thousands of FBI agents, the FBI agents that actually, you know, said, jawohl mein Herr, and actually executed that mission, and took the leg shackles to Reagan.
I mean, those people should be hauled in as well.
Absolutely.
Not just the SSA, not just the supervisors.
Absolutely.

So, what happens to special counsels?
Do we keep them?
Do we reform it?
Do we get rid of it?
Just leave it as a regulation for those special moments when you really need it.
The bad thing about the independent counsel statute is that it was triggered at just the slightest little thing, like if somebody just made an accusation.
This is not triggered so easily, so it's not so controversial.
