	For the Obamas, we have Kamala Harris' fortunes are diminishing day by day, and we have the Attorney General of the United States, Merrick Garland, on a surprise secret visit to the Ukraine.
	Why?
	Exactly.
	And more flights under the cover of darkness of illegal immigrants across the nation, thanks to your taxpayer dollars.
	But first, We get information from everywhere.
	What I'm going to play for you right now is a long clip that was said to be my cigar buddies, and it's stunning.
	It's from a graduate of Harvard University called Julia Hartman, and it is perhaps the most succinct summary of how the left won the culture war An analysis of what it's going to take to win.

	Last spring break, I went on a trip with 100 other Harvard undergraduates to Israel.
	It was one of the most extraordinary experiences of my life, and I will always be grateful to Harvard for that.
	I recall the trip with awe and joy, but a certain moment rattled me.
	Our group attended a Shabbat dinner at a Tel Aviv synagogue.
	The rabbi proclaimed, Welcome to Israel!
	You are all here from America, the best country in the world!
	He paused, but not a single person clapped.
	The Israelis stared in disbelief.
	Americans are the freest, most privileged people on earth.
	Yet many of us are ashamed to show any, even the tiniest trace of national pride.
	Why?
	Because we Americans of recent generations have been swaddled in prosperity and security, and in consequence, have become ungrateful for the blessings we enjoy.
	It requires vigorous athletic imagination for most of us to consider the basic brutal realities that much of the world experiences daily.
	Even worse, we have consumed a cultural diet that reduces America to its ugliest moments and dismisses its noble ideals and accomplishments as jingoism.
	This nation saved the world from global catastrophe three times in the 20th century.
	This nation has grown to treat racial, ethnic, and religious minorities with equality and respect compared to other places and times on Earth.
	This is the nation where people are not constrained by their gender, religion, or class, but can work to achieve a better life.
	In this nation, we can criticize our government, securing the knowledge that we will rise the next morning and our country will still respect our rights.
	We view these things to be our birthright, our permanent and guaranteed condition, but they are not.
	They exist only because past generations have sacrificed to secure and maintain them.
	And to our discredit, we have used these blessings not to strengthen our country, but to tear it down.
	We members of this university, and we Americans, have shirked our responsibility as the most privileged cohort on earth.
	We have remained cringingly silent in the face of corrosive ideas, woke culture, that has corrupted our institutions and severed the bonds that hold our country together.
	The New York Times won a Pulitzer Prize for reporting that the sole purpose of the American Revolution was to preserve slavery.
	And we remain silent.
	The Oregon Department of Education asserts that showing your work and finding the right answer in math is white supremacist.
	And we remain silent.
	The American Medical Association has stated that the U.S.
	should remove gender from birth certificates.
	And we remain silent.
	Howard Zinn, the author of the most widely read history text in American public schools, said that America has done, quote, more bad than good.
	And we remain silent.
	A huge percentage of the donations to the National Black Lives Matter organization have been spent on compensation and benefits, including several extravagant real estate purchases and questionable consulting contracts.
	And we remain silent.
	On this campus, we often hear how oppressive America is.
	Just outside of this church, there was a sign for Israeli Apartheid Week of an upside-down, faded American flag with painted bullet holes in it.
	And we remain silent.
	We must not lie to ourselves or to one another by denying that a large reason that we remain silent is that we see personal and professional advantages in doing so.
	We are ashamed to be American.
	The shame should be on us.
	The people who excoriate religion live in a society where their freedoms are based on teachings in the Bible.
	Many who say that the nuclear family is antiquated grew up in two-parent households.
	Those who condemn the police as oppressive still summon them when they are in danger.
	And too many use their right to free speech to advocate suspending it for all who disagree with them.
	What a litany of dishonesty.
	We are using our privilege to undermine the very system that has given us that privilege.
	America, despite its failings, is the last great stand on Earth.
	We must speak up against this now, or our civilization will face a somber reckoning.
	As President Reagan said, If not us, who?
	If not now, when?
	If not us, who?
	If not now, when?

	We have a war against women.
	We have a war against traditional, real, biological genders.
	And there is a very easy response to all of this, whether it's the woke military, whether it's Leah Thomas.
	It's what are the men doing?
	What are the fathers doing to defend the fairer sex?
	Not too long ago, my Salem colleague, the founder of Turning Point USA, I'll ask a very, very simple question.

	In a different America, in a 1950s America, let me tell you what would have happened.
	is that the fathers of every other competitor would have come down out of the stands and formed a line in front of William Thomas and saying, Hey, tough guy.
	You want to get in the pool?

	Because you're gonna have to come through us.
	Women have been left to fend for themselves.
	And guess what?
	Now men are terrorizing them.
	William Thomas is a man terrorizing other women.
	Why are we putting up with this?
	And the reason is because we've allowed men to become weak.
	And so, I'm about done with this whole topic.
	My patience has run thin.
	And so here's my challenge for every man across America.
	This is happening in your local school board.
	It's not a matter of showing up to meetings and all this.
	You need to intervene.
	You need to show up to the sporting event and be like, this is not happening actually.
	You're not competing against my daughter.
	She has XX chromosomes.
	You have XY chromosomes.
	Get off the court.
	Get out of the pool.
	It's not going to happen anymore.
	That is the question.
	Why are grown men, the fathers of these young girls, not doing what should be done?

	He has no right to compete against girls and he is terrorizing them by doing so and walking around naked in their changing rooms.
	What are the fathers doing?
	Just sitting there on the bleachers.

	All right, we're going to talk about your book in the next segment, but first things first, while we were connecting, we played that clip of you asking the question very forcefully.
	You could tell that the blood was raising in your veins, asking the question, where are the fathers?
	If this were the 1950s, And a grown male was getting in the swimming pool, pretending to be a woman, intimidating those young high school age athletes, college athletes, and then destroying their dreams.
	The fathers wouldn't be sitting there in the bleachers.
	So you asked the right question, Charlie Kirk.
	Now give us the answer.
	Why do the men of America sit by and let this terrorization of young women occur?
	Yeah, it's a good question.
	Unfortunately, I think we're seeing it manifest in more than one place.
	I mean, the country I grew up in, Dr. Gorka, and the country that I want to try to restore, and I know you do, too, is the Flight 93 country, where you take ownership with courage and boldness, and, you know, something bad might happen, but you're doing it for a greater good.
	It's a commitment to duty and sacrifice and to the good.
	It's the country where men and women both But mostly men stormed into the Twin Towers to go save people, and unfortunately they perished alongside the people they're trying to save.
	I think we have a whole attack on masculinity in our country.
	Unfortunately, too many men are playing into it.
	You could connect the Uvalde tragedy to what you saw with 19 police officers waiting for over an hour, and I wish I was wrong, Dr. Gorka.
	I was looking at every possible way of some explanation, but unfortunately, The data is showing and the evidence is showing that there are just 19 men that kind of just stood idly by and waited nearly an hour to intervene.
	And so I think it's all connected.
	I think it's a general attack on the American man.
	And unfortunately, far too men are rising up and understanding what a man actually is, which is to use strength to protect the people that are not as strong.
	A Western value is the idea of the strong protecting the weak.
	In every other country, the strong crush the weak.
	Not every other country, mostly every other country.
	Where do we get this idea?
	Of course, from the Bible, from our heritage, and from our tradition.
	And so, we now see that manifested in transgender sports and the lack of men standing up to protect their daughters.
	You didn't sit back, you didn't wait, you didn't decide to stay just a bystander.
	Less than a decade ago, instead of going to college, you said, I'm going to push back on the left wing, on the America hatred.
	You created Turning Point USA, which is now a phenomena.
	It truly is one of the most important institutions in America today.
	You've talked about why it happened, what is missing, but what is it going to take to fix?
	You were speaking at the Saving America Tour.
	Turning Point USA has been very active in the high schools, the colleges, but now we're addressing the faith element.
	Is it because, is it more than just culture?
	Is it really the lack of the values of the New Testament being inculcated into young men across America?
	Is that the answer?
	I believe it's part of it.
	I believe that we're really at a spiritual war and there is a spiritual dimension to all of this.
	And it doesn't have to be limited.
	But I believe that if we're talking about really trying to fight for liberty, which is God's idea, not man's idea, then we must activate the faithful.
	It's incredibly important.
	And so what do we do to fix this?
	Well, I think direct challenges to men that have been kind of feminized over the last couple of years.
	Dr. Gorka, you're going to be speaking at our upcoming Men's Summit.

	But we will soon.
	We're going to be doing our part to do a men's summit of what does it mean to be a man, especially in America.
	Are we even allowed to talk about it?
	We don't really care about that, whether we're allowed to or not at Turning Point USA.
	But why has this kind of become so taboo, the hyper-feminization of the American male, almost the creation of what I call the elite androgynous being, where you can't quite tell if they're a man or a woman.
	But they're certainly wearing a mask and you know they get every booster every time it's announced.
	That's not sustainable.
	Our country was built on the heroic, the strong, the courageous, and the bold.
	One that understood duty and also delayed gratification.
	I believe that men need to be clear leaders of their family and their community and their country of when you have to basically forego indulgence and pleasure for a greater good that might await you tomorrow.
	That takes That takes a fair amount of both mental and spiritual discipline that I believe is lacking in our country.
	But there's still some phenomenal men in America.
	Dr. Gorka, as you all know, I think we have to elevate them, celebrate them, and then challenge other men to make a decision and a choice to become the man they truly are built to be.

	Let's open with a cut from the newly installed president of the Heritage Foundation.
	This was his interview with me less than a week in office.
	He's a former educator, sixth generation educator, former president of a college.
	I said it's exciting what's happening at the high schools, the pushback from the Mama Bears, but what about the colleges?

	You ran a college.
	Can we even fix higher ed?
	There's schools I think we can do.
	Can we save higher education in the colleges?
	No.
	You've got to overthrow it.
	Control-Alt-Delete is how you fix American higher ed.
	So you've got to start over.
	And we've got some ideas on the policy side when we have more time another day to fix it.
	But people need to understand, you know, pick your spouse, your friend, put three hands together.
	There's no more than 15 colleges you need to be entertaining sending your kids to.
	It's that bad.
	Overthrow them, control or delete, which I think is the topic of your upcoming book.

	By the way, Kevin Roberts is doing a great job at Heritage.
	He deserves some credit for really what he's doing there, and it's well said.

	You can buy a book to learn about how college is terrible, to go fund the organization, to go take back the college.
	It all kind of makes sense.

	Acted as if I was a prosecutor and I was trying to convince the jury.
	Because a large majority of my audience will be somewhat sympathetic to the cause beforehand, but I'm making an argument that college is largely a scam.
	It's an irredeemable institution.
	It needs to be destroyed from within.
	Collapsed.
	That has done damage to our country and the people who defend it, who sit on the boards of these colleges, they are all protectors of an institution that's making us less free, less happy, less prosperous.
	And less American in every possible way.
	And so I basically put forward in the book an argument, a 10-count indictment, and you are the jury, and you can decide by the end of the book whether or not you want to indict that college is a scam.
	And basically, what I am trying to make the argument for is both the indictment that it's a financial scam, that it's a cultural rot, that it is spiritually bad for children, that it creates bad politics, More than anything else, I think that what I'm trying to convince people to do is to no longer be a participant.
	The call to action is to withdraw your child from college, stop giving money to your alma mater, don't go to college altogether.
	Now, I make the necessary carve-outs.
	Hillsdale College, amazing college.
	There might be one or two others.
	Regent does pretty well.
	Liberty does pretty well.
	Grove City?
	No, they've gone woke, believe it or not.
	Grove City has gone woke?
	Uh-huh, yeah.
	It's unbelievable.
	I'll send you some articles.
	Now, their board's fighting back, and it's a mess, but they're nowhere near what Hillsdale used to be.
	I know, I was shocked when I learned that, too.
	Maybe they'll be able to get it back to where it needs to be.
	But anyway, the point is that you list 10 colleges, 15 colleges, that's it.
	There's well over 3,000 schools, if you count the technical schools and community colleges.
	And it's this expectation that exists in upper middle class society that your child has to go get a piece of paper.
	And that's all that it is.
	It's a piece of paper.
	And it's increasingly meaningless.
	And sorry, go ahead.
	Yeah.

	But that doesn't happen anymore.
	And I mean, you know, it's It's a credentialing exercise and it's awesome that, you know, your son was able to survive.
	He did.
	He did survive with his values intact.
	And it's not just credentialing.
	It is also money making.
	These are real estate enterprises that just give out diplomas as well.

	The Secretary of Homeland Security, Alejandro Mayorkas, at some point, as the Secretary of Homeland Security, knowing what a huge national security crisis this is, knowing how many Americans died from overdoses, at what point does he tell the White House, look, I can no longer support your open borders agenda.
	I am the Secretary of Homeland Security.
	And we created a dangerous situation on the border where our homeland is less secure.
	But he hasn't.
	He keeps going on that he went out there yesterday saying the border's closed, the border's secure, lying to the American people.
	I met with about 150 GOP representatives up at Hill a few weeks ago, and I told them, day one, you take back Congress, he needs to be impeached.
	Because not only did he violate the oath he took, he put this country in great danger of drug overdoses, gang members, and known suspected terrorists.

	Tom, Secretary Mayorkas, he should be called, and this isn't a joke, this is a statement of fact, it should be the head of the Department of Homeland Insecurity, correct?
	Absolutely, because under his leadership this country is less safe, less secure.
	Yeah, and in the last 16 months, it has just been an escalation in terms of open borders, giving illegal immigrants safe passage.
	Is there anything, one action that they've done that actually improves the situation on the border, Tom?
	No, no.
	We got the first Secretary of Homeland Security that I've ever seen is complicit in cross-border crime.
	Look, everything he has done, he's been in power 16, 17 months.
	The numbers keep climbing and climbing and climbing.
	He tells the Senate during the Senate hearing, well, we've got a plan, the plan is coming together.
	Unless his plan is open borders, which he's proven that's what it really is, He has no enforcement plan.
	He has done a single thing to slow the flow.
	And look, we sued him, Seb.
	We sued him to put Title 42 back in place.
	We won.
	We sued him.
	And I'm saying we because I actually filed an affidavit with the state of Texas for this.
	And we sued him for Title 42.
	We sued him for remain in Mexico.
	We won both.
	A federal court said you must reinstate both.
	And here's the fact.
	They're only doing remain in Mexico at about 40%.
	And as far as the, no, excuse me, they're only doing Title 42 at about 40%.
	Remain in Mexico, they're running at about 5%.
	And this has been for months.
	I don't know why, at what point does a federal judge call him into court and hold him in contempt?
	I mean, the federal judge ordered them to do it, and they're ignoring it.
	What's really pathetic is the Secretary of Homeland Security and the White House, when they get ordered by a judge, you know, you're going to do this to secure the border, they immediately appeal it.
	They don't want to secure the border.
	They haven't done a damn thing to slow the flow.
	So you said in that cut that as soon as there's a GOP victory in the midterms, God willing, that the Secretary should be impeached because he's complicit in the activities of the human traffickers, the drug smugglers, and the fentanyl crisis.
	Now let me put it to you, this is from one of our amazing callers, one of our amazing listeners, who said if you are making conscious policy decisions that endanger Americans and actually cost the lives of Americans by overdoses.
	Shouldn't that person be federally charged with crimes, not just impeached?
	Because they are actually helping the cartels, Tom.
	Well, I don't disagree with that.
	And look, you know, this administration is, I meant what I said, they're complicit in cross-border crime.
	Because in my day, if you want to hire an alien smuggler to get a relative to Chicago, You had to pay that smuggler to get him all the way to Chicago.
	Under Biden administration, you only got to pay the smuggler to get him to the Mexican border.
	Because the US government under Biden administration will get him to his final destination at taxpayer expense.
	They'll get him a plane ticket and they'll fly him to Chicago.
	So, yeah, I think they're complicit.
	You know, Alien Spawn, Conspiracy to Commit Alien Spawn is a felony.
	Now, I certainly don't think DOJ would ever talk about the same thing when I was ICE Director, when I said, in sanctuary cities, if a jail refuses entry of ICE into his jail, isn't that the same as this?
	When I was an agent, back in the day, if someone, if someone hid an illegal alien in their home or place of employment, We would charge him with a crime.
	So if you know he's in the jail because his fingerprints were run and DHS got a kickback to say, hey, this person's there.
	He's illegally here because we deported him four times.
	You're not allowed in that jail.
	Is that not harboring?
	Is that not a harboring charge, a felony?
	So back when I was ice-dressed, I made a comment.
	I think DOJ needs to look at this.
	And if he finds somebody, whether it's a politician or a sheriff, is harboring an illegal alien in their jail, shouldn't that be charged?
	And I'll say the same thing about this administration.
	We have two standards.
	We have the standards of a United States citizen.
	We have the standards for the administration and members of Congress.

	It's non-existent.

	If there is a person called Maybe A Girl who is giving Schiff a run for his money, that's just too funny.
	There is no run for the money, but we do have a jungle primary in California, so the top two vote-getters move on to the general.
	And the Republican candidates that were up there didn't do it, didn't cut it.
	Maybe a Girl, number two, challenging Adam Schiff.
	Not the first time, by the way, but the first time that I believe Maybe a Girl will be on the ballot in November.
	And I gotta tell you, I'll be voting for Maybe a Girl, because I can't in good conscience vote for Adam Schiff.

	If the residents of this Californian district don't vote for Maybe a Girl, doesn't that mean that they're all transphobic?

	But what disturbed me more and you're right if you are driving around right now in your car if you're just listening to this you need to look at the images that came along with those words because it is scary that is a blank stare there is nothing there and when you put that in Kind of correlation in conjunction with what the president did over the weekend when he fell off the bike and did his best imitation of our economy, came crashing down at the beach.
	You then had yesterday when he was asked about the upcoming gun legislation, which is a whole other conversation, but when he was asked about that, I don't know if you saw it, he said, I was told to say that they're going to introduce it later and I'll comment after that.
	I mean, who is running this place?
	Who's running the country?
	It's scary.

	It is the person who decided to give a guy who's almost 80 a bicycle with toe clips.

	Is there any big news out of California apart from maybe a lady that our national show needs to hear?

	Yes, of course.
	Maybe a girl is only a minor story in California right now.
	Running against Adam Schiff.
	Probably the biggest story in Southern California for us certainly is still the fallout from The shooting and murder of those El Monte police officers.
	This is an LA county.
	They were serving, it was like a domestic abuse or it was a domestic violence call and basically the person shot both of the officers who responded to the call.
	Ambushed.
	Ambushed them.
	ambushed the officers at a motel.
	And the reason that they were there is that the shooter's wife had been stabbed the day before by this man.
	She checked herself into a hotel or motel, and he showed up.
	Police arrived, ambushed, and killed them at the scene.
	He then turned the gun on himself, which was just revealed this week.
	And it's a good thing that it was because George Gascon, who is our liberal district attorney in Los Angeles, when he entered office, had an edict that if anyone died at the hands of law enforcement, that he would pay for the funeral.
	His office would pay for their funeral.
	And so it was being reported that it was possible George Gascogne's office would pay for the funeral of this cop killer because it was being reported he had been shot by law enforcement.
	Now they revealed that he actually turned the gun on himself.
	And shot himself.
	And so that had ended that conversation.
	But it is not beyond the point of possibility for George Gascon to pay for the funeral of a cop killer because he is more concerned with them than he is about the victims.
	The mother, it was Corporal Michael Paredes and then Officer Santana.
	who died, who lost their life last week.
	And Officer Santana's mother is incredibly brave and is filled with grace and God right now.
	She has been speaking out on behalf of her son.
	She's been grieving very publicly and she has blamed Gascon for her son's death and has used his name several times in local media.
	So Gascon actually had to come out and hold a press conference yesterday to explain himself Once again, why this person was out after being arrested and he should have been in jail for three years.
	He was given 20 days in prison and let out.
	This is someone who's had a long history with law enforcement.
	He's a known gang member, a known drug abuser.
	He had his weapon taken away with the felony conviction.
	He unlawfully had a gun.
	And George Gascogne did not even mention Seb.
	I'm sorry to the family.
	This is my question.
	Literally, you read my mind.
	Any apology, any glint of shame, anything?
	Nothing.
	And he stood in front of his podium yesterday and I was stunned because he spent the entire time explaining why he made the decision without even offering any real sympathy to these families who are suffering right now.
	These men had young families at home.
	They have kids.
	They have parents.
	They have wives.
	And nothing from Gascogne just explaining how this guy wasn't really a violent criminal and he has no way to predict how people are going to act.
	But I'll tell you right now if and I have zero record I can confirm no record with law enforcement.
	I do have a firearm.
	I have no concealed carry permit.
	I guarantee you that if someone caught me With my gun, even though I am a lawful citizen and I obtained this gun legally, they would throw the book at me and make an example, yet when it comes to guns... You wouldn't get 20 days after a violent felony.
	Absolutely right!
	And this Gascon, who is all about getting guns off the street, forgets that somehow and gives this guy 20 days in prison so he can go out, hurt his wife, kill some police officers, and then kill himself.
	And so, you know, we talk about this recall all the time.
	It looks more and more likely to happen.
	They have until the end of the month to collect signatures.
	And July 6th is the last day they can turn anything in, and it looks like it might happen.
	El Monte, which is the city that these police officers served, is the 35th city in California to hold a vote of no confidence on George Gascón, and it was unanimous.
	This is a completely Democrat city council, and they voted 5-0, no confidence in George Gascón.
	He is now having to answer for all of the people that he's letting out of prison.
	And it's not, it seems like there's somebody new he has to explain every single week in Los Angeles.
	Did I hear you correctly?
	35 towns voted no confidence.
	El Monte is the 35th to vote no confidence.
	That's incredible.
	So do you think he may go the way of Chesa Boudin in San Francisco?
	I believe if it makes it to the ballot, he will be recalled.
	And I don't think there's enough people willing to save him.
	He doesn't have enough political stock.
	Now there will be the George Soros's of the world who will give him money to try to save himself, but I just don't see anyone like Mayor Garcetti or even Gavin Newsom at this point stepping out and trying to put their political career on the line for the likes of George Gascogne.
	So I think he goes if this makes it to the ballot.
	The people who are doing the recall, I talked to them quite a bit, and they say that they have the signatures that they need, but they're trying to get another 100,000 more because they know LA is going to throw out a lot of signatures.
	So if they can make the ballot, I believe chances are really good.
	Okay, guys, if you're listening to us, and I know at least, you know, a large proportion, if you look at our callers, over 50% of our callers are from California.
	If you're in the area, please, please get involved with the signatures, with the petitions.
	Let's get rid of this person and put somebody in there who actually thinks criminals are a bad thing and should be punished.

	I mean, for one, this requires a bit of logic on their part, but rioting is just never advantageous to the party in power.

	This is the incredibly disturbing news from Uvalde.
	Shocking testimony from the Texas DPS Director.
	That's the Department of Public Safety.
	Ruben Ruiz is a police officer for the Uvalde School District.
	And he was on the scene after the gunman entered the school and started shooting.
	Ruben Ruiz is the widower of slain elementary teacher Ava Miralis.
	Officer Ruiz, who was armed, tried to save his wife.
	His wife had called him from inside the school and said, quote, she had been shot and was dying.
	He tried to move into the building At which point he was detained by the officers who were there, who disarmed him and removed him from the site.
	DPS has not revealed who arrested or detained officer Ruben Ruiz, but can we just stop for a second?
	A sworn peace officer carrying a sidearm was informed that his wife was bleeding out inside the school and fellow police officers detained and disarmed him.
	I have the blues back.

	I've worked with thousands of officers over the years.
	Trained them.
	Briefed them on ISIS and Al-Qaeda.
	But the officer who did that should be arrested now.
	He should be stripped of his shield and he should be arrested.

	Let's start perhaps not with January 6th and the way it has been proceeding, but with the latest ruminations, noises coming from the Supreme Court.
	Looks as if a good decision is coming out with regards to parent choice and a certain coach.
	Yes, well, there was an important case yesterday that was decided that if Maine was going to give out money to people to go to private schools, they could not say, oh, but you can't go to a religious school.
	So that religious schools and public schools had to be treated the same to get taxpayer money.
	given them to aid them in going to the schools.
	This is the last of the anti-Catholicism laws that were started.
	Remind us about this, because this is something that maybe younger generations don't appreciate.
	It was such a big issue, JFK running for president, this potential papist running the government.
	But there was actually a lot of state animosity to one faith in America, and that was the Catholics.
	Yeah, it wasn't my faith, Catholicism.
	I was called a macro snapper.
	I'm a mackerel snapper too!

	That for some strange reason a Catholic school is somehow a government distortion of the founding principles of the Republic.

	Nothing with it religious could get any kind of government funds.
	And he tried it but it failed as a constitutional amendment.
	So all the states took it up.
	Well, that's usual.
	And over 30 states had these kinds of laws that prevented any public taxpayer's money going to any religious schools, mostly Catholic, of course, because that was the time was the late 1800s.
	So that was when Catholics were really becoming into the United States as immigrants.
	And so I think this case today is one of the last things, the last issues.
	The last vestiges of anti-Catholicism.
	of anti-Katholicism.
	It was a 6-3 vote with the three liberals dissenting.
	And what it does is it sets the table for...
	The tolerant liberals don't want freedom of conscience, Joe?
	Yes, what this does is, however, though, it's wonderful.
	It sets the table for Coach Kennedy praying at the 50-yard line because it means he's going to win 6-3 at least.
	At least.
	At least 6-3.
	And what that will do is set into motion a much, much better state of the establishment clause showing that playing on the 50-yard line and giving money to Catholic private schools does not establish a religion. - I, you know, Let's just be clear.

	As an immigrant, I find it amusing that I have to sometimes explain the disestablishment clause of the American Constitution.
	It doesn't mean that you can't pray at a government meeting.
	It doesn't mean that schools can't start with a prayer.
	It means that there will be no state religion, as there is in the UK.
	And it means that nobody can be penalized by the government for being of the wrong faith, quote-unquote.
	End of story.
	Finished.
	You know, that is, you know, konjets filmu, that's the end of it.
	You said also that we have the National Guard that's arrived here in DC.
	Expectations of a decision on the abortion case?
	But it won't be today, it won't be Wednesday.
	You said Thursday is traditionally the day, Joe?
	Well, usually it's Monday and Wednesday at this time of the year, but since they didn't sit on Monday, it'll be Tuesday and Thursday.
	Oh, so it's sliding.

	And then next Monday will be... So you think it's going to be tomorrow?
	We don't know.
	We have no idea.
	Could be.
	We'll know if Alito's name shows up, if the first case has Alito's name on it.
	Explain that.
	Well, they have... Here's the way they do it.
	Opinions are reported out by the court in reverse seniority.
	The least senior judge who writes the case gets his or her case reported first.
	And the most senior... Is lost.
	cases reported last.
	So if you see Alito's name, that's a good sign that Dobbs has been decided.
	Because he wrote the decisional memo that was leaked.
	Exactly.
	But here's the concern that we've been hearing some reporting, and I don't know what it's based on, and that is that Roberts is still trying to massage a compromise.
	So if that were the case, Roberts would be writing it, and Alito wouldn't be the author.
	So, okay, let's, So, okay, let's spend a couple of minutes.
	I wanted to switch topics, but this is far too important.
	So, I'm not a lawyer, but I've read the decision document.
	Fascinating.
	It was less of a legal treatise and more of a historic and cultural one.
	Exactly, exactly.
	Of course, nothing like this has happened before, with a 67-page document being released prior to the final decision.
	But in internal practice, if an associate justice has written this document, I mean, if you read it, it's very clear.
	The last paragraph states, as a result, this is sent back to the states.
	I mean, it is, you know, Roe v. Wade, end.
	Gone.
	Casey, gone.
	Sent back to the states, where the representatives and their constituents can argue it, as is the wont of a republic.
	Given the way it was written as a fait accompli, is there any room for the Chief Justice to massage anything?
	Yes, that's the first draft.
	But then that's circulated, and then the dissenters say... and then they have to send their words to the author of the opinion, and the author gets to say, well, the dissent says, but I say... But what was that concluding paragraph based on then?
	It wasn't just Alito saying, I'm sending it back to the States?
	That had to be a measure of the sense of the court, hadn't it?
	Well, he had votes.
	He had enough votes because they showed that that was a majority opinion he was drafting.
	So that meant he had at least five.
	So the bottom line is, if Roberts were to succeed, let's say theoretically, and get a modified opinion which no longer did what Alito's opinion did, In my opinion, that would be a disastrous day for the Supreme Court because it would mean that political and physical violent pressure and violence at the home of justices led to a change in a decision.
	And that, I think, would have far more serious consequences for the country than if the original opinion would stay the way it is.
	What's O'Mara telling you?
	Is he going to peel somebody off, or is he going to stay?
	I think the Alito opinion will stand.
	Victoria?
	Well, I'm hoping it will, because it would be a travesty.
	I can't imagine that Kavanaugh would cave and change his vote.
	Because here's the thing.
	It's public what his vote was.
	It's not a secret anymore.
	It'd be one thing if you changed your vote.
	No, it'd be an open reversal.
	It would be an absolute change in position.
	And I'm not sure he would be able to go and speak anywhere.
	Sorry, go ahead.
	No, it's just, it would be frightening if they had not leaked the opinion, if whoever leaked it had not, there could have been a chance for some massaging.
	Although, at oral argument, both sides said there's no half way.
	It's either you reverse Roe v. Wade or you uphold the law.
	So, you know, I don't know how they would split the baby.
	I don't know how you split the baby other than doing the horrible thing that Roberts did in the Obamacare case where he said it was commerce, but that was a tax when everybody said it wasn't a tax.
	Where he legislated from the bench.
	Exactly.
	When a lawyer reads that opinion, you know that he switched and we also know because we talked to certain justices who were really mad.
	At that point, you're just playing politics.

	Yesterday we had Brad Raffensperger and many others appear in front of the January 6th.
	I'm going to use a phrase one of my callers used, Inquisition.
	It's either a Star Trader or an Inquisition.
	Give us your take to date in the last few weeks, Joe DiGenova, in terms of your experience working as U.S.
	Attorney for the District, working as a Special Counsel for the DOJ, as a lawyer to date.
	Your description of this event.
	On January 6th, we were in your studio when this happened, and my immediate response after watching it was, this was a catastrophic security failure.
	And everything to date that has come out of these hearings has confirmed that.
	It shows that they purposely did not want to be prepared.
	They had insecure fencing.
	They had insufficient number of police officers, no National Guard, no U.S.
	troops.
	The fencing that exists at the Supreme Court In anticipation of the Roe case, the Dobbs case, is the kind of fencing that should have been up.
	It wasn't.
	What they had up were bicycle racks and all sorts of things.
	They had their civil disturbance.
	Fifty percent of them were on leave that day.
	Can you explain your unique position in the past in having worked on congressional security?
	Well, I was the United States Attorney for the nation's capital and as part of my job, my job was to coordinate security for the city With the Chief of Police, the Secret Service, the FBI, and if need be, the Department of Defense for major demonstrations.
	Because we were going to press criminal charges in my office against anybody who violated whatever the laws were at that time.
	So when I saw this, I immediately knew on January 6th that somebody had not done their job.
	Or someone had prevented people from doing their job.
	So here's the question.
	Do you have any sense, given that we found out that Nancy Pelosi refused the President's offer of the National Guard, now we know Chuck Schumer likewise stood down or refused any, or was provided threat assessments and ignored them.
	And Mitch McConnell, he was Majority Leader.
	Is this just incompetence or is there something more there, Joe?
	On the House side, I am absolutely certain that Nancy Pelosi made a decision not to use troops or to have security at a high level.
	There's no way when the chief of police, Chief Sund at the time, when he said, I've got to have troops, I've got to have more men, I've got to have more capital police, and he was refused.
	To me, that's purposeful.
	There's no other explanation for that.
	Hey, Joe, what day in the hearings is that issue going to be discussed?
	The same day they discuss Ray Epps.
	That's the day.
	And the tower commander.
	For people who don't know, there was a guy named Ray Epps, identified as a Ray Epps, who was standing out there saying, come on, go in!
	Well, he was on the FBI's most wanted list for about 10 days and then just disappeared and went back home.
	No one will tell where he is.
	I know, it's so strange.
	Your take on what we're witnessing on Capitol Hill in the last couple of weeks, Victoria?
	Well, I call it a Soviet show trial.
	Good.
	Because where do you have a situation where the person in the dock... Is not in the dock!
	Well, but there's no representation, that person cannot present evidence or witnesses, and has nobody to cross-examine the evidence and witnesses that these people are presenting.
	It's frightening, and I'm so It's one of the most unfair proceedings I've ever seen and it's so un-American and people aren't saying that.
	The Washington Post says, oh you should go and testify.
	This really is the House Un-American Activities Committee.
	Why are the star witnesses, one of our listeners brought this up, Not being sworn in.
	Isn't that strange?
	Do they have some fear of perjuring their own witnesses?
	I have no idea.
	But isn't that strange?
	Here's the thing about this committee.
	This is illegitimate in every sense of the word.
	What Nancy Pelosi has done to the institution of the House is almost... You can't fix it.
	And I pray to God that the Republicans take over the House and the Senate in the next election.
	So that they can right the ship, conduct themselves in a proper way, but also not let the Democrats who did all of this in violation of the House rules and the Constitution get away with it.
	All of those Democrats should be stripped of committee assignments, they shouldn't be allowed to be on committees, and they should not be allowed to benefit from what they did to undermine that they're the ones who have undermined the Constitution.
	But in the past, the Republicans get in and they say, oh, we don't want to do, we don't want to be like Democrats.
	Don't rock the boat.
	There seems to be, from a very simplistic, even childish analysis, it seems so risky for them to do this.
	Because if you set this precedent now, that we can go after a president, we can go after an administration, do they not realize that if they lose an election, that this can be done to them?
	Well, I don't think they had any idea.
	They thought that they were going to federalize all the elections, so they were going to be in power forever.
	So they just think that they'll be in power forever and so they can do whatever they want?
	Absolutely.
	This is a drunk with power performance from the beginning of this Congress.
	They thought they were going to continue to be in power.
	None of them anticipated that Biden would be such a corrosive and just awful president in every sense of the word.
	His approval ratings are now down at 37, 33, 39, depending upon which poll.
	And so, I think they've just decided, they've gone this far, they don't have any choice, and they're walking the plank themselves.
	Yeah.
	Do you think it will backfire in terms of the mostly apolitical American populace when they look at this?
	Is this gaining any traction?
	Do you have a sense?
	I think at the gas pump it is.
	I mean, I don't know that you can win over people that are really not paying attention, but they have to go to the gas pump.
	They have to go to the grocery store.
	And that's the point.
	These hearings have been overtaken by inflation, gas, Afghanistan.
	And this crazy climate change thing, where they purposely decided they want to destroy the fossil fuel industry from day one, and the American people understand that.
	Yeah, we've been playing those cuts from the campaign trail by Joe Biden, where he said, that's it, yep, the goal is to get rid of fossil fuels.
	Why did January the 6th happen?
	It happened because of an election that wasn't fair, wasn't transparent.
	We were told that that was just a conspiracy theory.

	So the big question of the January 6th show trial, I'm going to use that phrase show trial, is the target is of course my former boss President Trump.
	Let's start with you Victoria.
	How Great is his legal jeopardy.
	Because I've seen a couple of different avenues of attack.
	First it was, he caused the insurrection.
	He incited the violence.
	That's why they've never showed the clip of him saying, march peacefully and patriotically to the Capitol, which of course would negate that, refute that.
	Now, they seem to have switched tactics midway and say that he's, he raised funds to investigate fraudulent election activities and then did nothing with it and just kept it for his own purposes or political campaigning and they're going to try and use some kind of financial charge.
	Whatever it is, is he in legal jeopardy?
	I can't see any basis for legal jeopardy.
	The latest is what you had Adam Schiff talking about at the beginning of the hour, the alternative slate.
	Oh, yes, let's unpack this.
	The electors.
	Yeah, the alternative electors' slate, which was done by the Democrats in 1960, by the way, and nobody went after them criminally.
	What would the charge even be, then?
	Well, that's why Dana Bash is such a suck-up reporter.
	She didn't say.
	Please, reporter.
	Oh, okay.
	Please.
	It would be a conspiracy to defraud the United States government of faithful electors.
	That's what it would be.
	A conspiracy to defraud the United States.
	But I don't know, but it's got to be something, that's got to be something illegal about that, and when it was done in 1960.
	What is the difference between having a slate of electors, and here's what was in the documents, it said, if Trump wins, legal arguments.
	I mean, language to that effect.
	We're in there.
	It wasn't like, we are the other electors.
	It wasn't, we're going to make up the results.
	No, it was only if he wins in court decisions, because there's a certain deadline by which electors have to be chosen.
	So if they weren't... The safe harbor.
	Not only that, this wasn't being done in secret.
	This was being talked about.
	All of this was publicly known.
	People knew what people were trying to do.
	It was all part of the political process.
	Rough and tumble, but nonetheless known.
	And so what's the difference between that and a guy by the name of Daniel Brezinoff who in 2016 in December went out and got all kinds of ads to tell the Texas electors to vote for Hillary Clinton?
	I mean that was in complete contradiction to what the law provided which was Trump won Texas.
	The electors have to vote for Trump.
	It wasn't an alternative slate.
	It was, hey, go out and disobey what Texas state law is, which is you have to vote for whoever won the state.
	Let's just remind ourselves exactly what they did, the Democrats did, in 2016.
	The same people who said, it's an insurrection, you can't do this!
	They did it against President Trump.
	I have an objection because 10 of the 29 electoral votes cast by Florida were cast by electors not lawfully certified.
	I object to the votes from the state of Wisconsin which should not be legally certified.
	Mr. President, I object to the certificate from the state of Georgia on the grounds that the electoral votes were not... There's no debate.
	I object to the certificate from the state of North Carolina.
	I object to the 15 votes from the state of North Carolina.
	Um, I object.
	I object to the certificate from the state of Alabama.
	The electors were not lawfully certified.
	Is it signed by a senator?

	Is President Trump in legal jeopardy given what you've heard so far in the January 6th show trial?

	But there's nothing that the President did, and there's no evidence that's been presented by the January 6th Committee to show that any crimes were committed by anyone.
	But listen, we have a corrupt Justice Department.
	Merrick Garland has used it for political purposes.
	And I give you an example, Project Veritas.
	That, I mean, there is no crime in having a diary of the President's daughter.
	That was abandoned property.
	That was abandoned property.
	Not stolen.
	Abandoned property.
	No debate about that.
	And then he has his offices raided.
	Or, what about his home?
	No, no, no.
	His home.
	And he was handcuffed and shoved up against the wall.
	Or just the news that was broken, I think, on Friday by our friend John Solomon, that Stephen Colbert's crew team breaks into Congress, is arrested, is handcuffed, and the same US Attorney's Office that brought the charges against the January 6th rioters refused to press charges against this left-wing TV show's team.
	But Peter Navarro, what happened to him is an impeachable offense.
	Whoever authorized that, it's so disgusting.
	This is one of the most terrible things that Merrick Garland and Christopher Wray have done.
	They have weaponized the FBI.
	The FBI is acting on orders.
	The handcuffing and shackling of Peter Navarro at an airport for a misdemeanor offense was done for political purposes to intimidate him, to embarrass him, and to intimidate others.
	That is disgraceful supervisory authority by the Attorney General and the FBI Director.
	It's happened before.
	It's never happened to the extent that this has been done by Merrick Garland and the FBI Director Christopher Wray.
	This is disgraceful, what happened to Peter Navarro.
	So the bottom line of what we're saying to you is, no reasonable lawyer prosecuted- Out of January, there's a commission.
	Something crazy could happen.
	Yes, because Merrick Garland is acting in a political way.
	Absolutely.
	So, given what you've said about DOJ, the political weaponization of the FBI, let's talk about the recent Sussman acquittal.
	We've discussed again and again and again John Durham.
	The next case won't be in DC, it'll be in Virginia, which is only slightly less completely Democrat than the nation's capital.
	Will anything of meaning, of worth, come out of the Durham investigation?
	It already has.
	I think that that Durham's investigation has revealed the perfidy of Hillary Clinton and all the people around her, that she was responsible for fabricating the lie about the Russian collusion oaks, that it was used as a way to cover up for her horrible campaigning and her outrageous performance as a candidate. that it was used as a way to cover up
	But the other thing is that the simple truth of what happened there is that the Russian conspiracy was a lie.
	It was a lie from the beginning.
	Everybody knew it, and yet it was pursued vigorously by the Democratic Party and by the senior leadership of the FBI that knew it was a lie.
	And in the book Shattered, and I don't know if you've read it, but in the very last chapters it talks about how they're going to say, this wasn't Hillary's fault.
	We're going to blame it on the Russians.
	Right.
	That is the chronicling of her campaign to New York Times or Washington Post.
	Authors trailed her campaign.
	It was supposed to be.
	How she shattered the ceiling.
	She was elected president and then, because of their access to write the book, They see what happens after she loses and they are present and are told about the conspiracy that is created out of whole cloth to blame the Russians as a way to forgive her loss and to explain her loss.
	And then they were quiet about it.
	They didn't say a word as all of this was going on.
	Your expectations of the Durham investigation going forward?
	Well, it's not expectations.
	It's hope that more indictments proceed, but who knows?
	He laid out a conspiracy.
	I hope he brings it.
	We don't know why he didn't charge the conspiracy with Sussman.
	I would have charged the conspiracy that Sussman was clearly involved in with all those people.
	Of course, they would have acquitted them all because it's a DC jury.
	Fine.
	There's nothing you can do about it.
	See, by the way, the acquittal of Sussman The D.C.
	jury system is such that a Republican cannot get a fair trial in the District of Columbia.
	But that started back in the Nixon administration when the trials were there.
	Those D.C.
	juries were never going to give a Republican a fair trial.
	Ronald Reagan's attempted assassination, that jury that found John Hinckley not guilty by reason of insanity, that was a verdict against Reagan.
	They hated Reagan.
	They hated Republicans.
	They were never going to convict Hinckley.
	And when Scooter Levy was on trial, they said, why isn't Cheney in the dock?
	One of the jurors said that.
	And the FBI uses this.
	They've got somebody, because I've had these clients, who did something in the venue is the District of Columbia.
	They say, do you really want to go to trial with a DC jury?
	I mean, that's what they did to Mike Flynn.
	Yeah.
	Does that mean that this can never be any different?
	Is there no option to have these trials?
	Can a good lawyer not argue to have them held outside of D.C.?
	Well, you can argue for a change of venue.
	It's in the total discretion of the trial court.
	These judges that now sit on the District Court in the District of Columbia are overwhelmingly Democrat, and they are not sympathetic to notions of jury The type of criticism of juries that we're talking about here, I think it would be highly unsuccessful.
	It's just a very bad situation.
	But I want to tie that up with the point we were talking about earlier, and that is that these people from January 6 have been languishing in solitary confinement and otherwise.
	What's wrong with the D.C.
	judges?
	They don't get these people out.
	Doesn't one of them have a sense of this is illegal, this is unconstitutional?
	You mean the judges who are hearing their case?
	They're the ones that set the bond.
	They don't have to listen to the United States government.
	Well, these have to be political decisions, no?
	Or just lack of courage.
	It certainly appears like there is an animus toward all of the January 6th defendants.
	By all the judges.
	Among most of the judges.
	There's been one or two judges that have objected to the bond situation.
	But for the most part, there's been no pushback from the judges against the federal government, the prosecutors.
	And to have these accused be forced to make statements from the courtroom that, yes, I recognize Joe Biden is the legitimate president.
	That is what happens in a Stalinist regime, when you are forced to make self-critical statements.
	It's got nothing to do with the law in a case and what they're charged with.
	Having people make statements like that.
	And by the way, having the judges not doing a good job of jury selection.
	Allowing people to sit, for example, on the Sussman jury.
	Three people who worked for Hillary, gave money to Hillary.
	I mean, the relationship.
	The judge's wife was representing Lisa Page.
	I mean, my goodness.
	What in the world about the appearances of fairness were completely lacking for the government?

	All of the things we've mentioned when it comes to a politicized law enforcement, intelligence community, DOJ, can these things be fixed if the right person is in the White House and we have the Senate in the House?

	You need a powerful leader who Has it ever been this bad before?
	here is going to change and if it isn't people are going to be let go.
	I mean you just have to take control of an institution like that with a powerful leader and that was clearly the FBI doesn't have one now.
