Maricopa County executives robbed Kari Lake of Arizona's governorship after one of the shadiest election days in living memory. Now, Lake has achieved what Donald Trump never did in 2020: She is having her election challenge heard in a public trial. Charlie tracks all the trial's developments life as they happen, calls out lies when he hears them, and gives his take on both the lawsuit's likely outcome, and what the outcome ought to be.Support the show: http://www.charliekirk.com/supportSee omnystudio.com/listener for privacy information.

Let's get into the most urgent news.
Right now, Carrie Lake and her legal team are in court.
A judge has allowed the Carrie Lake election challenges to proceed to court.
She put forward 10 election challenges.
Two of them have now been allowed to be heard in a trial format.
Now, this is a very quick trial.
This is a lot of information compressed in a short period of time.
Because of that, Kerry Lake's legal team decided not to call Katie Hobbs to the stand, which is an interesting legal strategy, but I suppose with the limited time they have, they just don't want someone to take the fifth the entire time.
Stephen Richer, the Maricopa County recorder, just testified and confirmed that chain of custody was broken.
He said all ballots that are delegated to a third party or a location are in defiance of Arizona election law.
Stephen Richer also said under oath that he did not involve himself, donate, or was engaged in the creation of a super PAC against Kerry Lake.
Let's try to get that information, by the way, to fact check Stephen Richard.
Did Stephen Richard just lie under oath?
Let's get that information.
He said that was absolutely false.
I remember reading news story after news story.
I saw the documents myself.
Now, Carrie Lake spoke at our Turning Point USA America Fest.
Her speech was brought to you by Turning Point Action.
Let's go to Cut 46.
Hey, guys, guess what?
Christmas came early yesterday.
We are going to trial.
This is so historic.
And you know what?
I couldn't have done it without you.
A little over a day ago, I stood here on this stage and I said, please pray, not just for me.
Pray for our attorneys.
Pray for our witnesses.
Pray for the judge.
My goodness.
You did it.
And yesterday we got great news.
We're taking these bastards to trial.
So getting a trial is a big deal.
Donald Trump, as many of you know, attempted several legal challenges during the 2020 election.
I'm sorry, after the 2020 election.
And in Arizona, none of them were allowed to proceed to trial.
Now, I'll be very honest.
Kerry Lake had a phenomenal lawsuit, has a phenomenal lawsuit.
I have it right here.
There are some very serious complaints in this lawsuit.
We could flip through it.
We could read it.
Not the best use of our time today.
But the strongest part of Kerry Lake's lawsuit, in my personal opinion, was not even allowed to proceed to trial, which was the signature verification.
The lack of integrity around signature verification is one of the great injustices unfolding in the era of mail-in balloting.
It's happening in Georgia.
It's happening in Pennsylvania.
It's happening in Arizona.
Signatures that are not remotely matching with that on file are being approved.
And so Kerry Lake puts forward 10 complaints.
Two of them are now being heard in trial.
The two that are being heard in trial are chain of custody, were the ballots administered and followed in a way that was respectable or respectful or following of Arizona state law.
And the second is the machines.
When I went to go vote in Scottsdale, Arizona, many of you heard me tell this story dozens of times.
When I went to go vote, the machines were out.
The poll workers, very sweet people, were confused and embarrassed about the fact that you could not go and use the machine to cast a ballot at the local polling place, at the local voting center.
Not allowed.
So you got to vote in a different way.
This happened all across the valley.
The question is, why did they pass the test the night before and they failed the test the day of?
What resulted was long lines, chaos, voter disenfranchisement.
We have real records of people that were not able to cast a ballot or vote because of what Bill Gates and Stephen Richard did in Maricopa County.
And now this is being heard in a trial format.
This is a significant step in the right direction.
This is significant progress.
Kerry Lake is further in the election integrity fight than Donald Trump's campaign was ever able to in the state of Arizona in 2020.
Now, I also want to manage your expectations.
I want to be very honest.
The likelihood that after this couple-day trial, that it's going to result in a new election or Katie Hobbs not becoming governor is low.
It is not impossible, but it is low.
We need your prayers.
We need any sort of help that you can provide, which is limited at this time because it's just in trial.
Basically, your prayer is the best thing that can happen, best thing you can do.
That a judge will act and will see that this was an illegally administered election, as now has been admitted in court.
They have admitted that the chain of custody that was broken with the ballots was against Arizona law.
It's against the law.
So when the government breaks the law, what is the remedy?
Now, look, both sides will appeal regardless of this decision.
This could go all the way up to a circuit court, potentially even to the U.S. Supreme Court.
Maricopa County, under oath, admits they do not count ballots at vote centers, which is required by state law.
Bill Gates is a criminal, not Bill Gates, the Microsoft Bill Gates, even though he's a criminal for different reasons.
No, Bill Gates from Maricopa County was the one that was bragging.
Remember on election day, he said, oh, everything is so hunky-dory, you know, and everything's going great.
By the way, you guys could put your stuff in box three and it will be counted at a vote center.
That is illegal.
So what is the remedy?
When state laws are there for a reason and they just break them, how do you go about fixing that?
So, regardless of who wins this two-day trial, there's going to be appeals and consecutive amounts of legal challenges.
But this is a big accomplishment by Carrie Lake to get this to trial.
Saving Preborn Lives Today00:03:49
Remember, the swear-in date is January 2nd.
So, this is all being rushed so that it's done by then, or a new election is administered.
That would be the right thing, but it is unlikely.
So, right now, Carrie Lake's trial continues, and we're keeping an eye on it.
We're going into great detail about what is being discussed.
And Stephen Richer, under oath, do we have that data on Stephen Richer's super PAC, as I asked?
Stephen Richer was involved in some sort of PAC, but he said under oath, I just heard it before the show started, that that's a complete and total lie, that Stephen Richer was not involved at all in any sort of super PAC whatsoever involved in trying to defeat Republicans.
Bill Gates, remember, said in a radio interview, he said the best way to save the Republican Party is humiliation at the ballot box.
These are the people that are administering your elections.
This lawsuit is a strong one, and now it is being heard in court.
Carrie Lake has her date in court.
What will come of this, we do not know, but she has already been able to go further in a very significant way than prior election lawsuits.
It is Christmas week.
I want to tell you guys about a way that you can help save a baby's life for just $28 this Christmas season.
It is true.
Pre-born is one of my favorite organizations.
That's why we're partnering with them this Christmas season on charliekirk.com.
There's a banner.
We know that pregnant girls and women who see their babies on ultrasound are far more likely to choose life.
Your gift today can save a baby's life.
Just $28 can give a mother who is abortion-minded the chance to see the truth of the baby that is growing inside her.
$140 can do this for five girls and women.
And a $15,000 gift will provide an ultrasound machine that will save lives for years to come.
You just go to charliekirk.com and click on the pre-born banner this Christmas season.
We are just days away from Christmas, one of the holiest days of the Christian calendar, one of my favorite days.
I love this week.
And usually this week's a very slow news week.
This is the exception.
We got Trump tax returns.
We got Omnibus.
We got Carrie Lake stuff.
It's really all over the place.
We just finished Amfest.
So in this chaotic time, make a commitment to save a baby's life.
If you are pro-life, then my opinion is that part of your giving budget should be directly to help save babies' lives.
That is charliekirk.com.
Click on the pre-born banner.
No better time to save a baby's life than right now.
Your gift is matched dollar for dollar, doubling your impact.
Erica and I are giving money to pre-born.
I think you guys should as well.
CharlieKirk.com, click on the pre-born banner.
We have to be pro-life in every possible way, not just argue for pro-life politics, but go to charliekirk.com and click on the pre-born banner.
Portions of this Charlie Kirk show are brought to you by Pre-Born.
Again, CharlieKirk.com.
Super simple.
Click on that banner.
Give back this Christmas season.
Remember this?
On election day, Bill Gates telling you everything is great.
Everything is wonderful.
Everything is fine.
Don't believe your lying eyes.
Play cut 48.
When do you anticipate the votes will be counted in total, those 400,000 plus votes?
Well, we will be going into next week.
There's some onesie twosies, again, pursuant to Arizona law.
But I think that we'll see the lion's share here wrap up by early next week.
Realistic Hopes for Election Remedy00:04:40
And by the way, they said under oath, I don't recall ballots being rejected.
I saw ballots being rejected on Election Day.
You saw ballots being rejected on Election Day.
They are lying under oath.
Stephen Richer said he was not involved in a super PAC, even though American Greatness reported that most of the money raised by the PAC defending Arizona values, a group that believes that there is more to be gained by working across political and cultural lines, defending Arizona values, sent most of these donations to Concilium Consulting, as reported by the Arizona Mirror.
Quote, it's highly unusual for an election official such as Richer to, quote, get involved in elections the way he's planning to do and by spending in elections that his office will oversee.
Did Stephen Richard just lie under oath?
That's a felony.
Let's get the exact clip I'm asking.
I'm not accusing him.
I'm asking a question because he just said it was completely false that he started a super PAC that was against Kerry Lake.
I hope Stephen Richer has good lawyers.
Breaking right now, Maricopa County did not reconcile check-ins and ballots against voting-centered PBR chain of custody, resulting in a 17,900, I'm sorry, 17,491 gap in election day ballots.
Election certified in violation of audit requirements in election procedures manual.
Exactly what we have been saying on this show this entire time.
Maricopa, they broke the law.
They are a pack of criminals.
So what do you do with criminals?
Do you just say, oh, try again next time, pal?
You can make an argument that breaking the law in an election is a very high crime because it's a crime that impacts the trajectory of the entire state, of the entire community, of future laws, of measures, of decisions.
It is not the same as just jaywalking or not having your seat belt on.
Someone says, Charlie, is a revote not likely at all?
Then what remedy can be possible in your eyes?
If they're lying under oath, there's got to be a legitimate remedy.
The judge should be upset at this clown show.
Well, Matthew, thank you for your email.
Remember my words.
It is possible that there will be a remedy that will be moral and just, but it is unlikely.
Not trying to be cynical.
I'm not trying to get your hopes down.
I'm trying to be realistic about the current legal system in America, the media pressure, and all the other dynamics involved.
Carrie Lake's complaint is terrific.
Someone says, Charlie, how can this evidence be refuted by the judge?
I think a Navy SEAL lawyer wouldn't be considered low culture.
Well, we don't know.
I don't know how this judge is going to rule.
I don't want to speculate.
I pray he'll do it the right way.
I'm just trying to manage expectations because I do not like hopium, hope and opium mixed into one.
And then every time we get let down, I would love to be proven wrong, but even that I wouldn't be proven wrong because I'm still saying there's a chance.
There is a likelihood.
It is just a low likelihood.
Now, there's a chance the judge says, wow, all these things are terrible.
Okay, Stephen Richer and Bill Gates, you guys are censured and Katie Hobbs is governor.
There really is no roadmap.
There is no blueprint.
Someone says here, Charlie, they never get convicted or charged for lying under oath.
That's true.
That is correct.
Remember, Bill Gates said under oath, the only way is to humiliate Republicans at the ballot box.
This is the guy, I'm not sorry, I'm sorry, it's not under oath.
Bill Gates on radio saying that Republicans need to be humiliated to the ballot box.
Not under oath.
This is a radio interview.
This is the guy that was tasked with running our elections.
Play cut 49.
You said the other day, I think the way back, and I believe you're talking about your party, is by humiliation at the ballot box.
What do you mean by that?
Well, I fear, I fear that if we continue to nominate people who deny the truth, then what may have to happen is that we lose elections.
He's talking about Terry Lake.
That's the guy that is the referee.
He's the umpire of the game.
He's in charge of the rules.
Was Bill Gates aware that machines might fail on election day?
Rents are soaring at unprecedented highs.
Scott Jarrett on Tabulator Disruption00:15:33
If you're renting or have a friend or family member that is, now is a great time to make the move to homeownership.
Look, you got to own renting, that's great, reset stuff.
Andrew Del Rey and Todd of Akian at Sierra Pacific Mortgage have helped so many people make that leap from renting to owning with lots of programs that offer first-time buyers assistance with little to no down payment needed.
I encourage you right now to visit my buddies, their website.
They're great guys.
They're Christians.
They're conservatives.
They love the Lord.
AndrewNTodd.com right now.
The thing I love about these guys is it's not about the transaction.
They're helping you create a plan to help you reach your goals.
Give them a call or go to their website, andrewandTodd.com.
With today's still historically low interest rates, it's easier than you think to become a homeowner.
I've relied on them and producer Andrew has as well.
I highly recommend you take action now.
And if you knew someone paying rent, tell them about Andrew and Todd.
Go to andrewandtodd.com and tell them the Charlie Kirk show sent you.
Cut 50, please.
And we're very excited about how things are going today on Election Day.
We did want to come out and discuss one issue that's going on out there in about 20% of the vote centers.
Again, we have 223 vote centers across the county.
In about 20% of those, when people will go and they try and run the ballot through this tabulator, maybe one out of every five or so of those ballots, they're not going through.
Yeah, so why is it they weren't going through then, Mr. Bill Gates?
Is it because the settings on the machines were changed?
Why is it that they passed the test the night before?
And by the way, it wasn't 20%.
It's closer to 58 to 59%.
Let's pretend it was 50%.
It was at my voting center.
It was at Tyler Boyer's voting center.
It was at Austin Smith's voting center.
I could name Turning Point staff member after Charlie Kirk show staff member, where they saw one after the other, Issue, Stephen Richer is asked in court if he knew that the law required early ballots to be counted at the vote center, and he responded by saying they cannot be counted at the vote center.
Stephen Richer is admitting he broke the law.
Play Cut 51.
I'm not asking you to be a legal expert.
I'm asking, do you know, or do you have an understanding?
Do you have an understanding of whether the law requires that early ballots be counted at the vote center?
Early ballots actually cannot be counted at the vote center because they are governed still by early voting law, which is my domain, if you will.
And we have to do a whole bunch of things before we can properly tabulate the ballot that is inside that early ballot envelope.
And that includes scanning it in.
That includes imaging it.
That includes signature verifying it.
That includes sending it to a signature verification audit queue.
That includes sending it to a bipartisan ballot processing team.
We keep all tabs all through this process such that if somebody, for instance, puts two ballots in one envelope or if a ballot is damaged inside of an envelope, that will be marked by the bipartisan team.
And that's actually what I spend a lot of my time on Thursday, Friday, and Saturday in that big room doing.
Sounds sort of nervous, doesn't he?
Kerry Lake has just tweeted.
Scott Jarrett suggests that Maricopa County produces their own ballots in-house.
Cannot rule improper ballot definitions being an act of sabotage.
Maricopa County refuses to classify what occurred on Election Day as a disruption, claiming the widespread failure of printers did not affect voting trends at all.
By the way, we know this is a lie.
We have text messages from Stephen Richer that show this is a lie.
Stephen Richer texted Tyler Boyer, and he said he anticipated 400 to 450,000 people showing up and voting in person on Election Day.
That number was closer to 270,000.
We have those text messages to Stephen Richard.
Now they're not under oath, but you're lying.
That's not the truth.
You told Tyler Boyer that you were anticipating 350 to 450,000.
I saw the lines in Anthem.
By the way, do we have the lines of what happened in Anthem?
Three, four-hour waits in Anthem, two-hour waits in Sun City, one hour wait in Queen Creek.
That's not a disruption.
If this happened in black neighborhoods, they would call it a lot more than a disruption.
Play cut 52.
So you don't believe that what happened on November 8th was not a disruption in the election process.
I do not catch it.
Are you aware that Supervisor Gates came out on election day and said 20% of all vote centers were affected by these issues, the ballots being rejected by the tabulators?
And we didn't have ballots rejected by tabulators.
They were not being read and by tabulators.
But that's not a disruption when voters still have ballot options to participate in dropping in those ballots in our secure door number three.
This guy is named Scott Jarrett, and he says it's not a disruption.
Let me tell you why it is a disruption, Scott Jarrett, because people don't trust these machines and they shouldn't.
They want to see their vote counted right then and there.
So therefore, when their ballot will not be read by the machine, all of a sudden it creates lines.
Scott Jarrett is so arrogant, so smug.
Oh my goodness, I have other words for him.
He knows exactly what happened on that day.
Conservative Republicans were disenfranchised and he's thrilled.
That's, yeah, it's not a disruption when tens of thousands of people are unable to vote.
One testimony after the other.
Charlie, I voted on Election Day.
It took me two hours to end up voting.
I saw at least 500 people leave line in disgust.
500 people, but that's not a disruption.
Remember, based on modeling, they were overwhelmed by Election Day turnout and they probably did not have enough capacity.
You add disruptions, you're guaranteed to disenfranchise thousands, if not tens of thousands of voters.
And that's not a disruption.
Why are people so angry about this topic?
Why are people so fired up about what happened in Maricopa County?
It's not just that they did something wrong.
It is their unwillingness to acknowledge that anything went wrong.
Not even that they did anything wrong, that anything was wrong at all, that it's somehow acceptable and that it is normal to have three hour voting lines.
They will not own it.
In fact, it is so creepy and Orwellian.
So you walk into the room and you ask your kid, hey, and they have cookies all over their mouth, how many cookies did you eat?
And he turns up to you and he says, I didn't eat any cookies.
You did.
No, no, no, I could see the cookies on your mouth.
No, no, no.
You ate the cookies.
It's the exact opposite.
It's total and complete psychological projection.
They won't say, I'm sorry.
They won't take responsibility.
They won't own it because they know if they do, there is massive criminal liability for them.
And there should be.
What should the penalty be for disrupting an election?
What should the penalty be for not allowing people to vote in the matter of their choosing?
Someone says, Charlie, what do you feel the outcome will be with all of this?
Do you think the judge will see through them?
All right.
Let me just reiterate.
I pray that this gets resolved in a way that will administer a new election.
That is not impossible, but it is very unlikely.
What is likely, but what would be tragic, so what is likely is also what is tragic, would be the following.
The judge says, okay, you guys then follow some laws.
You're ordered to fix them next time.
Katie Hobbs is governor.
That is likely what will happen.
Judges are risk averse.
Now, hopefully these appeals will keep on going up and up and up and up.
And I pray for a miracle here.
I truly do.
Let's go to another piece of tape here.
Let's go to, we're still actually tabulating some of these.
Scott Jarrett was testifying that what happened was not disruption.
Bill Gates said 20% of all the vote centers had ballots not going through tabulators.
Bill Gates also said the only way that the Republican Party can get back to a place of normalcy in his mind is through humiliation at the ballot box.
You factor all these things together.
Keep my microphone on this.
This is, according to Scott Jarrett, there are no disruptions.
Let's play Cut 53.
I will continue to narrate over it.
This is the line in Anthem, Arizona.
That is in the northernmost part of Maricopa County.
Let's play Cut 53 and keep my mic on as I, this is it.
This is not a disruption.
Look at this.
Look at these lines.
How many of these people ended up going home?
According to sworn testimony, hundreds of these people ended up saying, you know what?
Forget it.
I'm going home.
Waste of time.
Lines and lines and lines and lines.
Why?
Because of Stephen Richer and Bill Gates and this guy, Scott Jarrett, who say this is not a disruption.
No, this is more than a disruption.
This is an unmitigated sabotage.
And what they are doing in court right now, lying under oath, misconstruing the truth, covering things up, is an attempt to try to get away with it and acknowledging and admitting they broke the law.
Someone says, Charlie, why don't you call the judges corrupt?
Well, we don't know how they're going to rule yet.
So I'm giving you a prediction of what is likely.
And once we see what happens, then I'll give you my opinions.
I'm not going to speculate in the future of what has happened because we don't know yet.
We don't know if that's going to happen and what is how things are going to result in, how that's going to result in, I should say.
Someone says, how can anyone in charge of Maricopa County not know the printer issue and paper size issue happened?
They just continue to be in the dark so they can do this over and over again.
No, they're lying.
They know what happened.
They are lying.
Now, will they be held accountable for lying under oath?
Also, extremely unlikely.
This person says, Charlie, can these lawyers be disparred for their part of the coup, similar to what Democrats do to our side?
They can be, but they probably won't be.
Update: Maricopa County has just said that they were unprepared for Election Day.
The question is: was the lack of preparation deliberate or intentional?
Now, we can go dig up our tweet, Ryan or Andrew, or Blake.
Can you go find my tweet that I sent out to Stephen Richer?
We said this and we were ignored and we were laughed at.
And Stephen Richer said that we were wrong.
And we tweeted out weeks ahead of time.
Are you guys ready for the volume of people that are going to show up on Election Day?
We don't know.
Who changed the machine tabulator settings?
Who changed the printer settings?
Why did they pass the test the night before and they started at 58% of locations fail on Election Day?
Why is it that Bill Gates said everything was just fine and he said, just go put it in box three, which is against the law?
Why is it?
Someone says, sorry, but Carrie Lake's attorney is lame.
We need a bulldog.
We get one opportunity.
And is this the best that can represent us?
Well, look, I'm going to defend them.
They did get this to trial.
So good for them.
We'll see what happens from there.
But getting it to trial is no small accomplishment.
It's a big deal to even be able to have a day in court.
Also, Abe Homeday's trial, I don't think is happening yet, but will be, was approved from they ignored or they did not acknowledge the attempts for dismissal.
And Abe Homeday is going to trial as well.
Abe Homeday, only 500 votes separates Abe Homeday from a Democrat attorney general.
So what consequences can there be?
Well, I could tell you what should happen, but what should happen, what will happen are typically two different things, especially in the country that we're living in.
I want to play another piece of tape here.
Very important.
And I think we played this earlier, but it's worth playing again.
I just can't believe this.
Scott Jarrett says what happened on election day was not a disruption.
Not only are they lying, they're calling you a liar.
Think about that.
That's worse than lying, isn't it?
What is worse than lying?
Calling you a liar.
Play cut 52.
Had legal and ballot options to still be able to participate within our voting locations.
So I don't agree.
What not catch this is a disruption.
So you don't believe that what happened on November 8th was not a disruption in the election process.
I do not catch it.
Are you aware that Supervisor Gates came out on election day and said 20% of all vote centers were affected by these issues, the ballots being rejected by the tabulates?
And we didn't have ballots rejected by tabulators that were not being read and by tabulators.
That's not a disruption when voters still have ballot options to participate in dropping in those ballots in our secure door number three.
It's not a disruption.
He's calling you a liar.
You didn't experience three-hour lines and anthem, you silly citizen.
Instead of saying, look, this is all 90% of the anger towards him could be ratcheted down if he said, look, man, election day was not ideal.
It just wasn't.
It wasn't how we want to do things around here.
We acknowledge it and we're embarrassed, but nothing bad happened.
Nothing evil happened.
If he said that, his sympathy ratings would go up.
Instead, there was no disruption.
Why was there disruption?
Everything was fine.
It was perfect.
They're calling you a liar.
