We're going to hear arguments, as Evan said, three hearings over the next few days.
But tomorrow it's arguments for an evidentiary hearing.
This all comes down to a request by Trump's team.
They want to get Jack Smith fired, get rid of him as special counsel, say it's invalid in the Mar-a-Lago case.
So what's really at stake here?
So, nothing really, in the sense that the law requires that she validate Jack Smith's appointment and, you know, not disqualify him.
You know, the jurisprudence on this goes back to 1988, when the independent counsel statute, which preceded the special counsel appointments, when the independent counsel statute was fully vetted in the Supreme Court and upheld.
You know, the D.C.
Circuit has upheld the special counsel appointments.
As Evan pointed out, other district court judges have done it.
This has been routinely litigated.
It's not going to be routinely litigated tomorrow.
I mean, the mere fact she's having a hearing rather than just denying the motion, as Judge Shilin pointed out previously on CNN, It's silly.
The fact she doesn't deny most of these emotions without a hearing is silly.
The fact that Trump can get a hearing, you know, on the flimsiest argument is shocking.
But the other thing that's more fascinating about Tamar is, you know, she's not just listening to the parties, Tamar.
She's opened this hearing, you know, to outsiders, people not even participating in the litigation.
are going to have a chance to say their piece.
The worst thing that could happen to her is that she actually does rule for Trump on this because that would go to the 11th Circuit and then I think this petty partisan prima donna would be put in her place and they would remove her.
All right.
Petty partisan prima donna alliteration at its best.
Ty, thank you.
Look, the argument from many is that Cannon is dragging this whole thing out for no good reason.
But I know, Ken, that you have reporting on how some of her defenders are disputing that argument.
How do they see it?
Well, they say that what's wrong with having a hearing and being extra careful in a case that's this high profile and under this level of scrutiny?
It just shows that she wants to get all the evidence into the record.
And it's hard to argue with that.
But one interesting sort of element of all this is that federal judges have magistrate judges below them where they can share the load and allow those magistrate judges to rule on some of these motions.
She has chosen not to do that at all.
This is the primal scream of a dying regime.
Pray for our enemies.
upon herself, which means it takes that much longer to plow through all these motions.
And so that's the thing where it's not about whether she's having hearings, it's about
the workload.
She's taking it all on herself and it's taking much longer hours.

A lot to go through on the legal side today.
The lawfare against President Trump.
We're going to start with the great Julie Kelly.
You heard Ty Cobb last night calling her a petty Judge Cannon, a petty partisan prima donna.
Tell us what happened today, actually, in the courtroom.
Where do we stand on this?
Is Jack Smith going to be removed?
julie kelly
Well, first of all, let's address that.
I've been at that courthouse multiple times.
I'm pretty sure I've never seen Ty Cobb there.
And as you know, these proceedings are not accessible in any other way except going to the courthouse and observing in person what's happening there.
So again, you have these, well, talk about partisan lawyers.
He has no idea what's happening in this case.
He has no idea how she conducts her business today.
By all reporting, unfortunately, I couldn't be there today.
I'll be there next week.
She gave very deep, she was really grilling both sides.
Very detailed manner, which is really her approach to all of this, and pushing both the defense, Trump's team, and the government to explain their positions.
And as to the unconstitutionality, I guess in one point she said the special counsel's appointment required a broad, malleable reading of the Constitution.
On the flip side, she kind of pushed back on Trump's team as to whether Uh, uh, saying that, uh, Jack Smith was not a superior officer that the DOJ routinely hires, uh, and retains other attorneys outside of the assistant U.S.
attorneys to conduct investigations and, and handle prosecution.
So this was, it's hard to tell, Steve, because I wasn't there and you're only relying on the reporters who were there, what they choose to post.
I will be purchasing the transcript as soon as it's available.
So I'll be posting that, making that available so people can read through.
But back to this continued criticism, demeaning Judge Cannon of people who are completely ignorant about this case and how she handles them and what happens in her courtroom.
So we're supposed to, what, not think that a judge in this position on precedent and criminal indictment against a former president That she does not have a responsibility for transparency and a full vetting of all of the accusations that Jack Smith has made.
So Jack Smith is just allowed to make all of the accusations and his indictment all stand up there and, you know, in June a year ago and explain this indictment and how Donald Trump threatened our national security by hoarding national defense information at Mar-a-Lago.
And so he is supposed to be able to control the narrative, but the defense is supposed to what?
Have both hands tied behind their back.
That's what the Ty Cobb and Andrew Weissman, Rachel Maddow, all of these Democrats and state-run media, state media, want the American people to believe.
That somehow she is the villain to the rule of law and fair judicial process instead of one of its most stalwart defenders.
Uh, which she definitely is.
But of course, today's hearing is only the beginning.
Next week we can talk about this, a more hearing.
And then I'm assuming next month, the big bombshell series of hearings about that, um, scope of prosecution motion, uh, for more evidence that demonstrates collusion with the Biden White House, including his general counsel.

Let me go to that.
The real hearing on this, what you call the scope of prosecution, was supposed to take place next week, I think, the 26th, 27th, 28th.
That has now been pushed because of these motion schedules.
When do you believe that will take place now?
julie kelly
Well, I have to believe, considering the holiday and July, and I'm sure that, you know, people have travel vacation schedules, that she will be Scheduling that series, that was supposed to be three days of hearings, Steve, as you recall.
I broke that news on The War Room as she posted her motion vacating the trial date and then setting these three days of hearings.
So I assume that will be mid to end of July.
But next week we still have some interesting motions.
She will hear Jack Smith's argument for a gag order, which would prohibit Donald Trump
from criticizing law enforcement involved in the unprecedented armed raid of Mar-a-Lago,
but also the totality of the investigation.
So I will be there Monday to hear that.
But then Tuesday, two key defense motions will be argued.
One is the defense motion to suppress all of the evidence collected during the Mar-a-Lago raid
based on the unlawfulness of the application, false claims made in the FBI's application for that warrant,
and FBI agents exceeding even the very broad scope of that warrant.
Furthermore, she is going to entertain, and this was a big bombshell I covered back in the day as well, and that was a former chief judge of the D.C.
Circuit, Darrell Howell, the Trump-baiting Obama appointee, that took the really rare step of piercing attorney-client privilege between Donald Trump and Evan Corcoran, claiming that there is evidence of a crime.
Between the two of them.
Pierce that privilege, forcing Evan Corcoran to produce all of his records, including recordings and notes, turn all of that over to Jack Smith so they can help concoct this case.
And of course, Donald Trump has filed a motion also to suppress any of that evidence, any of Evan Corcoran's records, of course, based on attorney-client privilege and Beryl Howell's ridiculous Order to pierce that that privilege.

If you think about it, just put in perspective, you've got all those motions and some of those are blockbusters.
Plus next week you're going to have Fisher immunity.
Then then then he's then he's sentenced to July 11th and then.
But let's leave the debate aside, because that's like politics.
I'm saying he's sentenced July 11th and they just had the gag order.
Fiat Firestorm, and then you come back later in July and do the scope of prosecution.
You literally, in a 30-day period, if Fisher cuts our way immunity and the scope of prosecution for three days is off, this could be the worst month, worst 30-day period in the history of the Justice Department.

It really could, and that's why they're ramping up these attacks on Judge Cannon, because she has been, as I said, a one-woman wrecking crew.
She almost alone, single-handedly, has turned the table on Jack Smith and this Department of Justice.
And dragging out, yes, she is.
She is very deliberate.
She is a very careful jurist.
She's nitpicky to a point where she will scold defense attorneys or the government if they don't file their motions within a certain number of pages, within double-spaced, in a certain font.
She's very particular.
She does not like sloppiness, which is why she does not Is not a big fan of Jack Smith and his team.
So you're right.
So let's beam this out even further.
Let's say, yes, Fisher lands next week.
Obviously, it will.
1512 C2, which will impact not just 350 J6ers, half of Jack Smith's indictment against Donald Trump in Washington that has been on hold since December 2023, awaiting the Supreme Court's ruling on presidential immunity.
If Fisher cuts our way, which many speculate that it will, and oral arguments seem to hint that very strongly, not only could Jack Smith lose half of his case, this will create a tsunami of motions at the D.C.
courthouse.
Now turning to immunity, if what it looked like the justices were going to, it sounded like during oral arguments on April 25th, If it looks like they're going to kick this decision back to either the D.C.
Appellate Court or Judge Chutkin, who authored that landmark opinion that former presidents are not immune from criminal prosecution, and if they ask either court, the appellate or the district court, to look at the indictment and figure out which elements of the indictment would be covered under presidential authority, obviously, anything dealing with appointments to the Department of Justice would, Or what they believe are outside of the scope of presidential authority, you know, making calls to state election officials, etc.
That's going to take some time, too.
But that will restart activity in either the D.C.

So then Jack Smith is going to have to defend his indictment and say, yes, none of this is covered.
By immunity, which he kind of already has, but if the court says, no, that's not true, you have to prove it up and hold more hearings in Washington about that.
Yeah, this is not the, this is not the summer, fall that Jack Smith and DOJ thought that they would be having.
Let's put it that way.

They never, they never thought they'd get it.
In fact, Lawrence Tribe, I just want to read this and we'll go to break.
I want you to answer on the other side.
One terrible possibility is that while Judge Cannon is hearing arguments today that the whole system of special counsels like Smith for J6 and Weiss for Hunter Biden is illegal.
So SCOTUS is putting the finishing touches on a decision ripping up Smith's entire mandate and possibly undermining all the indictments he has obtained against Trump while it considers ending the so-called Chevron doctrine making the administrative state possible.
That would make the Federalist Society's unitary executive theory a Bannon-like wrecking ball of gigantic proportions that would explain but not justify the delay in handing down these rulings.

You know, what other decision we're waiting for is the Missouri case.
And what the Supreme Court will say about Biden-White House colluding with big tech To censor and silence Americans who are critical about COVID lockdowns and the vaccine, so-called vaccine.

This afternoon, correct me if I'm wrong, a judge, a federal judge in Nevada, I think, dismissed the cases against six of the quote-unquote Trump electors, ma'am.

Yes, it was actually a state case that was brought, so it was Judge Mary Kay Holthus, So brave to do this and you know it just goes to show you Steve that really at the end of the day when you've got the judicial system that's not tainted by politics and is pure on the law and on justice that really that's that's when you see results.
I mean This case should have never been brought.
You know, basically what we had was we had a Democrat AG, very radical Democrat AG that I tend to believe takes his orders from DAGA, which is the Democrat AG Association, more than making his own decisions.
And what he did was he essentially went grand jury shopping, like a lot of these cases end up in, you know, in very in front of radical judges.
And he just, you know, I mean, for lack of a better word, he got screwed because the judge didn't buy it this time.
So I'm very happy.

So how did you guys do it?
I mean, because the electors, whether it's in Michigan, Nevada, Arizona, Georgia.
This was all done to strike the fear in the hearts of MAGA and destroy these people, put them in bankruptcy, put them in prison for decades.
Tell me, how did you guys do it?
This is a stunning victory, ma'am.
How did you guys do it?

It is a stunning victory and really at the end of the day, I mean, it was a question
of jurisdiction.
Look, you had six electors that had nothing to do with Clark County, but essentially what
the AG wanted to do was he wanted to have a grand jury issue indictments, you know,
and in a liberal county, in the most liberal county in Nevada, you know, I won't bore your
audience with the fact that he actually presented lies to the grand jury and failed to disclose
exculpatory evidence to the grand jury because those are just logistics and technicalities.
But really, at the end of the day, what we saw here is a judge that essentially said, I don't understand the nexus between these electors and Clark County.
Why did you bring this case in Clark County?
And, you know, they try to fabricate and the dad that argued this was fumbling all over the place.
And I actually felt bad for him because they teed him up to get destroyed by this judge.
And we knew that this was probably going to be the result because it was so unjust.
So the only way to, you know, correct injustice is to ensure justice.

Is this a template for the rest of the electors in Nevada?
Can you take this template to Arizona?
Is there hope for the folks up in Michigan?
I mean, walk us through this.
Can you expand this?

Well, you know, each case that, I'm sorry, each state that brought their state cases, we've already reached out to the Arizona litigation team and we are more than happy to help.
Look, I mean, you know, I'm not going to take all the credit for this.
You know, I was one sixth of a litigation team and really at the end of the day, our team in Nevada was so strong.
We had We had three Democrat attorneys.
We had three Republican attorneys.
And at the end of the day, really what it comes down to is attorneys that see, you know, the justice system as pure justice and aren't tainted by politics.
Because at the end of the day, if you remove politics from the court of law, justice prevails.
And, you know, we're more than happy.
We might swoop into Arizona.
We might swoop into Michigan.
And Georgia.
And, you know, take the show on the road.
I told my two amazing Democrat, you know, female colleagues that did this case with me, thank you for making America great again.
And they're staunch Biden supporters.
So it was a lot of fun behind the scenes.

You're all over the steel in Nevada.
You're also working with people, not just in Arizona, but nationally.
Give us, on a Friday afternoon, before a lot of people take the weekend off, give us your assessment right now where we are in Nevada, because we must win Nevada.
And where do you think we are in the rest of the country on stopping the steal?
They're going to try to steal it, so how are we doing on stopping it?

Look, I mean, we're filing cases after cases.
The Nevada GOP has never been more aggressive in the lawfare, I think, in the history of the Nevada GOP, frankly, in federal court.
I anticipate a few more cases coming down the pike by the Nevada GOP.
The only way to fight fire with fire is essentially Scorch, the Mark Elias machine, and really that's what we
intend on doing from here on till November.
Nevada is winnable.
It's at play.
It all comes down to how much money is going to be spent, not necessarily on the lawfare,
but on the boots on the ground.
Turning Point is doing an amazing job here.
And I think we can deliver Nevada for President Trump.

So, um, this, this case, this dismissal makes them look impotent and he should be embarrassed that his is the first elector's case to get dismissed.

What's your assessment of what happened in Florida today?

Steve, honored to be with you, honored to be with the posse.
My assessment is that the special counsel's got a real problem, because on one hand, they want to say they're independent.
On the other hand, they're saying that they've been overseen and are being monitored and controlled by the attorney general, by Mayor Garland, and you can't have it both ways.
And Judge Kannon, very astutely, she pointed to that and really pressed them for an answer.
And her lawyer, just like he was unable to answer questions in front of a friendly panel, in the DC circuit on immunity, he fell apart in front of
the fair judge, Judge Kannon.
And so I can't really speak to that.
So they are again trying to skirt the reality, which is, as we know, that Crooked Joe Biden,
Merrick Garland, are absolutely controlling these weaponized witch hunts.
These are Biden witch hunts against President Trump in Florida and DC, in New York and Georgia.
And they're completely falling apart like the rotten house of cards that they are.
And by the way, Attorney General Mukasey was in Florida today as part of an amicus brief that is arguing the fact that Jackson wasn't even duly appointed, and she can't even be duly paid for under appointments and appropriations.
So a ton going on there.
All wins for President Trump and MAGA.
And then politically, obviously, the polls are absolutely Shocking in how much they show the disdain of the American people for the Biden crime family and for Joe Biden.
No matter how hard Fox News tries to rig their polls with Democrats, they can't hide the fact that the American people want President Trump back in office as soon as humanly possible.

You know, and like Politico's lead story says, this city may decide the 2024 election.
And they said the black community, if they take the temperature of the black community in the city, Joe Biden's got a big problem.
It's Milwaukee.
And you read this article, it's devastating to Biden.

The other thing, Boris, they had this meme or they had this this kind of thought.
That there was a fundraising deficit that President Trump could never overcome.
Remember, they rubbed their nose in that for month after month after month.
What's the status of that, sir?

Crooked Joe Biden on the cash crunch and crushing him on fundraising,
and both with low dollar and small dollar finances, the fundraising that's coming from the great American

and on the high dollar fundraising for groups that are supporting President Trump's re-election.
What is that speaking to?
No matter how hard Joe Biden and his cabal are trying to hide the reality from the American people
that he is A, illegitimate, and B, decrepit, The American people, all of them, no matter what their backgrounds are, what their ethnicities are, what their economic status is, they are seeing through it and they're backing President Trump.

The gag order has got to come into the sentencing.

The gag order is unconstitutional.
President Trump has been unconstitutionally gagged both in D.C.
And in New York, in the New York AG case and the Crooked Manhattan DA case.
And by the way, Drain Jack Smith, the special counsel's office, are trying to do the same thing in Florida.
They've been unsuccessful.
The judge can and actually chastised them for trying to short circuit the correct process for meeting, conferring, and again, you're going against the rules and the system of justice we have in this country.
These gag order, the gag order in Manhattan DA's case, The one that Judge Marshall, acting just as Marshall put in place, is completely unconstitutional.
It gags the leading political candidate for presidency.
It gags the defendant.
And why is he doing it?
Because he's trying to get the American people not to know about the judge's absolutely debilitating conflict and about how crooked and corrupt that whole case is, from everything from the jury instructions to the fact that they had a complete liar testifying.
And also, don't forget, That this case is absolutely lawless.
President Trump did nothing wrong.
There was no crime.
No crime, no crime, no crime.
And that gag order is part of the reason that that case is a sham and a Frankenstein and an absolute affront to the American system of justice.
And that's why the American people are so disgusted by this weaponization and political interference, election interference against President Trump.

Let's leave the debate to the side for a second, but next week you've got major motions back in court in Florida for three days.
You've got then Wednesday, Thursday, maybe even Friday, historic Supreme Court immunity, Fisher, the Missouri case, five major cases on deconstructing this administrative state, including the Chevron deference.
Your thoughts are of the historic nature of next week with the Supreme Court and the federal courts.

Between next week and the week after, and the term of the Supreme Court may actually
go to the beginning of the week after, first couple days in July, obviously major decisions
coming down on Fisher, the misuse of the obstruction, the Sarbanes-Oxley obstruction statute that
was supposed to be geared against Enron and Arthur Anderson.
They're trying to use that against Americans and President Trump.
So between Fisher, obviously the case of immunity, you cannot have a presidency without immunity,
and a slew of other important cases.
It's going to be a seminal moment in American history as we go into the sentencing on July
11th, and again, the corrupt lawless case in Manhattan, and then right into the convention
where President Trump is going to continue his march to the White House at all of these
events.
Just, you know, history as we've talked about.
Sometimes it takes decades for nothing to happen.
Sometimes decades happen in days.
Right now, history is happening in days.
We're seeing it before our very eyes.
And between all of us, between the MAGA posse, the MAGA movement, which is now the Republican Party, all we can do is continue to fight and continue to do everything possible to bring President Trump back to the Oval Office, January 20, 2025.

What they're doing is they're laying the predicate.
For a, I think, a pretty severe prison term for President Trump.
You can see all day long, they're just they're salivating.
They're talking about this gag order.
They're talking about, oh, these death threats are getting talk about, oh, it's President Trump has done this and his evil followers.
So, you know, gird yourself for what's going to happen on 11 July in New York City, because it is I'm sure it's going to be shocking.
But they're already laying the predicate.
The predicate is that Trump is dangerous.
Trump has put the court in jeopardy.
That Trump's followers are even more dangerous.
So you're going to get this over and over.
This is the mantra.
And I think that has to be pushed back on big league.
We have to take that on.
It's nonsense.
First off, you got these death threats.
You got them?
Show them.
What do you got?
Tell me.
Show me what you got.
Tish James, you know, she's got a big security detail.
Alvin Bragg.
Tell us.
Show us.
Show us what MAGA has done, please.
Please identify MAGA, because you made this now, and they're trying to drive a more severe sentence, and they're trying to drive grasping President Trump, if not remanding him immediately to prison.
To give him supervised release and that supervised release, I believe they're going to say it's very, very restrictive to the point that President Trump will be kept in the New York City area.
And if he wants to leave, that he will have to get permission of the court.
You have to go to Mershon as a supplicant and say, hey, I got to go to Nevada.
I've got to go campaign Nevada and Arizona, these other states.
And it's up to Mershon.
Well, didn't you go to Nevada two weeks ago?
You know, do you really need to go to Ohio again?
This is direct, direct, direct election interference on this is just not even it's not even close, not even a close call, direct election interference.

Is this thing ever going to get sorted out?

Steve, it's getting crazier by the minute.
More irregularities, more resistance to a true and accurate canvas.
We got reports in the Lynchburg Registrar's Office that they've been allowing my opponent to drop off ballots after Election Day that aren't postmarked up through today's deadline at noon.
We've got reports to that effect.
Obviously, we're investigating that.
We still got resistance in the Albemarle Registrar's Office that has fought us every step of the way.
That's the one that started two hours early without notifying me and my campaign, but allowed my opponent's campaign to be there early.
We also have resistance in the Buckingham Registrar's Office.
That's the one that's got allegations of corruption from the past from a hyper-biased Republican chair who's overwhelmingly for my opponent.
So you got crazier stuff by the minute going on, Steve.
We're demanding and pursuing all legal remedies, a full hand count, hand ballot audit.
We've got some other stuff where we're concerned about the election results that we're pursuing to make sure we get to the truth and do everything we can that the will of the Republican voters across Virginia's 5th District who participate in this election is reflected.
We know, by the way, Steve, that my opponent, I had, and McCarthy, they reached out to Democrats and drove Democrats to the polls to try to defeat me.
That's unfortunately legal in Virginia.
Most would say it's not really ethical or moral, but it's legal in Virginia.
And of course, my opponent and his backer, McCarthy, who wasted $15 million, $10 million against me.
We had to spend $5 million trying to fight for me.
That should have been used against Democrats.
Now we're going to have to spend more money on this recount effort, on this hand count.
We're gonna again demanding that their ballots be counted by hand and compared to the actual
results.
Steve, we talked about this before, you had three fire alarms pulled around the same time
that closed down three precincts on election day for about 20 minutes.
We're getting there.
We're we're foiling that information with the respective counties or cities that took
place in Hanover County, Albemarle County, Lynchburg City.
We won Albemarle and Lynchburg, but the people who run those outfits in the cities are not
for me, of course.
And so we're meeting some resistance.
But Steve, we're fighting.
We're pursuing it.
We're giving it everything that we've got.
We've got a team that's working on it.
We've got lawyers at the ready, lawyers helping us now.
This has national implications, Steve.
It's not just me against my opponent.
It's the Freedom Caucus against the D.C.
Swamp.
And my opponent, the people funding him and backing his campaign, voted differently than I did on all these omnibus spending bills, on the FISA reauthorization without a warrant, on borrowing $100 billion and sending it overseas to Ukraine and others, including $10 billion from Hamas.
And they expect something for this money if he ever got to Washington.
He would be owned by the Swamp.
He would listen to the party.
And he would vote very differently than me.
And that's not what the people of the Fifth District want.
