Perhaps the most important fact, the most important takeaway is that Enrique Tarrio, leader of the Proud Boys, was convicted of seditious conspiracy and other felony federal offenses even though he wasn't even at the Capitol that day.
He wasn't even in D.C. that day.
That, my friends, is an important bit of what I'll call atmospheric precedent.
You know why? You know who else wasn't at the Capitol that day?
Steve Bannon, Mike Flynn, Roger Stone, Rudy Giuliani, Mark Meadows, John Eastman, Donald Trump.
They weren't at the Capitol that day.
But to be responsible for the crimes that occurred at the Capitol that day, presence is not required.
Buckle up, fellas.
You know, friends, I sat in on some of the Proud Boys trial, not nearly as much as I sat in on the Oath Keepers trial, but I was in the courtroom for some of the closing arguments.
I heard some of the prosecution's argument.
I heard some of the defense attorneys make their closing arguments.
And you know what my favorite line was?
It didn't come from the prosecutors.
It came from one of the defense attorneys.
He argued to the jury, Ladies and gentlemen, Donald Trump's statements Let's go to the Capitol and I'll be right there with you.
Let's march to the Capitol.
Fight like hell or you won't have a country anymore.
Now go to the Capitol and stop the steal.
The defense attorney argued, ladies and gentlemen, those statements will be government exhibit number one in the future criminal prosecution captioned United States of America versus Donald Trump.
I couldn't agree more with that defense attorney and his argument.
In fact, I think it was prophetic.
...inexorable prosecution.
I said earlier that I never would have imagined mild-mannered Merrick Garland as Inspector Javert in the famous musical, but he has been.
I'm just curious about where you think this might still go.
As Joe said, we have this figure, I'll call him the unindicted co-conspirator, to use the Watergate term, who sits atop this.
Garland has shown that he is willing to go harder and farther than people might have imagined.
What do you see as coming next, surprises down the road?
Remember, David, that unindicted co-conspirator was individual one in a Southern District of New York indictment charging Michael Cohen.
That said, This is a case where you take Merrick Garland at his word.
He said he was going to follow the facts.
That's precisely what they've done.
He said he was going to hold people responsible who committed crimes on January 6th and in connection with that.
And that's what he's done.
I think there's an important point here that folks often miss.
The Department of Justice, by design, has an extraordinarily thin political layer.
Overwhelmingly, the men and women who are bringing these cases in the U.S. Attorney's Office and investigating these cases for the FBI, overwhelmingly, are career prosecutors and investigators.
This is what they do.
And they're good at it.
Now, Garland deserves the credit when they do it well, and he deserves the blame when they do it poorly.
But there is an inexorable march toward justice here because career prosecutors and agents are following facts.
To Ken's point, there's a lot of witnesses out there.
You know, I know this not as a criminal, but as a former prosecutor.
Committing crimes and getting away with it is extraordinarily difficult.
As an example, you know, the ongoing investigation at Mar-a-Lago regarding the documents and perhaps the movement of the documents, the obstruction of the investigation.
There's a lot of people who know stuff about that.
You ask those people questions and you follow the facts.
Well, Tim, on the topic of the courts, what is your reaction to the latest revelations about Clarence Thomas?
And then do you want to put a wager down on when you think Senator Feinstein will return to the Senate?
Well, I'm jealous, a little jealous of Clarence Thomas.
I guess I don't want to breathe very many rules, but it must be nice to have a billionaire sugar daddy paying for tuition, paying for your mom's rent, you know, taking on private jets.
It's a good gig if you can get it.
Look, I think the latest from the Washington Post, though, is the most troubling thing yet, in all seriousness.
If you look at this deal between Leonard Leo and the Federalist Society, where he tells Kellyanne Conway to pay Jimmy Thomas, but not to report it.
I mean, that is a direct, possibly, violation of the law, certainly another example of corruption.
And look, I just, I don't think anything's going to happen because there's no way that the Republicans are going to push Clarence Thomas out while Joe Biden gets to nominate the next Supreme Court justice.
And there's no way to get 66 or whatever it would be, 67 votes in the Senate to impeach Clarence Thomas without Republicans.
So it is obviously corruption.
The Republicans have shown they don't care about that.
They didn't convict Donald Trump after he tried an insurrection.
I just, I don't see them convicting Clarence Thomas over this.
So there is a huge domestic terrorism problem in this country as the Department of Justice and the FBI understand.
That is one of the reasons, as was just noted, this is such an important victory for not just the Justice Department.
but for all of us to combat the idea that you can not just voice your opinions, but you can do so through violence.
This is now the 14th conviction of the most serious charge, seditious conspiracy, where we had nine convictions with respect to Oath Keepers.
We now have had five convictions with respect to the Proud Boys.
It amps the pressure up on Jack Smith because so far the leader, the person who caused all of this to take place, has not yet been charged.
And so the question of should there be charges against the former president becomes one that I think answers itself when you see people, lower-level people, such as people who were just convicted, being brought to justice, but you don't see the leader yet.
I want to make sure that the Department of Justice feels that pressure today.

We've got a lot to go through the day, so buckle in.
And we've got to start with, and I want to make sure people understand exactly what's going on here.
They can't stop the Trump movement.
They can't stop you. And they're infuriated that you have a say-so in your country.
They're particularly infuriated that you know how to use leverage.
Okay? So it's driving them mad, mad that you have a say-so.
Particularly your head of the creditors committee, New York Times today, lead editorial on the Times, from Paul Krugman, who won a Nobel Prize, was awarded a Nobel Prize, talking about minting, I'm not kidding you, in the pages of the paper of record of our beloved republic.
Printing the $1 trillion platinum coin to make sure the MAGA extremists can't get spending cuts.
We're going to get to all that.
But here's the point. The polling, you know, and Trump is grinding up.
The primary's over. There aren't going to be any debates.
You know, the RNC's got Dave Bossy got to wake up here and understand what's going on.
Trump's numbers are now, they've shocked the establishment and the apparatus.
I think Harvard-Harris has him up.
I think it's 45, 41.
Rasmussen, 47 or 48, 41.
The key number is the bottom number there, the denominator.
That would be Biden. Biden is hanging around in the low 40s and not moving.
And these are the best numbers he's ever going to get because this economy is cratering around us as the regional banks balance sheet implode.
So the only way they're going to stop Trump is law fair.
The only way they're going to stop these great judges that President Trump nominated for the federal bench in the Supreme Court is to come at them and either scare them with assassinations, not protect their homes, everything.
There's never been a court.
There's never been justices. And this is one of the most organized, well-orchestrated hits I've ever seen on one of the finest men in America.

But I want to talk about the J6, what's happened here in the last 24 hours.

He sounds just like a Valley Girl.

That's an L.A. joke for people from Los Angeles.
Mike Davis, your thoughts, observations about what's really happening here?

So first, I want to thank the Manistee County Republicans for having me come out and do their Lincoln Day speech last night.
It's a 6,000-person town and 200 of them showed up.
And we talked a lot about this weaponization of our justice systems, our politicization and weaponization to go after Trump, Trump, Trump's top aides, Trump supporters.
Now they're even going after conservative Supreme Court justices.
People need to understand that this is lawfare.
That's They fear they can't beat Trump in the polls in 2024.
So they simply indicted him in New York with Alvin Bragg's bogus case against Trump, and they're going to indict him down in Fulton County, Georgia, and Jack Smith's going to indict him in D.C. So this is lawfare.
It's unprecedented what the Democrats are doing.
These charges are bogus.
Remember what happened on January 6th.
The protesters had a permit from the National Park Service to protest on January 6th.
The Electoral Count Act of 1887 specifically allows presidential candidates to object to presidential elections.
So does the First Amendment.
It is only a crime to object Two presidential elections in third world Marxist hellholes.
And what happened on January 6th was a protest, got out of control, and turned into a riot.
It was not a seditious conspiracy.
It was not an insurrection.
Do you think that every grandma who showed up and walked into the Capitol and took selfies on January 6th was part of some seditious conspiracy or insurrection?
No, it was a protest that got out of control.
And remember, Democrats are the kings of protests that got out of control.
We had BLM and Antifa riots destroy our country for months.
They attacked the White House.
They attacked The Portland Federal Courthouse on a nightly basis.
They took over federal land and shot at cops.
They burned St. John's Church.
They attacked Senator Rand Paul, a U.S. Senator, leaving the White House.
Let's talk about dangerous riots.
They weren't charged with seditious conspiracy.
They weren't charged with insurrection.
They were barely charged. Many of them got amnesty.
Many of them, the charges were dropped.
But this is the Biden Justice Department They're politicizing the justice system, working with local DAs, these woke Marxist DAs around the country.
They're trying to take out Trump because they fear they can't beat him in 2024.

Well, I mean, this is the same Merrick Garland who authorized an unprecedented, unnecessary, and unlawful home raid on a former president to go get documents that the Justice Department was not entitled to go get because the Presidential Records Act specifically allows a former president to have his presidential records in the office of former president, which is funded by Congress and protected by the Secret Service with staff, And security clearances and skiffs.
Yes, we dodged the biggest bullet ever when my former boss, Chuck Grassley, blocked Merrick Garland to the Supreme Court and then Trump won and put my other boss, Neil Gorsuch, on the Supreme Court because it would have been a much different country if Merrick Garland were on the Supreme Court.

Okay, welcome back. Brother Davis, walk me through the Supreme Court, one of the most important institutions in our nation, and probably the world, from time immemorial, and now just a relentless assault.
The audience has to understand something.
This is a political war, and our opposition will use any means necessary to win and to have control.
And we don't. We don't.
What they're doing to the Supreme Court and what they're doing to Justice Thomas is one of the most organized hits I've ever seen in my life.
And I've seen a couple of organized hits.
Maybe run one or two in my life.
This is pretty awe-inspiring.
They're coming at every different direction.
They've done years of research on this.
They've weaponized it. And it's all to take out Justice Thomas.

Yeah, we talked about this last night at the Manistee Republican Lincoln Day dinner.
Look, for the first 150 years of our republic, the Supreme Court understood its critical role was to keep the federal government in check to protect everyday Americans from government overreach.
And government breakdown.
And that was perfectly well understood until about 90 years ago.
And when the Democrats threatened to pack the Supreme Court because the Supreme Court was striking down FDR's New Deal program as unconstitutional, then there was the switch in time that saved nine.
And they threatened to put Six more justices on the nine-member Supreme Court, this liberal supermajority to make sure that they rubber stamp everything that these politicians in Washington wanted to do.
And for the last 90 years, we've seen how badly that's turned out for our country, where we have the federal government that's completely out of control.
Our founders would be stunned to find out what they have created with our federal government.
We flipped the Constitution on its head.
And said the federal government has unlimited powers, essentially, instead of limited powers that are enumerated in the Constitution, then we have this administrative state where this fourth branch of government thinks it's the legislature, thinks it's the executive branch, and thinks it's the judiciary.
It's just gotten out of control.
The Supreme Court has changed.
President Trump transformed The Supreme Court with the appointments of Justice Gorsuch, Kavanaugh, and Barrett, and it's the first constitutionalist majority on the Supreme Court in nearly 90 years and they're on the verge of rolling back the federal government.
We have the Chevron case this term where hopefully by July they're going to overturn Chevron deference and put a major check on these administrative agencies and that's what the Democrats fear.
That's why they're doing this organized campaign to go after the Supreme Court.
They're trying to delegitimize The Supreme Court justices so they can destroy the Supreme Court.
Either cow the justices to rule the way the Democrats want, or destroy the Supreme Court with court packing, impeachment, jurisdiction snatching, Term limits, and that's what they're trying to do.
They have hated Clarence Thomas for 40 years since he escaped the Democrats' plantation.
Jenny Thomas, his wife, never worked in the Democrats' kitchen.
They've tried to destroy the Thomases for 31 years that he's been on the Supreme Court.
It's not going to work.
They're only going to embolden the man.
And it's the Clarence Thomas court.
President Trump delivered from the 5-4 left of center court to the 5-4 Clarence Thomas court.
And it is the last line of defense protecting Americans from these politicians, power grabs and tyranny and anarchy.

I want everybody in the audience to understand, because this is going to be a major strategic element when we talk about saving this republic and taking the country back.
And what Mike Davis walked you through this morning is absolutely of the highest.
It's one of our, this in the parental rights, the stopping, not just the woke agenda, but specifically as part of that woke agenda, this out-of-control transgender ideology and all the grooming.
In the schools and the libraries with these activists called teachers.
Those are two on the domestic side.
The economy and the war of geopolitics are also massively important.
Don't get me wrong. But these two, the courts and the parental rights, are what firing people up.
Trump comes out of nowhere, gives a list of 20 judges he's going to put up, including Gorsuch, who nobody knew at the time, because of his brilliance In understanding how to deconstruct the administrative state, nobody really knew this guy except people inside the system like Mike Davis who knew he was a brilliant, brilliant Alito-like, Scalia-like intellect and writer.
You had that upset kept Garland, you know, they would have ruled forever with the Clinton administration.
This is the power of Trump's victory in 16.
Then you had these two decisions by the Trump court and Mike Davis was there to shepherd These amazing justices through, and remember the Kavanaugh fight, and I said, if you look at the Kavanaugh fight, when it was over, they ran across from the Capitol, the Supreme Court, remember banging on the doors?
I said it was just like the French Revolution.
That was the signal right there.
They were off the chain. And they've got two aspects of this.
The emotional, which is the Dobbs, right?
Which gets all the emotion.
They got all the emotion of their shock troops in the streets on the Dobbs and abortion and all these.
But the one that they really fear, the smart money, the West Virginia decision, and now putting Chevron on the agenda, when you have brains like Kavanaugh, you have brains like Gorsuch and Alito, it's game over.
You have to have a multi-pronged attack to deconstruct the administrative state.
You have to come at it in multiple ways.
But the one way we have to do it is the tip of the spear is illegal.
Mike Davis, this is why, and I'm telling people right now, you ain't seen nothing yet about what they're prepared to pull on Trump.
And this is why I'm telling them, there's not going to be a primary.
There's not going to be a primary.
I don't care what Asa Hutchison and Chris Christie and, you know, and Vivek, good guy, don't care.
Nikki Haley, don't care.
Tim Scott, nice guy, love the story, don't care.
We're at war. And they're coming, and the only way they're going to stop the onslaught that we have set up for them, and the Lisa Monaco people know that, hey, they're going to be looking at jail time for what they've done once we get into the records, Lisa, Sequoia, what you're hiding, Lisa, Sequoia, they know it.
And these people know how to play Smash Mouth, do they not, Mr.

All they care about is power.
And like good Marxists, they're willing to put in prison their political enemies and the supporters of their political enemies.
Now they're going after the judges, the Supreme Court justices who are in their way.
This is a transparent Attempt by the Democrats to destroy anything that gets in their way.
And remember, these Democrats who pretend like they care about separate branches of government and democracy and insurrection have cheered on from the Biden White House and the Biden Attorney General's office.
They have cheered on illegal obstruction and intimidation campaigns outside of Supreme Court justices' homes for months.
They gave a stand-down order To the U.S. Marshals where the U.S. Marshals could not arrest these illegal protesters for obstruction of justice under 18 U.S.C. 1507.
And the people in the know understand that this stand-down order almost certainly led to Justice Kavanaugh's 1 a.m.
assassination attempt against Kavanaugh, his wife Ashley, and their two teenage daughters because these U.S. Marshals had a stand-down order and they couldn't tail the guy after he left the front of the house and he went behind the house and almost killed the Kavanaugh's.

I know you've got to bounce, and I appreciate you doing this before you head to the airport.
Justice Alito gave an interview to The Wall Street Journal, which they very rarely do, and this is a guy of the highest moral and ethical standards.
I mean, he laid it out right there about Dobbs, how it got leaked, why it was leaked, and the intimidation, and actually brought up they wanted to assassinate us.
What were your thoughts of Alito's actual comments, which I found stunning, sir?

Well, he's spot on.
There were Supreme Court justices who had to get moved to safe houses after the Dobbs leak, and that was the intent at the Dobbs leak.
There's no question that the law clerk, one of the 12 liberal law clerks to the three Democrat-appointed Supreme Court justices, almost certainly leaked the Dobbs decision.
They leaked the draft decision along with the internal deliberations of the Supreme Court Justices conference discussion.
So it had to have been one of the nine justices or one of the 36 law clerks to the nine justices.
It's almost certainly one of the 12 law clerks to the three Democrat-appointed justices because they had the access and the motive.
And the motive was to get Justice Kavanaugh, Justice Barrett, one of the justices to switch their vote or get them killed.
And that almost played out as planned.

And here's what they also know.
The three liberal progressive left-wing justices they have on there are no intellectual heft, no gravitas, no ability to write an opinion.
They're not only outnumbered by votes, they're massively outnumbered by intellect.

I've met Sotomayor. I know them.
They're very good people. I don't know Justice Jackson.

As for the platinum coin, the law allowing the government to mint a trillion dollar coin was never intended as a way to bypass debt limit extortion.
But the debt limit was never intended to provide a mechanism for extortion either.

It's the out-of-control spending that buries the working class and the middle class more.
