EPA is supposed to be on our side.
So we went, I went to have these explained because they threw so many more aerators as soon as they started digging up the site.
The second, you know, when they were told to pull up the tracks, they said that they are releasing with every shovel full, releasing butylacrylate and other chemicals in the air up there, and it's coming down the creek.
So I have filmed weekly on a weekly basis in this creek since this happened.
And as they're digging, more chemicals are coming.
And when they put these up here, they're spewing chemicals into the air.
So I went there specifically to ask for air monitors.
What is missing right here?
There is not an air monitor by any of those machines.
If this was a regular construction crew, this site would be shut down.
There are kids playing right here, breathing in those chemicals, playing in the creek.
There's no fences. If they have to do this, there should be a cyclone fence and there should be signs, enter at your own risk, where deadly chemicals are hazardous chemicals in the air.
It's, what is the word?
Negligence. It's negligence.

The head of the Environmental Protection Agency says toxic threats he's seen in communities like East Palestine, Ohio are unacceptable in our country.
That whole town is a chemical cocktail, and we're all lab rats.

Today, EPA Administrator Michael Regan testified today before the Senate Appropriations Committee about the agency's budget request.
Regan's comments come as News Nation has learned that residents in East Palestine, Ohio, are dealing with what one expert calls the fentanyl of chemicals.

Questions still remain over who authorized a controlled burn following the Norfolk Southern train derailment three months ago.
News Nation investigative correspondent Rich McHugh is on the ground tonight in East Palestine, Ohio.
Hey, Rich. Hey Elizabeth, the big lingering question here in this toxic disaster is who ordered the controlled release, the slow burn of the vinyl chloride into the atmosphere here?
Norfolk Southern says it was a decision made with Ohio officials and the EPA. The EPA says they were not consulted and this was a decision that they did not sign off on.
Now, we're learning more on who drove this decision.
On February 7th, three days after the Norfolk Southern train derailment in East Palestine, Norfolk Southern conducted what it called a controlled burn, releasing 116,000 gallons of vinyl chloride into the air.

I think that was a mistake.
I'm looking very closely at who made the decision to set the vinyl chloride on fire.
I think that decision will be a major factor.
In the lives of many communities in Pennsylvania and Ohio, not just East Palestine.
On February 14th, Ohio Governor Mike DeWine said he was among those involved in the decision.
We then made the decision to go ahead with the second option, which was the controlled release.
But on March 9th, Norfolk Southern CEO Alan Shaw told Congress this.
That decision was made by Unified Command under the direction of the incident commander.
Who's that?
The incident commander was Fire Chief Drabeck.
News Nation has reached out to Fire Chief Drabeck, but he's not responded.
And it's unclear who had the legal authority to order a controlled burn.
Having him make that monumental decision doesn't seem logical to me.
Further, I was on a meeting with the EPA recently and asked them why they signed off on the decision to do the open burn, and they told me they did not sign off.
The EPA told me that they were not asked about whether or not to do and that they were not part of that decision.
And testimony from Eric Brewer, Director of Emergency Services for Beaver County, suggests it was Norfolk Southern who recommended burning the vinyl chloride.
We learned that Norfolk Southern wanted to do a controlled detonation of the tank car in question.
We were assured this was the safest way to mitigate the problem.
During one of those planning meetings, we learned from Norfolk Southern that they now wanted to do the controlled detonation on five of the tank cars rather than just the one.
This changed the entire plan as it would now impact a much larger area.
In a statement to NewsNation, Norfolk Southern writes, Now,
I've spoken with the EPA and we are expecting a statement from them, but to reiterate, the EPA says they were not consulted and that they did not sign off on this.
The big question is why?

Okay, Thursday, 4 May, year of our Lord, 2023.
We told you we're going to keep hammering for the folks in East Palestine.
We're going to keep hammering because now they are focused around the issues we told you they had to be focused around and everybody's pointing the finger in a different direction.
The EPA has come out with a statement.
I want to bring in Jeff Clark and Jeff was assistant attorney general and charges this kind of entire area, particularly refereeing with the EPA. And he was the one that laid out a couple of months ago exactly what was supposed to happen.
There's still too much fuzziness in nomenclature.
There was a controlled release, quote unquote, into the ditch of the liquid of which they added the different cars because they said if you didn't do that, it was going to blow up and send shards everywhere of iron everywhere and steel.
And then once it was in the ditch, there was a, quote unquote, controlled burn to put it into the atmosphere.
So two things they've got.
Now they focus, as you said, Jeff Clark and the incident commander, but they're sticking it on the poor fire chief.
Let me be brutally frank.
The fire chief, it's so far above his pay grade and his billet to make that decision.
That's just an outright lie.
Talk to us about what we know as of today, Jeff Clark, how you've nailed this, and where do we go from here, sir?

Sure, Steve. Well, thanks for having me on about this, and it's important to just keep hammering this, as you say, for the people of East Palestine.
Let's take a step back and look at how this has evolved, right?
So, Norfolk Southern says that the fire chief was the incident commander.
He made the call to do the controlled burn and the release to the ditch, okay?
That's questionable in and of itself, but that's what they said, and that's what they also told the Senate, right?
Next, We had the folks from DOT, I think, you know, at Pete Buttigieg's attempt to kind of cover his ass, telling CNN that the EPA administrator made the call to, and EPA people made the call to do that controlled burn, okay? Then we have the fact that EPA says they did not do it, that it was Norfolk Southern, okay?
And then we have the Pennsylvania witness you just showed at the end of the clips, Saying that Norfolk Southern did it, right?
So you have like a complete circular motion as to who supposedly did this.
They're all pointing fingers at each other.
And there are two witnesses who say that it was Norfolk Southern who did this.
And then you have the agencies involved.

But hang on. But hang on. Whoa, whoa, whoa.
Whoa, whoa. Stop. Norfolk Southern has no authority in this position whatsoever.
As soon as it crashes, it goes off the rail.
You go to the National Response Center.
Walk me through the chain of command here.
It goes to the National Response Center.
Automatically, by definition, the National Response Center, you have an incident commander.
That incident commander, correct me if I'm wrong, is a senior EPA official.
I just want to walk through.
That is the regulation in black and white, is it not, sir?

That is. So there's a statute on point, as I pointed out before to you, Steve.
It's the Clean Water Act, Section 311, and it specifically directs that the president shall direct all response actions, federal, state, and private.
And then there's an executive order that delegates that power either to the Coast Guard, if you're talking about something that's off on the sea, Or to here, because you're talking about an inland water, to EPA. So EPA is where the delegation rests.
EPA is in charge of how to do the response.
So EPA can't just sit back And let Norfolk Southern drive the train, as it were.
And you have this former EPA official and now EPA itself basically admitting that they did not follow the law, that they let Norfolk Southern do that.
So that's expedient for them because they can try to say, oh, it's Norfolk Southern and point the finger at them.
But it's simultaneously admitting that they did not carry through with their duties under the law.
They violated their duties under the law.
And that former EPA official you saw in the clips, Judith, she needs to talk to the EPA IG as soon as possible to give her perspective about how this should have happened and how the story makes no sense.
She also needs to be interviewed by the criminal lawyers that Governor Shapiro said he was going to sick on this.
So this is, you know, a bombshell piece of new information, Steve.
And whatever way you look at it, EPA either, you know, fell down under their duties under the law or they're just trying to engage in a CYA exercise.

The point I was making in East Palestine is that you pay $6 trillion a year for this.
The EPA is going to be the biggest one that they come out whining about that you can't cut it, you can't cut it, you can't cut it.
What is their function then?
This, I would argue, is their most important function among everything.
As this material event happens, the EPA is supposed to be the on-scene commander.
Yes, they do a lot of things in regulation.
They're checking creeks all the time and checking all this environmental stuff, whether it makes sense or not.
I got that. They're bureaucrats, the administrative state.
But this is where they're called into action in the defining moment.
Right? This is what they're supposed to be.
The task and purpose of EPA in the moment of a catastrophe and disaster is to be the on-scene commander.
The on-scene commander representing the President of the United States.
Correct? This is what they do.
How can they have all this shuffling around and Regan sitting there and he's crying and saying, you know, they're so important.
Our job is. Heck, he was on a plane over to Africa to go on some boondoggle over there on the cult of climate change.
He doesn't give a crap. And who's in charge of this?
Is it the Commerce Committee?
Is it oversight? Why is nobody?
How come these guys haven't been in a keel hall?
And why did the staffs let Norfolk Southern off the hook?
Why did the Republican staffs not already have this vetted?
Heck, if War Room can do this two months ago, why can't congressional staffs do it?
Why are these guys, like, leaning on their rakes, brother?

Well, Steve, look, I think they've been focused on the genesis of the accident and how to try to make sure that you don't have these train derailments.
And that's obviously an important issue, but it's not the only issue.
This issue that we've been focused on and putting our finger on deeply for months has been who ordered this control burn?
And you just heard in the clips you played in the cold open, An EPA official, former regional administrator of Region 2, say, you know, this seems like a mistaken decision.
This is not the right decision to have made.
Did they even do any analysis, right?
This is what the IG at EPA needs to get to the bottom of, and it's also what the Senate EPW Committee should be getting to the bottom of.
It's important for them, you know, to try to minimize and reduce the number of train derailments, but this issue of EPA mismanagement is just terrible.

Jeff Clark. Somebody in the Trump orbit and legal are listening, watching the war room, because they took your theory of the case with Bragg, and they're now trying to take it to a federal court.
Walk me through this. Sure.

So, Steve, there's something I don't think a lot of local prosecutors or even state prosecutors know about, which is there's something called the Federal Officer Removal Statute in 28 U.S.C. 1442.
And Bragg, from that perspective, made the mistake of making his entire indictment about incidents, events that occurred after Donald Trump became president.
And he has this still kind of not fully fleshed out theory of it being tied to getting elected to federal office.
So there's clearly a connection between his indictment And Donald Trump's holding of the highest office under the U.S. Constitution, that gives Donald Trump and his team the right to remove that case to federal court.
And based on New York Times reporting today, it looks like they're going to exercise that option and they're going to pull the case out of the Manhattan court, local court there, and they're going to pull it into a federal court.
And I already saw Occupy Democrats whining about that on Twitter, you know, retweet if you disagree with this decision and think it's a maneuver, etc.
Well, it's a procedural right that Congress granted in order to protect federal officials essentially from being hometowned in jurisdictions Where they may essentially be taken advantage of.
And Alvin Bragg has pleaded himself right into that issue by focusing on events that are all 2017, post-January 20th, 2017, or later.

I was listening to a Russian analyst last night, a video analyst, of the drone attack and he said whether or not this is Ukrainian or Russian is irrelevant.
If this war continues, Ukrainians will take action on Russian soil, which is an interesting analysis.
If you've been invaded by an external force, sooner or later, wars tend to spread in that direction that the invading force pays the price.
So whether or not this drone is Ukrainian is irrespective.
This war will continue thanks to the Holomodor.
The Ukrainians will fight to the last 12-year-old with a sharpened stick.
And as a result, actual, real conflict, not false flag operations on Russian soil probably will be inevitable.

So, there is a huge domestic terrorism problem in this country, as the Department of Justice and the FBI understand.
And that is one of the reasons, as was just noted, this is such an important victory for not just the Justice Department, but for all of us to combat the idea that you can not just voice your opinions, but you can do so through violence.

And so the question of should there be charges against the former president becomes one that I think answers itself when you see people, lower-level people, such as people who are just convicted.

Unfortunately, what he said, so what happened in the Proud Boys trial today, what he's gloating about and what Merrick Garland and Christopher Wray and Matthew Graves and Lisa Monaco had their press conference this afternoon to brag about these seditious conspiracy convictions, four out of five members of the Proud Boys, including their leader Enrique Tarrio.
Convicted of that very rare charge.
They also were convicted on other conspiracy counts, obstruction of an official proceeding.
The jury had some mixed verdicts for some of the lower counts.
But these are huge bombshells and big victories for the DOJ. Not tough to do in the D.C. Banana Republic Judicial And legal circle of hell, I've called it for the past two years.
Very easy to do, especially when the foreman of the jury referred to January 6th as an insurrection during the jury selection process and called BLM basically social justice warriors.
That was the foreperson for the jury, just to give you a taste of what these men were up against.
But look, this is a really tragic day.
This was not an incident of domestic terrorism.
These men were not violent for the most part.
This is a First Amendment case, as are many of the January 6 cases.
But this is just another way for this Department of Justice to retaliate against Americans who protested Joe Biden's election and to criminalize political dissent in this country, which this DOJ is doing very successfully with every trial and every conviction.
But today is their biggest victory by far.

And talk to us about it.
This is not about the Proud Boys.
This is about President Trump, correct?

Exactly right, Steve.
You know, you don't have that press conference, as I said, with the heaviest hitters out of the Department of Justice, so you can brag about getting, you know, convictions for Zachary Real.
No Americans ever really even heard about outside of Washington, D.C. This is, as Weissman said in his California accent, That this is the way to go after Donald Trump for the same charges.
And Jack Smith, I use quotes, Jack Smith, the pretend special prosecutor handpicked by Merrick Garland, will now be armed with these convictions with this same evidence to present to the grand jury now probing indictments against Donald Trump.
But look, Steve, I explained in my pieces on American greatness the reason why The Department of Justice used Donald Trump as a key figure in this case and in this trial.
I was there for closing arguments in D.C. last week.
The Assistant U.S. Attorney, Conor Mulrowe, his first video clip he showed during closing arguments wasn't of the Proud Boys.
It was the clip of Donald Trump from September 2020 in that presidential debate telling the Proud Boys to stand back and stand by.
That was used by this DOJ It's sort of a call to arms of sorts, where the president was instructing the Proud Boys to plan for January 6th, even though nothing had been planned by that point.
But they stitched together this case, not to keep these men in jail for decades, which will happen, but to eventually go after, as you said, the man Andrew Weissman has wanted in jail now for more than seven years.
And that man is Donald Trump.

But what they did in this trial, you followed this closely, and you did great reporting.
I guess they went back to build this because it hasn't been used in, I guess, over 100 years.
They go back to their group chat.
Is that what the evidence the jury saw?
They went back to their group chats about how they were planning this?
I mean, it seems like a reach to be able to get to this verdict.
What did they show in your mind?
The jury, was it dialogue they had?
Was it emails they sent?
Was it a group chat?
Was it actions that they took?
What was it that convinced this jury?

So it was mostly, most of the evidence was gleaned from about 500,000 messages that were collected in this case, including messages, Steve, by an unknown number of FBI informants that the government finally admitted.
At least eight were involved in this group.
I suspect it's probably More like dozens.
But they were also embedded in these group chats talking about the stolen election, talking about plans, you know, to go to D.C., not just on January 6th, but December of 2020 for the Stop the Steel rallies to protect people.
There were clashes between the Proud Boys and BLM and Antifa rioters.
That sort of evidence was presented to the jury.
And so it really was a First Amendment case.
How do you overthrow the government by force, Steve, when you bring no weapons to the Capitol?
When you stop at food trucks on your way from the Washington Monument to the Capitol?
When in Ethan Nordean's case, he walked through doors that had been opened by police as Capitol Police are standing right there.
He's walking there by himself.
How do you overthrow the government by force?
And that's the key terminology there.
When you haven't assaulted any police officers.
I mean, this is the crazy sort of cases, evidence.

Was that all presented by the defense attorneys?
Was all that brought up in the opening statements presented as evidence and then in the closing arguments?

They did. I mean, they did as best as they could to explain that a lot of this was just talk.
One of the defense attorneys described the case as disparate us.

Then what did the government show besides the text messages that convinced the jury that this was a conspiracy?
julie kelly
They showed videos of some of the Proud Boys, Ethan Nordean and Joseph Biggs, at that first breach point.

You remember with Ryan Samsel, the man with the red hat turned backwards, and...
Ray Epps, by the way, made several appearances in the evidence, especially in the last week of the trial.
He remains on charge.
Of course, these guys' lives are destroyed.
They'll be in prison for a very long time.
So they showed videos of them.
They showed videos of them making their own videos, you know, posting on social media, sort of bragging about what happened on January 6th.
So there were some video clips that were presented.
So that is the bulk of the evidence.
But you don't see any of the Proud Boys.
One of them, Dominic Pizzola, is accused of using a riot shield to break a window.
He's the only one charged with destroying any government property.
So this is the sort of really, as another defense attorney said, case built by paper clips and rubber bands.
It didn't matter, though, Steve, because you're going before a jury made up of voters from a city that voted 93 percent for Joe Biden.
I mean, these people have open hostility, contempt for Donald Trump and his supporters.
This trial never should have taken place in Washington, D.C., but Judge Tim Kelly, who's the real villain here, by the way, refused to move this out of Washington, D.C. to another jurisdiction where they would have had a more fair shot at a legitimate trial.
You know, jury selection was going on when the January 6th Select Committee was tallying Congress, holding them responsible.

So I wanted to make that clarification.
But yes, you can see all of the news today.
And I wrote about this. I've written about this and said this for weeks and months.
My piece last week was laying out exactly this roadmap that kind of ended today with these convictions and emboldening Jack Smith to bring these criminal indictments.
I would suspect that that will happen within the next few months.
Sentencing in this case will be in September.
So this is going to be a source of continual headlines for the left and for Democrats against Donald Trump in exposing his legal jeopardy until they finally do indict him.
Now, they could choose not to pursue seditious conspiracy charges, Steve.
That is a possibility.
But he will be indicted.
It's a matter of what I never for a while thought that they would bring seditious conspiracy charges against him, but now with this and then the two Oath Keeper trials where six Oath Keepers were found guilty by a jury on those same charges, connecting all of that to Donald Trump I think certainly escalates that risk for him.
