Well the virus has now killed more than a hundred people in China and new cases have been confirmed around the world.
You don't want to frighten the American public.
France and South Korea have also got evacuation plans.
But you need to prepare for and assume.
Broadly warning Americans to avoid all non-essential travel to China.
This is going to be a real serious problem.
France, Australia, Canada, the US, Singapore, Cambodia, Vietnam, the list goes on.
Health officials are investigating more than 100 possible cases in the US.
Germany, a man has contracted the virus.
The epidemic is a demon and we cannot let this demon hide.
Japan, where a bus driver contracted the virus.
Coronavirus has killed more than 100 people there and infected more than 4,500.
We have to prepare for the worst, always.
anthony fauci
Because if you don't, then the worst happens.
unidentified
War Room.
Pandemic.
Here's your host, Stephen K. Bannon.
joe biden
But, you know, as they study the Omicron variant, we have just two cases reported here in the United States.
But as I explained on money, this new variant is cause for concern, but not panic.
We knew there'd be cases of this Omicron here in the United States, and it's here.
But we have the best tools, the best vaccines in the world, and the best medicine, and the best scientists in the world.
We're going to fight this variance with science and speed.
Not chaos and confusion, just like we beat back COVID-19 in the spring and more powerful variant Delta variant this summer and fall.
As a result, we entered this winter from a position of strength compared to where America was last winter.
steve bannon
Wow.
That feels like speed, doesn't it?
And it sounds like science.
Whoa.
Thursday, 2 December Year of the Lord 2021.
Elections have consequences.
Stolen elections have catastrophic consequences.
I think every minute of every day we see the catastrophe all around us.
It's just so much misrepresentation, so many lies, so much spin, and just buffoonery.
I mean, you don't even know how to take it seriously.
But now he's like hit the... I mean, he's looking for the glide path to land it somewhere.
Amazing.
Nearly 120 million downloads on the podcast and, more importantly, a bigger live audience.
Remember, we're live three hours a day, two in the morning, one in the afternoon.
Very proud of that.
Proud of the team we've put together.
Proud of our contributors.
Some of the regulars, kind of the stock company that you can see.
And also, really love having new guests on all the time to try to bring you the most important issues of the day and the signal, not the noise.
There's so much going on right now because of everything else going on in the in the fear porn and the fear mongering and all this it there is a they have a method and they understand they've bled out political capital the American people have rejected this and some pulling out Boris is going to get into in a second but in all that.
In their arrogance, they're going to try to jam through something here that's more more radical for its time than the New Deal or the Great Society and those kind of the increases in in government intrusion or involvement in your life, however you say it.
This is more radical.
And remember, in 1932, Franklin Delano Roosevelt, and in 1964, Lyndon Baines Johnson, they had mandates.
Whether you like it or not, they had mandates, overwhelming mandates in the House and the Senate, and really with the American people's backing for that time.
Here, you have an administration that has imploded.
Every number says that in every demographic, in every region of the country.
And there's no support for this program.
They kind of keep, oh yeah, huge support for abortion, huge support for every, you know, when they talk about free programs, they never really look, when you look at really the real numbers, there's no political capital for his program whatsoever.
And yet they try to jam it through and you have a few heroic people up there, but I'm not sure there's a playbook.
I think it's kind of chaos and confusion.
So I want to bring in Boris Epstein before we get to some of the polls, which we got to get to in a second.
Where do we stand on the CR?
We got to continue resolution.
Is the House going to vote?
Is the Senate now?
I hear a standoff because the guys, although they've given an off-ramp to approve it, it's pretty tough for them to swallow.
They want to vote.
They want to debate and vote on vaccine mandates.
And you saw what happened in Germany today where they're locking down everybody that's unvaccinated.
If you see what's happening in Australia, they've already done it and they're going to do forced mandatory vaccinations on 1 February and breaking news as soon as we came on.
New York City has just announced the religious schools, the Jewish schools, the Catholic schools, other religious schools, and private institutions, private schools, full vaccinations.
Boris Epstein, where do we stand now on Capitol Hill, sir?
boris epshteyn
Great to be with you, and congratulations on the huge, staggering numbers this show.
Really no words could describe how powerful it is.
How many times I've been honored to be stopped on the street, stopped in a restaurant in Arizona, in D.C., in Florida, in New Jersey, in New York City, by people saying, love you on the war room, send my best to Steve Bannon, and I'm proud to be a very small part of the war room posse.
So thanks for having me on, and it's an honor.
As always, I will tell you on the news you just said, New York City requiring public institutions, including religious institutions, to mandate vaccines that they're going to have a major constitutional problem and and I bet you right now there's a there's got to be a filing being prepared as we speak to challenge that unconstitutional correct me if I'm wrong because the Catholics haven't been as strong on this as some have been very strong there's obviously but hasn't some of the top rabbis in Israel and in
steve bannon
the United States actually put out these edicts that say absolutely under no circumstances can So isn't that right in the grill of the religious schools of the Jewish religious schools?
Because I keep reading people send me with these some of these rabbis have been hardcore say no way can't do it.
boris epshteyn
Here's my view.
I firmly believe that each individual in America and around the world has the right to decide whether to take the vaccine or not.
And I think that constitutionally under the First Amendment To force a religious institution to mandate something.
Is an absolute contravention of the First Amendment and the separation of church and state.
You know, I'm not somebody here who's going to sit and discuss or debate the Talmud and the Torah and what the big book says about whether someone should take the vaccine or not.
That's not up to me.
I'm not that holistically trained.
But what I will tell you, Is that I absolutely believe that a rabbi has the right to tell his flock, to tell his congregation that, you know, I believe that the vaccines are wrong.
Or they have the right to say, yes, sure, go ahead and do it.
That is the very nature of freedom of religion.
That is the very nature of separation of church and state.
So, for New York—I mean, it's not surprising that it's New York, because the liberals over there, you know, have completely forgotten our Constitution.
They pretend that they're living in communist China or the former Soviet Union.
But this is going to be a major problem for the Democrats.
You're going to have people of all of the major religions, people who are not religious and, you know, libertarian, saying, you know what?
You can't force me to do something to my body, or you can't force someone to do something to my child that I'm not okay with.
This could be a major tipping point.
We've talked about this a lot.
The American people, which right now I believe are two-thirds MAGA at least, will not stand If they are mandated, told, forced to do something to their body, which they do not agree to do.
steve bannon
If that's the case, hang on, if it's two thirds, why is it only three senators up here about these vaccine mandates?
You got Cruz and Lee who have forced the government to do this before back in 2013, in August of 13.
and the senator from Kansas.
Right?
So tell me, where does this stand right now?
This budget, we're 24 hours, maybe 48 hours away from shutting down the government.
Pelosi's shutting down Biden's government for no money.
Where do actually we stand on this?
And are there, you say there's two-thirds that back this, where are the senators?
boris epshteyn
Not strong enough.
Need more.
Need Hagerty.
Need Marshall Blackburn.
Need every Republican senator.
Every Republican member of Congress should be standing up and saying they will not vote for one iota, one set of a budget, if mandates are involved, if mandates are included, or if there are any mandates whatsoever.
And we cannot have, and I've got to say this loud and clear, In no way can we have a repetition on the continuing resolution of what happened on infrastructure.
This assumption, well, you know, the Democrats are going to get their act together, so it doesn't really matter.
Let's not go whip votes against.
That is wrong.
That is incorrect.
You think the Democrats are going to all kumbaya together and come out and vote for a CR?
Wrong.
Just like it was wrong on infrastructure.
If Republicans held strong, And did not have the 13 traitors, including Nicole Melia Takis, who I absolutely am disappointed in, and I absolutely refused to support or cheer for at any event that she's at.
And I think we need a major, major, major challenger to her in Staten Island.
Those same 13 traitorous Republicans better not dare.
I think to vote for the C.R.
for the continuing resolution if they want to have a continuation of their political parties.
steve bannon
Boris, is this being whipped right now?
Is Scalise whipping this vote?
I hear Stan does hold the line, and obviously the war room posse is lighting up guys' phones, but is leadership whipping this vote right now to make sure there are no Republicans across the line here in the House?
boris epshteyn
I'm going to put it this way, and as an honest, always signal not noise for you and for the war room posse.
I'm going to give you the honest answer, as always.
I've asked that question a lot in the last two hours.
And I've gotten some happy talk, I have not gotten a direct answer.
unidentified
Which to me says, there's not enough of a whipping operation.
steve bannon
He just gets the answer, it's not being whipped.
boris epshteyn
There's no whip operation.
Right, the answer is in the process, and the answer is no.
steve bannon
The audience has got to understand, if you're not hitting them about the heads, they're not going to do what they're supposed to do.
boris epshteyn
Because they're going to wander off.
We give credit where credit is due, to Kevin McCarthy, to Steve Scalise, we talk about Lee Stefanik a lot.
On this, there is one whip.
The whip in the house is Steve Scalise.
So to Steve Scalise and his operation, I hope you hear us loud and clear, whip against the CR.
There's no two ways about it.
steve bannon
We want no Republicans.
Real quickly, I gotta get into this real quickly because I've got Navarra.
This Trafalgar poll, another poll's out today.
More bad news for Biden.
Give us a highlight reel.
And Denver, you can put some of the slides up if he calls for them.
boris epshteyn
Denver, can we put the slides up please?
This is a brand new Trafalgar poll done from November 26th to the 29th.
Denver, if we could have the slides up.
Very, very important poll.
And what this shows, And this is actually really staggering.
Again, and this is November 26 to 29.
This is weeks after infrastructure passed.
This is after Build Back Baroque, Build Back Worse, Build Back Pathetic passed the House.
Joe Biden's strongly disapproved is at 52.2%.
His strongly disapproved, not combined disapproved and strongly disapproved.
Disapproved is another 18.
But Strongly Disapproved is 52.2.
If you combine Approved and Strongly Approved, the Strongly Disapproved still outstrips it.
It is absolutely staggering.
And then he's got problems with the defendant.
steve bannon
Hold on, hold on.
Slow down, slow down.
You're saying if you add the Strongly Disapproved and the Disapproved together, you're at 70%?
unidentified
52.18?
steve bannon
You're at... No, you're at...
boris epshteyn
It's 52, so with, let me give you the numbers exactly.
If you're at, for independents, you're at 51.2 strongly disapprove, disapprove is at 10, so you're at 60, you're at 60, 10.9, you're at 63 disapprove.
Hold it, hold it.
You're 63% disapproved.
steve bannon
Hold it, hold it.
Independents are 63% disapproved?
boris epshteyn
That's amazing.
29.3% approve, 62.1% disapprove.
Again, let me say it slower, actually.
With independents, 29.3% approve, 62.1% disapprove.
steve bannon
Overall... We told you... Okay, hang on.
Independents is the proxy.
The reason I want to get Trafalgar up today, I told this audience If you put your shoulder to the wheel, the proxy for the American people, independent voters, are going to have a two-handle in front of it.
unidentified
29.3%.
steve bannon
29.3%.
Denver, go to the independent, please.
boris epshteyn
Go to the no party other.
That's the overall.
59.1.
That's the next one.
Right there.
unidentified
Nope.
boris epshteyn
Previous.
Boom.
Nope.
Before that.
I feel like I'm John King.
There you go.
62.1% disapprove.
29.3% approve.
Keep that up.
steve bannon
I want you to hold over.
I'm going to hold you over.
I'm going to get Navarro in here.
I've got to talk about this.
It's a landmark day, ladies and gentlemen.
We told you that number was out there.
He has no, this is a total and complete rejection by the American people of what he has accomplished and what he has done to this country and what he's failed to accomplish.
And they're up here trying to radically transform this nation.
We'll be back in a moment.

The epidemic is a demon and we cannot let this demon hide.

MyPillow.com.
Promo code WARWIRM.
Okay.
I've got Boris.
I'm going to get back to these numbers in a second, but I've got to bring in Peter Navarro.
Peter, from the first cold open, Biden said, I'm going to give you speed and science versus chaos and confusion.
Sir, I hate to be so brutally frank about this, but he's talking about you, that you're the person that does chaos and confusion.
OK, and that's what they had last winter.
And he's giving you speed and science.
What say you, sir?
peter navarro
So I guess if I'm the guy he's criticized, I'm the guy on February 9, 2020, write a memo.
We can get the vaccine done by October or November.
We did it in Trump time, had 150 million doses handed over to the Biden regime after Inauguration Day.
And it was a miracle.
So if that's chaos and confusion, embrace The chaos and confusion.
Now, let's compare the track records.
Biden had the Trump vaccine from day one.
More people, more people have died from COVID under the Biden regime.
Over 350,000.
Then did under the Trump regime and we were in the fog of war.
We didn't know what was hitting us.
We didn't know that it came from this lab here that Tony Fauci built and it was genetically engineered.
So I'll take the Trump record anytime.
What's missing here from the from the Biden plan?
Pretty shocking.
is any mention of therapeutics. Of those 353,000 people who died under the Biden regime, that's like, it's about three and a half rose bowls of people, right?
Well over half of those people would be alive today if hydroxychloroquine were readily available to people through their private physicians.
I had a very interesting conversation with a young woman today.
She's in her 30s.
She's got several children.
She got COVID.
She's got a fairly significant case of it.
She's in her ninth day, not feeling well.
It's the worst thing she's ever gone through.
She was unable to get hydroxychloroquine anywhere in the state of Arizona.
She got a prescription for ivermectin, but couldn't get it filled.
And so she's left with her only protection is an experimental technology, an RNA technology, which is not really a true vaccine, which could basically interfere with her reproductive cycle.
So that's the Biden plan.
And Steve, here's what alarms me.
Germany versus Sweden, Florida versus Vermont.
We have a world now split by by scientism and science.
The scientism is is is this this godless worship of a fake vaccine that's going to make Pfizer and Moderna shareholders rich, but it's likely going to cause endless mutations and not provide adequate protection for people.
steve bannon
We're burning daylight.
peter navarro
I appreciate that.
steve bannon
But you said it's a fake vaccine.
This is the one that you called the Trump vaccine earlier, and this is the one you worked on.
So it's not fake.
It's just not for everybody, right?
peter navarro
It's not a vaccine.
So let me be clear about this.
It's an experimental RNA technology that injects antibodies, a limited number of spike proteins, gets a limited immune response.
And gives you some protection in the short term, but breeds vaccine-resistant mutations.
So yeah, look, President Trump did a great job on this, okay?
But we're using it in the wrong way.
It should only be a measure for senior citizens at risk, high risk of death, and people for comorbidities.
Targeted, as you said, targeted.
I can't say this more.
Flood the zone with hydroxychloroquine, ivermectin, zinc, vitamin D, azithromycin, and all the other things that are coming up as cheap antivirals.
I'm telling you, Steve, more than half of the people that Joe Biden has killed with his policies on COVID would be alive today.
And remember, Fauci was the guy during the Trump administration Along with Han at the FDA and Janet Woodcock, who's the current head of the FDA, and Rick Bright, who killed hydroxychloroquine during the Trump administration.
So, there are literally, of the 700,000 plus people who have been killed here in this country, more than half of them would be alive.
And let's not forget, Steve, we have the highest death rate here of any major country.
Let me say that again.
The United States of America has the highest death rate of any major country.
We've got supposedly the most sophisticated, in quotes, vaccine, but no therapeutics.
steve bannon
But now that you say that, they argue because only 59.8% of the country is fully vaccinated.
peter navarro
It's got nothing to do with that.
There's plenty of other countries with lower death rates with much lower vaccine rates.
It's just total BS.
And I keep saying vaccine, but it's not.
The injectables, the jabs that they put out there, it's not helping.
This latest version, which should have been the Xi Jinping version, They call it an Omnicron instead because they skipped the letter in the alphabet, which is just another kowtow to the world.
People are getting that virus and they've had the jab.
I mean, it's insanity.
People are dying needlessly.
steve bannon
I think the numbers... Go ahead.
Hang on, hang on, hang on.
Slow down.
We've got to get to other topics.
The 29.3% of independents, right now, you're the first one to call stagflation.
They're now saying inflation is at 6%, going to get worse.
Wall Street Journal finally agrees with you.
Powell finally agrees with...
Well, it's not going to increase Joe Biden's popularity.
I saw a PIMCO out there agrees with you.
Everybody agrees now.
He's a twenty nine point three percent approval among independents.
He's got a two hand on front of it.
Where is that going to go?
Dr. Navarro says if they pass this massive spending over the next couple of days, what's going to happen?
peter navarro
Well, it's not going to increase Joe's Biden's popularity.
All it's going to do is throw away this very now expensive gasoline on an inflationary fire.
So it's going to it's going to create more demand, pull inflation.
At the same time, it really doesn't address any of the supply chain issues or the jobs issues.
Remember, Steve, during the Trump administration, when I was working on a two trillion dollar package for President Trump, which Pelosi wouldn't allow us to get past, that was all focused on bringing jobs back to the US, having manufacturing here and therefore supply chain here and therefore resilient rather than fragile.
Supply chain, so this we are at some point.
There's a there's a clip.
I need you to play because because what you and I talked about earlier is that this is the tipping point if they pass that bill.
All hope is lost on the stagflationary front.
I mean, it's bad now, but all hope will be lost, and what you're going to see soon is the stock market crumble under the weight of this, and that's going to ripple through to the pensions, and we're going to be in really hard Time's here really, really quickly.
steve bannon
We're going to try to play it.
OK, Boris, what is the current status, as you see it, on the CR and the Senate version of this?
I know they're going to try to have this side car debate on the vaccine mandates, but are we going to be able to stop and force Nancy Pelosi to shut down Biden's government?
boris epshteyn
I actually just received an update from the House that Steve Scalise's team did send out a very, very specific direction to all the members, to their teams, saying to vote no, to vote no.
On the CR extension.
I have the language right here.
They talk about this legislation would keep current levels until February 18, 2022.
The text was not made available until 8 a.m.
this morning, and now, of course, they want to vote for it.
This is the old Pelosi trick that they've been doing ever since Obamacare and before, right?
Just drop the legislation, nobody ever reads it, and then they want everybody to vote for it.
So, And there is whipping going on on the Republican side, and that's breaking news as of the last five, ten minutes.
There is whipping going on on the Republican side from Kevin McCarthy, Steve Scalise, Elise Stefanik, the conference chair.
Against this continuing resolution.
I hope that it was not just this message.
I hope it wasn't just an email.
That there's more hand-to-hand combat.
Let's put it that way.
On whipping of nose.
We should have zero.
I mean, maybe Kinzinger.
But really, there should be absolutely no votes for this continuing resolution.
Because Kinzinger is not a Republican.
He doesn't matter.
unidentified
The Cheney actually hasn't been voting on these things.
steve bannon
But there should be...
boris epshteyn
Zero real Republican votes on the U.S.
unidentified
election.
steve bannon
Need the posse now to get on there about their congressman.
Okay, Peter, real quickly, what's your social media?
We're going to put your... Peter called the stock market short about, what, two weeks ago.
Peter, what's your social media handles?
peter navarro
Real P. Navarro on Getter, the Twitter killer.
Let's just focus on Getter for now.
I'm still on Twitter, but go to Getter.
There's just much more engagement on there.

of the War Room apparatus by going to MyPillow.com, promo code War Room.
OK, got two of my favorite people, two heavy hitting lawyers, constitutional geniuses in the C block here.
I want to start with John Eastman.
God, do I love this guy.
John Eastman, Raheem Kassam and the great team over at National Pulse have a story because I never talk about this stuff because I'm focused on, you know, destroying brick by brick this radical regime that is the Biden administration and proud of it.
So suck on that, Democrats.
Embrace the suck.
But there's a huge story up here about your lawyer and something destroying the January 6th subpoenas.
Can you walk us through what's going on here, sir?
And we've got it up.
I want to put it up on the screen in Denver, and I want to put it on all of our platforms so people can see it right now in the live chat.
John Eastman, the floor is yours.
dr john eastman
Yeah, I love that headline.
My lawyer's just destroyed the January 6th committee and its subpoenas.
Look, what we what we discovered looking into this and, you know, I should say, That I, like you, was subpoenaed to come testify to the January 6th Committee, but also to produce documents, communications, spanning a period of 19 months.
Everything I've ever written or said or communicated to anybody about election integrity, including my contact lists.
I mean, this is the most far-reaching intrusion on First Amendment and Fourth Amendment rights I've ever seen.
But we also did a deep dive into the legality of this committee.
Nancy Pelosi acknowledged at one point that when she refused to put on the Republicans that had been recommended by the House Minority Leader, Kevin McCarthy, that that was an unprecedented step.
And indeed it was.
Throughout our history, our committees in Congress have been bipartisan.
Each party has roughly a proportional share of the committee members that reflect its proportional share of the overall body.
And when Pelosi refused to accept any of McCarthy's picks, that meant there were no Republicans appointed to that committee by the process that has normally been employed.
And that had very significant consequences.
One, the authorizing resolution for the committee says five out of the 13.
Well, she didn't take any of them, so that's zero out of 13.
She did appoint two nominal Republicans, Liz Cheney and Adam Kinzinger, who are virulently anti-Trump, but they weren't appointed by the Republican caucus, and therefore they are not reflective of the Republican Party.
The reason this is significant is in the way the committee does its business, it has to have consultation with the ranking minority member.
And there isn't one.
It has to give the ranking minority member the ability to hire counsel to be a counterpoint in the questioning of witnesses.
There isn't one.
That counsel is supposed to be given equal time according to the House rules and longstanding precedent.
But there isn't one.
And the notion that counsel hired by Liz Cheney, who was hired or appointed by Pelosi, can serve that adversarial role is laughable. And so this whole thing is just a farce. And more importantly, you end up with people kind of having to be deposed behind closed doors.
And as we saw Adam Schiff do in the Ukraine impeachment, he would selectively leak distorted versions of what was said behind closed doors in order to try and build a narrative that wasn't true.
And without, you know, back then you had other people like Jim Jordan who could go out and publicly correct the record because because they're protected by the Constitution, speech and debate clause.
From being held to account for anything they say.
But if a witness goes out and corrects the record, now that's a contempt of Congress.
This is a star chamber, and it's really rather extraordinary.
steve bannon
Can I ask you, Rahim wrote this article because this is off, I just want to make sure we get the facts right, this is a letter that your lawyer sent to Benny Thompson, the chairman of the committee, is that what the, he wrote a letter, a detailed letter about these issues?
dr john eastman
Yeah, my legal team put together a letter responding to the subpoena request explaining all of the reasons why I was going to assert my privileges under the Fifth Amendment not to come testify and not to produce all these documents.
And the first half of the letter is all these procedural flaws in the whole process.
I mean, these aren't technicalities.
There's a good reason for 230 years We've had bipartisanship on committees.
That's how we protect against hyperpartisan witch hunts.
There's a good reason why Congress doesn't have law enforcement capability, because it's politicized by definition.
And yet they are operating as if they're a prosecutor, judge and jury.
Chairman Thompson has even said, well, I get to rule on your own objections, and then I get to be the deciding voice on the appeal of your objections.
That's not the way Our system of justice is supposed to work, and yet that's what they're doing here.
And so we decided to kind of call them on it and really expose what's going on.
steve bannon
And when did this letter, Raheem's story I think just came up, when did you transmit this, or your team transmit this letter to Chairman Thompson?
dr john eastman
It was transmitted to Chairman Thompson yesterday afternoon, and it was copied to Minority Leader Kevin McCarthy because it was his picks to the committee.
We've got the letter up now on all the platforms, and we've got Rahim's amazing story.
steve bannon
Rahim, great job, great analysis on National Pulse.
We've got it up everywhere.
John, on social media, how do people continue to track you and follow your thoughts and writings about all this?
dr john eastman
But it would be really useful if people would visit givesendgo.com slash Eastman to help us with the legal defense fund to cover the legal fees here.
And what's going on here is they are trying to target everybody that ever called and dared to call into question the false media narrative.
There was nothing wrong with the last election.
And we've got to push back against that if we're going to still control the direction of our government.
steve bannon
Can you give your GiveSendGo again?
Can you give that and we'll get it's on the cry room.
Make sure I get it in all the chat rooms and everything.
What is it?
dr john eastman
GiveSendGo.com forward slash Eastman.
And by the way, I highly recommend that site.
It's a it's a great crowdsourcing site for religious conservatives, but it also allows people to send prayers if they would prefer to do that as well.
And we're finding that very helpful and encouraging.
steve bannon
Always need prayers, don't you?
Okay, John, thank you so much.
Thank you for joining us.
I want to thank Rahim Kassam and the team over at National Pulse for writing that up.
Thank you, sir.
John Eastman, the great John Eastman.
Okay, I want to go down to Ernie Priate.
Ernie, you argued the last big case, I think in front of the Supreme Court, or one of the last big cases in front of the Supreme Court, about abortion.
Walk us through your assessment.
Walk us through your assessment of yesterday.
unidentified
Well, it's a great argument by the lawyers on both sides and great questioning by all the justices, except for the stink bomb that Justice Sotomayor threw into the pit, which I thought was a little bit uncalled for.
But the fact of the matter is, I think Mississippi's statute of banning abortions, except for rapings or so, after the mother, after 15 weeks, is going to be upheld by about a 6-3 vote, maybe 5-4.
And there are three justices who are going to say that There is a federal right to abortion, as is articulated in Roe.
There are at least two justices, Alito and Clarence Thomas, are going to say that there is no federal right to abortion.
There are therefore four justices in the middle.
Gorsuch, Kavanaugh, the Chief Justice, and Amy Coney Barrett.
So where they're going to come down is somewhere around, I believe, I believe.
The Chief Justice is trying to straddle both camps.
He doesn't want to see the court held in disrepute.
He doesn't want to see the precedent cast aside easily.
steve bannon
But what is it about the legal argument?
What are the legal points that you think they're going to sit there and go, yeah, we're going to hold the Mississippi?
Give us the two or three that strike you the most.
unidentified
Well, they're going to say that they're going to use the analysis of the Casey case.
They're going to say that there was no undue burden created by the Mississippi statute that says you can't have an abortion after 15 weeks.
Chief Justice Roberts particularly articulated that when he said, what's the burden of having to decide within 15 weeks whether you want an abortion?
And that really wasn't effectively answered on the other side.
So I think Amy Coney Barrett was going in that direction.
Justice Kavanaugh is seeking to get the court into a neutral posture, that is, let the states, let the Congress decide this.
Justice Gorsuch is, again, one of those people that doesn't want to use viability line drawing.
Casey essentially gutted Roe.
People don't realize that, but it really gutted him.
It left it a shell, because it took away the strict scrutiny analysis and replaced it With the with the undue burden standard, that is something that is a substantial obstacle for the woman to get an abortion.
And it replaced the third trimester analysis with the viability analysis.
And they said that viability began at 28 weeks.
Now we know that viability certainly begins in 23, 24 weeks and maybe even further than that.
So does the court want to get into the line drawing of when viability is?
I think not.
I think the court's going to say, that's up to the states, that's up to Congress.
And so we're going to have multiple, multiple decisions, but upholding the statute, but multiple, multiple decisions, but no one unanimous decision.
steve bannon
Real quickly, I'm not a lawyer and this is really not my line of country, but watching the clips on all MSNBC and CNN last night, did you feel that the liberal justices were asking technical legal questions or they were more political questions?
You mentioned, sort of my ears, that the stench is never going to get off this court.
We're going to ruin this court.
What are your thoughts about that?
unidentified
Well, you know, they wanted to make some statements.
get their constituencies excited about what the risks are here of this Mississippi law.
But the fact of the matter is the best questioning was done by the so-called middle of the court and by the conservatives on the court, because they were driving at where is it said in the constitution that there is a right to privacy, there is a right to abortion.
They were asking, what is the problem with getting a woman to make a decision before 15 weeks on an abortion?
And so they were looking at ways in which practical things could occur in the process.
They're going to allow the states, and some legislatures are going to come up when they already have.
California, New York has already said, there's an abortion you can have from day one to the end of that, to birth.
And in fact, New York says even after birth.
But other states are going to be drawing, drawing, and maybe at six weeks, maybe at 10, 12, 15, 17, 19, who knows where.
And they're going to let the states make that call.
And that's where we are, I think, going forward.
steve bannon
If it hadn't been for the work of guys like you, over the last couple of decades, working the legal side of this, working the legal arguments, we would not have been there yesterday, but that historic day.
So everybody wants to thank you.
All the laboring in the vineyard you did, thank you so much.
Gotta bounce.
Ernie Priet, who argued Casey, one of the great lawyers in the life movement.
Vernon Jones next.

If you see what's happening in Germany today, which announced a lockdown for all unvaccinated people, Germany, the nation, following Austria that already called for it, Austria's designated February 1st as full mandatory vaccinations for everybody.
And I keep telling you, they say, oh, conspiracy theory, then 60 days later, it's the news, it's breaking news, right?
New York City just announced all the religious schools, the Jewish schools, the Catholic schools, the private schools, mandatory, mandatory, mandatory.
Okay, up on Capitol Hill, they're fighting on it right now.
Listen, one of the reasons, and I do not admire her policies or what she stands for, but I do admire her fight.
One of the reasons we're up here right now, having these.
unidentified
Epic fights.
steve bannon
Because of a woman in Georgia named Stacey Abrams, right, who ran roughshod over a bunch of wimp Republicans, and she enforced her will onto the process.
And that's where we are today.
She announced yesterday she's running again for the governorship of Georgia and Rachel Maddow, MSNBC, starting last night, all day today has been promoting her first interview on cable is going to be with Rachel Maddow tonight.
And that is going to be the massive fundraiser.
This is the kickstart of Stacey Abrams run for the governorship of Georgia.
And if you don't think that's going to be important in 2024, you are sadly, sadly, sadly mistaken.
I want to bring in now Vernon Jones.
Vernon, what say you, sir?
Stacey Abrams is getting the star treatment on MSNBC.
Brian Kemp, correct me if I'm wrong, the governor of Georgia is down there right now with a special session doing a terrible job on redistricting, giving Democrats what they want.
Okay.
Not stepping up on a 10-4 congressional split was what we deserve and what we must get.
He did not even add anything about a full forensic audit about the 2020.
What say you about Stacey Abrams?
What say you, sir, about her coming out party tonight with Rachel Maddow?
vernon jones
Well, first of all, it's going to be interesting because she's going to start our campaign off by what?
Saying that the election was stolen from her.
Isn't that ironic?
So she deserves a rematch because it was stolen from her.
And you know, in terms of being with Rachel Maddow and that whole thing, the coming out, well, you know what that's about.
Stacey Abrams is the Hail Mary for the Democratic Party in 2024.
Look, Joe Biden is gone.
Kamala Harris doesn't even exist.
Who's on their bench?
There's no bench.
This is a Hail Mary for them.
Stacey Abrams is their Hail Mary.
And how many times do Hail Marys succeed?
Think about it.
steve bannon
Hold it, hang on a second.
You're arguing that her run for governorship in 22 is to set her up to run for the presidency in 24?
vernon jones
Well, who else would be running in 2024?
I mean, let's think about it.
It's not Joe Biden.
Kamala Harris, she is just, like I said, she's like ghost.
Who's there?
Stacey Abrams is there.
Hail Mary.
That's what they're counting on.
They're putting everything on Stacey Abrams.
And you know what?
Again, how many times do you see Hail Mary's work?
Every now and then, but clearly, that's what this whole thing is about.
Everybody's betting their money on a Democratic side.
steve bannon
You say that, but Donald J. Trump is not a 1600 Pennsylvania average.
She enforced her will with Stacey's law, not Georgia state law, on the 3 November of 2020 and on the runoffs after that.
Vernon Jones, what say you to that?
vernon jones
Well, again, you and I both know she continues to defeat Brian Kemp.
She defeated him on changing our election process.
You're right.
They came up with Stacey's law as opposed to state law.
She defeated him with the Atlanta All-Star game when we lost our star game.
Who defeated Brian there?
She did.
She's defeating him now.
You better believe she's done the polls and they've done the research.
They know that Brian cannot defeat her.
I'm the only person that can defeat Stacey Abrams.
Why?
Because Brian cannot hold the Republican line.
Because too many of them are disappointed how he cut and ran on them on election integrity.
At the same time, they know that I'm the only one that can take away the Democrat votes.
I can actually deduct a lot of non-minorities, but those independent and conservative Democrats, and those Democrats who are frustrated in the direction that the left is going.
So I can hold the line of the Republican Party, bring more people to the Republican side, and we win that election.
And that's what scares them the most.
The other thing, too, Steve, they cannot play the race car with me.
Can you imagine Stacey Abrams on stage with me trying to play the race card?
See, Brian Kemp and others, they would cave in.
They don't know how to handle that.
They're weak anyhow, as you mentioned.
steve bannon
Well, let me ask you about weakness.
Why?
What is it about Stacey Abrams that strikes fear into the entire Georgia Republican establishment as personified by Brian Kemp?
vernon jones
Well, I think you said it right.
It's the establishment rank and file Republicans.
They're not afraid.
Look, Georgia is not a blue state.
Georgia is a red state.
Brian Kemp made a big mistake with his leadership and the decisions that he's made.
He has not stood up and fought for Georgia.
I'll give you an example.
We just had a special session.
It's over.
Nothing on there about the forensic audit, nothing on there to ban companies from firing people for not taking the vaccination.
As a matter of fact, Ron DeSantis, they started their session after Georgia, and even before they finished, They had a bill signed by the governor banning those companies from firing people.
Just the other night at the Oconee County GOP, a women's meeting, Brian Kemp was approached by a young lady in health care, and she said, listen, I'm about to lose my job because I won't take the vaccination.
He told her, go find another job.
Now, don't believe me.
You can go to hers.
Been out there.
And it was just disappointing.
And so he will not fight.
And so you know what that lady said?
She said Brian would not Help and protect her and her job, so she's not going to be there to protect him for his job.
There are a lot of Republicans that are going to cut and run on him, too.
steve bannon
Vernon, real quickly, what's your social media?
How do people find out more information about you and your campaign?
vernon jones
They can go to jonesforgeorgia.com and donate and be a part of this movement.
And it is a movement, and we are going to take Georgia back.
We have the ability to hold the line, bring more people to the polls, bring more people to the side of the Republicans, and hold Georgia.
When we take Georgia back, we take this country back.
steve bannon
Vernon Jones, appreciate you coming on.
We'll be watching Stacey Abrams tonight.
Thank you very much.
By the way, the House just voted.
The only Republican that voted to cross the line was Kinzinger.
Boris Epstein had a called shot there, so Scalise and the guys did their job.
I don't know why this guy's in the conference.
Isn't it time to bounce him?
Isn't it time to bounce Cheney?
Okay, tomorrow morning at 10 o'clock.
We're in the firestorm right now, this radical spending.
We're going to pick it back up at 10 a.m.
tomorrow morning.
