I have been critical of President Trump on this program.

I know the man.
But I gotta call balls and strikes.
I can't let my personal political feelings get in the way of facts and calling balls and strikes.
That's the difference between me and the liberal left media and the Ben Shapiro type media on the right.
I gotta put that aside and call balls and strikes.
Because I owe it to you to call balls and strikes.
Do I think Trump is the best candidate for president?
Yes.
Do I feel his post?
I'm going to be indicted Tuesday.
We must protest.
We must do this.
We must do that.
Folks, I'll tell you this.
If you're one of the people that has to wait for Trump to put a post out for you to get involved, you're one of the problems.
Do I agree that we need to protest and not let this happen?
Not necessarily because it's Donald Trump, but because it is a two-tiered justice system that I would be protesting.
That's what I would be protesting.
A two-tiered justice system.
And if you are that uninvolved that you have to wait for a post from Donald Trump to go do something, hate to say it, folks, you're part of the problem.
Part of the problem.
Now, here's the other issue.
Last time Trump called for people to peacefully protest, there are still people sitting in jail for over two years from January 6th that did not receive a pardon.
So, don't expect...
Or count on any help from Donald Trump when the system retaliates against you.
You have to be solid in your convictions about the justice system to go protest.
Folks, I will never go out and protest on behalf of A man who walks the earth like I do.
I will, however, go out and protest systems, inequities, injustices, but not because a person told me to.
January 6th, I was in D.C. I was in D.C. because I felt the election was stolen.
Regardless if it was Donald Trump or anybody else.
If we don't have free and fair elections in this country, what do we have?
So, I've also been listening to the liberal media having their meltdown.
Donald Trump said go protest.

Hey listen, I'll tell you what.
If you're going to be a jackass and go out there Like the left does and flip cars and set shit on fire and everything else.
Hate to say it, you got what's coming to you.
You got what's coming to you.
But if you want to walk arm in arm down the street peacefully, I support you 100%.
And then, if the government enacts even more injustices towards you, then at that point, I would say, all bets are off.
Folks, we need to take the high road.
We need to show that we are not the brainless thugs that the left is.
I agree with protesting.
I agree with your First Amendment right to protest and have your voices heard.
Have it be done for the right reason.
Don't protest over a man.
I would protest the system.
And that is the difference, folks.
Do not play into the left's narrative That just created over two plus years of turmoil with the big January 6th insurrection.

So apparently Trump's team has been in touch, his legal team has been in touch with some reporters.
And here's a CBS piece I want to play.
Good morning and welcome to Face the Nation.
We had a sense of deja vu early Saturday when former President Trump hit send on a social media post saying he, quote, will be arrested on Tuesday.
Protest.
Take our nation back.
He's referring to the Manhattan case focusing on the alleged hush money payments he made to porn star Stormy Daniels late in the 2016 campaign.
That grand jury is still hearing testimony and will need to vote as to whether or not Mr. Trump should be indicted.
But his urging support from his followers in advance has caused a political firestorm and has prompted additional security concerns.
If Mr. Trump Trump is indicted, that would be yet another first.
No sitting or former president has ever been indicted.
Our Robert Costa has been reporting on the investigations.
He's here with me now.
I know you have been speaking to the Trump legal team.
What is the broader strategy?
Margaret, good morning.
Speaking to Trump's lawyer Joe Tacopina and other close allies of the former president, it's evident that in the coming days with regard to a possible indictment, the legal strategy is going to be combative.
They are going to question the scope of any possible felony that's issued for former President Trump.
They're going to talk about the timing and they're going to attack the credibility of Michael Cohen.
The longtime Trump lawyer and Trump fixers who's at the center of this case over his payment.
But there's a lot of debate in the inner circle about how combative to be, including the use of the word protests in the former president's social media language over the weekend.
There's some consternation among some allies privately.
Maybe that's a bit too far, but they do want to see solidarity with his supporters.
You're gesturing to security concerns there, too.
Tell me about what's being planned.
I mean, this is unprecedented territory.
Bringing in a former president for potential indictment, how does this work?
What's so surprising in the reporting is that there's not much planning going on, at least between the Trump camp and the Manhattan district attorney.
People close to the former president say there are real gaps, tensions between the D.A. and the Trump team about how this could unfold.
Whether there would be a perp walk or cameras or the former president walking in, whether he would have a private entrance or not.
What we do know is that the Manhattan district attorney, Alvin Bragg, has informed his own colleagues that he will do everything he can to keep them safe, knowing the former president has called for protests.
There's a lot of unease inside the Manhattan DA's office at this time.
Whenever there is an indictment, should it come, it would be coordinated by NYPD and Secret Service and other local authorities.
CBS News has learned there are some conversations among those entities at this moment.
This is also obviously a huge political story.
Senator Lindsey Graham said yesterday the prosecutor in New York, quote, has done more to help Donald Trump get elected president than any single person in America today.
Is that how the Trump camp sees it?
Well, Senator Graham is a longtime advisor and friend of former President Trump, and the Trump wing of the Republican Party sees this as a very similar moment to what happened when the FBI raided Mar-a-Lago, that this is going to create a lot of momentum for the president, the former president, in the 2024 race.
And what you saw over the weekend right now is a lot of calls for Republicans to speak out in defense of Trump, to come out and say, We're with him.
The DA's out of line.
There's been pressure on Florida Governor Ron DeSantis to speak up more loudly about what is happening to Trump.
Some DeSantis allies say they want to have him stay in his own lane.
You see former Vice President Mike Pence, he is speaking up, calling any possible indictment politically charged, but he's not trying to weigh in too much on the specifics of the case.
That's the balancing act you see from so many Republicans right now.
Show anger towards the DA, but don't necessarily rally too much.
And the Trump campaign has been issuing press releases, raising money off of this, and trying to call out those who haven't spoken yet in the former president's defense.
But this is just one case in Manhattan.
We know there are many other issues legally here, including at the Justice Department with what the special counsel is pursuing.
What can you tell us about that?
I can't underscore enough how my reporting shows that while this is a lot of activity in Manhattan in the district attorney's office, the federal grand jury investigation of January 6th is very serious.
And former Mike former vice president Mike Pence could face a crossroads this week, whether he will testify or not.
We're told by sources the chief judge may force him to testify, but Pence will raise an argument on constitutional grounds that as a former president of the Senate, he should not have to testify about his conversations with Trump about January 6th.
All right.

Now, folks, I'm not a big fan of Fox News, just like I'm not a fan of CBS. But I try to watch everything.
I was even looking at CNN and MSNBC clips where they had that dude, Mr.
Rachel Maddow on.
Anyway, Steve Turley breaks it down pretty good on Fox News.
Let's go ahead and run that one.
We're back with a Fox News alert.
Former President Trump saying this morning he will be arrested on Tuesday.
Trump shared on True Social his potential arrest comes over accusations and a $130,000 payment to Stormy Daniels.
Prosecutors have called hush money.
A spokesperson for Manhattan District Attorney Alvin Bragg's office declined to comment.
Joining us now with his legal take is Fox News contributor and constitutional law expert Jonathan Turley.
Jonathan, good morning.
We've had other guests on already this morning.
We're trying to understand.
I guess the breaking point here is state versus federal offense and jurisdiction.
Can you help us understand this?
Well, one would say that Bragg is outside of his lane, but in this case, he's on a completely different highway.
I mean, this is an effort by a state official to effectively prosecute a federal crime, a crime that the Department of Justice decided not to prosecute.
And the reason for that decision may have involved the difficulty of these types of claims because you have the payment of money to effectively end a scandal.
Now that occurred right before an election, obviously, in 2016.
But you have to show that that money was paid with the election solely in mind.
There's obviously a lot of different reasons why a married man would want to hush up a scandal with a former stripper.
And that's the problem that they had in the John Edwards case.
That was a much stronger case.
The Department of Justice went all in and they lost ultimately because these are very difficult cases to make out.
Now you take that And now you have the Manhattan DA taking a case to court that the Department of Justice declined to do so.
And that raises some obvious questions.
Right.
Obviously, Alvin Bragg either has Trump derangement syndrome or he wants to raise his profile.
How does this end for Donald Trump, in your view?
Well, you know, this is going to now get pretty wicked on all sides.
I mean, you've got a person who's running for the White House.
This could easily extend to the election.
But there are a number of flaws in this case.
It is based on Section 175 dealing with falsified business records.
They need to actually federalize the case in the sense of hooking into that alleged federal violation.
The reason is I think Bragg is out of time.
The statute of limitations is about two years on this offense.
That has already run.
You can extend it to five years if you connect it as a felony to another crime.
Even at five years, I'm not sure the time has not run out.
So there's going to be some very intense challenges here.
Now, obviously, this is one of the worst jury pools that Trump could find himself in.
But we have to keep in mind that we have a legal system here which is designed to protect the rights of the accused.
And even if he's convicted, there are going to be significant Appellate challenges and reviews.
I think we have to be careful not to just assume in the most inflammatory way that the rule of law is dead.
This is not the first DA who has yielded to public pressure to bring a criminal charge.
Jonathan, I think oftentimes, as attorneys, we can get sucked into the idea that this is about wins and losses and begin to try to figure out who would win a case, when often what's happening is a lawsuit serves its own purpose.
Either it moves you towards a settlement, or in this case it has its own political implications as well.
Just in the pursuit of understanding those political implications, on Tuesday there will probably be photos.
Of President Donald Trump in handcuffs.
And that has its own political fallout.
You also brought up the timeline.
Even if Trump were to win, how long would that take?
Because that then impacts his run for president.
Yeah, unless this case is dismissed because of one of these flaws, it is going to muck up the works.
And it is unfortunate that we're already starting with this environment.
This has the feeling of a thrill kill for many on the left.
And they need to think seriously about what this implicates for the legal system.
You know, this is a claim that not only the Justice Department didn't pursue, but Brad's predecessor in his office didn't pursue it to court.
But also Bragg himself threw a flag on the play.
The only reason I think we're seeing this case is that two of his prosecutors resigned.
In my view, they acted really inappropriately in the case of one of them who wrote a book about someone who wasn't even charged, let alone convicted.
And that pressure, I think, finally found its mark with Bragg.
And they bring this rather curious charge based on the falsification of state records and connecting it to an uncharged federal crime.
Well, come Tuesday, we'll see where this goes and what the fallout immediately is.

So let me break that down for you again in case you missed it.
This is a state official trying to prosecute a federal crime.
A federal crime that the DOJ didn't even want to touch.
Steve Turley touches on the statute of limitations two years and then five years if you can connect it to a felony, which all statute of limitations have gone.
For those who are unaware, statute of limitations means the period between a crime is committed to when you can then be brought to trial or prosecuted or paperwork filed, charges filed, indictments filed, whatever the case may be, for that crime.
You can't get it done within two years in this case.
You ain't got nothing.
Five years if it's a felony.
But the big thing is here is the DOJ didn't even want to touch this.
This is solely a political witch hunt.
It's obvious.
It's obvious.
There is no denying.
We've said this about a million things, the Russia stuff, where...
You know, the dossier where Trump had Russian hookers peeing on him and stuff.
Okay?
All phony, all face, all fake, all false, all face.
Just had a picture of some Russian hooker peeing on Trump.
And folks, it's not just presidential candidates or presidents that they do this to.
They do this at all levels of politics.
The funny thing that got me is I was listening to another liberal media outlet about this indictment.
And this jackass sat there all smug.
Well, this is how our legal system works.
And Trump will get a fair trial in front of a jury of his peers.
Oh, yeah!
Yeah, I'm sure.
I'm sure it'll be a fair trial there in Manhattan.
It's over 90% Democrat, believes every word the liberal fake news tells them.
Yeah, I'm sure that'll be a fair trial.
Something else.
Something else I gotta touch on, too.
This is over a payment to a porn star that Trump supposedly slept with.
First off, Stormy Daniels, no relation whatsoever.
None.
None.
Okay?
Stormy Daniels is a little haggard and worn out, isn't she?
Kind of looks like she's been rode hard and put away wet.
And here's Donald Trump.
A billionaire.
A billionaire.
And he paid this hooker porn star $130,000, supposedly.
Allegedly paid this porn star $130,000 to shut up.
That's like me giving somebody $10.
Think about that.
It's like me giving somebody a $10 bill.
Hey, shut up.
So obviously, maybe Stormy was a little jaded that maybe she ain't that good in the sheets, okay?
I mean, she is a little haggard, is a little beat up.
Like, maybe she's insulted that she didn't get more.
I don't, honestly, she's not really even worth the ten bucks that, you know, on my level, for Stormy Daniels.
Not worth ten bucks.
She should be happy she got to 130 and had moved on.
Trump already beat her in court several times.
And this is still resurfacing over and over and over and over again.
Crazy stuff, isn't it?
Like, first time a former president's ever been indicted.
Like I said, the big thing is this is a state official.
Trying to indict a former president for a federal crime.
I don't think that's been done before either.
Strictly political.
So folks, if there are protests, obviously we're smart enough not to burn down our own cities, loot our own stores, do any crazy shit like that.
If you feel compelled to do so, I would gather in Manhattan, one of the busiest cities on the planet, have millions of people take to the streets and just shut the city down.
Just shut it down.
Too easy.
Folks, there's more of us than there are of them.
But you do it peacefully.
You do it peacefully.
If you show up to protest and you see people doing shit they're not supposed to be doing, we've got to police ourselves.
We've got to police our own.
We're not thugs and animals and degenerates like on the left.
We can get our point across peacefully.
And again, if violence is used to retaliate against a peaceful protest, then at that point gloves are off.
But you do know this will be shown on a world stage.

It will accelerate and intensify this work to save more lives more quickly.
First, this executive order helps keep firearms out of dangerous hands.
As I continue to call on Congress to require background checks for all firearm sales, And in the meantime...
In the meantime, my executive order directs my attorney general to take every lawful action possible to move us as close as we can to universal background checks without new legislation.
That was President Joe Biden yesterday announcing his latest executive order, expanding universal firearm background checks and boosting the use of red flag laws.
With this new order, Biden is looking to make red flag laws much more widespread.
And these on paper are much different than what these could be in practice.
On paper, red flag laws are purported to prevent unstable individuals from purchasing or possessing a firearm.
In practice, what's to prevent a ticked off family member or ex from calling the cops on you for revenge and saying that you're mentally unstable?
Having your guns taken away and then putting the burden of proof on you To prove that you deserve to have them back, have your rights back.
Joe Biden doesn't care about that.
No, instead he's planning to spend alongside this legislation a $231 million publicity campaign to promote red flag laws and teach everyone how to use them.
Although the order stops short of requiring universal background checks, that's Biden's next step.
And then, of course, the next steps after that and after that and on down the road are going to be an all-out gun ban.
10, 15 years from now, who knows?

Additional legislation already willing to go around the laws in place.

I knew when Joe Biden issued this executive order yesterday, I knew exactly who to call to respond to this.
So have at it, Teddy.
What's wrong with Joe Biden?
I just want to say this from my cold, dead hands.
OK, and my gun folks out there will know exactly what I'm talking about.
Brother, here's the thing.
So he wants universal background checks.
Now, there's already background checks to purchase a firearm.
For instance, back in 2018, I believe it was, his son, Hunter Biden, lied on a federal background check and then took possession of a gun.
So with these laws, with these universal background checks, when Hunter lied on the form, that's actually punishable up to 10 years in prison.
And then when he took possession of the gun, that's another 10 to 15 years in prison.
So when Hunter Biden is behind bars, For illegally filling out a form, for illegally possessing a firearm, then I'll care about what Joe Biden has to say about gun control.
I'm a gun owner.
I know you're a gun owner, Teddy.
We've all had to do background checks.
We've all had to pass background checks to be able to buy a gun.
I've yet to find a gun vendor or anyone who will sell a gun without a background check.
So I don't understand the point of this to begin with.
And on top of it, he's trying to do it, these UBCs, without Congress or any sort of new law, just governing via executive order, Teddy.
It's a dangerous precedent.
It really is.
Well, if you remember when he took office, or right before he took office, he says only a dictator would govern by executive order, and then his first 48 hours in office, he filled out more executive orders in the last two days combined.
So, brother, you know, I did some stats on this, and I looked at the top five states with the most gun ownership.
We're looking at Montana, Wyoming, Alaska, Idaho, and West Virginia.
Alright?
Then I took a look at the states with the strictest gun laws.
Did you know that the states with the strictest gun laws, none of the top five top gun owners are in that list, but the states with the strictest gun laws have the highest Gun crime rates.
California, New Jersey, Illinois, Maryland, and New York.
You know, you throw Baltimore, Chicago, LA in there.
In New Jersey, you have Newark and Patterson.
So, like I said, brother, you know, when he pulled out of Afghanistan, he left $85 billion worth of the most sophisticated weapons ever on God's green earth.
Did he do background checks on the Taliban that he left that to?
Don't want to hear it.
I'm sick and tired of it.
The Second Amendment says, shall not be infringed.
And until Hunter Biden's behind bars, can't take anything the man says seriously.
And what he's moving to, what he's really trying to get towards, is making it illegal to do a private transfer of firearms without a background check.
In other words, if I want to give a gun to my father, He's got to do a background check.
If he wants to give a gun to me, he's got to make me go through a background check.
That's what all of this is about, Teddy, is getting to a point where you can't even gift a close friend or a family member, your own son, with a firearm.
Well, brother, right here in Pennsylvania where I am, okay, you have to go to a gun store, to a licensed FFL dealer, Do the transfer paper to transfer a firearm to that family member.
Unfortunately, do I agree with it?
No.
But that's the way it's got to be done.
And I've done it with a bunch of guns, even guns that I've given to friends.
Okay?
Hey, let's go meet down at the gun store, we'll do the paperwork, sign it over.
They run their background, boom, good to go.
Okay?
Because my name is still tied to that original serial number unless I do the transfer responsibly.
Now, it's not responsible citizens like me who are going out and shooting up cities with stolen guns.
That's the problem.
You can have all the gun laws you want, and until you start enforcing the ones that you already have on the books that apply to his own son, Hunter Biden, nothing will get done.
You know, it's more on paper, that's it.
Yeah, and we've seen, I mean, there's something to the tune of 20,000 gun laws on the books, Teddy, and they're acting like, you know, one more gun law is going to be the one that breaks the camel's back, finally gets all the gears churning and gets everyone to all cooperate and kumbaya with all the other 20-something thousand gun laws on the books.
This is really about dealing with the crime issue.
There's two approaches.
You have the right, who says, throw people in jail and be tough on crime.
