| My friend, Ivan Raichlen, who's a constitutional lawyer, who's going to go over and weigh in on the latest court cases. | ||
| We have so much to talk about. | ||
| You know, the news is really kind of coming in very fast. | ||
| And I am not a constitutional lawyer as much as I would like to be. | ||
| So I, you know, I can only Only speculate what certain things imply with these court cases, but we need to have some professionals weigh in at this point. | ||
| Number one, Donald Trump says he is joining the Calvary, he's going to be joining the Texas AG bid to overturn election. | ||
| And at this point, we have up till just a few minutes ago, I believe 19 states has now joined this massive Texas lawsuit to overturn the election results. | ||

| Texas is the only state that has the balls big enough to actually go through with this. | ||

| Now, let's hear from our good friend Ivan Reikland to weigh in, constitutional lawyer. | ||

| I'm great. | ||

| Just trying to make sense of all of these legal proceedings right now because they can be very confusing and there's a lot of propaganda and fake news out there to try to- I can make it simple. | ||
| Try to discourage us and everything. | ||
| So yes, help make it simple and we have the 19 states joining in the Texas case. | ||
| Trump's saying he's going to intervene in the Texas case and he's going to join in. | ||
| What does that mean to you? | ||
| Tell us what that means and what are the chances this is going to lead to a victory? | ||
| Sure. | ||
| A lot of questions that I get is, Oh, look at the Pennsylvania case. | ||
| It looks like it's being dismissed. | ||
| I use this analogy. | ||
| I like using analogies to make it simple. | ||
| The Pennsylvania case is like, you know, you're shooting a basketball hoop and you're trying to go for the 20 point shot. | ||
| And then all of a sudden you have an opportunity for the 20 plus 11. | ||
| Plus 16, plus 16 point shot. | ||
| Excuse me, 10. | ||
| Combine those. | ||
| Are you going to take that shot when you only have one second left on the buzzer? | ||
| Or are you going to go for the 20 point shot? | ||
| So that is essentially what happens with the Texas case. | ||
| The Texas case goes up against four states. | ||
| And I just realized earlier today, the reason why Texas did not sue Arizona, which we're calling this the hashtag Guam, Georgia, Wisconsin, Arizona, Michigan, and Pennsylvania, right? | ||
| We're draining the guamp. | ||
| Drain the guamp. | ||
| Hashtag drain the guamp. | ||
| The reason why Texas is not suing Arizona is because Arizona just announced that they're joining in on Texas's lawsuit. | ||

| And yesterday when Texas filed that lawsuit, in the morning, I look at my phone and I see there's an article that Texas files this lawsuit. | ||
| Didn't think of that. | ||
| Brilliant legal maneuvering. | ||
| That's another constitutional angle that they can use. | ||
| And then I thought to myself, hmm, if I was a Supreme Court justice and I saw five states disputing four states, that would be a more compelling argument to take that case. | ||
| And as soon as I tweeted it out, next thing you know, a lot of people are retweeting it. | ||
| And then I saw that President Trump retweeted it too, didn't he? | ||
| Yeah, that was great. | ||
| I mean, we're trying to, we're all rowing in the same direction to make sure that our constitution is intact. | ||
| I'm supporting and defending it to the death, and hopefully it doesn't have to get to that, but we shall see. | ||
| Right, okay, so, you know, a lot of people are saying, though, it shouldn't have to take this many states for the Supreme Court justices. | ||
| I mean, they're human, and they're supposed to be constitutionalists, so it shouldn't even have to get to this level for them to decide to take this case up, because, I mean, anyone with eyes to see can see that this has been fraud and and then not only just eyes to see but then there's stacks of evidence there has been uh the constitution that's been violated left and right by so many different states and and governors and whatnot | ||
| so so i guess my concern is because of their lack of it seems like almost lack of interest on their part and this is sort of our last hope Is it possible that they can just throw this case out, too, or that it's just not going to go anywhere? | ||
| Like, what are the chances, do you think, that this is going to hold up? | ||
| Just to contextualize, it is really not our last hope. | ||
| Okay. | ||
| We have four, five, maybe more paths to victory, right? | ||
| All right. | ||
| The first one is, for us, the first three words of the Constitution is, we the people. | ||
| So we're the ones that apply that pressure. | ||
| Every single viewer in here has just as much ability to do that as I do, as you do, and getting the word out. | ||
| So what needs to happen? | ||
| We the people need to apply pressure on your state legislatures in these states, right? | ||
| And you don't have to be from these states to do that. | ||
| Pick up the phone, melt their phones and tell them to do the right thing. | ||
| Go on your email or your phone or your phone and email them and melt their email inboxes and tell them, do the right thing. | ||
| Don't let the fraudulent election continue. | ||
| That's one component. | ||
| The second component is these lawsuits, right? | ||
| You have different lawsuits against civil litigation that are uncovering a lot of this fraud and evidence. | ||
| That's then going to trigger criminal investigations. | ||
| FBI, U.S. | ||
| attorneys. | ||
| How do we expedite those investigations? | ||
| You, me, the people watching this, pick up the phone, go on the website, contact the eight contested cities FBI special agents in charge. | ||
| They're publicly listed. | ||
| Contact your U.S. | ||
| attorneys in these cities. | ||
| Contact your election district officers that are the Attorney General's envoys to these cities and states to determine and investigate any sort of voter fraud. | ||
| And also, contact the U.S. | ||
| Postal Service Inspector General's office in order to be able to figure out and demand, hey, you need to get ready be able to testify before Congress that there was some fraud going on in these different areas, and specifically the postmasters from these cities. | ||
| You need to blow up their phones. | ||
| That's the pressure that we can then push. | ||
| Additionally, we need to see some hearings, congressional oversight hearings of these states. | ||
| So on December 18th, we're going to see an intelligence community assessment that's sent forward from the DNI to the president, according to the executive order from 2018, that mandates that the DNI put out an intel community assessment on foreign that mandates that the DNI put out an intel community assessment on foreign interference in the I think we're starting to see foreshadowing of it. | ||
| Right, because Trump signed that executive order in 2018, specifically talking about the foreign interference in a United States election. | ||
| And I would think he'd have put these safeguards in place, right? | ||
| Or have a trap in place, knowing that this- Well, here's how it's going to play out, I think. | ||
| Well, actually, this is how I know it's going to play out. | ||
| Okay. | ||

| If you want to pull up while I'm discussing this, Deanna, if you don't mind, if you pull up my tweet and kind of pull up the plan of what's actually going to happen. | ||

| And we, the people, are going to execute this plan. | ||
| And the plan is executed how? | ||
| You contact all the people that are listed there to ensure they do what they're supposed to do, right? | ||
| You click on it in detail, basically, you go on my Twitter or whatever, and December 18th, that's when the Intel Community Assessment deadline is to produce it and submit it to the President. | ||
| That's classified. | ||
| Okay. | ||
| We're going to give them the weekend to consume it, assess it, declassify it for public consumption. | ||
| On that Monday, on December 21st through the 23rd, you mentioned earlier in the broadcast, is there going to be a Christmas surprise? | ||
| This is the Christmas surprise. | ||
| So from 21 to 23, the three days prior, you're going to have hearings. | ||
| If you want to pull up and see who is it going to consist of? | ||
| Well, it's going to consist of the intelligence committees of both the House and Senate. | ||
| And who's going to co-chair it? | ||
| You're going to have Senator Marco Rubio as the Senate Select Committee on Intelligence Chairman? | ||
| Obviously, right? | ||
| It's going to be held in the Senate. | ||
| And you're going to have Congressman Devin Nunes. | ||
| And folks are thinking, wait, wait, what about Adam Schiff? | ||
| Isn't he the chairman? | ||
| Actually, no, he's not. | ||
| In this instance, he's not going to be chairman. | ||
| Why? | ||
| Because this hearing is the setup For the House during the contingent election that may occur on January 6th. | ||
| If you don't know what I'm talking about, read the 12th Amendment. | ||
| If no one gets the sufficient majority votes of electoral votes in the House on January 6th, they go to what's called a contingent election. | ||
| And that contingent election is where the House votes by state delegation. | ||
| So the way the tally is going to be is we have 27 states that have a majority Republican delegation, we have 20 states that have a majority Democrat delegation, and we have 3 states that are tied. | ||
| Equal number of House members that are Republican and Democrat. | ||
| Again, 12th Amendment, look at it. | ||
| 27 to 20 to 3. | ||
| So, Kevin McCarthy needs to organize tomorrow A meeting of his state's delegations and essentially start picking who's going to be my chairman for this framework, only for this framework of who is going to be my chairman for the Intel Committee. | ||
| It's going to be Nunes. | ||
| Who's going to be my Judiciary Committee chairman? | ||
| It's going to be Jim Jordan. | ||
| Who's going to be my chairman for Homeland Security Committee? | ||
| It is going to be Mike Rogers from Alabama. | ||
| And then potentially he could play it out further with the Finance Committee chairman. | ||
| So only under this construct, Is Nancy Pelosi completely out of this conversation? | ||
| So now we have a joint committee session, and we have these hearings, and who's going to testify? | ||
| Under oath, I remind you, we need to find out what's going on with the foreign interference. | ||
| Absolutely. | ||
| Radcliffe, DNI Radcliffe is going to testify and lay it all out to the American people. | ||
| Next up, how about we bring in The executives of this company known as Dominion. | ||
| We haven't heard from them. | ||
| Let's subpoena them. | ||
| Let's hear from their international interactions. | ||
| Right. | ||
| I don't know why they haven't been subpoenaed already. | ||
| We know that China... The timing of it, right? | ||
| All of this is timing. | ||
| It's more appropriate to do this after the states have kind of pretty much sealed the deal on the election. | ||
| And then this is when we expose it. | ||
| 21 to 23. | ||
| And then if you want to take a look at the plan, look at the list. | ||
| Some of our Some of the people that we need to have as witnesses are Governor Kemp, Brad Raffensperger, Adam Schiff, Eric Swalwell. | ||
| So that's the nice little list there. | ||
| As witnesses? | ||
| That's who's going to be witnesses. | ||
| Now, if they plead the fifth, great. | ||
| You just answered our question. | ||
| If you're under oath and you're testifying, you're also going to answer the question. | ||
| It's a lose-lose for them. | ||
| It's a win-win for us. | ||
| And so we need to enforce that. | ||
| Okay. | ||
| To make sure that these hearings occur. | ||
| Now, uh, I'm going to talk about the next. | ||
| What? | ||
| You want me to talk about the next hearings? | ||
| Yeah, I want to talk about the next thing, but, uh, the next hearings, but just, and then let's tie this all in as well. | ||
| But you know, Coffee County in Georgia, right? | ||
| You've probably heard a Coffee County letter in Georgia said that it could not certify Georgia recount over their inability to duplicate the results. | ||
| So they sent this letter out saying that they could not certify the results after a second recount because they said any system, financial, voting or otherwise that is not repeatable, not dependable, should not be used, says the Coffey County Board of Elections officials. | ||
| They said to demand certification of patently inaccurate results neither serves that objective of the electoral system nor satisfies the legal obligation to certify the electronic recount. | ||
| So that's one thing I want to bring to your attention. | ||
| And then the other thing is, you know, there was a there was a a court case. | ||
| You know, from way back in the day, 1997, Foster versus Love, where the SCOTUS Supreme Court already ruled, and maybe this is what you're getting at too, that all ballots received after midnight on November 3rd are null and void. | ||
| So, is this the play here? | ||
| I mean, is this gonna be called upon at the SCOTUS? | ||
| Let's have you complete your thoughts there. | ||
| Okay, there's many components. | ||
| I would expect there's actually three or four cases on their way, in addition to the one that we were talking about, Texas, on their way to SCOTUS from the different states. | ||
| So we have one coming up from Georgia with Lynn Wood. | ||
| We have the GOP in Pennsylvania. | ||
| We have the Texas case. | ||
| So all of these are similar, but slightly different. | ||
| And it's going to really depend on the facts. | ||
| I would say | ||
| The main argument and the determination that the SCOTUS is going to make with the Texas case, let's just go back to that one real quick, is whether or not the state's legislatures are able to determine on their own without the governor and without the Supreme Court of their state's involvements in determining a slate of electors, and whether or not they have the ability to completely, after certification, still vote for their slate of electors. | ||
| And I think they're going to rule favorably. | ||
| And then once that occurs, if it does occur, every single person needs to melt their phones to make sure that they have the support of the people to do that. | ||
| Okay. | ||
| Now this other case, I can't really comment on it. | ||
| Uh, I'm, I haven't looked at that one specifically. | ||
| So I just think that all of these cases are leading up to that. | ||
| The other thing I'll mention is all these cases that are being quote unquote lost, uh, you know, With the lower IQ media that's out there. | ||
| Right. | ||
| In the single and double digits. | ||
| The reason why they're doing is that is the only path to victory for Biden is if Trump concedes. | ||
| And they know he won't concede, but they're hoping that with enough pressure of constant media and big tech media bombardment of his base, That it could potentially kind of demoralize. | ||
| Right. | ||
| And then maybe cause him and pressure him into conceding. | ||
| That's really their only path to victory because the Constitution and the legal arguments and the legislature makeup and then the state delegations from the states. | ||
| Like we have all these different paths to victory that they know and they're trying to avoid us learning about it. | ||
| And folks like us to kind of disseminate that these are the different paths. | ||
| Right. | ||
| So they have to focus on Like, the win's on their side. | ||
| Because at the end of the day, as you're doing court cases, you're finding out about things. | ||
| There's a little bit of discovery. | ||
| So all this stuff comes out, and more people that are in the orbit of the fraud come out as whistleblowers. | ||
| Come out as, hey, I saw something weird. | ||
| Oh, well tell me about it. | ||
| Well that's actually unlawful. | ||
| So then it builds that case as we move towards January 6th. | ||
| All these cases Build an entire case that then cannot be denied so that on January 6th, if it comes to it in the secondary vote, if it comes to that, according to the 12th Amendment, that's when congressmen will say, you know what? | ||
| 75% of my constituents, to include Democrats, are telling me, we agree with you objecting to accepting delegates From all these states, because of all the massive fraud and all of the massive foreign interference. | ||
| We demand that you refuse them. | ||
| It gives them that political will. | ||
| And that's why over the next 28, 29 days in the run up to that, congressional hearings are going to expose that. | ||
| SCOTUS cases are going to expose that. | ||
| State lawsuits are going to expose that. | ||
| Legislative hearings are going to continue to expose that. | ||
| For example, in Wisconsin on the Friday, All of that in the collective will expose every single component of fraud for in the event that the legislatures don't have a spine in the states to decertify or send a slate of electors for the president, then the Congress is going to make the call because they're going to have more time to do that because their vote is going to be on January 6th. | ||
| Whereas some of these states are going to feel like, oh, I have to do it now or yesterday because of safe harbor. | ||
| Which is Title III of the U.S. | ||
| Code. | ||
| Irrelevant. | ||
| Because in the same title of the U.S. | ||
| Code, on December 14th, is when the governors certify. | ||
| And in the same code, in the later section, it basically says that if the states don't submit their slate of electors, then the vice president on December 23rd demands of them, send the electors. | ||
| Because I haven't received them yet. | ||
| If that's in the same statute saying that the states haven't sent it, but yet there's a safe harbor, I would have to argue, and it's a lot stronger argument, that December 23rd is a stronger safe harbor argument than December 8th. | ||
| Okay. | ||
| But even then, the vice president demands of the states for them to send their slate. | ||
| It doesn't say how much time they have to respond. | ||
| If they want to respond in time, They gotta do it by January 6th at 1pm when there's the roll call. | ||
| Right. | ||
| So that's really the safe harbor, if you want to call it that. | ||
| Right, exactly. | ||
| January 6th, 1pm. | ||
| If the states even want to participate in sending a slate of electors, they may be embarrassed and say, you know what? | ||
| We don't feel comfortable voting for Biden or Trump because it's just complete shenanigans going on in our state and we have to get our own, let's just say, stuff in order. | ||
| Well, you know, and I hate to be a Debbie Downer. | ||
| I'm usually Deanna Upper, but I'm just losing so much faith in our system. | ||
| You would think, right, that these, you know, Republican governors or secretaries of state or Republican legislatures, Republican conservatives, Supreme Court justices, you would think that they would have a spine, that they would have some balls and that they would stand up for this. | ||
| But it just seems like left and right, they're either folding like a lawn chair, they are getting, you know, getting bought and paid for, they've got some blackmail deals, they got threatened, like what is going on? | ||
| And that's why I feel like no matter what way we turn, we see a hope, and then they let us down again. | ||
| So do you really have faith that these legislatures or, you know, I don't even care, the FBI investigation into all this is kind of silly, the DOJ, I don't think they're doing anything substantial it seems like. | ||

| So, two weeks ago, what was going on? | ||
| You had Rudy Giuliani, and you had Sidney Powell, and that was it. | ||
| Yeah, right. | ||
| A week ago and a half, you had what? | ||
| You had Pennsylvania basically sending to the Congress, hey, you know what? | ||
| Don't accept our slate of electors. | ||
| That's a massive shift. | ||
| Arizona, same thing. | ||
| You have a component of the legislature saying, do not certify our Arizona electoral slate. | ||
| Those are indicators of, that's massive movement. | ||
| The other components, you have, I mean, all this foreign interference that's going on. | ||
| I would argue, beg to differ with what you're saying. | ||
| Massive movement with the Supreme Court, massive movements with the, I mean, this is light speed compared to normal movement. | ||
| Exactly. | ||
| It's complete light speed. | ||
| By the way, if you want to increase the speed with which this happens, again, the first three words of the Constitution is the component that forces the level of speed with which this actually happens. | ||
| So we the people melt their phones. | ||
| In the last 24 hours, if I told you last week, hey, Texas is going to file a case and 17, 18 states are going to join within 24 hours. | ||
| Yeah, I mean, I probably wouldn't have anticipated it, but that's why it does seem like momentum is building. | ||
| I want to say one thing before I forget, because it's very important. | ||
| I was doing some thought earlier today. | ||
| We need to have whoever's listening out there contact you. | ||
| Here's a call to action. | ||
| Contact your state legislatures, the House, the Speaker of the House, and the Senate President in all six of these states. | ||
| And tell them they have to file by tomorrow also joining in the case or in some capacity saying that they're also harmed by the actions done by these other state legislatures that didn't follow the rules. | ||

| So I'm going to be putting out on my social media this explanation, but we also need to have the state legislatures in this lawsuit, in the Texas lawsuit, because the attorneys general, Basically represent the governor, right, as the executive of the state. | ||
| So the dispute is between the legislature and the federal Congress. | ||
| We need to get them involved in these cases. | ||
| So pressure the hell out of them. | ||
| Blow up their phones. | ||
| I mean, we need 20. | ||
| We need at least 20 by tomorrow, so they have until 10 a.m. | ||

| They need to file a lawsuit in response to the Texas lawsuit in SCOTUS. | ||

| In order to increase the standing and the argument of what Texas is arguing. | ||

| And again, you know, this is what I just learned today is that the Supreme Court has already ruled in 1997, Foster versus Love, that all ballots received after midnight of election day are null and void. | ||
| That means the ballot stuffing, early morning rigging, subsequent ballot discovery, and all of those things that happen in the morning, the wee hours of the night, and anything past November 3rd would be considered null and void. | ||
| That the SCOTUS already ruled on this in 1997 at this lawsuit. | ||
| So you would think that if it gets to the Supreme Court that they would rule the same way and they have this to look at to go back on. | ||

| And we're going to get to that in a second. | ||
| He also, you know, thousands of people that were underage and a lot more. | ||
| Now, before we get to the details of that lawsuit, here's what's also really interesting. | ||
| The Amistad project just put this out. | ||
| They say that electoral college dates, which we were talking about before, they're actually moot in light of ongoing election contests. | ||
| And a lot of people don't understand this. | ||
| They don't really know it, so they just see these deadlines coming up. | ||
| And they think, oh, my gosh, we're we're done. | ||
| You know, this is just we're losing all our chances and we don't have time anymore. | ||
| And they're sealing these these election results. | ||
| Right. | ||
| But it's actually more ambiguous than most people think. | ||
| So they says the week of, you know, this December 8th, it's the big deadline, right? | ||
| The big deadline to finalize the election results. | ||
| But the Amistad project, which has been involved in numerous lawsuits, they combated these claims over the weekend in a white paper that posits from a constitutional standpoint that the only deadline that really matters is January 20th. | ||
| Just like Ivan said, it's January 20th, the electoral college deadlines, December 8th and 14th. | ||
| They're arbitrary and they're a direct impediment to states' obligation to investigate disputed elections. | ||
| So this is really important to know. | ||
| The December 8th and 14th timeline of selecting electors, it could easily be moved without harm to the country. | ||
| Especially when one side is not providing the details we need to verify election results. | ||
| And the other side has evidence that is starting to flow. | ||
| And as we see now, You know, we have the evidence that's starting to flow. | ||
| So these are really just the December 8th deadline that they've been trying. | ||
| The MSM has been scaring us, thinking that this is the be all, end all. | ||
| It's actually not. | ||
| It is much more open-ended. | ||
| It is much more ambiguous, especially given the fact that There's opening there's there's lawsuits that are ongoing and that's very important to know so that's good news You can check that out the Amistad project. | ||
| It is not set in stone and this is this they talk about a lot of other good things and then what I also said is that remember The SCOTUS already ruled in 1997 Foster vs. Love that all ballots received after midnight by election day are null and void. | ||
| That is good. | ||
| So the voters vote, the officials count, these combined actions form the election, and the election must be decided on that day. | ||
| States have failed to make a final selection of officeholder by midnight after election day have violated that statute subjecting the nation to at large to the very evils congressionally mandated deadlines were drafted to prevent. | ||
| So to remedy this situation, a person or state merely needs to ask the U.S. | ||
| Supreme Court to remedy the violation by nullifying the votes of states which attempted to commit election fraud by extending election day to election weeks. | ||
| So again, if this does make it into the Supreme Court, they take it. | ||
| They could draw on this ruling 1997 Foster vs. Love. | ||
| So that's another piece of encouraging information, encouraging news. | ||
| We need to see as much encouraging news as possible so that we can all be excited and looking forward to a Christmas miracle that is very likely to happen. | ||
| So that's the big pieces of news on the election front. | ||
| There's also, not only, there's so much going on, but one thing is very, very disturbing, is the amount of North Korea. | ||
| You know, it's like, our censorship, our fascists, fascism in the U.S., they've really reached North Korean style censorship levels, totally Orwellian, and they're not even ashamed of it. | ||

| They says, for example, we will remove videos claiming that a presidential candidate won the election due to widespread software glitches, counting errors, etc. | ||
| It says we're going to be enforcing this policy today and we will ramp it up in the weeks to come. | ||

| What are the implications of that? | ||
| That means that nobody, you know, that means that now news anchors, shows, political pundits and comments, they're gonna have to self, they're gonna have to thought police themselves. | ||
| They're gonna have to monitor their own speech because if they say something on a news station at all relating to any of the fraud or voting regulators, et cetera, that content, that video isn't gonna be allowed on YouTube, okay? | ||

| So this means I guess any any of the news that is going to be covering the election fraud, the court cases over the next six weeks, not going to be allowed on YouTube. | ||

| They said, Which is obviously true. | ||
| That Facebook has maintained its monopoly position by buying up companies that present competitive threats, which they do. | ||
| And by imposing restrictive policies that unjustifiably hinder actual or potential rivals that Facebook does not or cannot acquire. | ||
| The lawsuit asked the court to order the divestiture of assets, divestiture or reconstruction of businesses, as well as other possible relief the court might add. | ||
| Because remember, Facebook bought Instagram, Facebook bought WhatsApp, and what they do is they buy these companies, So that there's no other competition. | ||
| And then they make it almost impossible for any other competing company to even compete, to make it as big as them. | ||
| They do everything that they can to stamp them out. | ||
| So this is a major lawsuit. | ||
