Bob Casey, the incumbent senator, lost by a pretty wide margin, and Dave McCormick is the new senator from the Commonwealth.
It's not even going to be close when all is said and done.
They have a mandatory recount when it's 0.5% of the vote, which is what the number was.
Fair enough.
Have that happen.
But that's not where the trouble went in.
In September, the Republican Party in Pennsylvania went to that state Supreme Court, and the Supreme Court ruled unequivocally that ballots must meet legal standards for them to count.
They've got to be dated properly.
They've got to be signed properly, etc.
This was in September before the November election, this past election.
Now, in spite of that Supreme Court ruling, you have, which is kind of remarkable, to be very honest with you, in Bucks County, you have a woman by the name of Diane Marseglia, who said that Roe v.
Wade was the reason for her just outright saying publicly that she would violate the Supreme Court decision in September, just a couple of months ago.
Now, the Supreme Court has subsequently ruled seven to zero that, in fact, that Supreme Court order stands.
They weren't going to change their mind from September.
It never was going to happen.
And right now, you have people like Senator Danes is now saying that this person ought to be charged because this was in direct defiance of what the law in the Commonwealth of Pennsylvania is.
Now, the woman, Diane Marseglia, has put out a statement, and she is now saying, originally, she said she would violate the law, county illegal ballots, and now in tears, basically saying she made a mistake.
She said, last Thursday, when I spoke at a meeting that you're all here about, the passion in my heart got the best of me.
I apologize again for that.
That was a hearing, and we were talking about provisional ballots.
We were specifically talking about the fact that there were certain provisional ballots where a judge of elections did not sign and did not make sure that a voter signed the outside of an envelope.
To me, it was frustrating and unconscionable that we would take away somebody's vote, not because they made a mistake, but because an employee or one of our members or one of the judges of elections didn't know what to do or forgot or just made a mistake.
That issue that I spoke on has now gone viral for my comments.
It was genuinely not the best words.
I would do it all again.
I would not do it all again.
I think she means not, but it says in the statement I'm reading, I would do it all again.
I feel terrible about it.
I should have been more clear.
Please, I will be more clear in the future.
And she claimed her reference to the court precedent related to the U.S. Supreme Court overturning Roe v.
Wade, which resulted in loud groans from the crowd.
I remind you all that we all say things that are out of turn.
We all make mistakes.
I made a mistake.
And because I'm an election official, I'm held to a far higher standard.
But is it a legal standard?
I mean, that's the point.
And anyway, here to weigh in on all of this, Greg Jarrett, Fox News legal analyst, best-selling author, David Schoen, Civil Liberties Attorney, former counsel for President Donald Trump.

I'm not sure.
You know, there's a part of me that maybe is too compassionate.
I don't know.
There's a part of me that thinks that this woman should never be allowed to have anything to do with any election ever again.
I mean, this was so defiant of a Supreme Court decision.
However, if we are to follow the law, she would probably be indicted.
Am I wrong, Greg Jarrett?
You are correct.
She decided to count ballots that were repeatedly deemed illegal by the Pennsylvania Supreme Court.
And then she was arrogant enough and dumb enough to publicly announce what she was doing, recognizing that she was breaking the law.
You know, she said, people violate the laws anytime they want.
If I violate the law, it's because I want a court to pay attention to it.
You know what?
The court, the magistrate court, which decides criminal referrals, should take notice and pay attention to what she said and what she did and make a criminal referral to the district attorney.
Because election tampering and interference, even by an official, especially by an official, is a crime.
It's a fraud felony.
It's a conspiracy felony.
25 Pennsylvania, 3527 is the statute if you want to look it up.
And the U.S. attorney...
By the way, I'll do that in my spare time.

The fact that you know this stuff cracks me up.
Go ahead.
This is what makes you so good at what you do.
You know this one because you and I have talked about it before.
The federal felony, conspiracy to deprive people of their constitutional rights, 18 U.S.C. 241.
You know that one because we've talked about it.
Whenever you count deliberately an illegal ballot, you are neutralizing the voters who sent in valid ballots, and that's a deprivation of their constitutional rights.
That is a crime.
It's a conspiracy to commit a crime.
So she's opened herself up.
Now, what she should do is she should resign.
And, you know, that might in some way help her if authorities want to be charitable about it.
She has opened herself up to criminal charges and she incriminated herself unbelievably enough.
What's your reaction, David Shoan?
First of all, she did say I would do it all again.
I heard her say it live, but I think she must have misspoken.
Listen, the problem for her, first of all, you're right.
She can never be allowed near an election, maybe not even a voting booth, ever again.
It doesn't matter why she did it.
It's not her prerogative to violate the Supreme Court decision and to count votes that they have said can't be voted.
But what she made it worse, besides the comment that Greg accurately read, that she said she violates laws and so on.
If she does so, here's why.
She's, again, turning it around, taken out of context.
She apologizes for the upset and the confusion it caused.
Nothing caused any confusion.
She was explicit in what she said.
It's a misinterpretation of an inartfully worded statement.
That's not an apology, really.
And she seems still not to recognize how very wrong what she did.
She's concerned because people are taking her to task over it.
She has to be out.
She's out.
Well, should she be charged?
I'm not a big fan of using the criminal process to address every ill that there is.
I do think she committed a crime.
I think her own words convict her.
She certainly committed a conspiracy and at a minimum an attempt.
But I don't know what purpose it serves at this point.
I think we have to make a clear statement what she did was wrong and illegal and so on.
But I don't know that it's worth taking up the process with as long as she's out.
Can't ever come back.
But we have this phenomenon now going on with Democrats.
For example, the Supreme Court ruled on student loan forgiveness and the Biden administration kept giving out money for student loan forgiveness.
They just defied a Supreme Court ruling.
I'm sitting here in amazement that Democrats, elected officials, lawmakers, governors of blue states are all saying that when Donald Trump enforces the law, that they're not going to help him and that they're putting the safety of people that didn't respect our laws, border sovereignty, ahead of the safety of the American people.
That is incomprehensible to me, Greg Jarrett.
And as a matter of law, aren't these governors that are saying these things, that are aiding and abetting in this law breaking with their sanctuary cities and states that is in direct defiance of federal law?
Didn't Harris and Biden break the law by aiding and abetting illegal immigrants?
I mean, aren't they all breaking the law here?
Well, they are, because it's a crime to be here illegally.
It is also a crime, and it's a felony, to illegally harbor an illegal immigrant.
You can be subject up to five years imprisonment for harboring aliens.
And I use that word aliens because that's how the statute reads.
So, you know, these sanctuary cities are illegal.
The new Department of Justice come January should take a serious look at, you know, these sanctuary cities and these policies that are aiding and abetting criminality.
And, you know, I wrote about this, goodness, seven years ago, I think it was, that the law needed to be enforced.
And I cited the statutes and I said, look, this is illegal.
Why aren't these people being criminally charged?
And, you know, that has always fallen on deaf ears.
But I think a new Department of Justice, whoever is the Attorney General, needs to take a serious look at it.

I mean, this is institutionalized law breaking.
And they even tried that bill that Kamala Harris talks about, the border security bill from day one that she was pushing.
That was never a border security bill.
That was an amnesty bill that would have allowed 2 million illegals in the country every year, likely unvetted as most of the people have been.
And they would then have the ability to codify into law.
They would have discretion about whether they even enforce that law, which means they would codify their illegal activity into law, which would have been a disaster.
First of all, I have no doubt in my mind that the new Justice Department will shut this stuff down and will go after it.
But consider the hypocrisy.
It's as if the Democratic Party decides certain crimes are our crimes, which we have license to do, and others we're going to concoct crimes.
And as if Trump is involved, we're going to create a crime and charge him with it.
And that was what lawfare was all about with all of these charges brought against him.
And we saw it for the last several years.
But I'll tell you this, where they ought to rule today.
During the second Trump impeachment trial, their theory, literally, and it's in their brief, so anybody suggests I'm wrong, I'd be happy to read it to them, that anybody, any former president can be impeached no matter how long out of office.
They gave the example, you know, Thomas Jefferson could be impeached for something to do with slavery and so on.
So these are probably impeachable offenses, what's happened here.
I'm hoping that the Congress won't take up their time again with another impeachment.
But if they did, based on their own language, I think that President Biden would be subject to impeachment, quite frankly, because their whole theory is it's got nothing to do with just being thrown out of office.
Once you're out of office, you can still be impeached and convicted, according to the Democratic Party.
According to the Democratic Party.
But here's one of the things that I think both of you will agree with me on.
What they have done using by weaponizing the Department of Justice, what they have done to the FBI, James Comey in particular, FISA abuse in particular, the intelligence agencies, you know, 51 former Intel officials that knew nothing about Hunter's laptop impacting an election at the request of Wink and Tony Blinken.
To me, we have to restore constitutional order.
To me, Greg Jarrett, we have to have fidelity to our Constitution.
We cannot do to them what they did to Donald Trump and to many others.
And that means that there cannot be retribution.
What we need to do is restore constitutional order, take away any possibility in the future of the weaponization of justice, restore the FBI to its former greatness, restore intelligence agencies to their former greatness.
Am I wrong?
No, you're not wrong.
I agree with all of what you said.
There are other steps that can be taken short of criminally prosecuting the people who so blatantly violated the law.
For example, the 51 ex-Intel officials who signed the phony letter saying that the laptop seemed to be Russian disinformation.
They should have all of their security clearances yanked, which means they would never be able to do such a thing again.
You know, but I agree with you that just because law fear was corruptly used against Trump doesn't mean that he should flip the table and use it against the same people.
And, you know, I think he's made it clear that he's not in this for retribution.
His retribution is success for the American people to put forward and accomplish his agenda as he promised on the campaign trail.
I think that's the right course of action.
Sean, I have to say I think that this election was in large part decided based on what you just said.
I think the American people are fair-minded people.
They love their constitution.
They love integrity in government.
We saw it every step of the way.
They never could play it straight.
They put on the Mueller Commission only people who hated Trump and had conflicts of interest.
The prosecutors they used to bring these cases in jurisdictions where they knew they could get a conviction, no matter what the facts were.
People, I think, were sick of it and fed up with it, and it tore at the heart of our Constitution and our justice system.
And it strikes fair-minded Americans wrong.

Well, I wanted to weigh in on the transgender athletes.
I'm looking at this from a couple different perspectives.
I'm a biologist.
Plus, I've bred horses and cats and dogs and shown them.
And there's such an obvious difference between the genders, even if there are those that don't want to acknowledge it.
It's night and day.
And one of the things that always comes to mind is horse racing.
You have Phillies running against Phillies.
You have Colts or the male horses running against male horses.
And within that, the definition of a male horse is a gelding, which is a male horse that's been neutered, for lack of a better term.
And it doesn't matter what his testosterone level is, because I know that they do that with athletes.
They measure the testosterone level and they say it's below a certain point so they can compete.
But when it comes to horses, you're running intact males against neutered males, and you don't have Phillies thrown in there for the most part.
And Phillies, again, they just don't have the, typically, I should say, not all, but typically they just don't have the build and the stamina that a male horse has.
I mean, the fact that you have to state the obvious, and when I started my talk radio career, this is not a discussion I ever anticipated we'd be talking about as often as we have to talk about it.
I never thought I would be discussing a presidential candidate that wants to offer free taxpayer-funded sex change operations to illegal immigrants and convicted felons.
But here we are.
Welcome to the year 2024.
And what you are saying generally, there are exceptions to it.
You know, I do mixed martial arts and situational self-defense, and I train every day.
And generally speaking, men are physically stronger than women.
There are exceptions.
There are some trained martial artists, female fighters that could probably kick my you-know-what from, you know, here to eternity.
But that is the exception.
It is not the rule.
Men tend to be biologically stronger than women.
And, you know, the fact that this is a complicated issue for people, I don't know why.
I mean, and I always defer to Caitlin Jenner, who I've known for so many years, interviewed Caitlin when Caitlin was Bruce Jenner.
And we've had very, very deep and profound conversations about this.
And at one point, I remember saying to her, I said, I'll be honest, Caitlin, I don't understand it.
And you know what her answer was?
I don't expect you to understand it because you're not living it.
And I said, that's a fair answer.
And it is a fair answer.
And then she went on to explain, you know, that, for example, you're talking about a decathlon championship, a champion here, a great athlete, still is a great athlete, even as she's getting a little older.
She can drive the ball 300 yards.
She could win so many ladies' golf tournaments if she wanted.
But she says herself, it would be an unfair advantage having been born a biological male.
And, you know, I do agree with Speaker Johnson on dignity, respect.
I believe in the golden rule, love God with all your heart, mind, body, soul.
Treat your neighbor the way you want to be treated.
You know, treat people like, I mean, it's just simple stuff.
Treat others the way you want to be treated.
That's it.
And if we do that, I think we're a better society.
Now, with that said, you know, maybe the answer is they could put a couple of trans bathrooms in Congress and let the taxpayers pay for that.
I guess that's, you know, maybe that's the compromise.
I don't know.
However, I think as of now, with that not being in place, that, yeah, biological men should use the men's bathroom and biological women should use the women's bathroom.
And I can't believe with all the problems we have in the country that this is what Congress now has to deal with.
But welcome to Washington.
Welcome to a woke world.
Welcome to radicalism and extremism that is now dominating the Democratic Party.
That's who they now are.
It defines them.
And the American people rejected it in huge numbers over this election.

Now, there were a few campers in there, but I estimate there was probably 20 to 30 tents, Sean.
And a good number of these tents, they had generators outside the tent.
So I would imagine, because the temperature is 35 degrees today, I would imagine that they are running space heaters inside these tents.
And I just thought about that, about how dangerous that is.
And I know that you're friends with President Trump.
And I'm just hoping that maybe you would relay this story to him and see if we can't get some help for these people.
They're living in tents.
They've lost.
Well, I have offered help.

Their lives upended.
