The Supreme Court of the United States, as we learned on Friday, has now taken up the issue of Colorado and whether or not you can kick Donald Trump off the ballot using the 14th Amendment, Article 3.
And it's not going to happen.
I can't imagine or envision any scenario in which that would be allowed to happen.
Number one, Donald Trump was never charged with insurrection.
Nobody's been charged with insurrection, let alone convicted of insurrection, which is exactly what that amendment to our Constitution is referring to.
It was interesting over the weekend.
I saw that Missouri Secretary of State Jay Ashcroft threatened to remove President Biden from the ballot in response to the decisions by Colorado and Maine to try and ban Donald Trump from their ballots.
He called it disgraceful, said it undermines our republic, and he expects the Supreme Court to overturn this.
It should be a 9-0 opinion, but I'm out of the prediction business when it comes to what way the Supreme Court justices are going to come down on a decision.
But if you're not charged and you're not convicted and your office is not even specifically mentioned, which it is not, and I don't think that the people that framed, that wrote the 14th Amendment, I don't believe that they did so, kept the president out of there by accident.
I believe it was by design, and no one's convinced me otherwise.
But anyway, he said he expects the Supreme Court to overturn this.
If not, Secretaries of State will step in and ensure that the new legal standard for Donald Trump applies equally to Joe Biden.
Well, the case can be made now that an impeachment inquiry begins this week into Alejandro Mayorkas as to whether or not Joe Biden has literally not followed through on his oath of office to uphold our Constitution.
And that being on the issue of immigration, that he's violated our laws of aiding and abetting those people entering the country illegally and providing them free transportation to the state of their choice.
President doesn't get to pick and choose.
We do have co-equal branches of government.
We have separation of powers.
And Joe Biden doesn't get to pick and choose which laws he's going to enforce and which laws he's not going to enforce.
That's not the way it works.
We learned on a podcast, Jay Sheety's, I've never heard of this before, on-purpose podcast released today.
Michelle Obama complaining that she is terrified about what could possibly happen in this year's presidential election.
She's saying, in other words, that she has no confidence in Joe, because that's what it sounds like to me.
She said, because our leaders matter.
Who we select speaks for us.
Who speaks for us?
Who holds that bully pulpit?
It affects us in ways that sometimes I think people take for granted.
She went on to say, we cannot take this democracy for granted.
And sometimes I worry that we do.
And those are the things that keep me up.
And she said the future of artificial intelligence education, whether the public is too stuck to their phones and voter engagement among her chief concerns.
Anyway, she was asked about the phrase she famously uttered in 2016, when they go low, we go high, and how it evolved.
And without mentioning him by name, Michelle Obama appeared to condemn Trump.
The tone, the tenor, the message matters.
We can just say that the first thing that comes to our minds, the becoming author said, this is not authenticity to me.
That's childish.
Oh, is that like every Democrat now saying that the very Democrats that don't want Donald Trump to even be on the ballot to allow the people to decide are the very ones saying democracy is in jeopardy and that our system of government is in jeopardy?
And Biden saying that the fight for democracy is at the heart of his 2024 rematch with Donald Trump.
And if you want to defend democracy, make sure you can't vote for Trump.
And then Biden strategically comparing Trump to Nazis to raise the stakes of everything.
He delivered this speech and said that Trump is echoing this same exact language used in Nazi Germany.
Okay, they go low, we kick them, the Eric Holder strategy.
Anyway, as a result of that speech, Biden did raise a whopping $1 million online just by going off.
Well, we can see which way Biden is going here.
Biden doesn't have anything to run on.
This is what I said the very first day back.
I said, buckle up because this is going to be what the election year for Democrats is going to be about.
Democracy is in peril.
They're going to say January 6th, January 6th.
They'll leave out the parts that would be exculpatory, just like the January 6th committee did.
I mean, they had a predetermined outcome.
They stuck to it the whole time.
Never mind that the Capitol police chief said repeatedly, even on this show and on my TV show, that there were many, many signs that they had actionable intelligence.
Never mind even Lester Hope on NBC News reported it.
Never mind Trump said to peacefully and patriotically march to the Capitol so your voices will be heard.
That never got played during the January 6th committee hearings.
Jim Clyburn also echoing the comments of Michelle Obama that he's very concerned about black voter turnout for Biden.
Well, what has Biden done for any demographic group?
Why break down demographically?
The country's suffering.
And this goes to the heart of what I'm telling you to brace yourself for, which is going to be a political, emotional roller coaster if you care about the country and the direction of the country.
And you can't name a single policy that Biden's implemented that has been effective and has made your life better or a single foreign policy issue that he's good on because they don't exist.
You know, I noticed that Biden, the campaign, brought a bunch of top journalists to Wilmington, Delaware over the weekend to meet top officials.
Well, that's basically them being fed their talking points so they will just echo everything that the Biden campaign wants to message.
That's all that is.
That's pretty much the 2020 strategy anyway.
But if you want to talk about if they go low, we go high.
No, they go low, we kick them.
I think it's the Eric Holder, we go low, and we kick them.
Biden's away, we nearly lost America on January 6th.
Well, if we had all this intelligence, why didn't we act on it?
Forget what Sean Hannity reports.
NBC News Lester Holtz reported that.
Actionable intelligence ignored.
That would be an intelligence failure.
You know, why not listen to the Capitol police chief who was originally against the guard being called up, but in the days leading up to January 6th, three years ago, he saw intelligence and he was desperately trying to have guard troops on standby and nobody wanted to pay attention to him.
I don't recall him ever being interviewed by the January 6th committee.
You know, there's certain details they want to omit here.
For example, why didn't the sergeant of arms get questioned?
Why didn't Nancy Pelosi's text messages, emails, phone calls?
Why didn't they get subpoenaed?
You know, Chuck Schumer, same thing.
Why not the sergeant of arms?
They're the ones that are supposed to be in charge.
What did they know in terms of actionable intelligence that they didn't act on?
You know, why does everyone ignore that I have four interviews with four people in the days leading up to January 6th, Trump himself, Kash Patel, who was the chief of staff of the then acting defense secretary Miller.
Miller says it himself.
And also we had in the meeting Mark Meadows, and they all said the same thing.
Trump said, do we need National Guard troops?
Muriel Bowser, the D.C. mayor that would have had to sign off on it in writing, didn't sign off on it.
So it wasn't going to happen.
But why let that get in the way?
And then, of course, just like everything else Joe Biden does, it becomes an unmitigated disaster.
If you haven't seen the tape, we'll air it for you tonight.
But this is going to be their whole campaign strategy.
And Joe Biden had to be let off stage by Jill Biden, literally walking him off stage like a child after he read a speech that we know somebody else wrote for him.
I don't even think he's capable of writing the speech, you know, filled with his hatred and his vitriol and his blame and democracies in peril and, you know, making Nazi comparisons and calling Trump every name in the book.
Well, it's certainly convenient because then he doesn't have to talk about his disastrous border policies.
He doesn't have to talk about his disastrous economic policies.
He doesn't have to talk about anything of real significance to the American people.
He doesn't have to talk about war in Europe and his handling of it, his part of it, he botched, or the fact that he's not been supportive of Israel in reality.
He's saying one thing publicly, and I'm being told by the highest level officials in Israel.
He's saying other things behind the scenes, telling basically Israel to lay down and give up and surrender and have a ceasefire that's permanent.
Well, they killed what would be the equivalent of, if you extrapolate population, out 40,000 Americans in a day.
Anyway, Biden was mocked for appearing days confused and mumbling and bumbling and stumbling after his anti-Trump speech when his own wife has to go out there and escort him off the stage.
It's getting worse.
I can't think of a Joe Biden public appearance in the last number of months, I don't know, four or five months, where everything has gone well, where he's been able to get through a speech, get off the stage, and not look days confused and mumbling and mumbling.
You know, cognitive decline is something that is degenerative.
It never gets better.
It only gets worse.
And I don't care what medication somebody might be on.
It might buy you time.
It might give you a few hours during the day where you're more lucid than you would otherwise be, but it's certainly not enough to get anybody through.
Now, we have this great mystery about our defense secretary, Lloyd Austin, who was hospitalized at Walter Reed on the 1st of January, where he still remains.
But here's the scary part.
This is our Secretary of Defense.
His hospitalization was kept secret for days from top administration officials.
Apparently, it was an elective surgery that had complications.
And now we're learning that not even Joe Biden himself knew.
How is it possible that President Biden didn't notice that his own defense secretary had been missing in action for this length of time?
And whatever happened to the transparency that the Biden administration promised that they would implement?
I thought they were going to be not transparent.
I know, well, even the deputy who covered for the Defense Secretary Austin didn't even know that he was hospitalized, according to one press report.
The Pentagon press secretary, Major General Pat Ryder on fake news CNN, saying that Austin transferred certain operational responsibilities that require constant secure communication capabilities on January 2nd, the day after he was admitted to Walter Reed.
Throughout the week, they made some routine operational and management decisions, but they didn't even tell the president.
I think if anybody else did this, I think rightly so, heads would roll.
You know, what's worse is Biden didn't even know that his own defense secretary was missing, nor did National Security Advisor Jake Sullivan.
He only noticed that he wasn't at a meeting.
It wasn't until the Pentagon let Sullivan know, but that wasn't until Thursday of last week.
So anyone thinking that the nation is well-led despite Biden's feebleness, better think again because what if we had a national security crisis at the time?
By the way, can somebody get the defense secretary?
We can't find him.
Anyone know where he is?
No, we don't know.
He's been missing in action for a number of days.
I mean, you would think somebody's head would roll here.
You think somebody would get fired for this.
Probably Secretary Austin himself would be held accountable because he is responsible for the decision.
But there is a growing outcry among members of Congress about the secrecy over his hospitalization.
But, you know, they talked a big game about transparency, but I would say that they failed that test by a long shot.
It's pretty outrageous not to know that your own Secretary of Defense is missing in action.
That's somewhat problematic.
We do have some news on the Hunter-Biden front.
Republicans now will move to hold Hunter in contempt this week.
Ultimately, a decision to charge would have to come from the guy appointed by Hunter's father.
If Hunter Biden is indeed held in contempt by the House of Representatives, the U.S. Attorney Matthew Graves will have a big decision to make.
In other words, will Hunter get the exact same treatment as people like Steve Bannon or people like Peter Navarro?
Or does he get an exception as usual because his last name is Biden?
I would imagine it will be the latter.
That's my guess.
But anyway, they're going to take those steps this week.
The president's son refused for a sit-down closed-door deposition, which is the natural process.
He's also been offered, after he does a sit-down interview, to do a public hearing.
Anyway, the committee's meeting Wednesday of this week on a resolution recommending that the House find Hunter Biden in contempt for refusal to comply with a subpoena.
And by the way, that should result in the same actions that people like Bannon and Navarro had to face.
I don't think it's that complicated.
You just need to understand this is all they've got.
Democracy in peril.
Comparisons to Adolf Hitler.
You know, already the mob in the media, Joe, Liberal Joe, is repeating it, and everybody else will repeat it.
You're going to elect a Nazi.
This may be the last time Americans ever vote again.
This could be it.
This could be the end of our country.
No, it's not.
None of which is true.
But that is all they've got.
Bidenomics selling that didn't work.
If he wants to sell Joe's border policy, good luck with that because that's not going to work.
Bidenomics, well, if we had a good stock market, I went over these numbers.
I'll go over them again.
Then when you dig deep into those numbers, they are not as good as they would have you believe.
And if anybody's out there living in the real world, you know that you're doing a lot worse under Biden's economic policies than under Trump's policies.
That's just a fact.
But still, we got two extra trillion dollars in debt thanks to Joe last year, $6.5 trillion since he's been president.
Quite an accomplishment, Joe.

It's a degenerative condition.
In other words, it's not going to get better and it's only going to get worse.
And it seems that Biden's condition has been accelerated.
And I don't know if it's because of the stress of the job.
Not that he really has much stress when he's gone 40% of the time.
But it's not like he has a busy work schedule ever.
And is he on medication?
I don't think we'll ever know the truth.
I mean, there are certain medications, you know, that we are seeing hope for in terms of very specific diseases like Alzheimer's.
And I'm not claiming he has Alzheimer's.
I'm just telling you, this guy is in a cognitive decline.
He's a mess.
And the fact that he finishes these speeches that other people write for him and he throws out the word democracy in peril over and over and over again and Nazi over and over and over again.
And Donald Trump, Donald Trump and MAGA Republicans and the whole mantra, you know, that somebody else wrote, but then has no idea whether to exit stage left or stage right and needs his wife yet again to direct him where to go and walk him off the stage.
Speaking of the economy, the world is becoming more and more unstable by the day we see it.
But, look, I'm not waiting around to find out how bad this can get.
I just I don't see anything that's given me a lot of hope and optimism worldwide right now.

These are tough economic times.
Bidenomics, they're not using the phrase anymore, which probably tells you everything you need to know.

Speaking of which, you know, we did a breakdown of these numbers.
Now, Biden inflated his employment numbers, and these numbers came out last week, and everyone's quick to say these numbers are amazing.
But what they didn't tell you is that, and this seems to be by design because it's almost happening every month.
But, you know, you get numbers from the Bureau of Labor Statistics, and then they have been revising those numbers downward month after month after month.
As a matter of fact, the government quietly, just magically erased 439,000 jobs through November of 2023.
A closer look at the numbers of the Bureau of Labor Statistics.
So they come out with an initial report, then they come out with a revised report.
And pretty much every single time you look at it, it shows up it's revised downward.
If you look at the U.S. labor participation rate, it is now historically low.
It's 62.5%.
Edward Lawrence reporting that the December jobs report showed 683,000 workers dropped out of the labor force.
A record high of 8.69 million people now hold multiple jobs just to make ends meet.
And the economy lost 1.5 million full-time workers since June of last year while adding 796,000 part-time workers.
So you can claim that those are jobs, but you know what?
No, I don't think anybody can.
I'll tell you this.
I don't think anybody can say.
Well, Hannity, the stock market went up.
Well, for the 60% of Americans, really, that are living paycheck to paycheck, the ones that are literally putting bare necessities on credit cards with high interest rates, the people that are going into their pensions early with a very, very high penalty.
They're not going to tell you that the stock market means a whole hill of beans to them at this particular point in time.
And the numbers from last year, 2023, just made up for the losses in 2022.
But full-time workers fell over $1,005 from November to December.
Part-time workers rose $762,000.
Multiple job holders now at a record high of $8,565,000.
That's up $222,000 in December.
And then you look at the revisions from October to November, non-farm payroll employment numbers, it shows a more stagnant job growth than initially reported.
You know, October revised downward, November revised downward.
In total, these revisions, that's where I come up with the $439,000.
Federal debt under Joe Biden is up a whopping $6.2 trillion.
The Biden administration has been, you know, just purposely out there deceiving is what this is.
The energy department, even though the price of oil is, you know, $75 a barrel, a barrel of oil, they're now claiming that the strategic oil reserve refill prices are good for taxpayers.
Let me tell you what that is.
That is the Biden insurance policy, because if you remember, they depleted those strategic petroleum reserves in the lead up to the 2022 election.
And unbeknownst to a lot of people, we've taken note of it.
The squad, I guess, hasn't noticed yet.
The new green dealers and the climate alarmist religious cult never really taken notice yet.
But American production of energy, somebody got to Biden and was smart enough to tell him this is the biggest thing that you could do for the economy.
And if you want to fix the economy, start producing more energy so we're not so dependent.
Now, simultaneously, he's also letting Iran get a hold of $10 billion.
He's importing oil from Venezuela and becoming more dependent than ever before.
What they're also not telling you is demand has never been higher than it is right now.
So that's a nuanced point that nobody will ever make in the media mob, but they want the economy to at least, they want to create the impression or the perception that something is happening that's not.
And then if Biden ever got reelected, I guarantee you the climate alarmist religious cult strategy of not doing domestic drilling or fracking or coal mining would be back in play within seconds.
Everything is more about the immediacy of doing everything possible that they can do to get Joe Biden reelected.
By the way, the Biden DOJ has announced plans to target, quote, nonviolent January 6th protesters that never entered the Capitol.
And I read this.
Our friend Kerry Pickett wrote this for the Washington Times.
And anyway, the D.C. U.S. attorney, this guy Matthew Graves, I believe he's the guy that's going to make the decision on whether to hold Hunter Biden in contempt like they did Bannon and Navarro.
He's announced that Biden's January 6th prosecution team will now start focusing on rounding up the nonviolent protesters who never even entered the Capitol building that day.
Well, are you not allowed to have a peaceful protest?
They didn't go into the Capitol.
They weren't part of what took place that day.
Why would you hold them accountable?
He's the attorney, by the way, that blocked David Weiss's initial attempt to bring tax charges against Hunter Biden.
Just as another side note, Hunter Biden didn't deserve to be prosecuted, what, for failing to pay $1.4 million in taxes?
But if you go anywhere near the Capitol and you didn't enter the Capitol, you didn't trespass, you didn't violate any laws.
Well, we have all this videotape that still exists from the summer of 2020 and the 574 official riots that took place that summer that they told us was mostly peaceful.
And we have videotape of people pelting bricks, rocks, bottles, Molotov cocktails at cops that injured 2,000-plus police officers and killed a couple of dozen Americans.
And we've watched businesses burn to the ground and billions of property damaged.
Why don't we use that tape and go after those people?
Pretty unbelievable.
Anyway, that's what their plan is.
Bill Barr has ripped Biden's DOJ for going too far with these prosecutions.
He said the Justice Department went too far in charging more than 1,200 people for January 6, 2021, including those that he said simply walked around the building and didn't do anything else.
Like everything else the left does, they go too far.
This is what they've done with Trump.
This is maybe the most fascinating jujitsu, political jiu-jitsu move ever.
Because the more they persecute Trump, the more they indict him, the more they arraign him, the more they talk about him, his poll numbers go up.
Now, I've been doing this a long time.
It defies all conventional political gravity.
It doesn't usually work out that you arrest somebody, you arraign somebody, and their poll numbers go up.
So then you have to ask, well, what's causing that phenomenon?
And I would argue that the left has now done something nearly impossible.
They've taken a fighter and a brawler like Donald Trump and they've turned him into a sympathetic figure.
Because Americans fundamentally are fair people and they see injustice when they see it.
And going back to the Russia hoax and two impeachments and all the overreach and now comparing him to a Nazi and democracy in peril, and it's just people's eyes glaze over.
They look at him as the victim in all of this and they don't like it.
And that's why this is so critical that we not have a weaponized Department of Justice or a politicized or weaponized FBI.
Later on, we'll get into this issue of blue states, the blue state exodus.
I still cannot get over the reaction to my announcement last week that I'm now a full-time permanent resident of Florida.
I didn't do it to get a reaction.
I just did it to inform my audience.
And like everybody else, there are reasons that people make decisions about where they want to live.
There's a National Review article, we'll get into this later too, that actually suggests with population trends shifting and changing the way they are, they think it might actually, on the electoral map, be helpful to Republicans.
I hope that's true.
You know, if you'll need more reasons to leave California, they got a new California law restricting carrying guns in public.
You do have one sheriff out there saying, sorry, I'm not abiding by this unconstitutional order.
On top of what, now California retailers are required to have gender-neutral toy aisles, and the hundreds of thousands of illegal immigrants in California now are given free health care thanks to the taxpayers in California.
The California Sheriff's Office announced Wednesday that it does not plan to enforce this new gun law backed by Governor Gavin Newsom, a new concealed carry law that went into effect that prevents firearm owners from carrying weapons in sensitive public places like parks, stadiums, government buildings, medical facilities, churches, public transit, many parking areas, anywhere liquor sold, consumed, et cetera, et cetera.
So, what are they going to do now?
They're going to go after this guy.
Wouldn't surprise me.
Biden has been watering down the vetting process we've now learned for Chinese illegal immigrants.
Now, of all the countries that I keep mentioning, hostile regimes, some of our biggest geopolitical foes, like Iran, Syria, Egypt, Afghanistan, Russia, China, Russia and China, you know, they've encountered 26,000 Chinese nationals at our southern border.
We've chronicled how Chinese nationals have been purchasing thousands and thousands of acres of American farmland, American ranch land, and land near military installations.
Now, none of us would be allowed to go to China as American nationals and be able to do the same thing there.
Well, now we learn that the border customs and border protection agency now has watered down the screening process for Chinese asylum seekers amid a record surge, over 26,000.
Now, why am I suspicious knowing that China is our number one geopolitical foe?
Why am I suspicious the way they treat us with their spy balloons, their hostile actions in international waterways against our Navy, international Airways with our fighter jets threatening our ally Taiwan, and of course, unfair trade practices, intellectual property theft, the spy balloon.
You had it all together.
Why would CBP be slashing the number of questions that their processors are required to ask roughly 40 to just five, which is why we're having an uptick of border crossings all of a sudden of Chinese nationals?
How many of these people might be spies?
How many people might be part of terror networks because we're not vetting any of them?
That's why throughout this week, you're going to watch and see on Wednesday, Alejandro Mayorkas, this impeachment now will take center stage at the House Homeland Security Committee.
And the time for it has come.
Biden's approval rating on handling immigration has now reached an all-time low, and it's only getting worse.
He's upside down on every major issue.
Look, he has to talk about democracy in peril.
He has to talk about January 6th.
He has to fixate on Donald Trump because he can't talk about any success because he doesn't have any.
