This is Jay Sekill and Jordan Seculo in for Sean Hannity.
We are um I gotta say this.
Right now, you're looking at what's going on in the air when it comes to balloons and spy balloons and regular balloons and the trains that are derailing with toxic material, airplanes hitting each other.
I mean, this is a dysfunctional government.
And I am thrilled with our next guest who we got, has really been a friend of ours for a long, long time that's right.
Tulsi Gabber's joining us now.
2020 Democrat presidential candidate, a veteran former Congresswoman, and she's been speaking out on this issue involving East Palestine, uh, Ohio.
It is horrendous.
I'm sure if anybody's been watching, it's terrible.
Just the imagery, and you know just from the imagery alone, when you see the EPA come out and said, Well, if it's been tested, and that got the check from us, we drink the water.
And then you think about Campbell.
The governor said no, don't you think about Camp LeJuta, these other issues we see, you say, do we really want to trust these these guys on this issue with uh we know over time it could be decades later to clean up at ground zero.
The list goes on.
Let's talk to our friend Tulsi Gabriel.
It's a great podcast, by the way.
I've had the privilege of being on.
Tulsi, welcome to the Sean Hannity Show.
I'm glad you're with us.
I want to get you, you know, you have you've got a unique situation.
You've served in Congress, you're serving our military, so you've seen a lot from a lot of different sides.
You look at what's going on now.
I I you kind of have joke, but it's also very serious.
You got balloons being, you know, Chinese spy balloons being shot down, and then we shoot down with military.
And you can't play military for this.
They did what they were told.
Three balloons that apparently were like launched by the Northern Illinois balloon brigade.
You got a train derailment in Palestine, uh Palestine, Ohio with toxic, toxic materials coming out.
And the people there are already suffering, and this is gonna make it worse.
Airplanes are hitting each other on runways and near misses as they're landing.
You know, you you like I said, you've served in Congress, you've served in the military.
What are you seeing right now?
I I really want to get your view on this because this is to me horrific.
Uh James Jordan, it's great to talk to you.
Um, look, it would be too simplistic to say, well, this is a failure of leadership.
We have to go deeper and understand why on the issues that you've raised, as well as so many others that we could cite, uh, whether it's the open border or their collusion with big tech, there are so many, so many issues that we could cite that point to this failure of leadership, but it all comes down to the reality, which is they don't care about our country or the American people.
That that is the only conclusion that can be drawn from this string of failures that are undermining our constitution, undermining our freedom, and ultimately causing harm to the American people and to our national security.
So when we look at this response that they've had uh to the unfortunate catastrophe that the people in East Palestine are really struggling and suffering through is number one, they did not they did not do what was necessary to prevent this.
When you look at the Pete Budejd interview he did, I think yesterday or the day before, where he says, Oh, well, you know, this incident is gaining particular attention, but there are over a thousand train derailments in the last year alone, as though, hey guys, there's not that much to see here because trains derail all the time.
Like, I don't understand how he doesn't see the problem in that statement of saying, Well, hold on a second.
Why is that the case?
What are you as a director of transportation?
You put it you put a small town mayor that they bragged about in charge of one of your biggest departments, the Department of Transportation.
By the way, you may have had derailments, but you didn't have derailments with toxic fumes in the air.
Yeah, it's a what it is a shocking number though, Tulsa is to hear that we have that many derailments, and we s we put together this one point two trillion dollar infrastructure program.
That's exactly what he talks about, oh, these all happened last year.
They act like they haven't been in office.
Like they've just like he just walked into the Department of Transportation today, and so he just you know the blame is like we're spending the money, or Americans think we're spending the money on infrastructure, but it's not going to the infrastructure, obviously, that we need to get up to speed, and then you see this horrendous action, and this this move, even FIBA has said this it's not us.
Don't come knock at our door.
You don't we don't handle these kind of situations.
Yeah, you know, Jordan, that's exactly the point is they're not taking responsibility for this.
They come and spend our taxpayer dollars on this, you know, trillion dollar infrastructure bill, and meanwhile, are not actually addressing the real infrastructure problems that we're facing in this country.
And unfortunately, the catastrophe in East Palestine is getting a lot of attention.
There was another train derailment in Michigan yesterday that also was carrying toxins.
They were able to to turn the rail car uh right side up again after it went off the tracks without any uh damage, at least that we know of at this point.
But the point is to your listeners right now, Americans across the country are starting to think, well, hey, where's the nearest train tracks in my neighborhood?
What risk is is you know, me and my family, my kids, my loved ones at next time there are trains, as they do running across this country when you have the corporate leaders like Norfolk Southern who are completely abdicating their direct responsibility for this catastrophe, and of course, our federal government leaders in the Biden administration who are doing the same.
They don't care, they are not investing in the kinds of technology and safety mechanisms necessary so that those who do live near these train tracks can sleep peacefully at night, knowing they're not being put at risk.
But the root cause of this is they don't care.
They care about themselves, you know, political ambition, their own enrichment, but they do not care about the American people, and that's where we have to demand more and get these people out of office.
I we have heard, and I have not verified this independently.
We've heard that Norfolk Southern has sent out a thousand dollar checks to individuals within the zip codes that are being impacted by this.
Let me just give some free legal advice, which you know, I've done a couple of cases here and there, like a lot of them, and including at the Supreme Court multiple times.
If they're offering you a thousand dollars, I wouldn't be cashing that check.
But that's tough for those a lot of those.
I know it is right now because there are lawyers and law firms that would do this.
Yes, represent these people.
You know what Norfolk Southern came back?
Because some of them said, by the way, when you cash this check, you can't hold us a release.
Right.
Uh, for anything, you can no longer bring any actions related to this incident against worth their new response is they got the wrong letter.
So they got caught.
And they said these people got the wrong letter.
This was about letting us on your property to do.
Yeah, well, that they got caught.
See, what I mean is they're getting caught.
We live in a social media age now.
These big companies who's to get away with this, we see that our own family, grandfather who worked at a plant.
They thought you could just uh pay it off in such a small amount.
And they didn't go to attorneys at that time, but it could have been worth millions even back in the day.
Tulsi, when I look at the the situ what I call the government dysfunction, and we we talk about it in this the horrible situation with this toxic train derailment.
We talk about it with the what's happening on the airlines and the cancellations, and then China launches a spy balloon that the United States knew it was launched, our government tracked it, went throughout the entire traversed the entire United States over our military bases, including your home state of Hawaii.
And here's what's so fascinating to me.
The head of NORAD, and I'm not blaming him because I'm sure this is the information they gave him.
The head of NORART says we've had uh domain gaps in our ability to track this, which ended up not being true that because they did track it.
So we shoot this one down after it's done all its spying over the you know the coast of South Carolina, and then we shot three, you know, Snoopy balloons or whatever they were down this over the weekend last weekend.
This is to me, this is absurd.
Now you served you are in the military, you've served a long time.
I I d I don't get what they're possibly thinking, and this is dangerous for the American people.
Uh without a doubt, and and you know what what links um kind of all of these things together, Jay, is don't don't forget what we've recently learned now that they shot those other uh uh uh uh unidentified flying objects down with a four, you know, four hundred and fifty thousand dollar missile each time.
And oh, by the way, they missed one one time, so they had to shoot at it uh again.
Um you look at the over trillion dollars that they claim that they are putting forward towards infrastructure, meanwhile our infrastructure i is crumbling.
Uh this is dysfunction, this is a failure of leadership, and ultimately it comes down to those who are short-sighted, who are not not making decisions based on the best interest of the American people in our country.
We look at we look at the Department of Defense budget, for example.
We look at, yes, I I still serve, I'm Lieutenant Colonel in the Army Reserves.
I'm I'm hitting close close to my 20 year uh time in service anniversary in April, and I recognize very well the need to have a strong military to defend our country.
But you look at how they're spending our money.
Where are they where are they spending it?
How are they wasting it without any accountability, and doing so in many cases in ways that actually undermine our own national security?
And that's something that should piss off every American.
You know, I was thinking about the 400,000, you know, uh w missile that we're launching.
And I again, I mean, the military, the the pilots are being d they're doing what they're told.
They got an order, take it down.
And I'm thinking about this.
We know that it costs more than 400,000 because you got a F 22, which is an expensive aircraft.
Listen, it's still dangerous.
Anytime they're flying it, mock who knows what, you know, going towards an object, things can happen.
Unfortunately, you know, nobody got hurt, but the and the military trains for this.
But it's this was the first time, Tulsi, we deployed missiles from an aircraft inside the continental United States.
And it was after it looks like it was the Illinois, you know, Northern Illinois bottle cap balloon brigade said their plane their balloon went down about that time.
I mean you could laugh about it, but you can also cry about it.
I mean, it's it's preposterous that this is the intelligence we had.
I I can't Rick Rennell's coming on your later.
I want to talk to him about this.
Because to me, Tulsi, and like I said, you're in the military, Lieutenant Colonel.
How is this possible that we what this was?
And this this is what's interesting too, Jay, is you're saying that this is based on the intelligence that we have.
Well, we're hearing uh Washington Post, I think reported yesterday, amongst other many other news sources, that there is a an unnamed intelligence official who's now reporting that yes, they were tracking, you know, the first big balloon ever since it launched from Hainan, uh, as it drifted down towards the the South Pacific, towards Guam and Hawaii, but then they are assessing that it was likely strong winds that started pushing it towards the mainland and they lost control.
Anyway, the the the point here is that there is new information coming out.
This information is being routinely dismissed by the State Department and U.S. Senators, both Democrats and Republicans, which point to what what is the agenda that people have?
Is is there a disconnect between the intelligence agencies and the military and the White House?
Are they dismissing information that isn't convenient for whatever their objective may be?
The truth matters, we need strong leaders who can make the best informed decisions on the best interest of our country, not based on an emotional knee-jerk reaction or out of concern of what a headline may say about them.

I have to say something here.
I mean, these are common sense principles.
That when when John Kirby starts talking to them, Admiral Kirby starts talking about, you know, we're gonna come up with a uh core principles.
They they need to be listening to people that actually know what core principles mean.
Yes, they should have been done.
I mean, how do we how do we not have core principles set up?
Because these balloons that we shot down now over the week, if we believe them, we believe Kirby and Biden now have people have been doing this for years.
This is not new technology, and they decide to shoot these down.
Uh you needed core principles before that.
That these had no you realize there was no connection between these three incidents and the Chinese balloon.
They want you to put this all together and say, I'll see we get tougher and tougher as we got used to this Chinese spy balloon.
No, as Tulsi said, and as we we've talked about too, they they tracked that balloon from the moment it launched, and they wouldn't shoot it down.
No, when it was over the water of the West Coast, when it was over coming up to Hawaii's border as well, could have gotten rid of it very early on then, but they didn't take action, and they shot down three more balloons, trying to make them look tough that have nothing to do with spy programs and pose no risk to the public or military.

Hey everybody, welcome back to the Sean Hannity Show.
Jay Secolo and Jordan Seculos sitting in for Sean.
We head up an organization called the American Center for Law and Justice, ACLJ, which uh a lot of you joined, I have to say, last week, and we appreciate that.
And many of you are joining today as well at ACLJ.org.
We talked to you a little bit about that victory we had against the National Archives.
We'll get more into that.
But there was another case that was going on in Washington, D.C., with all this discussions about China and the balloon, the spy balloon coming over in the United States, traversing the entire country.
Our friend who's been a friend and a client of the ACLJ's for four decades, Pat Mahoney, is with us on the program.
Uh, Pat, you've done, I can't, hundreds, probably thousands at this point, of civil protests all over the country, of course, a lot in Washington, D.C. Tell folks what was going on.
Because folks, this is unbelievable.
If you can't mention the Chinese government at their embassy, telling the Secret Service that public sidewalks are theirs instead of the United States.
And the Secret Service initially saying, yes, it is.
But I want Pat to set the stage of welcome to the broadcast, Pat, but tell everybody what you were doing out there.
Sure, Jay.
Uh, first of all, thank you so much for having me uh on the program.
So we scheduled a an event, uh, a peaceful demonstration at the event uh at the Chinese embassy, which I'm going to say conservatively.
We've had 75 over the past ten years.
It was the name of the event was No to Spying, Yes to Freedom in China.
And we did something kind of creative.
We we got these uh helium balloons about two feet in diameter.
We had two of them, and we were going in front of the Chinese embassy to confront them and challenge them on their violation of international and American airspace.
I I need to say, Pat, by the way, those that size balloon now could be shot down by the United States military, so don't let it go.
But go ahead, tell us what happened.
Jay and Jordan, I gotta tell you, when I got out of the car, I was just hoping I would make it to the front of the embassy with the balloons attacked.
But but anyway, so as I always do, um, I go talk to law enforcement uh before we do the event, introduce myself, say what we're going to do.
And I was a little bit surprised when I got there.
There were several Secret Service cars parked uh in the road in front of the Chinese embassy, several motorcycles at Metropolitan DC police.
And Jay, what happened next?
I have to say, you and I often say we should never say, I can't believe this happened, but it happened for the first time in my 46 years of public ministry.
I went to the Secret Service.
I said, we're going to peacefully demonstrate as we have for many times here.
The Secret Service said to me, Reverend Mahoney, you can't demonstrate there.
If you do, you will be arrested.
We were talking with okay.
I I got we gotta stop right there.
Stop for a second, Pat, because I want to set the stage here.
And uh one of our senior counsels, the ACLJ, former assistant U.S. attorney and head of the criminal division for the Department of Justice in the good old days, uh, Andy Econom's with us.
And Andy, just setting up what Pat just said, he's on a public sidewalk that the Chinese government is claiming is China's.
Right, and it is not Chinese.
A public sidewalk is a public forum, a traditional public forum.
It belongs to the people of the United States or the municipality, and Reverend Mahoney had every right to be there to peacefully protest as long as he was doing it consistent with what the local ordinances are.
He has, he has always done so.
And so the Secret Service had no business telling him we represent the Chinese, they own it, you can't be on this side of the street.
So, Pat, for people that are listening into the John's program here that may not have known that the Secret Service, and I have a lot of respect for the Secret Service.
They do a great job, but obviously they're being, you know, getting mixed signals.
What did the Secret Service agent or or officer actually tell you about where you were and whose property it was?
So they told me on the public sidewalk, which is in right in front of the main embassy, that that was not public, that that was uh and I'm quoting him now directly.
Chinese property that because of the balloon shoot down, there has been a lot of uh tension and uh in relationships.
They had meetings with embassy of uh officials, and the Secret Service was telling me if I went onto that public sidewalk where I have been at least 75 times in the past before peacefully demonstrating, I would be arrested because it was not American property,
it was Chinese property, and I could not believe the United States Secret Service, who I deeply respect also, were being guided, intimidated, and bullied by the Chinese government.
Well, unfortunately, Pat, it is believable because it happened.
And it's what's happening is the sensitivity of this situation have gotten to the point.
First of all, the Chinese government, we we we had on Christy Noam, uh Governor of South Dakota, who we've represented also, um, who's trying to stop this acquisition of property.
But Jordan, to me, the irony of this is Pat is standing on public property, Washington, D.C., owned by the American people, open for free speech.
We've argued those cases for four decades at the Supreme Court.
We've never lost.
We've won them unanimously.
Nine zero in the Jews for Jesus case.
I can go through list after list after list of free speech access cases we've won.
Yet the Secret Service gets the word from the Chinese Communist Party's embassy, because that's what it is, and they say, hey, this is China's property, as if that was the edict.
After years of having no issue uh doing a peaceful protest on that public sidewalk, and you know, it took uh I think he had to bring it like a sergeant to get this response.
We're finding it out.
Yeah, this is to me, this is the absurdity is that they defer to the Chinese Communist Party on on uh public protest.
I mean, think about that for a minute.
This is a country literally this is not funny, but they are engaged in a genocide.
There is no freedom of speech, so they will mow you down with a tank, as they literally have done.
On a public forum.
And they are going to tell American police, security, anybody about where what's public they don't like?
You said mindset very important, yes.
Understanding where the Chinese Communist Party is, is where they say China first.
The President Trump would talk about the tide.
That's he knew going into meetings with them.
That's what their mindset was was China first.
They they're just they're gonna assert to the police there's no there's that's not that's our sidewalk because they don't even understand the concept, nor do their uh the folks in DC, their the embassy staff, of freedom of speech.
No, they don't know freedom of speech.
But you know, here's the other thing.
So we talked about Andy that this is a public sidewalk, it's a public forum.
But what Pat was engaged in, holding a sign passively, flying the balloon, which made the point very clear.
You know, no spying, but how about human rights?
That is pristine First Amendment protected speech.
There is nothing more publicly protected speech than what Reverend Mahoney was doing.
Absolutely nothing.
And what bothers me is to paraphrase what Jordan was saying, instead of taking up the position of an American citizen that we have a First Amendment in this country and we have the right to peacefully protest, the Secret Service agent takes the position of the Chinese Communist Party and says, No, this is Chinese property, you gotta get off of here.
You're not allowed to protest.
And they got this information, Pat, it apparently from the Chinese Communist Party's embassy.
Correct?
Yeah, that that's what they told me.
And then, Jay, right now I have dear friends who are in prison in Hong Kong for two years without even a trial date set for ordering for organizing peaceful demonstrations.
And I was polite.
I respect authority.
I'm a Christian, but I said I will not be bullied or intimidated.
I had the same tone.
I am going over onto that sidewalk.
If you choose to arrest me, fine, but it's a public sidewalk.
And I want to tell all the listeners, uh I was uh Jay was talking to you earlier.
One would think that in a situation like this, uh, when I was expected to get arrested, I called my wife first.
But no, I called the person who I know could probably get me out of jail.
I called Jay.
I'm on the sidewalk.
I don't I'm expected to be arrested, and right in the middle of it, I called Jay.
Also, there was a fun part where I moved my car.
It was in a parking lot.
I said, if I'm going to get arrested, I better move my car because the Chinese government will tow it.
I'll make it a lot of people.
Yeah, you know, this is this is this is the part that's so absurd.
I'm glad we could help, by the way.
I was on the air on our broadcast when this a letter off to the uh to the officials here at the state at the uh secret service so that they understand that this is protected speech in a protected public place, public forum.
But you did get allowed to engage in the protest because eventually a more senior Secret Service official came.
Is that correct?
Yeah, a captain.
But Jay, here's the issue.
I'm a season activist for for the listeners on the show.
I've been arrested a hundred and twelve times, but all for good things like Congressman Lewis might say, good trouble.
But ninety-nine percent of all Americans, when they saw armed secret service agents telling them they will be arrested for going on that sidewalk, they would have left.
I mean, I shudder to think the kind of chilling effect.
I shudder to think of all the people who went to demonstrate peacefully at the Chinese embassy two days before or two days from now.
That's why I'm so excited.

We stood up and we won and we got a result.
Now we are, like I said, we're in communication with the the Secret Service on this because it's important.

Jordan, here's the thing.
You took it the take a look at the case involving Pat Mahoney at the Chinese embassy, where the Chinese say, Oh, that's our property, even though it's U.S. property, or the National Archives who can't find, like I said, they can't find top secret documents with former presidents, but they can target a student that says we're the pro-life generation.
But in all of those situations, we went to court at the ACLJ and won.
Yeah, we win.
We got an injunction against the National Archive.
And I want to say for you for that, that's not it on national archives.
That's still beginning to make sure that anyone in a similar situation can visit that museum without fear of being targeted and harassed.
We've got damages, discovery to do, mediation to do, and that's just the archives case.
The Spisodian case has has not reached that point yet.
We've notified them about what the National Archives have done, which archives admitted to everything that we alleged.
Yes.
And the injunction, Andy, for our audience means they can't stop that activity.
The students wearing their uh retire uh attire that has pro-life messages on it.
That's right.
A U.S. district judge has said you gotta let them wear their attire, make their public statement in the National Archives peacefully as they do, and the ACLJ will go to court if it has to go to court.
As a client of mine, the old Secretary of State of Georgia used to say, I said, Mr. Fortson, we got to go to court.
He said, if you got to go to court, go to court.
Well, that's what we did.
And I'll tell you something, folks.
It makes a difference.

Well, that's that's his whole thing.
I mean, he's personally attacking his co-host.
He personally attacked Nikki Haley.
And we've had strong ones on the broadcast.
I know I know.
You know, we had Christy Nobod, Tulsi Gabbard.
I mean people like Nikki Haley, who we know is our friends as well.
These are these are strong folks, regardless of mad woman, they're strong people.
Yeah, but you know, he went Caitlin Collins, who's their main uh White House correspondent, and then it was uh the other co-host is is uh what are they I mean, I know they've been pretty silent.
I mean it the media has said they were they one of them left the set.
Yeah, upset.
But it is amazing that they got away with this.
I'm surprised they're not calling about right there saying you apologize.
Get him get him out of here.
Yeah.
Listen, I believe in free speech, but you know what?
