We are less than four hours away from the release of this tape out of Memphis as it relates to the Tyree Nichols case.
In case you don't know, we have five police officers have been fired and brought up on charges and one count of second degree murder, all charged with one count of second degree murder, aggravated assault,
acting in concert on two accounts of aggravated kidnapping, two accounts of official misconduct, one count of official oppression, according to court records that we now have available to us.
It is getting a little scary in terms of what people are out there saying.
Let me play for you and every single person that has weighed in on having seen this videotape.
The verdict is unanimous.
What we're about to see in less than four hours as a country is going to be an unconscionable beating of this young man by five police officers.
The police chief, the Memphis police chief, herself says that the acts here defy humanity, a complete disregard for life and much more.
Listen.
Sunday morning is when you first saw the video?
That's absolutely right.
And then when you saw it, what was your reaction?
I was outraged.
It was incomprehensible to me.
It was unconscionable.
And I felt that I needed to do something and do something quickly.
I don't think I've witnessed anything of that nature in my entire career.
Really?
Really?
That bad?
It was that bad.
What are we going to see then?
You're going to see acts that defy humanity.
You're going to see a disregard for life, duty of care that we're all sworn to, and a level of physical interaction that is above and beyond what is required in law enforcement.
Wow.
Pretty powerful words from the Memphis police chief.
Again, the officers have all been fired.
There are five of them.
It turns out, I know race always comes up in cases like this.
It shouldn't.
And actually, this was addressed too by the Memphis police chief, who I think rightly said and was correct in saying that this shows law enforcement issues aren't about race, but bias is on the table, was her specific comments.
The district attorney in a press conference called the second-degree murder a knowing killing.
In other words, intentional.
He died January 10th.
I don't know how many of you have seen the video of him in his hospital bed.
I mean, it will shock the conscience and the soul.
If it doesn't shock you, you don't have a conscience or a soul.
And there's nothing that warranted this.
This was not an armed individual.
You had five police officers against one individual that was incapable of defending himself in any way.
And nobody even alleged that he had a weapon at any point.
The officers pulled over Tyree Nichols around 8:30 p.m.
Confrontation apparently ensued.
He was asking why he was being pulled over.
He eventually felt threatened, ran away.
Okay, let's say he ran away for whatever reason.
It doesn't matter.
It doesn't give you a right to beat this guy.
You don't become judge, jury, and executioner.
I'm still sticking with, I have not seen the tape.
I am just, I am very, very, very troubled by the admonition, the warnings, the adjectives used by everybody that has seen it.
There is 100% agreement with the Memphis police chief in terms of the analysis of this tape that it is that bad.
So my gut, my instincts tell me, uh-oh, you better brace yourself here.
Anyway, so it was pulled over about 8:30.
And officers said another confrontation happened at that point, but he had already at that point been detained according to the timeline that I'm looking at.
It was after this that police say that Nichols contained, had shortness of breath, was later taken to St. Francis Hospital in critical condition.
You could see the condition he was in when you get the images from the hospital bed.
His attorney, Ben Crump, said the video showed that Nichols was shocked, pepper sprayed, restrained when he was pulled off, pulled over for a traffic stop.
A preliminary report of Crump's independent forensic pathologist said Nichols suffered extensive bleeding caused by a severe beating.
The family attorney said Nichols was kicked and was the subject of multiple uses of force during what he called an unadulterated beating for three straight minutes.
Memphis police chief, as I said, said the other officers are under investigations for violations of department policy.
The DA in Memphis told the news conference, although the officers each played different roles in the killing, they are all responsible.
The director of the Tennessee Bureau of Investigation said during the news conference that he saw the video, found it absolutely appalling.
Let me be clear.
What happened here does not at all reflect proper policing.
This was wrong.
This was criminal.
Second-degree murder is punishable by 15 to 60 years in prison under Tennessee law.
One of the officers was accused previously of using excessive force, and he was named as a defendant in a 2016 federal civil rights lawsuit while employed by the Shelby County Division of Corrections.
So that's where we find ourselves now.
Now, I do have some questions.
Who thought this was a really good idea to release this tape on a Friday night?
That doesn't make any sense to me.
I would have released it on a Monday morning when people are not off for the weekend.
If it's as bad as they're saying, why would you release it at 7 p.m. Eastern on a Friday night?
And we'll be covering this at 9 Eastern tonight on Hannity.
Anyway, the officers have been charged with what officials, other officials called a heinous beating in the case of Tyree Nichols after this traffic stop.
And this body cam video is expected to be shown, as I said, in less than four hours.
And law enforcement nationwide, all across the country, are preparing for potential civil unrest tonight.
In Atlanta, in Georgia, Governor Kemp issued a state of emergency and has activated the National Guard.
This, in light of what had happened a couple of weekends ago, the weekend violence in Atlanta.
The order calls for up to 1,000 Georgia National Guard troops to be called up to subdue any riot or unlawful assembly.
If you're looking for some of the media coverage of this and predictions about this, the New York Times is reporting this afternoon that law enforcement nationwide is preparing for trouble tonight.
I'll read specifically from the Times.
Police officials around the country said they're watching the situation.
Spokespeople for the police departments in Philadelphia, D.C. said they had ample staffing on hand for any protests or demonstrations that may follow the video's release.
In Texas, police and city officials in Dallas, Austin, San Antonio said that they were aware of the imminent release of the video, have not taken any special steps.
In New York City, the police department said in a statement that officials were preparing for the possibility of protests.
The department has examined, adapted, adjusted our response to protests and is prepared to protect the constitutional right to peaceful protests and works to ensure public safety for every New Yorker exercising their First Amendment rights.
That is all one big fat lie because of defunding, dismantling, and no bail laws in New York.
Nobody in New York is safe anymore.
Back to Washington, D.C.
The D.C. Metropolitan Police Department has fully activated all sworn personnel in order to prepare for the possible protests over this tape when it's released now in less than four hours.
All 4,000 officers in D.C. will be on duty for 12-hour shifts ahead of any First Amendment activities in D.C. will remain on those shifts until the activation protocol is lifted.
I don't know what First Amendment activities mean.
The police are being called out to protect the First Amendment.
No, they're being called out to protect against potential violence.
Can you just say something for what it is?
That's why they're there.
That's why they're being called up.
And by the way, I think it's the right decision.
Down at the U.S. Capitol, crews are preparing to set up fencing, etc.
Metropolitan Police Department said they respect the community's right to demonstrate, peacefully protest, but police will not tolerate any unlawful behavior during the demonstrations.
Police say they will take swift action against anyone breaking the law.
So we've got all of that.
We'll watch that.
Now, we did get today the 911 call of Paul Pelosi.
I want to play it for you here, and then on the other side of the break, I'm going to play the police body cam audio, and then I'll explain and give you my thoughts on it on the other side.
Here's the 911 call.
San Francisco Police on the floor, 2022.
I guess I told him I just said San Francisco Police, do you need help?
Oh, there's a gentleman here just waiting for my wife to come back.
Just waiting for her to come back because she's not going to be here for a day, so I guess we'll have to wait.
Okay, do you need police fire a metaphor for anything?
Eight seconds.
I don't think so.
I don't think so.
Zero, two, twenty-three, and eight seconds.
There's the Capitol Police around.
No, this is San Francisco.
They're usually here at the house protecting my wife.
No, this is San Francisco Police.
Friday, October.
No, I understand.

Okay, well.
0, 2, 24, and what is it?
15 seconds.
Let me step in here because I want to give some context and not let you hear this.
So what you have, and it's very apparent in this 911 call, is that the person that is about to assault Paul Pelosi is standing right next to him.
Later in this 911 call, he identifies himself.
So he's kind of like a hostage calling 911, and he can't say exactly.
He's dropping as many hints as he can.
Yeah, this gentleman's waiting for my wife, Nancy Pelosi, to come home.
You would have thought that maybe San Francisco police, second in line for the presidency, if they would have any call from that home coming from that home or that address to say, uh-oh, this is serious.
Although I don't criticize the dispatcher because even though this was an odd call in the end, she sent police.
They were there, according to most reports, within two minutes.
And he asked, is the Capitol Police around?
They're usually here at the house protecting my wife.
And that one seemed to go over the operator.
He said, no, this is San Francisco police.
He's like, I understand that.
I don't know what do you think.
And here's the guy you can hear in the background.
So again, this guy's got a hammer.
He's trying to call 911.
He's speaking in code.
Call us back if you change your mind, the lady says.
And she said, he says, no, this gentleman just came into the house.
He wants to wait for my wife to come home.
Do you know who the person is?
No, I don't know who the person is.
He's telling me not to do anything.
What's your address?
He gives his address.
Again, he says, my name is Paul Pelosi.
Anyway, this gentleman, he's telling me to put the phone down and just do what he said.
Okay.
What's the gentleman's name?
I don't know.
And then the guy jumps in and you can hear him.
My name's David.
That Pelosi says, the name's David.
Okay, who's David?
Pelosi says, I don't know.
What's that?
He says, well, I'm a friend of theirs.
He says, he says he's a friend.
And then the operator asks, but you don't know who he is?
No, ma'am, I don't.
He's telling me that I'm being very leading, so I got to stop talking to you.
And I can stay on the phone with you if everything is okay.
Anyway, to the credit of the operator, she did send the police.
They were there within two minutes.
On the other side, we'll get to all of these tapes in full and we'll tell you more about it.

New York Times pointing out cities all across the country are bracing for potential unrest tonight.
I don't think you can get any more descriptive than the Memphis police chief.
This is in the Tyree Nichols case saying that this video has acts that defy humanity with a complete and total disregard for life.
And it couldn't be any more clear.
Everybody that has seen the video pretty much is saying the same thing.
So anyway, a lot of preparations for tonight around the country going on.
The tape will be released.
We'll be on Hannity our usual time, 9 Eastern, following that story and hoping that there is not unrest in any city, in any place around the country, and that people protest that it will be peaceful.
You know, if there is violence or rioting, we will identify it as it is because there's many people that won't, which is unfathomable to me.

All right, let's go.
I'm going to go through this slowly before we get back to the issue of Tyree Nichols and what we expect at 7 p.m. Eastern, and God only knows what will be going on at 9 Eastern tonight when I get on TV.
So, the Paul Pelosi tape comes out today.
Let me just describe the scene.
Now, just as a matter of course, I just want to remind people: a lot of the reporting on this became confusing.
A lot of it turned out not to be true.
It didn't make sense.
For example, reports came out that said, oh, Paul Pelosi answered the door and said, Oh, come on in.
He's down the hall.
It wasn't down the hall.
When Paul Pelosi opens the door, the assailant is there with a hammer in his hand.
Now, when Paul Pelosi makes his 911 call, it is obvious that somebody is there and he's not free.
He's not able to speak freely.
In that situation, you could arguably say he's a hostage.
A guy's not holding a gun to his head, but he's holding a hammer that he's about to put into his head, which eventually did happen.
So he's being very careful on the phone, but he's doing everything in his power to tell this 911 operator, who understandably doesn't quite get exactly what's going on here.
She got it enough to get the police out there in less than three minutes, and two minutes and some odd seconds.
So you got to give her a lot of credit.
In the end, she probably saved this guy's life.
The cops saved this guy's life.
And remember the reports that, well, he was going to stay as long as it took till Nancy got home.
And then based on her answers, he would decide if he was going to use the hammer on her or not.
One question that I do have, and it frustrates me, is, you know, every speaker, you are second in line.
It's the president.
If anything happens to the president, the vice president becomes president.
If anything happens to the vice president, the speaker of the house becomes president.
That is, you know, second, you know, in line if something ever happens, God forbid, to a president.
So why they don't have full-time security at this house, I don't know.
We pay a fortune.
When she was speaker of the house, we paid a fortune for Nancy Pelosi to take a private jet.
And I think it was appropriate myself.
You can't have a Speaker of the House second in line of the presidency saying, okay, here's my ticket to San Francisco waiting somewhere in a terminal somewhere.
That's not a really safe place.
I don't even particularly think it's safe for even senators.
We've seen senators harassed, people like Ted Cruz, even Mitt Romney, and Lindsey Grant.
It doesn't matter what your politics are.
This is what frustrated me about the January 6th Commission.
Sure, okay.
You kick off Jim Banks, you kick off Jim Jordan.
Fine, you politicize it.
You get in all your digs against Donald Trump.
But one thing they didn't do, they never talked to the sergeant-at-arms.
They never talked to Speaker Pelosi.
They never talked to the Capitol Police Chief.
They never asked the mayor of D.C. to explain why in writing she rejected the National Guard.
They never asked for their emails, their text messages.
They never asked for their phone records, none of that.
And at the end of the day, sure, they got their pound of flesh with Donald Trump.
What have they done to make the Capitol safer?
Nothing because they never focused on it.
And if you don't want something like that to ever happen again, and I don't, we've got to protect our elected officials.
We've got to protect our institutions.
By the way, that's our house, the people's house.
And if I had my way, the way they protect the White House is the way I would be protecting the Capitol.
You create a perimeter and you have those big cement blocks so cars can't be drawn.
You have a big old fence.
You can make it nice.
The one at the White House is, what do you call those, you know, call them wrought iron wrought iron fences.
I mean, it looks nice.
Joe's building a wall at his house.
Joe Biden, your president, but you got to protect him.
Just a fact.
Anyway, so these are the conditions.
So Paul Pelosi, and you'll hear towards the end that the guy is, it's obviously he's on speakerphone.
You hear his voice describing himself.
Now, notice during this 911 call, he mentions, yeah, he's waiting for my wife to come back, Nancy Pelosi, hoping that that triggers in the operator's mind.
It did not, it didn't seem to anyway.
Or you would think that the police department, having the speaker in their district, might have that address or that name flagged if it's ever mentioned in a 911 call and operators informed about it, but that's a separate issue.
Then he talks about the lady asked, do you need police, fire, medical, anything?
He answers, I don't think so.
That's an odd answer.
Again, he's trying to talk.
The guy's right next to him with a hammer about to clobber him in the head.
Then he says, the Capitol police around, they're usually here at my house protecting my wife.
That was a big sign.
And she said, no, this is the San Francisco Police Department.
I'm not being critical because she acted.
She picked up in the course of this call something was odd.
Pelosi then says, okay, well, I don't know what do you think?
Then you can hear this other guy in the background.
Then Pelosi says, he says everything's good.
I've got a problem, but he says everything's good.
He's trying to telegraph, get over here.
Now, hard to do, hard to interpret.
Again, no criticism of the operator at all.
No criticism of Paul Pelosi.
He's a victim here.
It was obvious in this entire thing that he was a complete victim.
And in my view, this guy broke into his house.
You have surveillance video.
We'll show you tonight of him pounding with his hammer the back door of their home.
That was prior to him actually getting into the home.
But anyway, so he says everything is good, but I've got a problem.
But he says everything's good.
And then the operator says, okay, call us back if you change your mind.
At that point, I said, uh-oh, she's not getting it.
But he goes on, no, no, no, this gentleman just came into my house and he wants to wait here for my wife to go home.
So anyways, then she asked the right question.
Do you know who this guy is?
Do you know who this person is?
No, I don't know who this person is.
He's telling me not to do anything.
Then she asked for the address.
From the minute that address comes in, I can tell you that phone call was made to the police.
Good for her.
So she really, you know, they get all sorts of calls all the time at 911 centers.
And you don't, you know, you get lunatics calling all the time, too.
So sometimes you're just not sure.
What is your name?
My name is Paul Pelosi.
Anyway, this gentleman, he's telling me to put the phone down and just do what he said, okay?
Okay, what's the gentleman's name?
I don't know.
Then the guy steps in and he says, my name's David.
Pelosi goes, the name's David.
And the operator said, okay, and who is David?
Pelosi, Paul Pelosi's, I don't know.
What's that?
Then the guy with the hammer goes, I'm a friend of theirs.
Pelosi says, he says he's a friend.
Operator says, but you don't know who he is?
No, ma'am.
You know, bingo, she's on it now.
And then Pelosi says, he's telling me I'm being very leading, so I got to stop talking to you.
Operator, okay, are you sure?
I can stay on the phone with you to make sure everything's okay.
By this point, the police have been notified.
I can tell you, knowing how 911 operations work.
Anyway, and he wants me to get the hell off the phone, okay?
Operator, okay, thank you.
Bye.
This is the 911 call.
San Francisco police on the four.

Oh, I guess I told him.
It says San Francisco police.
Do you need help?
Oh, well, there's a gentleman here just waiting for my wife to come back.
Nancy Pelosi.
223 and 10.
He's just waiting for her to come back because he's not going to be here for a day, so I guess we'll have to wait.
Zero.
Okay, do you need, please fire a medical for anything?
Eight seconds.
I don't think so.
I don't think so.
Zero, two, twenty, three, and eight seconds.
There's the Capitol Police around 220.

Then the police show up two minutes later, and when they open the door, the guy's right next to Paul Pelosi.
You know, that wasn't the way it had been reported.
Remember, they said, oh, come on in.
He's down.
He's over here down the hall.
No, he's right next to him with the hammer in his hand.
Listen to what happens.

What's going on, man?
All right.
Drop the hammer.

They got him, Michael.

Pretty scary.
The police, you know, so all of a sudden they said, put down the hammer.
He said, nope.
And then he attacked, immediately started flinging.
He took that hammer and went right for Pelosi's head.
Police were actually pretty quick and amazing.
It just goes to show you when reports come out, they always could be wrong.
And he was a victim in this case.
Now, separate and apart, you never blame a victim.
He had no idea.
He doesn't know how to defend himself.
He was a victim here.
And it's not political.
I just hope that I ask people on the left all the time, what are you going to do?
God forbid, somebody, please, for all of you, always anticipate the worst because there's a lot of evil people in this world.
If we haven't learned that in the last year, last year.
So many people are nuts, absolutely raving mad.
And he's, thank God, he's okay.
Those police officers were amazing.
They got there so fast.
Lady was amazing.
Pelosi did everything he could possibly do.
And in the end, he turned out he's okay.
Thank God.
I don't like to see people hurt, innocent people hurt by crazy people.
I just don't.
