The Rudy Giuliani Show (E14): Jury Deliberations Continue in New York Trial

Good afternoon, this is Rudy Giuliani with The Rudy Giuliani Show.
I begin by telling you that what is going on in that courtroom south of me will be an eternal disgrace to the legal system in America.
A judge who is a product of a corrupt political system And it really is just an acting judge, a guy they've had stumbling around and never put him up for nomination, has decided on his own to change 800 years of American and English legal history in charging the jury that on some aspects of this case they can be less than unanimous.
Namely, the underlying crime That Trump has to have the intent of committing in order to make this anything.
Because the original crime, the false statement on the business record, has been barred by the statute of limitations.
Let's also point out that the statement is correct.
It does involve legal expenses, because it was describing not only the payment to Stormy Daniels, but a number of other legal expenses.
And the accountant, not Trump, used a generic term for it that is certainly defensible and not false beyond a reasonable doubt.
I mean, the reasonable doubts stand that he still maintains, which is quite remarkable because he doesn't seem to be an American judge.
Any judge that could even contemplate the idea of something than a unanimous verdict in a case like this is a corrupt disgrace or a total fool.
The requirement of unanimity In a criminal trial, goes back as Justice Gorsuch points out in the most recent, very compelling and binding opinion about this, Ramos versus Louisiana, points out that this has been an unassailable practice of English and American law since the 14th century.
Now, the 14th century was 1300.
was 1300. That's 800 years ago. You know, back before Henry VIII and Elizabeth I, they
were charging juries in England that you had to be unanimous before you could take a man
or woman's liberty away.
Thank you.
But not in New York in 2024.
There, the democratic dictatorship of New York can do anything.
I never thought they could do this, and I never thought there would be this kind of acceptance of it.
There should be an outcry.
against this.
The chief judge of the state should say after the trial he's going to be summarily removed as a judge because he is inventing foreign law that's repugnant to the American legal system.
Now all you have to do is read an opinion, which I'm sure they don't do, She's got a political case.
Remember what I told you.
In Manhattan, on a political case, every single judge is guided by the Democratic leader.
They are not... I'm not saying they're all corrupt.
I am saying, quite straight out, they're all corrupt when the case is political.
Because they're all put there by Democratic bosses, not by you.
This guy isn't put there by anybody.
He's never even been elected.
They didn't think enough of him to nominate him.
But they've given him all the Trump cases.
Now, how does he have Biden's case?
I mean, Biden's case.
He should have Biden's case, just to quit him.
Bannon's case.
What's he going to do to Bannon?
Just find him guilty on day one?
Yeah, you're guilty.
He might as well have done that with Trump.
I mean, this case is an outrage.
It must be condemned in order to defend the American legal system.
I don't know.
I think maybe even in the Soviet Union they pretend to have unanimous verdicts.
I'm sure they pretended.
I'm not sure about Hitler's Germany, if they pretended to have unanimous verdicts.
This is unthinkable for any American judge.
A judge that thinks like this is a menace.
Now, here's the opinion.
This is Ramos versus the United States.
Hey, lazy bum, read it!
Read it, you corrupt bum!
That's the law laid down by the United States Supreme Court not a long time ago, 2020.
Justice Gorsuch points out that 13 times the Supreme Court of the United States has made it clear beyond any doubt that a criminal case has to be unanimous in all respects.
In this particular case, they're tracing the two states, and only two states that I know of have ever even attempted non-unanimous verdicts, not New York.
So even if there was no federal rule, the New York State Constitution requires a unanimous verdict, because it also derives from common law.
And basically, what What Gorsuch says is that this is one of the rock-solid pillars of American justice that makes sure that defendants aren't wrongly convicted because the jury has to be unanimous.
And there are no exceptions for, you know, three elements in the case.
Two can be unanimous and one doesn't have to be.
What he's done, I cannot explain to you How egregious a misconduct this is.
This is much worse than anything Trump is charged with anywhere.
what they're doing here in throwing aside the American Constitution and
creating the possibility that they'll use this for you and certainly for me.
The text and structure of the Constitution clearly suggests that the term trial by an
impartial jury, which is in the Constitution twice by the way, carried with it some meaning
about the content and requirements of a jury trial.
One of those basic requirements was unanimity.
Wherever we might look to determine what the term trial by an impartial jury meant at the time of the Sixth Amendment's adoption, Whether it's common law, state practices in the founding era, or opinions and treatises written soon afterwards.
This is what we lawyers decide things on, not what Joe Biden's regime tells us to do.
But we decide it based on the Constitution, which is a lot more important than that corrupt president's regime.
A jury must reach a unanimous verdict in order to convict.
The requirement of jury unanimity emerged in 14th century England and was soon accepted as a vital right protected by the common law.
Want me to read you Blackstone?
I don't know if Judge Crooked there knows what Blackstone is.
But Blackstone is a legal treatise where you find most of the common law.
As Blackstone explained, no person could be found guilty of a serious crime unless the truth of every accusation, the truth of every accusation, should be confirmed by the anonymous suffrage of twelve of his equals and neighbors, indifferently chosen and superior to all suspicion.
Real questions on that too, by the way, whether they were indifferently chosen Since they're all Democrats and superior to all suspicions?
Can't even find out who they voted for?
The same rule applied in the young American states.
James Madison drafted the Sixth Amendment and made it clear that it carried the requirement of the widely accepted unanimity.
Host adoption treatises Made it clear, including one by Nathan Dane in 1824.
As he points out a number of times here, 13 times in the history of the court, it's made it clear there must be a unanimous verdict.
There can be no question that the Sixth Amendment's unanimity requirement applies to state and federal criminal trials equally.
However, despite this, two states, Louisiana and Oregon, decided on having an exception where you could have non-unanimous verdicts.
They both emerged from the sorry history of the Ku Klux Klan, which of course is close to Joe Biden's heart, I'm sure.
I wonder if Judge Crooked here knows that what he's relying on in terms of practice for the only time that there were non-unanimous verdicts Are things that emerged to make sure that black people were convicted and white people weren't.
That's the history of it in Louisiana.
Explained in great detail by Justice Gorsuch.
And then eventually carried over to Oregon.
The court made it clear again in 2020 that that This rule is repugnant to the Constitution, repugnant to common law, and one of the basic rights that we have, which was stripped from Donald Trump, as have other rights been stripped from him, me, and others.
It has to stop.
This is too much to watch.
It's too much to watch a judge, after I've sat through hundreds and hundreds of trials, not just as a lawyer, but a law clerk and an observer, listening to the unanimity requirement.
It's too much to see this acting poor excuse for a judge telling them they can be less than unanimous and confusing the hell out of them.

Now let's look for a second, because it was used today, this very erroneous, illegal, and illicit charge from the jury.
On the issue of a unanimous verdict, which I believe should have required a rebuke today from the Chief Judge of the New York Courts, that this does not represent the law in New York, that we have not gone back to pre-14th century, nor have we taken over standards of proof that are used in dictatorships, whether they be fascist or communist or Nazi.
This is an enormously important guarantee so that you don't go to jail improperly.
It's one of your most important guarantees.
Something so serious as taking your liberty away or putting it in jeopardy has required among our ancestors, maybe not the ancestors of the aliens who are coming in illegally, but among our ancestors, It is required unanimity, which is why we're a civilized country.
And many are not.
I believe there are more dictatorships than there are countries ruled by law.
This would be very comfortable there, Judge... whatever the hell your name is.
The crime that has to be proven here is, and this is the judge himself, Under our law, a person is guilty of falsifying business records in the first degree when, with intent to defraud, that includes an intent to commit another crime, or to aid or conceal the commission thereof, that person makes or causes a false entry in the business records of an enterprise.
Now, I told you this fails on false entry.
The entry is true and they have not proven beyond a reasonable doubt And on that, even according to this idiot, it has to be unanimous.
But with regard to intent to commit another crime, of course they have to be unanimous on what that crime is.
Now, if this were a fair case in a place that is not a democratic fascist dictatorship, this case would have been thrown out because in all this time, Bragg has not apprised the defendant of what that crime is.
Includes an intent to commit another crime.
In order to give the defendant due process, you've got to tell him what the crime is.
Now he's facing him with three.
And he's saying, you don't have to be unanimous on which one it is.
Well, then you haven't found him guilty.
You haven't found, beyond a reasonable doubt, and unanimously, an intent to commit another crime.
Because it's an intent to commit possibly three other crimes.
They have to be unanimous on the crime!
Now, what he might use is a complete misunderstanding of the racketeering laws and the continuing criminal enterprise laws way beyond his skill.
This is like a guy who had two years of medical school wanting to do brain surgery.
I mean, this is a fumble-bumble jerk, if there ever was one.
No way he could understand RICO law and continuing criminal enterprise.
There is a slight opportunity for non-unanimous findings under that law.
But, apropos of the opinion of Gorsuch, you first have to find a complete RICO crime, which includes, I believe, four predicates.
You can have 20 predicates.
After you find four, you don't have to be unanimous on the rest.
But you've got to find four unanimously.
Here you have only one.
A crime.
It doesn't say crimes and many predicates.
And to treat it like a predicate in a RICO case would mean you'd have to have unanimity on at least one.
So they'd have to come out unanimous.
If you wanted to treat it like a RICO case, which, believe me, I'm telling you this in all sincerity, this is way beyond this guy's capability.
If this guy understood the RICO law, he would not be an acting judge for 22 or 23 years, and he wouldn't rule the way he rules.
Even a corrupt judge would rule in a smarter way than he does.
He is dumb and corrupt.
Ill-prepared, like this probably would frighten the hell out of him.
And corrupt.
So if he wanted to follow the RICO line of cases, what he'd have to do is tell the jury they had to find one of those unanimously.
If they wanted to go on and find the other two by a majority verdict or whatever, they can do anything they wanted.
It doesn't matter because they've already found the crime.
It's kind of unnecessary to do it.
In a RICO case, it's sometimes important to do it because it fleshes out the full scope of the criminality.
Although it doesn't get much weight by judges.
So, I don't know how to say this to you any more importantly.
The great disappointment here is that the legal profession hasn't stood up as one and said, get out of court, judge.
You just embarrassed the hell out of us.
You just changed one of the most fundamental principles that makes America a great legal system.
Who the hell are you to do that?
Just a stumble-bum appointment of a Democratic leader with a daughter who's making a fortune off this case, including now special tickets for her paid clients?
So your daughter is getting special tickets, all access for, let me see, who are they?
There's some of them we know, don't we?
One of them from the Brennan Center.
Now the Brennan Center is so anti-Trump, I don't think they think about anything else anymore.
And the lady is a Trump-hater par excellence.
What the heck is her name?
Joyce Vance.

And then there's another one, too, that's in there.
There's another one in there.
Somebody's wife.
Dan Goleman's wife.
Or is it his mom?
I mean, Dan Goleman is the successor to, I guess, the slimy people who used to lie about Trump during the Russian collusion things.
He's about as anti-Trump as you can get.
He's also, I believe, a client of the judge's daughter.
In other words, he pays her.
Oh, you can't get in!
Maybe if you paid the judge's daughter, you could get in.
Call up her political agency, pretend you're a Democrat and a Trump-hater, and see if you can retain her for 10 grand, and she'll get you a ticket.
And don't forget, Dan Goldman had actually prepared Michael Cohen for his testimony, and Dan Goldman himself is a... Well, I guess his mother wanted to see how well it worked.
I mean, Ted... Goldman himself is a client.
...discussing about this case make it much more important than Donald Trump, maybe even more important than this election.
This is the destruction of the American legal system and proof that the two-tier system of justice is a dictatorial system of justice.
I've always said that, you know, there's two-tier... They use words that are too euphemistic.
Two-tier system of justice sounds like, oh, that's not really good.
Two-tier system of justice is no justice.
You can't have a different system for two different people.
That's what we had when we had prejudice and we had discrimination against blacks or slavery that was widely supported by the Democrat Party.
Or these non-unanimous verdicts emerge from the Ku Klux Klan and Louisiana when it was a Democrat state.
That's where it comes from.
From the senators that Biden admires.
And among other things, the daughter is giving out tickets to her clients?
We've got to get any more graphic than that?
I need any more proof that this guy fits right into the 150-year history of a corrupt Democrat party ruining New York?
Why did New York do so well with Republican mayors?
You kind of remember them.
Well, Guardia and me.
One, you might remember, but he kind of pointed in the other direction.

But he became a liberal Democrat.
Of course, at heart he was.
I like John Lindsay, and I helped John Lindsay a lot, and I'm proud that I did.
But John Lindsay was one lousy mayor.
Sorry, John, but you were.
And you are probably one of the groups of liberals, because you had a lot of liberals around you, who made this city a welfare-dependent city, which is maybe one of the biggest curses that have been put on a group of people, who the Democrats try to hold in slavery.
No wonder you became a Democrat.

So let's, I mean, all we do is talk about this case and I can see why it's so important to the future of America, isn't it?
I mean, none of us know what the impact of a conviction will be.
Will it help Trump the way the indictments did?
There's some indication that it might.
Will it hurt him?
Because conviction, you know, people I'm sure that not everyone follows what I'm laying out here.
I can't imagine everybody really understands how devastating this is to American law.
And they lie so much, and they have... I mean, I don't know what they're listening to all day.
I mean, most of it is propaganda.
So it could end up in giving us Joe Biden back as a president, which is the destruction of America.
We might as well say goodbye to our democracy.
All the verdicts now are going to be not unanimous?
Except maybe for Democrats?
Well, Democrats you don't even bring to trial, so you don't have to worry about it.
Trials will just be for Republicans.
What about Hunter Biden?
Can you convict him with a less than unanimous verdict?
He's charged with several different things.
So, somebody on the tax, somebody on the gun, they add up to 12, he's guilty.
Go off to prison.
How about, if it were a non-unanimous verdict, Joe Biden should be in prison for 150 years.
I mean, Joe Biden is demonstrably guilty beyond a reasonable doubt, just based on the hard drive.
I could prove it to you the way a disc jockey plays recordings.

I'll tell you, the amount of anti-Semitism in this country Has to disturb you as much as what I'm saying because there's a connection here, I think, with the fact that we've become something of a dictatorship under Biden.

I mean, it was under control in the sense that it wasn't the big protests that existed before.
And there was a very good article today that we may have time for.
That kind of indicates that we made this movement too big.

And it sure went way beyond whether you want to distinguish anti-Zionism from anti-Semitism, which I don't think you can, but whether you want to distinguish it or not, they didn't bother to do that.
And what is anti-Semitism?
A hatred of Jews.
And they don't just hate Jews.
They want Jews eliminated, and they shout it out.
In America.
Whoever thought in America we would hear those kinds of Nazi statements made?
It's all under Biden as the President.
If the President sets the tone, my God, he sets an anti-Jewish, hate-Jews tone.
And the way he double-crosses and belittles the leader Of Israel at a time of war?
We've never done that with an ally.
What, we do that just with a Jewish ally?
I mean, it is imperative that he wipe out Hamas.
You used to say that, you big liar.
Well, yesterday there was a horrible attack.
on orthodox students.
Now, I'm extraordinarily sensitive to this because I got elected in the wake of Crown Heights.
I read the report, the Giugenti report, about Crown Heights, maybe five times, made notes on it, and followed it.
And I changed the city.
For 20 years, there were no riots in New York City because of what I put in effect.
And I thank Mario Cuomo's appointee, Mr. Giugenti, for some of the ideas which I took from him.
And then they were carried out by Ray Kelly, who had to live through and was a hero of Crown Heights.
He stepped in on the fourth day and stopped the beating up of Jews just because they were Jews, led by the star of CNN, Al Sharpton, and permitted by David Dinkins.
It was the first, and I hope Or have we had them now?
Pogrom in U.S.
history, in Crown Heights.
Well, a maniac tried to mow down Orthodox students yesterday.
And it was in Flatbush, pretty much in that same area.
The guy faces a number of charges.
He's also got a record, of course, and he's mentally ill, and because Adams can't figure out how to put the mentally ill in prison, or in a mentally ill institution, although he's got numerous ones, they're running around the city, and he's supposed to be tough on crime.
These people would not be running around the city if I were the mayor of the city.
They'd be sitting in the empty places where we used to keep the mentally ill, and I can show them to you.
I actually informed Cuomo of them when they didn't have enough beds.
I said, we've got about 20,000.
And we've got buildings like the Goldwater Pavilion, where we could separate them in all different places.
Look at this.
This guy's chasing him with a Crown Vic.
He's in a Crown Vic.
He's a Pakistani.
He's in a Kravik and he twice comes around the block to hit the orthodox Jewish students,
yelling out things like, I'm going to kill all the Jews.
Two attempts at It's a 2011 white Crown Vic.
It's on East 55th Street in front of the Mizitha Nicholas Yakov School.
Oh, he could be charged with a hate crime.
Now, this is in Brooklyn, which means there's a chance he'll go to jail.
If this were Bragg, you know, they're preparing a jail cell for Trump.
They can give him a whole building.
Brad doesn't put anybody in jail.
This'll be a strange occasion.
I learned from one of the, it'll remain nameless, correction department people, they had to go over the things you do to put somebody in jail, because they do it so little in Manhattan.
These guys would go free if it were Brad.
He might even give him some kind of an award.
And he's prosecuting Trump for what?
For a truthful statement?

It was announced by Tashi Hanegbi, Israel's national security advisor.
That they expect another seven months of fighting in Gaza in order to accomplish the mission of eliminating the people who want to eliminate them.
Now tell me what's unjust or unfair about a war against people who for 40 years vowed to eliminate you and then and have over the last 20 years violated the ceasefire at will and then with a horrible attack with the worst numbers in terms of destruction of Jews since the Holocaust.
Tell me what is wrong or unjust about self-defense there.
And isn't the only defense to eliminate them?
They refuse to say, even if there's a peace, if they'll accept Israel.
So why is Biden stabbing them in the back?
Why is Biden telling them they have to end the war?
Why is Biden giving money to Iran?
Why?
Because he's a traitor.
Oh, I know it's hard to accept that, but Graham Airbase, please, go back to it, it makes it easier.
He left an airbase 400 miles from China, right at the beginning of his presidency.
He paid him back right away, a good chunk of the 31 billion they gave his family and him.
And his son tells you, when they tell you, the liars, that there's no proof that he got money, his son tells you that he gets half of what his son gets.
And has for 30 years.
So there's no reason why we shouldn't accept that.
That's proof in court.
That's proof you put in evidence.
And unless they have some rebuttal, it'd stand.
And there's all kinds of proof that it's true, including money going directly into his accounts.
All kinds of activities by Shirestine, or Furestine, or whatever his name, to match up the accounts so he gets the sneaky money.
And then he also paid all the expenses of the family.
That's the crooked money.
His son didn't make any honest money.
His son made crooked money.
So if his son says, as he did, in a text that they ignore, even the conservative media ignores this for some reason, have an income, went to his father for 30 years, and he paid all the expenses of the family.
That is, as far as I'm concerned, that's gospel truth.
Nothing's been done to disprove that.
Not a thing.
It's right there, in black and white.
Now, you wonder, is he a traitor?
Well, he's got this guy, Malley, who's been working for him and the other traitor, Obama.
Now, why do I call Obama a traitor?
Because he gave cash to terrorists who were killing Americans.
What am I gonna call him?
An American president?
Yeah, a disgraceful American president.
When the Ayatollah said, oh, don't wire the money, send it by cash, what the hell did he think was the reason for that?
Or are we not allowed to ask, what did the prince think?
Well, the prince had to think it was for the terrorists that he knows Iran supports.
And thereafter, plenty of Americans were killed by Soleimani until Trump eliminated him.
So that money clearly was available and I'm sure was used to kill us from our president.
All covered up.
Nobody even talks about it.
Malley was in the middle of that.
Malley has now been removed or put on leave from the Biden administration but nobody does anything to him and all kinds of proof is coming out that he was leaking documents about Iran, classified documents Fears!
There are a dozen documents, including some Mark Sensitive and Classified, that he put on his personal devices, that there is, I guess, a report that says they were accessed by a hostile cyber actor.
I will bet my life that's the regime of terror, the one he was spying for.
So this spy is sitting around, not arrested.
I don't know if they even searched him.
And Trump is being prosecuted four times, more than Al Capone.
And it's not political.
And Biden plans to have a speech when the trial is over, and it's not political.
Biden hasn't talked about the hostages.
Biden never would talk about Lake and Riley, except the one time he got her name wrong.
And he's gonna have a speech after Trump verdict and it's not political?
He sent, that was a disaster, he sent a StumbleBum actor there yesterday who read... I mean a guy filled with venom and hatred and what's he doing at the trial other than politically trying to exploit it?
He's not a legal expert, thank God.
Well, maybe he is compared to the judge.
Maybe he agrees with non-unanimous verdicts.
Who knows?
And he was trying to pick a fistfight with somebody.
Trump, right?
Now, if you listen to Adams and you listen to Biden, all these illegal aliens coming in are just wonderful for this country.
On the other hand, they have no reason to say that because they don't vet them, really.
They ask the Chinese four questions.
Oh, and the Chinese, you know, tell them, I'm a spy.
I'm here to see if I can get more information than the balloon got based on their being able to fly over.
We appreciate that Biden allowed us to do that and gave us a guided tour, but we couldn't get everything we wanted.
So now we're going to bring in these spies to see if they can get some ground information.
Biden will let them in, but they don't say that.
They say, no, I'm not a spy.
And then the ones who are drug dealers, what do you think?
Oh, yeah, yeah, yeah.

No, they don't tell them that.
They lie to them, and there have been 7 million of those.
Then there have been about 1.5 million, at least, that were spotted coming in, but we never talked to them.
So, I mean, they could come out of the nuthouses all over the world.
And then there's the group we never see at all.
And estimates of that have been at least half to equal the number that we do see.
So let's take half.
That's another three million people, except those are three million people we never got to see, directed in by the cartels.
You have to imagine they're the worst ones.
And that's why the head of the FBI, the little weasel who's head of the FBI, is crying wolf constantly over a terrorist attack.
He's trying to cover his sorry ass.
Because he did nothing about it for three years.
He watched it happen.
Of course he doesn't know who's on the terrorist list.
He wasn't checking at the border.
When you open the border, jackass, who do you think is gonna take advantage of that but the terrorists?
If you don't think that, you shouldn't be running the FBI.
But you ran the FBI as a political I mean, you have to call it that.
You don't show up at people's homes that didn't commit violent crimes with machine guns dressed up like super soldiers.
