Good afternoon, it's Rudy Giuliani, and this is the Rudy Giuliani Show, and I'm dressed a little festive for my birthday.
Today is my birthday.
I'll tell you at the end which one.
Happy birthday, Mayor.
Thank you.
You know, today I was going to begin with the summations in the trial, because aside from cross-examination, the most interesting part of a trial is summations.
Maybe the most interesting part, because they have to pull everything together, and it seems to me from the parts From the parts that I've seen of the summation, they're pretty standard.
Right now, Mr. Steinglass is using the very old but tried and true argument of a prosecutor.
We don't get to pick our witnesses.
He says, we didn't pick Cohen up at the witness store.
The defendant shows him to be his fixer.
The case is not about Cohen.
He provides context and color to the docs.
The case is all about Cohen.
Without Cohen, there is no case.
And even with Cohen, there is no case.
Because Cohen doesn't prove that the statement that they claim is the core of this case is a false statement.
The statement says, uh, legal, uh, retainer legal expenses.
That is a perfectly adequate description of a group of expenses that were lumped together by the accountant.
And it would probably be the one that would come to mind for the accountant.
There is no proof from anyone that Trump selected that description.
In fact, as far as we can tell, it goes from one person in the accounting department to Mr. Weisselberg to the person who entered it.
And it came out of a group of stock A group of general descriptions they had when you have a whole conglomeration of items.
Remember, here's what Cohen blew up on them, and I hope that his lawyers made this clear.
All along, he thought, oh, this was just one thing, and he called it legal expenses or legal retainer, and it was hush money.
Well, it wasn't.
If he had just put down hush money, he would have left out three or four other things that were involved in there.
In fact, more money for that than for the hush money.
There was over $400,000 worth of expenses that were being accounted for in that one item.
And since they were all being paid to the lawyer on a monthly basis, it was a perfectly reasonable A description as a legal retainer or expense for the accountant to picket.
Now, we're way far away from Trump having committed a crime because there's not a single inch of proof that he picked the statement.
Only that it's not false.
And if you want to get into fighting over, is it false, maybe a little, remember, they've got to prove, it can't be close, they've got to prove beyond a reasonable doubt it's false.
There's no way that's false when it's four or five legal expenses.
And the accountant carried it that way.
One of the defense witnesses, the lawyer for the woman, He said he did not consider it hush money.
He considered it consideration.
And what does that mean?
That means the payment that's made in a contract that binds a contract, and that it's done all the time, that he did it many times, that they did it many times, and that it's done in business.
Often people pay money to each other to settle claims.
In this case, it was a rather reasonable amount of money for someone in Trump's circumstances.
And when you hear about the settlements for so-called sexual claims, they're in the millions and millions of dollars.
So this could not have been much of a claim, right?
I know $135 million will sound like a lot to the jury, but it's got to be put in the context of, you know, the $20 million for this one and the $10 million for that one and the $5 million for that one.
And then there was testimony again from the state witnesses that this had to do with not wanting to have problems with his family and his wife and all of which lead to the second conclusion.
See, there are three elements to this crime.
Element number one is, was it a false statement?
No, it was a true statement.
It was absolutely truthful.
A statement.
Number two, was it done in pursuance of another crime?
Well, what's the other crime?
They don't tell him.
At one point, he alluded to six, then to four.
Now it's three.
Could be state.
A failure to comply with the campaign finance law?
Although no state campaign finance law was brought into evidence, and this was a federal election they're talking about.
And then there's a tax violation?
I don't know what the hell the tax violation is.
They gave them the money to pay the taxes.
You're entitled to do that.
So it comes down to the old and the tried and the true.
And that is that it was a campaign contribution to the federal election because it kept bad information out concerning Trump.
Well, you know, too bad.
But the federal government has decided that is not a campaign contribution.
And nobody made him the federal government.
And the judge who to say that the judge is prejudiced is such an understatement.
It's almost embarrassing to say the judge has got to be From the point of view of the conduct of the trial, the most crooked judge I ever observed.
Slimy, lying, all on one side.
Doesn't even make a pretense of it.
How he can let this case go to the jury and they can't figure out what the underlying crime is, is mind boggling.
I've talked to 30 lawyers at one time or another in the last several weeks.
And none of them can explain it to me.
I asked several who are more expert on this area of New York law than I would be, is there some special provision on the New York law?
You know what they said?
Yeah, it's called democratic corruption.
There was a Democrat too.
He said, come on, you know from law school that political cases, they're all corrupt.
And it's true.
What this should bring out is a massive investigation of the New York court system, particularly the New York Supreme Court in Manhattan, the Bronx, Brooklyn, and Queens, which is run by the party bosses.
And man, I had cases.
I'll give you my old cases.
You can take a look at those.
Bet you could bring them right up to date like I did with the commission.
It's a disaster.
It's a disaster.
The false statement is true, and it's certainly not proven beyond a reasonable doubt to be false.
The second, the felony is a federal offense, which first of all makes it impossible for Brad to charge it.
He's a state prosecutor.
And number two, according to the federal government, it's not a crime.
According to the According to the Justice Department, according to Mueller's report, if you bother to ever look at the footnote there, and according to the U.S.
Attorney, according to Bragg's predecessor, Bragg himself, until he changed his mind.
And finally, you have to have intent to commit the crime.
You have to do it knowingly, with a purpose.
There's no evidence he knew it was happening.
What's the crime?
Not the payment of the money.
That's not a crime.
The crime is the false entry.
How can you do it with intent if there's no proof that he knew it was happening?
This should be a 10 minute not guilty verdict.
In fact, if the judge had that much integrity, the case would be thrown out and the prosecutor would be sanctioned for trying to convict an innocent man, which is a horrible, horrible thing.
Now, The big argument that Trump has made is that this is all theater.
This is all political.
This is not a real case.
This is a attempt to interfere with the election, particularly when you put it together with the other three, all of which have equally frivolous elements to them, and all of which are brought on the same year, which just happened to be the year that he's going to run.
I don't know of any man that was tried for four major felonies in one year.
And I don't know of any judge except a crook like this guy or Anger Moron that would go along with it.
But if you want to know that this is a political show, what did the White House do?
They sent an actor today!
You want it to be a show?
Now, I personally was very shocked when I saw him because I thought I remembered Watching the hearse and whatever, pulling into Calvary Cemetery, burying him.
Way back in the 70s!
Is there any footage of that?
So, I mean, we can show that this guy is dead?
You got that, Kennedy?
You got that, Kennedy?
The doorbell rings.

So he's dead.
So he's dead, so he shouldn't have been an honest witness.

I think that the presence of an actor, this reminds me of January 6th, if I recall correctly, and Dr. Maria will remember this, didn't they have a movie producer at January 6th?
Yeah, they had a movie producer at January 6th, and they had a movie producer for the phony, illegal, criminal January 6th hearings, where I think they lost my testimony.
You know why?
Because I kicked them all.
They never released my testimony.
You know why they didn't release it, right?
They think they're a match for a real lawyer.
They never really had to work in their lives because they take bribes.
Now, here is proof.
I think we should be allowed to call as a witness anybody they bring for a phony press conference.
And I think he should be questioned about this because this is one of his, this is one of his colleagues, uh, who makes this accusation about, uh, about De Niro.
Listen to this.
It's quite serious.
It's not like the old days, where we can do anything we want.
A refusal is not the act of a friend.
If Don Corleone had all the judges and the politicians in New York,
then he must share them, all of his youth.
He must let us draw the water from the well.
Essentially, he can present a bill for such services.
After all...
Remember, there's a scene when, at the end of this, there's a scene
in which the godfather, before he dies, because I thought he was gone,
says, you know, it was Barzini all along.
And Barzini is the one who gets shot at the courthouse they're in now.
...changed.
It's not like the old days where we can do anything we want.
A refusal is not the act of a friend.
Don Corleone had all the judges.
It's a good point here.
Notice there's no qualification.
He says that he has all of the judges and politicians in New York.
So we should be allowed to call.
We can't call Barzini because, unfortunately, Barzini is dead.
He was killed at the New York Supreme Court, top of the steps.
Man, every time I go there, I point it out to Ted.
Remember there was the guy who's dressed up like a cop?
Yeah.
Boom, boom, boom.
He took him out.
He came rolling down.
Barzini thought he was so smart.
He thought he was smarter than Michael.
Like Kelly was.
And the Godfather is gone, but there got to be people around that would know that he had all the judges and all the politicians in New York in his pocket.
You think that's over?
You think the 150 years of Democrat corruption in New York is over?
It ended for a short period when they had, uh, uh, well, it ended during a period when they had a mayor named LaGuardia.
And then it ended during a period when they had a mayor named Giuliani and a mayor named Bloomberg.
And baby, that's it.
Some of the mayors knew about it.
Some like Ed Koch didn't know about it, but it happened around big time.
I put so many of people around him.
In prison, that's how I became mayor, really, famous enough.
My name recognition and all that silly stuff.
So in any event, I think this was an absolute indication that this is a political show.
But what a tragedy to take the criminal justice system and use it as a political show.
And they don't just do it to our presidential candidate.
At some point in the next couple of weeks, they have to go out to Arizona In order to get fingerprinted and photographed again.
Last time I went, I got a standing ovation from the prisoners.
I'm not looking for... I don't like standing ovations from prisoners, frankly.
I'm used to them being angry at me.
But, you know, there is one last point about this De Niro guy and about the godfather when he got older.
He developed a little bit... Well, there are some suggestions.
Uh, that maybe there was something anti-Semitic about him.
What's, uh, I hate to bring this up, but you know, you want to use them.
You got to take all of them.

You know, it was a little hard.
to sometimes pick it up.
I'm a pro-Congressman and I love this thing.
I mean, that's something.
I wonder who it was.
I mean, you think it was in New York, a Jew congressman or someplace else?
Well, he had all the ones in New York in his pocket.
So that would include the Italians, the Jews, the Irish.
But man, I mean, calling a guy like that.
I don't know.
But I mean, in all seriousness, it is, it is an absolute indication that this is a one damn, it's not a joke.
This is a desecration of our criminal justice.
The reason I use this was Michael Caine walked in during the trial of Carmine Persico in front of the jury before the jury came in and he was sitting at the, he was sitting, he remained sitting next to Carmine Persico.
Known to his friends by the nickname junior known behind his back as Carmine the snake.
Well, uh, when the jury came in, uh, the judge asked him to leave and he gave Carmine a big, big hug.
So the jury would see it.
Right.
So after it was over, the press asked me, what did I think of, uh, Michael, what was his name?
Michael Caine, the guy who, the guy who played Sonny.
James Caan.
James Caan.
I said, God, I thought they killed him at the tollbooth.
Always had a sense of humor.
And Carmine got 100 years.
That was funny too, huh?
And then he threatened to kill me.
Only a cheap, cheap, cheap guy.
Offered only 400,000 to kill me.
Four years earlier, the Sicilian mafia, Who the real thing off at 800,000.
Four years, my price went down.
Very, very embarrassing.
Extremely embarrassing, I must say.
You know, now Biden, Biden, Biden is very interested in the border, right?
Even at Harris, they've been really working hard to make sure that everybody can come in that can come in.
Every criminal, every miserable bum, terrorist.
China, they only ask four questions.
So Chinese, it's taking them a little too long to come in.
So they got it down to four questions.
They all wear suits and they all look like spies.
They just, you know, but they all deny it.
You know, you know what happens when you ask the Chinese their four questions?
First thing they want to make sure that they're not going to just, you know, use their money in one place.
And they say, will you go to restaurants other than Chinese restaurants?
So you have to say, yes, you will.
And then, and then, and then they ask, um, will you, will you, uh, pay, will you pay your taxes?
And they say, uh, yes, of course we will.
And then they say, uh, Will you pay your expenses, get a job, and not be a burden on the public?
Of course, you say yes.
And then they say, you are not a spy.
And then you say yes.
And if you say yes, that's it, they let you in.
Then you can start your spying.
I mean, just the other day, a New York City lieutenant was arrested for giving information to the Chinese.
He wasn't arrested, actually.
He was dismissed from the job and not prosecuted.
Are we ever going to prosecute anybody but Trump and me?
I mean, someday other people are going to get prosecuted, right?
But, you know, like the ones the Democrats like, like the communists and the people like that.

And they're picking out skilled workers that are going to make money for them.
You don't get money for sending people here to work in a restaurant.
You get money for sending people here to bring in fentanyl, to bring in children, to bring in women, to bring in bombs.
And that's what they're making their big money on.
They're making their biggest money on human trafficking.
They don't have time for Bunches of people that want to come here to work.
Sure, you got a few, but this is disproportionately a much larger group of criminals than we've ever had before.
First of all, it's from all over the world, not just from Mexico.

Any terrorist group, any organized crime group, any criminal group of any substance has open entry into the United States.

The press described it as a Florida man.

Who came here from, not Florida, just a few months earlier from Guatemala.
And our vetting is so good, the guy was wanted for murder in Guatemala, but he got a chance to come here and commit murder.

This story, as the Post points out, has been hidden, and it's basically just been in the right-leaning media.
He was wanted in Guatemala for murdering two other people, according to the U.S.
Border Patrol.
Four national news outlets covered this story.
Newsweek, People, Huffington Post and CBS and none of them covered that he entered illegally.
Do we have a censorship as a victim of censorship?
I can tell you we have censorship and it goes deep and it's big.
It's bigger than just the hard drive.
This is happening all the time.
I've been trying very, very hard and not having a great deal of success trying to find these, trying to pull them out.
But, you know, unless somebody else brings them out, they cover them.
And the crimes are not all murder.

I'm sorry, Angel Gabriel Kuzchok was not a Florida man.
He entered the United States not even a year ago.
Wanted for murder.
Checked out, not at all.
That is the story.
Not the exception.
So don't tell me there isn't a lot of crime.
You just don't know about it.
And I don't know about it all either.
But we're going to do everything we can to dig that up for you.

And he says the psychiatrist is wrong.
And then he rethinks it and he says, but I am, but I am a danger to the children.
That's never repeated, is it?
Never said while this piece of scum goes on trial.
Let's see if they're going to show the pictures of his, his driving around with crack, smoking crack while he's driving an automobile.
So, so he can kill people on the road.
I mean, it's outrageous what they keep from you.
Nor do you know that he and his father, well, certainly he was, for sure, for about three or four years, were partners with Whitey Bulger's nephew.
So maybe we should have had the scene from The Godfather where they say, and the families from all over the country are here, the Scarlatti family, and this family, and the Biden family.
I gotta tell you, some of those guys are better fathers than you are.
They wouldn't disown a granddaughter.
Evil, evil, evil, evil.
And that's why the world is in the condition it is.
Trump has now, for several times, made it clear that he is going to throw out these people who came in illegally with a clear prejudice toward criminals.
It has to be because you look at the crime rates in Venezuela and they're way down.
You look at the prisons in Venezuela, way down.
And worst of all, you look at the nuthouses and they're way down.
And they call them nuthouses in Venezuela.
So don't get upset.
Trump has made a point that he is going to immediately deport.
First, he's going to stop with all the illegals, you know, that committed crimes and then the illegals who were protesting.
I mean, if you're protesting, what the hell are you doing here?

So you wonder exactly what the heck Biden's game is here.

Is it possible he wants an opportunity that allows a lot of money to flow, like Arafat did, and really doesn't care how many people he gets killed while he does that.
He sure didn't care how many people he got killed in Ukraine when he basically invited Putin to come in with his constant, we will not put in any troops, no troops will go in.
I mean, Putin played him like a little jackass that he is.
I am getting very, very worried and we'll have, we'll get Gordon Chang on in the next couple of days.

Uh, because I listened to him the other day and I was going to give him a call, but why not just put them on?

I'm getting very worried because I, I, I don't know if you remember, but sometime ago to the beginning of the year, I said that both China and, um, And Iran are going to have to make difficult decisions.
Both of them have, you know, massive, massive territorial ambitions.
China wants to lead the world by 2048, and Iran wants an Islamic empire.
And I think their Islamic empire, you know, theoretically encompasses the world, but it's really the Middle East.
They want to control the Middle East.
They've always wanted to control the Arabs, really.
Arabs, Persians.
Sunni Shia.
It's deep, deep, deep, deep.
So what's the name?
It's the Islamic Empire, right?
And the reality is, best we can tell, they're a couple of months away from being able to have like three nuclear weapons ready.
Now, I don't know, Ted.
We're going to examine this when we get back, but I'm going to give you the facts, and I'm going to ask you to think about this.
It says in today's reports that the Biden administration is urging England, Germany, and others to lay off any more sanctions on Iran just because they are moving closer to a nuclear weapon.
They want to sanction them for violating the rules, and America says, no, don't sanction them.
I want you to think about that for a minute.
