Welcome back to Rudy's Common Sense.
Today we are going to discuss the impeachment.
The impeachment that was voted by the House several days ago, and the impeachment trial, if there is going to be one, in the Senate, and that's what we're going to discuss.
Should there be one?
And what does the Constitution say about that?
On one side I have the impeachment articles, on the other side I have The law.
Something that—I don't know if Democrats have this one.
I don't think so.
The last impeachment was not for a crime or a misdemeanor.
Turns out, with the hard drive that I now have, it was for an entirely innocent and defensible act, except the FBI concealed the hard drive, the exculpatory evidence, from the president.
And from his counsel, which is a heinous offense, actually, for which no one's paid any price.
I wonder what they're hiding this time.
Well, in any event, they don't have to be hiding something this time.
The president of the United States was impeached in a proceeding that could only be described as, gosh, it made the Starr Chamber look fair.
There were no witnesses, as I recall.
There's no evidence.
So it was based—he was impeached based on—the raw material of the impeachment were bloviation.
You know what bloviation is?
It's, you know, what senators and congressmen do.
They just say things.
That's all we had.
We had them saying things and referring to newspaper accounts and television accounts by a media that is 85 percent infected with Trump derangement syndrome and reports probably three-quarters of the facts about Trump falsely.
A media that insists that there was no evidence of voter tampering, that there was no even suggestion of voter tampering.
A place like Georgia claims they had a perfect election, even though 165,000 underage people voted.
165,000 underage people voted in Georgia.
You think they really voted, actually?
Or you think maybe that was a dodge for phony registrations and phony votes?
Many of them, at least.
I'd like to go find those 165,000 that voted.
But the governor and the secretary of state are hiding that.
Like they're hiding the Dominion crooked machines and the paper ballots that might very well prove to be false and phony.
when you see that these underage people didn't vote.
Oh, by the way, the margin was 11,000.
165,000 illegal votes just there.
30,000 illegal votes on screen in living color.

Welcome back to our discussion of the Articles of Impeachment and the United States Constitution.
So the president, the president is impeached for, now let me read the language, engaged in insurrection or rebellion.
Who has, any person who has engaged in insurrection or rebellion against the United States is prohibited from holding any office under the United States.
Are they crazy?
Rebellion or insurrection?
I mean, we had riots all summer.
In one city, we had riots for about 100 days.
That wasn't rebellion or insurrection.
The mayor, the governor allowed it.
Some cases even defended it.
People died.
This was an insurrection or rebellion against the United States?
It was a terrible thing.
It shouldn't have happened.
Largely organized by groups trying to embarrass President Trump, including Antifa.
There's hard, solid proof of that.
That was never introduced, so the Congress got a totally false picture.
They never heard the tapes from John Sullivan or from James Sullivan, who testifies against his brother as being one of the major organizers, a self-proclaimed Antifa member.
Never heard that.
Never heard any testimony, which makes the impeachment document a farce.
I mean, you might as well stick New York Times and Washington Post, CNN, MSNBC, put them in as exhibits.
They're your exhibits.
The hate Trump medium is now the basis of an impeachment that doesn't charge a crime.
He's charged, kind of, with inciting violence, but the crime of incitement isn't even close to the crime of incitement.
Incitement basically requires getting these people all excited and having them just run off and riot.
People didn't get excited.
I spoke.
They sat there and clapped because they were too cold to get up.
Nobody ran away while I was speaking.
No one got all emotional, nor did they get all emotional when the president spoke, nor did they get all emotional or incited when Professor Eastman spoke.
That's all made up.
In fact, they had no evidence that a single person from the speech went to the Congress when they were challenged to produce one.
They didn't.
And they charge him with basically causing an inciting.
They say, thus incited by President Trump, members of the crowd he had addressed, in an attempt to, among other objectives, interfere with the joint session's solemn constitutional duty, unlawfully breached and vandalized the Capitol, injured and killed law enforcement personnel, menaced members of Congress, the Vice President, and congressional personnel, and engage another.
When challenged to produce a single witness from the speech, That did any of that, not a single name was given.
Not only wasn't there a witness, there wasn't even a name.
I mean, that's—you gotta just throw that out.
Any court in the land would throw that out.
Plus, the president didn't have the right to cross-examine any witnesses.
Of course, there were none, which is even worse.
He didn't have a right to call witnesses.
I mean, he could have called James Sullivan, who could have testified that his brother was planning this thing before the speech was even given days before.
And in fact, the president had—the brother, John Sullivan, had sent out a tweet in which he threatened the president, which was completely ignored by the Secret Service, completely ignored by law enforcement.
And not taken down by Twitter that takes down anything conservative that suggests that the election was fraudulent.
This guy can put threats to the president.
Saying the election is fraudulent is violent and threatening the president isn't.
Where do we live?
Do we still live in America?
Or are we trying to recreate East Berlin?
What's going on with these Democrats?
How have they become so dictatorial?
How can they write things like this?
People from the crowd went there?
Who?
And what did they do?
Did they go in?
Did they go in lawfully?
I mean, the police let the people in.
Did they go in lawfully with the police letting them in?
I don't know.
Did they destroy anything?
I don't know.
I can tell you, in one of the killings, it was organized by that whole thing.
You could see the people there.
They were all Antifa people.
The only person harmed was the person killed, and that was a Trump supporter.
That was the only Trump supporter you could really find there, except possibly for the police, who didn't seem to do much to stop it.
So this charge is completely baseless.
It should be dismissed.
It should be dismissed as failing to state an impeachable offense, failing to provide any facts upon which it is based so you can defend yourself, having been produced in utter disregard of even a figment of due process, and It should also be dismissed because how ridiculous is it for the Senate to hold a trial, which is a trial about removal from public office, when you've already been removed from public office?
This is like holding a murder trial after the defendant was executed.

Let's look at the Constitution now.
This is something that Democrats have been trashing.
For five years.
All during the time I represented the president, my stomach was sick at their phony invocations of a constitution they have shown utter and total disrespect for.
People should be impeached.
It's the people who tried to frame Donald Trump of a crime that he didn't commit.
Collusion.
Those people should be impeached.
Or prosecuted.
Or both.
Nothing happened to them.
Nothing.
Schiff said he had evidence of Russian collusion.
Never produced it.
He said it on television, not just on the floor of the House.
He's not immune.
Why isn't that a conspiracy to defraud the United States, along with his other phony lying congressmen?
They're still in office.
That'd be a real impeachment.
They can be removed from office.
It says, the Senate shall have the power to try all impeachments.
The Chief Justice shall preside.
Two-thirds necessary.
And there it explains what it's for.
Judgment in cases of impeachment shall not extend further than to removal from office and disqualification.
So if impeachment is from removal of office, by the plain language of the Constitution, Article one, section three, clause seven.
If it's for removal from office, see I underline removal from office, just in case anybody thinks it's for anything else.
So how can you remove someone from office if they've already been removed from office?
It doesn't say removal from office.
And disqualification to hold and enjoy any office of honor.
They're together.
Removal from office, but also the same proceeding.
Removal from office and disqualification.
Two in one.
That's what the proceeding is about.
It's absurd to hold an impeachment for removal from office for a person already removed.
This Congress has done, and this new one I'm sure will do even worse, horrible things to our Constitution.
It's tolerated a level of censorship by not removing Section 230.
It's tolerated a level of censorship on free speech.
It's the worst deprivation of free speech in the history of America, and it's done nothing about it.
It's taken the benefits of it, because it's all been for the benefit of the Democrat Party.
That censorship, by the way, constitutes by far a massive, massive illegal campaign contribution Way beyond any of the nonsense they were talking about in their false pursuit of Donald Trump.
Massive contributions by Zuckerberg and Dorsey and the would-be dictators who run high tech.
Nothing done about that.
He's being charged with insurrection?
Incitement?
When the people had gone in already while the speech was still going on, and the people at the speech were sitting there like frozen mummies?
When I finished my speech, I stayed for the rest of the speeches, and everybody with me wanted to go.
I mean, really, people that love President Trump.
And they wanted to go because their lips were getting blue.
And I said, no, no, we can't walk out.
It would be embarrassing if we got up and walked out.
At the same time, I was freezing.
I don't know how many walked to the Capitol.
I don't know if any did.
A lot did.
A few did.
I doubt that a lot did.
I don't know if anybody went into the Capitol.
And I don't know if anybody who went into the Capitol went in illegally.
All that is charged.
And not a single witness.
I don't know.
I can't say that often enough.
Not a single witness.
Who do they think they are?
Dictators?
We're a country of laws, not of crooked men and women.
These rights here, these rights right here, they come from God, not from Nancy Pelosi.
These are sacred rights.
These are the rights that undergird the greatest democracy in the history of the world.
And they are being trashed.
I know you get in trouble when you doubt someone's patriotism, so I won't do that.
But I doubt if they understand what it means to be an American.
Abraham Lincoln said, how do you define the good, better, or best American?
The belief in the values in the Constitution, the Declaration of Independence that hold us together.
Where's the belief in this Constitution that says you shall impeach someone to remove them from office, and then, and then, You have an impeachment to remove someone who's been removed, who you attempted to impeach before, and who was acquitted, and now it turns out it was a phony charge before!
You should be impeached!
You, Pelosi!
Nadler!
Schiff!
And you should be tried after that for conspiracy to defraud the United States.
And then we should see, how much did Obama know?
How much did Biden know?
Oh, and by the way, you're impeaching a man who's removed from office for not committing a crime, and you just inaugurated a president where there is a hard drive showing 30 years of criminal activity.
And you censored that from the American people.
What are you doing to our country?
You're ripping it apart.
Prosecuting an impeachment to remove a man from office who's been removed
based on no allegation of a crime and not a single witness.
Please, Democrats.
Please, Democrats.
Please!
I know many of you dislike Donald Trump.
I know many of you Hate Donald Trump, I guess.
And whatever you think of any of this, just go look.
Look at the tape in Fulton County.
Look at how they're stealing the votes.
Look at the affidavits.
You think all those people are lying?
Don't you think he has a basis, at least, for believing that it was stolen?
When we've got hundreds of affidavits of people saying there was cheating?
We have videotape of it.
We have scientific evidence.
Nobody's ever heard it except the state legislatures, and only some of it.
These are things American people should know about.
This is what free speech is about, to bring these things out.
Some people may hate them, disagree with them, say they're wrong.
And there's no incitement here.
Nobody ran off from that speech and did anything.
Not a single thing.
Not a single thing, and it had started before the speech was even over.

The damage they've done to due process, the damage they've done to the impeachment clause of the Constitution, and the damage they've done to the United States by pursuing this man day in and day out, before he even entered office, by trying to frame him for things he didn't do.

And now we got an impeachment even phonier than that.
To remove someone from office he's already removed based on not a single witness, on no evidence, and on ridiculously contradictory allegations.
Please, Democrats, please, please, save these rights.
Stand up for these rights given to us by God.
And if you don't believe in God by nature, that's what Jefferson said.
They're not Democratic rights or Republican rights.
They're rights of free men and free women.
And they have been trashed by the leadership of your party for five years.
They're the ones who should be impeached, not Donald J. Trump, who in my view was the most productive president in my lifetime, by far.
And probably is going to be known in history as one of our best presidents because he accomplished so much under stress.
