Why are we number one?
Well, you know, because we're just not doing it right.
We're completely confused.
We have all the opportunities.
We're not testing to stay properly.
We shouldn't even report the numbers this way.
Let's hear it from ABC. You just said it there.
Some of the case counts, daily case counts, can be meaningless if we're not keeping up with everybody that's getting tested at home.
So, I mean, you're not the only one who says that.
There's some controversy over keeping up with that number.
You got it, TJ. And so the controversy there amongst public health officials, epidemiologists, infectious disease, should we be even mentioning the daily COVID case at this point two years in?
Wait a minute.
So we went from incessant right-hand screen, cases, deaths, cases, cases, surge, to now, should we really be reporting these?
That doesn't seem very effective for the messaging that the vaccines work.
Mentioning the daily COVID case count at this point two years in.
Advantages of that, you know, it does tell us where we are.
It can help predict and project where we are going and guide responses.
But there are negatives there.
As we just said, they're inaccurate.
They could be double what we're hearing in these headlines.
Johnny, we could be beating ourselves.
It could be double.
Again, this takes massive time and resources for people to really get these numbers.
That's just not sustainable in the third year of a pandemic.
So there is a push by many just to report weekly case counts, as we do with other infectious diseases like influenza.
Can you give us a false sense of how good we're doing or how bad we're doing?
I mean, you heard my letter grade is a C+. I think, given who we are, we could be doing a lot better, and we should be doing a lot better.

Mayor Adams just pledged new support to city hospitals as we've been telling you they've been under strain.
Just within the last hour, the mayor laid out a new three-point plan.
This includes more than $100 million in funding for city-run hospitals.

This comes as the number of COVID patients in hospitals across the state is the highest it's been since May of 2020.

Late today in Helmers, Queens, Mayor Eric Adams met with frontline health care workers as many of their colleagues are home sick or in quarantine, a staffing challenge faced by most local hospitals.
And so today we are announcing a three-point plan to make sure each and every hospital in the city of New York has the resources they need.
We want them to be fully staffed and provide top-quality care no matter which borough they're in and no matter where they're located.
It is needed across the city.
New Yorkers deserve that.

$138 million going to city hospitals.
They can use that money for things to pay for staffing and PPE. The mayor also pointing out to this point, hospitals in the city have a 75% occupancy rate.

There was some experimental evidence that the FDA put out about a week ago showing that in laboratory studies, there appeared to be decreased sensitivity in terms of the test's ability to detect this virus, but that doesn't correlate well with real-world settings per se, so we really don't know whether or not that experimental evidence...

That doesn't correlate well with real-world settings per se, so we really don't know whether or not that experimental evidence is suggested that these tests may not be as sensitive at picking up the virus.
But they do appear to be detecting Omicron at pretty high rates, and I think it could be reasonably confident that That they are false positives.
Once again, if you're using the antigen test to protect a high-risk setting, the best approach is to do serial testing over a period of time.
While any individual test could miss the infection, if you're doing serial testing, you're likely to pick it up.
And we need to get tests into schools.
We still don't have tests widely available to the schools so that they can use these tests for test-to-stay policies to prevent large quarantines when there are cases diagnosed in the classroom.
Again, test-to-stay policies.

They're all like, oh, as long as we test, this home test, send me a test.

To any physician, any health professional, and they would say, yeah, it's possible to get more than one thing at the same time.
When you talk about an upper respiratory virus, like influenza, like COVID. Not really a surprise.

But just because Israel was first to press, if you will, with their report of this case study does not mean that it's the only one.
And it is possible that we can see and hear more of that.

Employers in Los Angeles County will soon be required to provide medical-grade masks like the N95 to anyone working indoors.
It comes as a testing site in Los Angeles confirms a case of so-called flu-rona, someone infected with both the flu and COVID. It's not new that two viruses can infect someone at the same time, although it's not common.
If you do get virus, if you do get two viruses in one, which again is rare, You will be protected if you're vaccinated.

Now, what I've seen is some people are looking at the detailed results.
I don't think every test center gives you that.
And I've seen some evidence of people being diagnosed with flu virus, but also with Corona SARS-233.
And they're saying, oh no, you got the flu-rona, or some will get, you tested positive for COVID. But 233 is a coronavirus, and it's, you know, the flu.
It's like the cold.
Literally a cold.
And so that may be what we're calling fluorona now.
I'm not so sure it's an actual COV SARS-2 that they're detecting.

People get their information from places like USA Today, and they did a handy video explainer.
There is increased activity in flu this season compared to last season.
They do expect to see more cases of co-infections.
Fluorona is not one disease.
It is two infections happening in one person.
Fluorona is basically a co-infection of influenza and SARS-CoV-2, which is the virus that causes COVID-19.
Co-infections with any viruses or pathogens have existed before COVID-19.
It's not clear whether it would cause more severe disease, but the good thing is that there is treatment available for both viruses, SARS-CoV-2 and the influenza virus.
That's all the good news.

And now, scientists are tracking a new variant in southern France, where at least 12 people have been infected.
Doctors are calling it a highly mutated variant.
Just have to keep track of it.
It has been around for almost a month, and we haven't really seen it make a big impact, so I'm cautiously optimistic.
According to a recent study, that new variant has 46 mutations but does not appear to be spreading rapidly.
Experts are figuring out whether this new possible variant could pose a real threat.

And the current governor of the state of New York, who was not elected, who got there by default after Andrew Cuomo was thrown out, she's making some very interesting moves.
New York hospitals must now clarify whether COVID-positive patients come to the hospital because of COVID symptoms or due to some other ailment.
Governor Kathy Hochul announced a major adjustment to hospitalization reporting Monday.
We talk about the hospitalizations.
I have always wondered.
We're looking at the hospitalizations of people testing positive in a hospital.
Is that person in the hospital because of COVID? Or did they show up there and are routinely tested and showing positive?
And they may have been asymptomatic or even just had the sniffles.
Someone is in a car accident.
They go to the emergency room.
They test positive for COVID while they're there.
They're not there being treated for COVID. Hochul said she called multiple hospital leaders and heard that in some cases, 20 to even 50% of COVID-positive patients were admitted for a different reason.
In other words, admitted with COVID rather than because of COVID. Hochul said the change in reporting comes down to being honest with New Yorkers.
She noted case numbers are high, but says she wants to see whether hospitalizations correlate with the numbers.
Also on Monday, Florida Governor Ron DeSantis noted the importance of hospitals making this distinction.
When you have a variant like Omicron, which is much more widespread, you are going to have people who get into a car accident, go into the emergency room, they're swabbing everybody, and you're going to have people that have incidental positives.
He pointed to Jackson Health System in Miami, one of the state's largest hospital systems, which has already implemented the practice.
DeSantis said the hospital system anticipates that about half of their COVID-positive patients are not being treated for the virus.
So what do you think that's about?
This is all old news, though.

Which is something I would have not taken note of in my news, probably.

I'll find out when I go to Pardon the Interruption, which is the only sports show I listen to consistently because it wraps all the news from everywhere with some decent opinions.
So I turn it on and they both blackballed the story.

So now I realize, and I repent, I will never take that approach again.

I think it's just to make themselves look like they're leading the pack because nobody pays attention to Fauci anymore.

To me, it sounds like it can be used in a way to lead to testing.
I think that they're still trying to make that the thing.
Even in Luxembourg, we have quite a number of boots on the ground reports today.
In Luxembourg, they're under the 3G system.
So even if you're double vaccinated and boosted, you have to have a test result QR code to go anywhere.
But here's the thing that is most interesting.
A report from one of our healthcare workers in Vegas, Vegas Hospital.
Information coming in that anyone who tested positive for COVID can come back in to work as long as they wear an N95. They don't need a negative test to come back to work because they are that understaffed.

Canada's even doing it, and it's all on the QTs.
Meanwhile, the Mayo Clinic just fired 700 workers who failed to comply with the COVID vaccine mandates.
So, you know, some people are still trying to take the system down.

Second round of grant funding available through the Texas Vaccine Outreach and Education Program.
This is an exit strategy for us if we weren't the way we are.
The Texas Department of State Health Services, in partnership with Texas A&M Health, announced the opening of the second round of funding for the Texas Vaccine Outreach and Education Grant Program.
In this round, organizations can apply for grants to engage in vaccine education and outreach with the goal of increasing the number of fully vaccinated Texans against COVID-19.
Now, this is an interesting thing, to get one of these grants.

And then the researchers looked to see if there was a difference in a person's risk of having severe COVID between the two groups.
So the risk of having to visit the ER, being admitted to the hospital, ending up in the ICU, or even being put on a ventilator.
Was there a big difference between Omicron and Delta?
Yeah, there was a clear and substantial difference.
Dr.
Pamela Davis is a pulmonologist at Case Western and a senior author on this paper.
She says if you're infected during the Omicron surge, the risk is lower for all the outcomes I just mentioned.

The sweep was simply that.
We were going to challenge the results of the election in the six battleground states.
They were Michigan, Pennsylvania, Georgia, Wisconsin, Nevada.

So this kind of starts it off, this takes us back a little bit.
So by disputing the results of an election in six states, or even one state or 20 states.

Attorney General Merrick Garland said in a speech today that the Justice Department is moving at, quote, record speed and scale to hold people responsible for the attack.
And that work continues.
Investigative correspondent Tom Dreisbach has been tracking all of these cases along with a team here at NPR. Tom joins us now.

All right, so can you just give us a sense of where the criminal investigation stands at this point?
Right.
The FBI calls the Capitol riot an act of domestic terrorism, and it's the Bureau's most sweeping investigation in its history.
As you said, they've arrested more than 700 people, and they continue to make arrests, it feels like, almost every day.
The charges so far range from people who are accused of entering and walking around the Capitol but not committing violence, to more severe charges, people who allegedly used dangerous weapons to assault police.
What kind of a charge is entering the Capitol and walking around?
I think that could maybe be trespassing, but even that's iffy.
Okay, you're charged with entering the Capitol and walking around.
Oh, I'm sorry, I'm being guilty.
Extremist, insurrectionist, violent...

Almost every day.
The charges so far range from people who are accused of entering and walking around the Capitol but not committing violence to more severe charges, people who allegedly used dangerous weapons to assault police or even conspired for weeks or months to plan the attack.
Today in that speech from Attorney General Merrick Garland, he said something interesting about how investigations like this work.
Essentially, he said they start with the low-hanging fruit.
We build investigations by laying a foundation.
We resolve more straightforward cases first because they provide the evidentiary foundation for more complex cases.
Overt actors and the evidence they provide can lead us to others who may also have been involved.
Garland said investigators are following the money.
They're looking at involvement of people, quote, at any level, and whether they were actually there that day in Washington on January 6th or not.

The House Select Committee investigating the January 6th insurrection is asking Sean Hannity, the Fox News host and close confidant of Donald Trump, to voluntarily cooperate with its investigation.
In a letter, the committee said it believed Hannity had, quote, advanced knowledge regarding President Trump's and his legal team's planning for January 6th, unquote.
On Tuesday, the committee released a number of text messages sent by Hannity to White House officials before and after the insurrection.
On January 5th, Hannity wrote to White House Chief of Staff Mark Meadows saying he was, quote, very worried about the next 48 hours, unquote.
Shortly after the news broke about Hannity's text messages, Donald Trump canceled a news conference he scheduled for Thursday on the first anniversary of the insurrection.
That is a disingenuous lie.
Go for it.
The reason that Trump canceled it, he was going to give a speech today.
Today's the 6th, I don't know.

And he was going to give a speech today, and the Republican senior, all the people, the senior members of the party in the Senate specifically, and some Congress people, Told him not to do it for various reasons.

And so he's put the speech off.

He said, yeah, give the speech, but give it one of the rallies.
So the Saturday rally is going to give that same speech.
It's got nothing to do with Hannity in this letter.
All they want is they want to make everyone look guilty, bring in as many people as possible.

The Clip Custodian earned his chops today, and he clipped a minute of the strategy that is going to be used to convict these people, and it's not what you expect.
I've been surprised because it's such a novel legal argument to see that prosecutors are relying quite a bit on a law that was passed actually in the wake of the Enron scandal as part of the Sarbanes-Oxley Act.
For those of you keeping track, it's 18 U.S.C. 1512 C.2.
So this is a law that prohibits corruptly obstructing an official proceeding.
In the original context, it was contemplated mostly with regard to criminal proceedings.
It was passed in response to Enron's burning of incriminating financial documents that could have been used in the criminal proceedings.
But here prosecutors are arguing that it applies in connection with Congress's certification of the election as the relevant official proceeding.
Several defendants have already challenged the statute on the grounds that it's unconstitutionally vague, and already there have been, though, two separate judges in the district court in D.C. who have rejected those arguments.
So, so far, it does seem like that will be a useful charge.
It carries a 20-year maximum prison term, so it can be a very useful tool for prosecutors.
How about that old friend popping up, Sarbanes-Oxley?

And here's what she mentioned, U.S. Code 181512, tampering with a witness, victim, or an informant.
Whoever kills or attempts to kill another person with intent to prevent the attendance or testimony in an official proceeding, prevent the production or record document in an official proceeding, prevent the communication by any person to a law enforcement, blah, blah, blah, blah.
Whoever uses physical force or threat of force against a person to influence, delay, or prevent testimony in an official proceeding, withhold testimony.
I mean, hinder, delay, or prevent the communication.
I mean, yeah, okay.
That's what they're going to use.
And, you know, by the law, it might work.
Yeah, take it to the Supreme Court and they'll throw it out.
It's stupid.

A lot of them are taking it upon themselves to re-engage in the broader conservative culture war.

For Aguilar, who we met outside a local school board meeting in California, it's opposition to mandates.
We figured out that going to the Capitol and working that particular piece doesn't do anything because these legislators have already met up their mind.
She is the founder of a group called Mommalisha and says her activism is peaceful.
Like many who share her goals, Aguilar uses alternative social media platforms like Telegram to organize and strategize.
This is what they're doing at the school board meetings.
Those go-local tactics are also being embraced by prominent white nationalists.
This is the right approach.
Going to the school board meetings, going out to protest.
Groups like the Proud Boys responding, taking to the streets of towns in Long Island and North Carolina to protest public health measures.
Extremist groups have always seen the culture war as a place that has enough anger and division already that it can be fruitful for them.
It's very sad what they're doing here.

A new investigation by the Washington Post and ProPublica has found Facebook played a key role in spreading false information about the 2020 election in the lead up to the January 6th insurrection.
The news outlets report at least 650,000 messages were posted on Facebook attacking the legitimacy of Joe Biden's victory prior to the insurrection, with many calling for political violence, including executions.

QR code stickers discovered on nearly 30 Austin Porking pay stations this weekend.
They place those stickers on the pay station in a location that appear to be legitimate.
Illegitimate because Austin Parking doesn't use QR codes, taking payment only through an app, coins, and cart.
We've talked to industry professionals who have warned us about using QR codes, and that's why we do not utilize QR codes on our infrastructure.
At all.
Jason Redfern of the Austin Transportation Department says the stickers were part of a scam directing users to this fraudulent website.
It pretends that it's something that it's not and asks you for financial information so that you can, in this instance, purchase a parking session.
Redfern says the city of Austin was notified of a QR code scam by the city of San Antonio in late December, putting Austin City staff on alert.
I love this.
I'm in awe of the idea and I'll tell you why after you're done.

Well, first of all, the way these scammers had to operate before, as you remember, just to get any kind of data, they had to put these pre-scanners, these devices on top of a thing where you stick your credit card in.
This happened to me once in Los Angeles.

Yeah, and it was like, okay, they got all my money, but it was just some guy and he ended up buying a bunch of tennis shoes and tacos.
And pretty much...
It was true, because I saw the charges.
Yeah, a tank of gas and some sinkers.
But the idea of putting a cue, because they do this in Berkeley, they have, and in San Francisco, pay by phone on these smart meters.
I mean, these meters cost a fortune, and they don't even work half the time, but, well, they work most of the time, but they...
But anyway, they got a number.
You can call it or you can scan something and you can pay by phone.
I just think they just held with it.
Put your own sticker on there, pay by phone, and then it goes to some site and then it just gets your credit card number.
Perfect way to do it.
And then tells you how much time you have on the meter.
Yeah.
That you put the meter number down.
They got all your information.
They made the charge and the meter never gets updated.
It's terrific because it's so simple.
It's just a stupid sticker.
I mean, it's just a dynamite idea.
I appreciate criminals at this level.
So let's take this to its logical conclusion.
What if we had a sheet of stickers that we could distribute to people that had a QR code on it that you might put over other things that have QR codes, like those damn scooters.
Anything that has a QR code, stick a QR code on it and guess where it goes.
