And tonight, we are actually going to go deep diving into a logic and accuracy test.
And there's a story behind that.
And this evidence comes to you fresh today from South Dakota, even.
And I even tried to work with the county auditor and approach the state's attorney.
And I'm just going to give you a preview.
I'm asking for their removal of office or resignation.
I'm done with this.
We're going to hold you accountable to the law.
You had your chance today and you refused it.

So getting to the latest updates that are out there across the United States, really exciting news here.
All right.
So first up, when we take a look at the gateway pundit, we see Scott Pressler drops the gauntlet in Bucks County.
Oh, yeah, Bucks County.
We've only been talking about that for the entire week, as well as part of last week.
This is Pennsylvania where they just wanted to keep counting ballots to see if they can adjust the numbers.
Look at the crowd size there.
Love it.
Thank you for supporting all of our activities as activists, going out there and saying, look, you're breaking the law.
You are committing misconduct.
And we are going to have sweeping changes in the years to come.
You got that right, Scott.
And I thank you for pointing that out.
We are not done.
We are going to be reviewing the last few elections.
And if you've corrupted our elections in any way and broke the law, we are going to hold you accountable.
We need to come to the table and have guarantees that this mess will never ever happen again.
We are sick of this.
We want transparent elections.
And most of you, county auditors, county clerks, and election officials, you don't know how to run the machines to protect our votes.
You secretary of states, most of you deserve an F. Also, you legislators, you better start listening to us and understand because if you're not going to, we are going to run and we will replace you.
We shouldn't have to have this kind of oversight of the elections and this autopilot mode that we have done as Americans.
I'm sorry.
I'm part of the blame of that, even as an elected official.
And so, I apologize for my laxadasal attitude, but never again.
And so, on Wednesday, Scott Pressler, during the Bucks County meeting, demanded the immediate resignation of board members accused of enabling election fraud to steal the Senate seat for Bob Casey and the Democrats.
Bravo.
Thank you, sir.
Then, on, of course, the bigger news, Matt Gates' ex-girlfriend, who testified in the alleged sex trafficking investigation is unmasked.
That kind of pisses me off because women need to be protected, but boy, did they screw up?
This former Democrat came out and said he'll be great for the country.
Matt is very smart, as she told dailymail.com, and she is supportive of him becoming the AG.

This will absolutely shock you.
Uh-oh, you dumb Democrats.
This is why even the current AG didn't want to go after this because there was nothing there.
And don't worry, when you have a rhino coming forward, like, you know, Lindsey Graham, he's even telling the fellow rhinos, ditch the Gates lynch mob.
When Lindsey Graham is right, he's right.
And when he is saying Gates should not be disqualified based on allegations that led to no formal charges during a Department of Justice investigation, these Democrats didn't have to do us any favors, and they would have loved to hang Matt Cates.
But when they are saying there's nothing there, you better stop.
And he's right.
Nobody should be disqualified because of a media report, Graham said, adding the bipartisan investigation didn't proceed forward.
That speaks volumes.
So at least Graham's legal prowess understands when there's nothing there.
So thank you, sir, for standing up.
I will give credit where credit is due.
So thank you, Senator.
Next up, J6 defendants, even though we get the Supreme Court ruling regarding the 1512, it shouldn't be used because that was a thing that was used during Enron's time.
And the Supreme Court basically gutted it.
But the problem is that they're still there.
There are still no trials.
And Stephanie Boas and so many other J6ers that have been trapped in this miraz, Trump cannot take office fast enough.
We need to rescue these people.

Now, when it comes to sanity, I'm going to give another piece of credit where I've been watching and enjoying this.
Thank you, Speaker of the House, but I'm still disgusted in you.
I'm proud that you said a man is a man and a woman is a woman, and a man cannot become a woman.
I don't know why that's incredible.
It's biblical.
It's scientific.
You're not changing the DNA at this point in time.
And it's funny now that it has entered their house, they want to take action.
But you know what's disgusting?
Mr. Johnson, I'm calling on you to protect all of the women throughout the country.
I'm calling on you to protect all of our daughters throughout our schools and universities, anywhere that is receiving federal dollars, you need to be protecting.
And it's funny, as you sit there in this last sentence here, I'm not going to engage in silly debates about this, noting that this is an issue that Congress has never had to address before.
Duh!
And you've allowed all of us to sit out here and struggle through this malaise, and you've allowed a state like Minnesota to just go completely berserk on this.
And then these institutions of higher learning.
You kidding me?
It's part of the pathway of destroying our country.
Now, in other news, you know me, I have really, really big trust issues with polling.
And I want to point out a couple pieces here.
Remember that little Iowa story?
And they're like, oh, yeah, Kamala Harris is going to win Iowa.
And then another poll comes out, what, four to six hours later?
No, Trump is still in the lead.
Especially, I mean, it's like Iowa hasn't changed that much.
Common sense tells you this.
It's not like Iowa all of a sudden had a bunch of Fortune 500 companies relocate to Iowa or a bunch of processing plants or a population boom that all of a sudden changed the dynamics of what Iowa is all about.
We certainly would have seen a lot of differences during the caucus system of Iowa where they choose presidential candidates.
And we could see that the crowds for the Democrats were abysmal.
I actually was there during one of the opening Lincoln-Reagan dinners in Iowa where all of the candidates on the Republican ticket basically gave their three-minute speech that they were limited to.
And at that time, there was a lot of candidates.
That's where I got to meet President Trump and also Senator Tim Scott.
And the room for Vivek was very crowded, so I couldn't get into that room.
And then also DeSantis, his room was crowded at that time.
And so I couldn't make it there.
I beelined right for Trump.
And the proof of that is that press pass that sits up there.
And that's where I first handed President Trump some of the belts that I had purchased in Minnesota with basically layovers from Wisconsin and talked to his team about election security.
And it was just a short, sweet conversation.
There are other press people there that took pictures.
And so that evidence is clearly there.
And I posted that on Facebook.
And so that evidence is there.
And we talk about it in the movie Vindicating Trump as well.

So getting back on track here, the pollsters.
I'm so happy about this news article.

She has decided departure from polling.
That was the right decision.
So thank you.
And what's great too is, of course, we know Trump handily won Iowa in 2016 and 2020 and again in 2024.
So he is the three-time reigning champion of the elections in Iowa.
And what was crazy is that she was 16 points off, especially when Trump won the state of Iowa by plus 13.
And she was indicating that Kamala was going to win the state by plus three.
Let that sink in.
I really do have trust issues.
Then, of course, the media itself is just completely going into the dumpster fire.
And it was kind of funny seeing that a CNN pundit mocks the Morning Joe hosts and other journals reportedly fearing Trump retribution.
You know, and he just kind of looked at them and just kind of said, I mean, isn't it possible too that they're just two people who just think they're so full of themselves or so full of self-aggrandizement that they would feel that they would be personally targeted?
Jennings said, as Steltzer noted, some of the Morning Joe host coworkers agree with that assessment.
It's just so disgusting.
And Brian Seltzer, I don't know how he keeps in journalism.
How can we ever listen to him with all of the lies that he has said over the years?
Then, of course, the other big thing that is happening now with Comcast is kind of looking at their bottom line, looking at the bottom of the barrel of MSNBC and just kind of going, yeah, maybe not.
Maybe we're going to spin them off.
And I really hope they do that.
And I think the spin-off will probably have a few people fired out of the media.
Now, when I talk about this trust issue, we had the same thing here in South Dakota.
Jessica Palmea, head of SD Cammon scene, she was reading the newspaper or an online article, and she calls me up and she's like, how many absentee bouts do we have so far?
Go through it.
And I'm like, at the time, we had 110,000.
She's like, this media outlet is reporting that we already have 175,000 in.
I'm like, no, I don't think we're going to be quite at that target yet.
So how are they future forecasting this?
And then we kept track of it and kind of kept looking at it.
And then on election day, when we were kind of manning the call center, I reloaded all the data each day that I received from the Secretary of State's office.
And we were still short that number at that point in time because I'm like, are they predicting some kind of number?
Do they know something that we don't know?
What's going on here?
It just didn't make any sense.
And so luckily, Jessica called them out on it.
But I also, and so thank you, Jessica, for calling them out.
And that went viral within our state.
And I think I want to encourage all of you, go back, look at those newspaper articles, look at the online surveys, and let's start calling out these agencies for what they are.
They are trying to manipulate the elections to try and get certain people not to vote because they think it's already all over.
And what was really interesting is I went and flashed back to an article in South Dakota where Stu Whitney has been after South Dakota canvassing, hasn't been honest in his reporting.
And it's really disgusting because a lot of people read his articles and then they parrot it across the state.
And it's like, really?
Why are we doing this?
And so here we go.
Here's one of these polls that showed up in South Dakota.
And it was about this open primary system in South Dakota.
And he sits here and writes, according to a scientific poll of 500 registered voters, co-sponsored by South Dakota News Watch.
Oh, yeah.
So you're writing about a poll that your paper did.
And then apparently you worked with the Chiseman Center for Democracy at the University of South Dakota that showed that 55% of respondents favored the plan to change the state's election format, with 33% opposed and 12% undecided.
Well, this is kind of funny.
And so as he's sitting here writing about this, so let's name names here.
Julia Hellwaggy, an associate political science professor at USD and director of the Chiseman Center, said Democrats and non-affiliated voters feeling shut out of the process could lead to more willingness to explore alternatives such as open primaries.
Well, and then the News Watch poll apparently showed that Amendment H is supported by 82% of Democrats, 59% of Independent voters, and Republicans aren't as convinced that a change is needed.
That's kind of how I felt because I prefer the party process, with 40% in favor of open primaries compared to 43% against.
And then so here, this Mason-Dixon polling and strategy.
So what's the strategy part?
Is that a push type of a survey?
Conducted the survey May 10th through the 13th.
And what was interesting is they're saying, well, the margin of error is plus or minus four and a half percentage points.
Well, survey says you got it way wrong.
66% of South Dakotans said no, and only 34% said yes.
So your poll was so bad.
Nobody should ever pay you to do another poll in our state again.
It's so disgusting what these institutions are doing.
They're trying to push a preference, even in a Republican state like South Dakota.
And if they had even listened in the legislature, even the Democrat House reps and Senate reps were not in favor of this thing.
So I don't know where they come out of left field thinking that they are right on this stuff.
And it's so disgusting to see this type of manipulation happening in our news media.
Ron Johnson, Senator Ron Johnson of Wisconsin had it right during the early part of COVID.
I credit him with the statement, and it really opened my eyes when he said there's a story and then there's the story.
Let that sink in.
This is why I can't trust the media anymore.
And this is why you're seeing an explosion of alternative media sources.
This is where Trump, like I talked about yesterday, had it right to go onto the podcast.
Trump has been phenomenal at breaking through traditional media.
And I think that's going to be one of the biggest changes that we see over the next four years is the last of the earthquake to go through media that has been, as he's termed it, fake news.
And let's actually be more honest about it.
They've broken our trust.
And I think they're actually fraudulent news.
And I think we need to call them out on it.

Notice of post-election audit.
Notice is hereby given in accordance with South Dakota codified law 1217B-21 that the post-election audit of the November 21st, 2024 primary election.
Wait a minute.
Hold on, wait a minute.
So that's tomorrow.
So that the post-election audit of the November 2024 primary election will be conducted on November 5th, 2024.
Really?
So we're going to do that post-election audit on November 5th, but that date hasn't happened.
Yeah, she really messed it up.
So actually what's kind of funny is since it's at 10 a.m. on November 5th, the way that this is written, actually what she meant to say is that a post-election audit of the November 5th general election will be conducted on November 21st, 2024.
So as a quick preview, that's kind of a violation of law, the spirit of it.
And under this part of the law, that's a misdemeanor.
And so I've advised a couple of people to maybe show up because the way that this is supposed to be posted is actually on the building, which she did do.
And so that was on the front door.
And the newspaper has it right.
So the question is, is this damaging enough that it should actually be redone?

This one here, we are actually going to do a deep dive into an actual logic and accuracy test deck.

I think this is a perfect time to kind of get into that depth so that way you can actually see what to expect and kind of what do the different reports look like and how sometimes some people will do a little sleight of hand.
And you have to be careful what to look for here.
All right, so getting back to Moody County, I did look at their website.
It's not a great description, but they do post that the post-election audit is at 10 a.m. tomorrow, but they don't tell you which election it was, but we're just going to let common sense prevail.
So I'm not going to hang them over their head regarding the website because it's at least correct.
All right, so here's a peek at the website.
We're okay there.
Now, in regards to Moody County, I want to kind of talk about some of the other alternatives.
So when you find that there's an issue, what can you do about it?
Well, in our case in South Dakota, we can actually take an action against the auditor and their surety bonds for misconduct or omission of duty.
And so this is one area that we are probably going to be exploring in multiple counties in South Dakota.
And we also have kind of the definition of the officer and making sure that we understand that they are in charge.
And then we also had to review, you know, the grounds for removal of officers from office.
And you'll notice I highlighTedros incompetency because that one is a little bit easier to claim in this particular case.
Otherwise, the other ones, like say misconduct or crime of actually breaking the law, we could probably go after those as well.
But gross incompetency, at least may be a little bit easier to go with.
But I'm going to be open to this, especially after what happened today.
Now, let's get into the law where I'm actually hanging my hat on.
So in South Dakota, this is the actual statute.
And the biggest area I want us to focus on, we don't have to read the whole thing, but in red, during the test, a different number of valid votes must be assigned to each candidate for an office and for against each measure.
Pretty simple, right?
A different number of valid votes.
So that means zero is not a valid vote.
You have to take an action in order to cast a vote, right?
All right.
Then we also have administrative rules that have some additional pieces.
And highlighted in red, it states a test deck must be made for each ballot that is unique in any way.
So let's talk about what makes a unique ballot.
One type of unique ballot would be if you have a county that has six precincts.
Each of those six precincts would be a unique ballot, right?
Because if the totals are going to the precinct level, the ballot has to be designed differently in order for those precincts to be tracked.
So that's where you have a unique ballot.
Another uniqueness for South Dakota is that we actually have the standard ballot, which is the oval that you would fill in.
Then for the disability ballots, those have the barcodes at the top and then the candidates selected in the middle of the ballot.
And so those are two different ballots.
Reading positional ovals versus reading a barcode are two different ballot styles.
So that kind of tells us some clues.
So if I'm testing a precinct and I have two candidates with an erase and I have two ballot styles for each precinct, that means zero, anywhere that there's a zero, that's invalid.
Anywhere that there's a one, that would be invalid because that means that one of the actual ballot styles wasn't tested.
And that means only one ballot style was tested.
Was it the barcode or was it the oval?
That's important because in some jurisdictions we've observed in another state that I audited, the clerk did a switcheroo.
She tested the standard ballot, but had the voters voting on the barcode ballot.
So her logic and accuracy test was thorough on the standard and not thorough on the barcode.
That could have created all sorts of issues.
And I told the attorney that I was working with, that's a bait and switch.
That's like a lemon law.
And that is not acceptable.
And even in that particular state, they're supposed to test all of their ballot styles as well.
Stay tuned.
That will be a future case at some point.
All right.
So now getting back to South Dakota's example, what we also see here kind of down below is that we see that one through five there, that one or more ballots with a vote for each candidate in each side of the ballot question.
Okay, so that's a requirement.
Two, one or more ballots with votes in excess of the number allowed by law for each office in question.
Okay, there's a little bit of an asterisk here.
All right.
So only on the standard ballot, the one with the ovals, can you actually have an overvote?
The express vote device through ESNS product, that's actually programmed to prevent overvotes.
So that can't happen.
So anytime that we see zero for overvotes in South Dakota, that means the standard ballot overvote was not tested, violating the law and the rule.
If there's two there, that doesn't mean that the express vote flagged in an overvote because it should have prevented it anyway.
It's not going to print two barcodes for the candidates on that ballot.
So it's not going to print two barcodes for two candidates within the same race unless it's allowed, like a county commissioner seat or a school board seat where you can vote up to two, right?
As an example.
All right.
So now getting back to the administrative rules here, it also tells us that we have to have one or more ballots with an undervote.
Undervotes are possible with the express vote where a person decides not to vote for a race.
So that makes sense.
One or more ballots completely blank to verify that the machine is correctly configured pursuant to the law.
And then one or more ballots that do not have a ballot stamp.
And we're not going to worry about that in this evaluation for this.
So, what I did to kind of keep things clear as I do the analysis, I basically create a little cheat sheet that I use to help out attorneys where I'm looking at.
So, like South Dakota Law 1, SL1, SL2, SL3, and then I kind of create a little cheat sheet.
And then, AR1 is administrative rule one, administrative rule two, and an administrative rule three.
So, this is the types of things that I help candidates and attorneys where I'll break down their law and then create a little cheat sheet and just kind of go through it.
And then I'll kind of create the arrows for them.
All right.
So, now here's where we all have to really pay attention here.
The eye and the mind have to really observe what's going on here.
And so, sometimes there's some fakery and sometimes there's some real stuff going on.
So, the first one here is some auditors will hand you a report that looks like this.
This one is complete garbage.
I can actually tell that it was done in Excel.
This is not any type of ESNS report at all.
So, this is where the auditor basically added all the votes, put it into this Excel spreadsheet, and looked at it and said, Okay, looks like I'm complying with the law.
I used 118 ballots and I'm good to go.
For you, candidates out there, and for you activists, you can ignore this one, it will do you no good.
Now, this one here is really important.
This is called the zero report.
This is a real ESNS report.
And what's important about this is that they should be doing this zero zeroing of the tabulator before any testing of the equipment as well as any actual conduct of the election.
The zero report confirms that the machine was reset and that there's no extra votes hanging into the machine before they do the test or they actually conduct the election.
So, kind of the process is that first, before they do the logic and accuracy test, they will do a zero report, print it all out.
Then, they will run the test and then print out all of those reports.
Then, they may do the zero report right after that, or when they deliver in Minnesota, for example, the tabulators to the precinct level, they'll run another zero report before starting the election at the precinct and allowing voters to insert the ballots.
Now, in South Dakota, where we're central count and so many other states are, they will actually go to that machine, run a zero report before inserting any of the absentee ballots or inserting any of the ballots that are now coming in at night from the precincts.
Okay, now when we go through this, so here's that zero report again.
Now, we go and zoom in to the zero report.
There are some things here that we want to make sure that we are aware of.
So, up here at the top, we can actually see the date and time that that zero report was done, and we can also see that there are no ballots still sitting in its database.
And you also have the machine serial number on here as well.
In this case, we can see that the election judges actually initialed this, and that's typical of most states.
So, and we can see that this is right during the public accuracy test.
And so, these are clues that you're actually going to want to get this to make sure that everything was done correctly.
The next thing that we would look at that they will typically give you right away is the detail results.
Okay, this one is complete crap and it actually doesn't really help you at all, except it gives you a little bit of preview.
So for example, in this case, I know that there's six precincts.
And when I see blank sheets cast as one right here, I can already identify that, uh-oh, there's an issue.
The testing was not done right.
The other thing I can come down here, knowing that there's six precincts, that there's only one overvote, that means they didn't properly test all the precincts.
So those are clues that I can see right away based upon my experience.
I can also see how long it took them to feed all of the ballots in for 118, that it started at 305 and ended at 319.
So it doesn't take very long for this tabulator to basically process these machines.
So this one really doesn't have that much of a value for us.
We really can't use it that much, but this is where it gets gold.
So the title up there says detail results by precinct.
This is where we get to find all sorts of good juicy stuff.
All right.
So let me walk you through this.
The first thing that we see in here, and I'm going to try and do a terrible little arrow here.
So the first thing that we see is this precinct number.
That's important because that tells us exactly what we are looking at.
So do we have one precinct, two precincts, et cetera?
And so you'll see multiple of these behind there.
You'll also see the machine serial number.
That's important to denote as well.
You'll also see how long it took to basically do the whole thing.
You'll notice that matches with that earlier report that we just saw.
It's the same timestamp.
Then we also see for this precinct that there were 18 ballots that were cast in there.
But then you see the red arrow here that I've identified for South Dakota, blank sheets cast as zero.
That's a violation of law.
Then the other thing that we see here is the ballot styles.
We see that there's two here.
So the first one up here, whenever you see this kind of three segmented, that indicates that that is a standard ballot with ovals.
Okay.
The second ballot that is listed on here is ballot style one.
And that indicates that there is an express vote type barcode ballot.
Now here's what's interesting about this.
When we look at in South Dakota, we had four candidates running for president.
Okay.
We can see that there's only three ballots that were processed for the express vote machine.
So right out of the gate, we have to ask the question, which candidate wasn't tested.
Because remember, each candidate has to have a valid vote.
And they have to be different from each other as well.
So at a minimum, two candidates weren't tested.
Because if one candidate had one vote, another candidate had two votes, that would exhaust the ballots for the express vote.
That would have taken three ballots.
Then when we come down here, we see that one candidate, Harris, has one vote, and then Kennedy has one vote.
Overall, we didn't protect vote flips, but we have to be careful because which one of the ballot styles was not tested.
Because remember, zero and one, when you have two ballot styles, is not a valid, not a valid test.
And in this case, both of the ones would be invalid because you'd have to have a minimum number of two.
And so they failed that right out of the gate.
Then, also in South Dakota statutes, it's required that we test the overvotes and undervotes, and both of those have zeros.
And so that means that also violated the law.
And that's the first page.
See how easy this is?
So, in this case, there's lots of arguments to be had here.
Number one, if I was the Harris team or Robert Kennedy team, I would challenge this election and I would want the actual ballots counted by hand because I don't know if the votes were flipped, especially if the race was close.
That would be a potential issue.
Now, we do see that Trump and Libertarian Oliver have a different number of votes, so 11 and 5.
So, those votes were probably not flipped, and they are unique numbers.
So, those are probably mapped correctly.
That we can assume that if Trump had a tremendous number of votes in South Dakota, which he did, that the other races are probably unchallengeable.
Now, if it was close, that's where you could actually challenge that election.
Now, when we get to the next page in our precinct report here, again, we see additional violations, and so these are some of the initiated measures that we had in South Dakota and then referred law 21, which was the pipeline.
Here, we can see additional violations where up here there's just one vote for no, and so which ballot style wasn't tested.
Then, over votes and under votes weren't tested at all.
Same thing for initiated measure 29, only one yes vote.
So, what ballot style wasn't tested?
And then the overvotes and under votes, complete violations, not tested at all.
Then, referred law 21, another one vote for no.
So, what ballot style wasn't tested?
You violated the law.
Same thing for overvotes, not tested.
And so, as we go through this, we go to the next precinct.
And so, here you can see that this is now precinct two.
The other one was precinct one.
We still have the same ballot styles down here where there are two different ones, 27 and 3, and we see the blank sheets cast is zero.
Well, great, thanks.
But don't worry, it gets worse when we go down here for Walls, Oliver, and Kennedy.
They all have one vote again.
What ballot style was not tested?
Then, on top of it all, we have the violation of overvotes and undervotes.
And so, with that, this is one that we can't really trust.
Then we go into the next page of this Precinct 2 report, and here we can see that for the Constitutional Amendment H, the overvotes and undervotes was not tested.
Then, initiated measure 28, over here, looking at the no vote, only one ballot was tested, so that means the other ballot style was not tested.
Again, consistent violations in the over and under votes.
Then, getting down here, over votes and under votes not tested, or for law 21, the no vote, what ballot style wasn't tested, an overvote violation again.
Holy cow!
So now let's check out precinct number three over here.
So here we see the precinct three.
We see blank ballots still cast is zero.
And then we see the two different ballot styles again.
But now look at what's different here.
Trump and Kennedy each have three votes.
Well, I don't know if that's all ballot style number one or if there was a mix.
This isn't clear.
And so typically the way we want to see test acts done is we want them complementary.
And the way ESNS recommends it in their manuals, one of the recommendations is one to max.
So starting with the first candidate, it will get one.
Second candidate, it will get two.
Third candidate, three, fourth candidate, the number four.
So you would do that on the standard ballot.
You would also do that on the express vote ballot.
So then your numbers for Harris, for example, would be two.
Oliver would be at four.
Trump would be at six.
And Kennedy would be at eight.
So that way, the one, two, three, four are matches for both of the ballot styles.
But then when you add them together, it would overlay to be times two.
And that way you could tell if there were vote flips or anything else.
You'd be able to investigate it a lot more quickly.
And they're not doing that.
And so this is poor training by ESNS, by the Secretary of State, by the Auditors Association.
And remember, we've had these stupid machines since 2005 from the EAC, and we still can't get our act together.
And I'm finding this more and more.
I just had a logic and accuracy test sent to me from another state that I've really not looked at before.
And this is out east.
It's a larger county.
They failed.
It was so bad.
The way that they alternated the votes was for president with four candidate slots there.
They rotated 72 ballots for just one candidate.
And then the next precinct, it would go to another candidate, another precinct, another one, leaving the other three candidates with zero votes.
So they weren't properly tested at all.
So getting back to here, when we go to page two of this third precinct, well, look at that.
We've got over votes and undervotes not tested.
Then initiate measure 29, we've got the 15 there.
I can't ascertain that.
With the combined, it could be unique.
And so it could comply, but that's questionable.
And then the overvote, under votes, not tested.
And the same thing for referred law 21.
Yes and no, those are questionable because I'd have to see how many of those were on the standard ballot, how many of those were on the express vote ballot.
Yeah, here we are, precinct four.
Blank sheets cast, zero.
How terrible.
We see the two ballot styles again.
And here's where it gets really bad.
Now, this is a straight-up violation.
Chase Oliver, no votes selected whatsoever.
Then you have Trump and then you have RFK with one vote each.
So what ballot style was not tested down there?
And then of course to really make matters worse, over votes and undervotes were not tested at all.
Then we get into the second sheet here.
And this one I've added in Representative Dusty Johnson, who's our congressman.
And by the way, Dusty Johnson, you had, of course, you won your election, but that one vote here, what ballot style wasn't tested?
Then the over and under votes weren't tested as well.
Then we come down to the Public Utilities Commissioner here in South Dakota, statewide race, and two of the candidates have one vote.
What ballot style wasn't tested?
Then the overvotes and undervotes missed again.
Then for my friend Tom Pischke, who ran for the Senate again here in South Dakota, he actually won his race.
But why does he only have one vote?
Why was the other ballot style not tested?
Then you have over votes and undervotes.
Now, some people will sit there and go, well, what does it really matter?
He won the race anyways, right?
Tom Pischke?
Well, it does matter because there's a little bit of breaking rights when things aren't done correctly.
And we had that example in Wyoming where Weston, Wyoming, you can Google it and look at some of the reports out there, where there was a House member who's very well liked, and she lied about it, saying that, oh, there was a lot of undervotes because it was a protest vote.
Well, it didn't happen in the county right next door.
So what's unique about your county?
And then we come to find out that she'd reprinted the ballots.
And so, and the ballots were mixed in, the machine wasn't retested, and people were filling out an oval that was programmed to not be read.
And so when they did the hand count, lo and behold, oh, look at that.
There's a whole bunch of votes for him.
Well, that sometimes has, in some state legislatures, that affects your pecking order based upon experience.
You know, how many votes did you get?
So, yeah, it does matter.
Then, when we get into the next page here with the amendments, there we go again.
Constitutional amendment E, the no vote only has one vote.
What ballot style wasn't tested?
And then we have the overvotes and undervotes not being tested properly as well.
Then when we look at Constitutional Amendment F, they both have eight.
Why would you design it that way?
You know, so you know, what you didn't protect against vote flips.
We don't know.
So that's just a bad way to design it.
Of course, over votes wasn't tested.
They did do under votes.
Then we look at Constitutional Amendment G, and the overvotes and undervotes weren't even tested.
And this is really sad.
And then we get to this precinct, precinct five.
Woohoo!
Celebration.
Look at that green arrow right there.
We got a blank sheet actually cast so that complies with the law.
All right.
Woohoo.
Wait, one out of five.
Oh, great.
That's still a failure.
Okay.
Well, hopefully we'll see some more pieces here.
We see the two ballot styles.
Okay.
Oh, wait a minute.
You want to see a neat little math trick?
Let me show you something.
You'll love this one.
Okay.
So if I were to think about how do I know whether or not a test is valid or not.
Okay, so let's just think about this.
If I have candidate A, I have candidate B, I have candidate C, and I have candidate D.
Okay, so if I did what ESNS recommended, the first candidate would get one vote.
The second candidate would get two votes.
The third candidate would get three votes.
And the fourth candidate would get four votes.
That means I would need, let's think about this together here.
That means I would need a minimum of four, seven, nine, ten ballots.
Okay, so to do a legitimate test, I would have to have a minimum of 10 ballots to cover four candidates like in this presidential race.
Ah, crap.
So, on the standard ballot, I have only eight ballots.
So, that means this thing is completely invalid.
Oh my gosh.
All right.
So, let's rewind real quick here since I've only got a minute left.
Here's what she did in the primary: zeros, zeros, zeros, tested just one precinct, and the rest of it was completely garbage.
This is important because we have people that run in the primaries in South Dakota that actually matter.
And so, congratulations, Auditor Tawny Heineman.
You get an F.
And State's Attorney Paul Lewis, where we wanted to talk to both of you today to try and take corrective measures, you get an F. Both of you should either resign or be removed from office and never touch elections again.
And you, Paul Lewis, where you disrespected me today, and you basically are providing terrible legal advice to your auditor and your county.
You need to be removed.
And by the way, Secretary Johnson, you don't get off either.
You should have had better training, better oversight, so that I wouldn't have been able to discover this, to find out that our elections in South Dakota were an absolute failure and that you fumbled this, and you should have had better oversight.
So, you broke your campaign promise of fixing the elections in South Dakota.
So, congratulations on earning your F, and I will be working to help replace you out of South Dakota's Secretary of State's office.
And I can't wait to see you in the legislature as we try to promote more laws and accountability in the state of South Dakota.
