and he's been with us right from the beginning how do you buy a ballot uh you You can go to the shops that actually have the ballot and you can buy them straight up.
Well, I mean, most people think that to get a ballot, you've got to request one from the state.
And you are now making the shocking claim that no, anyone can buy ballots.

And today I have a special guest, Debbie Lindstrom out of Texas.
And I kind of ran into her several months ago on another case that she was working on.
And then last night, a friend of ours from Texas A ⁇ M, Dr. Dottery, sent me her report for me to review and comment on and kind of wanted some of my thoughts.
And so this morning, I kind of typed in seven different things of where I was coming from and reviewing the report.
And this is probably one of the seminal reports that I think is out there that really covers a lot of the bases.
And what's shocking is as we've been talking over the last month, we've kind of talked about how there are two buckets.
We have the system certification by the EAC and system security.
And then the second bucket is the ability of the clerks to run the equipment and follow the basic tenets of the law to establish confidence in our elections.
And what is absolutely shocking here is that the report that we're going to discuss with Debbie is probably one of the best reports in a singular document that looks at both of those side by side within the state of Texas.
So, Debbie, thank you for answering the call and all of the work that you have done.
I've kept track of you.
We've spoken several months ago about another case that you were involved in during the primary election in Texas.
And then I see this one come out of left field.
And I'm working on another case in Texas in Dallas County.
And we talked a little bit about that this morning.
And this is probably, I got to give you credit.
This is one of the best documents that I have seen out there.
We'll post it on Midwest Swamp Watch later on tonight.
And I was just absolutely shocked.
And kind of the, I'm going to let my screen go away so that we can actually see the title of it here where it's the Collin County Logic and Accuracy Report.
And so right in the very beginning, it says this report summarizes the key findings, positive aspects, and areas for improvement observed during the Collin County election test on October 11th, 2024.
It highlights both the success and challenges faced during the testing process, providing a comprehensive overview for stakeholders and election officials.
Oh my gosh, I love your approach in this because it isn't about negative.
It's not just some of the stuff that we see out there that just says, oh, why, why?
We've got such a problem and there's no way that we can fix this.
You actually detail some of the pieces for areas of improvement.
But first, let's kind of start at the beginning of what started this.
And let's talk about some of your early observations.
And there was something else that you shared too, which was the way things were done in the past, but because you made a special request to do things just a little bit differently, all of a sudden, that opened the door to greater understanding.
Right.
So we've been going to logic and accuracy tests since October of 2022.
And every time we go, we learn just a little bit more.
And October of last year, which was 2023, we figured out or we asked the question: where are these machines going to be deployed?
Which location are they going to be deployed at?
And we were told they're not.
We basically take them out of the closet, we test them, and then we put them back into storage or the closet, I say.
And so we thought, well, that's weird.
That's not a real test then.
And so what we started to do is we started to write down the asset tag numbers to see if they were the same machines that were being pulled out of the closet, tested, and put back.
And sure enough, some of the machines were, which was very disturbing to us.
And so we started to ask the elections office and our county commissioners, could you please let us choose a randomly chosen set of machines that you can hash validate.
And we were granted that opportunity this time, which was great.
We were really excited that they were going to let us do that this time.
Unfortunately, we got to choose our different machines and the DS-200 failed.
It completely failed.
Well, wait a minute here.
You just said something that's really important here because those of us in Minnesota, South Dakota, Wyoming, we don't know what a hash validation is.
You're one of the rare states out there that actually has this as part of your requirements in statute, but also in the administrative rules to actually do a hash validation.
Describe to the audience what that is.
Okay, so a hash validation is basically testing that the software that comes from the EAC down to the state of Texas and then to our counties that matches.
That it is exactly what is prescribed and is it is codified or is sent down from the higher ups.
And that's what you want.
You want your hash to match.
You want it to be the software that's supposed to be in the system.
Unfortunately, in this case, you know, it's supposed to match right all the way down.
They have this golden hash, and it is codified in the law that they have to test a representative sample of the machines, one of each type of machine that's going to be used in the election.
Now, in calling.
Wait a minute here.
Just a random sample.
We're not testing all of them to make sure it's the right software itself.
Well, it's not random.
It's a representative sample.
So they just say a representative sample means one of each type according to the law.
So that's what we've been doing: the minimum amount is just one of each type of machine.
So one DS200, one DS450, one 650, one 850, you know, one ballot marking device and one of the Express Touch, which we use ESNS machines in Collin County.
So yeah, so just one of each.
So based upon that, when they did this representative sample, then you go in and draw one out randomly, you discovered a missile.
For the first time ever.
Yes.
Completely failed.
So this really is the canary in the coal mine to really have all of us start asking for that validation because what this is so important in the software industry.
I worked at a software development company, the first ISO 9000 software development company in the United States.
And working with IBM Global Services, whenever we would have, we would receive software from them, that hashtag validation was so important to make sure that it was the correct software for versioning control, but also to make sure that we weren't receiving pirated software that may have been altered by the Chinese, the Russians, anyone else,
because that could actually happen in the industries that we were working with in the mid-range systems.
And so that is so important in the software industry to make sure that that is there.
And so this is where I'm proud of Texas, but also disappointed that the other states don't have it.
And so when they talk about we're the gold standard for elections, not quite.
And even with Texas, not testing all the machines just basically really is a hallmark of where you point out as an area of improvement to help secure our elections.
Right.
So that's what we want.
We just want, I mean, we've asked, can you please do more than just one of each?
And we've always just been told, well, the law only requires us to do a representative sample, and that means just one of each.
But to your point, I mean, when you're testing the hash validation, you know, you don't want anything to be added and you don't want anything to be subtracted from what the source, what the software is supposed to say.
So if it's failing, then that means that there's a problem.
Either something was added or something was subtracted.
It's not what it's supposed to be.
Do you have a sense of what was the case regarding the machine that was in error?
Was it something that was added or subtracted?
We haven't been able to ascertain that yet because basically, when we were at the logic and accuracy test and this failure happened, you know, everybody was concerned, including the election administrator.
And he, you know, he said, okay, well, we're, I'm going to call ESNS.
I'm going to like figure out what's going on.
And then I'll get back with you and we will talk about what the next steps are going to be.
And so I, you know, this was on Friday night, last Friday night that this, you know, we were, we finished the test at 7 p.m. that evening.
We started at nine, we finished at seven.
And then, so I'm thinking, well, nobody's going to be open.
I'll just call him on Monday or email him on Monday and find out what you know what's the plan.
And so I did email on Monday and I was told, well, we already figured out what the problem was on Saturday.
So we came in over the weekend.
We figured out what the problem is without the public there to see what happened, whether all of the people that are able to touch the machines are able to teach, you know, because there are people that work for ESNS that are in our elections that are in our elections office and they're contractors, but you know, they're not supposed to be doing the hash validation.
So we weren't able to see any of that.
And that was very concerning to us because we just want transparency.
We want to make sure that whatever is going on, that's why we're there at the logic and accuracy test to begin with.
It's a public test that the public is invited to to see how things are running and to it's supposed to build confidence.
I tell you, if it fails, it's not building confidence.
So well, you're exactly right.
And I'm going to make an assumption here because this is what I've observed in other states is that the public accuracy test is supposed to be the cheerleading event that the election official has already done all of their due diligence behind the scenes, that there's actually been testing already done.
And so they should be coming out to the public at this point in time to basically prove their work.
And we should be cheerleading in the public to kind of go, job well done.
We see that your work was well paid off and you did a great job.
Thank you for having our backs and protecting our elections.
But aha, you ran into just picking one random machine and it fails.
But it doesn't end there.
What happened to the second machine?
So then we were able to go pick another machine randomly.
We ended up picking up from the same cabinet that the other one was in.
But that machine was taken out.
And this was only the DS-200 that failed, by the way, which is the machine that counts our ballots at the polling station.
So that's very concerning that it's not matching what it's supposed to be.
So anyway, we go in and we get another test and it fails as well the first time.
Now it did pass on the second try, but it failed again.
And again, more concern.
What is going on?
That is supposed to match.
And if it's not, then there's a problem and we don't know what it is.
And then for them to go and do it on a Saturday when nobody can observe, that doesn't engender confidence in the public and what they're doing.
Yeah, to be able to fix something that fast when you're ending at seven o'clock on Friday, they're able to somehow miraculously fix it on Saturday.
It's not a quick drive from ESNS headquarters down to where you guys are.
Now, was the Secretary of State involved in this?
Did they provide a new copy or did the text there from ESNS that were contract have CDs to basically reflash or even a thumb drive to reflash the DS-200?
What happened?
Well, we don't know.
I mean, all of this was done in secret.
However, I've been in Austin all for the past couple of days.
And I will say that the director of elections, Christina Atkins, she said today that today was the first time she had even heard of my report.
That's kind of concerning.
That means that she was not in attendance or didn't even know that this was an issue, even though I did tell my elected officials on Friday during the test that it was failing.
Well, this is stunning because that's another issue.
My expectation and what we've read in the EAC documentation and as part of the process of Hava and the Secretary of States is that they're supposed to have an error reporting that when something like this devastating happens, it's supposed to be reported to the Secretary of State's office so that they're aware of it and they can work with the vendor, the county election official to make sure that things are rectified to restore public confidence.
And that sounds like that didn't happen.
Not to my knowledge.
Yeah.
That's stunning.
I mean, yes, it is stunning.
This is this is alarming.
And it is alarming.
So let me back up here a little bit to kind of help set the stage.
How big is Collin County?
Is there a major city?
Yeah, we're about 1.2 million.
We're north of Dallas, a suburb of Dallas, and we have about 700,000 voters.
Okay.
And so you have probably a few hundred tabulators sitting out there, precinct tabulators.
Absolutely.
Absolutely.
So for early voting, we're going to have around 45 be deployed for early voting.
And then for election day, I think we have like 140-ish.
So that's a lot of DS-200s that are that's how many polling locations.
Now, you know, some of them have more than one DS-200 that are deployed to that location because they're a larger, a larger volume polling location.
Yeah.
We do countywide voting, which is another whole thing.
But yes.
So, yes.
So a lot of machines are going out.
And this is what's even kind of more disturbing is that when they found the problem, they only test, they only fixed the problem on 16 of the machines.
And so I don't know what they're going to do with the rest of those.
I think they still have the problem on them, or at least that's all we can assume is that they potentially have a problem.
And I don't know if they're going to fix it or not.
And correct me if I'm wrong.
I think in our morning discussion, you said that some of them are already deployed and are actually active out there for early voting, correct?
Well, no, early voting starts on Monday.
So, but they are all, they're already in cabinets ready to be deployed really theoretically next weekend.
And so they will, you know, they're already ready.
They're already ready to go out.
So they only took out 16.
They tested the, or they, they figured out what the problem was.
They tested it on 16 of those.
They did, let me go back and just say they did quarantine the one that completely failed.
So, I mean, that's good that they, and to me, that machine needs to be tested by an independent cybersecurity expert.
And I know you probably know a few of them.
I know a couple too, that, and we have one in common that we know that would be an excellent choice to do that testing.
But we need to figure out what is the real problem.
Now they've given me an answer, but I don't know if they're doing things behind the scenes.
It's really hard to trust the answer that they gave me.
What's the answer they gave you?
Basically, they just said that they tested the hardware first and then something changed between when they did the hardware testing to the hash testing for this.
So that means either something was added or subtracted in that step.
And so the solution was to basically factory reset all of the machines.
So yeah, that's kind of crazy.
We have to go all the way back to the way that they were when we received them at the beginning.
So what was added or subtracted from the source code?
And because this was our first and only time to randomly select, and these machines, we were just testing the same machines every time.
Those were the pristine machines that were going to pass the hash validation every time.
We got to choose a randomly chosen one.
So how long has this problem been there?
And nobody noticed.
It's kind of disturbing.
So I guess a couple things that I hope your team reviews is I hope you do a FOIA request regarding the incident log to make sure that it's there.
You already tipped your hand that you are tracking the serial numbers of the machines from election to election since 2022.
So that's a good piece of advice for everybody out there in the country.
Start doing that.
We observed in another jurisdiction in Wyoming where the serial number that was printing out from the reports and the serial number that was on the back of the machine, it had an extra digit and so it was off.
And just recently, ESNS was able to reset that serial number.
I'm not sure how they were able to, in essence, update the BIOS.
And I'm aware.
And the other concern I have for you as well to monitor is the protected count.
Did that number adjust in any way on any of these machines?
And so hopefully you have records of previous logic and accuracy and you can look at the number of votes that happened within each of the precincts.
Of course, you're like me, a vote center where people can vote anywhere.
And so it just creates a hot mess from a reconciliation standpoint and a chain of custody that concerns me.
Yeah.
So another question I have for you is, do you have the two ballot styles where your voters fill in the ovals and then you also have the express vote, which is the barcode ballot at the top?
No, we only have ballot marking devices.
That was something that we asked for from our commissioner's court is to have the ballot, at least have the ballot on demand printers that would be able to print a hand marked ballot.
We did ask for that.
They did kind of say that they might be open to it, but they're still looking into the logistics and the cost and all of that to see if it's even feasible for us to do that.
So, you know, that's what we want because we know that we cannot read barcode.
None of us reads barcode.
And so we know that, and we know from other counties across the country that those barcodes can be misprogrammed or they can flip or, you know, whatever.
There's all kinds of issues with that.
So we really wanted to go back to a hand mark so we could preserve the voters' intent.
You're exactly right.
And what's really sad, and this is a statement that I make episode after episode, is I want to remind the audience that we are operating under the 2005 voluntary voting system guidelines set out by the EAC.
And we're going into the 2024 election using these same standards.
And we had these vote flips in Pennsylvania using the express vote machines where people were selecting one judicial retention and it was sending those votes down to another judge down below.
And then the judge below, those votes were going up above.
And so it's really disturbing.
And I don't know about you, but I make a lot of mistakes whenever I type.
And so this is where logic and accuracy is supposed to be the bedrock according to the vendors because this is how they win cases and don't have to settle because they always blame the election official for not having enough, robust, enough logic and accuracy tests.
Now let's go into that.
Let me tell you one thing about that because in Collin County, a couple elections ago, we actually had one polling station that had to be visited because 17 votes on one day, voters complained that they flipped.
And basically, I think they just did a hardware configuration and fixed it.
But how many people went through that polling station on that day and the previous days until they figured this out that their votes flipped and they didn't even know it because they didn't look at their ballot.
So we, I really encourage everybody, if you have that kind of a ballot where it is a barcode, you need to at least read the selections and make sure that it matches what now we can't match it up to the barcode.
So I get that's another different issue, but at least look and make sure that the English that's down there or Spanish, whatever language, that it reads as you want it to, the selections that you wanted for your ballot.
And you bring up a very good point because in every single statute, it is the voter's responsibility to number one, get the vote, the ballot back in time.
Two, if there's any mistakes on the ballot, that the voter has to correct it.
And in three, especially on express vote paper printed ballots with the barcodes, it's their responsibility to make sure that the name printed below is actually the candidate that they selected.
Right.
And I've worked at many polling places and I'll even tell people, please make sure that you put, you read your ballot before you stick it into the tabulator.
And it's maybe 10%, even when you're telling people, you know, to do that, that even look at it.
They're in a big hurry and they just want to get out of there.
So that's a different issue.
But voter education is important for that.
You're absolutely right.
And so that is one of the things that hopefully this platform has been doing where we've talked about even pen rests on the OL ballots.
We've talked about the vote flips.
We've talked about making sure that you're available to help your election official.
Because in your case, when you think about the express vote machines, there's basically four inputs into that thing where it's the touch screen at its default level, the expanded touchscreen for people with visual impairment.
Then you have the joysticks or controller.
Then you have sip and puff.
And so you and then you have the audio piece where who knows if your name is actually pronounced right as a candidate.
And we've even seen cases where for Spanish languages, the 2016 version was loaded in for a 2022 election.
And so there is not enough time in the day for the election staff to actually test all of this.
And so this is really while we are going through this public inaccuracy test now throughout the United States.
So many states are starting this or in the middle of it or about to conclude it within the next couple of weeks to 10 days before the election, that it's so important that we get the disability community involved.
We get everybody involved to test all of the equipment.
And even if you're able-bodied, go please test the express vote machines, especially in different ways and help these election officials because they really don't have enough time.
And the really good ones value the feedback because the more we can catch before the election, the better off we are.
Yes, I totally agree with that.
And that's part of the process that we've been on is we have, and they have made changes, which is great.
You know, that is part of the positive in my report is that, you know, as we've been going and as we've been interacting with them, they have made changes.
Now, some of the changes to me, they should have been done already.
It shouldn't have been the public that had to bring this to their attention.
For example, and I know you testified about this at a hearing, but our password was the same on all the machines, at least since 2020, all the way up until this current election that we're about to have.
And, you know, when I realized that, I was like, how many thousands of people have the same password?
And it was the same one that you mentioned in your hearing.
So I was like, wow, is that the factory reactory setting one?
That's terrible.
Oh, it's just horrible.
And don't worry, I've visited now seven states that are using the same password for ESNS.
They updated it, but unfortunately, three of the passwords are too easy to guess.
And it's absolutely disgusting.
I'm not going to say what they are.
I will let the court cases explain what they are because I don't want to impact the election to disrupt the election in any way.
That's not my goal.
They are changing them for Collin County.
So Collin County is changing them.
So I was really pleased to hear that.
And there's been other little things that they've done.
They put signs on the machines that say, please read your ballot.
There's little things that they've done.
And we are going to have sequentially numbered ballots, consecutively numbered, sequentially numbered ballots starting.
It's supposed to, the law says starting with the number one.
I'm not exactly sure how they're going to implement this since this is the first time in a while that we've had sequentially numbered ballots.
But, you know, we're happy about that.
That's another security issue that is going to be positive for our county.
So that's good.
It absolutely is.

We're going to deep dive into the report a little bit more because I want the public to actually see this so that they know what to look for when they attend their logic and accuracy test.

And I had a little bit of an internet connection, so hopefully I didn't scare Apollo behind the scenes there too much.
But just reviewing here, so let's take a look at what a logic and accuracy test is.
And so if you want to do a, if we can do a split screen while she kind of tells us about it, we'll show the viewers basically kind of the definition of it on my side, if you can kind of squeeze it in.
And then she can basically, Debbie can basically kind of walk us through it in more layman's terms.
But for those who want to see the actual definition, I'll kind of keep it there for them.
Yeah, so just the main thing is that the logic and accuracy test is just making sure that the software on the machines is what it is supposed to be.
And then that ballots are accurately, that they're accurately created and then that they deploy, they count correctly.
I think that's really kind of the layman's. term of what is actually happening in the logic and accuracy test.
It's not, it's really not a test that's going to make you feel confident if you are concerned about what's inside of the black box machine.
But it is important because we do want to make sure that our ballots, that all of the candidates are on the ballot that are supposed to be on there and that they are counting correctly.
Right.
And so it's all about the accuracy, making sure that things are working correctly and that we can establish.
And so part of the notes that was in your report, you had basically outlined that you were able to choose the machines.
Six citizens were there to choose a DS200.
It also talks about the hash validation and how it failed.
Then it had to be quarantined and not used for the 2024 election.
Then you chose another DS200 and it had to be picked from the Davis area and you guys wanted to pick a different one and they were pretty sure, nope, we need to do this.
And then that one failed the test.
But then let's talk about the big central count tabulator, the DS850, the mail-in ballot test results.
And so I just want to reclarify: the mail-in ballots would be the ones with ovals on them, correct?
So that would be the standard ballot.
Yes.
Okay.
So yes, if it's mail-in, then you do get to have the little bubbles.
But the regular citizens that go in person have to have a barcode.
Okay.
And so the first scan, one ballot jammed and was recreated.
And so that's normally what would happen because sometimes in the mail, stuff gets a little crinkly and gets a little sideways.
You know, things happen.
Total ballot scan, 2,400.
Coffee filled on it or something like that.
Yeah.
Yeah.
10 were off target.
That is stunning.
And you've got a little asterisk there on that, but we're going to get back to that.
The second scan, another ballot jams and was recreated.
Total ballot scan, 2383 plus 10, 71 off target.
When you say off target, what does that mean?
It means that the count was not correct.
So we were expecting the count to be 2464 total, and it wasn't that number.
So when you, so was it the number that was assigned to each candidate, or was it the count of the ballots?
No, the total number, the total number of ballots that they, that they ran through this test.
So wait a minute.
You're saying that it is, was it under or above?
Well, I mean, it was supposed to be 2464.
And you can see that it's 20.
Now that's with the 10.
So if you take off the 10, it would be 24.54.
So you're under by 10.
Okay.
So that's not supposed to happen.
Then you have the third scan, counts cleared and zero report run before rescanning.
Rollers clean between second and third scan to remove dust and ink buildup.
Expected results for mail-in ballots, 2454 regular ballots plus 10 write-ins.
And you have the stunning piece down there, exceeds the Help America Vote Act error rate requirement.
Now, there's a couple of requirements that are out there, which is you're allowed one error per half a million ovals or one error per 1.5 million ovals, depending on where you're at.
Which in either case, it's not good.
Right.
You failed both.
Yeah, they failed both on both.
On the first, on the first and second scan, on the third, it did.
And they did think that it was because of the jams.
I will say that in Collin County, we do have a lot of really good processes in our ballot board.
And one of the things that they do do is they take all of the ballots when they've opened them from the mail-in and they stack them in stacks of 50.
And so when they, if that were to happen, I do believe that if the count was off, that the county would know.
Because if they're doing, let's say they're doing four stacks at a time, then they should know that there's 200 ballots that are being run through.
And if it doesn't count 200, then they would know that it's off and they needed to rerun those.
Okay.
And then you talk about four races were off due to undervotes.
How would the four races be off due to under votes?
Did the mark disappear?
Because that's not normally a thing.
Yeah, I don't know.
I think what it was was that they said that.
So the technicians were the ones that were entering in the you know the expected what, what they wanted that ballot to look like into the ballot marking device, and so what they said is that it was basically a fat finger.
Um they okay, the person did it wrong yep, and then uh, I liked some of the uh comments that you have in your analysis here.
Uh, it went right to the the heart of uh what I believe.
Uh, every race needs a different number of votes for uh each candidate.
Uh, when multiple candidates have the same expected number of votes, observers cannot tell if the machine might flip votes for those candidates during the actual election.
That is so true and accurate, and I even recommend that you take the ballot into segments where you take a group, you know, in the statewide races, put them together and have a unique number for all of them.
Then in your uh legislative, city and commissioner races, put them in another group and have unique numbers for all of them.
And then in your um judicial retention, uh ballot initiatives, put those in another group and have unique numbers for them, so that way we can minimize the opportunity for uh mistakes to get flow through our elections to prevent what happened in Pennsylvania.
Those are all great ideas and I at the end of this report and I don't know if you want to show it, but you can show where I put That they could see that the numbers were all the same for all of the candidates.
It's kind of near the end of the report, but I just picked the first one, which happened to be the presidential one.
And you can see that, you know, Donald Trump and Kamala Harris and also Jill Stein all had the same exact number that they were expecting for that one race.
So we asked them, we said, okay, here's, you know, what if the votes flip?
What if, you know, Donald Trump's votes, you know, are actually assigned to Kamala's and Ms. Harris and then the other way around.
We wouldn't know that based on this test.
So we need, we asked them to do another test on top of it to at least kind of break those up so that we could at least see that they weren't flipping.
You're exactly right.
And so this is another example of a test act that I've reviewed that basically destroys the confidence of the voter to claim that the election official understands how to have proper oversight of the elections.
You know, in Wyoming, 23 of 23 counties failed their logic and accuracy test based upon our analysis and the requirements of their state laws for the primary election.
And now in Wyoming, we've already received six counties that have failed already for the general election.
I've already received a couple in Minnesota, received a couple in South Carolina, three in Texas, Wisconsin, Minnesota, South Dakota.
I mean, it's just, it's on and on.
And I even had a clerk in South Dakota was claiming that nobody asked for her logic and accuracy test and that I wasn't there.
And it's like, that was true.
I was there for the post-election audit representing a candidate.
And then I went to your office with you and reviewed the book.
And so I wrote that letter to her yesterday with the evidence and my analysis.
I have to check my email to see what the results of that is.
But no, this is a good point.
And so here's the evidence right here where that's just not, that's not confidence building.
And I asked them to do that about a month ago.
I said, would you please, I mean, I gave them a list of what I was looking for.
And a lot of some of it came from your recommendations, like folding the ballots.
We've never been able to fold the ballots before.
And actually, last week, I asked the question, Are we going to be able to fold the ballots?
And they said no.
And so I came back and I said, well, if we do it, if the citizens do it themselves at the logic and accuracy test, would you let us do it?
And they said yes.
So we were able to fold a few.
It wasn't 10%, but at least we got to fold a few.
Yeah.
And here's the other thing that was amazing.
This is another one right out of Clay Farik, Dr. Dottery, and my heart.
And as a matter of fact, you've got Dr. Dottery quoted here in there when we ask about the Microsoft patches that are updated monthly.
And I'm, you know, can we at least get within the last six months?
You know, here we are in most states going into an election where we haven't had any patches from Microsoft or antivirus updates for the last two years.
You know, and so I document that based since January 1, 2022, going forward, there's just a handful of systems that actually have the updates.
And that is even of June of 2021.
My understanding is we've been using this system since 2021.
So January of 2021, this version, 6.110.
And so The way that they were talking is that if they made any kind of change, that it would basically invalidate the certification.
So, I don't know that it's ever been done for this version.
That's actually a lie, and that's a conflict in the law because here, here's the beauty of where you and I live.
Here is so I corrected it for your state as I do for other states.
It's no longer voluntary, it's required because your statutes adopted it.
And right there in that section, 7.4.2: protection against malicious software, voting systems shall deploy protection against the many forms of threats to which they may be exposed to, such as file and macro viruses, worms, trojan, horses.
And it says right there: vendors shall develop and document the procedures to be followed to ensure that such protection is maintaining a current status.
I don't know about you, but I'm not okay with drinking two-year-old expired milk.
Me neither.
But yet, we're doing it for our voting systems.
And so, this is where it's just at a loss.
And you also highlight another area here: we are not adversaries.
I'm so glad.
And we're not, and we're, and they're treating us like if we're there to cause problems, we're there to observe and we're there to ask questions and to understand our election systems.
And those of us who are experts in our fields, whether we're accountants, mathematicians, computer science professionals, we are trying to help you secure the elections.
Yeah, I mean, I would much rather have a friendly experience with my election administrator.
And it's sad to me that we can't just make suggestions or observe things and say, Hey, can we fix these?
And it's just received in the wrong way.
It's an adversarial.
And so, here we are looking at your state.
Your state, your county has failed the two buckets.
And so, that's where I score it with an X: that the certification by the EAC and system security is a failure.
The ability of the clerks to run the equipment and follow the law is a failure.
The fact that we saw here from your own test X that three of the candidates had the same number of votes, and we wouldn't be able to ascertain if they were flipped or not, um, is just absolutely stunning.
I'm going to warn Apollo that I'm going to switch back so he has a chance to make me not so wide.
Um, there you go, thank you, Apollo.
And it is, I want to thank you for the hard work that you have done.
This report is actually, I think, really seminal in understanding where we're at, and especially Clay's testimony in front of Fulton County, Georgia.
Um, the little bit that I've done with Danesta's Souza, the stuff that some of us have done out there, like Peter Berninger, regarding the voter roles, uh, the team in South Dakota, Cavansey, looking at the voter roles of the mail forwarding uh addresses.
You have mail forwarding companies in Texas as well that are impacting your elections.
It's just absolutely we are so grateful.
I just feel like I'm just such a low, I feel like a hobbit most of the days.
I'm just all along on the journey, but I am so grateful for people like you and Dr. Doherty and Clay, and you know, all of the people that are on the Lindell team.
You don't know how much you've helped us to understand the situation and educate us so that we can be empowered to go into our counties and make a difference.

How can people support you and your organization and find out more about citizens defending freedom?
And it looks like they're starting to grow across the United States.
Yes.
So we are a national organization, Citizens Defending Freedom, and we have chapters in different counties across different states.
So I'm in Texas and, you know, what are we have four pillars?
We look at education, elections, faith, and freedom.
And so I am the elections lead here.
And really our whole goal is just to empower the citizens to look for breaches of freedom in their area.
And so we empower them, we educate them, and then we ask them to come alongside of us and go to a school board meeting, go to a county commissioner's, go to the city councils and understand what's going on in your community.
And then when you go out, you can speak to those issues where your freedoms are being breached.
So we are big, staunch defenders of the Constitution.
Absolutely awesome.
Absolutely encouraging.
Keep up the great work.
You know, and I'm so grateful for Mike Lindell that every time he hands me the baton to say, hey, Rick, can you sub in for me today?
And I will just say absolutely every single time.
And I do have to apologize to Jessica Palmea and the South Dakota Canvancing team.
I was supposed to be on a meeting with them for training.
I know Penny Baybridge is doing an awesome job of coordinating kind of the poll watchers training tonight.
And then I'm supposed to jump on later if they're still willing to meet to kind of talk about some of the voter role pieces.
But there's a lot of great grassroots organizations that are out there.
And my first exposure to Dr. Dotery was down at the Lindell event last year.
I couldn't make it to the first two.
I had COVID the first year.
And in the second year, I had a conflict.
And then so I made it, you know, third time's a charm.
And of course, that's where I presented in front of everyone from the Minnesota report some of the ballots that I had purchased out in the wild, you know, in 2023.
And then we did it again in 2024 with Denise D'Souza and his team.
And we wanted to understand, because people don't understand us computer people fully about are our elections secure.
So I said, okay, let's start at the beginning.
Is the very paper itself secure?
Because I do a lot of investigations regarding bear bonds, money forgery, all that kind of fun stuff, and a lot of computer forensics.
And so I said, all right, let me take some of my experience of where I've helped law enforcement and also corporate investigations and let's go back and let's just start at the beginning.
And so between what everybody has done out there on their own to kind of develop this knowledge base, but also to have experts like Clay Farik out there, who actually worked at one of the test labs to basically validate what you're finding, what I'm finding, what Dr. Daudery, who's an actual professor in the computer industry, and he's out there at Texas A ⁇ M saying, yeah, these guys are right.
These are serious problems.
And so when we have these professionals coming forward and volunteers coming united to say, we have to do better to protect our elections, I'm so excited for what's going to happen in this election.
I think there's going to be a lot of legal challenges, but I also look forward to seeing what's going to happen in the next legislative cycles.
I think as we start communicating as activists across state lines, I think we're going to start coming up with kind of a gold standard of how we need to reform our elections.
And I think it's time for the states to step up and kick the EAC to the curb.
But the only thing they got right was the disability rights.
But the rest of it, they don't have the oversight.
They don't have the auditing pieces or the enforcement to make sure our elections are protected.
That has to change.
And for now, we the public, we the people are coming and we have to have oversight.
It's not a criticism of the election officials, but we need to support them and we have to protect our elections.
Absolutely.
Absolutely.
And I'll just say that Dr. Doherty is one of my favorite people.
He is amazing and just a true Texan through and through and just so smart and so just kind.
I just really appreciate him.
And I like Clay too.
Yes, I do too.
I look up to them and I'm honored every time that they ask my opinion on something and my analysis.
And so I really appreciate their work.
I appreciate your work.
And all the unsung heroes out there, don't stop.

It's part of the First Amendment.
We have the right to petition our government.
