It's important from the officer's perspective and what's reasonable, and they are in this high-pressure situation.
And the fact that the gun was removed, that's a factor, but it's not the only factor because you don't know in these situations, does he have another gun or something else to make someone safe?

And the way they are trained, and Brandon will confirm this, you fire until the threat is no longer a threat and then you re-evaluate.

You don't do that.
And that's not the way they're trained.

So, the case that we're going to talk about, guys, is Tennessee versus Garner.
All right.
This is the main case, all right, that basically has allowed the law of the land to the use of force, law of the land.
So, Tennessee versus Garner, 1985, is a civil case in which the Supreme Court of the United States held that under the Fourth Amendment, when a law enforcement officer is pursuing a fleeing subject, the officer may not use deadly force to prevent escape unless the officer has probable cause to believe that the suspect poses a significant threat of death or serious physical injury to the officer or others.
It was found that the use of deadly force to prevent escape is an unreasonable seizure under the Fourth Amendment in the absence of probable cause that the fleeing suspect posed a physical danger.
Legal scholars have expressed support for this decision, stating that the decision had a strong effect on police behavior and specifically that it can influence police use on deadly force.
Okay, so here's the facts of the case.
At about 10:45 p.m. on October 3rd, 1974, Memphis police officers Leslie Wright and Elton Hyman were dispatched to answer a burglary call.
Officer Hyman went behind the house and his partner radioed back to the station.
Hyman witnessed someone running across the yard.
The fleeing suspect, 15-year-old Edward Garner, stopped at a six-foot chain link fence.
Using his flashlight, Hyman could see Garner's face and hands and was reasonably sure that Garner was unarmed.
After Hyman called out, police halt, Garner began to climb the fence.
Believing that Garner would certainly flee if he made it over the fence, Hyman shot him.
The bullet struck Garner in the back of the head, and he died shortly after an ambulance took him to a nearby hospital.
$10 and a purse taken from the burglarized home were found on his person.
Hyman acted according to a Tennessee statute, a state statute, an official Memphis Police Department policy authorizing deadly force against a fleeing suspect.
The statute provided that if, after notice of the intention to arrest the defendant, he either flee or forcefully resist, the officer may use all necessary means to effect the arrest.
That's some real cowboy shit right there, real nigga shit.
Set that nigga to the shadow realm.
Garner's father then brought suit in the United States District Court for the Western District of Tennessee under the Civil Rights Act of 1871, 42 USC, 1983, naming the city of Memphis, its mayor, the Memphis Police Department, its director, the officer Hyman's defendants.
The district court found that Hyman's actions were authorized by the statute.
On appeal, the United States Court of Appeals for the Sixth Circuit remanded for reconsideration of municipal liability under Monel versus New York City Department of Social Services.
The district court found the statute and Hyman's actions were constitutional.
The Court of Appeals reversed: if the killing of a fleeing subject is a seizure for the purpose of the Fourth Amendment, it is only constitutional when it is reasonable.
Okay, key word here: reasonable.
All right.
The court then found that based on the facts in this case, the Tennessee statute failed to properly limit the use of deadly force by reference to the seriousness of the felony.

So what did this basically do?
This basically, guys, set the precedent where the use of deadly force needs to be reasonable.

And this is one of the main cases that led to that.
So an important member of the United States, the police officer may use deadly force to prevent the escape of appealing suspect only if this officer has a good faith believe that the suspect poses a significant threat of death or serious physical injury to the officer or others.
And that obviously applies in other situations, whether or not they're fleeing or whatever.
But basically, it comes into the concept of reasonableness.
Okay, guys, it doesn't have to be true.
It doesn't have to be perfect.
It just needs to be reasonable.

And then let me go, Graham versus Connor.
That's the other one as well.

So Grant versus Connor is the other one.

So Tennessee versus Grant vs. Garner was the United States Supreme Court case in which the court determined that an objective reasonableness standard should apply to a civilian's claim that law enforcement officials use excessive force in the course of making an arrest investigatory stop or other seizure of this person.
Okay, so the outcome of the case was the creation of an objectable reasonableness test and examining an officer's actions.
That test over time via case law would evolve to a standard that could be summed up as given the facts known at the time, would a similarly trained and experienced officer respond in a similar fashion.

So these two cases, guys, are basically the backbone, right?
Obviously, Grant versus Connor is more direct on this topic, but also Tennessee versus Garner.
These two cases are the backbone of use of force in the United States.

160-pound man coming at me when I have backup, my life is in danger, right?
Especially when he has no weapon.
Now, let's switch the scenario.
Same exact scenario, but it's a female officer and she's by herself, right?
It's nighttime.
She does a traffic stop.
This guy resists her and he tries to punch her.
Well, guess what?
She could pull out her gun and shoot him.
And guess what?
She's going to be justified.
And this is why 2020 hindsight, Monday morning, Monday morning quarterbacking never works.

She is going to have significantly more justification to shoot that individual than I would.

I'm an able-bodied guy.

This guy resists, but we're able to take him down.

She can shoot him.

And the reason why is because from her perspective, it is reasonable for her to shoot him.

They never say, hey, let's think of a good way to get rid of the illegal aliens.

But as far as what I think a good messaging should be going forward, is focus on the criminals for the deportations, meaning for the arrest outside of the jail.
Focus on the sanctuary cities because, you know, one of the issues with Minneapolis, it's a sanctuary city where they would rather turn over.
As with many of these cities, the sanctuary cities have been, which is a big reason why we've had these problems in the fucking first place, by the way, is these sanctuary cities.
