There is something which is called 403.
That when the evidence is probative, meaning it is provable, it tends to prove something.
When the evidence is probative, but it's so prejudicial, it confuses.
I'll give you a perfect example.
In every murder case, somebody has to identify the dead body.
You always have to prove it.
This person was killed.
You can't prove, you can't say that Ted Bundy killed somebody.
You gotta know who that person is.
Because for all you know, that person they say was killed couldn't be alive.
So, you have to identify the dead body as the person.
You can do it through dental records, a friend, family member, somebody somewhere to look at the body either in the corpse or in the morgue.
Somebody has to say, yep, that's the person.

If I were to hand a mother a picture of the individual in the most gruesome form of death and the mother loses her mind screaming, you could object and exclude that as evidence.
It might even be prejudicial for mistrial purposes because the provative value, it's relevant, it proves something, but its tendency to...
