This is Jim Fetzer in Madison, Wisconsin, where I'm delighted to be joined today by Giuseppe Fafandulo from the District of Criminals and David Scorpio from the exotic land of Ecuador.
We're here to bring you all the news you need to know.

♪♪ And it's a doozy today.
Trump is unhappy, I would say furious, with his legal team's performance.
It was pathetic.
The opening statement by a fellow named Bruce Cantor was meandering.
It was insignificant.
He didn't issue any arguments.
He even made the concession that Trump had lost the election, which Donald Trump would never have done and would categorically reject.
Trump's lawyer for his first impeachment, Alan Dershowitz, said Trump's legal team's performance on Tuesday was not good.
He said of Castor, I have no idea what he's doing.
Why Trump didn't stick with Dershowitz is beyond me because Dershowitz is much better.
The American people are entitled to an argument, Dershowitz told Newsmax, but this, just after all kinds of very strong presentations on the part of House managers, it does not appear to me to be effective advocacy.
He was not the only one who was unimpressed.
Senator John Cornyn of Texas, and I've seen a lot of lawyers and a lot of arguments, that was not one of the finest I've seen.
Another Republican was Bill Cassidy of Louisiana, who wound up voting to move forward with a trial as constitutional.
He said Trump's team was disorganized, did everything they could but talk about the question at hand.
When they talked about it, they just kind of glided over it, almost as if they were embarrassed of their arguments.
Now if I'm an impartial juror and one side is doing a great job and the other a terrible job, as an impartial juror I'm going to vote for the side that did the good job.
I think Giuseppe, actually the way they teed it up by playing this edited footage of the crowd and so forth that ran 13 minutes, they could have dispatched it by just playing the totality of Trump's speech at the ellipse.
Because it was like 45 minutes, it was very peaceful, and he talked about patriotic and all that.
It's very clear that this, what he said, the ellipse, had nothing to do with and certainly did not incite that.
It would have been a very effective response.
Your thoughts?
Well, it's, I'm a little perplexed because A week or so ago, when he introduced his new team, everybody was lavishing praise on them.
And when they released the strategy, it seemed like, oh, that's pretty clever.
And yet, when they get there to deliver the goods, they bumble and stumble.
I mean, this is a conspiracy investigation show.
Does this mean the fix is in?
Well, I'll just tell you, I thought Castro was so bad that it had to be deliberate, a form of sabotage, and for him to say the American people had chosen a new administration and imply it was all on the up-and-up was a disgrace, frankly, not factually, historically, politically stupid, colossally stupid, a blunder, and it appears it has to have been deliberate.
Scorpio, your thoughts?
Yeah, I have to agree.
Sabotage is the exact word I was going to use, Jim.
You know, I watched part of the opening statements, and this lawyer actually praised the other team's presentation, saying they did a great job.
What kind of a lawyer does that?
You know, it kind of reminds me of the Boston bombing suspect, Jokar, His lawyer said, hey, my client's guilty right at the very beginning of her presentation.
This is sabotage and there's no question about it.
And the mainstream media is even, I heard Chuck Todd talking about it on a clip.
And he said, well, after this kind of a opening statement, I think anything's on the table now.
Meaning like, well, maybe he'll really get convicted because the presentation and the defense was so terrible.
And the other thing they kept emphasizing is how emotional this presentation was by the prosecution.
Very emotional.
And one of these senators, I forget his name, he looked Jewish to me, started crying crocodile tears when he said, oh, my daughter was with me when this happened.
And she said she doesn't ever want to go back to the Capitol building and started to cry on stage.
Just absolutely shameless.
Your points are impeccable, Scorpio.
It was all emotional.
And when you get emotional, you set reason and rationality to the side.
It had no substance.
The second attorney for Trump was making good points.
Failure of incitement.
There was no incitement, which has to be specific and with intent.
There was not even any insurrection, because that's an attempt to overthrow the government.
That obviously wasn't doing it.
Worse, you could call it vandalism.
But I heard Chuck Cogmick the same point.
He was saying, well, given that the House presentation was so well organized and effective, and the Trump presentation so disorganized and ineffective, who knows?
And I got to admit that they were much more effective in terms of presentation, since you don't get a second chance to make a first impression.
This was really terrible politically for the president.
Just terrible.
Meanwhile, six Republicans wrote with the Democrats to declare his impeachment trial unconstitutional.
Raskin, this was a guy who appealed to his daughter.
He's very effective in argument.
That was obviously a contrived event where he said about his daughter not wanting to come back to them.
It was fake tears on his part.
The Democrats really have a backup plan that's the whole idea.
They're all there to trash Trump as much as they can.
They're trying to discourage his supporters of the past from supporting him in the future.
I don't think that will be successful.
But their backup plan is to declare that he's ineligible to run for office in the future.
That's always been the plan.
The Section 3 of the 14th Amendment, a rarely cited Civil War area provision, allows Congress to bar individuals from home and office if they have engaged in insurrection.
Legal scholar Jonathan Turley has argued censoring Trump is a dangerous tactic, barring the former president from running again in the future based on a rarely cited provision without a trial and supermajority We'd open up the floodgate for parties in power to keep their political opponents out of office.
I gotta say, Jonathan Turley is among the only legal commentators who are doing a good job.
He's actually being comprehensive and balanced.
I'm impressed with Turley.
I'm unimpressed with the argument of the Democrats, but their presentation and style is superlative.
And because this is a political event, It's not going to be judged by the standards of the law, and they are making a lot of headway, I'm sorry to say.
Giuseppe, your thoughts?
It would seem to me that this is a show trial, and that the deep state, who now is in the proverbial catbird seat regarding controlling the government, even though it is an illegal installation of a non-elected president, You know, they're just gonna, you know, they're milking every last drop out of Orange Man Bad and continuing to foment Trump Derangement Syndrome, so he's the bad guy, so more to come.
Yeah, I caught a few minutes of what's going on today, though I don't expect to invest a lot of time in it now.
And it was just pathetic.
It was like every Democrat getting up there to vent their spleen about Donald Trump.
Just as you say, Giuseppe, orange man bad.
That's the theme of the entire effort.
It's clearly an exercise in propaganda.
Scorpio, your thoughts.
Well, if the Republican Party goes along with this in any sizable numbers, you know, they need 67 votes to convict.
If they get anywhere close to that, the Republican Party is essentially committing mass suicide.
And it doesn't take a political genius to figure that out.
So if they come anywhere close to convicting, I think it's just a further attempt to hand the entire apparatus of uh... the american politics over to the democrats
and that might be the plan of the republicans have been a flaccid
and uh... you know ineffective of bulwark against the
uh... this uh...
agenda of the democrats of since trump is an office so we'll have to see how it plays out
and but you know on its face this is a an obvious attempt to uh... take out a political enemy
and this is a show trial is a stalin uh... stalin s show trial
and most importantly jim this is an attack on free speech if trumpet said something like
hey we're gonna go storm the capital want you guys to break windows go in
there and you know it's fucked the whole place up you know, that'd be one thing, but he didn't come anywhere
close to that. So this is just another attack on free speech. And we're living in an age where we're
free speeches under attack every single day. Those points are excellent. Scorpio and I would
observe that Republican Party before Trump really didn't amount to a hill of beans. And it's
only because Trump turned it into a populist party. It's had political viability.
And now it appears they want to revert to their old country club, banker, finance, high society, have nothing to do with the real people and the real needs.
and they would thereby eviscerate themselves politically, which is why I think there's actually an opportunity here
for a third party.
I would call it America first.
Others talk about patriot party.
I think the time is now.
Meanwhile, we know we have all kinds of evidence that this was rigged.
We have a Michigan senator thinking the Capitol riot was staged and that Mitch McConnell was a part of it.
This wouldn't surprise me.
The Michigan Senate majority said Trump people were not responsible for the riot and that people wanted a mess ahead of the violence.
These are very appropriate comments.
The local GOP group later voted to censure him for not supporting former President Trump enough in failing to stand up to Governor Whitmer regarding the Second Amendment and COVID, but that's really odd.
The conversation began as a meeting about the upcoming censure but turned to the Capitol riot when asked about the D.C.
thing he called it a hoax from day one.
Why wasn't there more security?
Yes, it was ridiculous.
It was all staged.
He's 100% right about this.
I like it.
I think they wanted to have a mess, he said, partially attributable to people who were recruited to participate, and those who got caught up in the emotion of a mob.
He's spot on.
These, of course, we know.
We have the report from James Sullivan that his brother, John, let 226 Antifa members pretending to be Trump supporters.
In the wake of the riot, McConnell put the blame on Trump, saying he provoked people who wanted to overturn Joe Biden's elected victory.
But that's complete and total bullshit.
In my opinion, this is a disgrace that McConnell said such a thing.
The ultimate blame lies with the unhinged criminals who broke down doors, trampled our nation's flag, fought with law enforcement and tried to disrupt our democracy and with those who incited them.
But this fact does not and will not preclude our addressing the shocking failures in the capital security posture and protocols.
Well, that's because it was an organized, arranged event where Nancy Pelosi was in conspiracy.

The Homeland Security Exercise and Evaluation Program provides a set of guiding principles for large emergency
response drills.
In these guidelines, we read about the various roles such as players, controllers, simulators, evaluators, actors, observers.
The term participant encompasses many groups of people, not just those playing in the exercise.
The head directors of large emergency drills are called exercise controllers.
Their job is to keep things running according to the master plan.

Any professional emergency response drill or military drill makes use of fake blood in a variety of forms.
Blood capsules, sponges, syringes, and squibs.
A simple blood squib is a pouch that is designed to break on impact.
There are all kinds of squibs using various pumps and tube assemblies.

It's basically a small pack containing a fake blood supply, and a pumping mechanism, and some tubes.
Some of them are battery operated.
Now that we're equipped with the various roles, let's start the analysis.
I peek outside the speaker's lobby.

Notice the enormous earpiece.

Almost like they're waiting for something.

Rufio takes off his hat, changing his appearance.
He receives the signal and they leave.
And it all feels a little rehearsed.
And you can see Adam Gray push his way through.
Now, this is orange in the front.
You should also note that the glass is not glass, but plastic, or stage glass.
And you'll notice that this barricade was set up before they entered the room.
You can see Barani and Red to the left of the screen.
In about 30 seconds, they're going to make their way to the front.
Notice how our star keeps looking over to the left, as if she's waiting for something.
As the officers leave, they're pretending to talk to each other.
And you can see how easy this plastic comes out.
You see how easy that is?
Frack taps the back of Vedder.
Jaden is the first one to give the command that there is a weapon at 34 minutes and 49 seconds.
And you can hear others chanting the same thing.
Notice that the gunman briefly removes his hand from the weapon, like he's communicating, replying to his earpiece.
Look how long it takes him to do it.
Notice this person just walking in the background.
If we draw a straight line from where the weapon is to where our star is, you will see that they don't match up.
The weapon is far below her neck area.
And boom, right there.
Now that's 15 seconds since Jaden announced there was a weapon.
That's important.
Now let's back it up 15 seconds.
We can see this guy point to Orange.
Orange gives a hand movement.
And look, the Hollywood glass just falls right out.
Swat 1 goes to Sam.
Now why would Blue ever be in on this conversation?
Blue makes his way past Yellow, where he grabs him.
And you can see Barani making a hand movement.
And he touches Red on the back.
And Barani signals her to get into place.
And she goes through, and she's ready to fall.
And they all scatter.
Notice this guy in the background.
No one looks in the direction of the gunman.
Yellow gets into place.
Now that's Rufio.
Right when she goes up, he turns his back.
It doesn't make sense that Rufio's corralled all these people into breaking down the doors only to step to the side and turn his back.
In this angle, Rufio turns to take a peek.
And he touches red on the back.
And Ninja automatically puts his hands up.
Also notice when she falls back, her backpack looks fairly plump.
A perfect breakaway for a fall.
And you'll see Yellow breaks her fall.
Boom with his foot.
And here you can see the plastic glass.
Red gets out of the way.
And interestingly enough, Ronnie moves down just to touch her.
Just to touch her right backpack area.
Just for a brief moment.
While Sam comes down, he moves her what?
Nine inches to his left.
He's about to reach under her right shoulder.
At the same time he does it, it's what one briefly squeezes her right hand.
Or he's putting something in there.
When Sam picks her up, she puts her hands in front of her face.
It almost appears that she opens her eyes.
Right there.
And she just puts her hands out.
Boom.
She's set down.
Then her elbows go down.
As Data and Orange move into place.
Now Sam's gonna make a big hand movement.
His left hand is still under her right shoulder.
Trying to give her a back massage and shit.
Who writes this?
And look how she's laying.
She's still got her right leg up.
It's only been 11 seconds since the weapon went off.
And here you can see her curl the side of her mouth up.
While a drop of blood runs out from under her nose.
Which takes less than 16 frames.
Here it is in real time.
No blood.
And there it is.
And she has her hands like she's about to give a shadow puppet performance.
It's just an interesting face to make.
No suffering.
It's like, boom!
Instant depth.
She's basically using that backpack as a pillow.
All the while, look to Sam's right.
There's Ninja.
And Ninja's been there all along.
And he comes down with him.
And it almost looks like she has a smile on her face.
It's almost like a Mona Lisa.
And she's holding her right hand clenched like she has something in there.
Now you have SWAT 1 coming in, playing a scene blocker.
And notice how Rufio is just clamoring over SWAT 3.
Because there's quite a bit of photographers in that room.
Now look!

He grabs him in the back, and he puts his hands up!
See how he just grabs him and he puts his hands up?
They were friends earlier!

And look at Barani!
Okay guys, I'm just gonna pull out my phone.
And notice how he looks at his hand.
He's gonna do that a couple times.
And there's a reason for that.
So now SWAT 1's making his hand movements, you know, the big pointing.
And now he's gonna put up his weapon.
And he does this little dance with his knees.
Okay, thank you.
Thumbs up.
Like, he's pretending to talk to someone.
And he's like, thumbs up.
And now Data moves in.
He clumsily takes his book bag off.
Now here it gets really strange.
With the exception of her nose, at this time code we see there's no blood on her.

We're gonna see her pop in right there.
Nothing.

But wait!
Boom!

Four frames.
That's four seconds!
And now it looks like she's devoured some small woodland creature.
I love how blood defies gravity.
But how is that possible?
Let's back it up four seconds.
Now watch.
Notice how Sam moves his left hand from her right backpack area.
And he goes to grab her hand.
Like she's doing the peace sign.
With her hand.
Dips it in.
Look at that movement.
Now you can see him move his hand across her face.
But look.
She moves her wrist into his hand first.
It kinda looks like she's smearing blood on her face.
Or putting something in her mouth.
But you can see the movement.
And he swats her hand out.
And he forcefully turns her head to the right.
It's hard to see if those are her fingers or if she's holding on to something.
No, Sam gets up and all he's doing is just pointing.
Look!
Well, I guess my work here is done.
They're both pointing at the same time because it makes for good pictures.
You've got the drama, you've got the pointing, and all this blood is just gushing out of her mouth.
It'll make no sense.

Y'all murdered this person?
It's only been 21 seconds since the weapon went off.
Grabbing him like, what are we gonna do?
And notice, he has a full beard.
Do people in these positions normally have full beards?

He's also double masked.

And they just keep pointing, look.

We can see that Yellow has changed his appearance as well.
And so Data does these big gestures.
She's still got her damn hands like she's playing a scarecrow or something.
Now this guy coming in he's a parrot blocker and he's saying move move.
Data just looks up he's like All the while Ninja's still back there, just monitoring everything.
Data is just still fumbling through his bag, not looking for anything in particular.
Everybody's just kind of moving around her.
We have an active shooter.
How original.
Get her down!

She is down, bro!
God, it's so cringey.
So they're screaming for a flashlight.
And of all things, a flashlight.
Because the flashlight will enhance the drama of the photo.
And it draws the eye down towards the light.
There she is!
Where's she hidden?
Yeah, it seems like no one really knows.
And that's when she opens her mouth, like she's spitting it out.
You can see she has blood on her fingers.
But when do we see her ever touch that area?
And Data taps her left hand and she puts it down, like flicks something away, fixes something out of her hair.
It's unclear if Data is contributing to the blood effects or if he's just a scene blocker.
You can see SWAT-1 knees her right arm closer to her, and then she tucks it under her right butt cheek.
So this is the medic.
He identifies himself as the medic.
Notice that wonderful earpiece he has on.
And let's see the various ways he tries to save her.
Medic puts his water bottle down.
Squad 1 just grazes her.
Everybody's just grazing her.
Hair collector getting up in there.
And so medic pulls down the flag that's tied around her neck.
And notice he only had one glove coming into the room, which is very interesting.
Look, when he does this move, She opens her mouth briefly, or she says something.
So he's only using one hand, but she just lets some of the blood out of her mouth.
Thank God for capsules.
And her eyes are, she's looking at things, where before she was just looking straight ahead.
At the same time, you can see them just hanging out.
And here comes the scene blocker cop.
Now Ninja's either just making hand movements for the camera or he's giving directions to SWAT 1.
And SWAT 1 is just fumbling around with this little napkin, this little toilette in a baggie.
Notice how Medic tucks this what looks to be a cell phone in between Data's knees.
It appears Data takes the cell phone away with him.
Did you see that?
What is Parrot Blocker pulling from her hair?
And here he puts it into his pocket.
Pair Blocker shouts to SWAT that he's a medic, yet does nothing.
You can start to see his very small pool of blood.
Like the size of a cookie.
Right where Sam's hand was.
That's when they all come out.
We can't save her!
Get the f*** out of here!

We gotta get EMS here.
Guys, now notice Ninja just randomly puts his hands up.
The cops have been next to him this whole time and now he's putting his hand up for the camera.
Did you hear Jaden?
Because he keeps repeating it over and over.
He's saying the light faded from her eyes.
They're all gaslighting because they know the audio is going to be recorded.
They're all kind of pointing and overacting and fumbling in their little corners.

Look at Shades.
And Fredo has no one to talk to.
He's got nothing to do right now.
And SWAT 1 and SWAT 2 are still fumbling with this stupid f***ing bag.

They're just tugging it along.

That's Medic's hand.
Do you hear the scrunch as he squeezes?
And the medic comes in.
It almost looks like medic hesitates.
And then he comes in.
Now we see this very small pool of blood.
See how there's just a small passive blood stain?
It leaves no trail or indication of a direction.
There's no spine, satellite, or elongation tails.
There's no cast-off.
There's no arterial spray or expirated spatter.
Which makes the use of a blood squib in her backpack and around her neck the most plausible explanation.
Which could be why during this whole ordeal they nipped her up and tied a flag.
She's gone, man.
We're gonna see that, uh, Cap.
Black Hat Cap.
He's still just looking for a pulse, but he just declared that she wasn't there.
And now look!
He clearly has blood on his fingers.
And he turns his fingers around and looks at them.
And he just wipes them on the flag.

And he moves it out of the way.
And that's when SWAT 1 comes in, this little towel, and dab, dab, dab.
Dab, dab, dab, dab, dab.
Like this is fucking ASMR or some shit.
At the same time, he snaps another photo.
Ronnie's faking a call.

There's Jaden.
And Ninja just ninjas his way over to us.

And now look at Rufio with his hand on top of his head like, oh, it's such a shame.
Oh, Ronnie puts his hand around Red.

Who later gets fake arrested, and then Red is pushed out with data.

Luckily, they don't have that far to go.

You would think if it was as easy as for everybody else to get into the Capitol, it would be for paramedics.
Now we see Sam on the other side of the door, and we see he's littered his latex gloves on the capital floor next to the blood.
No one would ever do that, unless it was to add drama to the photos.

The findings don't suggest that if the lawsuits had all been decided before Biden was certified, That Trump would have won, nor do they necessarily affect many of the electoral college votes in the disputed battleground states.
But on the other hand, of the 22 cases that have been heard by the courts and decided on their merits, Trump and the GOP have prevailed in 15, two-thirds of the fully adjudicated cases.
They dug through court filings and legal minutiae to track down 81 lawsuits
filed in connection with the November 3rd election.
The lawsuits were tracked on a publicly available spreadsheet.
Of the 81 cases, 11 were withdrawn or consolidated.
23 were dismissed for lack of standing or on other grounds.
Both a cohort of 11 and of 23 should not be considered wins or
losses for either side because they have nothing to do with our merits.
That leaves 47.
Of those, 22 have been finalized after the court had heard arguments considered evidence initiative ruling.
Of the 22, Trump and Republicans won 15 and lost 7.
That leaves 25 yet to be disposed of, so they have actually won the majority of the 2020 election cases fully heard and decided on the merits.
Among the legal victories, RNC vs. Miller in the Iowa courts, where they won an injunction over absentee ballot applications, RNC vs. Gill.
Mark, Trump won an injection preventing a county official from distributing and accepting signed forms containing pre-printed information.
Trump for President versus Bockvar in Pennsylvania.
Trump campaign granted an injunction against the counting of mail-in and absentee ballots where voters were allowed to provide proof of identity days after the election.
There were only three suits addressing voting machine inaccuracies.
One was dismissed Due to jurisdiction, one ruled against, although no discovery was granted.
One is still open where discovery was granted.
A likely explanation in these areas is that legally proving fraud or voter machine manipulation is very time-consuming, requires substantial investigative work and documentation, and there wasn't enough time to get it done by this point.
Our view is the public needs to be much better educated regarding the election integrity issue, and I think that goes without saying.
