This Cop did the UNTHINKABLE!

Hodgetwins dissect the fatal confrontation between Deputy Timothy Poole and Daniel Birch in Charlotte County, stemming from a dispute over a black-painted light bulb. They analyze body cam footage showing Poole tasing an unarmed Birch, drawing his firearm after Birch swatted at the weapon, and shooting him three times while demanding he kneel. The hosts criticize the 22-year veteran deputy for allegedly engineering his narrative and failing to de-escalate a trivial conflict, noting the lack of public outcry due to the victim's race. Ultimately, the episode highlights disturbing racial biases in policing and questions the justification of lethal force over minor infractions. [Automatically generated summary]

Escalation at the Golf Course 00:06:15
Yeah, we got a damn good show.
You tell me.
I tell you what, if you guys want to cross your teeth and go ahead and cross your teeth and dot your eyes.
Let's do it.
Let's do what?
Do whatever you need to do.
Because I'm tired of you showing up on my house.
I haven't been to your house.
This guy's a fucking alcoholic.
He's down there at the golf course.
So let's do it or not do it.
What are we going to do?
What are you threatening?
Do it or not do it.
Are you threatening?
Do it or not do it.
Did you get clean up the lamp?
Come on.
Come on.
Go back to your go back to your apartment.
Do it.
Do it.
All right, that cop's an idiot.
Just because he tells you to do it doesn't mean you should do it.
You're the boss.
You're supposed to set the rule.
But you know what?
We laugh, but watch what happens next.
Hey, before we get to the rest of this video, don't forget about our new giveaway.
Ford wrapped a Bronco in 10,000 cash.
Get in the win.
Just go to my website.
You purchase something that you like, and you automatically end it win.
Come on.
Wait a minute.
He's going to his abode.
Come on.
He's backing up.
Come on, motherfucker.
Why are you trying to get away from me?
He pulled his paper because you were already trying to hit me.
I didn't try to hit you.
Yeah, you're moving up on me.
So now I'm bleeding.
I didn't see that.
I didn't see any of that.
I saw him backing up.
Yeah, I didn't.
You told him to go back to his abode.
That's what he's trying to do.
Well, you keep tasing him.
Well, I think he's backing up because he's shooting a taser at him.
Well, he's about to go in his house.
Yeah.
Now I'm bleeding, and you're doing all that.
Faith in Central.
Go ahead and send me back up.
Subject tried to attack me.
Got him at gunpoint right now.
That's crazy.
You need to get down on your knees.
I haven't done anything wrong.
Get on your knees.
Now, I haven't done anything wrong.
I need it there.
Shots fired.
Shots fired.
So he shot him three times after he tried to knock his weapon.
Yeah, yeah, yeah.
Yeah.
Oh, man.
Excuse me.
You can't come at me like that.
He didn't come up.
Sit back here.
Sit up so I can help you.
Sit up so I can help you.
Now you want to help him?
And he's got an attitude about it.
You just shot the man three times.
Yeah.
And you got an attitude because he can't sit up.
That's called mentally.
That's low capacity.
Why do you do that to me?
Sit up so I can.
The news covered it.
Walk away.
You need to get down on your knees.
I haven't done anything wrong.
Get on your knees.
Now.
Breaking news video of a Charlotte County deputy shooting a man to death.
Thank you for counting on Golf Coast News.
I'm Kelly Burns.
And I'm Peter Bush.
The deputy was responding to an argument over a painted light bulb.
I think the cop, when you respond to these disturbances, you got to keep in mind what you're responding to.
And the whole point in going there is to de-escalate this nonsense, but he escalated everything.
Yeah, yo, just call us minor dispute.
The intent is to calm everybody down.
Yeah.
He escalated the situation.
Yeah.
Gulf Coast News reporter Jackie Gunther has an exclusive interview with the neighbor who called for help.
She joins us live in Charlotte County.
The deputy tried to get a man to go back into his apartment, but he didn't listen.
And now we're seeing him get tased and shot.
So let's do it or not do it.
What are we gonna do?
What are you threatening?
Do it or not do it?
Are you threatening?
Do it or not do it.
You see Deputy Timothy Poole pull out his taser at a condo on Saxony Circle last month.
Daniel Birch tells him to tase him.
You can see Birch swatting at the taser, which does not phase him.
That is when the deputy draws the gun, calls for backup, and demands him to get on his knees.
Go ahead and send me back up.
Subject tried to attack me.
Got him at gunpoint right now.
You need to get down on your knees.
Birch gets closer and he also swats at the gun.
Shortly after, the deputy shoots three rounds with two hitting Birch.
We're freezing that part of the video.
Fired.
Shots fired.
You didn't come at me like that.
You can see immediately after the deputy gets medical aid to help Birch.
Sit up so I can help you.
Sit up so I can help you.
What did you do to me?
Sit up so I can help you.
Birch died the next day in the hospital.
This all started when neighbor Terry Beggs confronted Birch about a light bulb that was painted black.
He tells me despite his health struggles since the incident, he hopes the deputy and Birch's family are doing okay.
I hope the deputy's okay.
I really do.
I really do.
And I feel sorry for Dan.
I hope the deputy's okay.
Babe, I'm looking at this from a...
No, you're looking at it the right way.
You have the right perspective.
You're surrounded by crazy people.
Family, I really do.
I really do.
I'll get over the mental stuff and the shakiness.
Hopefully.
But I'm more concerned about them.
They've been through more than I have.
As for Deputy Poole, he has served with CCSO for 22 years and he is currently on administrative paid leave as proto.
He's not even a rookie.
He's been doing this for 22 years and he's on paid leave.
The Unnecessary Use of Force 00:04:05
Like, he's got the police union.
They protect the, but he did not have to ask, escalate it to something physical.
He didn't have to.
Yeah, he should have gave him an opportunity to leave.
Go back to your apartment.
I mean, it's going to be some back and forth, but give him an opportunity to leave peacefully.
You pull out his taser.
You didn't have to use it right away like that.
You could have used a little restraint and then you went straight to the firearm.
Yeah, it's nuts.
And he's already at his apartment.
He's on his right in front of his.
Yeah, I don't know who he's calling.
Maybe he's calling for the cop.
I don't know.
And that guy who lost his life, he had no idea that that cop was going to shoot him.
Yeah.
Because, you know, the rational thing, he was probably thinking rationally, he's not going to shoot me.
I'm out here in shorts.
I have no weapons.
I'm walking away.
Yeah, I knocked his taser away, but the cop pursued him.
Yeah, the cop kept coming forward and putting it in his face.
It's like the cop wanted him to do something so he could use it.
But the guy never did do anything that would justify him.
He swatted it out of his face.
With the gun?
To swat the gun out of his face?
That's a threat.
Yeah, you shouldn't even do that.
That's crazy.
Yeah, I think he put it in his face so he could swat it, so he could use his firearm.
I mean, that's a natural reaction.
I put a gun in your face.
Naturally, you're going to want to knock it down.
No, naturally, I'm like backing up.
But just think about it.
Naturally, you're going to want to knock the gun away.
Yeah, yeah, yeah.
You're not necessarily assaulting the police officer at that point.
You just want that gun out of your face.
The only time you should pull your taser is...
I don't think it's...
He didn't even give him an opportunity.
He did.
Was he like threatening another guy?
I don't know.
It was over a light bulb.
Said, do it or not, do it?
I don't know.
Yeah, I think this whole situation is nuts.
Yeah, I don't think that guy should be a police officer.
You're too high-strung.
That shit went to hell in a handbasket.
Like, that's crazy.
Let me suppose to de-escalate.
That was nuts.
Let me see these comments.
It's while the deputy engineering his own story while knowingly wearing a body cam.
Okay, they agree with us.
Yeah.
Yeah, hold on.
Let me read these.
I want to read a couple comments.
I like that comment.
He was engineering the own story on the body cam, but you could see it wasn't rational what he was doing.
Those are some.
Yeah, let me start over.
It's while the deputy is engineering his own story while knowingly wearing body cam.
Yeah, it didn't make sense.
It was irrational.
The policeman must be punished with the utmost rigor of the law because the video clearly shows an execution without the slightest chance of defending the victim.
Right.
Did that dumb really say sit him so I can talk to you?
Is he eight or something?
Does he not understand what a gun can do if you shoot a guy three times?
He isn't going to get up.
Yeah, it's like a disconnect.
Like, you've been on the force for 22 years?
Yeah.
And you don't have the wherewithal to understand what a bullet does to a human body?
Two of them?
Yeah.
And you didn't have to have an attitude because he couldn't sit up.
Yeah.
If this deputy isn't charged with unaliving, we have an evil problem in law enforcement.
Right.
Man, that was crazy.
And nobody's going to really talk about it because the victim's white.
If he's black, everybody be talking about it.
Oh, that's a good point.
Nobody cares.
Nobody cares.
Even white people are not going to care.
Especially the white people on the right.
There's no he doesn't.
This is egregious, Kevin.
Yeah, but man, we got some sickos on both sides.
You know, I don't think Kevin, the Republican voter, is not going to say this is.
I don't know.
Officer Tater might think that's Jessica.
Well, he might do a video though.
I'm going to be looking for it.
I'm thinking I don't think there's any justification for that.
I'm sure he'll find some justification.
He never assaulted anybody.
He never.
Well, he never came aggressively to anybody.
Yeah, never swung a punch.
All he was doing was deflect a gun out his face.
Yeah, I'm talking about before he even pulled the taser out.
No Reason to Pull It 00:00:47
Yeah.
There was no reason to pull it.
You got to combat him a little verbally, but nothing to warrant you pulling out of shooting him with tail.
I'll be interested to see what Officer Tatum being a former law enforcement officer.
But I think that's that's that's I don't want to live in a I don't want to live in a society where cops are that aggressive.
That's that's that's scary because you know a lot of times you're upset you do things that you don't accustomly do and then before you know it your life has been taken by overzealous police officer.
Yeah, this is all over a light bulb.
Yeah you hope the deputy is okay.
He shot a man who didn't need to be shot.
Right.
Yeah.
Crazy story.
Yeah.
That is nuts.
Yeah.
