[00:00:36] Are you threatening? [00:00:38] Do it or not do it. [00:00:39] Did you get clean up the lamp? [00:00:41] Come on. [00:00:43] Come on. [00:00:46] Go back to your go back to your apartment. [00:00:48] Do it. [00:00:50] Do it. [00:00:54] All right, that cop's an idiot. [00:00:55] Just because he tells you to do it doesn't mean you should do it. [00:00:59] You're the boss. [00:01:00] You're supposed to set the rule. [00:01:03] But you know what? [00:01:04] We laugh, but watch what happens next. [00:01:23] Come on. [00:01:24] He's backing up. [00:01:25] Come on, motherfucker. [00:01:26] Why are you trying to get away from me? [00:01:26] He pulled his paper because you were already trying to hit me. [00:01:30] I didn't try to hit you. [00:01:31] Yeah, you're moving up on me. [00:01:32] So now I'm bleeding. [00:01:34] I didn't see that. [00:01:34] I didn't see any of that. [00:01:36] I saw him backing up. [00:01:37] Yeah, I didn't. [00:01:38] You told him to go back to his abode. [00:01:40] That's what he's trying to do. [00:01:41] Well, you keep tasing him. [00:01:42] Well, I think he's backing up because he's shooting a taser at him. [00:01:45] Well, he's about to go in his house. [00:01:47] Yeah. [00:01:48] Now I'm bleeding, and you're doing all that. [00:01:50] Faith in Central. [00:01:51] Go ahead and send me back up. [00:01:52] Subject tried to attack me. [00:01:54] Got him at gunpoint right now. [00:01:56] That's crazy. [00:02:01] You need to get down on your knees. [00:02:03] I haven't done anything wrong. [00:02:05] Get on your knees. [00:02:06] Now, I haven't done anything wrong. [00:02:09] I need it there. [00:02:12] Shots fired. [00:02:13] Shots fired. [00:02:16] So he shot him three times after he tried to knock his weapon. [00:02:20] Yeah, yeah, yeah. [00:02:21] Yeah. [00:02:22] Oh, man. [00:02:25] Excuse me. [00:02:31] You can't come at me like that. [00:02:33] He didn't come up. [00:02:33] Sit back here. [00:02:36] Sit up so I can help you. [00:02:38] Sit up so I can help you. [00:02:40] Now you want to help him? [00:02:42] And he's got an attitude about it. [00:02:44] You just shot the man three times. [00:02:46] Yeah. [00:02:46] And you got an attitude because he can't sit up. [00:02:50] That's called mentally. [00:02:51] That's low capacity. [00:02:54] Why do you do that to me? [00:02:55] Sit up so I can. [00:02:58] The news covered it. [00:03:01] Walk away. [00:03:02] You need to get down on your knees. [00:03:04] I haven't done anything wrong. [00:03:05] Get on your knees. [00:03:06] Now. [00:03:08] Breaking news video of a Charlotte County deputy shooting a man to death. [00:03:13] Thank you for counting on Golf Coast News. [00:03:15] I'm Kelly Burns. [00:03:16] And I'm Peter Bush. [00:03:17] The deputy was responding to an argument over a painted light bulb. [00:03:24] I think the cop, when you respond to these disturbances, you got to keep in mind what you're responding to. [00:03:31] And the whole point in going there is to de-escalate this nonsense, but he escalated everything. [00:03:37] Yeah, yo, just call us minor dispute. [00:03:41] The intent is to calm everybody down. [00:03:44] Yeah. [00:03:44] He escalated the situation. [00:03:46] Yeah. [00:03:47] Gulf Coast News reporter Jackie Gunther has an exclusive interview with the neighbor who called for help. [00:03:52] She joins us live in Charlotte County. [00:03:57] The deputy tried to get a man to go back into his apartment, but he didn't listen. [00:04:01] And now we're seeing him get tased and shot. [00:04:06] So let's do it or not do it. [00:04:10] What are we gonna do? [00:04:11] What are you threatening? [00:04:12] Do it or not do it? [00:04:14] Are you threatening? [00:04:15] Do it or not do it. [00:04:17] You see Deputy Timothy Poole pull out his taser at a condo on Saxony Circle last month. [00:04:23] Daniel Birch tells him to tase him. [00:04:26] You can see Birch swatting at the taser, which does not phase him. [00:04:29] That is when the deputy draws the gun, calls for backup, and demands him to get on his knees. [00:04:35] Go ahead and send me back up. [00:04:36] Subject tried to attack me. [00:04:38] Got him at gunpoint right now. [00:04:40] You need to get down on your knees. [00:04:41] Birch gets closer and he also swats at the gun. [00:04:44] Shortly after, the deputy shoots three rounds with two hitting Birch. [00:04:49] We're freezing that part of the video. [00:04:51] Fired. [00:04:51] Shots fired. [00:04:52] You didn't come at me like that. [00:04:54] You can see immediately after the deputy gets medical aid to help Birch. [00:04:58] Sit up so I can help you. [00:05:01] Sit up so I can help you. [00:05:04] What did you do to me? [00:05:06] Sit up so I can help you. [00:05:06] Birch died the next day in the hospital. [00:05:09] This all started when neighbor Terry Beggs confronted Birch about a light bulb that was painted black. [00:05:14] He tells me despite his health struggles since the incident, he hopes the deputy and Birch's family are doing okay. [00:05:21] I hope the deputy's okay. [00:05:23] I really do. [00:05:24] I really do. [00:05:25] And I feel sorry for Dan. [00:05:27] I hope the deputy's okay. [00:05:32] Babe, I'm looking at this from a... [00:05:34] No, you're looking at it the right way. [00:05:36] You have the right perspective. [00:05:37] You're surrounded by crazy people. [00:05:39] Family, I really do. [00:05:41] I really do. [00:05:43] I'll get over the mental stuff and the shakiness. [00:05:49] Hopefully. [00:05:52] But I'm more concerned about them. [00:05:57] They've been through more than I have. [00:06:03] As for Deputy Poole, he has served with CCSO for 22 years and he is currently on administrative paid leave as proto. [00:06:11] He's not even a rookie. [00:06:12] He's been doing this for 22 years and he's on paid leave. === The Unnecessary Use of Force (04:05) === [00:06:16] Like, he's got the police union. [00:06:17] They protect the, but he did not have to ask, escalate it to something physical. [00:06:22] He didn't have to. [00:06:23] Yeah, he should have gave him an opportunity to leave. [00:06:26] Go back to your apartment. [00:06:28] I mean, it's going to be some back and forth, but give him an opportunity to leave peacefully. [00:06:32] You pull out his taser. [00:06:33] You didn't have to use it right away like that. [00:06:36] You could have used a little restraint and then you went straight to the firearm. [00:06:41] Yeah, it's nuts. [00:06:42] And he's already at his apartment. [00:06:43] He's on his right in front of his. [00:06:44] Yeah, I don't know who he's calling. [00:06:46] Maybe he's calling for the cop. [00:06:48] I don't know. [00:06:48] And that guy who lost his life, he had no idea that that cop was going to shoot him. [00:06:53] Yeah. [00:06:53] Because, you know, the rational thing, he was probably thinking rationally, he's not going to shoot me. [00:07:02] I'm out here in shorts. [00:07:03] I have no weapons. [00:07:04] I'm walking away. [00:07:05] Yeah, I knocked his taser away, but the cop pursued him. [00:07:10] Yeah, the cop kept coming forward and putting it in his face. [00:07:13] It's like the cop wanted him to do something so he could use it. [00:07:16] But the guy never did do anything that would justify him. [00:07:19] He swatted it out of his face. [00:07:20] With the gun? [00:07:21] To swat the gun out of his face? [00:07:23] That's a threat. [00:07:24] Yeah, you shouldn't even do that. [00:07:25] That's crazy. [00:07:25] Yeah, I think he put it in his face so he could swat it, so he could use his firearm. [00:07:29] I mean, that's a natural reaction. [00:07:31] I put a gun in your face. [00:07:32] Naturally, you're going to want to knock it down. [00:07:33] No, naturally, I'm like backing up. [00:07:35] But just think about it. [00:07:37] Naturally, you're going to want to knock the gun away. [00:07:39] Yeah, yeah, yeah. [00:07:40] You're not necessarily assaulting the police officer at that point. [00:07:43] You just want that gun out of your face. [00:07:45] The only time you should pull your taser is... [00:07:48] I don't think it's... [00:07:50] He didn't even give him an opportunity. [00:07:51] He did. [00:07:51] Was he like threatening another guy? [00:07:54] I don't know. [00:07:55] It was over a light bulb. [00:07:56] Said, do it or not, do it? [00:07:58] I don't know. [00:07:59] Yeah, I think this whole situation is nuts. [00:08:02] Yeah, I don't think that guy should be a police officer. [00:08:06] You're too high-strung. [00:08:07] That shit went to hell in a handbasket. [00:08:12] Like, that's crazy. [00:08:13] Let me suppose to de-escalate. [00:08:15] That was nuts. [00:08:16] Let me see these comments. [00:08:18] It's while the deputy engineering his own story while knowingly wearing a body cam. [00:08:22] Okay, they agree with us. [00:08:23] Yeah. [00:08:24] Yeah, hold on. [00:08:24] Let me read these. [00:08:25] I want to read a couple comments. [00:08:26] I like that comment. [00:08:27] He was engineering the own story on the body cam, but you could see it wasn't rational what he was doing. [00:08:33] Those are some. [00:08:34] Yeah, let me start over. [00:08:35] It's while the deputy is engineering his own story while knowingly wearing body cam. [00:08:39] Yeah, it didn't make sense. [00:08:40] It was irrational. [00:08:41] The policeman must be punished with the utmost rigor of the law because the video clearly shows an execution without the slightest chance of defending the victim. [00:08:49] Right. [00:08:51] Did that dumb really say sit him so I can talk to you? [00:08:57] Is he eight or something? [00:08:58] Does he not understand what a gun can do if you shoot a guy three times? [00:09:02] He isn't going to get up. [00:09:04] Yeah, it's like a disconnect. [00:09:05] Like, you've been on the force for 22 years? [00:09:08] Yeah. [00:09:08] And you don't have the wherewithal to understand what a bullet does to a human body? [00:09:12] Two of them? [00:09:13] Yeah. [00:09:13] And you didn't have to have an attitude because he couldn't sit up. [00:09:16] Yeah. [00:09:16] If this deputy isn't charged with unaliving, we have an evil problem in law enforcement. [00:09:22] Right. [00:09:24] Man, that was crazy. [00:09:26] And nobody's going to really talk about it because the victim's white. [00:09:29] If he's black, everybody be talking about it. [00:09:32] Oh, that's a good point. [00:09:33] Nobody cares. [00:09:34] Nobody cares. [00:09:35] Even white people are not going to care. [00:09:37] Especially the white people on the right. [00:09:40] There's no he doesn't. [00:09:41] This is egregious, Kevin. [00:09:43] Yeah, but man, we got some sickos on both sides. [00:09:49] You know, I don't think Kevin, the Republican voter, is not going to say this is. [00:09:54] I don't know. [00:09:55] Officer Tater might think that's Jessica. [00:09:59] Well, he might do a video though. [00:10:01] I'm going to be looking for it. [00:10:02] I'm thinking I don't think there's any justification for that. [00:10:06] I'm sure he'll find some justification. [00:10:07] He never assaulted anybody. [00:10:09] He never. [00:10:09] Well, he never came aggressively to anybody. [00:10:13] Yeah, never swung a punch. [00:10:15] All he was doing was deflect a gun out his face. [00:10:17] Yeah, I'm talking about before he even pulled the taser out. === No Reason to Pull It (00:47) === [00:10:21] Yeah. [00:10:21] There was no reason to pull it. [00:10:23] You got to combat him a little verbally, but nothing to warrant you pulling out of shooting him with tail. [00:10:30] I'll be interested to see what Officer Tatum being a former law enforcement officer. [00:10:37] But I think that's that's that's I don't want to live in a I don't want to live in a society where cops are that aggressive. [00:10:44] That's that's that's scary because you know a lot of times you're upset you do things that you don't accustomly do and then before you know it your life has been taken by overzealous police officer. [00:10:56] Yeah, this is all over a light bulb. [00:10:59] Yeah you hope the deputy is okay. [00:11:02] He shot a man who didn't need to be shot. [00:11:05] Right. [00:11:05] Yeah. [00:11:06] Crazy story. [00:11:07] Yeah. [00:11:07] That is nuts. [00:11:08] Yeah.
