♪♪♪ Merrick Garland, Lisa Monaco, the entire Justice Department, they're not going to shut up Trump, they're not going to shut up Navarro, they're not going to shut up Bannon, and they're certainly not going to shut up MAGA.
If you look right here, you reporters, in the two and a half or three years we've been here, look at the rise of MAGA, look at the rise of Donald Trump.
If the election was held today, according to Harry Enten over at CNN, President Trump would win in a landslide.
All of this, besides the major legal issues that have to be addressed, all of this is about one thing.
This is about shutting down the MAGA movement, shutting down grassroots conservatives, shutting down President Trump.
Not only are we winning, we are going to prevail, and every number and every poll shows that.
There's nothing that can shut me up and nothing that will shut me up.
me up. There's not a prison, there's not a prison, there's not a prison built, there's
not a prison built or a jail built that will ever shut me up. All victory to MAGA.
We're going to win this.
We're going to win at the Supreme Court.
And more importantly, we're going to win on November 5th in an amazing landslide with the Senate, the House, and also Donald J. Trump back as President of the United States.

They call him the honey badger for a reason.
That was my former colleague at Breitbart, my immediate boss in the White House, chief strategist to the President of the United States, the man who brought him from 16 points behind in 2016 to win the election against Hillary Clinton.
Today, a judge ordered Stephen K. Bannon to report to prison on July the 1st for a four-month sentence for contempt of Congress, which means he will be incarcerated for the duration of the election.
Hard to imagine a better guest to react to all of that.
So much to discuss.
We're going to have him on for two full segments.
No monologue to open the show today, because we don't have the time.
Florida's very own firebrand, Congressman Matt Gaetz.
Welcome back to America First.
Well, thanks so much for having me, Seb.
But we are seeing something in our country right now that is the death of the legal system, the death of the justice system.
And it's infuriating.
And it's also very sad to me personally.
I've given my life to the law.
I've studied the law.
I've practiced law.
I've made law.
And now to see the world look at America not as a stable system of fairness, but as a system where if you challenge the regime, it will manufacture a basis to deprive you of your liberty.
Let's think about what actually happened with Steve Bannon.
Congress had a runaway committee.
A committee established outside of even the resolution authorizing it, because the resolution authorizing it demanded a minority-ranking member, chosen by the minority party, like every other committee in the entire United States Congress.
And yet this committee broke bad.
It went rogue.
And in doing so, engaged in the type of conduct that we really haven't seen from other legislative bodies.
had an obligation according to his lawyer and keep in mind Stephen Bannon is not a lawyer
and his lawyer tells him that President Trump has raised executive privilege and as a matter of law
you cannot go testify until the judge or or some other tribunal releases you from that
executive privilege obligation and so this Meaning, let's make it clear for those who don't understand the law, executive privilege because he worked for the president who enjoys executive privilege.
Great point.
Executive privilege was not a claim asserted by Steve Bannon.
It was asserted by Donald Trump and it found Steve Bannon.
And so in criminal law, there is a requirement In any criminal law, that you know you're breaking the law, that you have an intent to commit an illegal act.
If you believe that you are allowing the legal process to answer a question that has never before been answered, then that's never a basis to go lock somebody up.
And yet here I think the timing is performative.
And look, you know, there is a lot of Brownswell right now for Trump.
We are seeing the polling numbers, if you can believe it, even getting better in some of these swing states.
And even Bannon is one of the people we rely upon to marshal intellectual energy, political energy, financial energy for the campaign.
And so, you know, they haven't been able to lame Donald Trump in any way.
Despite these crazy efforts, and so now they're trying to deprive Trump of even access to the people like a Peter Navarro, like a Stephen Bannon, maybe even like a Walt Nata, a patriotic American who served in our Marine Corps, who's now the subject of criminal process.
You see, that is how they're trying to use this, and I believe that Congress ought to immediately step in and define election interference as a feature of criminal law. It's never been done before,
so we've never had to write those laws before. But I think we actually have to go into the
statutes and say, if you're using criminal law in this way against a candidate for federal office, you
are engaged in election interference, and we have a federal basis to stop you from doing so.

So much to discuss, but I've got to, you know, pull out a little bit, open the aperture here.
This isn't about Steve.
It's not even just about President Trump or election interference.
Can we look at the broader phenomena?
When we have three associates of President Trump who have been charged in Wisconsin a few days ago, when we see what's happening to President Trump's lawyers, not just his valet, and when we see, for example, a 75-year-old grandmother get a custodial sentence on Tuesday because she prayed at a Planned Parenthood abortion clinic.
Matt, this is about anybody who disagrees with the Democrat Party and their ideology, is it not?
No, they have invested a tremendous amount of time and political resources into getting these Soros DAs in office, into having people who are involved in, whether it's the election infrastructure, the judicial infrastructure, the prosecutorial infrastructure, they have seized those institutions and they have converted them from What were at times vaulted institutions in American life to now just very diminished tools of politics.
And the problem is, if we just complain about it and don't take some action to constrain that authority and constrain the real tyrannical approach that's been taken, then I fear, like you say, we're all at risk of losing some degree of liberty.
I mean, if they would have been successful at getting Trump off the ballot, What they're really trying to do is attack your option in selecting your own leader.
And in getting Bannon off the board and behind bars, they're trying to make the intellectual apparatus, the people who are out there in the Republican Executive Committee, knocking the doors, making the calls, they're trying to make those folks, I think, demoralized with the incarceration of Bannon.
But I think just like The phony felony prosecution in New York backfired.
I actually think this is going to backfire, too.

That we immediately advance our election interference defense, and that relates to the Trump prosecutions, the Bannon prosecutions.
We immediately do that.
That we cure any perceived contempt of the Congress by declaring the actions of the January 6th Committee invalid.
We can do that without the Senate.
We can do that without the White House.
We can do that right now to save Steve Bannon.

They know that the federal system is completely separate and distinct from a local prosecutor's office like that in Manhattan.
You know, Matt Gaetz, for his own part, Now, I know you guys enjoy this kind of Teflon-coated Kevlar immunity when you're talking on the floor of Congress, but he wasn't there.
He was on Anderson Cooper's show on CNN.

Listen, we've seen the justice system so tortured.
I don't know if I want to interact with it any more than necessary.
I can tell you that, you know, Adam Schiff saw Merrick Garland squirm when asked basic questions about whether or not he would produce his correspondence with... Oh, stop, stop, stop, stop, stop, stop, stop.

I know he's not an impressive person.
He's the meat puppy for the real Attorney General Lisa Monaco, but Congressman Gates, why can't Merrick Garland answer the question about communications between DOJ and Bragg's office in Manhattan?
It seems pretty straightforward.
I guess that's why Adam Schiff was so hot under the collar wanting to criticize me because It's just basic questions, and Merrick Garland only feeds into people's concern about political capture at the Justice Department when he's so opaque about this.
If they were independent, he would have just said, look, Mr. Gates, they're independent officers.
We haven't communicated with them.
Whatever they've done, they've done of their own volition.
If he'd have said that, we'd have moved on to another question.
You know what?
There is an arrogance that they can sit there and provide these non-responses.
And you know where I think that arrogance comes from?
The fact that we still fund them.
Because they sit there and they give us these nonsense responses.
And then we just turn around and say, okay, well, gosh, we didn't want to shut the government down, so here's all the money you need, FBI, DOJ.
Hang on, stop it.
This is a facet.
This is really important, because you're the guy in the trenches.
We've been told by, you know, leadership, Republican leadership, oh, well, we can't, you know, just slice off Jack Smith's budget or the DOJ-FBI budget.
We've got these omnibus continuing resolutions, and it's just impossible.
So that's Bravo Sierra, Congressman?
Why is that impossible?
Why not just say, look, here's the deal.
We're not going to fund this stuff anymore.
And if you all, the Democrats and Joe Biden, are willing to shut down the entire government because you want to continue with this activity that like two-thirds of the country sees is just brazenly political, then that'll be on them.
Can you imagine how bad Joe Biden will look if people only get their social security checks because he's so busy trying to jail his political opponents?
That's how you use leverage, but the problem is we have too many Republicans who are gutless, and that is why these primary elections are so important.
We need fighters.
We need people who will really see the problem for what it is.
America is in a state of grave decline right now, and I take no joy in saying that, but we have to recognize it, and we have to reverse that decline, and I think it starts with trying to restore Article 3 courts and our justice system as something that is non-biased, not something that is weaponized against people Joe Biden doesn't like.
All right, so here's the big question.
You know, you are one of the handful of fighters.
You're talking to about three and a half million people, you know, much bigger than most TV shows.
What is your message to those who believe in America?
What should they be doing for the next five months?
Well, there are more of us than there are of the America last people.
That's the good news.
And so, we have to organize.
We have to coordinate.
Remember, it was Steve Bannon who said, show up to your local Republican executive committee.
If there's an empty position, fill it.
If there's a leadership opportunity, run for it.
We have to do more than just complain.
We have to get back to seizing the institutions that used to be really vaulted in America so that we can reconvert them To their original purpose of serving the nation, not serving the whims of a dying regime.
And if people do that, I do believe we will be on the march.
You look at what's going on with working class people in the politics, we've mostly been talking policy, but if you just look at the polling right now, working class, African Americans, Hispanics, people of all kinds are realigning around our ideas.
Because they're tired of being embarrassed globally, they're tired of being in all these wars, they're tired of the borders being open, streets being unsafe, while Joe Biden tries to tell you that the third grade teacher gets to pick the gender of your kid.
Nobody wants that world, and that's why people are coming our way.

No, there is a very clear distinction between what we are doing and what they have done in weaponizing the judicial system.
They're undermining the people's faith in our institutions, our system of justice itself.
What we're doing, Neil, is the opposite.

I would have had you for like this, you know, triple A, straight lay student because I've never had a guest, especially at your seniority in politics, who I meet once in person and has been as conscientious as you have in the last week saying, Yes, I'd like to come back on the show.
I'm traveling on these days and constantly just, you know, making sure it happens, not leaving it up to your bookers, not leaving it up to my team, but actually texting me.
So I like the cut of your gypsum.
So we need more like you in politics nationally, not just in Texas, although I think Texas is going to protect you and keep you there as long as they can.
So let's return to the subject of the day we met.
Let's return to the...
Seeming, the seeming obvious scenario that three days before the GOP convention in Milwaukee, President Trump will probably be put in prison or under house arrest, and I don't say that lightly because Steve Bannon will be put in jail, or prison rather, On July the 1st for the four remaining months of this federal election.
So can you, as an eyewitness to all of this, as somebody who had to deal with the insanity of what occurred to Ken Paxton in Texas as well, what's happening to America, Lieutenant Governor?
Well, if you believe in reading prophecy, a lot of what's happening has been said in the Bible thousands of years ago.
We have families turning on families.
We have a nation, some of the nation, turning its back on Israel, God's chosen people.
So I could go biblically to what is happening.
I can also go to historically what is happening, and that is we are at a time When many empires of about 250 years or so start to decline, and they decline because there's too many not working and contributing.
There's a lack of order and discipline in society, a lack of following the rules, following being disciplined, and a lack of leadership.
So if you combine all of that, Sebastian, we are at a point in America where we have the worst leadership in the White House we have ever had.
There's no question about that.
Even the backup player, the backup quarterback.
Kamala Harris is worse than the starting quarterback.
And then you have a nation where there are no laws anymore.
I mean, you have the mayor of Boston saying that if you steal up to $1,000, you shouldn't be arrested.
That's been said by Soros AGs all over the, or district attorneys all over the country.
So when you don't stop the lowest crime, a lot of crime is committed, ransacking stores, stealing what you want, because there's no accountability.
When there's no accountability to that crime, Commit a bigger crime.
There's no accountability to following the rules to government.
And that is led in large part by the Democrats who have no accountability to the Constitution.
So we're at that 250-year mark where a lot of empires have failed.
And you need in that situation, Sebastian, where there's no law and order, no justice system, where the military is weakened by leadership, you need a strong person to save the country and the Constitution.
And that's Donald Trump.
And no one will stop him.
And he will be the next president, no matter what they try to do to him in the next five months.
Now, I don't want to talk party politics, I want to talk the state of America for a second, because I sit in this studio three hours a day, I do my Newsmax show on Sundays, and I get out and about a little bit.
I meet listeners, I go to events with our listeners, I'll be at the convention in Milwaukee, I'll be at the first debate with President Trump.
But you probably have a much better sense.
You just got back from a visit to a rural Texas.
Are you seeing any trends that should make us feel good?
Are people saying, okay, I want America back.
I want Texas to be safe.
Tell us what you're seeing as you travel the nation and the state.
Yeah, it's clear that, you know, I said to one of the Trump sons, I won't mention which one, but several months ago, they said, well, how do you think dad's doing?
We were doing an event together in the panhandle of Texas.
And I said, well, the first time we ran in 16, Christians weren't All of those groups are now all convinced because he did everything he said he would do.
members of corporate boards weren't really convinced that he would be a
great leader for corporations, conservatives weren't convinced he was
that conservative, pro-lifers weren't convinced he was that pro-life. Well all
of those groups are now all convinced because he did everything he said he
would do. So the first of all you don't have as many doubters you had. Secondly
there's a fairness.
Winston Churchill said it takes a while for America to get to the right decision, but Americans usually get there.
Americans are getting to the right decision.
And then you add this trial and all these other attacks on him.
There's a fairness that all Americans feel, Sebastian.
And Americans know he is being mistreated.
And what they're doing to him is wrong.
And so this trial, it's already in the rearview mirror, by the way.
You know, news stories only have so much of a cycle.
His trial in New York, that's already in the rearview mirror.
And then you get down to the bottom line, Sebastian.
Elections come down to local politics.
And local politics are not good in any state.
And it comes down to your wallet.
And no one's wallet's in good shape unless you're a member of the super-rich.
So all of those things add up together.
I agree with what Steve Bannon said.
This will be a landslide in November.
Wow.
And then, God willing, if that happens, if we do our part, how hard is somebody in your position In Texas.
How hard do you think it's going to be just to simply restore the faith of the American people in our justice system?
That will be a test.
That will be a test.
One of the things we have got to work really hard in our inner cities where we have lots of crime and lots of George Soros DAs.
We have to look at laws like Florida has passed and we've looked at in Texas to where if a DA is not prosecuting people as following the law, the state law, so we have to see about how we address that, remove them, to be sure we have a justice system that Arrest the criminals that need to be arrested, and judges don't let them out on the street like they do in blue cities and blue counties all over the country and blue states.
And part of that, Sebastian, I'll be honest with you, I don't like the idea that there's judge shopping.
You know, there's this sense that, well, if there's a Republican judge, well, it's going to end up this way.
Or a Democrat judge.
That's not good for anyone.
It should be, we should elect judges or appoint judges.
We elect them in Texas.
We should have those judges who follow the Constitution and the law.
That's what we need.
And it shouldn't be partisan.
You shouldn't walk into any courtroom feeling like you're going to lose because of the judges or the jury or you're going to win.
So that's going to take time.
I thought what Donald Trump said, President Trump said yesterday on Hannity was very good.
First of all, revenge is to be a successful president.
Yes.
Which he will be.
We know he will be.
But secondly, he even said, you know, I didn't feel right about going after Hillary Clinton.
I know.
For all those crowds who... That's powerful.
It's just not the right thing to do.
You have great faith in November the 5th.

I texted to Steve, Steve Bannon, in the last hour that it's not lost on patriots that the
order from a deep state judge that he report to prison occurs on the 80th anniversary of
He comes from a proud military family.
His children served.
He served eight years in the Navy.
And as we remember what happened 80 years ago on D-Day, We understand the message the left is sending.
We will remember what happened that day in the biggest amphibious combined arms operation in history, which was about one thing, saving Western civilization.
The threat is no less today.
It's not from an external enemy.
It's not from an international Reich.
It's from those inside our country that hate America and are shredding the Constitution every single day.
Forty years ago today, one of our greatest presidents gave the following speech in Normandy.
At dawn on the morning of the 6th of June, 1944, 225 Rangers jumped off the British landing craft and ran to the bottom of these cliffs.
Their mission was one of the most difficult and daring of the invasion.
to climb these sheer and desolate cliffs and take out the enemy guns.
The Allies had been told that some of the mightiest of these guns were here, and they would be trained on the beaches to stop the Allied advance.
The Rangers looked up and saw the enemy soldiers at the edge of the cliffs shooting down at them with machine guns and throwing grenades, and the American Rangers began to climb.
They shot rope ladders over the face of these cliffs and began to pull themselves up.
When one ranger fell, another would take his place.
When one rope was cut, a ranger would grab another and begin his climb again.
They climbed, shot back, and held their footing.
Soon, one by one, the rangers pulled themselves over the top, and in seizing the firm land at the top of these cliffs, they began to seize back the continent of Europe.
Two hundred and twenty-five came here.
After two days of fighting, only 90 could still bear arms.
Behind me is a memorial that symbolizes the Ranger daggers that were thrust into the top of these cliffs.
And before me are the men who put them there.
These are the boys of Puento Ho.
These are the men who took the cliffs.
These are the champions who helped free a continent.
These are the heroes who helped end a war.
Gentlemen, I look at you and I think of the words of Stephen Spender's poem.
You are men who in your, quote, lives fought for life and left the vivid air signed with your honor.
I think of just the reality Of that day.
Those landing craft.
Those thin aluminum landing craft.
With the GIs packed in like sardines.
And somebody had to be at the front of that landing craft.
The first row.
The people who exited first as the ramp was dropped.
Just the sheer idea that you're going to be the first person that a bead is drawn upon by the entrenched German troops 90 feet up with their MG42 Hitler zipper fully automatic squad serviced machine guns.
And they didn't.
They didn't say, well, I'm going to wait.
You guys go first.
Or hide in the back of the troop carrier.
No.
They prepared their weapon.
They made sure it was ready.
And they launched into the abyss.
Why?
Why did they do that?
Blindly following orders or because of some imperial ideology about living space like Hitler said for his soldiers?
Lebensraum?
No.
Because of one thing.
The need to crush evil.
That's why after the 12 million G.I.s came home, those who survived after World War II, how many chewed on the barrel of a 1911?
How many shot themselves?
How many committed suicide?
Not the 22 a day we saw after 9-11 and the wars in Iraq and Afghanistan.
Why?
They saw things as horrific.
Normandy beaches, Battle of the Bulge, Iwo Jima, the death camps?
Here's my theory.
Because Eisenhower, and every commander beneath them, and the Commander-in-Chief in the White House, was explicit.
You, gentlemen, are doing the Lord's work.
You are killing evil.
When you know you are on the side of the angels, whatever you can see, it's just a little bit easier to deal with.
We have an enemy that is evil, and now they're inside the wire.

I think you've spent a few days in your life in a courtroom, not as a defendant.
So, could you comment on Jeffrey Toobout and his scurrilous critique of Judge Cannon from Florida?
Well, look, if I go to Jeffrey Toobin for advice, I guess it would have to be on public onanism, because he doesn't know a damn thing about federal court.
You're using really big words.
Don't look up that word.
Do not.
Listeners, do not.
It's in the Bible!
Well, yeah, lots of things are in the Bible that may not be FCC compliant, but carry on.
Well, look, federal judges are confirmed by the Senate.
They have a lifetime appointment, and they run their courtrooms.
Any way they damn well please.
And every judge has different rules.
Every judge does things differently.
Here we have a claim by a litigant that the special prosecutor has been unconstitutionally appointed.
Whether you agree with that or disagree with that, whether you like Donald Trump or not, that is a legitimate question and it is a big and important one.
And she's taking expert testimony from both sides.
She has critics of the special prosecutor appointment and supporters of it coming in to give her testimony.
I think that is a perfectly reasonable thing to do.
It is Certainly not unprecedented.
It is certainly within the range of normality.
In fact, I watch her case carefully.
She handles this case like any other federal judge would handle theirs.
She refuses to be ruled.
She tells the litigants exactly what she expects, and she expects them to do it, and she holds them to it.
And I understand that The Democrats want judges that will essentially frame the president.
We know that.
We've seen that happen.
That's what they want.
And the fact that she won't give it to them enrages them.
It's not unusual.
She's doing exactly what she should do.
Let's listen to what they're saying about the man who's in the dark.
This is the man who is most responsible for the theft of the last election, Mark Elias on MSNBC, who I guess he's got the new talking points for the DNC.

So as we prepare for 2024, Donald Trump is plotting his next crime.
We may not know sitting here right now what that crime will be, but we know it will involve subverting the outcome of the election.
We know it will involve election interference.
We know it will involve efforts to prevent the will of the voters from having its day.
What do I think it'll focus on?
I think that it's going to focus on the certification process and the vote counting process.
That is where so much of their attention, so much of their ire, so much of their bile and frankly where they have anchored the big lie and election denialism since 2020 has been on that fulcrum of between the moment the ballot is cast and the moment it is counted.
We saw it with fake electors but we also saw it in the efforts to prevent Uh, counties from correctly certifying election results and the putting of election deniers in office to refuse to certify elections in 2024.
And I think that is what we all need to be prepared for.
We all need to be prepared to fight against.
So President Trump's gonna steal the election and you posted this image.
I didn't think it was real when you posted it from the Biden-Harris campaign yesterday.
The title is Donald Trump confirms plans to jail opponents.
Have you heard of this guy called Steve Bannon, Kurt?

Apparently he's going to be a guest to the federal government for a while in yet another selective prosecution.
You know, that stack of pardons on January 20th is going to be perilously high.
Yeah, he's going to need the auto pen.
He's going to need the presidential auto pen for all those signatures.
And as for Mark Elias, I guess I understand why he goes to one of these garbage cable outlets, because he's getting a better reception there than he is from the federal court, where he's getting his rear kicked on a regular basis as the courts throw out his garbage theories.

How does that happen in America, of all countries?
The one that is a beacon, or should be for others.
The one that Ronald Reagan called the shining city on a hill.
To which, that we know of, at least 8 million people from other nations have flocked to in the last three and a half years.
The leader of the opposition is under a gang order.
He's facing more than 730 years in prison.
And he is the man that the left wants to destroy.
But sadly, it's not just political.
It's also governmental.
It's bureaucratic.
When I joined the Trump administration, I didn't use the phrase deep state.
I thought it was, well, just a little bit excessive.
But within a matter of days, I saw it from the inside.
What can be done about it?
Can we restore transparency, responsibility, accountability in government?
This is a very special issue of America First 101 with somebody Well, if anybody has some ideas about what needs to be done if the Republic is restored on November the 5th, then it is the Executive Director of the Oversight Project at the most important conservative think tank NGO in the nation.
It is the Heritage Foundation, and he is Mike Howell.
Mike, welcome back in studio.
Thank you for having me.
Can we start, I told you at the beginning, I want to walk our listeners through a 101 all the way up to like grad school, PhD level of how things should work.
In government, what reinstituting rule of law should look like equality before the law.
So let's start with the fact that we're conservatives.
You're not here to do politics, but we have allegedly a conservative house, or at least under the leadership of Mike Johnson.
You've worked on Capitol Hill.
What are the powers, for example, of the lower chamber of Congress in terms of, well, let's use the word for your entity, oversight?
Because we have a leader of the opposition who's being targeted by the Department of Justice, by local prosecutors.
What kinds of things could Congress do to re-instill faith in the American judicial system?
Right, so the sleeping powers that Congress have are absolutely awesome.
It is the primary branch of a government, the first in the Constitution, for a reason.
Okay?
Over time, Congress has absolutely atrophied.
We've seen the rise in executive power and judicial power and congressional power shrinking.
So the way this system was designed, that their ultimate power would be, obviously, is the power to fund or not fund something.
The power of the purse.
Power of the purse.
And we've settled into this new environment where we live from CR and big government omnibus Christmas tree package that everyone has to vote on every single cycle.
So the legislative branch is truly not legislating at all anymore.
It's just rinse and repeat, add on some new toys, add on funding for whatever the current foreign war is.
So, ultimately, the way this worked before is that if Congress wanted information out of the executive or for them to change tactics, they would alter the funding.
And this would routinely happen because you'd have a vigorous appropriation cycle, you'd have members that were actually involved in the day-to-day mechanics, tracking funding mechanisms, and they would adjust accounts accordingly.
And therefore, the threats that they could, you know, put on the executive branch would be taken seriously.
Now, they don't do that.
In fact, even with a Republican majority that we've had the last year and a half, the weaponization has only increased.
In fact, it's worse than it was when Democrats were in charge of the House.
And that's primarily because... I want to repeat that for our listeners.
Under Republican leadership of the House, the entity which has the power of the purse, which is absolutely gargantuan in terms of power, because government can't do anything meaningful without money, the weaponization, the perversion of federal powers, the DOJ, the FBI, has actually increased under their control?
Absolutely.
Look no further than, you know, Trump's conviction in New York in that kangaroo court that is basically orchestrated by Joe Biden.
Look at all the other prosecutions that have picked up pace.
The extremes they've gone to are further than they did under the Democrats.
And that is partially and primarily because they don't need the House for anything anymore.
They've given them the kitchen sink.
They funded all these prosecutions.
So we've been told again and again and again by putative leaders of the conservative movement in the house that we can't affect the funding, we can't do anything about the funding.
Now is that a lie or is that because we have these abortion-like omnibus funding measures which means that everything is agreed for in one big pile and therefore they can't say, hey Merrick Garland at Justice, Jack Smith is now defunded because Jack Smith is a hack.
Is it real?
Is there a real excuse?
Or is this just boilerplate?
It's one of the biggest lies that are told in all of politics.
And what makes it worse is a lot of the same members that end up voting for these things and proceeding, you know, off this cliff, are the same members who will come on your show, other shows, or anywhere they, you know... Place your camera.
To say, America first, and we're going to save this country and condemn what's happening to President Trump.
No, they funded it.
And what really makes me sick is after this kangaroo court and the verdict that came down, the best, a lot of the biggest fighters on Capitol Hill could do was recommend that, hey, maybe the next funding cycle we'll defund some of these.
That's September 30th.
President Trump could be in prison by then.
And so they're pointing to a future thing.
But that's the awesome power.
There's a lot more that I'd like to get into, if it's okay.
Oh, totally, totally.
But let me just ask you, because it's news, you said somebody else has added themselves to the list.
This was, I think, three days ago, two days ago, a letter from a coterie, a handful of senators.
Mike Lee is one of them.
We have Turbeville.
We love Marsha Blackburn.
Josh Hawley, Joni Ernst, and others.
J.D.
Vance, Marco Rubio, Rick Scott, Ron Johnson, Hussein.
Basically, they're on strike in the Senate.
They're not going to assist the incumbent executive and the Democrats with anything because of the weaponization against the president.
Does this mean anything, Mike?
It absolutely does.
This president does not deserve a function in Congress that'll sit there and play patty cake for nominations like it's peacetime.
The president, you know, right now, Joe Biden, has declared war on this country from the inside by arresting and ordering the arrest.
And this is, you know, beyond Provable, at this point, that the White House orchestrated the political persecution of Trump, not only in New York, but in Georgia or elsewhere.
And so, absolutely, we should not be having regular hearings and confirmations, nominations.
And what really shocked a lot of people is, yesterday, seven Republican senators voted for a D.C.
judge in support of Joe Biden's D.C.
judge.
You know, this is the first legislative action after arresting President Trump.
So Republicans confirming another hatchet man or woman for the Democrats in D.C.
Correct, correct.
And what blows my mind, it's not even like this is a Rhodes Scholar.
This was a mid-level worker for the D.C.
government here, and they're just putting her on the bench for life.
Does she know what a woman is?
Can she define a woman?
I seriously doubt it.
She worked in the child services there.
She's becoming a judge?
A judge in D.C.
You jaywalk, well they don't charge for that anymore around here, but you do something in DC, you'll be seeing her soon.
And then the other thing that we hear about all the time is criminal referrals and subpoenas.
We've got this news that broke yesterday, this is from the Daily Caller, that the House Republicans have referred two members of the Biden family, Hunter and James Biden, It's true.
And it also was referred to David Weiss, who's the special prosecutor for Hunter Biden, who's prosecuting him only for a gun crime as opposed to running an international pay-to-play business with his father as a product.
So the joke's already in on that Weiss prosecution.
So it goes to them for a decision as to whether to proceed.
At its best, you know, David Weiss on a, I don't think this will happen, but he'll take it up, right?
That's the best case scenario.
The most practical outcome here is it's just another example of the dual standard in the weaponization of government.

Mike, you said you want to introduce us to some other things Congress has in their power to do to kind of begin some restoration of the justice system.
One of them concerned the Master at Arms, but walk us through a menu of things that aren't creative, don't have to be cut from whole cloth, but exist in writing right now and can be done.
So the first thing is always think of the enforcement side of things.
We're used to letters being sent and the conservative movement right wing, whatever you want to call it, has settled into applauding the announcement of the process.
Member sends a letter, goes on cable news, congratulated on cable news, tweets it out, has a hearing, has a clip, tweets it out, matter closed.
That is not the way things should work.
What we care about is the enforcement of consequences and the obtaining of information.
And so to do that, you have to litigate.
You need a very litigious house to go out and enforce their subpoenas.
You mean like the Democrats did with the illegal January 6th committee?
Like they did.
And they cost many people who broke no law besides working in the White House that day in the eyes of the law.
Like Peter Navarro?
Correct.
Who right now is sitting in a federal prison.
Correct.
And you know, I was unfortunate enough to represent, so I was fortunate to represent a friend, but unfortunate to be across from those evildoers on the January 6th committee, and they put those people through absolute hell.
And this class of Republicans on Capitol Hill hasn't even been willing to approach that type of conflict.
So let's get this mentally correct, because And I made this sin as well, committed this sin as a lame man who's never worked in Congress, that we think, oh, these are legislators and they talk on the floor, then they can propose a bill, get some co-sponsors and maybe turn it into an actual law eventually.
But you're talking about legal action using external legal professionals, correct?
Correct.
So give us an example of, you know, if Jim Jordan wants to have consequences for the abrogation of the U.S.
Constitution with regards to January 6th, President Trump, Peter Navarro, innocent Americans who, you know, we heard sworn testimony on the floor from the FBI, 250,000 warrantless searches of U.S.
citizens because You know, they bought a MAGA hat online, therefore they were put on some secret list of threats to America.
So, walk us through who would do this, who would they hire, and what action would they take?
So, there's two main types of activity.
The first is using civil contempt.
So, there's two types of the household viewing contempt.
One is criminal.
It goes over to the Attorney General.
Right now, that's obviously Merrick Garland.
He's not going to prosecute himself.
He's there to save the Bidens from prosecution.
The other option is civil contempt, which means you take it to a judge.
And the judge then decides whether you're in compliance with the subpoena or not.
If the judge decides you're not, it forces you to turn over the documents.
You don't turn over the documents, the judge can then impose consequences on you.
So we want to know, for example, what the communications were between the January 6th committee and the White House.
This works best outside the federal government context, but essentially, yes.
Oh, what about Fannie Willis?
What communications were there between Fannie Willis, right?
And then, who, which judge decides?
Do you get to choose a judge?
Is it randomly picked?
Which judge would that civil contempt go to?
So, this is where we gotta get creative.
We gotta get outside of D.C.
Yes.
Okay?
Luckily... You mean we shouldn't do it in a city that voted 93% for Biden?
Right.
I think we should get out right now.
I mean, like, right this moment.
But this is the beauty.
The party, you know, members of Congress come from all over the country.
They should be doing this stuff in their districts.
To represent their constituents.
Right.
And we need not limit our ability to send subpoenas.
Right now, there's only a few people on Capitol Hill who get the funny little hammer and get to be chairman.
And that's a purposeful cap of the ability of volume to go out.
So we need to empower more people to send more subpoenas and do it in different jurisdictions.
How, what would be required for that to happen, to give a regular member the capacity to subpoena?
Does something have to happen legally?
So, it is legal 101.
The House has, their responsibilities are in the Constitution.
After that, they make their own rules.
The House could make a rule about anything.
They could vest all power in a stranger off the streets if they wanted to.
And so the way they structure it now to the benefit of leadership to be able to maintain order and political allegiance is you have to pay your dues and then you get to be a chairman.
And so they have to reserve power and consolidate it there.
And then when you're chairman, you got to pay more.
But guess what?
You get to send the fundraising letter that says, I have the big hammer now for a few years.
So here's what they should do practically right now.
And we're pushing for this hard.
And this is the talk of town.
A lot of members are talking about this.
I hope this comes to pass.
There's $10 million, at least right now, that this House had access to from the January 6th levels.
Left over.
Left over.
It rolled over.
J6 ended.
New House started.
It was available.
Available.
This was part of McCarthy's deal to become Speaker.
He had to increase the levels to the J6 budget.
Okay, and so the House now has access to that.
I think it was $18 million in total.
But due to kind of the change, half it goes away after one year and then the other half's available.
So, the House hasn't touched this money.
It was supposed to go to this super-style church committee that we were promised to be set up.
That never happened.
Never happened.
But the good news is, the money's still sitting there.
And so what the House should do...
Take that money and hire a lawyer to lead all of this.
And that lawyer with $10 million... Would hire other lawyers.
Hire other lawyers, investigators, process servers, potentially people to actually serve these warrants to folks.
And the House has available to it a tool called Inherent Contempt.
That is the ability to actually put handcuffs on somebody if they're not in compliance.
Who's putting the handcuffs on?
Because it's not going to be the FBI or the DOJ, right?
So, it would be the House, you know, Capitol Police, Sergeant at Arms, or the people they usually throw around.
But again, the House can do whatever the House rules say.
Because the Speaker controls the Capitol Police.
Correct.
They work for Congress.
But it need not be them.
That's the convenient choice.
I see no constitutional reason it can't be the Texas Rangers.
I see no constitutional reason it can't be former Navy SEALs who are upset with what's going on with this country.
We need to think outside of the box.
Because right now the left knows we are in this box.
And we need to break out and stop just looking for past president and do something new and aggressive.

We're going to use people to serve subpoenas and warrants for those who have transgressed and spat in the face of the U.S.

Give me some issues, Mike.
Where do we begin?
Is it the 73-year-old grandmother who was just given a custodial sentence for, you know, praying at a Planned Parenthood?
Is it what happened to Peter Navarro?
What baskets of issues would you target first?
So there is a huge list of things that urgently need to be addressed.
most egregious and most Americans could say, hang on, that's wrong, that needs to stop.
So there is a huge list of things that urgently need to be addressed.
There are two that rise to the top as meeting this criteria because they are time bound.
If we don't solve them now, there's no chance to solve them again.
And those are the lawfare that is going on and the rigging of the election that's happening
right now.
Can you explain first, I mean, because I do want to do 101, I use it all the time and
apologies.
What does lawfare mean?
Lawfare is the abuse of the legal system to achieve political ends.
So the law is supposed to be a neutral instrument.
But after the long march through the institutions, it's been captured by partisans, without any allegiance to the Constitution, who can be vessels to help achieve political ends under the guise of law.
For example, the third-ranking individual at the Department of Justice magically appearing in Alvin Bragg's prosecution team to run that case against President Trump and to turn a misdemeanor seven years ago into 34 felonies, that kind of thing.
That's absolutely a perfect example of it.
It is using the law as a guise, as a disguise, actually, for what's actually happening.
And this is something the left inherently has an advantage of, because one, they have no bounds or morals that prohibit them.
Well, the only thing they want is to maintain power.
Correct.
And then two, they've conquered a lot of these systems, the law firms.
Right now, Alvin Bragg is paying, you know, conservative law firm Gibson Dunn over a million dollars to help do this dirty work.
And what we learned this week is Chuck Schumer's brother is the partner in the law firm that is managing numerous of these lawfare cases against Republicans, including the president.
Right, right.
And then some of our best lawyers are the biggest, you know, softies and scary cats in the whole game.
And so the left has institutionally had an advantage here.
That being said, we don't need to take it all back right away.
We just exploit the advantage that we have right now.
Give me concrete examples, because you know best, because you're the executive director at the Oversight Project at Heritage.
Give me a couple of cases or a couple of categories of things that we should drill down on.
Is it the grandmothers?
Is it the president?
What should be the first instance?
The first instance should be the organizations and individuals involved in the persecution of conservatives right now for the purposes of election interference.
So I'm talking about Georgia, New York, Wisconsin.
So like Rudy, John Eastman, the lawyers who are being targeted, these individuals, giving them a help?
And going after people, you know, this could apply to judges too.
There's nothing that says Judge Marchand doesn't have to answer to a congressional subpoena.
And so it should be enforced against these individuals.
That would be amazing.
The individuals that are politicizing this, you know, Judge Marchand's daughter is the one making the most money for the family off of this.
And so there's no reason she should not have to appear and provide documents and answer questions.
And so you could scale this up with an empowered special counsel and operate in all these areas at the same time.
Something that Congress, there's five months left, they're gone for two of those months.
They're not in all of August, they're gone in October.
There is no time for them to do anything.
There's, I think, 30-some legislative days left.
So all these promises of, oh, we decided the fight and we're going to do it now, there's not even time left to do it.
They need someone else to do it.
Second category, election rigging outright.
We're seeing the systems of the election again being shifted to favor and protect the Biden administration.
For example, the use of federal programs and federal money to have a get out the vote.
Exactly.
That's being run by guess who?
Verified nonprofits, which is a billion-dollar leftist apparatus.
Every single person involved in those, leading those nonprofits, should be sitting before the Congressional Special Counsel right now.
And then every single, you know, person on down.
You need to impose a consequence and oversight and accountability for those people, because they're subject to the same Constitution we all are.
All right, I'm going to ask the very tough question to Mike before we finish.
I'm excited.
I love this.
I want it to all happen.
But will it?

What do you think it means by retribution?
It's laughable that you or anyone would describe Davos as protecting liberal democracy.
It's equally laughable to use the word dictatorship at Davos and aim that at President Trump.
In fact, I think that's absurd.
But I'm going to step aside from that constructive criticism and instead answer your question.
And I'm going to be substantive here.
President Trump, if he's the next president, for that matter, I think whoever the next conservative president is going to take on the power of the elites, which I mentioned earlier.
But the thing that I want to drive home here, the very reason that I'm here at Davos, is to explain to many people in this room and who are watching, with all due respect, nothing personal, But that's your part of the problem.
Political elites tell the average people on three or four or five issues that the reality is X when in fact reality is Y. Take immigration.
Elites tell us that open borders and even illegal immigration are okay.
The average person tells us in the United States that both rob them of the American way of life.
They're right.
President Trump will take that on on behalf of the average American.
I don't know if our guest wrote the talking points for the president of the Heritage Foundation.
It's a very new Heritage Foundation.

I'm going to decide.
And then we have a Republican Party that says, well, you know, this Trump thing, America first, that's just that's just a freaky, you know, anomaly.
And we'll get back to business and we'll have our footsie under the table with the Democrats.
If we go back to business as usual after November, what happens to the Republic?
I mean, it doesn't survive.
It's on life support right now.
What's at stake this go-around is the last chance.
And I mean that with all sincerity.
Because what the left is aiming to achieve is a complete takeover of the systems that could perpetuate their power.
That includes the election system itself.
As corrupted as the election system is now, and there's a built-in advantage, I would say, of 5% to 8% of what I would call illegitimate cheating, that number could explode to 20%.
The border.
They're going to amnesty all the illegals.
20 million plus in my view.
Way higher.
Not to mention the 10 million that have come in under Biden.
That number is going to explode too.
There's no reason to hold it back at that point because there's no political consequence for opening the border.
There's going to be a complete takeover of the judiciary.
And so even the appeal of the Constitution won't be there anymore.
We are going to see a just wholesale protection and perpetuation of the left's absolute strangle grip on this country.
And we're not going to have another fair shot to take it back.
I like what you've told us is an action plan.
It's based upon what is true, what is legal, but it also is imaginative.
What are the chances in five months that we could get part of that even started?
I mean, honestly, you live in this stinking cesspit that is Washington, D.C.
You work here.
How hard is it going to be?
What is your message to those who could maybe influence the course of events?
I would say, if you think what I've said is a bad idea, tell me how doing nothing is better.
Our options right now are give Joe Biden $10 million at the end of this Congress, or try something new beyond just the pen pal games that have been played and patty cake.
And so, let's take a risk.
It's worth fighting for.
That's what the American people deserve.
They're so sick and tired of business as usual.
They need to see someone fighting.
Do you have any idea, and we don't rehearse, as you can tell, even when President Trump
comes on, we don't clear the questions in advance, so Mike doesn't know what I'm going
to ask.
Do you have any idea why there's such a paucity on our side of imaginative, organizational,
aggressive approaches to what we want?
And I don't mean the illegal crap that the left does, like Mark Zuckerberg dropping half
a billion to privatize the election in 2020.
I mean just, you know, getting, creating an ecosystem to protect our Constitution and
to do things that actually vouch safe the values we believe in.
We don't have that ecosystem that Mark Elias has created, that Zuckerberg has created.
Why is that on our side, Mike?
Do you have a theory?
I think fundamentally the left is run by ideologues with great access to wealth, and all they
want to do is win.
On the right, the people who hold the levers of power are essentially in there for profit
maximization, personal profit maximization, and power perpetuation.
A lot of, everyone who, you know, participates and watches $100 million plus get lit on fire in the Republican primaries, your vote doesn't go to help the candidate, it goes to pay a huge consultant.
That's what we've devolved the fundraising apparatus to.
We waste money and so we have to, the people at the top of the system want to protect themselves and seek the maximum profit, you know, maximization.
And make sure that their buddies get the contract so when they leave office they can go and work for those companies and be on the board.
And my idea for this special council, yes, it makes members of Congress a little less powerful, in that someone else has power and someone else can be leading a charge.
But we should not let ego and stature stand in the way of saving this country.

We're not going to mention any names now, but if you were sitting right now with those people on Capitol Hill who haven't taken the necessary steps to actually implement their oath of office, to represent the Constitution and their constituents, but who you think might be on the edge of wanting to do so, what do you say to them, Mike Howell?
I would say this is a very dangerous moment, not just for the country, but also for the integrity of the House of Representatives and elected leadership in this country.
If things go on the trajectory they're going, the people who will be held most responsible were those who had power and chose not to use it.
And so I think a lot of people are thinking of this election just in terms of Trump or Biden.
They're going to lose trust in a lot of things afterwards.
And the first people they're going to point to are the people who had a chance to do something and did nothing.
Second, the American people are a lot smarter than you give them credit for.
They are up to the fact that letters and hearings and cable news hits aren't good enough.
They see what the left has been able to innovate so evilly and the success for their side it's had, and they know the right's not doing that.
And so now that there's an option on the table to do something about it, if they were to say,
no, we just want to send more letters and do more hearings, I think they'd be making a crucial mistakes for themselves.
Yeah. So they have to also be a little bit selfish because their future depends upon
whether they do something now or not. Right.
And give me one thing that they could do the easiest in the next five months.
What's the one thing that they could send a signal with?
Not another letter, not another criminal referral.
What would tell you that they finally got the message?
Aside from the appointment of the Legislative Special Counsel, I think it's a complete ban on considering anything that's being put forth on the legislative calendar.
This president... Play hardball.
He does not deserve a function in Congress.
