Nancy Mace, I keep mixing her up with that singer, saying that somebody has to go to prison who has the last name Biden.
The press conference this morning from Comer giving details about another A new corruption scandal, not involving China, Ukraine, or Russia, but this time, Romania.
We'll discuss that and so much more.

I know we call a lot of people rhinos.
She goes on CNN and MSNBC all the time.
Talks about how Republicans need to not talk about guns or abortion.
You're just going to lose elections.
She voted to hold Bannon in contempt, didn't think Ilhan Omar should be kicked off the committee.
But isn't it weird that somebody like that, who's, you know, a rhino when she's on the mainstream media, she'd say something like, a Biden needs to get arrested and put in prison?
Isn't that a bit weird?
No, because look, it's worked for Lindsey Graham for decades.
People don't follow the news that much, so you get the soundbites out there, they see you on Fox every now and then, and you think, oh look, that person's with me, they're good, they're hardcore.
And they keep getting re-elected.
So a far nicer prettier version of Lindsey Graham.
All right I wanted to play anyway just for the record or we shall see if she continues to act like a rhino.
Let's talk about another case that is closed for now until it is appealed and that is of course the E. Jean Carroll.
I don't get it when people have like letters before their name.
If you don't like using your foot.
My mother was called Margaret.
She detested the name Margaret.
Her middle name was Susan.
I didn't even know that her real name was Margaret until I saw her passport as a teenager.
If you don't like your given name, don't even put the letter in front!
Jean Carroll!
What is this absurdity?
Anyway, I have a piece.
I wrote it just before I came into the studio.
It's on my substack right now.
I think the headline gives it away.
We can put it up on the screen.
So, Trump didn't rape E. Jean Carroll, but he defamed her by not raping her.
We're going to break it down with a man who specializes in civil cases.
Remember, this wasn't a criminal case, this was a civil case.
We're going to have the third hour today with none other than Kurt Schlichter, who is one of the most successful defamation lawyers, attorneys in America.
But here's my take as somebody who's looked at the verdict and who's looked at the person, the timing, The backer and the verdict.
And here we have the strange, the peculiar aspects of this case.
Number one, the timing.
This story of Jean Carroll being raped by Donald Trump came out first in an article she wrote for the New York Magazine in the summer of 2019.
Interesting timing.
Especially given the fact that the incident was meant to have occurred In 1995.
Or 1996, because she doesn't know which it is.
She doesn't know which year it occurred in.
Having occurred almost 30 years ago, the statute of limitations, of course, applied, and therefore no case could be brought, because it was decades old.
Except for this interesting wrinkle.
Last year, the governor of New York, in which state the crime allegedly occurred signed something called the Adult Survivors Act which provided a peculiar, almost magical window of 12 months for people to bring sexual assault, sexual abuse cases whose statute of limitations had expired
But the Act would only last for 12 months, meaning they had to bring it between November 24th, 2022 and November 24th of this year.
How weird.
Shouldn't justice apply to all victims of rape, not just for one magical year in which E. Jean Carroll brings her case?
Oh, and don't forget, of course, that Kathy Hochul, the Governor of New York, detests President Trump and is famous for having said that all Republicans should leave her state.
What about the victim?
Yeah, a little strange herself.
She has said many peculiar things about what she thinks about men, as well as boys, who she finds horrible.
And she's actually given an interview on CNN where she called, where she said, people call rape sexy.
Yeah.
We'll play that for you a little bit later if you don't believe me.
But she did actually say that on CNN and made Anderson Cooper very, very embarrassed.
Then we have who backed the case.
Just as with Alvin Bragg in Manhattan who brought the charges against President Trump being given a million dollars by George Soros for his campaign, even the gutter press, even the Daily Beast has admitted that E.G.
Carroll's suit has been funded by none other than Reid Hoffman, the billionaire founder of LinkedIn, who detests Donald Trump.
Hmm.
And then lastly, weirdest of all, the verdict.
A jury of nine, six men, three women, who decided the following.
I've read the actual, the document that they filled in.
They said, President Trump is not guilty of raping Jean Carroll.
Not guilty!
But then they said, yeah, but we think that he sexually abused her.
And he defamed her, so we're going to give her damages of almost five million dollars.
Now in English, what does that mean?
It means they don't believe her story.
They think she lied about her story about being raped.
But, what, they just don't like Donald Trump?
And they'll say, well, sexual assault.
We'll say that he assaulted you.
Didn't rape you because the evidence isn't just good enough.
And we're going to give you five million dollars.
The whole thing stinks to high heaven!
And that is meant to be quote-unquote justice in the year 2023.
It's just another example of political prosecution, which in other words is political Persecution.

We have numerous cuts from Congressman James Comer.
The big news of the day, I guess Russia, Ukraine, China weren't enough.
Now we have to add another nation to the list.
Cut 10, Congressman Comer.
Many of the wire payments occurred while Joe Biden was vice president and leading the United States efforts in these countries.
First instance, while Vice President Biden was lecturing Romania on anti-corruption policies, in reality he was a walking billboard for his son and family to collect money.
Hunter Biden and his associates capitalized on a lucrative financial relationship with a Romanian national who was under investigation for, and later convicted of, corruption in Romania.
The Bidens received over $1 million for the deal.
And 16 of the 17 payments to their associates' account that funneled the Bidens' money occurred while Joe Biden was vice president.
So multiple wires to the Biden family from Romania every month when he was lecturing them on fighting corruption.
I have to ask the lady who broke the original laptop from hell story for the New York Post.

So, to your first question, first of all, thank you for having me.

So, to your first question of whether I'm surprised about Romania, no, I'm not.
And this had previously been reported, actually.
Not only had this been reported that Hunter was Basically taken on by a Romanian oligarch to help him with corruption allegations.
A guy who was arrested and put in prison in Romania for being corrupt.
That's correct.
That's correct, yes.
His name is Popoviciu.
Excuse my pronunciation, my Romanian's a little rusty.
But anyway, so Hunter is retained by this person to help him with his corruption jam.
And at the same time, obviously, as Comer said, you know, Joe Biden is lecturing Romania about their corruption, which is probably fair, but he just shouldn't be involved in it.
And then it's also been reported by the New York Post, by John Levine, that according to Hunter's calendar in his laptop, he has multiple meetings with his father just after taking meetings with his Romanian patrons.
So, again, this is an issue for—this is the issue for the House Intelligence Committee.
It's—sorry, the Oversight Committee.
It's—we have the pay.
They are having trouble proving the play, or at least showing where that comes in.
We know that Hunter Biden was accepting this money from these people.
We know that Joe Biden is linked to Hunter Biden's finances all over the place.
We also know that Joe Biden is all over these business arrangements and meetings, and sometimes in cuts, as in the case of CEFC.
But what they have yet to show, and they kind of teased this the other day, is where does The policy change happened.
And what exactly is that?
And that is really the nut of what we're trying to figure out.
This is what I'm worried about, because you can say money from this country, but it doesn't make any difference in the eyes of the general public until there is the smoking gun of, yes, a piece of paper.
I, Joe Biden, change this policy regarding Romania or Ukraine because of the money.
And are we ever going to see that?
Well, that's it.
Congress has made those allegations.
It's not like this is something coming out of right-wing media.
Congress has made those allegations.
Last week, Comer and Grassley came out with an explosive letter to the FBI saying that they had a whistleblower that came forward and said that there was proof within the FBI that there was bribery.
What does that mean?
Taking money and then changing policy in return.
They said that there was proof of bribery within the FBI of Joe Biden.
And they have not shown that to the public.
And that's very serious.
And, you know, obviously the work that Congress is doing is good and important.
And, you know, I'm not trying to bum out about that.
But what is critical to make this case to the American people about why this is worth their tax money and why this is worth their time is where does the action come in?
And, you know, when I was at the New York Post and we reported on the story of the Laptop from Hell, that series, the allegation at the time by Joe Biden was that he had no idea what was going on with his son and that he had no involvement whatsoever.
What did that reporting show?
It showed that that was a lie, that he was lying.
You know, you can speculate as to why, but that he was actually involved and that he had taken meetings with his son's clients.
I call them patrons, because I think that's closer to a fair categorization of what they are.
And that he definitely knew exactly what was going on.
And not only that, but like I said, in the case of CEFC, that he had a cut in it, or it would appear.
So now Congress, the narrative has moved forward since then.
That was over two years ago.
What are we trying to understand now is what was that money paying for?
Yeah, so here are my issues, and we'll continue in the next segment, but don't go anywhere.

The committee is concerned by the complicated, suspicious network of over 20 companies.
We have identified the Bidens and their associates used to enrich themselves.
Most of these companies were limited liability companies formed during Joe Biden's vice presidency.
The bank records show the Biden family, their associates and their companies received over $10 million from foreign nationals and their companies.
Some of that money came from a Chinese company and went to Hunter Biden's company.
Other transfers occurred with the help of Rob Walker, who then sent it on to different Biden family members.
This is not how lawful businesses operate.
It's a game of I Spy, by the way, Seb.
You see the back right there, they do have a chart, but it's hidden behind everybody else.
Oh, yeah, yeah, yeah.
And it's small.
It's tiny.
Should have 12 people in front of it.

For example, the Bidens used their associate, Rob Walker, to bring in millions of dollars from China and Romania.
Walker's limited liability company, Robinson Walker LLC, paid Hunter James, Hallie, and others in the Biden network more than $2 million after foreign money hit his account.
One third to the Bidens.
That was the pattern.
For example, on March 1st, 2017, only two months after Joe Biden left office, Robinson Walker received a $3 million wire from State Energy HK Limited, a Chinese entity.
The next day, one third of that money $1,065,000 went to the bank account in Abu Dhabi of the company EEIG, which was controlled by James Gilead.

If this is supposed to be the moment, the denouement of the evidence, there's two options here.
Either they're lulling the Bidens into a false sense of security by saying, Sorry, this is all we got.

A Romanian nobody's ever heard of.
Oh, this is really how pathetic they are.
You are a professional communicator.
You are a journalist.
You broke the OG Hunter Biden laptop story.
Give us your take on what you've seen in the last few hours.
Let's sit.
I mean, maybe I'm a little bit of a diva, you know, I can be a little bit of high maintenance on this issue because I just live it every day and I'm familiar with it inside out.
I think I know it better than I know the back of my own hand.
But honestly, yeah, I mean, like as we said, you know, in the last segment and over the break, it's, you know, these, these guys are making very big claims and they need to support those claims lest they look like fools.
And, um, You know, this isn't, like I said, this isn't something that was concocted by right-wing media.
These are the words of James Comer.
So he needs to really put up what he is claiming.
Vaguely, he needs to get more specific.
And so, you know, this press conference, yes, it's interesting, but that would have been really interesting two years ago.
We're now in 2023.
And we know for a fact, because of testimony by Tony Bobulinski, because of documentation off the laptop, because of investigations, even in the Senate, you know, where we know that Joe Biden knew what was going on.
Obviously he knew.
We know that his family is full of sketchy consultants that are grifting off of his name.
We know that, too.
What it appears to be is that they're doing this basically sort of legally because, you know, there's no law that says that the son of a vice president or the son of a senator can't do business with sketchy oligarchs.
So we know all of this.
This has all been reported.
This is all out there.
The American people are basically familiar with this.
Them introducing some character from Romania, which has, by the way, already been reported to the eagle-eyed reader.
You know, this isn't impressing me personally, to be honest.
Let's play a little game.
As you say, you know this better than the back of your hand.
If you were Chairwoman Morris, and that had been your press conference, where would you have begun and where would you have put the focus?
Because we are, like, you know, years into this.
How would you have done it differently?
Well, so, okay, well, God forbid that anybody trusts me to vote for me.
Like, that's not happening.
But in this hypothetical, you know, where would I begin?
First of all, we're over 100 days into this Congress.
I would have probably had Hunter Biden come testify under oath about what is going on.
He is the subject of all of this.
Obviously, I mean, I don't even think that Hunter Biden is necessarily our biggest problem.
He's not actually.
He's a bad man.
He's a bad man for his father.
None of this has to do with Hunter Biden.
Nobody cares about Hunter Biden and what he's up to.
Actually, this is about Joe Biden, who is the one in power, and the one where there is questions swirling about his level of honesty and, let's say, if there is any corruption that he's involved in, right?
So I would have probably subpoenaed Hunter Biden, and he's obviously not gonna come on his own will,
so you would have to subpoena him and have him testify.
It doesn't need to be some sort of spectacle.
You don't even need to humiliate this person.
Just have him testify under oath where he can't lie and ask him, drill down on the details
of what is going on here.
You know, I would have subpoenaed Joe Biden's brother.
I would subpoena Eric Schwerin.
I would subpoena Bevin Cooney, Tony Bobulinski.
It's like there are many characters involved in this scheme, and we can pretty much understand what's going on and legislate it out of existence just with their testimony.
That's their job.

There was an element of surprise then, that we do not have now.

Democrats are masters of utilizing lawfare to take down their opponents.
Meanwhile, Republicans hold investigations and press conferences.
One side plays to win.

I had high expectations of Congressman Comer, and to say I'm a tad disappointed It's an understatement.
I know we don't have the DOJ.
I know we don't have control of the FBI, but still, we could do better, couldn't we, if we believe in the Republic?
We absolutely could.
I mean, and here's the most pathetic part.
It wouldn't take some engineered effort.
It would merely take equal application of the law and existing statute.
I think that's the most amazing thing about it, is there's no follow-through from the right when it comes to prosecuting equal Even equal, like, when you have someone on the right who was accused of something, you invariably have a situation where the mere accusation is enough to sort of justify any sort of action that's taken against them.
But when the right has the script flipped on them, and they actually hold the levers of power, you inevitably end up with a situation where, well, we can't sink to their level.
It's like, how is equal application of the law sinking to anyone's level?
I think it's rising to the level of the Constitution and of local state constitutions as well.
And you see this situation where, you know, it's ridiculous.
Trump just the other day and periodically he'll send out a message, you know, on Truth Social or whatever.
Where he just periodically asks, where's Hunter?
Right?
Just the other day, he released a video saying that it's absurd that he has to be the one to remind everyone that, hey, wait a minute, this guy basically got a job with a Ukrainian oil company for which he never had to show up.
And made millions as a result.
Anybody gonna look into that?
Possibly see a connection there with what's going on with the Ukraine and our involvement in it?
How about this one metric?
How many months are we into a new Congress with a new speaker?
And they're having this press conference and they're writing letters to the DOJ and the FBI.
But how about this crazy idea?
Why hasn't Hunter Biden been subpoenaed to actually testify in front of Congress?
Am I crazy?
Indeed!
I don't know, maybe they couldn't find enough crack to give you- wait, what?
No!
You need some kind of incentive to show up, but I don't- that's exactly what I'm talking about, is the mere application of law is seen as some act of political vengeance.
And of course, if you want acts of political vengeance, you need only look at what's Going on with Trump and the lovely, lovely, lovely woman that anyone would be attracted to.
We will discuss Ms.
Carroll in the next segment, but let's stay on this issue of Not understanding what game you're playing and when the game is rigged against you.
So we'll talk to him later.
We'll actually have the third hour with a man who's very successful in court.
His name is Kurt Schlichter, Colonel Schlichter.
And he wrote an article at Town Hall a few weeks ago where he said, the trouble is, We still believe in normalcy.
That the conservatives think things are normal.
And, for example, when it comes to the legal system, whether it's Gene Carroll, whether it's the Mar-a-Lago raid, or January 6th, the legal system presupposes that things are quote-unquote good.
You can't have a legal system Unless it is deemed, the presupposition is, things are fair.
Haven't we arrived at a point where that presupposition just means we're always going to have our backside handed to us?
It does.
I mean, if you wanted to be charitable, you could say people like Mitch McConnell and such are institutionalists.
One of the reasons I made my Lincoln video relatively recently is not so much to adjust the myth-making around Abraham Lincoln, it's to sort of dismantle a myth that is persistent about the partisan flip in this country, that Republicans at some point became conservatives And Democrats at some point became liberals.
It used to be, it is true, that the Democrats were the conservative constitutional Jeffersonian party in this country.
But what that is really is a misunderstanding of the true domestic political binary in the United States of America.
We do not have left-right in the traditional European sense.
We have Jefferson versus Hamilton.
That's what that is.
And it used to be that we had the Hamiltonian Whig Party, the Hamiltonian Federalist Party at one point, That ultimately was taken up by the Republicans.
The Republicans were the Hamiltonian statist party from the very beginning.
The Democrats for a long time were the Jeffersonian party.
What happened is that after the Civil War, the Democrats were then subsumed by the Hamiltonian former Whigs who couldn't get elected in the South, so they just became Democrats.
So there was no flip.
It's just that we wound up with two statist parties.
So the reason I mention this is Trump represents The re-ascension of this movement that started, gosh, all the way back with Taft and Coolidge, went on to Goldwater, ended up with Pat Buchanan.
We've talked about this before with the Buchanan Brigade, and ultimately that finds expression in the Tea Party, and ultimately that becomes the Trump movement.
This is a takeover of the Republican Party.
What is the best description for that?
Politics, because for those who aren't as au fait with America's history as they should be, is the easiest label populist?
What is, is it national sovereignty?
What is it?
Populism is the mask that it wears.
It can take up, it's basically the delivery mechanism, right?
So it's not correct to say that it's populism.
It's really, in terms of ideology, and I've said many times, Trump is not an ideologue, but if he has any ideology, he's a little bit more Jeffersonian in certain ways.
He can also be Hamiltonian, because he is from New York and such.
Like I said, not an ideologue, but at the end of the day, that's really what this is.
It's kind of the re-ascension of that movement.
You saw it, I think, an important presidency to look at, and he's probably my favorite president to read up on, is William Howard Taft.
Because over the course of William Howard Taft's presidency, he starts out as the puppet for Theodore Roosevelt, a progressive and a statist.
And slowly over the course of his presidency, he becomes the first Republican president to become kind of anti-statist and pro-free market.
And by the end of his presidency, he winds up laying off a bunch of Roosevelt bureaucrats, and he winds up accruing a massive vendetta from Roosevelt, who then basically runs against him as a third party.
And that's how we wind up with Woodrow Wilson in the White House.
I don't know anybody who can crunch that much American history and political science into 11 minutes.

He was deemed not guilty of rape, but had to pay penalties for defaming her because he didn't rape her.

Forget about Manhattan, any big city, any conurbation, you look at what happened to Bannon, to Navarro, do we have a justice system left anymore?
Unfortunately, it's very, very politicized.
I did a video where I affectionately borrowed a phrase from Michael Savage called the stench from the bench.
He's been talking about this issue for a long time, and I feel passionately about it as well.
I think we have a real problem with our justice system in this country.
You know, we have A Supreme Court that at times can adhere to constitutional principles, and at other times they just go into business for themselves.
I think it is fair to say that of all the branches of government, the one with the fewest actual checks and balances on it is the Supreme Court.
Because the Supreme Court, there's only one real format for review.
And thus, there has only been one attempt to impeach a Supreme Court justice in the entire existence of this country.
And that's because the only way you can remove a sitting Supreme Court justice is, and this kind of goes down to like lower courts too, is to initiate an impeachment process through Congress, which if you just analyze that for five seconds you can see that's a problem, because then whoever the congressman is that forwards that motion has to shoulder all the political consequences of the dog and pony show that comes tumbling after.
So rather than impeach a Supreme Court justice, they just sort of sit on their hands and make noise about it maybe, kind of like what's happening with the Democrats Right.
as they're looking to get rid of Clarence Thomas, but of course they can't do it, right?
Because again, they'd be hit with the political consequences of that.
It doesn't work.
We need some kind of additional check and balance on all the courts.
Yeah, we- I think one of the, oh, go ahead.
No, no, no.
I think one of the most obvious things about COVID is just the paucity of judicial rectitude
that we have cowards.
Forget the 2020 election and refusing to hear evidence, just the fact that America could be shut down and judges said that's absolutely fine.
We are less than 20 months away from a presidential election.
In the break we were talking about the man who is now trailing More than 30 points behind my former boss, Ron DeSantis.
You said he's not necessarily a bad guy, but you did have a very interesting piece of advice for him.
What is that advice, RazörFist?
Well, I think DeSantis' wounds are, you know...
This week, this month, this last five months.
I mean, look, you can clearly track the trajectory here for DeSantis.
He began as a possible frontrunner.
Yeah.
He was polling ahead of Trump in a few polls.
And we're talking like January.
This wasn't even that long ago.
And month by month, week by week, He has just, there's been all these self-inflicted wounds.
And the wounds are deep, but I think they are recoverable.
Like, I'm fine with Ron DeSantis still running.
I think it'll help elevate him nationally regardless.
Yes.
But if he doesn't want to go down as Scott Walker 2.0, he really needs to put those advisors on mute.
He needs to get back to what was working for him.
He's a guy who has, I think, like, DeSantis' superpower is he's able, in the best circumstances, to read the room, see what someone else has done, take it a step further, and be more committed to it than them.
Right?
That's really...
What he's been doing over the course of his, like, gubernatorial reign and what has really worked for him, honestly.
Yeah, the issue is whether or not those self-inflicted wounds will continue if he continues to be supported by, you know, left-wing Obama bundlers, billionaires like Ken Griffin.
If that continues, it's not going to be good, is it?
No, not at all.
And the problem there is If you go a little too far, you know, like, look at the tail end of the 2016 primaries, where some of the people affiliated with Ted Cruz started printing up flyers of naked Melania Trump.
I mean, it got really, really bitter at the end there.
And I took to calling him Princess Cruz by the end.
It was just getting ridiculous.
He was getting spiteful.
But, one of the great things that Trump is able to do is he is able, even if he utterly demolishes DeSantis in the primary, he has a unique superpower, similar to DeSantis, to pick up his opponent, dust him off, handshake him, and it's kind of like a king making, a little bit?
It's blown my mind how he can do that with people that he's been, you know, dueling to the death with.
I could never do that.

All right, for a bit of a giggle, I want to play a cut to you from Senator Elizabeth Warren about the reality about the debt negotiations.
Cut eight.
But the idea of Republicans who are trying to undermine our democracy and undermine how the systems work, that is a genuine threat.
We also are watching hostage-taking.
You know, we talk about it with the debt limit right now, that Kevin McCarthy says no, he's got to have all these negotiations before he will go along with the United States government actually paying the debts that it's already incurred.
You actually served in Congress.
The idea that a branch of government is having talks with another branch, was that ever described to you as hostage-taking, Dean Bratt?
No, this is quite amazing.
The Secretary of Treasury yesterday also said, you know, my job is to make sure Congress does its job.
But in Article 1 of the Constitution, the Congress actually has authority in all of its monetary duties, and the Treasury is supposed to follow the lead of Congress, not to mention the Federal Reserve.
And so what she didn't mention on the hostage-taking, the hostage is the $50 trillion we're putting around the necks of our kids.
And the radicals, these radical Republicans, are only trimming $4 trillion off of $50 trillion.
Leaving us only $46 trillion in debt, if they get their way, which they probably won't, because we'll go into negotiations with the Senate, and we'll probably end up with, you know, maybe a $2 trillion deal, leaving us $48 trillion in debt.
That's all the American people need to know.
And so this idea of hostage-taking is just, you know, absurd.
They're holding the next generation, they always say they care about the kids, they're holding the next generation hostage.
These numbers, for a mere mortal, they're just incomprehensible, does not compute.
Can you translate it into real events, what it means for the future of America?
What does the fact that people walk around this city like drunken sailors on payday actually mean in reality?
Yeah, I'm kicking myself the other day.
I was on another show that I love and you love.
And I forgot the miracle on 52nd Street, where at the end the judge gets a moment of divine inspiration to solve his case and says, here's a dollar bill.
It says on the back of the dollar bill, in God we trust.
In God we trust.
Credo, the Latin word, means I believe.
The word credit, linked to the Federal Reserve System, has to do with trust and credit and believability.
And for the average, that's what's at stake.
It's trust in the entire United States financial system.
It's not about this deal or that deal.
We're getting really serious, folks.
Social Security and Medicare are underwater, according to the own Board of Trustees reports.
We're $50 trillion in debt.
That's separate from Medicare and Social Security going insolvent.
And that's what's at stake, the livelihood.
And there's no economic papers.
If you're $50 trillion in debt, the interest payments in 10 years will be $2.5 trillion.
Just interest payments on the debt.
That's three times the current national defense budget.
And so, for real America, that's what's at stake.
We need to cut every dollar we can out of the federal government right now, return power to the states and localities as in the Constitution that made us the greatest nation on earth.
And then you'll see a return to normalcy.
Wow.
And we ought to peg the dollar to gold as well through the Federal Reserve System.
Instead of going to a digital currency, which the Federal Reserve is currently pursuing, and they're
active.
They're actively going to put it into play unless Congress blocks them.
But Congress, Mooney, and some of the financial services are putting in bills to block that.
Thank goodness.
Yeah, the digital currency, which will allow them to control you and cut you off whenever
they want to for political purposes.
Alright, you've got a magic wand, you went to Hogwarts.
It's day one of a new Republican administration.
Of all the things you've mentioned, of sending the money back to the states, pegging us on gold, what is the first act of a responsible, fiscally-minded president when he comes into office?
Give me just one.
Give me the priority, Dean Bratt.
Yeah, well if you're talking just on the fiscal side you got to end the Federal Reserve System as it currently exists.
They caused the 07-08 financial crisis.
They're currently bankrupt, by the way, right?
If you follow normal banking liabilities and assets, go look at the Federal Reserve's balance sheet.
They're negative.
They're negative on equities.
They're bankrupt themselves.
This is not a model for creditworthiness, for trustworthiness, for in God we trust.
That's why I started.
All of this is a moral issue.
And so I'd put the Federal Reserve at the top of the stack Because they built the bubble we're currently experiencing and there's no way out, right?
And can we do away with it without some kind of central bank like the Europeans have?
Just abolish it?
No, you just put into law the Taylor rule.
John Taylor out of Stanford University.
If we would have followed the Taylor rule, we'd have no problem.
He followed Nobel Prize winning Milton Friedman.
This is no radical policy.
This is rational economic science.
You never hear of science and economics, right?
We actually have a social science developed there, but I wouldn't read anything written in the last 20 years.
Go back 20 years plus when they used to tell the truth.
I say if you want to educate yourself, read a book preferably written by a dead white guy.
It's probably much better than anything published in the last 50 years.

A charge, Councilor Schlichter, that could not have been brought unless the anti-Trump governor of the state of New York had assigned something called the Adult Survivors Act, which for a period, a magic window of 12 months, made it possible to go back in time, irrespective of the expiration of the the statutes of limitations on these crimes and to bring a
case.
A law which, by the way, was brought last year and expires this year.
Smells a little fishy to me, but you are the professional.
Unpack for us the results that we heard last night out of Manhattan.

See, I practice in the real world of law, and this has...
Like, everything that seems to involve Donald Trump has nothing to do with the real world of law.
There's, like, a special law, the Trump law, the Trump exception.
Now, I have told many people, many times, the hardest and most difficult kind of case to win is a defamation case, because there's so many reasons you should lose.
This was partially a defamation case, and it should never have gotten in the door.
You know, just looking at what you mentioned.
Can we just stop there for a second and tell us, because this is your speciality, before you get to the things I mentioned, the thing you just said.
Why are defamation cases so difficult?
In the UK, it's relatively easy.
The person defamed doesn't have to prove it.
It's actually the other way around.
Why are these cases so strangely, peculiarly hard in America?
The First Amendment.
You're allowed to speak freely.
You're allowed to default to speaking freely.
And if somebody wants to sue you over it, they have a lot of procedural hurdles and they have a lot of hurdles in terms of elements.
For instance, you've got to prove the statement was false.
We hear a lot about, well, truth is a defense to defamation.
Well, in many places, falsity is an element, meaning the person suing has to prove it.
If it's a defense, the defendant has to prove it.
So it's very hard to do that.
It's also very hard Because you have the issue of facts versus opinions.
And what constitutes an opinion is very, very, very broad.
So you can't sue someone over an opinion.
I could say, you know, you could say Kurt Schlichter's a giant knucklehead.
Well, that's really an opinion.
It may be derogatory, but it's an opinion.
You can't sue over it.
Now, you could say, Kurt's a knucklehead, and he did this specific thing, this, this, and this way.
Yeah, maybe you could sue.
Probably be hard.
But you gotta prove damages.
And you gotta prove an amount of damages.
I'm still wondering, where'd the $5 million come from?
I don't know.
I don't know.
She was attacked.
I would think It would be a bigger verdict.
Yeah, we'll talk about that in a moment.
The five million, especially given the fact that we're talking about a billionaire real estate mogul, the five million seems rather paltry given some of the damages we see being awarded by other courts.
Before we go on to the specifics I mentioned, the last point, will you explain why, if you're a public figure who has been defamed, why it's basically impossible?
It's called New York Times vs. Sullivan.
And what it is, is it says that if you are a public figure, you must prove actual malice or reckless disregard of the truth.
Meaning you have to prove that the person who is saying the nasty things about you had bad intentions and knew they were false when they published or said them, which seems like, unless you're, you know, a mentalist, would seem rather impossible.
True.
And this is a controversial legal holding.
There are conservatives and liberals who want to challenge it.
I happen to like it because it encourages free speech.
But there's a cost.
The cost is people get their reputation hurt.
When if there was a lower standard, they wouldn't.
And I do worry about it being used against conservatives if it Was what was eliminated in a future Supreme Court case because this is a Supreme Court holding so it would take the Supreme Court to essentially reverse
Of course, after nearly 60 years.
Right.
So let's talk about the things I mentioned.
The 30 years delay, and then this magical law that was signed by Hochul, who detests President Trump, that gives a law that lasts for a year that seems to be tailor-made for this case, so the statute of limitations doesn't apply.
This seems utterly bizarre to me.
Well, there have been laws like this about child sexual abuse.
And, you know, that's debatable.
I'm very much against extending the statute of limitations.
I do a lot of defense work.
I defend people.
I also bring suits.
I will sue people.
I've sued people in cases similar to this one.
I've also defended people in cases similar to this one.
I don't like the idea of going back 30 years and saying, now you need to defend yourself.
Huh?
If somebody said, Kurt, where were you in either 1995 or 1996?
Because I don't know exactly when it happened.
I was like, well, how do you defend yourself?
You can't.
One of the reasons we have a statute of limitations is to protect people from exactly this.
Because what you have is a case that boils down to, she said he did it, he said he didn't.
And they decide who they believe.
And while that is technically how the law works, that's not particularly just.
Especially when you're talking about a venue composed of people who just hate this guy.
Yeah.
And look, I like Donald Trump.
I think he's being horribly abused again.
But I would make the same argument even if it was a liberal who had this happen to him.
Based upon this change in the statute of limitations.
I'm sorry, I didn't get that.

And remember, sexual abuse cases are Always very front.
They're very emotional.
They often have little physical evidence, especially after time has passed.
And the fact is, there are people who lie about it.
Yeah, yeah.
There are people.
Look, if this was the law, anybody can come back and say, you know, 30 years ago, Joe Blow did X, Y, and Z. Joe Blow's walking down the street.
Suddenly, you know, he's now embroiled in a lawsuit over who is this person?
In a lawsuit where the person who said they were attacked doesn't even know which year it occurred in.

Well, E. Jean Carroll, I was a little bit famous, but this verdict yesterday, Kurt.
So the summary from my layman's analysis, and here's the article.

So Trump didn't rape Carol, but he defamed her by not raping her, is the headline, because the charge was, you raped me!
And then you defamed me by denying you raped me, which I thought everybody has a right to say they're innocent.
That was the allegation!
I would have thought so.
That's what I thought, but hey, I'm not the lawyer.
Then they change, the fairy dust comes, they sprinkle the fairy dust, or the governor of New York says, It doesn't matter that it was 28 years ago, or 27, who knows?
We will allow you to bring this case for one year.
They bring the case, and the jury, only three hours of deliberation, I'll ask you about that in a moment, but after very quick deliberation, the nine-man jury of six men, six men and three women, says, no, we don't believe you.
He didn't rape you.
Oh, but we think he assaulted you.
And we're going to give you $5 million for him denying that he raped you, although we don't believe he raped you.
I'm sorry, Kurt.
I'm confused.
Well, you and me both.
That's not the answer I expected, but carry on.
Well, it's, I mean, it's a verdict that to me basically says, well, I don't really believe her story, but I hate Trump.
And we're going to cost him some money.
You know, I think what they did say he did was similar to the Access Hollywood tape.
Maybe I think and that was shown, which I think is probably an error to the jury.
And I think this verdict strikes me not as Based on what her accusations are or the law, but on their opinion of Trump.
And of course, you're in a very, very, very blue jury pool.
You have a judge that, at least Donald Trump says, was not particularly favorable to his side.
I don't know.
I don't know all the rules.
Right.
Is there grounds for appeal?
I can think of some.
Will it work?
I don't know.
Well, given what you know so far, well, I think he's going to appeal.
What is the most likely avenue of appeal?
Well, the inconsistency of the verdict, I think, is a good one.
The due process claim on the resurrection of the statute of limitations.
Frankly, I think that's probably the best of the arguments.
But look, There's a special law for Donald Trump and all conservatives, and it doesn't match the kind of law that I practice, because at least when I'm not representing someone famous.
If this was a normal case, I don't think it would have seen the inside of a courtroom.
If it was Joe Blow and, you know, Susie Jones, and she said 30 years ago, he did this.
I don't remember when, where, or how.
Oh, come on.
If it doesn't go out on summary judgment, the jury's going to look at it and go, this is stupid.
Is there anything to be drawn generally by the speed with which a jury brings a verdict, or is it just completely random?
Well, look, it's all tea.
Trying to figure out what a jury's gonna do is all tea leaves, and there's lots of received wisdom about it.
Usually, if you have a quick verdict in a civil case, and I think this would be, I think three hours is a quick verdict here, it's good for the defense, because it's a lot easier to say, oh no, you get nothing.
Because if you say yes, you get something, then you have to go through the damages portion.
Right.
And remember, a jury's supposed to deliberate over all of that.
Is it unknown for a big verdict?
Well, this isn't a particularly big verdict, really, for what it is.
It's, you know, the one up here, 25 years ago, just flat defamation, $3,049,912.
Wow.
Okay.
I presume that didn't involve a former president and a billionaire.
It did not.
No, it did not.

Look, it smells to me like a bunch of people who don't like Donald Trump were saying, you
know, he's just a bad guy and we're going to show him.
Yeah, and we don't believe the big story, but this is how we're going to punish him with the minor story.
And we're just going to say, no, he didn't rape you, but we're going to say he assaulted you.

The last thing, and then we'll move on if we must, in this bizarro world court case.
Is.
The phenomena we witnessed with Alvin Bragg, that we know he was funded in his campaign for DA to the tune of a million dollars by George Soros, and that he campaigned on putting President Trump behind bars, which doesn't seem as if you're an unbiased officer of the court.
And now we find out even the Daily Beast, the gutter press, even wrote a piece on the billionaire founder of LinkedIn, Reid Hoffman, I doubt it will, except to the extent that it was excluded in trial.
in this case, a man who detests Trump funding this case.
Could this factor into any kind of appeal, Kurt?
I doubt it will, except to the extent that it was excluded in trial.
I think the fact that it's being, the lawsuit is being funded by his political enemies,
I think is arguably evidence of bias.
And I think that should have gone to the jury, though I doubt that jury would have cared.
Look, you know, it's hard for me, Dr. Gorka, to treat these kinds of cases like normal cases,
the kind of cases I do all the time, where you're usually, you know,
Usually going to rely on facts and evidence.
I don't think that's what's happening here.
And I think it's wrong.
I think it's very dangerous the way that the law has been weaponized against political opponents.
Now, you being a student of history, you understand that the big reason that Caesar crossed the Rubicon is that he could not lay down his power because they were going to, they were essentially going to prosecute him in Rome and destroy his career, not take his property and his life.
That's dangerous stuff.
History tells us weaponizing the law has very, very dangerous consequences.
And we saw that, you know, it was what the last, you know, state through the heart of the Roman Republic.
Yeah.
Yeah.
No, that's a very deep, deep and meaningful historic analogy you're bringing there.
And how much more likely are we to see more of this?
Because we've seen criminal abuse of the criminal judicial process, DOJ going after pro-life pastors, January 6 people being kept in prison without trial for years and years, that this was a civil case.
Because a civil case, it's not beyond a reasonable doubt, it is a preponderance of evidence, correct?
So the level's much lower, Kurt.
Yes, it is.
We're going to see more of it because it apparently works.
And we're apparently tolerating it as a society.
There's ways to push back.
One of the ways is to get good judges.
The other is to aggressively pardon people unfairly convicted.
For instance, a guy defending himself in Austin was sentenced to 25 years to death.
Greg Abbott needs to get his parole board on task to get that squared away.
You know, one of the things that the other side uses is a presumption of normality.
So you have some of these allegedly Republican voices go, well, you know, we have to honor the jury system and respect the system.
No, we don't.
That's the problem.
When you corrupt it, it should lose the respect.
And this is the way that they try and convince us to go along with it.
And it's a very powerful weapon.

I mean, that is a crime mentioned in the Constitution.
You don't, you know, it needs to be addressed and I don't think it's going to be.
I just don't think it's going to be.
And, moreover, I think a substantial number of Americans don't care that it's not going to be addressed.
They're perfectly willing to tolerate it, as long as it gives them a political advantage.

We should stop using the phrase, a two-tier justice system, because as soon as you have multiple tiers, you actually don't have a justice system.
We need to recover it.
