Copies of both the warrant and the FBI property receipt were provided on the day of the search to the former president's counsel, who was on site during the search.
The search warrant was authorized by a federal court upon the required finding of probable cause.
The property receipt is a document that federal law requires law enforcement agents to leave with the property owner.
The Department filed the motion to make public the warrant and receipt in light of the former President's public confirmation of the search, the surrounding circumstances, and the substantial public interest in this matter.
Faithful adherence to the rule of law is the bedrock principle of the Justice Department and of our democracy.
Upholding the rule of law means applying the law evenly, without fear or favor.
Under my watch, that is precisely what the Justice Department is doing.
All Americans are entitled to the even-handed application of the law, to due process of the law, and to the presumption of innocence.
Much of our work is by necessity conducted out of the public eye.
We do that to protect the constitutional rights of all Americans and to protect the integrity of our investigations.
Federal law, long-standing department rules, and our ethical obligations prevent me from providing further details as to the basis of the search at this time.
There are, however, certain points I want you to know.
First, I personally approve the decision to seek a search warrant in this matter.
Second, the Department does not take such a decision lightly.
Where possible, it is standard practice to seek less intrusive means as an alternative to a search and to narrowly scope any search that is undertaken.
Third, Let me address recent unfounded attacks on the professionalism of the FBI and Justice Department agents and prosecutors.
I will not stand by silently when their integrity is unfairly attacked.
The men and women of the FBI and the Justice Department are dedicated, patriotic public servants.
Every day, they protect the American people from violent crime, terrorism, and other threats to their safety, while safeguarding our civil rights.
They do so at great personal sacrifice and risk to themselves.
I am honored to work alongside them.
This is all I can say right now.
More information will be made available in the appropriate way and at the appropriate time.

Mr. Attorney General, the former president said this is -- The President: Thank you all for your questions.
But as I said, this is all I can say at this time.
Mr. Ladies and gentlemen, we started the show with that live.
That was the Attorney General Merrick Garland, who was 30 minutes late to a press engagement that was announced just over an hour ago.
No questions, less than five minutes long.
It couldn't be better time for us to have in studio the guest.
We do have a man with years of counterintelligence experience under his belt in the U.S.
Army, now Director of Investigations and Research for the people who have been central to uncovering the truth about what happened in Mar-a-Lago.

Chris, I wasn't expecting much, but I wasn't expecting him to celebrate the counterterrorism work of members of the Department of Justice.
Was anything substantive said in the last three minutes by the Attorney General?
A lot of hollow platitudes, for sure.
But one good thing was identified, and that is he claimed that he personally authorized, approved the search warrant being submitted to the judge.
So now we know where responsibility lies.
So any other finger-pointing and second-guessing, set that aside.
Merrick Garland now owns this, and it looks like he's going to eat it.
This is for him to hang with and to be... He's claimed the responsibility.
It is his.
We'll talk about how you and Traditional Watch have managed to take action in Florida to find out what was behind this raid.
Right.
But the idea that, for the first time in history, a president's private residence was raided by federal agents.
He gained shade, what was reported for the last two days, that the warrant wasn't left there, the affidavit Wasn't attached, not even the front page was left.
He said it was presented to the lawyers.
We know the lawyers weren't allowed to be on site inside the building.
There was a request made to the security staff to switch off the security cameras while the FBI raided Melania's wardrobe, broke into the personal safe of the president.
The idea After two years of BLM riots, Antifa, January the 6th, that the Attorney General was unprepared to even give the justification for that warrant.
I find that stupefying.
You're the professional at Judicial Watch.
Your response to the lack of explication for even the reason for the warrant.
Yeah, he's deliberately vague and misleading in this regard.
It's an effort to further muddy the waters.
He then made this really pathetic attempt to cloak himself in the honor and integrity of the agents working in the FBI.
Sort of a wishful thinking by association that he could point and say, well, don't say anything bad about the FBI because, you know, they're great people.
And he chooses to associate himself with that.
It's another hollow, pathetic effort to give himself some dignity for something where he's so clearly out of bounds.
But also, it's irrelevant.
It's irrelevant to the matter at hand.
It's a sideshow.
It's a distraction.
It's an effort to divert and to diffuse away from the central issue, which is that I mean, look, so I have direct first-hand knowledge in Presidential Records Act stuff.
I've sat in the Clinton Presidential Library looking at Presidential Records with Bruce Lindsay, the Clinton's personal attorney and designated representative for Presidential Papers, sitting in the next room through glass, reviewing documents that were then given to me to review.
Wow.
So I have this kind of direct knowledge.
So you know how the system works?
Judicial Watch has sued and lost in court because we wanted Clinton recordings of an oral history he gave to historian Taylor Branch.
And we said that that oral history, those recordings, should be public.
But Clinton said no.
We lost in court and a federal judge told us, the president decides what a presidential record is.
You have no access to this.
Hang on, hang on, hang on.
A president decides what belongs to the US government and what is his personal?
That is correct.
100%.
Exactly correct.
I mean, this is why we have the Presidential Records Act, because Nixon was lambasted for saying, look, some of this stuff is mine!
Well, and here's the story.
Since 1939, FDR started turning over papers.
That's the precedent.
So from 39 to today, every president, every single one of them, gets in a little pushing and shoving match over, what am I going to keep?
What are you going to get?
You can have this record, but I want it sealed for 50 years, or I want it sealed until I'm dead.
Then you can release it.
There's always a negotiation.
There's clear evidence that President Trump was involved in negotiations with the National Archives over his records.
And was actually complying.
Correct.
He received a subpoena that he turned records over to in June.
The FBI was there.
They had him improve the lock on the storage area.
So one of the requirements was, earlier this year, up the security.
Correct.
Which they did, and then you shared with me before we went live what happened on Tuesday.
They broke the lock off its hinges.
The one that they said they should put in.
That they had to install.
So here's the irony of this.
So let's pretend for a second that you're a Trump hater and everything bad you could possibly imagine is true.
He's stolen documents and is classified blah blah blah.
Okay.
These records have been reviewed by the FBI two months ago, a month and a half ago.
They improved the lock on the storage area, which already was locked, but they put an even better lock on it.
And so now you have records that the government knows you have.
They're secured on a presidential compound guarded by Secret Service.
So what's the vulnerability?
Well, unless Sandy Berger comes back from the dead, and his ninja suit is dropped into Mar-a-Lago, steals from the safe the President's personal documents, and then stuffs them down his underwear.
I mean, otherwise, they're secure, Chris.
That is correct.
I mean, to try and make light of this slightly.
That's an excellent example of the insanity of this.
And so normally, this is a...
Attorneys send mean letters to each other, right?
And then they figure out which documents go where.
And in Nixon's case, it took 30 years of the back and forth between Nixon and the government.
And nobody raided Nixon's home.
Nobody raided Nixon's compound.

And the library sits here, and right next to it is the National Archives building.
And so we gained access to the archives.
Some of the stuff we asked for, they made, oh, we have to check on that.
The President's personal representative has to approve the release of it.
And so Bruce Lindsey had been the designated guy.
He showed up.
And the reading room, next to it there's a conference room where you can evaluate, have meetings, etc.
Bruce Lindsay's in the conference room.
There's a glass partition between us with louvered blinds, so I can look over and see him there, and he's going through stuff, and then the archivist takes it, walks it around through the hall, and then I review it.
This Presidential Records Act thing, they act as though it's something that just, you know, dawned on the scene last week.
It's been around forever.
We've exercised it in the way I just described with Bruce Lindsey.
We've sued over it.
Bill Clinton was keeping these recordings he made with Taylor Branch in a drawer in his personal residence.
And we said, well, you know, there's two sets of records.
There's one Taylor Branch has, but the ones he retained, arguably those records, that audio, he wanted to have an oral history of his presidency.
And so those really should be records that are given to the archives.
And when we sued to get them, the judge said, no, the president decides what's a presidential record.
You can't dictate what And that's the way it's always been treated.
I need that decision.
Can you get me that decision?
Yeah, I'll send it to you.

It's a federal U.S.
District Court judge here in D.C.
They said, no, it's the President's decision.
It's always been that way.
And so even if they're arguing over, well, we really want to have this copy and you can give... They have an index.
They know what he has.
None of this is a surprise.

There's no mysteries.
The FBI has already been there in June.
They've already inspected everything.

Let's jump straight in with what you guys have done at Judicial Watch.
So, allegedly, the raid executed by 30 FBI agents.
They didn't leave the warrant there, or at least they didn't show the supporting documentation.
The lawyers had to... I'm not going to disclose who you spoke to, but The lawyers were in a tough position, were they not, in Mar-a-Lago?
Yeah, I have informed opinion, and my informed opinion is that there was a showdown of demanding the warrant be produced.
The agents just wanted to go in, raid the building, and the lawyers had to say, excuse me, where's your warrant?
Well, let's be clear.
I mean, when a search warrant raid is conducted, the objective is shock and awe, right?
They wish to disorient and subdue the target environment.
Who's ever there?
And they're good at doing it.
And even somebody who's in anticipation of it or is a seasoned person, there's an effort to suppress the environment so they can take control of it.
And they're very good at it.
Nonetheless, they still have an obligation to provide the warrant.
More importantly, on Tuesday, late afternoon, early evening, we filed a motion in the Southern District of Florida to get to the affidavit.
So, a warrant is an authorization to go violate your Fourth Amendment rights and search.
It's a one-page document that underneath has to have something which Right.
And so the supporting document is an affidavit, normally by a supervisory special agent of the FBI.
A sworn statement.
Correct.
And it explains, this is our investigation, this is our target, this is what we're looking for.
We have reason to believe a crime has occurred or is occurring.
So in this case it would have to be, because it's about classified documents, somehow a crime has been committed relating to those documents or is about to be imminently committed on Mar-a-Lago.
Otherwise you can't do it.
Correct.
And importantly, inanimate objects don't commit crimes.
Right?
A piece of paper sitting there doesn't commit a crime.
So what you have to allege is that a principle, a human being, a character is conducting activities that are criminal.
So does that make you think that the FBI or the Department of Justice is claiming that President Trump is a criminal?
Well, obviously.
So here... But I mean, that's the key point.
So what does that affidavit say?
And here, as a seasoned national security professional, This is a man, and I make this point again and again and again for those who aren't familiar with the system, the clearance system, the classification system in America exists for one purpose, to support the President in national security decision making.
Correct.
Doesn't exist for the Speaker of the House, doesn't exist for the Chairman of the Joint Chiefs, doesn't exist for the Vice President, exists for the President.
So this is a man who, until he dies, maintains the highest security clearance on the planet.
It's called a legacy clearance.
So what exactly is the FBI possibly positing, Chris, that he's Xeroxing the nuclear launch codes and giving them to North Korea?
I mean, what planet are we on?
Right.
And also keep in mind, so the latest information that could be in these documents that were kept in boxes somewhere is from January of 2021, when the president left office.
That is hardly some crucial, critical, time-sensitive, latest breaking intelligence.
In the intelligence world, that is old, old news.
There's nothing in there.
All these same characters were already there in June.
They did an audit and an index of all the holdings the President had.
That's why they told him, hey listen, when you put all this stuff back in the storage area, we want a different, we want a bigger lock on the storage area.
Again, a universe of documents, they know what they are, secured according to their standards-- - Protected by the-- - On a presidential compound, guarded by the Secret Service.
How in any, I mean, they didn't leave them out on a hot dog stand at the beach, right?
This is super secured environment.
And the guy who has custody of them, he's already been cleared for everything under the sun.
He's the president of the United States. - It's not like Aldrich Ames' briefcase on the New York Metro on the subway-- - Correct, correct.
Or Hillary Clinton's email server with 22 top secret SCI emails across it.
I spoke today to a very senior FBI agent who retired in January who said the following, and I want your reaction.
He believes with the amount of equipment those 30 officers arrived with and the nine hours they spent there, this is an FBI guy who retired in January, he thinks they probably left devices there to surveil President Trump.
I was shocked.
I wouldn't doubt it for a second.
Wow.
I know, I mean, they vacuumed up every single thing imaginable when they were in the building.
I don't care what kind of piece of paper or item.
Nine hours.
Everything imaginable.
Now, here's the other question.
The President raised this.
Did they plant something?
That's one question to raise.
Another question is, did they stick within the four squares of the corners of the WART?
Or did they go further afield and look at other things?
It's, as that FBI agent told me, trophy pictures.
You're not supposed to take them, but he knows that those FBI agents probably took trophy pictures with their phones inside that building that will be potentially used in an election campaign.
Because let's not forget the most important point of all.
Really, this is the most important point.
It's not that he's a former president who was in the Oval less than 24 months ago.
He's a future candidate for the presidency.
That's the real reason.

But I think this this documents investigation is one that we haven't heard the last of.
I mean, David is absolutely right about the cautiousness, the innate cautiousness, and the by-the-book nature of Merrick Garland.
And I think that he's handling this absolutely perfectly.
I don't think the Justice Department should be saying anything more than it already said, which is basically nothing about this.
Yeah, because that's what you do in a representative democracy in a republic like America, when you raid a former president's house.

Chris, you said that you've been on this rodeo before.
You understand the presidential documents system.
For any other president, including Nixon, what's the process?
Obama took 30 million pages.
30?
Yes, 30 million pages of documents from the White House.
...have not yet been deposited in his presidential library in Chicago, which is weird, because he wasn't president for, what, a good few years.
What is the normal process of the argumentation as to who gets to keep what?
Okay, down and dirty fast.
It starts off with an argument.
The archives says, hey, listen, we know that there's this universe of records.
We should have them.
President says, no, actually, I want to keep this part and this part.
I'm doing my memoirs.
Whatever reason.
There's a movie.
He wants to keep it.
The lawyers exchange letters back and forth.
The National Archive and the President's lawyers have a... And they have a little fight over it, and it's a negotiated kind of settlement.
At some point, they may get a little more aggressive about it.
It's pretty rare, but it may happen.
At which point, in the most severe example, there's like an ultimatum letter.
From the Archive?
From the Archives, and then they either acquiesce or they again reach an agreement.
In the worst case scenario, the archives would serve a subpoena and say, we were exercising court process.
We want to make a claim in a court that you must provide this.
On this specific document.
At which point, again, it's usually negotiated away and it's not a big deal.
If that didn't happen, then you go to the court and ask for the relief and say, please give us, you know, have the court demand, in which case, again, that's an attention getter.
The attorneys know they have to comply.
And it's done.
I mean, that's where it ends.
An envelope is deposited by FedEx.
It never gets anywhere beyond that.
In this case... I'm thinking, I mean, Nixon's home was never raided.
No.
No.
No president's home's ever been raided.
No...
This is so off the charts, this is so extraordinarily above and beyond, it is unimaginable.
So they've jumped past the process we've just described, and they've gone into a court and said, we have reason to believe a crime has occurred, or is about to occur.
And they're making this claim over records that they just looked at in June and suggested that they improve the lock, which they did within 24 hours.
And again, these are records that they know about, they've screened, they've reviewed and indexed, they've made a suggestion about improving the security on a presidential compound guarded by Secret Service, and then they rate it.
I need you back for a whole hour.
We'll get you back next week after the judge that you petitioned has given that deadline on Monday for the FBI to release or the DOJ to release the details of this warrant.
But I want to just remind everybody Guests rarely shock me.
And you shocked me once, about two years ago, when we discussed Russia collusion.

And I said, can we salvage the FBI?
No.
Live on air, you said, no, send in the marshals, dismantle it.
Correct.
I was like, what did Chris Farrell just say?
You were right, Chris, because after this, there is no question, it cannot be salvaged.
Yeah, and there are more nightmare stories like this from the FBI, even before, except it never did involve a president.
It involved just ordinary citizens who were grossly abused, mistreated, lied about, manipulated, etc.
But now we see it, they're even arrogant enough to do it to a former president of the United States.
Rebuild it?
Divide its divisions?
Within the U.S.
Marshals Service, you create an investigative division.
That's not intelligence, not spying on Americans.
Correct.
And then you allow vetted agents to lateral over, and you collapse the FBI in on itself.
It could be done in six months, if they did it smart.

You know, I wrote this song because, number one, it's exactly how I feel.
I was watching our country Go through all these things that are so many things.
Honestly, it would take us five or six hours just to go down through them.
You went through a couple, but a lot of the things that are happening in our country that are so bad are being done under the name of the word progress.
And to me, I find that so ironic because it's anything but progress.
When you see the border, when you see how we left Afghanistan, when you buy a gallon of gasoline, when you try to find Food for your baby when you're worried about your kids getting indoctrinated at school and on and on and on under the name of progress.
And so some people have asked me, John, this is a conservative anthem.
I say no.
I'm pretty sure it's a populist anthem, because if you go look at the poll back in July, it said that 88 percent of Americans agree That the country is on the wrong track.
Well, buddy, if you get 88% of Americans to agree that they all like to eat ice cream, that would be a big deal.
But to agree that the country's on the wrong track, this is a populist message.
So it's a simple, straight-ahead country song, straight from the heart.
It's just the way I feel about things.
And what do you know?
I put the song out, and for 12 days in a row, it was the number one most downloaded song of all genres, not just country.
All genres.
And that tells you a lot about where people are today.
That's incredible.

And that's because the industry, in general, is run by people who don't agree with what that song says.
They see things completely differently than how I see them.
But it's this interesting There's a chasm in between the industry, the people running the industry, and the people listening to the music that the industry is putting out.
Our audience in country music is not 100% conservative, but they are a large percentage, I would say majority percentage, conservative-leaning people, and they're the ones that are out here supporting a song like Progress, yet the industry won't allow their artists to say things like this.
As of right now, in country radio, I think there are only three radio stations That I'm aware of in the whole country that are even playing this song, yet it's the number one most downloaded song in America.
Is that not crazy to think about?

But the worst, I think, is Merrick Garland, who has proven to be, I'm sorry to say, a political toady, who is bereft of rectitude and integrity.
If you had rectitude and integrity, think about just that short list Jarrett enumerated.
If you're either Christopher Wray, the director of the FBI, or his boss, the Attorney General,
Given the last six years, given the abuse of the FISA courts, the secret surveillance, the lying about Carter Page, the FBI lawyer who doctored a CIA document to reverse its content, to cast aspersions on Carter Page to justify that warrant, the numerous mistakes or quote-unquote mistakes on those warrants used to spy, spy illegally on members of the Trump campaign,
Neither of these individuals has apologized or even made an excuse.
They don't talk about these issues.
When Ray was on Capitol Hill last week, just before he jetted off prior to the Mar-a-Lago raid, he kept saying, oh that's an ongoing issue, or that's a private personnel issue.
I don't care.
Congress has oversight over your agency.
You don't get to say, I'm not talking about that because it's a personnel issue.

All right, who better to examine the political ramifications of the last 72 hours in America, in the last hour and a half, than the Washington Bureau Chief of the most influential conservative website on the planet.
It's Breitbart.com and he's Matt Boyle.
Matt, I need a sanity check from you.
I'm looking at a Chiron on Fox that says, AG Garland breaks silence on Mar-a-Lago raid.
But he didn't.
He didn't say anything, Matt.
He said nothing.
The news out of this is that Attorney General Merrick Garland said that he personally approved the search warrant.
Just because you have a warrant doesn't mean that you need to do a raid like they did.
In fact, I've talked to many people who've had warrants served upon them in just the past hour.
And many of them say that there are plenty of other ways that are very much less intrusive.
And by the way, it's worth noting that he used that word, less intrusive, in his statement, that they always try to do the less intrusive route.
They did not try to do that in this case.
He did not say during his remarks who approved the raid.
He did not say whether he was aware of the raid.
He did not say whether he approved the raid.
He says he personally approved The warrant.
There is a huge distinction and a difference.
Once they had the warrant, they could have called Trump's attorneys and said, we have a warrant.
We want to come get these documents.
We want to work out a time with you to go make that happen.
Let's make that happen.
Let's work it out in a peaceful way.
But the fact that they decided to do a raid was an extremely over-the-top, historically unprecedented level of intrusiveness.
Yeah, go ahead.
It's exactly the same as Peter Navarro.
If somebody's held in contempt of Congress, what always happens is that the FBI, the DOJ, sends an email or a letter to the person's lawyer and says, you are in contempt of Congress, could your client show up tomorrow at this address?
Instead, they send an FBI team to arrest him and put him at shackles at Reagan Airport.
It's exactly the same, but in this case, it's not a former assistant to the president, it's the former president himself.
Okay, so, That's the legal thing.
Let's look at the political ramifications.
There's this viral video right now that I need you to give me a sanity check on.
This person allegedly once in a blue moon when she was co-hosting or on the same show with Greg Gutfeld described herself as a conservative.
Now she's a contributor for CNN so that tells you a thing.
SE Cup had this to say about the raid on Mar-a-Lago, Matt.
This is a Trump world talking point, that all across the country people are very concerned about the overreach and losing confidence in the FBI and the Justice Department now.
That is true in mega-worlds, but I think most people across the country think if you didn't leave the White House... No, no, no, Essie, come out of the bubble!
Come out of the bubble, Essie!
If you didn't leave the White House with classified documents, you don't have to worry that the FBI is coming to raid your home office.
I think most people think holding even the President accountable is good.
That's a good thing.
That's a sign of a healthy Justice Department and a healthy FBI.
I think this Trump world talking point that the FBI is corrupt and the Justice Department is coming for average Americans Yeah, if they did it for Trump, they could do it to you.
I mean, this is preposterous.
Matt, the idea that the FBI raiding Mar-a-Lago, the President's private residence, is a MAGA world talking point?
No.
Okay, so first off, she's so wrong in so many respects.
What a moron.
But the point is that she's so wrong in so many respects.
Let's unpack all of this.
First, let's get back to the Attorney General's statement.
He said that the Justice Department always tries to be less intrusive.
They do not.
And we can demonstrate that as you point to Navarro, the Bannon case, the Roger Stone case, and now the Trump case.
And there's several more out there as well.
People are rightfully distrustful of the government.
Why is the IRS out there trying to hire armed agents, right?
Like they said that you need to learn how to be armed and use a deadly weapon.
Hang on, hang on.
I haven't even mentioned this.
Let me actually read this.
So this is from the IRS's website.
It's since been taken down, but this was up there until yesterday.
If you are applying to a job at the IRS, your major duties include, I'm reading it from the IRS website, to carry a firearm and be willing to use deadly force, Matt.
This is the IRS.
So, and again, what's happening right now, and you're seeing this play out in every respect in all of these fronts, is that the deep state, the permanent state in Washington, D.C., the federal law enforcement, all of these intelligence agencies, etc., whether it's the IRS, whether it's the FBI, whether it's the Justice Department, whether it's the IRS, whether it's the FBI, whether it's the Justice Department, CIA, the National They're all being exposed.
They're all starting to fight with each other.
And Trump is fighting with them.
And it's also worth noting that this is all happening on the backdrop of President Trump talking about using Schedule F upon his reelection to reclassify all these career government employees from GS-13s and 14s and 15s into being Schedule F employees, which means they can be immediately terminated in their at-will employees rather than this permanent protected class.
That's why they're doing what they're doing.
They feel threatened by Trump, so they're behaving in an extraordinary and extreme manner that isn't in line with what the attorney general just said.
I think that this has been coming for a long time.
I cut my teeth as a young reporter reporting on Justice Department scandals during the Obama administration, during— Remember Operation Fast and Furious?
I broke tons of stories on that whole scandal and the way that Eric Holder mishandled it.
And so on and so forth.
I think this has been coming to a head for over a decade.
The politicization of the Justice Department under Democrat rule in Washington, D.C.
is now out in the open.
They've grabbed every American's attention.
And now we're going to start getting to the bottom of it for real.
They are reeling.
And so it is imperative that every Republican member of Congress get engaged on this now.
Every candidate across America is prepared.
If the Republicans take the majority back in either the House or the Senate, they need to be ready to roll on day one.
Merrick Garland, the second they swear in a new Speaker in the House of Representatives, they need to have Merrick Garland there testifying that day.
That day!
They cannot wait till the next day, they cannot wait till the next week, they have to move immediately.
Matt, we'll see whether the leadership has the spine to do that, but here's the really big question.
Um, Breitbart wrote a story about it.
The day of the raid, I said that they have declared war on 74 million Americans.
I correct that.
I think by now, especially given the pathetic press conference, it's probably closer to 94 if not 100 million Americans.
What are the political ramifications of Mar-a-Lago?
I think my old boss, President Trump, is the strongest he has ever been.
Am I reading too much into this?
No, you're 100% right.
And it's not just a war on the Trump voters or even beyond that, independents and so on and so forth.
I think it's a war on the Biden voters, too.
Everybody who participated in democracy in America, everybody who voted in the last presidential election or the one before that or the one before that, they all had their rights just trampled on by the Justice Department.
This was an affront to the American people.
And when I say they grabbed all of America's attention, anyone who took the steps to cast their ballot and make their voice heard in this democracy, no matter who you voted for, you had your rights trampled on by this action.
And their lack of serious explanation or clear details about what they did and why is going to cost.
It's going to haunt them forever.
This was a true affront and I think that we're not even in the top of the first inning yet.
We're in pregame warm-ups for how big of a scandal this is going to become.
This is going to become the biggest scandal in American history.
It's going to make Watergate pale in comparison.
Every person who was involved in this needs to be held accountable.
We need to know every little detail about it, every little email, every little possible decision-making process along the way.
We are just in the very beginning of this, and it's just getting started.

Uncle Tom 1 talked about post-slavery Black America When the obstacles were absolutely horrific.
You had the Klan.
You had lynchings.
You had Jim Crow.
Yet, black America steadily moved forward.
The GDP steadily grew.
In 1940, 87% of blacks lived below the federally defined level of poverty.
20 years later, that number had dropped to 47.
A 40-point drop in 20 years.
The greatest 20-year period of economic growth in the history of black America.
Why?
Family.
God.
Entrepreneurship.
Fast forward, now 70% of black kids are born outside of wedlock.
There is almost an anti-entrepreneurship attitude led by people like Black Lives Matter.
These are co-founders of whom are trained Marxists.
Marx, as you know, wanted to dethrone God.
Marx did not believe in private property.
So the values that made black America struggle and continue to grow post-slavery have now been turned on its head.
It has been co-opted.
A movement that was justifiably won for equal rights has been turned into one for equal results, led by people like Black Lives Matter, Al Sharpton, and they have now made blacks angry, bitter, and believing America is systemically racist when, in fact, racism has never been a less significant factor.
What's going on here is the family has broken down, and the welfare state has incentivized women to marry the government and incentivized men to abandon their financial and moral responsibility.
And that's why we have these problems.
Larry, a stupid question, naive question.
Why isn't black America angry at the people who destroyed their culture?
That's a good question, and they ought to be.
I don't know that they are aware of how Marxists, socialists, collectivists have co-opted this movement.
The NAACP was founded by white socialists.
They had a black figurehead named W.E.B.
Du Bois to lead it, but it was white socialists who founded the NAACP.
And by the way, Du Bois later on defected, became a communist and went to Russia.
He was engaged in an ideological battle with Booker T. Washington, who believed in hard work and thrift and entrepreneurship.
Meanwhile, the Tuskegee Institute that was founded by Booker T. is still here, But W.E.B.
Du Bois defected to Russia, and look what happened to his career.
The bottom line is this.
We need to get back to God.
We need to get back to family.
We need to get back to entrepreneurship.
The spirit of hope and optimism that allow Black people to struggle mightily and, as I said, make steady progress.
There's a book written in 1901 by Booker T. Washington, Sebastian Cole, Up From Slavery.
That's just 36 years after the Civil War.
And in the book, he said, when a Negro boy learns to cook, to sew, to wash dishes, to practice medicine as well as or better than anybody else, he or she will be rewarded without regard of color.
Fast forward, you have a bunch of people now demanding reparations and pushing critical race theory as if America is intrinsically racist still when they've elected Barack Obama, who got a higher percentage of the white vote than John Kerry did, and got reelected even though he had a lousy economic recovery.

Larry, you watched The head of the Department of Justice, who was supposed to explain why they did something that's never happened before in American history, which is to raid armed agents, raiding the private residence of President Trump.
Your reaction as a man of the law and as an American?
And Sebastian, my first job, my first legal job was a law clerk with the L.A.
County D.A.' 's office, so I know a little bit about prosecutions.
And you heard A.G.
Garland say that the better course is to do something far less intrusive.
He didn't do that, which meant he felt this was something that was worth all of this.
The double standards just slap you in the face.
You've got, of course, Hillary having the unsecured server in her private basement, sending and receiving classified information, lying about sending and receiving classified information.
You have the fact that Joe Biden is clearly compromised, referred to as the big guy, getting 10 percent, yet, as far as I know, no criminal investigation against Joe Biden.
But one of them that is really blatant to me, Sebastian, ... is when AG Eric Holder was the first and only sitting AG ever to be found in criminal contempt of Congress for failing to turn over papers regarding Fast and Furious, that drug-running operation that, for reasons that still are a mystery, that the government allowed to happen.
He didn't turn them over.
He was sued by the Republicans.
And the judge, who was an Obama-appointed judge, made them orchestrate some sort of settlement, so the documents were turned over four years later.
So, a four-year cooperation talks, but Donald Trump's been out of office for a year and a half.
And my understanding is they only wanted these documents in February.
And Eric Holder was allowed to negotiate for four years.
This is absolutely outrageous.
It is unprecedented.
Everything that people have been talking about, this is a likely opponent in 2024 against whoever runs.
I think Kamala Harris is going to be the Democratic opponent, and you're having the sitting DOJ investigate him, and you can't figure out some sort of way of doing this in a much less intrusive way, it's outrageous.
And what's happened here, if you look at the polls, the polls show a greater number of Americans don't believe Donald Trump orchestrated a coup on January 6th, and a greater number of Americans believe he had nothing whatever to do with why there was a riot in the Capitol building on that day.
So the whole point behind the January 6th televised hearings has been to harm Donald Trump and to make it less likely he's going to run in 2024.
That's not working, and this is going to make it more likely that your former boss is going to run again Well, this is the question I wanted to ask you.

He should be locked down in a prison cell for his culpability in terms of the people who died, not because of COVID, but because they didn't get medical treatment, they weren't scanned for cancer because of his decisions.

Talk to us about the the mansion bill and how it's going to save the environment, Mark.
Well, this is a bill.
This is fascinating.
We had, again, when Manchin said he wouldn't support it, we had climate activist Bill McKibben, friend of Al Gore, actually say the Earth's geologic history would be altered.
We're going to have to name a new epic after Senator Joe Manchin.

You had the Holocene, the Jurassic, and now the Manchus scene.
This was insane.
They actually believe a pork barrel spending bill can impact the climate.
So what's happened now this past week, first of all, it's an IRS audit bill is what it's turning out to be the most impact this is going to have.
But the World Economic Forum did a video praising the Manchin-Biden climate bill.
And in it, they actually talk about the bill promoting climate-smart agriculture.
Now, when the World Economic Forum is praising Joe Biden's Green New Deal as climate-smart agriculture, isn't that what we call happened in Sri Lanka, where they toppled the government with their farming experiment, or what's happening in the Netherlands, or what's about to happen in Canada, or what's actually about to happen the same exact thing in Australia?
And basically what it means when they say climate smart, it means Bill Gates and or China or equity asset firms are going to take over all the family-run farms and they're going to run it at the behest of environmental, social governance, the United Nations and what the World Economic Forum.
Be afraid.

And to the extent there's concerns about the non-production of the e-mails, I think she has enough insulation between her and those production issues that barring some other real smoking gun, I don't see it.

This whole guy, unethical.
He was Team Epstein, even after he was a convicted pedophile.
And he cheated the system to get there.

I'm not sure there's a real person like that in America.
An individual who straddled counter-terrorism, prosecutor for the Department of Justice, intelligence investigator in Congress, and then chief of staff of the Pentagon.
And I've left out about 48 million other things.
But in this case, it's not.
A fiction.

I have so many things I want to dissect with you.
Let's start by... Let's talk about clearances and classified information.
Yeah.
So I've still got my clearance.
I gained a clearance.
I had a clearance, a secret clearance in the British Army.
I got a TSSCI in the White House when I came in.
And I think most people don't understand why the clearance system exists.
and why we have classified information and who the intelligence agencies of America work for.
So would you, as somebody who's worked in Congress, convicted terrorists of the DOJ, ran the Pentagon, why do we have intelligence services and who are they writing their classified products for cash?
Yeah, that's a great starting point.
We'll get to their failures in a second, but classified information serves a purpose, Seb.
It's to protect American national security interests, which means you are protecting Americans.
And sometimes the information is so sensitive we don't want it out there in the public, i.e., we don't want to tell Baghdadi that we're coming to get him because we put it out on Twitter.
We don't want the Facebooks of the world to know the positions of our hostages before we go and get them.
Those are just two obvious examples, but The better point is the intelligence collection doesn't always necessarily lead to an end state.
It shapes policy at the White House on how we defend against Russia, China, and Iran, the largest state sponsor of terrorism, and the like.
So there is a need and a purpose for classified information, but the over-classification of information has become a systemic problem, and the failure of agencies to be able to share with each other is another problem that I tried to fix when I was Deputy Director of National Intelligence.
We'll talk about what you did at the Office of the Director of National Intelligence, but when it comes to the end user, ultimately, who is the decision maker that these agencies are serving?
Who needs to get the daily intelligence briefing cash?
No, that's right.
It's created for one thing, the PDB, the Presidential Daily Briefing.
The Director of National Intelligence's main job, overseeing the IC, is to call information and take presidential directive and say, OK, this is what the Commander-in-Chief wants to focus on.
China, Russia, counterterrorism, Iran, the border, countering narcotics.
This administration wants to focus on, you know, the setting of the sun, but that's a different story.
But when you prioritize national intelligence collections efforts to things that matter, And then you put them in one space, you present them, as I did, to the president as a presidential daily briefing.
And his cabinet secretaries have access to that information as well at the highest classification levels, because we want Americans' policy to be dictated by intelligence that is actually provable, not on hyperbole and the fake news mafia.
So these reportings—another reason why classification is so important is because that information shouldn't be out there to the rest of the world.
But the problem is people have overclassified things and continue to do so to hide failures in government.
Yeah, that's why Sandy Berger, Clinton's national security advisor, walked into the National Archives and stole the highest classification documents that were embarrassing regarding al-Qaeda and the Clinton administration, stuffed them in his underpants and his socks, took them out of the building and burnt them and stuffed them in his underpants and his socks, took them out of That is not what classification is for.
All right, let's talk about the Raid of Mar-a-Lago.
I had a government clearance.
I maintained it because of some work I do as a contractor outside of government.
But we have this system in America where directors of agencies like the CIA, cabinet members and former presidents Retain their clearances.
They have legacy clearances.
They don't have to re-up them every five years.
They don't have to have an excuse.
So explain to me, with what logic could you raid a president's home if he still has the highest clearances, Kash Patel?
You can't, with the logic of politics.
The Department of Justice has become the Department of Politics, and so has this FBI.
Because nobody's raiding Barack Obama's home, where he has 30 million pages of information, a lot of which is classified.
He hasn't released one single page of it to the National Archives.
Here you have President Trump, the most transparent president in modern American history, giving documents in the National Archives, declassifying them, and telling them to get them out, but only to have the National Archives.
And I know this because I'm President Trump's representative to the National Archives and have been fighting to get these documents out.
They're not raiding Obama's home.
They're not raiding Bush's home.
They're not raiding Jimmy Carter's home.
They're not raiding Bill Clinton's home.
And this is the hypocrisy in the two-tier system of justice on full display.
He wants the American people to see the documents that show the corruption.
And, you know, this is me just making a guess, but I think the documents that they seized at Mar-a-Lago show more government corruption by the FBI and DOJ.
And if that's the case, it shows the politicization of our law enforcement, just like when I ran Russiagate.
Remember, Devin and I only got 60% of the documents out.
President Trump declassified the rest, but because of bureaucracy and the White House counsel, they were never released.
We're going to have to spend time on that question.
In the past.
I mean, this is not a novel challenge or issue.
Nixon, there was a debate for years, for years, between the U.S.
government, the National Archives, and the Nixon estate as to which documents were personal and pertained to him and were to be kept by him and which has to be surrendered back to the archives.
The way that was settled, Cash, was years and years of litigation and discussions.
Correct me if I'm wrong, never before in history was this question resolved by a raid by 30 FBI agents in plainclothes.
Yeah, that's not how law enforcement works, and you know that, Seb.
It's how politics works.
It's when you have an attorney general who essentially is beholden to the radical left agenda, and when you have a director and Chris Wray at the FBI who is beholden to nothing but his own ego, And fails to understand the simplest constitutional oversight requirements, like you saw when he appeared before Senator Grassley last week to demand questions about whistleblower protection and also comment on the Russia hoax.
And he failed to do all of it.
He failed to, he didn't even know that some of his top lieutenants at the FBI were the same corrupt FBI agents who broke the law in the Whitmer prosecution, which resulted in the Brittles, in the Russiagate scam, in the Hunter Biden hypocrisy.
We're going to get to the bottom of this.
A lot of lies and misrepresentations.

There's no question they didn't run.
You're not going to bust into a former president's house without telling the White House and getting them sign off.

The director of the FBI, because they're FBI agents, had to know, given that there is nothing more sensitive than burglarizing or raiding a president's home, former president's home.
And of course, because the FBI works for the DOJ, the DOJ had to know.

But the issue is, you look at how these people testify.
You look at how these people hold themselves in public.
The Attorney General, Garland, is a pathetic shadow of a man.

Likewise, Ray, who was described to me by a late, dearly missed senior FBI agent as the guy who arrived and spent six months hiding under his desk on the seventh floor.

I look at these people and they're devious.

And if you mishandle classified data, you can be disbarred from office, which of course doesn't apply to a president because there's only three requirements to be president.
Natural born citizen, 34 years old, and resident in the nation 14 years.
So he's a moron!
And not only does he not know the law as a lawyer, secondly, if you're such a great master strategist, Cash, you don't tweet out the plan!
Am I missing something?
Well, I don't think you don't ever really miss much, and I don't think you're missing anything here.
I think what he's relying on is the same strategy he ran during the Russiagate hoax.
He knows the mainstream media will perpetuate that lie.
He knows it doesn't apply to the president, but he doesn't care, because he wants CNN and The New York Times and The Washington Post to do it, because they will educate half of Americans with a disinformation campaign like they did when they said Donald Trump was a Russian agent, and we're still fighting that argument today.
And what they will do is convince half of America that, oh, President Trump can be disqualified?
This is how we'll do it, even though they don't care about the law or the facts or the Constitution.
So he is good in that regard that he's an evil person to plant this false information, because he knows the media, who he works with through Fusion GPS, and gets paid millions of dollars to do it.
He knows that he will continue to do this work.
And I don't know why John Durham has not indicted this man for his involvement in Russiagate.
And that Axios story of the, you know, the handwritten Sharpie notes down the toilet, that whole thing, that's got to be Mark Eli sending bogus photographs to Axios, right?
Well, I mean, Axios is, you know, basically gutter trash.
Their reporting is, you know, we talk about it when we are talking about things you put in the toilet.
So I don't really believe anything, nor do I really read them.

And I know you and Rick had a very limited time at ODNI, the Office of the Director for National Intelligence, but when President Trump says, I'm the president, the classification system works for me, exists for me, I've been elected by 64 million people, declassify the garbage that is the Russia hoax, he is, and I know I'm being naive, but walk us through the obstacles.
Why couldn't you and Rick Literally take the bags of garbage crap that was classified, you know, sharpie out the classification and said, and put a stamp on it, declassified by POTUS today and just given it to Salem, given it to Breitbart, given it to Newsmax.
Why was the establishment so effective in slow rolling the president?
The establishment had seeded people who were against President Trump's agenda in places like the White House Counsel's Office, such as Pat Cipollone, to bureaucratically impede the release of information that we knew would not jeopardize national security and not destroy foreign relationships, but they knew would embarrass the FBI and DOJ, places where they used to work and champion.
And they didn't want that to happen.
And that goes the same for Bill Barr.
And so, you know, we should have just bulldozed them because the president Declassified it, so that should have been it.
But we relied too much or allowed too much of the bureaucratic machine and the never-Trump-er deep staters to get in there and say, no, no, no, we have to slow the process down.
And you're right.
Rick and I did put out a lot when we were running ODNI, and Johnny Ratcliffe did a great job thereafter doing the same.
But here's something I'm learning, Seb, about the raid on Mar-a-Lago.
If the FBI—if it's shown that there's more documents that the president declassified—and remember, he put out a sweeping statement on October 2020 and then declassified whole sets of documents while leaving the White House.
If they are—these documents are the ones that show the FBI corruption that Devin Nunes and I found that were never released, they're going to have a big problem on their hands, because they are—this is the ultimate act of a cover-up If it shows, and I believe it does, I don't have any personal insight, but I believe it does, if it shows the further corruption and unlawful activity to surveil President Trump with the help of the Democrats.
So this raid could have been to cover up and hide the declassified proof that the FBI is corrupt, that's what you're saying?
Look, they did it once before in Russiagate, why would they not do it here?
I firmly believe that's the reason that they were in there.
Let me just ask a very prosaic question.
I've handled classified information, I've handled declassified information, but I've never been involved in the declassification of information.
In theory, Could President Trump say, all of this information is declassified now?
Or would it have to be run through the system?
Could a president say, everything that pertains to Michael Flynn's spurious prosecution is declassified as of now?
Could he just do that?
A sitting president can do that.
And he did that via—what's it called?
Via statement in October of 2020, he decossified all of the documents related to Russiagate and all of the documents related to Hillary email investigation.

So he already did it when he was president.
Why they're not out is the real question.
And I think it's directly connected to this raid at Mar-a-Lago.
And maybe the FBI will finally release it.
I doubt it.
But if it shows an FBI cover-up, And the further erosion of a power by the Department of Justice to carry itself out unlawfully, you know, I thought the country was at a tipping point before, and then we got to the raid at Mar-a-Lago.
If that proves to be the case, I don't know that these institutions will ever recover.
Aren't you disappointed, as I am, that just the agents, just the special agents, didn't refuse to execute that warrant, Cash, and just say, no, sorry, here's my badge, here's my gun, ASAC, or whoever you are?

Look, I don't know if you subscribe to this and I'm leery of getting out over my skis or celebrating, you know, before the chickens are hatched, but I do think that Lisa Monaco, Mark Elias, A.G. Garland, Director Wray, have made President Trump probably more powerful than he's ever been before.
When you've got Andrew Cuomo, right, when you've got Randy Andy saying, the DOJ, the DOJ better have some fire to this smoke, otherwise it's going to look like a political stunt.
When you've got Randy Andy saying that on Twitter, the Democrats are in trouble.
So, So I think he's stronger than he's ever been.

About two years ago, two and a half years ago, I had a former counterintelligence professional, great guy, Chris Farrell, from Judicial Watch, in my old studio.
And I asked him, so what do we do about the Bureau?
It's corrupt.
If you look at Russiagate, you look at FISA, you look at Flynn, you look at Manafort, they're just corrupt.
And he said, you have to send in the marshals, because they're still clean, and you have to dismantle the FBI.
Three days ago, VDH, the smartest guy I know, there's two 80-pound brains in America when it comes to politics.
There's Newt Gingrich and Victor Davis Hanson.
And Victor Davis Hanson said on TV, the FBI has to be broken up and its departments scattered across the US government.
You've been in it.
You've worked I've looked at the DOJ.
I've only educated and trained the agents and SOS and the IAs.
Can we fix it?
Because I don't buy it when people tell me, oh you just change the seventh floor and you get a new director.
That's not good enough as far as I'm concerned.
So you give me your vision.
If you are, you know, Chief of Staff of the White House, you're the next Attorney General, can we fix the FBI?
What do we do with the FBI?
Yes, we can.
And people might say, you know, just find that dismissive or naive.
But it's a combination of the things you and VDH lined out, and I've been saying for a long time.
Personnel at the top matters, but not just at the cabinet level, at the deputy level, at the chiefs of staff level, at the undersecretary level, at the special agents in charge level across America that run every FBI office.
That's the starting point.
Then you need your people in each legislative affairs office to be one of yours.
You need a general counsel that supports the president that was elected by the people of the United States of America.
You need a press office that won't leak and refer prosecutions for leaking of classified information immediately.
But the other thing you need to do is the FBI mothership in DC is way too big.
It does need to be blown up and spread out throughout America because we need more agents in the field.
We don't need any more agents in Washington DC hijacking investigations and corrupting them like they did Russiagate, like they did Hunter Biden, like they did Hillary Clinton email, like they're doing to President Trump now and January 6th and so on.
People are sick and tired of Washington because these big buildings exist here and they are creating a government bureaucracy that doesn't need to exist and what they're Incentivizing people to do in those agencies is, oh, you gotta come to DC to get your big promotion.
No, we don't want you here.
We want you in the field.
We want you overseas doing the work we paid to train you so much to do, because America needs that.
So when you send people back to the field, like when you send CIA case officers back to collect information instead of doing political actions back at HQ, that's how you fix it, along with the complete total overhaul of leadership.
But you've got to send people out to the things they were hired to do.
And not serve in DC.
I think if you don't do those two things, and a couple other things I mentioned, you can get your way back to restoring faith in these institutions.
Let's talk about those other things, because in a recent TV interview you gave, I think you used the phrase the government mafia, and I'm going to use that phrase because you're absolutely right.
That is what we have.
We have a government mafia, whether it's the 87,000 new IRS agents who you know will be used to target conservatives.
Whether it's, you know, the NSA that I was told had a four-man team that was actually surveilling Steve Bannon, myself, and others whilst we were in the White House.
Whether it's the FBI, the DOJ, all of this stuff.
You used a very powerful phrase, government mafia.
We've just discussed the FBI.
What else needs to be done?
And, more importantly, you're talking about having your person in place who's, you know, going to stop the leaks and everything else.
Do we have the requisite bench, Kash Patel?
Do we have enough people who actually believe in the Constitution, believe in one judicial system where all are treated equally to man those positions?
I think we do.
And if there was ever a shortage after last night's raid on Mar-a-Lago, I think we got a whole lot more.
And I say that half-jokingly, but like you pointed out, so many people on the radical left are coming out and saying, wow, we just maybe handed it to Donald Trump in 2024.
Think of how many people in the middle are actually going to be like, forget this bastardization of the Constitution.
I didn't sign up for this.
I'm with you guys now.
So I believe we have the bench in place.
But what we also need, Seb, It's a righteous Congress to act.
We need Kevin McCarthy to come in, if he's the Speaker of the House or whoever, to come in and say, yes, not only are we going to investigate Merrick Garland, the Attorney General, and the FBI director, and the agents below him, and the AAGs at the DOJ who've politicized it, but we're going to hold you in contempt of Congress and prosecute you when you fail to abide by a congressional subpoena.
We are going to get the documents out at Congress.
That these agencies won't give us.
That's the starting point.
That's what we do first in November.
And then we lead up to 2024 where we build the bench that we have and put them in the places we need to be.
But our Congress has a call to action to answer come November.
And if they fail, we won't be able to get it done.
I asked you who's behind the current criminal activity.

And what do they do?
Let's go hire these guys.
They're our people.
We can trust them.
Let's have them go to the FBI through cutouts.
Let's have them go to the CIA directly and funnel information about a fake Russia bank narrative and a fake Russia hoax that Donald Trump is a Russian asset and use the FBI and DOJ to corrupt them.
And they got their cronies in those institutions to certify the warrants and the searches and go before their fists.
And they got those cronies in the IC to believe, to force the issue that there was this Alphabank server connection at Trump Tower.
It turned out to be a total hoax.
And they wiretapped the White House.
This has to start from outside of government, and that's where it started with, was the Mark Elias and Michael Sussmans of the world, and it of course quickly spread to Fusion GPS, and then they used their political context, like the Bruce Doors of the world, like the Clappers, the Brennan, to seed this information in government, because they knew, they knew they would willingly take it.
