The judgment of the Fifth Court is reversed, and the case is remanded for further proceedings consistent with this opinion.
It is so ordered.
By a majority of the Supreme Court, Roe v. Wade, Casey are dead.
Just before the 50th anniversary of Roe v. Wade, the justices have restored order to America.
They have torn up the false decision that found a penumbra to privacy justifying the execution of the unborn in the Constitution.

This is the most monumental, significant, consequential decision.

This is the most consequential decision of the Supreme Court.
Ever.
Since the history of the founding.
I mean, truly.
The Civil War brought justice to the enslaved and a president emancipated them.
But this applies to all races.
It applies to the most vulnerable.
There has been a black holocaust in the womb.
Now, I understand that abortion isn't now illegal in America, but as this document I have in my hand states, it will now be decided, as it should in a republic of states, by the people in those states, the citizens of Texas, Massachusetts, Nebraska, Iowa, California, New Hampshire,
will argue amongst themselves, will have to convince each other, their representatives will have to make arguments in the legislatures of those states.
As it should be, because in the Constitution there is no right to kill the unborn.
There never was.
After yesterday's decision, on the birthday of Justice Clarence Thomas, signed by Justice Thomas, that states, oh yes, there is a right To bear arms in the Constitution.
These two decisions together are history.
And can I be very clear?
Very, very clear.
Roberts is not a Conservative.
He dissented or refused to fully concur in one of the decisions.
He kind of tried to be Solomon and split the baby.
Again, showing how garbage he is.
But to the five real Conservative Justices, Thank you.
America thanks you.
The unborn thank you.
And our civilization thanks you.
For holding the line, the left tried to sabotage justice.
The left tried to leak these documents.
The left tried to intimidate you.
An assassin traveled from California to murder one of you.
But you held the line in the spirit of Clarence Thomas in front of Senator Biden who said, I will prefer to die than withdraw from this confirmation process which has become a high-tech lynching.
That is, that is being a man.
That is being an American.
That's being a Christian committed to the truth.
God bless every single one of you.
And especially we must be grateful to the three new justices.
To Kavanagh Gorsuch and Amy Coney Barrett.
But there's one more person we need to thank.
Today's decision would not have occurred Unless the 45th President of the United States, Donald J. Trump, had nominated those justices.
And more importantly, because it's one thing to nominate, But when he stood by them, when Kavanaugh, a godly man, a good man, was outrageously calumnied, smeared, accused of being a serial rapist who drugged his victims, President Trump knew it was a lie and he stood by his nominee.
So as you give thanks tonight, let's celebrate tonight.
Let's give thanks.
Let's pray to the Almighty and thank him for what he has done to keep those justices holding the line, committed to truth.
Let's thank President Trump and perhaps today his detractors.
We'll think twice.
Perhaps today, the Never Trump movement, the bulwark, the Lincoln Project, will finally be flung onto the ash heap of history.

It's a realization of an extreme ideology and a tragic error by the Supreme Court in my view.
The court has done what it has never done before, expressly take away a constitutional right that is so fundamental to so many Americans that have already been recognized.
And then eight, nine.
Clearly, we hope that the Supreme Court would open its eyes.
But to see the Chief Justice side with this radical agenda, it's just stunning.
And again, as a woman, as a mother, as a grandmother, to see young girls now have fewer rights than their moms, or even their grandmothers, is something very sad for our country.

Today, the Republican-controlled Supreme Court has achieved their dark, extreme goal of ripping away a woman's right to make their own reproductive health decisions.
Because of Donald Trump, Mitch McConnell, and the Republican Party, their supermajority in the Supreme Court, American women today have less freedom than their mothers.

So when did you get to the Supreme Court, Mary Margaret?
So I got here at 9 a.m.
this morning because we knew the decision would drop at 10, but we had to be here just in case anything was going on.
And as usual, you know, you have the pro-life protesters on the right, pro-abortion protesters on the left.
And when they mingle, the police get involved and tries to go in between.
And so this morning there was a lot of that going on.
The police kind of made a line in between them with their bikes and they were protecting the pro-life protesters from the pro-abortion ones.
It was getting a little rowdy.
And then right at 10, the first decision came out.
We were all breathlessly waiting, and it wasn't Dobbs.
It was another one.
And right at that moment, the police line pulled out and left the area.
And I asked one of the cops, I said, Wait, are the police coming back?
What's going on?
And they said, Yeah, they're coming back.
They're just leaving for a moment.
And then, you know, the next thing we knew, the next decision had come out.
And lo and behold, it was Dobbs.
And the pro-life protesters start freaking out.
They're exclaiming and screaming with joy.
Pro-abortion protesters were kind of quiet for a minute, and then all of a sudden, they all broke out and chanting that it was illegitimate, over and over, illegitimate, illegitimate.
And just the atmosphere around the court just kind of exploded.
You know, nobody could believe that this had happened.
Roe v. Wade was overturned.
And in the next ensuing couple hours, tons of protesters have come.
The streets are filled It's dying down a little bit right now, but about an hour ago, it was very hard to get through the crowd.
And I believe AOC came down and tried to get through the crowd, and you could barely move.
Everybody was trying really hard to see her, they were really close together.
And it's still pretty crowded down here.
All these protesters, a lot of them seem pro-abortion, but there's plenty of pro-life ones too.
So tell us, I'm curious, just before the decision was announced, you said the police withdrew, but they had to come back, correct?
Yeah, they did come back, and they're still here now.
I mean, there's a lot more now.
They're on motorcycles.
They're on bikes.
There's a lot of police cars.
There's some tank-looking situation I saw, and then there were even police and riot gear that we saw earlier, but I haven't seen them for a little bit.
And what's the tone right now as we are speaking?
It is 3.24 p.m.

What is the mood of either side?
Paint us a picture.
Has it settled down?
I mean, I can't stop smiling.
I've been grinning all morning and afternoon.
So give us a picture of both sides now, a few hours in.
Well, everybody's milling around.
There's a lot of signs.
Plenty of protesters on both sides of the aisle.
It's kind of got a little bit of a, it's just a very tame protest vibe right now.
I think it will be fine.
I'm a little worried about how things will go after dark, but that remains to be seen because we know that Jane's Revenge, that pro-abortion accused group, has called for protesting after 8 p.m.
on the day that Dobbs' release row was overturned.
We will see.

Yes.
You know, the Qualified Opportunity Zones were really the brainchild during the Trump administration in the 2017 tax cuts and jobs tax.
And it was championed by Ivanka Trump in the White House.
And since 2017, there's been more than $20 billion that have been invested in Qualified Opportunity Zone investments.
And I think it's just a tremendous success of the Trump administration to bring capital and jobs into these previously overlooked areas.
So what kinds of things are in a Qualified Opportunity Zone and how does your company and the whole DST setup fit into it?
Well, first of all, it's an incredible tax advantage.
There's three components.
The first one is deferral.
The second is exclusion.
And the third is shelter.
So if you invest in an opportunity zone, and this can be the capital gain from any kind of capital asset, it could be real estate, it could be stocks, it could be bonds, art, jewelry, you name it, any capital asset.
If you invest the gain, just the gain portion, not the basis, but the gain portion within 180 days, Then you can defer your capital gain tax until December 31st, 2026.
Then secondly, there's an exclusion.
If you keep the investment in the Opportunity Zone for 10 years, you get a 100% exclusion on the back end.
There's absolutely no capital gain on the appreciation of these properties on the back end.
Hang on, hang on, hang on.
That has to be repeated for our millions of listeners.
That is stunning.
So if you choose to invest in one of these Trump-era Qualified Opportunity Zone investments, What happens if you keep your money there for 10 years?
Repeat that for us, if you would, John Harvey.
It's a 100% exclusion.
Actually, it's even more exciting than that.
You bring your tax basis to 100% of the sales price.
And what that means, Dr. Gorka, is that if you've taken depreciation over that period, which we will, to shelter the cash flow from these investments, Then we do not have to recapture that depreciation on the back end.
It's a 100% exclusion based on a 100% step up in your basis.
It's an incredible opportunity, and especially since most of these deals are development deals, and they're projecting two and a half, three and a half times your original investment.
So, this is, you know, as a layman, as, you know, a guy who just does a radio show, I have to ask you this question always, because the first time I met you and your amazing team and I learned about, you know, deferred tax, the sheltering of tax, the exclusion, I wanted to ask you, why isn't this better known?

And of course, one, two, three of them were nominated thanks to President Trump.
Now, let's get back to Joe Biden, who thinks abortion should be tragic, or at least he did think that 16 years ago.
This is, well, he tried to say something today, but it was stumble after stumble after stumble.
This is Joe Biden today on Today's Decision.

Make no mistake, this decision is a culmination of a deliberate effort over decades to upset the balance of our law.
It's a realization of an extreme ideology and a tragic error by the Supreme Court, in my view.
The Court has done what it has never done before, expressly take away a constitutional right that is so fundamental to so many Americans that it had already been recognized.
Real speech impediments today.
Anyway, I want to use this.
You have a real historian's streak in you.
You understand the context in which this 49-year fight has been fought.
16 years ago, It's a tragedy, every abortion.
Today, it is a tragedy that the Supreme Court overturned Roe v. Wade.
Isn't this, in a nutshell, Barron, what has happened to the Democrat Party?
And it's what the swamp is.
It's what the establishment is.
It's also very troubling to see that comparison of Joe Biden, you know, not even 20 years ago, and Joe Biden today.
You know, we cannot go without pointing out that you're talking about a different human being.
I mean, Joe Biden can't get through a sentence.
He can't make a point.
He doesn't know what he's talking about.
Constitutional right now, it actually expressly is nowhere in the Constitution.
And let's be clear for the audience.
What the Dobbs decision does is puts this issue back to the states, exactly where it should be.
Justice Blackmun, who wrote Roe v. Wade, admitted that that opinion was not based in any specific right, was not based in the Constitution.
They literally made it up.
So now, it is not that abortion is prohibited across the country.
It is that states are no longer prohibited from exercising their correct and honest and honorable Tenth Amendment rights.
So if the state of Alabama wants to outlaw abortion, it is free and able to do so.
And that is a major win for the rights of the unborn.
It is a major win for the Constitution.
And a huge win for President Donald J. Trump and MAGA.
It is a huge win.
It's a historic win.
Perhaps the most important Supreme Court decision of the modern age.
However, at the same time, just moments ago, the House passed the new gun control bill with 14 House Republicans voting with the Democrats.
Disgusting.

And there's more to come, because the elections have consequences.
Now, we also know there's stolen elections.

That's why Joe Biden gets to mess up our country as bad as he has, but we hope that that's just a short-term issue that once MAGA takes over the House and the Senate in January of 23, we'll be able to start fixing it and then really fix it once, as we hope and expect.

No, the other big point, and this is a really serious point, and we saw this on Voting Integrity too, and we've already seen the President do this, who just lies with such wild abandon.
He basically said, we are a shame before the rest of the world.
And Trudeau said the same thing.
Somehow, like, we're horrible now because we don't permit unlimited abortion.
Oh, no, no, we're horrible because we allowed states to decide.
But here's the deal is, is most European nations have much more restrictive abortion laws in the United States.
And so, but here's what happens.
Europeans hear Joe Biden say this, so they will attack Americans.
They will attack conservatives.
They will attack us for, you terrible people.
Why are you, why are you being so awful?
And then we say, well, you realize, of course, your laws are actually Stricter than ours.
Stricter, right.
France is a much more restrictive abortion than we do.
So ours were like China and North Korea, our laws.
And I saw the same thing on election.
I was meeting with an ambassador who said, why do Americans want to keep people from voting?

But to your earlier point about the Hyde Amendment and how Democrat administrations or left-leaning ideologues like to impose their values on other nations through the aid system.
Gotta ask your take on the pride flag being flown over U.S.
embassies, including the Vatican Sea.
Is this wise diplomacy, Jim?
Well, from a couple of aspects, it's wrong.
First of all, it is cultural imperialism.
They bring people to college and say, oh, how awful these imperialists were imposing their values and their dress.
What are we doing?
We're imposing a leftist political agenda on another culture who often think it's completely inappropriate and it's wrong.
So it's wrong from that perspective.
It's absolutely wrong because it perverts the meaning of a U.S.
embassy.
A U.S.
embassy is there to reflect America.
Not a particular political ideology, not a part of America, not a pride flag, or a Black Lives Matter flag, or quite honestly, even a POW MIA flag.
It should be an American flag, and that should be the only flag flown, so there should be no dispute about this.
But this gets back to the fundamental things about how what's changed.
You used to say that Politics ends at the water's edge.
That foreign policy should be an area where we make the decision on what to do solely based on interest.
In the American party that Joe Biden is the head of, politics don't end at the water's edge.
Foreign policy is an extension of domestic politics.
This is a really important point you've made before, that their ideology, permeates everything they do, including actions outside of America.
Right.
And what's so malicious about it is it's all framed as we're just being diverse.
We're just being inclusive.
And they're not.
What they're doing is they're taking an overt political agenda and they're masking it as fairness and they're foisting it on foreign countries.
They're foisting it on little kids in school.
They're foisting it on cadets at West Point.
And also on civil servants.
If you're the guy having to pull up the rainbow flag on the flagpole in the Vatican embassy, maybe you disagree with that.
And look, and what they're doing, and this undermines the fundamental premise of government, which is government, the people as a whole elect a government.
The government's then sole purpose is to serve the people, not part of the people, not some of the people, not the people we like and the people we don't like, but to provide equal justice and equal opportunity before the law for all and to be impartial.
And the people that serve in government, whether they are a public servant or in the military, they are supposed to be a selfless servant.
They are there to serve the American people.
They're not there like Vindemann to decide what's in the best interest of American people.
He decides.
Right.
And they're not there to adopt a specific political agenda.
Now we understand that governments come in and they're partisan, and they have policies, and yes, we have to support and implement those policies, but that's very, very different from using the U.S.
government as a tool of political indoctrination.
And if we have a second on this segment of the show, I'll give you a good example.
We're going to have to talk about it in the break because Father Pavone, one of the champions responsible for today's victory, is going to join us, I just heard.

And if you looked at it, there's almost no New Deal rhetoric.

official government doctrine.
I mean, look at all the film, the Disney films.
And that was a conscious decision on FDR's part to make peace with the Republicans.

I'm going to ask you again to answer the question.
You did it in studio about three weeks ago.
Did you expect this result?
Did you have faith that this decision would be held after the leak?
Honestly, I did.
I did.
And I told people that as recently as yesterday when I was addressing a group who was asking me, you know, oh, I'm afraid some of the justices might or one of the justices might change their mind.
And I said, look, there's several reasons why I think they won't.
I think they are.
These conservative justices are people of integrity.
I said, first of all, because of the nature of the decision.
I mean, this is not some kind of nuanced thing.
This is not some kind of tangential matter.
This is of grave consequence and of fundamental principles.
Secondly, I said, because they've been under pressure for over a year.
I think what happened after the leak is that the kind of threats that were already happening just came above the surface.
But I saw as soon as they announced they were taking this case and they posed the question over a year ago that they were ready to answer.
I was confident even from then that they were going to get rid of Roe.
And we, you know, you don't just change your mind on something so fundamental as this.
And then the third reason is Simply that this is something that if one of them were to change their mind after the leak and all the public pressure, we would completely lose, it seems to me, the authority of the court.
Because then it would be like, okay, anytime someone doesn't like something, just cause a public ruckus, put some threats out there, and you'll be able to change their minds.
Now, you've been working.
You're not going to stop because this doesn't, you know, stop abortions.
It simply sends the issue back to the state.
So now we redouble our efforts.

As a priest, as somebody who is part of a church that's been around for two millennia, it is not an exaggeration to say that this is a historic day today, is it not?
It's very historic.
I mean, this is a decision that It has done so much damage.
That's one of the reasons the justices give for reversing Roe today.
It has inflicted not just damage, but severe damage.
It has grossly misrepresented the Constitution.
And you know what it's done?
It's damaged American civil, political, and judicial life.
It has damaged it in a very serious way.
It has short-circuited the process of people working out a very, very major policy issue.
Now, we're going to be able to work it out.
You know, Seb, I see this today as a very big act of humility on the part of the court.
You know, they're not imposing a policy today.
They're kind of backing away from abortion and saying, listen guys, we can't work this out.
You can't expect nine men and women.
To work this issue out for the whole country, and you shouldn't have expected that 50 years ago.

This is really important.
They're actually removing themselves from the democratic process.
This is hugely important.
Yes, you know, in the in the in the Alito decision, here's an important line that people have to understand.
He said, look, we understand people are making their policy arguments on both sides of this issue, as they should.
He said, but those who support Roe and Casey, the question for them is not, why do you think legal abortion is a good thing?
The question they have to answer, and they have not answered, is why is it that this court should make the decision It is a beautiful document.
I read it into the record.
Why?
Why is it that this court should limit what the states are able to do on this policy?
It is a beautiful document.

Because it celebrates again and again and again that we are a republic, and it sends this issue back to the states where it can be decided by the people, which is really what America is all about.

And let's just unpack this.
This is the day after.
Clarence Thomas's, not his decision, but the one written by him, dropped on the Second Amendment.

So this is like a twofer in one week.
The Constitution actually has a right to self-defense.
Yes.
And there's no right to kill an unborn person.
This is what, you know, the Nancy Pelosi's reaction to this is, well, this outrage that, you know, abortion, this, but gun rights, that.
One of them is in the Constitution, the other one isn't.
Is that complicated, Kevin?
No, I was thinking about that in my own drive over here from Heritage to your studio, Seb, because I had just seen her comments and I said, I'd like to think she's smarter than that, that maybe that's just a political statement.
But the point is, on the face of it, it's absurd.
Because obviously, one is in the Constitution, one isn't.
But there's something, I would argue, that's even more important, which predates the Constitution.
Something you and I share, most conservatives do, which is a belief in natural law.
That's where these two momentous decisions, Justice Thomas' yesterday, Justice Alito's today, come from.
And I can tell you, as you are a lifelong movement conservative who spends some time thinking about these things, it gives me great optimism for the future that we have justices using that natural law.
As the basis of their decisions.
Which is as it should be.
You're almost stealing my next question.
Oh, I'm sorry.
That's why.
So I have here, we've been discussing it all day, this is the final decision that, let's be clear, if somebody gets crazy around you, Doesn't get rid of abortion, but in beautiful language, sends the issue back to the states, where the states can debate it amongst the citizens and their representatives, as it should be, as per the subsidiarity principle of the Republic of States.
And just on that point, Kevin, this document, when it was leaked outrageously, When I read it, I thought, how many people are going to actually sit down and read a 70 page document from the Supreme Court?
Maybe they're going to think it's all in legalese and jargon.
I read it on a flight.
I read the whole document on a flight for business and I was so blown away.
by justice alito's this is a document anybody can read yeah and it's not a legal treatise and it was so important i actually read the key parts onto video onto audio i posted so everybody can access it and it is what you said it is a It's a review of Western civilization's attitude to the unborn and to pre-quickening and post-quickening treatment of the unborn.
So this document isn't in a stuffy law case.
It's about our Western values, is it not?
It is.
What a wonderful question and summary by you.
Not that you have to hear that from me, but where I'm going with that is, because you know in my heart I'm a teacher, and I'm a historian.
That decision, the decision, the official opinion that's come out, is part of our history.
I would argue, and I don't think this is an overstatement, it's not only now an essential and brilliant part of American jurisprudence, it is part of what we call the Western canon.
That is, it is one of those documents that is, of course, going to stand the test of time because it appeals to timeless principles in natural law.
And I just want to emphasize for your wonderful audience, this is not something that's inaccessible.
I mean, this is something that it doesn't matter where you went to school, where you're from, however sophisticated you think Supreme Court opinions are, this is something that Justice Alito wrote for posterity in much the same way our founders wrote the Declaration of Independence.
Right, because people can be put off.
That's exactly right.
Natural law.
Do I have to have a philosophy degree?
No, no, no.
It is the viewpoint of human beings in our civilization for millennia.
That's what he summarized.
Yes, that's right.
So I don't want to get too carried away.
It's very hard for me not to get carried away today.
Let me ask some of the tough questions.
I immediately did a two-minute video this morning.
I was unshaven, no tie, no suit, just in the yard.
I said, guys, this is my reaction.
And one of the things I said is that, and again, I don't want to overdo it, so you be my sanity check.
You are the responsible president of this organization with a budget of how much?
How big are you?
About $100 million a year.
So he's got to be a responsible guy.
I know we've seen Antifa, we've seen BLM, we've seen the open border, record inflation, on and on and on.
But isn't this one moment that we should revel in and celebrate, isn't this an indication that we're winning on the big issues?
We are, and I'm very happy to be your sanity check provided you do that for me.
We do that for one another via text, right?
Sometimes we get each other pretty zealous about things, but that usually means we're right, right?
But to your question, all kidding aside, yes, and in fact, I mentioned to a lot of our staff at Heritage today, and leading up to today, We need as conservatives to remember to celebrate our victories because those of us who've been conservatives our entire adult lives are used to losing.
And the nature of conservatism is not necessarily reactionary, but one that is in fact trying to conserve and preserve.
And the nature of the radical American left is to tear down those very things we want to conserve.
Therefore, when we have Small wins when we have, I mean, this is a truly momentous win.
This is the most important Supreme Court case.
I think it's the most important event politically in my lifetime and in your lifetime.
I think it's more important.
I find it hard to disagree.
I mean, think about the others that would be right up there.
Reagan's victory in 1980, Trump's victory in 2016, which of course is directly related to this.
All of that to say, we are living through one of the most momentous defenses Of life, liberty, and the pursuit of happiness in the history of the world.

This is a 6-3 or a 5-4 really, if you look at the... On the overturning of row, it's 5-4.
Yes, it's 6-3.
But without Gorsuch, Kavanaugh, and Amy Coney Barrett, we don't have this, Kevin.
We don't have it.
So if we want to give thanks, we have to give thanks to my old boss as well, President Trump.
That's right.
And of course, conservatives have different horses they want to choose for the future.
You and I are both very grateful to President Trump, as I think your audience is.
The point is, he deserves credit for this.
That's true.
And it needs to be given.
And we also owe credit to some Republican senators who aren't always helpful to us, right?
Because they held the line on making sure that these nominees got confirmed.
And this is a day, to your point as conservatives, that we really need to celebrate.
Our movement is always healthy because we're willing to have debate internally.
We've done a lot of that since election 2020.
I sense that it's re-cohering.
And I guess the charge that I would give us, you and me and especially us at Heritage, given our assets and our resources, let's be sure we take advantage of this.
It's time to put pedal to the metal and not rest in our laurels.

I think right after you arrived, we had you in studio and then you announced, what is it, the first court case the Heritage ever brought was against the Biden administration on mandates, correct?
Yes, on vaccine mandates.

And the truth is still the truth, and that's what guides that great man, and what guided today's decision.

We've had our fun.
Man, I knew this was gonna happen.
But let's, I mean, you're here to make change.
That brings us back to those principles of conservatism that founded the Republic, that were the basis of our civilization, let's be clear.
The Founding Fathers were geniuses, but it wasn't a tabula rasa, it wasn't an empty, you know, sandbox they arrived at.
They brought their history from Europe, they brought the knowledge, the philosophy, and the knowledge of the mistakes that had been done under Different systems.
Feudal systems.
Royal systems.
But the principles that they enshrined are ancient principles.
Where is the fight right now at?
Let's step back from this monumental celebration for a second.
What are your foci at the Heritage Foundation in terms of the imminent battles we still have to fight?
There's so many.
But what have you decided, for you and Heritage, are the biggest ones?
I know you're an educator, so that's got to be out there, but you tell us.
Sure.
There are several, and of course Heritage is engaged in literally every policy issue, but I won't talk about them all, obviously.
Number one, just as a transition from this Supreme Court case, It's really important we understand that the fight to secure a truly pro-life country has just begun.
What I mean by that, as you know, is that we now have to be active.
We as a movement, we at Heritage, have to be active in every state capital where there isn't a so-called trigger law for pro-life legislation.
For the first time in our 50-year history at Heritage, we're involved in almost all the states to some degree or another.
We're involved in a handful in a very significant way, 15 to 20.
on this issue and others.
But the second point is, and it's related to winning the pro-life issue, is education.
We need to tear out root and branch.
That is, we need to eliminate fully the U.S.
Department of Education.
That's our objective.
It's long term.
We want the next President of the United States to come into office, whoever he or she is, and say, that's what I want to do.
Ken, can you stop here for a second and explain why it has been such a destructive force, what it's done to the cost of education, political correctness, why we have to get rid of this institution?
Sure.
I can say that as a fifth-generation teacher, as someone who's led both a K-12 school and a college, that what the U.S.
Department of Education has done with its $100 trillion that we've spent on it since it was created in 1979, is make, it's sort of like what we've done with health care, where there's an intermediary between doctor and patient.
The U.S. Department of Education has become the intermediary between parent, or between teacher and student.
And what that means is that the money that's being spent isn't being spent on the classrooms.
Or the student.
Or the student.
I mean, something like 30 cents of federal dollars, which of course is our money, goes to the student, goes to the classroom.
And so on the higher ed level, it's directly led to tuition going up.
So if someone is a parent of a college student listening to this, they want to know the origins of this tuition problem with colleges, it's the U.S. Department.
Department of Education.
And of course, just to sum up this particular point, Seb, it's the U.S.
Department of Education that's been advocating for this diversity, equity, inclusion nonsense and using our money against us.
I mean, think about Justice Thomas' comment about North always being North.
The U.S.
Department of Education doesn't believe that and uses our own money against it.
Because that's an oppressive thing.
2 plus 2 equals 4 is colonial oppression.
Yes, that's exactly right.
It's not a joke, guys.
If you don't believe what we're saying, you can look this up on your favorite search engine, hopefully not Google.
This is what is being told now as part of critical theory.
That the search for the truth and objectivity is somehow racist.
Yeah, it is.
I mean, we even see that in a couple of the museums in the nation's capital, which is just preposterous, right?
So, in order to lead up to that, because that's a decade-long project to get rid of that agency, we have to make sure at the state level that there's universal school choice, period, full stop.
Every single dollar that any government entity spends on education needs to follow the child.
So at Heritage what we're doing to sort of write a headline is operating on these aspirational goals that lead us to greater self-governance and we're not afraid of these big objectives like eliminating the Department of Education or implementing school choice at every state, but we also have to play as a baseball fan what I call small ball.
We've got to go hit some singles, some doubles, and lead up to that.
So, pro-life, education, we are deeply concerned about the threat of the Chinese Communist Party.
They've infiltrated our institutions of higher education, what used to be called Confucius Institutes.
That were government organs of subversion on our campuses.
Completely.
I mean, my alma mater, the University of Texas, is one of the biggest violators of common sense when it comes to keeping the CCP out of our institutions.
Heritage is going to shine the light on all of that because there are a lot of members of Congress Who are given campaign money by K Street lobbyists affiliated with the CCP to protect this.
I'm just here to let you know that next year when there's likely a Republican majority, they darn well better govern as conservatives rather than capital R Republicans when it comes to these issues.
So this is, and I know you're a 501c3, you don't do politics, you do policy, but this is a burning issue, Kevin, that when we're in minority, we govern as if we're in a minority, and when we're in the majority, we still govern as if we're in the minority.
Do you think that we can see a more conservative GOP in the future?
Do you think it's happening?
It's happening present tense.
And you know that I don't get into hollow optimism.
And I know you definitely don't.
Probably someone who's a mutual friend, Andy Roth, has a great piece in The Federalist today on how there is a red wave coming.
But the great thing, Andy's a great conservative, as you are, is that that red wave is more conservative in terms of policy than it's been.
And so what's going to happen is increasingly through the 2020s, we're going to see Republican leadership in D.C. become more conservative.
But the only way we can ensure that the swamp doesn't co-opt those new guys and gals is to make sure that we're their accountability partners, right?
That's what friends do for one another.
And I want Heritage to be in a position to be the people's accountability partner for conservatism in the nation's capital.
That's what we're trying to do with these issues.
I really like, I don't think that has been expressed enough in the past, and I've been associated with Heritage for years.

Kevin, I got, you know, so much to talk about.
I got you bogged down in issue two because I'm so excited that, you know, as a former educator myself and you as a president of a college to expand upon why we have to get rid of things like the Department of Education.
But let's continue the list.
What are the big targets of opportunity for you, the priorities at Heritage?
The next one on the list, and really on a lot of days, Seb, it's number one is border security and immigration.
Because not only is that inherently, just on its own, one of the big issues and crises facing the United States, it also speaks to what the left is trying to do, what the Biden administration is trying to do, and that is undermine the rule of law.
So we've got to secure the border for the sake of the rule of law, for the sake of the safety of Americans, for that matter, for the illegal immigrants, too.
I mean, this is really absurd.
Well, let's just hammer that for a second.
You're not going to let me continue the list, are you?
You hit things that require a little bit of amplification because we have to communicate to those who maybe aren't on our team.
And if you're apolitical, which most Americans I think are, or if you're kind of a questioning Democrat, who is getting hurt by open borders?
Two people the most.
It's the immigrants who are being smuggled and abused 60% of the women and then if you're a legal immigrant who recently arrived if somebody arrives illegally and then says I'll do you know Jose's job for cash for 50% Well, guess what?
The legal immigrant is out, so we have to communicate that, don't we, to as broad an audience as possible?
That's exactly right, and therefore I often do that, especially if it's with an audience that I know represents more of the political spectrum than just our conservative friends, by saying, the Heritage Foundation, I, Kevin Roberts, we're very pro-immigrant.
You by definition are.
What that means is, and America is, what that means is we want people who want to come here legally to have the shot to do so.
We're creating a gross disincentive for people to do that by having what is literally an open border.
I've been there several times.
It is literally an open border.
You're from Texas.
You understand it.
I know it really, really well.
And it's something that ought, that problem ought to transcend Republican and Democrat.
It should.
Because this is about America.
And we can, we've got to get back to the point where here in D.C., we are able to have a conversation about what our immigration system needs to look like, because then we get into a conversation about how we assimilate people into this notion of American nationalism, aristocracy.
Everyone gets to maintain their own cultures.
You have done that.
I mean, I know a lot of people in Texas who've done that.
That's the beautiful story of America.
Open borders prevent us from doing that, and I think it leads directly to us not being able to talk in a civil way about some of the other policies.
Let me ask the dark question.
What's the real reason?
I mean, is it about creating what they deem to be a permanent constituency, and because they've got a different skin color, they think that they must vote Democrat?
Is it really that cynical, do you think?
I guarantee you it is that cynical, and it is that crass, and I know that from time in Texas.
I also know that from my seven months here in Washington, D.C.
The American left is nefarious.
It's that simple.
And one of the successes that maybe we could have collectively is, as a country, is seeing an American left reemerge that isn't that cynical and crass.
We used to have honest policy debates.
I mean, don't you wish for the day when maybe someone like Daniel Patrick Moynihan, a Democrat, is back.
We have an honest conversation with him.
It's like one of my family members, you'll go unnamed, dear son, said, why don't you have people like Nancy on your show?
And I'm, to what end?
To what end?
She thinks I'm evil.
I think she's undermining the American Constitution.
You can't have the discussion.
I could have a discussion with JFK or Scoop Jackson, but those Democrats have disappeared, so I love that idea.
Let's try and maybe help that party become a little bit more, No, patriotic, like they were a few generations ago, but not too far back where they were racists and, you know, the KKK and everything else.
We don't like that Democrat Party.

Kevin, let's talk about the other side, if we may.
And again, not politics, but policy.
Are you as stunned as I am that in the last 17 months There's not even a glimmer of, how do I put it, non-radical behavior.
Whether it's opening the border, whether it's shutting down fossil fuels, whether it's surrendering in Afghanistan, you'd think now and again there'd be a little chink of an issue where we could collaborate or where there's a little bit of normalcy.
You don't have to like Bill Clinton.
I don't.
But Bill Clinton was a Democrat who would rein in the more extreme elements of the Democrat Party that existed back then.
Now, if you look at the last 17 months, even Biden, who's been a kind of empty shell for 40 years, it's as if the squad is running the Democrat Party.
Has that surprised you?
It has surprised me.
In fact, I was anticipating that Biden's administration, because of where he has been politically most of his career, would be more like Clinton.
Certainly not the political gifts of Clinton.
I'm not a Clinton fan like you, but we have to give credit where credit's due.
The man was very skilled and gifted, and actually governed relative to Obama and Biden, center-left.
Well, he stole a lot of Newt Gingrich's ideas!
He did!
Going to the point about his political savvy, right?
But yes, I've been stunned, and the two things have stunned me.
I was expecting the radical leftism regarding the pro-life issue, because we knew that was going to happen.
But the two things that have stunned me is the scale of the open border problem.
I mean, this is extremely intentional.
It's not incompetence.
But the second one is something you touched on briefly, and that is that the Biden administration has accepted wholesale the Green New Deal.
And they are now, in the last two weeks, as we've seen gas prices soar, we've seen refineries shut down because they're choked by regulation, we have seen senior members of the administration, and now Biden himself, say basically this is intentional.
We're trying to force the transition to fuel sources that you and I know don't work.
That's really radical because it goes to the point of not just gas prices being high, but to access to clean, reliable, affordable energy, lifting a billion people out of poverty.
In an age where we have inflation out of control.
Yeah, that's exactly right.
And so the fact that he's so willing, the president is so willing to double down on that, given all of the political costs, tells me how ingrained the squad and AOC types are in effectively running the country.
I call this phenomena, and I'm happy to hear other descriptions, that this is a political elite or party that is hostage to its own ideology.
I mean, this is political suicide.
In a midterm year, to have the Secretary of Energy laugh about, ha ha ha, you think I can change oil prices?
Well, President Trump did.
Or to have a Democrat senator say, ha, I have my electric car and I just laugh at the gas prices.
This isn't good in a political sense.
clever.
No.
So I know you're a historian professionally.
Let's put this into historical perspective.
How long can a political entity, an ideological conglomerate, last if it loses, by dint of its ideology, any rational connection to the real world?
Does this not mean that one of the two political parties in America must at some soon, at some juncture, have a crisis of confidence or just collapse, Kevin?
That's what's happening to the Democratic Party.
Already?
Yeah, it's happening now.
Again, present tense, it's happening.
And we're going to see that intensify between now and 2024.
And what's going to emerge, if it's called the Democratic Party, is something very different than the Democratic Party of the 1990s or the 1970s.
I grew up in a Democratic state in the Gulf Coast where Democrats were pro-gun, pro-life.
They were pro-America.
They were conservative.
That's gone.
This is the opportunity, though, for those of us who are conservatives.
And that's to remake our own movement, to modify it.
It doesn't have to be torn down and rebuilt, but to modify it to include working class conservatives who have been on our side during the Reagan years, during the Trump years.
It's a huge opportunity to turn our movement into a super majority.
And I'm an optimist.
You know that.
I think that's going to happen in the 2020s if we stick to our conservative principles and if at every level of government we are nominating, we're running men and women who represent them.
It's one of the great similarities between Reagan and Trump is that so many Democrats voted for him, working class Democrats voted for him, not the bi-coastal elites that hate working class Democrats.
One more thing briefly, also we have to engage the minority Who have come over to our side, especially, what is it, 10, 12 more, million more Hispanic and black Americans voted for President Trump four years in?
We have to build on that, don't we?
We do.
And our newest member of Congress, Myra Flores from South Texas, is an indication of what's possible.
And she's telling us, look, I got elected in part because these bi-coastal elites keep calling my people Latinx.
I don't even know what the heck that is, right?
And she's saying, keep talking about conservatism.
And this is the key point.
Don't water it down.
Those people you mentioned voted for President Trump, not because he went to the Rio Grande Valley or to black neighborhoods and pandered.
He said, this is who I am.
This is who I stand for.
Please vote for me.
that's massively important let's let's listen to kevin there to dr roberts this is we mustn't the establishment if you're listening we mustn't water down based upon some Unfounded fear that our values will be rejected by minorities across America.
On the contrary, that's why more than 10 million black and Hispanic Americans voted for president more in 2020 than they did in 15.

You did something really dumb.
You were living the life of Riley, running an amazing organization, the Texas Public Policy Institute Foundation, and then you came to The Swamp.
That is dumb, isn't it?

I mean, this isn't a swamp, this is a fetid cesspit!
So the left wants to discourage any decent American from working in the swamp, especially working for an administration like I did.

I had no desire ever to live in Washington DC and turned down many opportunities to do so.
