Biden's Vaccine Mandate Suspended by Dept of Labor; Judge Issues Injunction | Facts Matter

Good evening to everyone, and an especially good evening to Miss Kate Brown, who is the governor of Oregon.
That is quite a mask.
Regardless, earlier today, the Department of Labor came out and they officially announced that they have suspended their implementation of the national vaccine mandate, meaning that OSHA will neither enforce nor implement the vaccine mandate for private businesses.
This, by the way, came after a court order from the Fifth Circuit essentially forced them to do so.
Meanwhile, over at a university in Virginia, an assistant professor of criminology has just come out and said that society should remove the stigma surrounding pedophiles, and instead, we should be referring to them as MAPs, or Minor Attracted People.
Let's go through it all together.
This is your daily Facts Matter update, and I'm your host, Roman, from the Epoch Times.
And now let's begin today's discussion by talking about the vaccine mandate, or more specifically, about how OSHA has just suspended their enforcement of the vaccine mandate for private businesses.
Now, to give you a bit of background on this particular case...
Exactly two weeks ago at the behest of Joe Biden, OSHA, which is the Occupational Safety and Health Administration, they officially announced a new sweeping vaccine mandate for private businesses.
And according to the new rules that they released, any business here in America with over 100 employees, they would be forced to either mandate vaccinations among their employees or to require that their employees submit a weekly COVID test Now, as we already discussed in a previous episode, as a response to this new set of rules, lawsuits began to spring up across the entire nation.
And it was one of these lawsuits, specifically one that came out of Texas, that had an appeals court, specifically the Fifth Circuit Court of Appeals, issue a temporary injunction against the enforcement of this mandate.
To be more specific, about a week ago, a federal court of appeals, this specific court, they issued a temporary block of the mandate because according to the judges in that courtroom, there may in fact be constitutional issues with the Biden administration's vaccine requirement.
Here's specifically what the judges said in that court order.
Because the petitions give cause to believe there are grave statutory and constitutional issues with the mandate, The mandate is hereby stayed pending further action by this court.
Now, again, that was about a week ago, and that particular restraining order was only temporary.
However, the plaintiffs in the case, including the state of Texas, the state of Utah, as well as all the other litigants, they were requesting a permanent injunction.
And so what the two judges in that case did was that they gave the Biden administration an opportunity to respond to the court, to respond to these plaintiffs, and to challenge the order.
The Biden administration, they did just that.
They submitted a challenge, but the court rejected it.
In fact, the court issued this new 22-page fairly blistering opinion where they called the vaccine mandate, as it was written, fatally flawed.
Here's specifically what the court wrote in their opinion.
Quote, rather than a delicately handled scapel, the mandate is a one-size-fits-all sledgehammer that makes hardly any attempt to account for differences in workplaces and workers that have more than a little bearing on workers' varying degrees of susceptibility to the supposedly quote-unquote grave danger the mandate purports to address.
Then, further down in this same opinion, the court ordered that the vaccine mandate cannot be enforced in any way.
Here's what they wrote, quote, And so this order from this court, it goes well beyond a temporary halt, and instead it is a permanent injunction.
It says that OSHA cannot take any steps to either implement or enforce the vaccine mandate until the court says otherwise.
And several days ago, the Labor Department, they came out and they announced that they will be complying with this decision.
Here's specifically what the Labor Department said as a part of their statement.
The court ordered that OSHA take no steps to implement or enforce the emergency temporary standard until further court order.
While OSHA remains confident in its authority to protect workers in emergencies, OSHA has suspended activities related to the implementation and enforcement of the emergency temporary standard pending future developments in the litigation.
Meaning, in non-legal language, that the vaccine mandate on private businesses is effectively suspended.
Now, we here at the Epoch Times, we did reach out to the Biden administration for comment, but we have yet to hear back.
Regardless, though, moving forward, this lawsuit is about to get very big, much bigger than it was previously.
That's because besides this lawsuit from Texas, the one that issued this restraining order, there are actually in total at least 27 other states.
There are private employers, religious organizations, as well as other groups throughout the entire country who have similarly filed lawsuits against the new vaccine mandate as well.
And these lawsuits, they really are spread out across the entire country.
They encompass five different courts of appeals, including the 8th Circuit, the 11th Circuit, the 6th Circuit, the 5th Circuit, and also the Republican National Committee.
They challenged the vaccine mandate in the Court of Appeals for the District of Congress.
And so, literally, it goes across the entire country.
So, what does that exactly mean?
Well, to summarize, besides this Texas case, you have cases across the entire country that are likewise challenging the vaccine mandate.
And the different lawsuits, they are all using different legal arguments to make their case.
For instance, some lawsuits are saying that it's a violation of the Religious Freedom Restoration Act.
Some are saying that it's a violation of the First Amendment.
Some are saying that it's beyond the scope of what OSHA is authorized to do, etc.
There are many different arguments.
And so, with many different cases being brought forth, what will happen is a consolidation.
That's because in our judicial system here in America, when you have multiple petitions that are filed in at least two different courts, the cases are consolidated into one of those courts through basically a lottery system.
It's actually quite literally a ping-pong ball lottery like the ones you see over on TV. And this lottery, it actually took place just yesterday.
And in terms of the winner, well, can you please give me a drumroll?
Well, the consolidated cases will be heard by the Sixth Circuit Court of Appeals over in Ohio.
And that particular court, it's considered by many of the plaintiffs in these cases to be a lucky draw, given the fact that it is conservative-leaning.
In fact, the Sixth Circuit, it has twice as many judges that were appointed by Republican presidents than those that were appointed by Democrat presidents.
In fact, here's how one legal commentator over on CNN, here's how he described the particular draw.
The Sixth Circuit is a favorable draw for mandate challengers, one of the best they could have hoped for.
The court has many Trump-appointed judges skeptical of broad assertions of agency authority, and this is their chance to cement that reputation.
However, it's not necessarily the case that the judges who will actually be assigned to this particular case will themselves be conservatives.
That's because what still needs to happen is that a three-judge panel must still be formed in order to hear the case, and who those three particular judges will be has not yet been determined.
And so, even though the Sixth Circuit overall leans conservative, it is still yet to be determined whether the three judges who will be assigned to this particular case will themselves be conservative.
Because, given the fact that these three judge panels are actually assigned at random, it could still be the case that just based on chance, the judges might actually lean liberal.
Only time will tell.
However, regardless of which judges will ultimately be assigned to this case until the lawsuits are fully resolved, as we mentioned earlier, OSHA, under court order, will not enforce or implement the vaccine mandate.
And then furthermore, given the nature of this case, the large nature of this case, as well as the national implications, regardless of what will ultimately happen at the Sixth Circuit Court of Appeals, this case has a 99.9% chance of getting appealed once again, To the U.S. Supreme Court.
And so very likely within a few months, it'll be the U.S. Supreme Court which will ultimately decide whether this vaccine mandate is constitutional or not.

And now let's move on over and talk about education.
Imagine for a moment that after 18 full years of raising your kid, you send them off to college.
You likely feel pretty good about that.
I mean, you're at home, you have an empty nest, you did a good job, and you can kick back and relax.
However, within just a few months, your son comes back home for a visit, and you ask him, hey Johnny, what are you learning over in college?
And he looks at you and he says, well dad, I was thinking, maybe we should reduce the stigma around pedophiles.
You look at him shocked.
Well, you might think that's ridiculous.
However, it might not be.
That's because a non-binary assistant professor over in Virginia has been calling for the stigma of pedophilia to be delegitimized.
And of course, this is an individual who is teaching our children over in university.
Now, to start with, before we get into the actual discussion, I want to mention that this professor identifies as non-binary.
And frankly, in these situations, I never know what pronouns to use so that YouTube doesn't kick my video off of their platform.
And so instead, for the duration of this episode, I will just refer to this particular professor as Professor Allen, which is their name.
And Allen is an assistant professor of sociology and criminal justice over at Old Dominion University, which is located in Norfolk, Virginia.
Professor Allen is also the author of a book titled A Long Dark Shadow, Minor Attracted People and Their Pursuit of Dignity.
And just last week, Professor Allen gave an interview to an organization called the Prostasia Foundation.
And this particular organization, if you've never heard of it, it's a non-profit that, among several other things, hosts a section on their website called the MAP Support Club, which is a, quote, community for minor attracted people to find friendship and understanding among peers.
And during that interview, Professor Allen said that in place of the term pedophile, society as a whole should instead use the term MAP, Which is minor attracted people or minor attracted person.
That way, nobody's feelings would be hurt.
Here's specifically what Professor Allen said during that interview.
I think it's important to use terminology for groups that members of that group want others to use for them.
Furthermore, Professor Allen suggested that using the term map will lead to less stigma being applied to pedophiles.
Here's again what Professor Allen said during that interview.
It's less stigmatizing than other terms like pedophile.
A lot of people, when they hear the term pedophile, they automatically assume that it means a sex offender.
And that isn't true.
And it leads to a lot of misconceptions about attraction towards minors.
Furthermore, during that same interview, Professor Allen suggested that pedophilia is merely just another form of sexual attraction and it should be tolerated by society.
Here is specifically what Professor Allen said on this front.
On one hand, just because someone has attractions to children does not mean that they will never experience attraction to adults as well or even that their attractions to children will persist for their entire lives.
Sexuality can be fluid and there are many maps who have a range of attraction to both children and adults.
Now, as you can imagine, when this interview came to light, people were generally outraged.
Not only because of the nature of the comments about both normalizing pedophilia and adopting the term minor-attracted person, But more so because this was an individual who was teaching at school.
This professor was shaping the next generation of America's leaders.
And so, given the large amount of pushback over on social media, just yesterday, Old Dominion University came out and they announced that they had placed Professor Allen on leave.
Here's specifically what a spokesperson for the university said in a statement.
Old Dominion University has placed Dr.
Allen Walker on administrative leave, effective immediately, from their position as Assistant Professor of Sociology and Criminal Justice.
Reactions to Dr.
Walker's research and book have led to concerns for their safety and that of the campus.
However, in another statement that was released by the university, they, on the one hand, said that they don't endorse crimes against children, but on the other hand, they did defend the research that Professor Allen was conducting.
He was part of that earlier statement.
It is important to share that Old Dominion, as a caring and inclusive community, does not endorse or promote crimes against children or any form of criminal activity.
An academic community plays a valuable role in the quest for knowledge.
A vital part of this is being willing to consider scientific and other empirical data that may involve controversial issues and perspectives.
Furthermore, after this backlash manifested, Professor Allen released a statement saying essentially that this research will for one help to prevent crime and secondly create a more inclusive society.
Here's what Professor Allen said in the statement: "I want to be clear: child sexual abuse is an inexcusable crime.
As an assistant professor of sociology and criminal justice, the goal of my research is to prevent crime.
I embarked on this research in hopes of gaining understanding of a group that, previously, has not been studied in order to identify ways to protect children." And Professor Allen suggests that the best way to achieve this goal is to, for one, destigmatize pedophilia, and secondly, to use the term that the pedophiles themselves wish to be used for their group.
And by the way, just as an aside, I've actually been seeing more of this type of argument in mainstream media recently.
In fact, I remember about a year ago, I was flipping through the pages of New York Times, and I was really surprised because they had a full-page article there pretty much about this exact same topic, about getting rid of the stigma surrounding pedophiles.
Regardless, I'll end the segment with a quote from a student over at Old Dominion University.
Honestly, it just sounds gross.
Just because you're not acting on it, to acknowledge it is weird and not okay at all.
It feels uncomfortable to know that someone's like that on campus.
And just as a closing thought, if you happen to have any kids in college right now, maybe it's a good time to give them a call and ask whether they are being taught things like this in the classroom.
