NY County Goes ‘Constitutional’ — Won't Comply With Federal, State Authorities | Facts Matter

Good evening.
Five days ago, over in California, a group of parents have filed a lawsuit against the state because a new curriculum in the public school system was having their children openly pray to five Aztec gods.
Meanwhile, over in New York, a conservative county in the western part of the state It just passed this resolution right here and officially became what's known as a constitutional county, meaning that the local government there will uphold the Bill of Rights and the U.S. Constitution against all infringements from either state or federal authorities.
And lastly, over in Japan, a third person has sadly died shortly after getting a shot from the suspended Moderna vaccine, which contained little fragments of metal.
And furthermore, the lab results have come back and confirmed exactly what that metal was.
Let's go through it all together.
This is your daily Facts Matter update, and I'm your host, Roman, from the Epoch Times.
And now let's begin today's discussion over in New York.

And now let's move on over to New York.
Lawmakers over in Cattaraugus County, which is a conservative county in the western part of the state, they have just unanimously voted to become a constitutional sanctuary.
What that means is that they will protect the rights which are enshrined in both the U.S. Constitution as well as in the Bill of Rights from all infringements by either state or federal authorities.
Specifically, under this newly passed legislation, Cattaraugus County will become a, quote, constitutional county, unwavering in its commitment to protect the constitutional rights of its citizens.
Furthermore, this county's legislature vowed to use all legal means at its disposal to oppose unconstitutional efforts to infringe on the rights of the citizens, whether those attacks come from the federal or the state level.
Now, among several other elements, this measure which was passed, it declares that no county employees, no public money, no public resources, and no buildings can be used to either infringe on the rights of the citizens, nor can they be used to help other levels of government, like the state and the federal level, to enforce unconstitutional restrictions.
Now, we here at the Epoch Times, we actually spoke with one of the lawmakers over in this county, Ms.
Ginger Schroeder.
She was actually the one who drafted and pushed this resolution forward.
And here's what she said.
If the state or federal government continue to overstep their bounds and intrude into the lives of our citizens with unconstitutional mandates, our legislature will step up and challenge that.
Ms.
Schroeder further told us that the constituents in her county, they were becoming fed up with what they view as increasingly extreme violations of the U.S. Constitution, which are coming from both Albany, which is the New York state capital, as well as from Washington, D.C. And as an example of what that meant, she said that during the pandemic, the courts have allowed all power to be assumed by an autocrat and not a benign autocrat.
And just to pause here for a moment, who she's referring to here is the former New York governor, Andrew Cuomo.
And then she continues.
It was devastating to our community, and that's why we decided we simply had to do something about this.
I'm even willing to engage in civil disobedience.
Sometimes you have to stand up to government.
That's what our forefathers did.
If there's an unconstitutional mandate that comes down, I may choose not to comply with that, and I've encouraged others to do so as well.
Now, according to multiple lawmakers from this county that we here at The Epoch Times had a chance to speak with, they said that the concern of escalating infringements on gun rights, specifically, were a primary motive behind this measure.
In fact, if you look at the resolution itself, it makes that point pretty crystal clear.
It says here, quote, Additionally,
the lawmakers said that they vowed to, quote,"...use all legal means at its disposal to oppose any efforts to unconstitutionally restrict such rights in order to assure that its citizens will be able to keep and bear arms and use the same in defense of life, liberty, and property, whether in a well-regulated militia or individually." Now, while the Second Amendment was obviously a key motivator behind this move, according to Ms.
Schroeder, it was one of many factors.
During our interview, she said that the eviction moratorium, which stopped homeowners from being able to evict tenants who weren't paying their rent, as well as vaccine mandates, limits on the freedom of speech, limits on freedom of assembly, among many other infringements, were behind this move.
In fact, here's how she summed it all up.
We are headed toward very dark times, and that was all in the backdrop in my thinking about what we as legislators need to do.
Now, this county in New York is not the only one in the entire country which has taken this approach.
As we discussed back in June of this year, so just a few months ago, there were two counties over in Nevada which likewise declared themselves as being constitutional counties wherein any effort to infringe on the constitutional rights of their citizens will be treated as criminal activity, even if it's done by either state or federal officials.
Over in Nevada, by the way, the two counties which unanimously voted to become constitutional were Elko and Lander counties.
And according to the resolutions that they passed, it essentially says that the local governments of these two counties, which includes the commissioners as well as the sheriffs, they will stand against unconstitutional acts by both the state and federal authorities.
Now in terms of what constitutional rights they are specifically referring to here...
Well, here's part of what the Nevada Resolution says, quote, The people of these United States are, and have a right to be, free and independent, and these rights are derived from the law and nature and nature's God.
As such, they must be free from infringements on the right to keep in their arms, unreasonable searches and seizures, capricious detainments, and every other natural right, whether enumerated or not, pursuant to the Ninth Amendment.
They further went on to essentially bring their county back to first principles and say that they deny any government structure which supersedes either the Bill of Rights or the U.S. Constitution.
Here's what the resolution says on this front.
Quote, We maintain that no agency established by the U.S. Congress can develop its own policies or regulations which supersede the Bill of Rights or the Constitution, nor does the executive branch have the power to make law, overturn law, or set aside law.
And then, at the end of this resolution, these two Nevada governments, these two Nevada county governments, they became the first in the nation to officially join an organization called the Constitutional Sheriffs and Peace Officers Association.
Now this is a national organization that's made up of sheriffs and law enforcement officers from across the country who are dedicated to upholding their oaths as well as the U.S. Constitution.
And across the country, there are many, many sheriffs as well as many police officers who are members of this group.
But before this resolution in Nevada was passed, never before had a county ever requested to join.
These two counties in Nevada were in fact the first.
And here's a statement from the founder of this group.
And it looks like this movement is expanding, with this county in New York now joining the two counties over in Nevada.
Now, thus far, it's not exactly clear how these resolutions would actually play out in practice, how a constitutional county would act if and when a federal authority would come in and attempt to exert influence over their citizens.
Well, we'll just have to wait and see when such an incursion occurs.

And now let's move on over to Japan.
As we already discussed in a previous episode, the Japanese government suspended over 2.3 million doses of the Moderna vaccine over fears of contamination.
Specifically, they suspended the doses after tiny pieces of metal were discovered inside of the vaccines.
And in that earlier episode, we discussed how, unfortunately, two Japanese men who were in their 30s, they took the vaccine, they fell ill, and then they died shortly afterwards.
Now, back then, Moderna, alongside Takeda Pharmaceuticals, which is their Japanese partner, they released a joint statement saying that...
However, since that earlier report, there have been two developments.
First of all, and sadly...
According to Japan's health ministry, a third person has died shortly after getting a shot from one of the suspended batches of the Moderna vaccine.
According to the officials, this individual, who is 49 years old, he received the second dose of the vaccine back on August 11th, and then, sadly, he died the very next day.
The health ministry noted that his only known health issue was an allergy to buckwheat.
Now, like the first two men who died, this third Japanese man also experienced a fever shortly after getting his second Moderna shot from this tainted batch, and then he died shortly afterwards.
Now, Takeda Pharmaceutical, which is again the Japanese company which distributes the Moderna vaccine within Japan, they released a statement on Tuesday saying that the causes of death are being investigated, and that there is no evidence they are linked to the vaccine.
Now besides that, the second development that's worth mentioning in this case is that we now know what those tiny metal fragments were which were found inside the vaccine doses which were suspended.
According to the official investigation report from Moderna, those vaccine batches contained tiny metal fragments of stainless steel.
Here's what this report said on that front.
Quote, Now, this might sound dangerous, but according But according to this joint statement from both Takeda Pharmaceuticals as well as Moderna, they say that it's not.
Here's specifically what the statement says.
Here's specifically what the statement says, quote, The rare presence of stainless steel particles in the Moderna COVID-19 vaccine does not pose an undue risk to patient safety, and it does not adversely affect the benefit or risk profile of the product.
They then went on in this statement to say that it's actually routine to use stainless steel in things like joint replacements, and therefore, having small tiny fragments of stainless steel in the vaccine is not a cause for concern.
Here's what it says, quote, Now, after carrying out the probe, these two companies confirmed that the source of after carrying out the probe, these two companies confirmed that the source of the stainless steel contamination, which again, according these two companies confirmed that the source of the stainless steel contamination, which again, according to the statement, does not pose any undue risk to the patient, it was traced back
And according to this joint statement, they say that this contractor has taken steps to ensure that this contamination, which again, is perfectly safe and doesn't pose any undue risks to patients, will never happen again.
Now, we here at the Epoch Times, we reached out to Moderna for comment, but we have yet to hear back.
However, as of today, the health regulators over in Japan, they are currently investigating the deaths of all three of the men that we mentioned earlier.

And now let's move on over to California.
You know that weird feeling when your kid comes home from school and you look at him and you say, Hey, son, how was class?
And he turns to you and he says, Not bad, Dad.
We learned a little math.
We learned a little science.
And then we had to pray to the Aztec gods.
Now, you might think that's a ridiculous notion and would never happen.
However, over in California, it is.
In fact, five days ago, a civil rights group alongside several parents, they have filed a lawsuit against the state of California over the state's implementation of a public school curriculum, which reportedly has the students praying to Aztec gods.
Now, the civil rights group which is leading this lawsuit is called Californians for Equal Rights Foundation, and here's what their president said about this lawsuit.
The curriculum's unequivocal promotion of five Aztec gods or deities through repetitive chanting and affirmation of their symbolic principles constitutes an unlawful government preference toward a particular religious.
And besides this preferential treatment by the government, he also questioned why these specific deities were chosen for worship.
Here's what he said.
This public endorsement of the Aztec religion fundamentally erodes equal education rights and irresponsibly glorifies anthropomorphic male deities whose religious rituals involved gruesome human sacrifice and human dismemberment.
Now, this lawsuit was filed five days ago in the Superior Court of California over in San Diego County.
And alongside the civil rights group, the plaintiffs also include three parents whose kids are currently enrolled in the California school system.
And inside of this legal complaint, it details how the California Board of Education, it approved what they called an ethnic studies model curriculum, which includes, among several other things, a section on affirmation, chants, and energizers, which again has the students engaging in a pagan prayer and Furthermore,
this lawsuit states that the curriculum also includes something called the Ash Affirmation, which"...invokes the divine forces of the Yoruba religion four times, honoring this divine force and seeking assistance for the school day." And then, in case you've never heard of it, here's how the lawsuit describes what Yoruba is.
And furthermore, according to this legal complaint, it outlines how the California Board of Education appointed a man by the name of R. Tolteca Kuwathan to chair a committee which was tasked with developing an ethnic studies model curriculum, which eventually became what we're talking about now.
And this man, Mr.
Tolteca-Koathan, two years ago, he co-authored a book called Rethinking Ethnic Studies, wherein he, and this is according to the lawsuit,"...demonstrates an animus towards Christianity and Catholicism, claiming that Christians committed theocide, i.e.
killing gods, against indigenous tribes." However, the irony of having kids pray to gods to whom there were literal human sacrifices while criticizing Christianity for committing theocide...
Seems to potentially have been lost in the curriculum.
However, here's how the lawyers in this case, here's how they describe it.
The Aztecs regularly perform gruesome and horrific acts for the sole purpose of pacifying and appeasing the very beings that the prayers from the curriculum invoke.
The human sacrifice, cutting out of human hearts, flaying of victims, and wearing their skin are a matter of historical record, along with sacrifices of war prisoners and other repulsive acts and ceremonies the Aztecs conducted to honor their deities.
And besides all that, regardless of the method or object of worship, their argument in this case is more so that the state should not be pushing any type of religious ritual onto kids.
Here's specifically how the lawyers explain their legal position.
Our clients have both a religious and civic objection to the Aztec prayer, and they do not want their children chanting it, being asked or pressured to do so, or risking ostracism if they refuse.
Under both the California and United States constitutions, they have the right to expect all branches of the state government Now, we here at the Epoch Times, we did reach out to the California Attorney General for comment on this case, but we have yet to hear back.
