44 Senators Issue Letter Demanding Durham Report Be Made Public; Grand Jury Advances | Facts Matter

Good evening.
As reports are coming out saying that John Durham is presenting evidence to a grand jury in order to push criminal referrals, we have a bit of an update.
44 Republican senators just sent this letter to the Department of Justice demanding two things.
An official update on the Durham investigation, as well as a promise from the Attorney General that once the final report comes out, it must be made public.
Meanwhile, over in New York State, Andrew Cuomo has officially been replaced by Miss Kathy Hochul.
And one of her first acts as the new official governor of New York State was to release information regarding the true number of COVID deaths, which was a staggering 22% higher than the Cuomo administration was reporting.
This new information is fueling calls to reignite an investigation into the handling of nursing homes during the pandemic.
Let's go through it all together.

And now let's begin today's discussion by talking about John Durham.
Now, in case you don't know, John Durham is the former U.S. attorney for the District of Connecticut, and he is also the special counsel who is currently investigating the FBI's actions back in 2016.
That was, of course, when the FBI was engaging in an operation that they internally dubbed Operation Crossfire Hurricane, wherein they spied on a Trump campaign advisor.
And potentially, actually, they might have spied on the entire campaign.
It's what's colloquially known as Spygate.
Now, John Durham has been quietly conducting this investigation for over two full years now.
And I do mean quietly.
He has offered very little updates to the public as to what is actually happening behind the scenes.
However, according to this letter right here, which was just sent to the Department of Justice, and it was co-signed by 44 Republican senators, they are urging that the final report be made public once it comes out.
Which is actually something that I'm frankly surprised that they even have to ask for, given the fact that the Mueller report, when it came out, not only was it made public, but it even became a bestseller over on Amazon.
But I guess it just goes to show how little coverage the Durham investigation has gotten in relation to the Mueller investigation.
A lot of people have actually forgotten that it's even happening altogether.
Regardless, let's go through this letter together.
So it's officially addressed to the Attorney General, Merrick Garland, quote, Now,
I would just like to pause here for a quick moment and mention that, in case you forgot, during President Trump's administration, during the first two years, you might remember that the story of Russian collusion was on the airwaves nonstop, pretty much around the clock.
In fact, there was an analysis by the Media Research Center which found that during President Trump's first two and a half years in office, the Russian collusion story was the most covered topic on the major news networks.
ABC, CBS and NBC, they collectively spent a total of 2,284 minutes of their news coverage talking about Russian collusion, which was almost 19% of all their Trump-related news.
However, that pretty much all ended when Special Counsel Bob Mueller released his report and concluded that there was no actual evidence of this Russian collusion, at least none that he found.
But the fact that there was no actual evidence didn't stop many of the legacy media outlets from propagating this false narrative for over two years.
And so the question became, what actually started this narrative?
What was the linchpin that set off the Crossfire Hurricane investigation?
What was its predication?
Because up until today, we know a lot of different pieces of the puzzle.
However, we are missing the central investigation, which is, of course, what John Durham is supposedly up to.
He's the one who's investigating whether this whole thing was properly predicated, meaning whether the FBI's course of action was rational and logical from the evidence that they supposedly had.
which brings us back to this letter, which continues as follows.
Quote, The Special Counsel's ongoing work is important to many Americans who were disturbed that government agents subverted lawful process to conduct inappropriate surveillance for political purposes.
The truth pursued by this investigation is necessary to ensure transparency in our intelligence agencies and restore faith in our civil liberties.
Thus, it is essential that the Special Counsel's ongoing review should be allowed to continue unimpeded and without undue limitations.
Now, to pause here for another quick moment, when they wrote, To ensure transparency in our intelligence agencies and restore faith in our civil liberties, that is really worth highlighting.
Because according to an earlier report, which was released back in 2019 by Michael Horowitz, who is the Inspector General of the Justice Department, he found that there were 17 major errors and omissions in the FBI's request for spy warrants.
And think about that for a moment.
The FBI went over to the FISA court in order to request FISA spy warrants against a former Trump campaign advisor.
And FISA warrants, in case you're not aware, are really supposed to be used to surveil foreign actors.
Usually they're used against foreign terrorists.
However, the FBI presented a case that Trump's campaign advisor was having suspicious dealings with a Russian national, while at the same time hiding from that FISA judge that this campaign advisor was actually reporting these interactions to the CIA. Meaning that these were likely not secretive interactions which were being kept from the U.S. government, but they were actually being reported to the U.S. government.
However, as we mentioned in a previous episode, one of the FBI's lawyers who was actually applying for these spy warrants, he altered an email from the CIA making it seem like this Trump campaign advisor was not working with the CIA and instead talking to this Russian agent under the table.
And it's likely exactly these type of things that I just mentioned that this letter is referring to because if a private citizen who just happens to work on a political campaign can be surveilled using this kind of a serious spy warrant, which is typically reserved for foreign terrorists, if the FBI can line the application and then no one is held accountable...
Well, that can certainly reduce people's faith in the intelligence communities and in our civil liberties.
So then the letter goes on and concludes by making two requests of the Attorney General.
It says, quote, To that end, we ask that you provide an update on the status of Special Counsel Durham's inquiry and that the investigations report be made available to the public upon completion.
And so, what they did is they requested an update, they called on the Attorney General to make the final report publicly available when it comes out, and they asked you to smash the like button for the YouTube algorithm.
Now, seriously though, while we're here at the Epoch Times, we did reach out to the Justice Department for comment on this matter, but we have yet to hear back.
However, one of the senators who co-signed this letter wrote a complimentary statement saying this, We are over two years into the investigation of how the Obama-Biden FBI spied on an incoming president, and we still do not have answers.
America's national security apparatus was weaponized to take down President Trump, and the American people deserve to know how this occurred.
Furthermore, Congressman Daryl Issa, he's a Republican from California, and he also sits on the House Judiciary Committee, and he recently had an interview over on Fox News where he said that this letter, as well as the Durham investigation as a whole, is a real test to see whether Merrick Garland is truly a neutral attorney general.
Here's what he said.
This is a test of the attorney general.
Is the attorney general wearing the proper hat of the highest law enforcement officer?
Neutral, if you will?
Or is this simply an appointee of the president guarding the last administration and the one before, including Hillary Clinton?
No question at all, this is a real test of whether the attorney general stands as an officer of the law.
Furthermore, what a lot of people don't know is how powerful these FISA spy warrants actually are, which actually makes a lot of sense because they are veiled in a kind of secrecy.
However, there is some evidence to suggest that these kinds of FISA spy warrants, they utilize what is known as a three-hop rule, meaning that you get a FISA spy warrant against an individual, then not only can you spy on them, but you can also spy on whoever they communicate with, as well as the people that those people communicate with.
That's the three-hop rule.
Now again, the mechanics behind this three-hop rule are a little bit murky, just like everything else related to these spy warrants, Regardless though, here's what Congressman Issa said on this front.
The FISA law needs to be reformed again.
But before we get there, the abuses, the illegal activity of lying to get warrants, lying to get information you would not be entitled to, that is exactly what is already illegal.
I would commend and be proud if the Attorney General actually is doing what we've heard and that a grand jury will indict appropriately FBI agents, Department of Justice people who criminally went after indirectly, but ultimately the Trump campaign with malice and forethought.
No question at all.
There was a bias.
We've seen it.
We've proven that part.
Now we have to hold somebody accountable.
So far, no one has been held accountable, including Hillary Clinton.
And that might indeed be exactly what's happening.
Because as we already mentioned in a previous episode, there was a report over in the Wall Street Journal which said that John Durham is currently presenting evidence to a grand jury.
Specifically, that report said that John Durham is currently examining potential criminal charges against several low-level Federal Bureau of Investigation employees and people who aren't in government.
And so what appears to be happening is that right now, John Durham is presenting evidence to a grand jury which is focused on whether the FBI's tipsters knowingly provided false information in order to launch the surveillance on Trump's campaign.
Specifically, he's examining false tips which pertain to the connections between the Trump campaign and a Russian bank called Alpha Bank.
So we'll just have to see what ultimately comes of it.
However, here's what Congressman Issa wrapped up with.
Since people within the Department of Justice and the FBI knew it was false and lied, they should be held accountable, first and foremost.
No question at all, the American people need to know the truth.
But if we don't hold the FBI and Department of Justice people accountable for their criminal activity, for their cyber crime, if you will, then this will continue again and again, including it will continue in the next election.
I'm absolutely concerned that if there is not a punishment now, we will in fact see a very similar activity of the next Republican nominee for president finding himself being spied on at taxpayer's expense and ultimately accused of just the opposite.
It has never been this bad.
It is only going to get fixed if there is criminal referrals.
And so, we'll just have to wait and see whether that's what actually will happen.

And now let's move on over to New York, which as of yesterday officially has a new governor in office.
That's right, two days ago, Kathy Hochul officially replaced Andrew Cuomo as the governor of New York.
And besides the International Academy of TV Arts stripping Cuomo of his Emmy Award, there is something else worth discussing, which is of much more consequence, in my opinion at least.
Specifically, I'm referring to the nursing home situation.
That's right.
Just yesterday, Kathy Hochul released new data which was previously not reported by the Cuomo administration.
And this new data showed that there were nearly 12,000 more deaths from the virus in the state of New York than was previously acknowledged.
Here's specifically what Kathy Hochul said during an interview with MSNBC. We are now releasing more data than had been released before publicly.
So people know the nursing home deaths and the hospital deaths are consistent with what's being displayed by the CDC. There's a lot of things that weren't happening and I'm going to make them happen.
Now, what's interesting to note is that on Monday, which is when Andrew Cuomo gave his final coronavirus news briefing, he said that the New York death toll from the virus was 43,400.
However, with this new disclosure from Kathy Hochul, it now officially stands at 55,395.
That is a 22% discrepancy.
And the reason this matters is because, if you remember, the Cuomo administration was heavily criticized for their policies which forced recovering COVID patients to go into nursing homes.
Specifically, New York State's Health Commissioner, Mr.
Zucker, he issued an order on March 25th of last year of 2020, which stipulated that no resident shall be denied readmission or admission to a nursing home solely based on a confirmed or suspected diagnosis of COVID-19.
That order, by the way, it actually went a step further, and it even prohibited staff members from testing people for COVID.
And because of that policy, more than 9,000 people who were positive with COVID were transferred over to long-term care facilities, which, according to a statistical analysis, contributed to nearly 16,000 deaths.
By the way, I say statistical analysis because the true data is hidden.
The extent of the real deaths is not known, largely because the Cuomo administration has been withholding the data in order to delay investigations.
And by the way, that's not a conspiracy theory.
That was something which was admitted by Melissa de Rosa, who was Andrew Cuomo's top aide.
You might remember that in September of last year, in September of 2020, the New York State Senate, they requested all documentation related to the nursing homes in order to have a full accounting of the true number of COVID deaths.
However, the Cuomo administration would not comply.
Why?
Well, for a long time, it was not known.
However, during a video conference call with lawmakers, Melissa DeRosa, who is again Cuomo's top aide, she said that they did not hand over the data because right around the same time, then-President Donald Trump turns this into a giant political football.
He starts tweeting that we killed everyone in nursing homes.
Trump directed the Department of Justice to do an investigation into us, and basically, we froze.
Because then we were in a position where we weren't sure if what we were going to give to the Department of Justice or what we give to you guys, what we start saying was going to be used against us while we weren't sure if there was going to be an investigation.
So that was a pretty stark admission.
She said that they were worried about handing this information over because it might be used against them.
By the way, that phone call was only made public because the New York Post obtained a recording of it.
It wasn't publicly available until then.
Now, one New York state lawmaker wrote this as a response to these comments.
Governor Cuomo, the secretary to the governor, and his senior team must be prosecuted immediately, both by the Attorney General of New York State and the U.S. Department of Justice.
This bombshell admission of a cover-up and the remarks by the secretary to the governor indicating intent to obstruct any federal investigation is a stunning and criminal abuse of power.
And indeed, New York's Attorney General, Ms.
Leticia James, she conducted an investigation and released this report here, which was, by the way, 76 pages long, and it found that New York's nursing home death toll may be more than 50% higher than officials were claiming it was, because the Cuomo administration was hiding how many residents died in the hospital.
Specifically, that report surveyed 62 nursing homes, and it found that the state had undercounted the fatalities by an average of 56%.
Now, by the way, that report is not new.
It was released all the way back in January of 2021.
However, it made very little fanfare.
Very few media outlets actually gave it serious coverage, and then shortly afterwards, the FBI announced that they will not be investigating the matter.
That's right.
The Justice Department quietly killed the investigation into how nursing homes were forced to accept COVID patients and then how subsequently the actual data was hidden.
This decision led Stephen Scalise, who is a ranking member of the House Subcommittee on the Coronavirus Crisis, to say this...
It is outrageous that the Department of Justice refuses to investigate the deadly must-admit orders issued by the governors in New York, Pennsylvania and Michigan that resulted in the deaths of thousands of senior citizens.
Where is the justice for nursing home victims and their grieving families?
These deadly orders contradicted the CDC's guidance and needlessly endangered the most vulnerable among us to the deadly COVID-19 virus.
However, with this new information that was just provided by New York's new governor, perhaps there will be a renewed effort to investigate what actually happened.
We'll just have to wait and see.
