Supreme Court: Texas Sues 4 States Over Election; Forensic Exam of Arizona Machines | Facts Matter

Good evening.
In a totally shocking turn of events that might be a total game changer in this election, earlier today, Texas has filed a lawsuit with the U.S. Supreme Court against Pennsylvania, Georgia, Michigan, and Wisconsin, accusing them of running unconstitutional elections.
This sounds like the making of a legal civil war.
Let's go through it together.
This is your 2020 election update, and I'm your host, Roman from the Epoch Times.
Now, let's start today with a bit of housekeeping.
Yesterday, we reported on how a voter rights group called True the Vote requested the Nevada voter file from the Secretary of State.
And when the state responded with the voter file in an email, the message was cc'd to another email belonging to the CEO of a Pakistani-based tech company.
Now, True the Vote made the accusation that this company, this Pakistani-based tech company, had ties to both the Pakistani military as well as intelligence.
However, last night, the CEO of this company responded to our request for comment via email, and here's what he had to say.
He said that this claim about his company's ties to Pakistani intelligence is baseless.
He said that, as a matter of fact, CAFTEC, which is the name of his company, has never worked for any government department nor had any sort of connection with them.
Furthermore, he said that this whole affair was the result of a misunderstanding.
He claims that CAFTEC had been awarded a subcontract to develop an application to help review voter information and to help identify any potential voting-related fraud.
And that was why he was CC'd on that email.
Apparently, it was an automated response from the Nevada Secretary of State's email system that whoever requests the eligible voter's report would have CAFTEC CC'd on there so that they can help provide with data visualization services.
Now, we reached out to the Nevada Secretary of State's office for comment or for clarification, but I've yet to hear back.
If this story develops any further, we'll let you know.
Now, let's move over to Texas.
As I mentioned earlier, in a totally shocking move, earlier today, the state of Texas filed an election lawsuit with the U.S. Supreme Court against Pennsylvania, Georgia, Michigan, and Wisconsin.
They allege that these four states unconstitutionally changed their election laws, treated voters unequally, and enabled significant voting irregularities by relaxing the measures that kept elections secure.
Now here's the lawsuit right here, and you know it's going to be good when it starts off with, right after the table of contents, a quote from John Adams.
And it reads, That form of government which is best conscribed to secure an impartial and exact execution of the law is the best of republics.
Now, impartial and exact execution of the law.
That is exactly what Texas is accusing these four states of not doing.
For instance, it makes the case that Pennsylvania's Act 77, which allowed for universal mail-in voting, was illegal and was in direct contradiction to both the state and federal constitutions.
The lawsuit goes on to say that when you add up all of the flaws in these four state elections, it precludes knowing who legitimately won the 2020 election and threatens to cloud all future elections as well.
Okay.
So what remedy is Texas asking for specifically?
Well, basically, they're asking the Supreme Court for two things.
The first is to make the determination that the way in which Pennsylvania, Georgia, Michigan, and Wisconsin conducted the 2020 election violated the U.S. Constitution.
And secondly, as a remedy to that, Texas is asking the Supreme Court to not allow the counting of the electoral college votes cast by these four states.
And this would be a very big deal because the cumulative amount of electoral votes from these four states are enough to determine the outcome So we'll keep our eyes glued to this lawsuit and keep your abreast of any developments as they're going to be happening.

Now let's discuss what's happening over in Pennsylvania.
And to give you a bit of context, the Trump campaign team's strategy, as stated by Jenna Ellis, is currently twofold.
One is that they're working on trying to get their lawsuits in front of the Supreme Court.
And two, at the same time, they're lobbying the state legislatures in Arizona, Georgia, Michigan, and Pennsylvania to choose their own electors to send to the Electoral College.
That's one of the main reasons that they're holding all these public election fraud hearings in those states.
Now, up to today, there have only been two cases that are nearing the Supreme Court.
The first one is the one we just talked about in Texas.
And the second one is in Pennsylvania.
Now, we discussed in yesterday's episode, and I'll throw the link to that right here in the top right corner for you to check out, how Supreme Court Justice Samuel Alito, who is in charge of the emergency appeals in Pennsylvania, asked to have all of the briefs submitted by today, which is Tuesday.
And indeed, they were.
Earlier today, lawyers representing the governor of Pennsylvania filed a brief as a response to the Republican lawsuit.
Now, if you want to know more about that lawsuit, it has to do with the argument that Pennsylvania's Act 77 expanded mail-in voting illegally.
And we discussed that in yesterday's episode, so you can check that out for yourself if you want to know more of the details.
But now that this brief has been submitted, it's in the hands of Justice Alito.
And we'll know in the next few days, or even maybe later today, whether the Supreme Court will take up this case or not.
And this case is very significant because if Act 77 is found to have been illegal, then hundreds of thousands of ballots might be disqualified as a result, which would be more than enough to flip the entire result of Pennsylvania's election.
And just as an interesting aside, this lawsuit is not without precedent.
There have been attempts to expand mail-in voting in Pennsylvania in the past.
For instance, even as far back as the 1800s, the Pennsylvania Supreme Court struck down a law called the Military Absentee Ballot Act of 1839.
That act attempted to expand absentee voting in the state.
But even back then, the Pennsylvania Supreme Court held that a constitutional amendment was required to expand absentee voting.
You can't just do that through state law.
And that is pretty much exactly the argument that's being made here over 180 years later against Act 77.
So, we'll just have to wait and see what Justice Alito decides.

Now, let's move on over to Arizona.
The state legislature there sent out this press release last Friday in which they called for a forensic audit of the Dominion voting machines in Maricopa County.
Which, by the way, Maricopa County is the largest county in Arizona.
Something like 61% of the people live there.
And this call for a forensic audit came after President Trump's team held a hearing where they presented allegations of voter fraud and irregularities in Arizona's election.
So this press release reads in part, So what types of allegations is this referring to?
Well, among other things, President Trump's legal team presented witnesses to the Arizona lawmakers who, among other things, said that they saw Trump votes being shifted to Joe Biden once they were entered into the Dominion machine.
And they said that they saw this on multiple occasions.
Now, however, I will mention that the Dominion Voting System company came out on multiple occasions and strongly denied these allegations.
They say, for instance, that it's not possible for the voting machines to change votes like that from one candidate to another.
So who's telling the truth?
Well, perhaps a forensic audit will be able to determine that.
And it's not just in Arizona.
Yesterday, we discussed a similar forensic audit being conducted in Michigan as well, the results of which we're waiting for any day now.

Now, let's move on over to Georgia.
Yesterday, a federal judge dismissed Sidney Powell's election lawsuit there.
The decision was mostly technical, though.
The judge argued that the plaintiffs have no standing to bring the lawsuit, that it should have been filed in state court rather than federal court, and it was also brought too late.
Now, by the way, if you want to know the details of that lawsuit, of Sidney Powell's lawsuit, we covered that in an earlier episode where we went through it and distilled it down to the 30 allegations of voter fraud that it presented.
And I'll throw the link to that episode in the top right corner here for you to check out.
Now, Sidney Powell asked this judge to not dismiss the case, and she requested a few extra days so that she can conduct an examination of the Dominion voting machines in order to find out exactly what went on and to give the court further evidence.
But she was denied.
So we asked Sidney Powell what her next steps are, and she emailed us back saying that she will appeal this decision and proceed as fast as possible to the Supreme Court.
So we'll keep you abreast of any developments in this unfolding case, and I'll throw the link in the description box below this video so you can check out the judge's reasoning for yourself.
See if it makes sense.
Now, following George's second recount, which was also conducted without any signature verification, Joe Biden seems to still be the winner by about 12,000 votes.
The Secretary of State in Georgia has come out and affirmed this conclusion.
However, the Trump campaign has repeatedly called for a more complete audit of Georgia votes, saying that without signature matching, any recount would include fraudulent mail-in ballots.
However, now that the Secretary of State has come out and affirmed the recount, that might be an indication that he is not going to be conducting any sort of signature audit in Georgia.
Now, we discussed some of the evidence of voter fraud that would call for a signature audit in an earlier video, which included surveillance footage from Atlanta.

Now, does this mean that President Trump has no more avenues to victory in Georgia?
Well, no, not necessarily.
Besides the Supreme Court case that we discussed earlier, lawyers for the Trump campaign are increasingly calling on state lawmakers to use their constitutional power and select their own presidential electors, which, according to this article here, is being seriously considered in Georgia.
