Well, we had the New Hampshire primary yesterday, and surprise surprise, they actually came up with a result!
Unlike Iowa, which is gonna go back into a recount.
And it was essentially a draw with Bernie and Booty.
Bernie had slightly more votes, but of course Booty got the delegates, and surprise surprise, it's about delegates.
As a matter of fact, the losers, even people like Elizabeth Warren, said, well, you know, we have a delegate strategy here.
Yeah, you have a delegate strategy when you run for the presidency as well.
It's called the electoral college.
But when you lose, if you're a Democrat, what you want to do is you want to burn down the system.
That's as true of the leaders of the party as it is of their street mobs who want to burn down our cities if they lose.
And they've threatened to do that again as they attempted to do after President Trump won.
So today we're going to take a look quickly at the results.
We're going to look at who has dropped out, who bit the dust.
And where do they go from here?
We're also going to take a look at what is going on with Roger Stone.
I talked about that yesterday and in the afternoon I met my wife and daughter at a fast food place to grab a sandwich.
We had things that we had to do and I nearly choked on my sandwich when I looked up and saw CNN.
Curious about the fact that you had these Department of Justice people, Department of Justice came back in response to President Trump saying, this is really excessive.
You know, that's far more than we typically require prison sentences for innocent people.
And CNN was saying, what's this going to mean for the rule of law?
And look at this, we've got these Mueller Shills, who have been lying to us about Russia, Russia, Russia.
I mean, these people are proven liars.
They're the ones who ought to be indicted!
And President Trump has now taken action to make sure that one of them does not get promoted, at least.
Can we at least do that?
Well, maybe that is going to happen.
And maybe there will be a A pardon.
Norm Pettis is going to be joining me in the third hour.
We're going to talk about the sentencing guidelines and so forth, what's going on in the Department of Justice.
Is this grounds for impeachment, they say?
Look, this is not an impeachment trap.
This is a test of whether or not President Trump's got a backbone to do the right thing.
It's just that simple.
They will do anything to impeach him.
Anything.
Haven't we seen that already?
We have the imagination of Hillary Clinton.
She was the one who said, look at this, the Russians, they released all that dirty stuff about me.
Well now, we've had Judicial Watch find some more Hillary Clinton emails, and it may be grounds to finally lock her up.
But of course, I don't think any Democrats are going to go to jail.
I don't think any people in the establishment bureaucracy of the deep state, I don't think they're going to go to jail either.
I don't think they're even going to be fired.
These people who said, well, we're out of here, they got off of the case.
They're not resigning.
They're not going to get rid of those cushy jobs with the pensions and so forth.
So we're going to talk about that with Norm Paddatz, and of course we're going to talk about free speech.
You see some of the voters, as we look at some of the exit interviews and so forth, we had one voter tell an MSNBC reporter live on air, you know why I voted for Sanders?
Because I'm sick of the way you've been lying and spinning the information here.
So yeah, there's some blowback on that.
And we'll take a look at the issues as well, because we have Buttigieg, Saying that we need to flood small American towns with immigration in order to grow population.
I guess he's still thinking about the fact that he was mayor of such a tiny, tiny town.
And, you know, I imagine there's kind of a population envy going on there.
Because, you know, there's 307 towns where the mayors had a lot more on their plate than Booty Gay did.

It's the day after the New Hampshire primary, and surprise, surprise, this time somebody counted the votes, we're told at least.
We can presume that it was accurate, but we have other polls besides the New Hampshire poll.
Here's one poll that not too many people are talking about.
55% of voters say that impeachment push made Trump stronger.
Only 16% say that he's weaker.
Frankly, as we look at what's going on with Roger Stone and the furious hand-wringing, as I said, I happened to see it on CNN yesterday when I was in a fast food restaurant with my wife and daughter.
They were so upset about the fact that President Trump would say, you know, this is ridiculous.
There wasn't even any Russia thing.
It's been completely exposed as a fraud.
They sent the wrong person, trying to send the wrong person to jail.
And I tweeted out, I said, I think this is really kind of a move by the Justice Department, not necessarily to pull back and do what President Trump wants, but it's a move by them, these people who came after Roger Stone, Part of the Mueller investigation.
I think they want to send him to prison.
And they realize that as much as they hate Roger Stone, why?
Because of his association with President Trump.
This is really about coming after President Trump.
We know that.
And making up whatever they need to.
That's why President Trump, the majority of people, 55% say this impeachment nonsense made him stronger.
Because we can see how criminal these liars are.
Throughout the government and the Democrat Party, how they just make stuff up about people.
Not only President Trump, but also Roger Stone.
So when we look at this, I'm looking at these people in the Justice Department that want to continue to come after Roger and to make him serve seven to nine years.
They jumped the shark, frankly.
I think that was what they realized.
And I think they want to make it more difficult for President Trump to issue a pardon to Roger Stone by saying, well, no, no, we're not going to go that that excessive on this.
I mean, it was so far over the top.
And so I think they'll come back with something, you know, a couple of years and you're going to pardon him for that.
And a lot of people said this is an impeachment trap.
They want President Trump to pardon Roger Stone so that they can then impeach him for that?
Look, they're going to impeach him for anything that they can imagine.
We've already seen two moves to try to remove him from office that had absolutely no connection to reality.
Of course they're going to do something.
The real test for President Trump is whether he does the right thing.
And what he needs to do is not only pardon Roger Stone, but he needs to get rid of this incredible prison system that we've got.
That's the way that you take out Bloomberg.
You don't criticize him for stop and frisk.
You know, this first step that was done by President Trump, that is, it's good that they said, well, we have these mandatory minimums and after somebody goes to jail, sentenced to jail for life for a tiny bit of pot or whatever, you know, they don't get life sentences, but they get a 10 year sentence or draconian sentences.
That are mandated by algorithm without the judge having the ability to look at somebody's past life or their character and consideration of the sentencing.
Once they go to this algorithm, these mandatory minimums that have been part of the drug war.
That's why we have more people in prison in America than any society at any time in history.
We have more people in absolute numbers in prison than the Chinese do.
Not as a percentage of population, absolute numbers.
And it's because of this insane war on drugs.
Now, the first step said, we're going to take a look at people's lives, and if this is the first conviction, and if it was non-violent, and we'll actually do what we should have done if we don't have mandatory minimums.
And if somebody has served some time under our illegal UN war on drugs, they've served a few years, we don't need to keep them in there for life and charge the taxpayers for life.
We can let them out, and that's what President Trump did.
Now that's good, but that's the first step, and it's a teeny tiny, teeny tiny first step.
What President Trump needs to do is he needs to sweep away this mandatory minimum stuff, and he needs to get rid of this unconstitutional war on drugs.
You want a war on drugs?
Well, pass a constitutional amendment.
The reason they did it that way was because people realized what an absolute failure alcohol prohibition was.
But at least they had respect for the Constitution to do it legally.
So we'll be talking about Bloomberg when we come up here in just a couple of moments talking about the issues.
But Joe Scarborough is really freaking out.
He says he's getting panicked calls from Democrat Party insiders.
Insiders of the Democrat Party fearing the 2020 election.
They're panicked.
They fear that President Trump is going to be re-elected.
That's right.
And there's a good reason for that.
Because when you look at what these people are proposing, most, almost every one of them, when you go back and you look at their austerity programs, and that's what it is, every single one of these Democrats has a program of policies and issues that could be characterized as just simply forced austerity.
It's not about liberty.
No, no, not at all.
It's not about equality, even.
Or justice.
It is about austerity.
They want to force it on you, and the reason they want to force it on you is because of climate change.
And as The New American points out, we've had two very respected international polls Come out in just the last couple weeks, one from the Pew Research Center, the other one from the Gallup people, asking people what they're concerned about, what the biggest issue is.
And surprise, surprise, climate change is not a big issue, but it is the central issue for all these Democrats.
That's how out of touch they are.
They want to take our jobs, they want to take our homes, our meat, our transportation, everything in our lives.
They want to raise our taxes, impose carbon taxes.
I just showed you the pushback in Oregon yesterday.
I showed it yesterday, but it happened over the weekend.
It happened at the end of the week, I think.
Friday, I think, is when it was.
Had a thousand truckers show up because the Democrats in Oregon are trying to shut down the timber industry and shut down the truckers as well with carbon taxes and so forth.
They're going to shut down our transportation grid.
They're going to shut down everything in our economy and they got to do it because of climate change and yet nobody really believes this.
In the Pew poll, they asked 1,500 adults, 1,505, And this was conducted January 9th through the 14th.
They said, what should be the top priority for Washington this year?
And they gave them a multiple choice.
Things like the economy, health care, education were at the top that people chose.
Other things, the next tier, terrorism, Social Security, Medicare.
Out of 18 issues that they gave them as multiple choices, The climate change issue placed 17th out of 18 with the people who looked at it.
By the way, global trade, as I point out, came in dead last, suggesting that President Trump might not want to hang his hopes solely on his trade policies.
And they said, although many more Democrats and Republicans considered climate change to be a top priority in that Pew Research poll, that was 67% of Democrats versus 21% of Republicans, The issue still wasn't the top five issue for Democrats.
In the Gallup poll, it was even more interesting because they didn't make that a multiple choice.
It was a write-in.
So they asked people, what is the biggest problem, the nation's most important problem?
Not the Pew question, which was, what should the government's top priority be?
Give them a list of 18 different things, where climate comes in number 17.
Now Gallup has asked this every year since 2001, and on an infrequent basis for the past 60 years.
So what is the country's biggest problem?
And they wrote it in.
Guess what the biggest problem was?
Government!
Government is the biggest problem!
And you can put as a, in parentheses, Democrats and government especially.
So the most, the biggest problem for the government, if you just simply ask people instead of feeding them the answer, which is what MSNBC, CNN, Pew and these other people do.
Yeah, government is the biggest problem.
It's not the solution to anything.

That's right, we've got two of them that have now bit the dust in the wake of the New Hampshire primary.
We'll talk about who is circling the drain in addition.
We've got the results as well as the issues and we've got the pushback of people saying we're sick and tired of MSNBC and CNN spinning this and pushing us to one candidate or the other.
But who is out?
Who bit the dust yesterday?
Well, Michael Bennett, Colorado Senator.
Did you know that he was even in?
Of course you didn't.
I played a little bit of a clip as they were trying to push him, give him a little bit of a boost on one of the liberal cable news channels, quote-unquote news channels, and all he was talking about was he said, we got a climate denier in the White House!
How did that happen?
We can't do that again.
We've got to, you know, vote for me.
I'm all about the climate.
I just told you, it's not even on the top five issues of Democrats.
When Pew did the poll in the middle of January, they said that out of, they gave people, what's the top priority of government?
Here's 18 different issues.
Well, climate change was number 17.
When Gallup did the question, what's the country's biggest problem?
And they asked people to write it in.
Climate change wasn't even a write-in, not even a write-in on that poll.
The biggest problem is government.
You see, the government wants to, the Democrats want to justify Making a totalitarian government.
And that's really what we're talking about.
Centrally controlling everything in your life.
Every detail.
No restraints on central power whatsoever, because we've got to save the world!
It's all melting, right?
And that's what he represented.

It's not just about who's in the White House, he said.

And now they're going to go right down that list.

Anyway, the other guy to get out is Andrew Yang.
Now it was kind of interesting, one person took this as a slight for Trump.
Andrew Yang said in the wake of the Iowa mess, he said it might be helpful to have a president and a government that understand technology so this sort of thing doesn't happen.
I kind of think he was holding himself out there.
I could be a president Who understands technology, and I could keep this from happening.
No, I tell you what, if you understand technology, you understand that you don't want to have electronics anywhere near the counting of the election, or the casting of votes.
If you understand the technology, if you're not an absolute neophyte, you've got to understand that there is no such thing as cyber security.
It's a fantasy.
I've had William Binney on, and he said, there isn't anything that can't be hacked by the NSA.
And they don't even need to hack it.
I mean, the CIA, you know, the NSA is code breakers.
You know, they're going to go out there and they're going to break the code.
But the CIA just goes out and sets up front organizations, as we just saw.

Well, it turns out it's a CIA front.

He said, that whole thing in Iowa, that was so weird to me.
He said after the debate this last weekend, he said, it's like an app failure.
OK, that's not ideal, but all right, you can imagine that.
Yeah, you have to imagine that there was no corruption behind that incompetence.
That's a bit of a stretch for me, quite frankly.
I don't imagine that that's the case.
I think it was planned that way.
Anyway, he said that as he was talking to another person after the New Hampshire debate.
Went on to say, maybe everyone will see what happened in Iowa and be like, our jobs are safe.
It's not exactly clear what he meant, writes Breitbart, but he frequently warns about technology automation replacing workers.
Yeah, so, you know, his thing is, he's kind of laughing about it.
He goes, yeah, maybe everybody will look at that and say, look at this, failure of technology.
Maybe they're not going to have robots take my job.
Ha ha ha.
No, no, no.
It doesn't matter whether the robots can do your job.
What matters is whether the Democrats will mandate that you lose your job, or you lose your car, or you lose your home, or you can't eat meat, or you can't have a gun to defend yourself and your family.
It's not about what works.
It's about them making the decisions for your life.
That's really what this is about.
So, Yang and Bennett are out.
As a matter of fact, he did have one thing I think that was good to hear, Yang did, and it's something really that Elizabeth Warren and Joe Biden should listen to.

No, no, no.
They don't do that.
They keep asking for money, and they keep slogging on.
She was known and well liked among Democrats in New Hampshire, writes the Concord Monitor.
Voters historically prefer presidential candidates who are their New England kin.
Then came last week's third place finish in Iowa, punctuating what has been a steady fall for Elizabeth Warren.
Now, instead of a victory lap, her New Hampshire campaign has the feel of a last stand.
In political campaigns, having to insist that hope is not lost Is never a good sign, but that's exactly where the Warren and Biden campaigns are right now.
They're trying to put a happy face on fourth and fifth place finishes.
And so Elizabeth Warren has her, here's how she puts the spin on it.
She says, we might be headed for another one of those long primary fights that lasted for months.
And so she's going to slog it out, just like she slogged it out in the snow and the rain and the cold in New Hampshire.
We're two states in, with 55 states and territories to go!
The famous 57 states of Obama.
We still have 98% of the delegates for our nomination up for grabs, and Americans in every part of our country are going to make their voices heard.
So it's all about the delegates.
It's all about the delegates, right?
Except Elizabeth Warren got zero delegates yesterday.
Zero.
I don't think she got any in Iowa either.
And she's got her campaign manager saying that Super Tuesday is going to be what's going to keep their Titanic ship going.
Campaign manager laid out his team's preparations for a drawn-out contest again in a memo to supporters Tuesday afternoon.
Hinting that Elizabeth Warren is expecting to take a hit in the New Hampshire primary when results were released later in the evening.
They knew it was going to be bad.
They said, Warren is the consensus choice of the widest coalition of Democrats in every corner of the country.
But in the memo, as was pointed out by Naomi Lim, he failed to mention a single state That they believed that they could win.
Instead, it was like this nebulous idea of delegate math, right?
We're gonna win the contest for delegates.
Well, you've got to win some states in order to do that, quite frankly.
I think a lot of these states, they don't apportion the delegates by, you know, they don't apportion them by the vote.
They just winner takes all.
And so, they really don't have A path to victory.
But they don't have a path to do anything that they wanted to do.
Remember, Elizabeth Warren is trying to bribe college students saying, I'll give you $50,000 and I won't even bother to go through Congress.
But you can't do that.
And all these Democrats are promising you one welfare program after the other.
Tens of trillions of dollars.
They can't do that either.
They can't do the math.
Well, actually they can't.
They just think that you won't call them on the lies.
They think that you can't do the math.
Let's take a look at Biden, for example.
As New York Post puts it, the spectacular collapse of Joe Biden.
Yeah, referring back to Clueless Joe, right?
Instead of Shoeless Joe, it's Clueless Joe now.
Say It Ain't Joe was the headline of the New York Post, but he can't say that it ain't him.
He keeps on going and going and going, except unlike the Energizer money, he's not moving.
Once the presumptive Democratic nominee, Biden, fled New Hampshire with his tail between his legs.
He didn't even stick around.
That's how bad it was going to be, knowing that that was going to happen.
And he said the same thing that Elizabeth Warren said.
It's only two states.
He says, tonight we heard from just the first two of 50 states.
Just two, said Biden.
It ain't over, man.
We're just getting started.
It's never a good sign, said the University of Southern California political scientist Robert Trump.
Never a good sign when you leave a primary before the results are in.
And it's not a good sign when the best you can do in any jurisdiction was a second place finish.
Let's play a little bit of that clip showing Biden's best finish in New Hampshire.

Now we don't have a ton of vote down there yet, so we'll see if it comes in.

Second way up there.
I'll take a look at the size of that.
I almost don't want to do it because it feels mean to do it.
We're talking about a very tiny place up here.
It feels almost mean to do it.
But that just tells you that, again, you're not first, you're not second, you're not third in any place of significance on the map.
That is the definition of a very bad night.
Yeah, he finished in a very small area.
He finished second.
And overall he finished fifth.
And he didn't get any delegates in New Hampshire either.
Van Jones had this to say about Biden's weird strategy that he thinks is going to blow up in his face.

Hey listen, again, he's doing this rope-a-dope strategy.
I'm just going to get pounded in Iowa, I'm going to get pounded in New Hampshire, and I'm going to come back based on black people kind of lifting me over all these deficits.
And maybe it'll work for him.
But it's a very odd strategy, it's a very weird strategy, and I don't know if he knows, African Americans actually are watching TV tonight and see you can't get white votes.
And the reason that African Americans liked Obama Obama could get some white votes too!
Right.
And so, it's a bizarre kind of thing.
It's a sad thing.
For me, I got a chance to work for Biden in the Obama White House.
There's nobody that's got a bigger heart.
There's nobody who cares more.
There's nobody who understands the pain of ordinary people more.
It's sad to see where he is in this campaign.
But this strategy, I think, is going to blow up in his face.
Well, Alexander, that was the argument.
Yeah, it's going to blow up in his face.
thinks he can go to South Carolina and get votes from African-Americans but they're gonna look at this and say he can't get white people's vote why would I vote for him he can't win type of thing and he said you know they wants to refer back to Obama but Obama could get a lot of white liberals to vote for him Biden has said we could run Mickey Mouse against this president and have a shot unfortunately they don't have a Mickey Mouse What they've got are the seven dwarfs.
They've got Sleepy, who's about to disappear.
They've got Grumpy, who just won the New Hampshire thing.
They've got a lot of dopies.
But they all think they're Doc.
Every single one of them wants to take over our health care and run that.
Again, I'll remind you that when you ask people this question across the country, As a write-in.
Instead of giving them categories and saying, this is, you know, which one of these things that we always tell you government should be doing?
Which one of these things do you think is most important for government to be doing?
Because we tell you, we've got these 18 things that government needs to be doing.
And there's probably only two of those on the list that under the Constitution they should be doing.
But when you ask people what the biggest problem in the country is, not what government should be doing, but what is the biggest problem, most of them write in government.
And that's the problem that the Democrats have in front of us.
And then they also have this.
You have the student who was called a lying dog-faced pony soldier by Joe Biden.
Says that the former VP's designation there was tasteless and very sad.
She said it was kind of humiliating, the 21-year-old student, kind of humiliating to be called a liar on national TV by the former vice president.
Yeah, there you go.
That's not where he got it.
That should have come from Kramer.
Seinfeld.
You're a lying dog-faced pony soldier.
But actually it didn't.
Anyway, it was kind of humiliating to be called a liar on national TV by the Vice President.
Instead of answering the question, his immediate response was to attempt to invalidate me by exposing my inexperience.
That's what they always do.
Very common tactic.
He's not ever gonna get a straightforward answer from these people.
They're always gonna attack you.

I'll just mention again, Norm Pattis is going to be here in the studio.
We're going to talk about free speech, but especially about this persecution of Roger Stone.
By the way, over 150,000 people have signed petitions urging President Trump to pardon Roger Stone.
Michael Caputo, former Trump presidential campaign staffer and a longtime friend of Roger Stone, has collected 100,000 signatures.
And then there's a couple of other petitions.
There's one on the official whitehouse.gov website with about 16,000.
Change.org has about 40,000 signatures.
And this was all within just a few hours.
of the draconian sentencing request coming from the Department of so-called justice.
As Caputo points out, he says, just as we can see this elaborate impeachment hoax that just collapsed, the second one, it's exactly the same people who set up the first one and who set up Roger Stone.
People like Adam Schiff.
And people like these individuals in the FBI and others who put this up.
And he reminds everybody that Roger Stone was convicted by an all-Democrat jury in the District of Columbia.
And we talked about that when they were selecting jurors there.
How they had somebody who was a high-ranking Obama official.
Oh, no, no, that's not a problem.
You can't be a Republican and be on this jury.
I mean, that's how this whole thing was rigged.
There was no underlying crime.
But they say, well, he lied to Congress under oath, and I've hammered this about James Clapper because I think he's probably the best example of somebody committing perjury I've ever seen in my life.
I mean, you knew he was lying about that, even if you didn't know anything about the history of the NSA and what these people were doing when Ron Wyden asked him, Are you grabbing information from people's phones and so forth?
Are you doing dragnet surveillance on Mr. and Mrs. Verizon?
He didn't call it that.
That was the way that Rand Paul described it.
Rand Paul said you can't go to the FISA court and say I want a search warrant on Mr. and Mrs. Verizon.
It's a real search warrant.
You have to go to a real judge and a real court and you have to say, you have to be very specific about why you want the search warrant, where you're going to look for it, who you're going to look at and so forth.
These are just general warrants.
A hallmark of tyranny.
Anyway, he goes on to say, Meanwhile, we have not only Clapper, but we've got Comey, Brennan, McCabe, Strzok, Page, and Mueller himself all lied under oath.
They don't care.
Because, see, Democrats and bureaucrats can't commit crimes.
Only Republicans can.
And so over 150,000 people have signed a petition.
We're going to be talking about Roger Stone with Norm Pettis, a lawyer who knows a great deal about sentencing guidelines and other things.
And we've now had four prosecutors.
Leave the case in protest after President Trump said, this is ridiculous.
And it is ridiculous.
And it's gone on for way too long, in my opinion.

Biden, I want to take a look at Bloomberg as well.
Because this strategy really is Super Tuesday.
You know, you have the Biden camp and the Elizabeth Warren camp saying, well, you know, we've only had two results so far, and we're going to be playing in the Super Tuesday ballgame.
No, that's really Bloomberg's ballgame.
Because Super Tuesday is where you have the organizations that have the money to buy TV ads.
He doesn't have an organization, but he's got the money to buy an organization and run all the TV ads.
He's already, as I've pointed out many times, already spent more by himself before they had the first votes in Iowa.
Bloomberg had already spent over $100 million.
And that was, in 1996, what both presidential campaigns and both political parties spent, all four of them, combined.
And all four of them combined only spent slightly more than that in the 2000 election, where you had Bush and Gore.
And now you've got Bloomberg, by himself, spending that much money even before the first vote was cast.
So, we were talking before we went to the break about the student who said, yeah, it was really It's kind of humiliating to be called a liar on national TV by a vice president.
Well, you know, that's really what he's been doing all of his life, his entire political career.
Timothy Carney said, maybe nobody likes Biden because he's a jerk.
And, you know, he came after this 21-year-old student.
He said, I was a 22-year-old reporter on Capitol Hill.
Biden was reliably obnoxious to me.
Blowing off my questions with sarcasm and personal jabs?
That's who he is.
That's who he is.
For instance, he said, when I asked him about illegal immigration, he implied that my parents were illegal immigrants and asserted that I advocated hanging everyone who enters the country illegally.
No basis for that, right?
I just accuse people of things.
Biden ran the Judiciary Committee that borked bork.
One of the key moments in making Washington politics poisonous, cantankerous, and as dishonest as it is now.
And it's not even the Bork thing.
Now that happened before Clarence Thomas.
But I remember Joe Biden in the Clarence Thomas hearings coming after Clarence Thomas because Clarence Thomas had mentioned natural rights.
Natural rights.
In other words, the whole principle that the Declaration of Independence is based on.
The whole foundation of the American idea behind our independence and our Constitution.
Joe Biden doesn't like that.
He was very angry that Clarence Thomas had mentioned natural rights.
You don't have natural rights.
You have privileges that are granted to you by government.
That's the Biden and the Democrat view of things.
But when you look at the Bork issue, Reason said Joe Biden blocked Bork and now Biden is getting Borked himself.
What does he mean by that?
He said who's to blame for an electorate that values youth over experience that has elevated Booty Gay and Barack Obama over Biden or Hillary Clinton?
The culprit in a significant way is Biden himself.
He bragged, I almost single-handedly made sure that Robert Bork did not get on the court.
He said that in the Democrat primary debate last Friday night.
But he points out when Reagan nominated Bork in 87, Bork was 60 years old.
He had been a professor at Yale Law School.
He had served as Solicitor General of the U.S.
and as an Acting Attorney General.
Bork had served five years as a judge on the U.S.
Court of Appeals for the District of Columbia Circuit.
But he said one of the most significant ways that he upended the nomination was to change it.
Pre-Bork he said the most desirable thing was to have a lot of experience.
So Senators, be convinced that you were qualified for the job.
After Bork, however, the most desirable thing became to have a short paper trail as possible so as to minimize the chances that a nominee's writing could be distorted or seized upon in a way that could ultimately derail the nomination.
And that's really exactly what Biden did.
He distorted the record.
And he even came because Clarence Thomas had a record of natural rights.
He came after him with that.
Joe Biden would have borked Thomas Jefferson, and George Washington, and John Adams, and even Alexander Hamilton, the most statist of all the founding fathers.
They would have all been borked by Joe Biden.

You know, not only are the Democrats openly capable of trumpeting the idea that you're going to kill children born full term, that's what Governor Nauldum first became famous for nationally, before he became famous for his Ku Klux Klan pictures, and before he became famous for his gun control.
And now the Virginia House has approved a bill to join the national popular vote.
Now, I mentioned earlier in the program how you've got the fourth and fifth place finishers, Elizabeth Warren and Joe Biden, saying, don't give up yet.
This is about the delegates.
This is not about the popular vote.
It's not about, we just had two states here.
This is about getting the most delegates.
And we know that Hillary Clinton won the nomination for 2016.
When she got more delegates than Bernie did.
And that happened state after state, even though Bernie would get more votes.
And we just saw that happen again in New Hampshire.
They did it based on the portion of the delegates instead of winner-take-all.
And so since the two of them were very close, Bernie and Booty are going to get the same number of delegates.
In Iowa, it was also very, very close.
And until they do a recount right now, Booty has one more delegate than Bernie.
So even though the two of them are very close, it seems like last I saw, I don't know how he got more delegates, maybe it's the Clinton rule, but last I saw, Bernie was leading by a few thousand votes in Iowa, but of course they can keep recounting the votes until they get the desired result.
That's actually the headline of a satire piece that somebody put out.
But that's exactly what is going on with this.
But as they talk about, well, we're going to have the delegates and that's how Hillary got the election, but then when she got the nomination, when she lost the election, she said, it's because of the Electoral College and we've got to destroy it.
And now that's the argument in Virginia.
You've got a Republican saying the Electoral College is, quote, part of a quaint thing that we used to call in civics class checks and balances, said a delegate where a Republican on the House floor.
But the Democrat, Mark Levine, argued that the Electoral College was a throwback that, quote, began at a time when the founders actually didn't think there would be political parties.
Except their political party is all about the superdelegates, isn't it?
So this is a convenient dodge for them.
Because they just hate everything that the Founders did.
They hate the Constitution.
And they want to get rid of all of it.
Now, Virginia is going to join 15 states.
And this is a given.
I mean, it's going to be signed into law by the governor.
This is something that all the Democrats want.
This has now become a part of their party platform that they must destroy the Electoral College because they want presidents to be elected by a few cities.
That's the bottom line.
It doesn't have anything to do with race or any of these other issues.
You know, that delegate there, the Democrat, Mark Levine, goes on to essentially call the Constitution racist.
Anything they don't like is racist, including the Constitution.
And the Declaration of Independence, sure.
Because, you know, it's got natural rights.
That's what Biden came after Clarence Thomas, a black man, because he believed in natural rights.
No, no, no, that's racist, Clarence Thomas.
Anyway, they will join 15 states and District of Columbia when they put in their 13 electoral votes that will bring the total electoral votes to 209.
Once they get to 270 possible electoral votes in this Vote Compact, the National Popular Vote Compact, then that triggers it.
And so, despite what your voters select in your state, you will throw their votes away And you'll go along with the Democrat herd.
Because that's what we're talking about.
The herd is going to be determined by a few big cities.
That's already what's happening in many, many states.
That's why you have a lot of individuals saying in Oregon, in California, and now we've been talking about in Virginia, we need to secede because we don't have a voice anymore within our state.

Warren and Biden claim that they've got a path to victory through Super Tuesday, so they're going to keep going.
But the winners yesterday, and essentially a tie, a tie for delegates, and that's really what matters, you had Bernie slightly ahead, 25.7% to Buttigieg at 24.4%, leading by a 1.3 margin.
to Boudiguet at 24.4 percent leading by a 1.3 margin. By the way, President Trump beat William Weld who was, you know, again he's a popular Massachusetts governor evidently.
Former governor.
And so you would expect that he would do well in New Hampshire, and he got about 9%, but President Trump beat him 85% to 9%.
So, yeah, that's... I don't know how much longer William Weld is going to do this.
Maybe he can't do math either.
Sanders and Boudier get the same number of delegates.
They get nine each.
Amy Klobuchar moved up to third place.
She gets six delegates.
She was at 19.7%.
Elizabeth Warren and Joe Biden got zero.
Zero.
And again, Buttigieg is one delegate over Biden in the overall total.
Obama adviser David Axelrod said on Elizabeth Warren's campaign this is a terrible night for her, and yes it was.
But when you look at the shakedown on the votes, You can see what's happening with Booty Gay.
It's amazing to me to see how the media has coalesced behind him.
Even more interesting to see how the intelligence community has done that.
There is a satire piece from Unsubscribed Media.
It says, DNC promises to keep counting the votes until Bernie isn't the winner.
That's basically what's going on.
And a fake quote from the satire site of Tom Perez, DNC Chair.
We will work tirelessly across this great land, counting and recounting, throwing away ballots, even deleting votes if necessary, to make sure that Sanders does not become the nominee.
We will not let 2020 be another 2016.
Except that Bernie will not win the nomination, Perez asserted.
No matter what we have to do.
And that's basically what's going on.

She says, I decided I'd vote for Bernie simply because of what you're doing here on MSNBC.
And it was an MSNBC reporter who was interviewing the audience.

I voted for Bernie, although there are a number of candidates that I really like and so I felt like when I finished voting I was still undecided.

Now that's sort of a paradox to decide and then feel undecided.

Yes, but I want to say the reason I went for Bernie is because of MSNBC.
MSNBC. And I think it is completely cynical to say that he's lost 50% of his vote from the last time when there were two candidates.
Now there are multiple wonderful candidates who would be great presidents and people that we could, I think, that we can unify and get behind.
But the kind of the stop Bernie cynicism that I heard from a number of people, I watch him MSNBC constantly.
So I heard that from a number of commentators.
And so that just made me angry enough.
I said, OK, Bernie's got my vote.
This is such an interesting point.
What you're saying is, and we take criticism because we're journalists, right?
We got to be open minded.
You're saying that hearing from people, whether it's guests, contributors, the conversations you've heard that you felt were designed to tear down Senator Sanders or, quote unquote, stop him, actually endeared him to you.
Absolutely, absolutely.
I could have chosen several candidates, but that's what pushed me over the edge for Bernie.
That's really interesting and thank you for sharing it.
See, I knew you were complex.
Yeah, because there's not really much difference between any of them.
You can see it in the policies that they put out.
I've pointed that out over and over.
They all want to raise minimum wages.
Some of them, $17.
We just had Tom Steyer, in order to distinguish himself from everybody else, said, oh, I'll go to $22.
Do I hear $23 from any of the Democrat candidates?
Elizabeth Warren and all of them have been saying they're going to forgive student loans.
But she goes a little bit further.
She says, I'll do it without Congress.
I'll just do it by executive order.
So that's how they're competing with each other.
There's really not a dime's worth of difference between them.
So I said, when they flipped a coin in Iowa, a couple of the caucus results, they said, well, we'll just flip a coin because we can't decide.
They can't count.
So I said, yeah, there's not a dime's worth of difference between them.
But this is what this is an example.
of what this lady was pushing back against.
Again, she said, yeah, they've got a lot of quote unquote great candidates that just want to give her free stuff, right?
She could have chosen any of them, but she got angry because MSNBC was spinning this.

We got a good example of that spin.
If Bernie Sanders, though, doesn't run away with it, isn't this... I mean, he hasn't even... He can't run away with it.
Look, last time, four years ago, sitting right here, Bernie Sanders won 60% of the vote.
We were sitting here and it came in at 60%.
He's going to get half that if he's lucky tonight.
And by the way, when he won 60% of the vote last year in New Hampshire, that was not enough of a launching pad to actually win the nomination.
So the story of the Sanders campaign so far this year is how much ground he's lost from four years ago.
He's lost half of the support in New Hampshire.
He's lost half of his support nationwide.
He ran at 49% against Hillary Clinton nationwide last time.
He's running about 25%.
Do you hear how he's spinning that?
In other words, in a two-way race, Bernie got a lot more votes than he gets in a 30-way race that we've got now.
I didn't show you the ballot, but I mean, all the people, even that have dropped out before New Hampshire, like Cory Booker, Kamala Harris, and so forth, they were still on the ballot.
This is a very, very, very long ballot.
So you got Lawrence O'Donnell.
Hey, Lawrence, you need to stop the hammering!

Bernie, you're only helping him.
If you don't want him to win, what you should do is praise him.
You should praise him and praise socialism.
That would be the death knell.

MSNBC has become like that.

He says, this is one of the greatest Americans ever to live.

And the Sanders press secretary came back and said, that's how our Jewish candidate supporters are being described on the mainstream media.

Welcome back, you know Bloomberg was not on the ballot in New Hampshire Unlike a not one of the 30 or 40 people that were on the ballot, but he was on all the TV sets He is running ads All of the time as a matter of fact the onion has a political piece out about Some of the ads are now being run about Michael Bloomberg Says poll finds that Bloomberg is trailing among young black males that he's already thrown into prison.
Suggesting continued challenges in the former New York City mayor's quest for the presidential nomination, a new poll found that Democrat candidate Michael Bloomberg was trailing his rivals among young black males that he's already thrown into prison.
Quote, Bloomberg is continuing to perform poorly among African-American men Between the ages of 16 and 25, years old, when they were arrested for possession of marijuana during his tenure as mayor of New York, said the pollster, pointing out that fewer than 2% of the survey respondents who are still serving prison sentences as a result of stop-and-frisk policies named Bloomberg as one of their top three favorite candidates.
These numbers suggest that these individuals strongly connected to other candidates' policies of not having them detained and incarcerated based on their race.
It remains to be seen if Bloomberg can bridge the gap of minorities that he allowed to be terrorized by the police with another multi-million dollar TV ad buy.
Yeah, that's the question.
Can he buy his way out of this?
Maybe.
Maybe he can.
As a matter of fact, let's play, I talked about, gave you some quotes of this yesterday, but let's play about a minute.
Of what Bloomberg said as he was bragging about how he had all crime was in minority areas.
And so we're just going to throw them up against the wall and frisk them.
This was a 2015 speech that he made to the Aspen Institute, his other elitist.
I know where the crime is.
You guys here in the room here, you're not problems.
It's those minorities in my city.
We just throw them up against the wall and take their guns.
And I want you to listen to this, but let's think a little bit more broadly about this.
You know, when we had all these protests and everything about excessive police force, I was trying to say to people, yeah, let's not make this about race, because we had both liberals and conservatives making it strictly about race.
A lot of conservatives basically saying the same thing that Bloomberg is saying.
Yeah, there's more crime being committed by black people, so, you know, treat them more harshly.
No, we need to make sure that the police follow due process with everybody.
Because if you look at what Bloomberg is saying, his real beef, folks, is not with black people as much as it is black people who have guns.
He doesn't want black people to have guns.
That's something that goes back to the Jim Crow laws, right?
No free man will ever be disbarred the use of guns, said the founders of this country a long time ago.
They understood that having guns is a point of freedom.
And there are going to be bad people with guns, and the way that you stop that is you make sure the good people can defend themselves.
That's the only thing that you can do about that.
I just talked about the misguided attempts by one of the Parkland fathers who said, Let's do the school safety now, and we'll do the gun control later.
Well, no.
If you want to make your school safe, you have to make sure the teachers are armed.
Because just putting cameras in the rooms and putting locks on the doors isn't going to protect anybody when you've got a criminal with a gun.
It really isn't.
We've seen this over and over again.
I mean, just having an alarm system that's going to notify people of this?
You need to be able to protect yourself with a gun, and that is even more true When you have gangs of people who are selling drugs.
But when you listen to this, I want you to understand that the stop and frisk is really essentially the same thing as the red flag laws.
And if he's allowed to do this in New York because he says, hey, I gotta get the guns and the black people are the ones who've got the guns, well, in Virginia, guess what?
It may be the conservative Republicans are those people that are the real threat.
Aren't we hearing that all the time?
And don't you think that in Virginia it's going to be the conservative Republicans and the people wearing John Deere caps?
Those are the guys we've got to get up against the wall with them.
We need to come together to defend basic liberty and due process instead of allowing this to become the kind of authoritarian government that Bloomberg ran in New York City.

And, you know, when we look at Chuck Todd and these other individuals who are out there saying Bernie's people are a digital brown shirt brigade, Coming after anybody who criticizes their candidate, well, quite frankly, these people have been cheering on digital brown shirt brigades for a long time.
Coming after Infowars, coming after Alex Jones, coming after conservatives, the cancel culture, that's what this has always been about.
As a matter of fact, the CEO and founder of Grabian says that Chuck Todd has to resort to this kind of journalistic slights of hand to get his own views across.

Maybe he hasn't looked at the polls lately, the political polls.
Maybe that's not the path forward to getting a good box office.
So I looked at the trailer for Call of the Wild, and I thought it was the most pathetic thing I've ever seen in my life.
They have a computer-generated dog.
And all throughout the trailer, this dog is making the most ridiculous expressions that, you know, anybody that knows a dog knows that dogs don't make this kind of expression.
It's basically, they've anthropomorphized this way more than anybody at the Westminster Kennel Club would anthropomorphize a dog.
To the point of absurdity, it doesn't look real at all.
I don't know, you take a Jack London story and you make a complete parody of it at Disney.
There's some things that, even if you can do the special effects, maybe you shouldn't do the special effects.
So, there's a couple reasons why I will not be going to... There he goes, you can see how fake that looks.
A couple reasons I will not be going to see Harrison Ford's latest movie.
And nobody is going to see Birds of Prey.
We talked about how radically feminist that was the other day.
It's gotten so bad, That this was just released, I think it was last Friday.
Yeah, it was, because it was the same weekend that they were having the Oscars.
And everybody was talking about how bad it was.
So in less than a week, they've now renamed The movie.

They may not even remember what they saw last week.

One of the interesting things that he had When he was talking, he had a series of gaffes as he was trying to make the case of how he had a path forward.
And, you know, as he was saying, well, tonight we just heard from the first two of 50 states, not even a quarter of the nation, just two states.
And they said, Iowa and Nevada have spoken, but that's it.
Of course, it was Iowa and New Hampshire, that other state that starts with an N.
There's a few of them, Joe.
You better get them straight.
So he couldn't even remember where he had just fled from.
He was talking about how Nevada has spoken.
And then Joe Biden kept speaking, unfortunately.
He went on to talk about, of course he's in South Carolina, so he's reaching out to the black voters.
It's one of the reasons why the mainstream media has pulled out Bloomberg's quotes right now, because of South Carolina.
And so he talked about how all those Democrats that won against incumbents from Jimmy Carter to a guy named Clinton and a guy named Obama.

All these people who defeated incumbents like, you know, my President Obama that I was... Did I tell you how Barack and I are such great friends?
I want his wife to be my running mate.
And I want to put him on the Supreme Court.
Even though Barack Obama kicks him to the curb every time he gets a chance.
Anyway, he points out that Obama was one of these guys who beat an incumbent president.
And he did it because he had overwhelming African-American support.
And so he's making the case there.
And I guess he's assuming that the African-Americans he's speaking to there in South Carolina are as clueless as to what happened as he is.

We're going to talk about the First Amendment.
We're going to talk about what's going on with Roger Stone and these sentencing guidelines.
I mean, isn't this a little bit stiff for somebody who didn't commit a crime in the first place?
But we'll talk about what's behind all that.
Talk about the double standard.
The long list of people We've all seen on television lying to Congress about very substantive issues, and I think the biggest one to me is James Clapper lying to everybody about what they're doing to everybody in violation of the law, in violation of the Constitution.
They never even charged them, let alone found them guilty, let alone send them to jail for a decade.
But now, if you push back against that, oh yeah, that's an abuse of power for President Trump to pardon that.
We could go down a whole long list of people that were pardoned by the Clintons and others, if you want to play that game.
We've got a long list of people who really did do a crime.
And there's a lot more people that President Trump ought to pardon.
There are a lot of systemic problems in our so-called justice system that we need to take a look at.
We're going to take a look at the human trafficking and the child welfare issues before us, and we're also going to take a look at what the Democrats are doing besides joining The National Popular Vote Compact to get around and to subvert the Electoral College.
They also passed, as we reported yesterday, a ban on AR-15s and quote-unquote high-capacity magazines and also on suppressors.
They had Breitbart call up the Virginia State Police and said, you know, the Democrats, this is before they passed it.
You know, the Democrats are passing legislation to ban a lot of different firearms accessories, things like suppressors and so forth, and magazines.
Suppressors are going to be easy for them to go door-to-door.
And so they brought that up.
You know, you have to register if you've got a suppressor, a silencer, if you will.
And so they know who's got them.
And they could go door-to-door.
So they called up the Virginia State Police.
And said, uh, they're trying to make this illegal.
Are you going to then go door-to-door to pick those up?
Now, this is before it was passed, and so the Virginia State Police said, well, that's a hypothetical situation.
They haven't passed the law.
But then they did say, but our job is to enforce and comply with the laws.
And we're not saying that we're not going to do that.
Uh, so that has now passed.
So we will see what happens with that.
And when we look at what's going on with that, and we look at what Bloomberg was saying, President Trump tweeted out, wow, total racist.
Because he said, hey, I could Xerox a description of these people.
We know who the criminals are.
They're all young black men between a certain age.
And you can generalize anything like that.
And they're already making a lot of generalizations about Trump supporters.
Aren't they?
And calling you violent.
We just had the FBI do that again.
You know, we gotta worry about these domestic terrorists.
You know who the domestic terrorists are?
They're those guys with the MAGA caps.
You can spot them a mile away.
They're red!
So just put them up against a wall.
They probably got a gun on them.
So be ready to shoot if they make any troubling or concerning moves.
You just shoot them right there on the spot without thinking about it.
You'll be justified.
All you have to say as a cop is, I was afraid for my life.
This guy had a MAGA cap.
And boy, good job guys.
You put up a clip of Kanye West.
He's in double jeopardy.
He is black while MAGA.
It's got a MAGA cap on.
But he's really skating on thin ice.
He's a professed Christian as well.
I mean, they could get him just for that.
Triple jeopardy.
We have to be concerned about this, as Reason Magazine was talking about gun control last year.
Red flag laws leave gun owners defenseless.
And they did this in response to President Trump saying, you know, just got to take the guns and do the due process later.
He endorsed that.
And now the Democrats are picking that up.
See, the problem with Bloomberg is not that he's a racist.
He may very well be a racist.
The problem is, is not that he's a total racist, as President Trump said.
The problem is that he is a totalitarian dictator at heart.
And the groups that he comes against are going to be malleable.
And he's got an authoritarian urge.
And the real issue, the real issue is the due process.
And when we look at what Attorney General Barr is saying about human trafficking and the child welfare system, I'm glad they're bringing this into the domestic sphere finally.
You know, President Trump has talked about what's going on at the border, and people dismiss that, the Democrats dismiss that, saying, well, you're just defending your immigration policies and ICE.
President Trump has said in the past, and he's been right about this, In the last three years, ICE has arrested over 5,000 wicked human traffickers.
I have signed nine pieces of legislation to stamp out the menace of human trafficking.
Domestically and around the globe, my administration has undertaken an unprecedented effort to secure the southern border of the United States.
And that's what's behind what the left is complaining about as child separation at the border.
They have reported that these children are being recycled through.
They've been brought into human trafficking and they're using this because the previous policy saying we're not going to separate children from their families and these people get put at the front of the line.
They get special preferential treatment.
And so people are saying, wait a minute, the cartels are using these kids as a beard to smuggle people in and they're trafficking these kids.
They're using them as slaves.
And so that's why we need to do a test and find out if they really are their parents.
But nobody's talking about what CPS is doing here in the United States up until this point.
And that's really the giant story.
Because ICE's only total budget is $6 billion.
But the CPS system has a budget of $29 billion.
It's five times bigger.
And just like we see with red flags, just like we see with civil asset forfeiture, there is no due process.
They take the kids and then maybe they do the due process later.
And that's really what Attorney General Barr should be looking at as Attorney General.
Can't we have a system?
He talks about, yeah, there's a lot of corruption in CPS, but he doesn't talk about the system.
The way to address this is to give people due process, to give parents a presumption of innocence.
It's a very, very tiny number of these where there's even an accusation of violence or sexual assault.
That's only present in 16% of those cases.
That's the allegation.
The convictions are even far less than that.
Attorney General Barr said, emblematic in many ways, is one horrific case I was briefed on recently in the Southern District of New York.
A very dedicated team of prosecutors doggedly pursued a few little leads and ended up convicting 19 defendants in Manhattan with sex trafficking of minor girls and young women in the New York State child welfare system.
In other words, children whose society had a special obligation to protect Ended up instead being exploited.
The problem is, Attorney General Barr, that's not the problem.
The problem is that we had children who were taken by this system where Hillary Clinton and others incentivized this financially.
They've been kidnapped, legally kidnapped.
We've had Dwight Mitchell on many times talking about the problems in CPS.
They've been legally kidnapped and put in that system so that they could do this.
So the way you stop this It's to start giving people due process.
That's one thing they won't do.
The simplest thing that they could do that they will not do.
Isn't it amazing?
They will continue to push for other solutions rather than just enforce the Constitution.
But hopefully now that they're talking about it, they will do something about it.
I still don't know if they really understand what the real problem is or will acknowledge it.
Maybe they do.
I think they do understand the real problem.

You know, I've been talking for a long time about how we had venture capital firms that were set up by the CIA in Q-Tel.
They actually went public with it.
I said, you know, for the longest time anybody who follows this at all understands that the CIA has been setting up front companies in order to do what they want to do and now we have a series of articles that have come out talking, this is from the Washington Post, so I guess you can believe it, right?
CIA tells us that the Washington Post is trustworthy.
We've got NewsGuard that was set up by DARPA And just like they have set up these other people to control our speech on the Internet, and NewsGuard says that Washington Post is everything that they say and everything the New York Times says is true, even though we know that it is not true.
But I think in this particular case, this one is true.
Washington Post says that the CIA owned and operated a front company based in Switzerland for the purpose of spying on secret government communications across the globe, but also on their friends, Also, on American citizens.
You understand that, don't you?
I mean, you go back and look at the Church Committee hearings, at the Pike Committee hearings, as I pointed out, as soon as these institutions were created after World War II, they were spying on Americans.
That's why the Church Committee hearing came out and said, you can't do this!
We're going to stop that!
We're going to create the FISA Court!
And the Foreign Intelligence Surveillance Act.
We're gonna let you spy on people abroad, but, you know, it has to be foreign citizens who are abroad.
It can't even be foreign citizens here in the United States.
And you can do it with a secret warrant in a secret court.
You gotta get a warrant, you know, go before one judge and, you know, give your side of the case and we'll give you a warrant there at the FISA Court.
And in the Pike hearings in the House side, They called in the NSA, and the NSA said, I'm not telling you anything about us.
I'm not showing you the executive order that created the NSA by Harry Truman.
Not showing you any of that stuff.
You're nothing but a congressman.
We're the real government.
That type of thing.
He didn't actually say that, but that's really what's going on.
And so I pointed out that the Internet itself was a creation of a DARPA psychologist, J.C.R.
Licklider, that when it became practical, they started, they created these corporations to set people up, these venture capital corporations like In-Q-Tel.
They put people from the intelligence community on the boards of other venture capital firms that weren't 100% owned by the CIA to make sure they had the right people in place.
And so this is what they did going back to 1971.
A Switzerland-based communications encryption firm, Crypto AG, secretly purchased by the CIA and West German intelligence services in 1971.
And I'm telling you that what I've been telling you about the takeover of the Internet is in 30-40 years, I'll be vindicated by this, it'll all come out.
I've already drawn the lines for you, but now we can see it with this encryption firm here.
Made millions by selling encryption equipment to over 120 countries in the 21st century, but they use the same equipment to infiltrate each host country's communications in a Trojan horse style operation.
In other words, they've been doing for 50 years what they say China will do with Huawei.
That's why they're freaking out.
Because they know how powerful this is, and because they've been doing it for half a century.
And it's true, we should not have Huawei doing that because they will control the countries that allow them to set up the infrastructure.
On the other hand, if you let the CIA set it up, Washington D.C.
will be controlling it.
That's why you look at Boris Johnson and he says, well, I don't know, maybe I'll go with the Chinese because they're cheaper.
Pick your poison, right?
And we've got the Wall Street Journal coming out, trying to double down against Huawei and four American companies.
So, they leaked some stuff through the Wall Street Journal.
They published quote-unquote, highly classified evidence.
Now, is that a problem?
That they got highly classified?
No, no, it's not at all.
Don't expect to see the people at the Wall Street Journal being given the WikiLeaks treatment or the Julian Assange treatment.

I'm stunned by that.

We have joining us now in the studio, Norm Pattis, one of America's most controversial and successful trial judges.
And Norm, your website is normpattus, that's with two T's, normpattus.com, and it's an honor to have you.
I wanted to talk to you, of course, about Roger, because this is just appalling on so many different levels, that he would have a conviction, that they would come after him, let this sit there for months, and then come up with a sentencing recommendation that goes up to nearly a decade.
And then what happened yesterday as President Trump criticized that, and then CNN and others went crazy saying, now he needs to be impeached for that.
So I mean we have so many things to talk about with Roger, but give me your take on the sentencing guidelines.
Let's just assume, let's just assume, focus on the sentencing stuff.
Let's assume that Roger is guilty.
You and I both know that he didn't do anything.
And I think any kind of a sentence is draconian for somebody who is innocent and convicted, but we'll get to that in a moment.
But let's just talk about what happened yesterday, this seven to nine year sentence and the response to that.
Well, first, you called me a trial judge.
That might come as a surprise to some of the judges before I appear before, so I don't aspire to the bench.
I don't have that sort of demeanor.
I'm just a lawyer.
Trial attorney.
Thank you.
I do practice federal criminal law, and so I paid attention to the Stone verdict.
There may have been sufficient evidence in my view that he lied to Congress, but on the other hand, I don't know why it's a crime to lie to Congress when lying is an acceptable law enforcement strategy at getting the truth.
So when your government can lie to you to lock you up, and you can't lie to them to protect yourself, I'm feeling an asymmetry that doesn't make sense.
And when you're talking about Congress, that's their currency.
That's what they trade in is lies.
You know, Owen from your afternoon show, I'm defending him on a charge of impeding Congress, and I'm thinking, man, he should be running for office if that's the charge.
They can impede themselves pretty well.
But to get to the Stone case, federal sentencing is largely a cookbook enterprise.
There are things called federal sentencing guidelines that have existed since the 1980s, and what they're supposed to do is eliminate disparities in sentencing.
There are 94 district court Districts in the United States and the goal was to create a cookbook as it were that would produce some sense of uniformity So each offense and the book itself with the tables and whatnot is about this thick It's like a like a municipal telephone directory from New York The guidelines work in the following ways every offense has a base level so if you obstruct if you lie to Congress at seven or nine points And then you can add points based on offense characteristics.
And the total number of points gives you a location on a table, and that location is amplified by your criminal history.
And then when you do the criminal history across the top, it goes from 1 to 6.
The points, I think it's 1 to 36.
You end up with a location on the matrix, which is a range of the guideline sentence.
The action in Mr. Stone's case this week is in how you manipulate those guidelines.
The first sentencing memo gave Mr. Stone eight points, as it were, for physically intimidating a witness.
To me, that was a reach on behalf of the line prosecutors.
It also gave him four points for obstructing justice.
So there's 12 points right there, which is a significant bump up in the incarcerative consequences.
According to the, and I wasn't part of this process, but I read the papers carefully this morning because I knew you were having me on and I wanted to try to know what I was talking about for a trial lawyer.
That's hard.
According to the New York Times this morning, the communications within the Justice Department broke down.
They broke down in the following way.
Whenever there is a prosecution of a public figure of this sort, there's something called the Public Integrity Unit or other units within the Justice Department that approve and supervise the prosecution, especially when the world is watching.
And this case, the line prosecutors, the four people who are responsible for developing the case, should have run their initial sentencing memo up the flagpole.
These are the four people that were off of the case?
Right.
And according to the Times, there was a communication breakdown.
They made it part way up the ladder, but not all the way.
When the memo was published, as these things typically are, they're public documents, and backlash began to occur, including the President's reaction, people at the top took a look at it and said, wait a minute, there's something wrong.
And they instructed their office to file a supplemental sentencing memo.
The four lawyers quit, and so a supplemental memo was filed independently of them.
And in it, it said the eight-point adjustment for physical threats was not warranted, given the evidence.
Uh, Mr. Stone made some comments to, uh, I can't recall his name.
Rami Credico?
Credico, thank you.
A comedian who said that he had access to Julian Assange and he didn't.
And who also wrote a letter that was submitted as part of the defense sentencing memo saying he didn't feel threatened, neither he nor his dog felt threatened by anything that Mr. Stone said.
And so from the senior administrative perspective, the eight points seemed overdone.
As far as the four points for obstruction of justice, that was largely duplicative.
In other words, he was offended for lying to Congress.
That was obstruction enough.
The federal sentencing guidelines don't permit you to double dip.
So, from my perspective, when I first heard about this yesterday, you know, I followed the Stone case as a general reader of affairs.
I'm involved as representing InfoWars in a number of disputes, so I'm aware of these topics.
My gut told me that the market rate, the value of this case, in terms of incarceration, was probably 18 months to two years.
And it turns out that's what the defense requested.
They don't want any time, but they said if there's going to be time, it should be 15 months or so.
And frankly, as a guy who makes his living going to court every day, and has done so for a quarter of a century or more, that's about right.
So seven to nine years was an obscene overreaction in my view.
And I began to wonder why, because Aaron Zielinski, the lead prosecutor at the trial level, is somebody I've known for a long time.
He went to school with one of my kids.
I don't know him personally, but I know of him.
I know he's brilliant.
I know he's thoughtful.
And I'm thinking to myself, why would he do this?
And I guess the best analogy is I'll call it the teapot effect.
I think this whole head of steam built up in Washington with the Mueller report, and then it was going to, you know, then it got sublimated into the impeachment.
And now there's a lot of coitus interruptus.
You know, there's a lot of frustrated desire in Washington and a desire to hurt somebody.
And I think Roger was the available target, and they overwrote the sentencing memo and came up with a recommendation that is frankly shocking from a criminal defense lawyer's perspective.
I don't have a stake in the game.
And so, you know, I'm just reading this the way I read papers every other day.
The fact that these four prosecutors resigned suggests to me that something like abject cynicism.
I mean, right now, the trial judge has been sent a powerful message.
Something is wrong.
This sentence needs to be imposed to correct the broader sense of perception that there's injustice afoot in the country.
And if I'm the defense, I'd probably move to continue this sentencing for 60 to 90 days to let everybody calm down.
We just had a very emotional impeachment battle that was decided along almost exclusively partisan lines.
I don't know what to make of Mitt Romney.
And you've got a lot of act hunger, a lot of people looking for a Republican scalp to pin on the door and say the effort was worth it.
And I think Roger is a scapegoat right now.
And his lawyers should ask for his continuance.
And I can go on.
And you look at this, and as you pointed out correctly, you know, there is a lot of political motivation in this.

And I think they jumped the shark with that seven to nine years.
And I think part of it, I'm looking at this and I don't know who rolled this back, but my initial reaction when I saw that, first the seven to nine is like, that really puts a lot of pressure on President Trump to pardon Roger.
That is so over the top.
And then when they rolled it back, I thought, hmm, that's maybe them doing this to try to undermine the case for a pardon.
What do you think about that?
That's possible.
I mean, the president also has the power to commute the sentence, which would be to permit the conviction to stand and say, all right, the sentence is commuted.
You don't have to go to prison in this case.

About the injustice that was done to Roger Stone.
Regardless of whether you think that he's guilty or innocent, I think it's a double injustice because I don't think he did anything.
And we've seen, as I pointed out at the beginning of the program, we have seen official after official in this feeding frenzy to come after President Trump.
We saw Clapper lie to Congress under oath about surveillance program just a couple months before we had the Snowden documents released and he was proven to be a liar.
They let the statute of limitations expire.
They never came after James Clapper.
But then as part of this desire in Washington by the Department of Justice, by the FBI, by all these other agencies, they wanted to come after President Trump.
So we got Comey, we got Brennan, we got McKay, we got Strzok, Page, Mueller, all of them Lied under oath, and yet they come after Roger Stone.
But regardless of what you think about guilt or innocence, We're talking about the sentencing guideline.
As you were saying, Norm, typically when you look at this scoring thing, you broke it down, did a great job breaking that down in detail, where they would be and how they inflated the point system that gives you a grid as to sentencing guidelines.
They inflated that for threats or physical threats or whatever they pretended to be there.
My question to you was, I thought that it was so obvious and so egregious that It made it a slam dunk that was going to be a pardon for Roger.
Well, you know, you may have followed the Stone trial more closely than I did.
I think the evidence supported the fact that he did lie to Congress.
Now, what's that worth as a sentence?
You know, and some of the emails that he sent to Mr. Coderico were troubling.
I don't think they rose to the level of physical threats.
So I was not surprised that he was convicted.
The question turned on whether he had the intent to lie, whether he had the intent to threaten and so forth.
The jury reached the conclusion it had reached after brief deliberations.
The sentence of seven to nine months, though, was outrageous.
Seven to nine years.
Yeah, excuse me, seven to nine years.
That's okay, I called you a judge earlier.
And I think the defense was right to call the government on that.
I think what, as we were saying before the break, I think there was an administrative failure within the Justice Department.
There were some personnel changes in D.C.
and the D.C.
office, and I don't think the top dog, as it were, was able to sign off on this until it hit the papers.
So I think that claiming that somehow Bob Barr has abandoned the rule of law or that President Trump is subverting the separation of powers doctrine and that this is further example of corruption.
That's what CNN is saying and MSNBC is saying.
That overstates the case in a way that is difficult for me as a practicing lawyer to take seriously.
People continue to make partisan hay, or partisan forest fires, out of little sparks.
And these sentencing memos are just sparks.
Because remember the following, if you're a federal judge and I submit a sentencing memorandum to you, you have Article 3, lifetime independence, Article 3 of the Federal Constitution, And the constitutional responsibility to determine for yourself what the sentence should be.
The government's recommendations are simply that, the guidelines.
They're non-mandatory.
Defense counsel also submits a set of recommendations.
If you go into a lawyer's office and you see a gazillion books, they're not from central casting.
They contain appellate decisions.
And in the federal criminal practice, most appellate decisions arise from sentencing.
So, candidly, Barr and company could have made a shrewd decision in dialing back what I will call the hysterical initial sentencing guidelines because there could have been an appeal on Stone's behalf of a conviction in the seven to nine year range.
That was my take on it.
When I looked at it, I thought, wow, you know, that was so over the top.
It was.
I was sad to see it actually come back because I thought it would be a slam dunk to repeal that completely.
Well, here's where I think Roger Stone's lawyers have been incredibly passive, and it was frustrating to me.
I kept having this fantasy life that my phone would ring and it would be Roger Stone.
He should have been in the federal appellate court the afternoon that the judge imposed a gag order on him post-conviction.
I have never seen a ruling like that in my years as a lawyer and in my reading of the cases.
Gag orders are typically imposed to protect the jury, the integrity of the criminal justice system, but to protect the jury from extraneous prejudicial pretrial or trial publicity.
In other words, there's a piece of damaging information about a witness that jurors can't know because of the rule of evidence.
I say, well to heck with that, I'll go on the courthouse steps and I'll scream it out and hopefully they'll read it.
Some lawyers play the game that way.
When gag orders are imposed, they're imposed to protect the jury.
There was no lawful authority for the judge to say to Roger Stone, you can't talk through intermediaries or anyone else about getting a pardon from President Trump.
And so there was an effort made to politicize this show, your show, your network, Alex Jones, because Stone allegedly had some communication with him.
Whether he did or didn't doesn't matter, but Stone should have stuck to his stones, as it were, and said to the judge, damn you, I have a First Amendment right to speak.
I may have been convicted, but I've not sacrificed the rights of a citizen, and the right of the citizen to petition for redress of grievances includes my right to ask the president for a pardon if I believe my conviction was unjust.
For federal prosecutors to say in a sentencing memorandum that among the factors the court should consider in imposing a substantial sentence was Mr. Stone's decision to speak out is, in my view, a chilling, a chilling attack on the First Amendment.
And why Stone didn't go to the D.C.
Circuit Court of Appeals the very next day and ask for emergency relief is a mystery to me.
For a man who's made a living and a reputation as an aggressive political operative, he took a called strike there where he should have gone down swinging.
Yeah, and we're seeing this type of stuff happening all the time.
We'll talk about this.
Oh, no, we're not going to break just yet.

I just had a case come across my desk about a guy who was handing out Fully Informed Jury Association literature, and they got him for jury tampering.
I mean, it wasn't anything specific to the case, you know?
Well, so, you know, that is unusual.
The Fully Informed Jury Association believes in a practice called jury nullification.
We are now in Connecticut preparing a petition for review to the United States Supreme Court where a trial judge gave us permission Um, to argue nullification in a case.
The government sought a stay of the proceeding.
The Justice Department from Washington instructed them to seek a writ of mandamus in the Federal Appellate Court in New York City, instructing them to get an order to the judge not to permit me to argue nullification.
A divided panel, two to one, decided against us and we're going to be filing a petition for the United States Supreme Court to hear it.
Because, historically in the United States, jurors have had the ability to sit in judgment over the government.
Trials, criminal trials, you know, prosecutors like to use the following trope.
We want you to make the defendant accountable.
This is a case, and they ask during voir dire, are you comfortable sitting in judgment over another human being?
Those are the wrong questions.
In a criminal trial, it's not a test of moral guilt or innocence.
It's a test on whether the government can prove its case according to the rule of law.
And juries have historically played a role as being a check on government in this country.
And to emasculate them and tell jurors that they can't know the sentencing consequences of their decision is to treat them like children.
The nullification and amnesia, the Fully Informed Jury Association, wants juries to know what they're doing.
So that juries can play the role that jurors have historically played in the United States.
Holding the government accountable.
And so I think this game of hide the ball is shocking.
Is that the case that you're talking about?
Is that where the judge said you might want to consider jury nullification?
Is that the one where there was the issue of pictures on a phone and they said that this was interstate transportation?
Yes, it is.
The case involves, I don't want to use the young man's name because it's controversial, but my client engaged in sexual misconduct with a young woman.
He was 30, she was 15.
And the judge was saying this is a contrived notion to get this into federal court, right?
Well, sort of.
I mean, you know... We've got to take a break.
I'm sorry we got right into that, but now we're up against a break.
We'll talk about that when we come back, because I really am interested in that case, and I covered it because it was interesting that one of the three judges said, no, that's okay.

We're talking to Norm Pattis.
We've been talking about the sentencing guidelines and how the federal prosecutors in the Roger Stone case stretched it to the point of breaking.
And then we got into this jury nullification case that Norm mentioned.
And Norm, I just reported on this last week.
I thought it was an amazing case, how you've got a federal judge Who says, I don't think this ought to be in the federal courts.
Maybe this is a case for jury nullification.
It goes up to the appeals court, right?
And you got at least one of the three judges said, no, that's okay.
Which I think is an interesting case.
And you happened to be involved in that case.
It was Judge Parker who I thought wrote a very thoughtful decision.
I thought got it right.
And we're going to ask the United States Supreme Court to adopt his point of view.
The underlying facts are unsavory.
30-year-old man sex with a 15-year-old.
Many of your listeners won't realize it, but in colonial times, the age of consent for sexual conduct ranged from 8 to 10 or 11, depending on the colony.
It was only in the Industrial Revolution that the women's suffrage movement managed to create a higher age of consent. The fear was that as young women left the farms, go to the city, they'd be preyed upon.
So 16 or so...
But isn't it a state crime? I mean, to try to get that into the federal thing with mandatory minimums, that was really the issue.
Yeah, no, in that case it was, yes. So the states have the so-called police power, the ability to regulate our health, education, welfare, and morals.
Federal jurisdiction is supposed to be limited, and so it's typically limited by what goes on in interstate commerce.
In this case, a single video was taken, downloaded, and then deleted. In the act of downloading, it had bounced to the cloud.
No one ever saw it but the man who took it and the law enforcement agent who saw it later.
The government concluded that because this electronic image traveled outside of state boundaries, that constituted interstate commerce.
The law is clear that that does.
I don't agree with the law, but so the courts have decided.
The kicker in this case was, as a result of that electronic signal bouncing, he faced 1-5, 15-year mandatory prison sentence for what was consensual conduct, and it drove me crazy.
And so I asked the court for permission to argue nullification, and we had a series of difficult pre-trial proceedings, and I'll never forget this as long as I live, which, given my age, probably won't be all that much longer.
But I still won't forget it.
You know, we're going through a series of issues.
This was the ninth issue.
I'm writing my notes, getting ready for trial.
And I say, Judge, may I have a ruling on the ninth issue, the nullification issue?
And I look up and he's shaking.
And he says, this is a case that requires nullification.
And we're off to the races from there.
So we're going to ask the United States Supreme Court to take a look at this case and to take a look at other similar cases and say that depriving juries of the right to hold the government accountable makes us into passive spectators and nothing in the Constitution or our founding documents ever contemplated that.
Whether we succeed or not, stay tuned.

The Michigan case you were talking about, we had a chance to look at it over the break.
It appears that the Michigan Supreme Court, a state court, is going to make a ruling about whether a jury, a pamphleteer for FESIA, could be charged with jury tampering.
And the answer across the federal courts thus far, not state courts, is of course not.
To interfere with a jury means that you have to have in your mind the intent to interfere with a jury that's actually deliberating on a particular case.
They're going to talk to them in specifics about that case.
Here's why.
As opposed to saying historically people have the right to nullify.
And here's the fact.
No matter what a judge says about nullification, all judges recognize juries have the power to nullify.
They just don't want we lawyers talking about it in the well of the court.
Because if the jurors recognize they have that power, they might use it!
And I think they're an alcohol prohibition, and they did back at the time of William Penn.

You know, it has been a doctrine that is used whenever there has been low confidence in public institutions, and that is a time in our country right now that I think nullification should be required.
We have deep polarization in the country.
There seems to be a crisis of legitimacy.
If you want people to be Empowered.
If you want people to feel they have control of their destiny, let them sit in judgment over the government.
And what's wrong with juries knowing?
Because in that case, the case we're talking about, the jury's not supposed to know the sentencing consequences.
There's a famous case in New York.
Not supposed to know this guy's going to get 15 years because he had this on his phone and nobody saw it.
Famous case in New York where a man was accused of possession of child pornography.
His lawyers put on insanity defense.
It failed.
The jurors were never told what his sentence would be.
They returned a verdict of guilty.
The trial judge, Jack Weinstein, said to the jurors, I want to inform you that I'm obliged, obligated, to send this man to prison now for five years.
I want to ask each of you, if you had known that would be the result of your decision, the consequence, would you have made the same decision?
Several jurors said no.
Weinstein set aside the conviction in the Second Circuit.
The Federal Appellate Court reinstated the conviction saying Weinstein didn't have the right to do what he did.
But we, the people, had that right.
And if we were going to be passive and sub-hine, we'd have a British flag up there instead of a picture of the Capitol, and I'd be drinking the Queen's tea.
That's right.
Well, I covered a case, a New Jersey weed man.
And he had a large quantity of marijuana that he was using for his own use.
It was legal in California, but he goes to New Jersey.
And he gets arrested, and he thought, you know, I'm going to try jury nullification.
I know that a lawyer's not going to represent me in this, so I'm just going to do it myself, defend myself.
And so, in the first trial, he puts up from the New Jersey Constitution a thing saying that jurors have a duty to judge the law and the consequences, right?
The judge said, take that down!
But he goes, it was too late.
They'd seen it.
Seven of them voted for acquittal, but they came back a second time against him.
That next judge let him leave that up the whole time, and the jury acquitted him.
And he told them, he said, look, I'm going to be going to jail for X number of years because it was a mandatory minimum as part of the drug sentences.
I think jurors should know that it's a source of enormous frustration.
Years ago I had a case, it was a horrible case, a young man shot another man in the head over a girl.
A silly, asinine sort of case that the courts are filled with.
I did the best I could for him.
The plea offer was, I think, 55 years.
He couldn't face it.
We tried the case and I lost.
The evidence was indisputable.
A juror called me after the sentencing, weeks later, enraged, and she said, you lied to us.
And I said, I beg your pardon?
She said, you never told us what would happen if we convicted.
I said, the law wouldn't permit me to do it.
But now here's the kicker.
I said to her, as a matter of fact, ma'am, you know, had you known the consequences, could it have changed your verdict?
And she said, no, it's a long pause.
You know, she said, you know, he did the crime.
But the time is enormous.
And I think jurors should have the ability to say to the government, not this time.
You know, it might have been an act of passion.
It might have been an act of foolishness.
There's no requirement that we ruin another young life over that.
Yeah, exactly.
We've got to get back to, that's really what the jury is there.
It's to be a check on government power if the laws or the sentences are out of whack.
They should be the ones in the community to determine that.
Let's talk a little bit about free speech.
Because that's how you're predominantly involved with Infowars, because we've got a lot of people who don't like that anymore.
And I think it's become a very dangerous thing.
Last week, I did a report about a Chinese mixed martial arts fighter, and his name is Xu Xiaodong.
And basically, he offended the President of China because, you know, competition between different martial arts groups and these people were making extravagant claims about how their martial arts was greater than his, and he humiliated them.
And that, in the process, humiliated President Xi, who was very easily humiliated because somebody put up a meme of him as As Winnie the Pooh.
And so he basically banned Winnie the Pooh because they have the authority to do that.
But it was an interesting story of the ability to say something, even if it's offensive to somebody, as well as looking at the social credit system and how they punish people if they don't like what you say.
And we've got officials here in this country Who are saying, well, we just had Elizabeth Warren, who fortunately is not doing too well, but I don't see that the other candidates really are any different.
She was saying, I want to criminalize speech if somebody puts out something that is false in an election campaign.
And so now that's where we are at this point.
One of the things that this martial arts fighter said, I said some pretty harsh things, but weren't they true?
Well even if they're not, opinions should be protected and we've always taken the view, well not always, but for years we have taken the view in this country that the antidote to false speech is more speech.
And that giving government the power to penalize what it regards as untrue effectively creates a licensure requirement.
You're only free to speak if you meet the standards of the person imposing them.
That's never been a safe harbor in the law and yours in my lifetime.
But I see in the courts, because I litigate hate speech cases a little bit in the Northeast and now I'm doing some for you all here.
And I see a tendency in questions that I'm getting from appellate court judges about, you know, don't we need to do something about social media?
And I do think we need to check the algorithmic overlords that are... Yeah, we need to make it more free.
Exactly.

All right, Norman, let's talk about, let's see, where were we?
We were talking about hate speech, weren't we?
Well, and then, you know, stitching this back to Mr. Stone, I was saying he should have taken an appeal of the court's order against his ability to speak.
But restrictions on speech that fits within the broader class, you know, are limited under the First Amendment.
And recall that in our federal compact, the federal government is a government of limited powers.
And so my view, and I think the view of any responsible lawyer, is that we are permitted to do everything that we are not prohibited from doing.
Whether it's wise to do, that's a question.
And now they've changed that.
Everything is prohibited unless expressly permitted, right?
It's starting to feel that way.
But I think with respect to hate speech, there is no federal law against hate speech.
So you are permitted to say whatever you like about me or any other person or group.
You may not like men over 60 with long hair, and you can call me whatever names you like.
And I'm expected as a citizen to have either thin enough skin to take it, or the ability to get to a barber shop to shut you up.
I'll wear the hair and I'll take it.
But we've come to a point now, and there are profound reasons for it, where I think we're in a cult of victimhood.
I think, for example, the Pluralism Project has failed.
That we've taken the view that everybody's views are distinct and precious to such a point that we've created a culture of victimhood.
The snowflakes.
Correct.
It's no longer possible to speak in terms of excellence if you're a white male, because that's white male privilege speaking.
If you are going to talk about human excellence, then suddenly you're saying, well, people who don't share the attributes of excellence are less valuable.
Don't they have rights too?
And aren't you expressing hatred of them?
And in order to make people feel safe and included, shouldn't we prohibit speech that makes others uncomfortable?
The First Amendment says absolutely not.
But the law is evolving in such a way that I suspect within your and my lifetime there will be a new hate speech exception to the Bill of Freedom of Speech.
And here's what it's going to look like.
And I say this because of comments I get from judges at appellate court argument most recently.
at an argument in Connecticut involving a man who may have threatened court clerks.
A judge said, don't we need to do something about this violent speech?
Don't we need to stop it? Isn't social media, hasn't it made too much possible for too many?
And my view is not according to the First Amendment.
You know, Cicero once defined a commonwealth, a publica, res publica, as not just any collection of people, but people bound together by common interests, which we have.
We want roads and safety in the streets, but common conceptions of right.
And right means commitments to public authority, its limits, and what it can and can't do.
I think under our constitutional system, the First Amendment has traditionally protected the right to speak and placed on the listeners the responsibility of an intelligent and sane reaction.
We've now shifted the balance such that listeners' reaction becomes the standard, and the result is going to be, I think, a jurisprudence that's going to look like pornography, litigation does.
You'll recall Justice Potter Stewart saying some time ago that he couldn't define obscenity, but he knew it when he saw it.
And I think some judges are going to say, look, if speech doesn't have discernible social, political, or economic value, According to us, and it's meant merely to inspire, then we're going to limit that because we know hatred when we see it.
I was privileged last... That's a very subjective standard.
It is.
And what it winds up is, the next step is you wind up like China with a social credit system where you... No, you end up like InfoWars and Mark Zuckerberg where, you know, the social, you know, the community standards algorithm says that you're beyond the pale and listeners shouldn't be permitted to hear you on their platform.
And, you know, they occupy a quasi-monopolistic sphere in communications, but they have no First Amendment responsibilities because they're private companies.
Yet they have the 230 exception, which says you're not going to be punished for this because, you know, so you don't have to curate this, right?
Well, we are challenging 230 in a piece of litigation in Connecticut on behalf of a young law student whose speech was taken down.
And our view is if you're going to enjoy immunity from suit under 230, and you're quasi-monopolistic, then you're operating as a constructive public trust.
You're acting in the public interest.
And if you're going to enjoy the immunity, The benefit of immunity that confers the responsibility to apply First Amendment speech.
And just because you don't like the way it makes somebody feel is not sufficient grounds to censor.
Exactly.
They want it both ways.
Well, they do.
And I think, you know, the algorithmic overlords, people on Facebook and Twitter and whatnot, you know, they harvest our data to profit but also for purposes of social control.
And, you know, and so I do believe that, you know, in the emerging debate about artificial intelligence and superintelligence and so forth, you'll recall in 1776 Adam Smith wrote a book called The Wealth of Nations, and it was a powerful polemic about the ability of markets to efficiently allocate resources.
But it did so by way of the invisible hand.
The invisible hand's got a glove on it now.
It's called artificial intelligence.
And the people who control artificial intelligence control what we get to do.
Algorithms aren't neutral.
People generate algorithms.
That's right.
And when we sacrifice our ability to say no to the algorithmic overlords, we let somebody else decide what's efficient.
We end up with the guy in China.
We end up with Infowars, Alex Jones, and Facebook saying to the American public, he's too dangerous to listen.
I'll advance the following proposition.
And I mean it, what I say, and I can prove it in the following way.
Last May, I was given the privilege of addressing the Hartford County Bar Association on Law Day.
It was all judges and powerful lawyers in the state.
And my argument is there is no such thing as hate speech.
People hate what they're afraid of.
And in this country, people are divided and polarized because we're afraid of a world in which we feel that we've lost our place and our ability to control our destiny.
And we act out in ways that others find hatred, hateful rather.
But if you stifle the speech, you increase the fear, you deepen the polarization, and you end up with something like a legitimacy crisis in a civil war.
And in my view, we're very, very close to that point in this country.
You know, in the Northeast where I live, people are apoplectic about Donald Trump.
They hyperventilate all the time.
Look what happened!
Look what, how did we do this?
And my thing is, you know, you're missing the point.
When you make peaceful change impossible, you make a violent change inevitable, right?
Because you've shut down that free speech alley.
You've shut down people's ability to even air their grievances.
Here's what I say to my friends in the Northeast.
You're missing the point about 2016 and you may be missing the point about 2020.
The question is how, you know, the question is not How did Donald Trump get elected?
How did he fool us?
The question is, what conditions made him possible?
Donald Trump speaks to a part of the country you don't see in the mainstream media, flyover country.
I was in Washington, D.C.
We gotta take it, we're out of time.
You're exactly right, because people are, you know, people are so fed up with the speech codes, that it's like, go for it!
If he's gonna let the profanity fly out of these people's face, they like that.
